They are applying for a Conditional Use Permit (CUP) and Site Plan approval for a mini-storage use but the building could also include other types of businesses. The request was heard at a public hearing at the February 1 Planning & Zoning Commission. The public hearing continued to this March 1 meeting for further consideration. As noted previously, the intent is to attract small businesses, people who have recreational vehicles or other large vehicles to store, and similar uses. Storage of food trucks might be a potential use, but not cooking or selling food on site. Auto mechanics, car painting, and similar work would not be allowed either. The project is proposed as 16 units of 1,300 sq ft each in two buildings, for a total of 20,800 sq ft of building. Please refer to my February 1, 2022 planning report for other background on the project and property. PLANNING AND ZONING The property is guided Industrial in the 2040 comprehensive plan and is zoned I-1 Industrial Park. th Adjacent zoning is B1 Commercial across 20 Avenue to the west and Industrial on the other three sides. Properties to the south and west are occupied with businesses; properties to the north and east are currently vacant. March 1, 2022 Centerville Planning & Zoning Commission Page 2 of 5 RE: Max Storage Ï Conditional Use Permit, Site Plan CONDITIONAL USE & SITE ISSUES Uses The I-1 Industrial Park district includes the following uses, among others: ÑMini-storageÒ is allowed as a Conditional Use. Mini-storage is not defined in our code. A dictionary definition says itÔs a building with individual storage units to be rented or leased. This fits what is being requested. ÑWarehousing/distributionÒ is a Permitted Use in I-1, which would typically mean one business, not storage for many individual businesses in different units. Mini-storage, with individual units, by CUP is how we are processing this request. Permitted uses in I-1 include offices Ï Business and Professional Office and Construction Trade Offices Ï as well as car wash, construction yard, machine shop/repair (inside building), research, and storage accessory to a Permitted Use. There are many other Conditional Uses allowed in I-1, including manufacturing/processing. Retail sales and residential uses are prohibited in the I-1 district. As suggested previously, the uses allowed in the units will need to be carefully screened for uses that might need a CUP and to avoid parking problems. Landscaping th Avenue are The overhead doors facing 20 considered loading facilities that need to be screened from view of the street. The landscape buffer in the SW part of the site has been widened to 9 ft to allow landscaping as we suggested, with a row of spruce trees intermixed with lower shrubs, as illustrated to the right. Parking Parking is provided in 43 spaces striped on the outside edge of the site opposite each building. The project proposes 20,800 sq ft of building, which would require a minimum of 42 spaces for storage uses at 2 spaces per 1,000 sq ft. Parking should be adequate unless there are more intense uses that lease the space. Each of the units can also park four or more vehicles inside. March 1, 2022 Centerville Planning & Zoning Commission Page 3 of 5 RE: Max Storage Ï Conditional Use Permit, Site Plan Lighting Wall-mounted downcast fixtures are proposed on both sides of both buildings and between the buildings. The specs shows that light will be less than 0.5 foot-candle out a distance of 30 ft from the building, which is adequate. There are no lights proposed on ends of the buildings Ï the north and south sides Ï which could pose a problem, especially on the south side where there would be a very dark hole at the back of the site. I suggest lights be added on both north and south sides, also downcast cutoff type fixtures. Building Materials The building materials are the same as proposed previously Ï split-face concrete block on the lower part of the building and smooth on the upper part of the building with an asphalt shingle roof. The materials are acceptable. Trash Handling No outdoor trash cans or dumpsters are proposed. Trash will be handled inside each individual unit or within an approved enclosure on site of the same materials and appearance as the building. Signage Signage will be applied for at a later date. We would stipulate that it meet the CityÔs sign standards. For the industrial district the standards are: Wall signage: 10% of building wall area Ground sign: 200 sq ft, 15 ft height maximum, 15 ft setback Area identification sign: 64 sq ft, 20 ft height maximum, 10 ft from street ROW Directional signs allowed Engineering/Infrastructure Issue Engineering and infrastructure issues are reviewed in a separate memo from the City Engineer. March 1, 2022 Centerville Planning & Zoning Commission Page 4 of 5 RE: Max Storage Ï Conditional Use Permit, Site Plan Rental vs. Ownership The units are presented now as rental or lease, but it is possible the buildings and property could be converted to condominium ownership in the future, as is not uncommon (the property immediately south of this parcel, at 2005 Gateway Circle, is a condominium with two owners in one building). The CUP runs with the land, but if there are multiple owners on one parcel of land it is not clear how the City might handle this, should one of the units need its own CUP. This warrants further discussion. RECOMMENDATION I recommend approval of the Conditional Use Permit and Site Plan for Max Storage as depicted on the plans submitted with the following conditions: 1) Uses permitted within the units on site are storage inside the building or any Permitted Use in the I-1 zoning district. 