Pursuant to due call and notice thereof, the City of Centerville held a City Council Meeting &
Closed Executive Session on August 10, 2021.
COUNCIL MEETING
I.CALL TO ORDER
Mayor Love called the meeting to order at 6:30 p.m.

Mayor Love provided an opportunity for others to add or delete any items.
Administrator Statz added Resolution #21-0XX Î Calling for a Public Hearing to Vacate
Easements under Item #3, IX. New Business.
Motion by Council Member Koski, seconded by Council Member Mosher, to Approve the
Agenda as Amended. All in favor. Motion carried.

Mayor Love provided an opportunity for the Council to add or remove any item(s) to/from the
consent agenda.
Motion by Council Member King, seconded by Council Member Koski, to Approve Consent
Agenda as Presented. All in favor. Motion carried.
VIII.OLD BUSINESS
1. Block 7 Î Centra Homes
a. Purchase Agreement
Administrator Statz stated that lengthy discussion has been had regarding this agreement both at
City Council level, with staff and with Centra Homes representatives. He stated that the presented
Purchase Agreement addresses each of the three (3) concerns that Council discussed: project
delays capped at 24 months (ÐForce MajeureÑ clause); property returned to the City if failure to
complete improvements within 24 months (ÐReverterÑ clause); and developer escrowed funds
assuring funding of the Homeowners Association (HOA) due to failure of the project prior to
completion and sale of units (ÐHOA Pre-FundingÑ clause).
Lengthy discussion ensued regarding, Community Development Block Grant (CDBG) Funding,
Letter of Credit (LOC) requirements, market rate/affordable units (two), attempting to save mature
trees on the site, length of term for funding the HOA and associated dollar amount, streetscaping
of $100,000 with overages falling on the City, selling the property for $1 versus providing Tax
Increment Financing (TIF) or other options, purchase agreement requirements/process and
developer agreement requirements/process, lumber prices, etc.
Motion by Council Member Lakso, seconded by Council Member Mosher to Approve the
Purchase Agreement with Centra North, LLC as presented.
Council Member King asked if this items was to be discussed at the Closed Executive Session
scheduled for later in the meeting. Mayor Love stated that a motion and a second have been
received to approve the item and the Closed Executive Session was placed on the Agenda only if
needed to discuss the item further.
Discussion ensued regarding serving the individuals of the City with several of them addressing
the Planning & Zoning Commission and Council with their opposition to the project, difficult
decisions, previous guidelines and policies (Downtown Redevelopment Plan), (Comprehensive
Plan) and Requests for Proposals (RFPs) for the site.

Mayor Love, Council Members Lakso and Mosher voted in favor. Council Members King
and Koski opposed. (3/2) Motion carried.
IX. NEW BUSINESS
1. Peterson Shores
a. Final Plat
Administrator Statz stated that this is a fairly straightforward plat as it is splitting a larger lot into
two (2) parcels for construction of two (2) homes. He stated there was no roads, a DeveloperÓs
Agreement would not be needed, but associated fees (Park Dedication and Storm Water Access)
would need to be obtained from the developer (Mr. Peterson).
Motion by Council Member Koski, seconded by Council Member King to Approve the Final
Plat for Peterson Shores with Authorization to Record the Plat Contingent Upon Payment
of Applicable Fees. All in favor. Motion carried.
2. Ord. #XXX, Second Series Amending Ord. #111, Second Series Fee Schedule
for 2021 (First Reading)
Administrator Statz stated that this was the first reading, the amendments to the Fee Schedule were
outlined in the Council packet.
Mayor Love explained that it was standard practice to have two (2) readings of an ordinance
amendment. Council Member Lakso requested that a review of the format be given as she felt it
was difficult to read. Council Member Koski felt that with two (2) readings if was fostering more
opportunities for the public to become engaged.
No motion was needed at this time.
3. Res. #21-0XX Calling for a Public Hearing to Vacate Easements
Administrator stated that the Council has considered a Preliminary Plat for Sutton Transport. He
stated that there were several easements associated with the Fairview cul de sac that needed to be
vacated. Attorney Glaser stated that the impact is only to Rehbein Properties (owners on properties
abutting the cul de sac. Attorney Glaser stated that the amount of easement is small but the City
is giving up their rights and the Public Hearing was required.
Discussion ensued regarding public education, social media avenues and property returning to the
owner upon vacation.
Motion by Council Member Koski, seconded by Council Member Mosher to Adopt Res. #21-
009 Î Calling Public Hearing for Vacating a Roadway Easement. All in favor. Motion
carried.

