HomeMy WebLinkAbout2021-09-07 P & Z Minutes - Approved CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the regular meeting of the Planning and Zoning Commission held a meeting on Tuesday, September 7, 2021 at 6:30 p.m. I. CALL TO ORDER The meeting was called to order at 6:30 p.m. Chairperson Linda Broussard-Vickers 1. Roll Call Present: Chairperson Linda Broussard-Vickers Commissioner John Krueger Commissioner David Kubat Commissioner Darrell (DJ) Olson, Jr. Commissioner Les Kuiper Commissioner Richard Nelson Commissioner Nick Twohy Absent: None. Staff: City Administrator Mark Statz Council Liaison, Russ Koski City Attorney, Kurt Glaser II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Motion by Commissioner , seconded by Commissioner Kuiper to Approve the Agenda as presented. All in favor. Motion carried. IV. PUBLIC HEARINGS (6:30 PM or shortly thereafter) 1. Chapter 50 – Garbage and Rubbish Consider regulation of soft-sided dumpster bags 2. Chapter 156.102 – Home Occupations – Consider regulation of home-based auto repair shops 3. Chapter 156.111 – Fences – Consideration of modifications to fence placement related to the front of the home Chairperson Linda Broussard-Vickers opened the public hearing at 6:32 p.m. V. AWARDS, PRESENTATIONS & APPEARANCES 1. None VI. OLD BUSINESS Page 1 of 4 City of Centerville Planning and Zoning Commission September 7, 2021 1. Outdoor Storage in Residential Districts Administrator Statz introduced and provided background on this item. There was discussion on this item regarding if the graphic in the Commissions packet can be entered as part of the City Code. City Attorney Glaser stated legally, only certain images and graphics such as blueprints, including legal points of some sort can be included in City Code. Administrator Statz stated they could hand out the graphic whenever this item is discussed or mail it out with the public hearing notice. It was the consensus of the Commission to have staff and City Attorney Glaser add the language agreed upon in August, as well as definitions for clarity, to the draft and set this item for a public hearing. Motion by Commissioner Kubat, seconded by Commissioner Kuiper to call for a public hearing on this item. All in favor. Motion carried VII. NEW BUSINESS 1. Chapter 50 – Garbage and Rubbish Consider regulation of soft-sided dumpster bags Administrator Statz introduced this item and provided some background information on it. There was discussion among the Commission on this item. Motion by Commissioner Kubat, seconded by Commissioner Kuiper to close public hearing on this item at 8:18 p.m. All in favor. Motion carried. Motion by Commissioner Kubat, seconded by Commissioner Olson to recommend that the City Council adopt amendments to City Code, Chapter 50, related to Flexible or Compact Dumpsters as detailed in the attached suggested ordinance language, removing the license requirement for pick up and editing road right of way requirement to allow for placement of the dumpsters in the right of way, but excluding placement in the actual road. All in favor. Motion carried. 2. Chapter 156.111 – Fences – Consideration of modifications to fence placement related to the front of the home Administrator Statz introduced and provided some background on this item. There was discussion among the Commission on this item. Motion by Commissioner Kubat, seconded by Commissioner Olson to close public hearing on this item at 8:28 p.m. All in favor. Motion carried. Motion by Commissioner Kubat, seconded by Commissioner Kuiper to recommend that the City Council adopt changes to City Code, Chapter 156.111 as noted in the attached suggested code language, allowing fences to be constructed up to the front of the home. Chapter 156.102 – Home Occupations – Consider regulation of home-based auto repair shops Administrator Statz introduced and provided background on this item. There was discussion among the Commission on this item. Motion by Commissioner Kubat, seconded by Commissioner Olson to close public hearing on this item at 8:48 p.m. All in favor. Motion carried. Motion by Chairperson Broussard-Vickers, seconded by Commissioner Olson to recommend that the City Council adopt changes to City Code, Chapter 156.102 as detailed in the attached suggested language with modification to allow personal auto repair based on the findings that this home occupation is objectional because of public safety and pollution control concerns. All in favor. Motion carried. VIII. APPROVAL OF MINUTES 1. March 2, 2021 Planning & Zoning Commission Meeting Minutes Motion by Commissioner Kuiper, seconded by Commission Kubat to approve the Planning & Zoning Commission meeting minutes of February 2, 2021 as presented. Commissioner Nelson and Olson abstained. All others in favor. Motion carried. 2. July 13, 2021 Planning & Zoning Commission Meeting Minutes Motion by Commissioner Kubat, seconded by Commissioner Olson to approve the Planning & Zoning Commission meeting minutes of April 6, 2021 as presented, subject to review of the meeting recording regarding Chairperson Broussard-Vickers vote on the variance request. Commissioner Kuiper and Nelson abstained. All others in favor. Motion carried. 3. August 10, 2021 Planning & Zoning Commission Meeting Minutes Motion by Commissioner Olson, seconded by Commissioner Kuiper to approve the Planning & Zoning Commission meeting minutes of May 4, 2021 as presented. All in favor. Motion carried. IX. Announcements and Updates 1. Council Member Liaison Council Member Koski stated they have approved a maximum of a 3% increase in the tax levy for the City. He noted they have been working with the Fire Steering Committee to create the changes to the fire department. 2. Administrator’s Report Page 3 of 4 City of Centerville Planning and Zoning Commission September 7, 2021 Administrator Statz stated they have been working to keep the development projects moving forward. He stated that he has reached out to contractor’s to receive bids on items that developers have not finished on a timely basis. He noted that if needed, Letters of Credit will be drawn against for this action and payment to contractors. X.