2) If a use is proposed for any unit that is allowed by Conditional Use Permit (CUP) in the I-1 zoning district the property owner will need to apply to the City for a CUP on their behalf. If approved, any conditions attached to that use will run with the land and the CUP that is recorded with the property. 3) The property owner will notify the City of any change in use in any of the units and a determination will be made if the use is permitted or not. If permitted by CUP, as noted above, then the CUP process must be followed before that user can occupy the unit. 4) All goods, materials, and equipment must be stored completely within the enclosed buildings. No outside storage is allowed, except for vehicles owned and used by the tenants or owners of the units which may be parked overnight in approved parking spaces. 5) No residential use or living in the units overnight is allowed. 6) Parking on site will be managed by the owner. Parking is allowed only on the designated sites on the approved site plan. No parking is allowed on the City streets or in the drive aisles on site. If there are parking problems on site, as determined by the City Council, the City reserves the right to review and potentially revoke the CUP for the property until a solution can be reached acceptable to the City Council. 7) All trash handling will be inside the buildings. If outside trash cans or dumpsters are to be proposed they must be enclosed within a structure of similar material and appearance as the buildings, to be reviewed and approved by the City Engineer. 8) No outdoor sales or display of goods or materials is allowed. March 1, 2022 Centerville Planning & Zoning Commission Page 5 of 5 RE: Max Storage Ï Conditional Use Permit, Site Plan 9) Cooking of food, other than for the personal consumption of tenants of the buildings is not allowed on site, and no sale of food to the public is allowed on site. 10) All service or repair of vehicles and equipment must be conducted completely within the enclosed buildings, and then only for vehicles and equipment owned or leased by the tenants in the course of their business. Vehicle repair or maintenance for non-tenants is not allowed. 11) The lighting plan will be revised to add lights at the north and south ends of the building, for review and approval by the City Engineer utilizing all downcast cutoff type fixtures that allow no more than 1 footcandle of light spillage over the property lines. 12) Signage for the building and site will be applied for separately, to be reviewed and approved per City sign standards. 13) If any of the individual storage units are converted to condominium ownership the City will require a plat of the property to reflect the new ownership and reserves the right to review and approve the association documents. This will need further exploration and discussion. 14) Users of the Subject Property will produce no noise, vibrations, air pollution, light pollution, fire hazards or noxious emissions which will disturb or endanger neighboring properties. 15) Users of the Subject Property will create no act of public nuisance or disorderly conduct, as defined pursuant to the CityÔs Code of Ordinances or pursuant to State Law. 16) Users of the Subject Property will follow the applicable standards and requirements of the City of Centerville City Code, Rice Creek Watershed District, Anoka County, Army Corp of Engineers, Federal Emergency Management Agency, Minnesota Department of Natural Resources, and any other agency having jurisdiction over the Subject Property. 17) Landowner and Users will obey all laws and regulation necessary to operate a business on the Subject Property, and will obtain and maintain, in good standing, all licenses or permits necessary to operate this type of facility. 18) The Landowner is responsible for all of the conditions set forth in this Permit. 19) In addition to all civil penalties and remedies for violation of this Permit, violation of this Permit is a misdemeanor criminal offense. 60-DAY RULE The applications for CUP and Site Plan were received on January 5, 2022. Final deadline for action by the City per Minnesota Statutes 15.99 on both requests was March 7, 2022, which the City extended an additional 60 days to May 6, 2022. Landscaping The landscape plan includes 23 spruce trees in a double row at the front of the site on Main Street, three new maple trees and one existing tree to be saved. All other areas of the site outside the building, parking and storage are seeded or sodded with ground cover, and areas near the front of the building are landscaped with shrubs and flowers. The narrow stripe between the parking lot and staging area is preserved with added landscaping. See graphic to the right. Fence The front and east side of the site will have an 8-ft- high fence of Trex (plastic simulating wood) to provide additional screening, illustrated to the right. This will enclose the entire storage/staging area. Lighting Lighting is proposed on site with six light poles and a wall-mounted fixture. The submitted lighting plan shows less than 0.5 foot-candle going beyond the site on the Main Street side and about 1 foot-candle to the east onto the adjacent commercial property. Signage The narrative and building plans note a wall sign on the front (north) side of the building which will be detailed later and applied for, following City signage standards. Building Materials The existing building will be enhanced with black metal details, some existing, some new, as described in the narrative and on the architectural plans. Per the requirements of the CUP conditions, the civil plan set, and the Site Plan shown as 2.0 is