X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS
1. AdministratorÓs Report
Administrator Statz stated that he contained in the packet his report and that he would be
glad to answer questions regarding it if Council had any. He stated that he has been meeting
with developers regarding completion of their project without the CityÓs assistance in doing
so with use of their Letters of Credit (LOC). He stated that the deadline that they have
been given is Labor Date.
City Attorney Glaser stated that he was back in court for the first time since the courts were
shut down due to COVID. He stated that the courts are extremely backlogged but it was
very nice to see people and work through contentious cases.
Council Reports

i. Anoka County Fire Protection Council Î No report was given.
ii. Parks and Recreation Committee Î No report was given.
Administrator Statz reported that the Parks & Recreation Committee discussed Movie in
the Park, park maintenance and Main Street Market. He stated that additional discussion
was had regarding accessibility to play structures. Council Member Lakso stated that the
parking lot at Acorn Creek looks great.
b. Koski Î
i. Fire Steering Committee Î Council Member Koski stated that the next meeting
would take place on October 1, 2021 at 7:00 p.m.
ii. Planning & Zoning Commission Î Council Member Koski reported that the
Commission has been working on amendments to Ordinances (Outside Storage,
Home Occupation (automobile repair) and Bagsters/Temporary Dumpsters. He
also stated that the Commission swore in Commissioner Richard Nelson and
welcomed him to the Commission.
c. King Î
i. Economic Development Authority Î Council Member King reported that
committee scheduled a Business Appreciation Event for September 9, 2021 at
LaMotte Park and invited all businesses to attend. He also reported that at the
August 12, 2021 Main Street Market recyclable, logo bags would be available to
customers.
Council Member King asked about the Planning & Zoning Commission regarding outside
storage and why were additional meetings held again. Administrator Statz stated that if

had been approximately a year ago and it never made it to Council due to vacancies, public
input, etc. He felt that Council would be considering it shortly.
Mosher Î
Economic Development Authority Î Council Member Mosher stated that he
hoped that the Business Appreciation event would have a good turnout.
Police Governing Board Î Council Member Mosher report that the Board swore
in new officer, a new sergeant, lifesaving awards, Bola Wraps (instead of use of
atazer) and keeping up with current tools.
Mayor Love stated that discussion took place regarding the budget, tri-city formula and
potential for increased fees as we are growing (call volume and population) and
cablecasting of the meetings.

iii.Fire Steering Committee Î No report was given.
Other Mayor Reports Î Mayor Love stated that due to recent, serious medical issues with his son
he has been unable to attend several meetings. He thanked the public for their prayers and stated
that his son was released from the hospital today. He stated that he will need continued medical
follow-up.

Motion by Council Member King, seconded by Council Member Mosher to Adjourn the
Regularly Scheduled Council Meeting of August 11, 2021 at 8:07 p.m. All in favor. Motion
carried.

Due to staffing levels, TimeSavers was contracted to complete the Planning & Zoning Commission and EDA
meeting minutes. They have successfully filled the City's request to complete all minutes for these committee's
and minutes have been up to date for several months.
TimeSavers is requesting that the City enter into a contract going forward (January 1-December 31, 2022)

RECORDING SECRETARY SERVICE AGREEMENT
THIS AGREEMENT is made between TIMESAVER OFF SITE SECRETARIAL, INC.
(ÐTOSSÑ) and the CITY OF CENTERVILLE, (Ð Centerville Ñ).
Centerville wishes to retain the services of TOSS to act as recording secretary for all regular
Economic Development Authority and Planning & Zoning Commission meetings during the term
of this Agreement, and such special meetings as Centerville shall request of TOSS from time to
time.
IT IS THEREFORE AGREED AS FOLLOWS:
1. Recording Secretary. TOSS shall provide a competent, experienced and professional
recording secretary to transcribe and submit minutes of all Centerville Economic
Development Authority and Planning & Zoning Commission meetings and, as requested
of TOSS by Centerville from time to time, special meetings of its Subcommittees. Minutes
of each meeting shall be prepared and submitted via e-mail to such officer as the City Clerk
may designate from time to time within ten (10) business days after each meeting webcast
is posted.
2. Equipment. Centerville shall provide for each meeting at the meeting site all equipment
required to record the meeting. TOSS shall provide all equipment and materials necessary
to transcribe and prepare the minutes.
3. TOSS Charges. TOSS shall be paid for its services as recording secretary for each meeting
with a one (1) hour minimum, the highest rate prevailing, as follows:
a. Base Rate: One Hundred Fifty-Four and 00/100 dollars ($154.00) for any meeting
up to one (1) hour (billable time) plus Thirty-Six and 50/100 dollars ($36.50) for
each thirty (30) minutes following the first one (1) hour; or
b. Unit Rate: Fifty and 25/00 dollars ($50.25) for the first hour of meeting time and
Thirty-Three and 50/100 dollars ($33.50) for every hour after the first hour plus
Fifteen and 25/100 dollars ($15.25) for each page of draft minutes for submission
to the City of Centerville for their preparation of final minutes.
4. Billing. When TOSS submits the minutes of each meeting, TOSS shall bill Centerville on
TOSS' standard invoice form, which itemizes length of meeting and the number of pages
of draft minutes prepared by TOSS of each meeting. Centerville agrees that it will submit
each TOSS invoice with the next bill list or other applicable expense authorization list to
be considered by the Centerville City Council or the authorizing official of the Council.
5. Term. This Agreement shall become effective on January 1, 2022, and shall continue in
force until December 31, 2022. Either party may cancel this Service Agreement with or
without cause upon thirty (30) days written notice; otherwise, the Agreement shall remain
in force.
6. Delegation. TOSS may, from time to time, appoint one or more persons and delegate its
duties as recording secretary hereunder to its employees. TOSS warrants that any delegates
will meet the minimum standards outlined in Section 1 of this Agreement.
7. No Approach for Hire. Centerville agrees that during the term of this Agreement and any
extension to it, and for a period of six (6) months thereafter, it will not employ, hire,
subcontract with, or otherwise engage as a recording secretary a person or an entity formed
by a person who has acted as a recording secretary of TOSS.
8. Agreement Extension/Modification. At the end of the term of this Agreement or any
extension of it, the parties may make a new Agreement or extend or modify the terms of
this Agreement in writing.
9. Independent Contractor. The parties of this Agreement agree that TOSS is an independent
contractor. TOSS is not an employee of the City and is not entitled to the benefits provided
by the City to its emplo yees, including but not limited to, health, workerÓs compensation
and employment insurance, and pension or employee benefit plans.
10. Indemnification. TOSS shall indemnify the City against all liability and loss in connection
with, and shall assume full responsibility for, payment of all federal, state, and local taxes
or contribution imposed or required under employment insurance, social security and
income tax laws, with respect to TOSSÓ employees engaged in performance of the
Agreement.
11. Compliance with Applicable Regulations. TOSS shall, pursuant to performance, comply
with all applicable rules, regulations, statutes or ordinances of any other unit or agency of
government, including but not limited to those relating to non-discrimination in hiring or
labor practices.
12. WorkerÓs Compensation. TOSS shall obtain and maintain for the duration of this
Agreement, statutory WorkerÓs Compensation Insurance and EmployerÓs Liability
Insurance as required under the laws of the State of Minnesota.

Liquor & Tobacco License Renewals
BACKGROUND AND SUPPLEMENTAL INFORMATION:
On an annual basis the City issues certain licenses (On Sale and Sunday Liquor & Tobacco) and the State of MN issues Off Sale
Liquor). Annual renewal applications are received from the State of MN and forwarded to license holders for completion and fees to
be paid to the city.
The establishments listed below have provided those fees, completed applications, insurance certificates, ensured that their utilities are
current along with their property taxes which is a requirement of the City Code.
Their documentation is then forwarded to the Centennial Lakes Police Department for background checks to ensure that liquor
violations have not transpired over the year (either by the applicant or the establishment).
All CLPD Background Investigations Memorandums are attached for consideration of issuance of associated permits for 2022.

Resolution 21-0XX Submitting a List of Nominees for Open Seat on Rice Creek Watershed District Board
BACKGROUND AND SUPPLEMENTAL INFORMATION:
The seat on the Rice Creek Watershed District (RCWD) Board currently held by Steve Wagamon is up for
appointment. Cities may submit a list of candidates for the county to consider. Each city may submit a list of
at least 3, or cities may "jointly" submit a list of at least 3 candidates. The candidate for this seat must live in
hydrologic area (subwatershed) #4 (see attached map). Several cities that are a part of this subwatershed are
putting together a list to be submitted jointly. Staff is recommending that we endorse and jointly submit this
list, with the other cities involved.
Staff has spoken with several community members to gauge interest, but have yet to find a candidate that we
can put forward.
COST AND SOURCE(S) OF FUNDING:
No direct cost to city. RCWD is a taxing district whose board of managers is appointed by the county.

Business Water Connection Discount Program
BACKGROUND AND SUPPLEMENTAL INFORMATION:
In January, the City Council created a program to offer half-priced hook-up fees to the city's water system for
businesses as a way to support them through the pandemic. There are 14 businesses still on private wells. Staff
has had several inquiries about the program and wishes to clarify and modify the program. Recommended
changes to the program:
- Make pre-paid WAC charges eligible for retroactive reimbursement for businesses that have not yet
hooked-up (this does not apply to assessments paid or lateral benefit fees pre-paid)
- Clarify program eligibility for existing businesses or new businesses in M-1/M-2 zoning districts (downtown)
- Extend deadline to December 31, 2022
- Businesses must actually hook-up to be eligible for discounted fees. Prepayment of fees is not eligible.

TITLE OF ISSUE:
Old Mill Estates Boardwalk Engineering Proposal
BACKGROUND AND SUPPLEMENTAL INFORMATION:
Several weeks ago, the City Council reviewed the situation with the bituminous trail leading from the Old Mill
Court cul-de-sac to Acorn Creek Park. Consensus was that the city would entertain a proposal for a boardwalk
through the wetland in lieu of a bituminous trail along the edge of the lot's yard area if the homeowner picked
up the installation cost. If the council would like to officially make this their position, it would be appropriate
to have the homeowner: enter into an agreement to pay all costs, escrow the estimated costs and grant an
easement over the new trail. After the agreement is signed and escrow received, the city should have the design
work done and solicit bids from contractors. A proposal for the design work is attached for review and
approval. Staff feels that it is best to have the city hire the engineer and contractor and be reimbursed, rather
than having the homeowner contract for these services.
COST AND SOURCE(S) OF FUNDING:
No initial cost to city. Perpetual maintenance to be assumed by city.

This letter outlines the Scope of Services and estimated costs to provide structural engineering services for
a short boardwalk through a wetland area adjacent to Old Mill Court. Our understanding is that the
proposed boardwalk will be 6’ to 8’ wide, approximately 85’ long, and will be constructed on helical piers to
minimize wetland impacts.
The proposed scope of work will generally be limited to the structural engineering components of design
and construction observation for the boardwalk. It is our understanding that the City will provide the
boardwalk layout and site plan, solicit quotes, coordinate geotechnical services, and provide contract
administration for this work. The City will also procure all permits.
Scope of Services
The scope of services for this project will consist of the tasks below.
Task 1 – One virtual meeting/phone call with the City at 60% plan status to review the plans, schedule and
other logistics.
Task 2 – Design / Construction Documents. Stantec will provide boardwalk structural details, railing and
abutment details, and technical specifications, certified by licensed professionals, for the proposed pile-
supported trail. Final project specifications will be written in CSI format and prepared to allow accurate
bidding and expeditious construction. We will also provide a quote form for the City to utilize to solicit
contractor quotes.
Task 3 – Geotechnical Review. Our team will provide the City with the required scope of the geotechnical
services so the City can solicit quotes from geotechnical firms. Stantec will review the geotechnical report
and incorporate its results and recommendations into our structural design. Geotechnical investigation will
consist of a maximum of three soil borings at periodic intervals along the proposed boardwalk alignment.
The prepared geotechnical report will include information related to the subsurface conditions, potential
obstructions, and recommendations for the helical pile installation including pile depths and capacities.
Geotechnical consultant costs are not included in this proposal and will be paid for by the City.

Task 4 – Cost Estimate. Our team will prepare a detailed opinion of probable cost at the Construction
Document stage to confirm that the project documents reflect a project that can be constructed within the
identified budget, subject to variability in the bidding climate.
Task 5 – Construction Services. Our team will review shop drawings and submittals, respond to RFI’s, and
perform 4 hours of on-site project structural observation. The project will include one (1) compression test of
an in-place pile, performed by an approved testing agency. Costs associated with this third-party testing
are not included in this proposal and will be paid for by the City.
Schedule
We can begin this work once we receive authorization. Once the geotechnical analysis is received, we will
provide the structural drawings, specifications, quote form, and cost estimate within 4 weeks. This proposal
assumes that design work will generally be completed in late 2021/early 2022, and construction will occur in
2022.
Compensation
The work will be performed on a lump sum basis for a fee of $7,700 including expenses. This fee is not-to-
exceed without prior authorization. This scope and fee assume that the design/bidding/construction
process will commence from start to finish with no interruption of engineering services.
This letter and scope of services represents the understanding between the City and Stantec in respect to
the Project and may only be modified in writing signed by both of us and is subject to the current Master
Services Agreement between the City and Stantec.

the City in accordance with MN State Statute 429.101. The City has determined to rectify/reimburse itself for
unpaid claims this way rather than through municipal shutoffs relating to sewer/water and garbage/recycling.
These fees are paid through Anoka County Property Taxes for one (1) year unless the assessment was agreed to
be for a lengthier period by special agreement (Street Project, etc.).
By law, due notice to the property owner(s) was forwarded to them on Sept. 17 and a Public Hearing Notice for

INTRODUCTION
Shingle Creek Capital LLC is requesting a rezoning and
Conditional Use Permit (CUP) for the property at 2050
and 2070 Main Street in order to develop a building
supply sales use on the site. The use requires outside
storage of materials, not allowed in the current B-2
zoning, but storage yards are allowed by CUP in the
requested B-1 zoning. Site Plan review by the Planning
& Zoning Commission is also required but not all of the
detailed plans for that review have been submitted.
The requests were heard by the Planning & Zoning
Commission at a public hearing on November 2, 2021.
The recommendations later in this report reflect their
recommendation to the City Council.
PROPERTY
The property involves two separate lots, 2050 and 2070 Main Street. The west lot at 2050 is
occupied by the former Northern Forest Products building, an industrial use. The east lot at 2070 is
vacant. Test borings on that site indicate soil problems and buried debris which must be corrected
before development of the site, even for the outside storage use.
Each lot is about 200 ft wide by 585 ft deep, 2.69 acres each or 5.38 acres total. The lots are much
deeper than many other B-2 lots on Main Street, which are generally 125-250 ft deep, as seen on
the land use and zoning maps later in this report.

PROPOSED PROJECT
The proposal by Shingle Creek
Capital would use the existing
41,000-sq-ft building on the west lot,
converting it for use by the building
supply company, as illustrated at
right. The front of the building would
have a small retail showroom and
the rest of the building would be
used as warehouse space for the
building materials and supplies. The
front of the west lot would be
customer parking. Most of the east
lot and a small part of the west lot
would be Ñstorage and staging
areaÒ, meaning outside storage of
products and materials. The entire
staging/storage area would be
fenced. Identifying these storage
areas clearly on the site plan is one
of the conditions from the Planning
& Zoning Commission
recommendation.
The project would use the two
existing curb cuts off Main Street for
access.
There is an existing retention pond at
the south end of both parcels which
would remain. A small pre-treatment
pond would be added between the
outdoor storage lot and the existing
pond.
The proposal would change the use
of the property from its existing
industrial use to a general
commercial use, but not to Main
Street retail use as the City has
hoped for.

PLANNING AND ZONING
The property is guided Commercial in the 2040 comprehensive plan and was recently rezoned to
the newly created B-2 Main Street Commercial district, along with other properties fronting Main
Street in this area, as illustrated on the maps below.
The intent of the B-2 district is Ñto provide opportunities for attractive retail and service business
uses along CentervilleÔs Main Street appropriate for a high visibility community commercial
corridor.Ò This is in contrast to the previous B-1 district, intended to Ñprovide opportunities for retail
and service business uses which require larger development sites, highway visibility or highway
access.Ò

ÑBuilding supply sales and storage yardsÒ are allowed by CUP in both the B-1 and B-2 districts, but
Ñwithin building onlyÒ in the B-2 district. The proposed use needs B-1 zoning to operate with its
storage yard for materials and supplies.
Surrounding uses include Rumble Motor Sports (motorcycle sales and service) to the west, ADL
Auto Repair, and Noble Welding & Manufacturing to the east, none of which are typical Main
Street retail uses. Across the pond to the south is the CityÔs industrial park. Across Main Street to the
north is MidWestOne Bank, the future Kwik Trip gas station, and a vacant commercial site in
Rehbein plat, all of which are zoned B-2.
The portions of the zoning map below show what the pattern of zoning in the area is now and
what it would be if the requested rezoning from B-2 to B-1 is approved.
SITE ISSUES
Soil Correction
The applicant notes that there are Ñsubsurface environmental conditionsÒ on the east lot
that make it difficult and expensive (or unlikely) that a building could be built on that lot.
Therefore, its use as outdoor storage and parking is logical and reasonable at this time.
Lot Depth
As noted above, the parcels are deep north-south, about 585 ft total with about 450 ft of
usable space north of the pond. This is fairly deep for typical retail lots and much deeper
than many of the other B-2 lots on Main Street. Smaller retail sites typically rely on close
visibility and access, making it less likely that a site this deep could attract a small retail use.

Main Street Median
Site access is only to Main Street via the two existing curb cuts. There is a raised median in
Main Street which allows only right-in/right-out movements to the site, also posing a
challenge for typical retail users that rely on full, quick, easy access.
CONDITIONAL USE PERMIT
A CUP would be considered by the City Council only if the rezoning is approved. Otherwise, the
requested use with outside storage is not allowed in the current B-2 zoning district. If the Council
votes to deny the rezoning, the CUP is a moot point, since the identified business cannot make use
of the site without outside storage.
CUP Criteria
The Centerville zoning code has criteria for reviewing a CUP in Section 156.320(B)(2). The
applicants respond to these criteria in their narrative Ï that the use is necessary, desirable, and will
contribute to the public welfare; that the use will not have adverse impacts on adjacent property;
and that the proposed use will permit development and use of neighboring property.
Outside Storage
The Site Plan shows three separate staging areas on the outside storage portion of the site and
details the floor area of each part of the building use:
Main Floor Showroom: 1,801 sq ft
Office 2,140 sq ft
Warehouse: 37,179 sq ft
Total: 41,120 sq ft
The plan notes the square footage of the staging areas as 61,654 sq ft, about 1.5 times the area of
the building. which is the standard in the B-1 district for the size of outside storage areas relative to
the building. The identified storage area excludes space in the middle of the site for loading and
circulation, i.e., truck movements in and out of the site.
Parking
The site plan proposes 21 customer parking spaces, including 2 handicapped spaces as required
by ADA, for the retail showroom of about 2,000 sq ft, or 10.5 spaces per 1,000 sq ft, which is more
than adequate.
Site Access
Site access will from the two existing driveways off Main Street, the west drive for cars, the east
drive for trucks accessing the storage yard. Because of the raised median in Main Street, only
right-in/right-out access is possible. Cars coming from the east on Main Street can make a U-turn

at 20 Avenue to get into the site. Large trucks coming
from the east would use a circuitous route Ï a loop from
st
westbound Main Street to 21 Avenue to Commerce
Drive to eastbound Main Street, then a right turn into
the site, as illustrated to the right.
Landscaping
The landscape plan indicates 15 new spruce trees, two
new maple trees and one existing tree to be saved,
illustrated bottom right. All other areas of the site outside
the building, parking and storage area should be
seeded or sodded with an appropriate ground cover.
The staging/storge area is to be enclosed with a 6-ft
fence, but no other details are provided. The entire
storage area must be screened from the right-of-way
and adjacent properties. An earlier plan showed shrubs
in the narrow buffer strip between the front parking lot
and the staging area access, but that is left blank on
this later plan. That area would be part of the required
screening of the storage area.
Lighting
The narrative notes that lighting will be added in the
staging/storage area, but a lighting plan was not
submitted. All lights must be downcast, cutoff type
fixtures that allow no more than 0.5 footcandle onto the
public right-of-way of Main Street.
Paving
The staging/storage area is to be paved. Such paving
will be designed to meet the stormwater and
engineering standards of the City.
Building Materials
The narrative and sketch elevation notes that the front
end of the building near Main Street will be renovated
but no detailed building elevations, plans, or material
specifications were submitted.

Trash Handling
Trash handling will be inside the building as indicated on the landscape plan.
Signage
Additional signage is noted in the narrative and on the sketch front elevation. A signage plan must
be submitted which conforms to City standards for the B-1 district.
ANALYSIS
The City of CentervilleÔs vision for Main Street moves away from industrial and general commercial
uses to smaller retail uses. The property at 2050/2070 Main Street is a former industrial use now
zoned B-2 Main Street Commercial. Given the challenges to developing this site, an intermediate
solution might be reasonable. This approach can be summarized in the following points:
1) The proposed use for building supply sales needs outside storage in a storage yard.
2) Outside storage is not allowed in the current B-2 zoning, which is the rationale for rezoning
to B-1 which allows outside storage.
3) The intent in creating the B-2 Main Street district was to have more attractive Main Street
retail and not large highway oriented uses like the proposed use for building supply sales
with a large outdoor storage yard.
4) The lots at 2050 and 2070 are deeper than many typical retail site, unlike many of the other
parcels nearby along Main Street.
5) The median on Main Street poses a challenge for quick, easy access for Main Street retail
on this property.

6) The applicants note that the east lot needs soil correction and cleanup. This suggests that it
would be hard for that lot to develop with small retail uses at any time, since it is not easily
buildable. It may be more suited to parking or storage long term.
7) The proposed use will be an improvement over the existing state of the property and a
significant investment, but not all the way to the Main Street retail vision the City has.
8) The conditional use permit can narrowly define how the outside storage will appear and
perform, restricting other unwanted commercial uses, such as auto sales lots. Outside
storage must be completely screened and this process is subject to a Site Plan review.
OPTIONS
1) Approve the rezoning to B-1 as requested. Approval of the rezoning allows the use to
develop with a minimum of confusion, but incrementally moves the CityÔs Main Street
vision forward. As a condition of rezoning to B-1 and granting a CUP for outside storage,
the City could plan to rezone the property back to B-2 in the future, leaving the proposed
use non-conforming. However, this non-conforming outside storage could be passed on to
future users through ÑgrandfatheringÒ.
Staff and consultants recommend this option.
2) Deny of the rezoning to B-1. The City has considerable discretion in zoning and rezoning
decisions, and the City could wait for the next proposal on the property. However, the
property has been vacant for some time and considering the many challenges facing this
property it may be many more years before a viable proposal for a Main Street
commercial use is offered.
3) Zoning amendments to allow the proposed use. This would require the application to be
delayed at least another month while that new language is prepared and reviewed by
the staff and Planning & Zoning Commission, and then approved by the City Council.
4) Create a new zoning district. A new district could be created for this parcel Ï perhaps a B-
3 district Ï that would blend some aspects of B-1 and B-2 allowing the outdoor storage for
a building supply use as proposed, but leave out other objectionable uses, such as car lots,
etc. This too would require the application to be delayed at least another month while that
new district language is prepared, reviewed, and approved.
Staff recommends Option 1 to transition this property from its current industrial use to the long-term
vision of a Main Street retail use. The project would be approved in conjunction with a Conditional
Use Permit that would allow the outside storage but limit other uses that would move the property
further from the Main Street vision.

Conditional Use Permit
If the rezoning is approved, then a CUP could follow to allow the outside storage along
with reasonable conditions related to other site features. There are details missing that
would allow the City to develop full conditions, plus Site Plan review will be required by the
Planning & Zoning Commission at some point.
RECOMMENDATIONS
Approve Rezoning B-2 to B-1
I recommend approval of the rezoning of 2050 and 2070 Main Street from B-2 to B-1 provided the
applicant also secures a conditional use permit for the proposed use. This was also the Planning &
Zoning Commission recommendation on November 2.
Findings of Fact Ï Approval of Rezoning
1) The property at 2050 and 2070 Main Street is zoned B-2 Main Street Commercial.
2) The current use of the property is industrial in nature.
3) The depth of the lots, subsurface environmental conditions on the property, and right-
in/right-out access to Main Street make it difficult to develop the property with small retail
uses as envisioned for the B-2 Main Street Commercial district.
4) The proposed use will be an improvement over the existing state of the property and a
significant investment but not all the way to the Main Street retail vision the City has.
5) The proposed rezone to B-1 will allow a transition of the existing industrial use of the
property and structure to a commercial site as envisioned for the B-2 Main Street
Commercial district. After the new, transitional use is established, the property will be
rezoned back to B-2 to ensure the eventual transition of the property to a commercial use,
and promote uniformity among the neighboring properties.

Denial of Rezoning
Should the City Council deny the rezoning, the following findings of fact might be considered:
Findings of Fact Ï Denial of Rezoning
1) The property at 2050 and 2070 Main Street is zoned B-2 Main Street Commercial.
2) The current use of the property is industrial in nature.
3) The intent of the City in the B-2 Main Street Commercial zoning district is to provide
community scale retail commercial uses, not highway oriented uses or uses that require
warehousing outside storage.
4) The requested rezoning would allow for uses, including outside storage, that are
inconsistent with the CityÔs vision and desire for this portion of Main Street.
Conditional Use Permit
I recommend approval of the conditional use permit with the following conditions, which reflect
the Planning & Zoning Commission recommendation on November 2:
1) Complete a site plan review process for outside storage.
2) The entire property, including the building, storage and staging area, and loading and
circulation area shall only be used for building supply sales as described in the application
and depicted on the submitted plans, including the revised Site Plan dated 11-4-2021 and
covered by this conditional use permit.
3) All goods, materials, and supplied must be stored with the building or within the screened
storage and staging areas identified on the revised Site Plan dated 11-4-2021.
4) The storage area must be completely screened from adjoining properties and rights-of-
way, including a double row of evergreen trees at the site perimeter and dense shrubbery
between the customer parking lot and the staging area, to be reviewed and approved by
the city planner and city engineer.
5) All outdoor storage and staging areas must be maintained and kept in an orderly
condition within the areas identified as Staging Area on the revised Site Plan dated 11-4-
2021.
6) All parking shall be managed on site and all customer parking shall be located within the
customer parking area located adjacent to the existing building.

7) Two handicapped parking space, including at least one van accessible parking space per

Commission and City Council.
9) All lighting on site, whether existing or new, shall be downcast cutoff type fixtures that allow
no more than 0.5 footcandle onto the public right-of-way of Main Street, with a detailed
lighting plan and fixture specifications submitted for review by the Planning & Zoning
Commission and City Council.
10) Paving of all surfaces on site shall be submitted with detailed plans for review by the
Planning & Zoning Commission and City Council and reviewed and approved by the city
engineer.
11) Stormwater handling on site and design of the pretreatment area shall be submitted with
detailed plans for review by the Planning & Zoning Commission and City Council and
reviewed and approved by the city engineer.
12) All engineering and infrastructure issues shall be reviewed and approved by the city
engineer.
13) All signage on site, whether existing or new, shall be submitted with plans for review by the
Planning & Zoning Commission and City Council and reviewed and approved by the city
engineer.
14) The design of the exterior building remodeling, including materials and colors, area shall be
submitted with detailed plans for review by the Planning & Zoning Commission and City
Council.
15) Trash handling will be completely within the enclosed building or an approved trash
enclosure submitted with detailed plans for review by the Planning & Zoning Commission
and City Council.
16) The conditional use permit is contingent on the sale of the property to Shingle Creek
Capital LLC.
17) Include standard conditions for CUP enforcement and compliance.
Since a conditional use is a permitted use to which reasonable conditions may be attached,
denial of the CUP is not recommended. Rather, the City Council should craft conditions that
address reasonable issues that can be accomplished by changes to the site or building plans.

Existing Conditions: There are two parcels associated with subject concept plan, and each
parcel is of equal size and dimension. The parcels are located south of
Main Street with approximately 400-feet of combined frontage. There
are two existing curb cuts on the site which will remain and may need to
be expanded. The east parcel is vacant with approximately 8,750 SF of
bituminous driveway that serves and connects to the improvements on
the west parcel. The west parcel is developed with the existing Northern
Forest Products building which has a footprint of approximately 41,050
SF. There is an existing parking lot and staging area comprising
approximately 23,300 SF. There is a large stormwater pond along the
southern edge of the site that provides stormwater management to the
subject parcels and the neighboring parcel to the west (Rumble
Industries). In general, the property has deferred maintenance and

Summary of Request:
Shingle Creek Capital is under contract to purchase the Subject Property and plans to reuse the
existing building, provide tenant improvements including exterior and interior modifications, and to
develop the adjacent east parcel for expanded staging/circulation area to support the proposed user. The
existing building is made up of a common entry/office space on the main floor fronting Main Street,
private offices on the second floor, and approximately 36,888 SF of attached warehouse space. The
building is characterized as general business/warehouse space.
Shingle Creek Capital is working with a national building material and supply company that intends
to use the existing building with proposed improvements to relocate its from
Minneapolis to Centerville. Exterior expansion of the parking/staging area is needed to allow for efficient

Uses, subsection (B) identifies a set of stated criteria to grant a CUP. We offer the following support and
findings for your consideration.

desirable to provide a service or facility which is in the interest of the public convenience and will
contribute to the general welfare of the neighborhood or city;

maintenance and repair and the site could benefit from extensive soil correction and site cleanup.
If a CUP is granted, we will clean up and remediate soil issues so that the east site becomes
buildable, and we will provide tenant improvements to both the exterior and interior of the existing
building making it an attractive contributor to the Main Street corridor. The retail showroom will
allow residents and local businesses the opportunity to patronize the building and the site
activating the property once again.
(b) That the proposed building or use will not have a substantial or undue adverse effect upon
adjacent property, the character of the neighborhood, traffic conditions, utility facilities and other matters
affecting the public health, safety and general welfare; and

Shingle Creek Response: The existing condition of the building and site create an adverse impact
on adjacent properties and uses since the site is in disrepair and is inactive. The proposed use will
and objectives for the Main Street corridor. The retail component of the operations will face Main
Street and dedicated customer/retail parking will be visible and accessible to Main Street. A
Street improving the character of the frontage making it more compatible with adjacent users.
(c) That the proposed building or use will be designed, arranged and operated so as to permit
the development and use of neighboring property in accordance with the applicable district regulations.
Shingle Creek Response: The footprint of the existing building will not be modified or enlarged. The
improvements to the expanded staging area will allow for extensive soil corrections bringing the
stability of this area up to structural standards. The staging area improvements will include paving,
permitter fencing, lighting, and landscaping. Moreover, all improvements will ensure a viable retail
pad could be developed in the future on this lot. Adjacent property owners have similar lots sizes
and configurations comparted to the Subject Property, so the proposed use will not adversely
impact the surrounding area.
Benefits of Approving the Rezoning and CUP for the Subject Properties
Rezoning the property to B-1 will allow the existing building to reused by a business that will help
transition the corridor to more permanent general commercial business use. The CUP will ensure that the
operations are consistent with the City Code, that the building is reused and improved, and that the site
remains a commercial use. We offer the following benefits to consider:
Site will once again become active and will transition to a general commercial business use. The
existing mixed-use building provides the perfect layout and amount of space for our tenant. The
user is a national building material and supply sales company with primary business lines including
roofing, siding, windows, and a wide variety of related products. The activity on site will include:
o Business-to-business sales.
o Showroom for will-call sales and general public.
o Dedicated second floor office space for employees: sales personnel, territory managers,
and other administrative and management functions.
o The existing warehouse and storage space will allow for stacking and storing of inventory
that is kept onsite.
o After necessary soil corrections, the expansion of the bituminous area will allow for
loading and staging of the supplies. Activity in the staging area and yard will occur daily,
and the site will be active throughout the year.
Reuse and improvement of the existing building for a commercial general business use is
optimal The existing building needs
improvements both inside and out. The structure is functional, but aspects are outdated and

beyond their useful life. To make this building useable, marketable, and attractive for the new
user we intend to:
o Fully renovate the north end of the building with Main Street frontage to create a
showroom for the public and sales staff use.
o Refresh the existing offices on the second story to be used by administrative staff and
territory managers.
o Address deferred maintenance by replacing the tired roof. Modernize the warehouse
space with new electrical and HVAC to create a functional space where product can be
stored.
Improve the site for both function and appearance. There is a retail/office component to this use
so appearances matter. Some of the intended site work includes:
o Creating a friendly building entrance by adding add a modern awning, painting aspects of
the façade, adding new decorative lighting and signage.
o Landscaping and buffering will be concentrated on the frontage of Main Street. The
staging area will be screened by landscaping, and the staging area will be fully fenced for
security.
o Customer parking will be clearly marked and striped. Delivery trucks will have a separate
entrance from customers and staff.
o Staging areas will be fully fenced for security, and landscape improvements will be placed
exterior of fencing.
o Stormwater will be managed consistent with the RCWD regulations, and we intend to
work collaboratively with the City and RCWD on the best solution given the challenging
site conditions.
Consistency of Zoning, Use, and CUP will create clarity and consistency for the long-term vision
of the site. The rezoning will ensure the permanent transition to a commercial general business
operation. The B-1 Zoning District permits Building Supply Sales and Storage Yards with a CUP, but
does NOT permit any other uses with outdoor storage/sales areas. You can be confident that
unless changes are made to City Code standards for B-1, the only type of user for the site with
outdoor storage/staging is a Building Supply Sales company.
Site specific benefits of Rezoning and CUP:

Conclusion and Summary

The rezoning will take effect upon the transfer of the Subject Property from Devereaux Family, LP
to Shingle Creek Capital, LLC or its assigns
The CUP is approved for the use as a Building Supply Sales and Storage Yard. No other uses are
permitted without an amendment to the CUP.
The Property must remain as two separate parcels, but the CUP must be recorded against both
parcels.
The Applicant has twelve (12) months from approval to pull all necessary permits and commence
construction of the proposed improvements.
The final site plan must be reviewed and approved by the City Administrator before any site work
may commence.
A grading and erosion control plan must be submitted to the City Administrator/Engineer for
review and approval prior to any site work commencing.
The final landscape plan must be reviewed and approved by the City Administrator. A mix of
deciduous and conifers is required to ensure adequate screening of the expanded staging/storage
area.
The landscape buffer on Main Street must be maintained in good repair and health as long as the
CUP is active.
A 2-year landscape guarantee for the identified trees must be provided.
The outdoor staging areas must be maintained and kept in an orderly configuration. No storage
of any materials not directly used or distributed by the Building Supply company may be kept
onsite.

Skating Rink Lighting Proposal
BACKGROUND AND SUPPLEMENTAL INFORMATION:
Last week, the Parks and Recreation Committee recommended approval of a proposal to install two poles, each
with two LED flood lights to better illuminate the skating rink (Pleasure Rink) at LaMotte. This rink is well
used and more reliably has ice ready for skating earlier and later in the season than the hockey rink. It is
currently lit with only two lights, both from a fair distance away, making for less than desirable illumination.
The Committee is not recommending replacement of the bulbs on the Hockey Rink Lights at this time. Costs
for this were shown in the proposal, but energy savings may not be realized due to lower usage of lights than
assumptions used in the quote. These additional lights are on the Parks Capital Improvement Plan (see
attached).
This is the second of two quotes gathered for the work. The first was substantially higher.