consistent with the Site Plan dated November 4, 2021 that shows an expansion of the pavement area onto the easterly parcel. We are working with the RCWD and the City through the stormwater permitting process, which may impact a small strip of paved surface area along the southern edge of the storage area (~3,500 SF gray shaded area on civil plans). Our engineers have prepared a treatment basin in this area as a “worse case scenario” if the existing pond cannot be used for full stormwater compliance. Additional stormwater modeling is in progress and will be available by City Council review on March 9, 2022 and a final determination regarding this strip of land will be made prior to final plans being approved. Summary of Landscape Plan (Sheet L1.0 and L1.1) Conditions #4, 8 Sheets L1.0 and L1.1 show the proposed landscape plan for the site. As shown, the proposed screening plan along Main Street includes a combination of vegetation, berm and composite fence. On the easterly site to fully screen the storage area an 8-foot composite Trex fence will be constructed on the approximately 3-foot-high berm. (See attached detail regarding Trex Fence, color TBD). In front of the fence and berm two rows of staggered evergreen trees will be installed and will wrap around the eastern property line approximately 30-feet to screen storage area from the sidewalk along Main Street. Additional perimeter landscaping around the building at the main entrance, along the full building façade along main street and wrapping around the west building elevation is provided. The landscaping at the entrance is intended to enhance the sense of entry that will include a new canopy and sign to reinforce the public/retail entry from Main Street. Additionally, the Trex Fence will line and gate the retail and employee parking lot area and will be further enhanced through extensive landscaping along the island on the eastern side of the parking area. A mix of deciduous and evergreen shrubs as well as perennial plans are proposed to add variety, and visual interest year-round. Stormwater Plan (Sheet 2.0, SW1.0 through SW1.5) Conditions #11, 12 We are continuing to work with the RCWD and the City to obtain necessary permits for the proposed improvements. During the CUP process in November a small pretreatment area was identified adjacent to the existing pond on site. After we completed additional due diligence including soil borings, obtaining pond elevations and preliminary stormwater modeling we believe that the pretreatment area may not be Page 3 of 4 Application for Site Plan Review 2050 and 2070 Main St, Centerville February 22, 2022 needed because the existing pond was over built and has capacity to manage the expansion area. We are in the process of performing additional stormwater modeling and will finalize the stormwater plan, which we are confident will demonstrate that no additional treatment on-site is necessary. Preparing for the worse-case scenario, we have designed a pre-treatment area that is included in our plan set and will be revised based on the outcome of the modeling. Architecture and Signage Conditions #13, 14 and 16 Sheets a200 and a201 identify the proposed exterior improvements. To reinforce the retail/employee entry from Main Street a large canopy/awning is proposed and is shown on Sheet a201. The proposed awnings are steel with vertical black corrugated metal siding, any exposed steel braces or framing will be painted black to create a uniform appearance. As noted on Sheet a200, all existing metal details including flashing, doors, frames will be painted black to match the new window casing and muntin detailing on the Main Street elevation. All downspouts will be replaced with new black metal downspouts and all cap flashing will be replaced with prefinished black metal. The proposed signage shown on sheet a201 on the North Enlarged Elevation is for reference only, and we propose that the user must obtain a separate sign permit once final design is known. Outside Storage Plan Conditions #1,3, 5 The Outdoor Storage Plan exhibit is provided to demonstrate the area where storage may occur on-site. This plan is consistent with the plans reviewed as part of the CUP approval process. As mentioned in previous sections, if the pavement area is expanded south then the staging area will be adjusted accordingly. City Planner Carlson stated he thinks they can do just as Administrator Statz stated and simply put conditions into the CUP that would apply to specific and certain areas within the property but they would want to confer with the City Attorney to be sure. Applicants, Chad Anderson and Nam Ly addressed the Commission. Mr. Anderson stated both him and Mr. Ly have small business backgrounds. He stated he runs a food truck and has been a tenant of a mini-storage facility in White Bear Lake where he resides and they see a need for this type of business in Centerville. Mr. Ly stated they plan to have a rigorous interview process, be good stewards of the community and ensure tenants operate in accordance with the City ordinances. Mr. Anderson stated he will be onsite managing the property and handling the tenants on a daily basis. He stated they did over a year of market research to figure out what they like and donÓt like about the mini-storage facilities in the area and they found they favored the Waconia location. He noted they do not intend to allow the space to be used as man caves or for hanging out like some places do; they plan to just use it as a storage facility. Chairperson Broussard-Vickers called for any public comments on this item. No one wished to address the Commission at this time. Commissioner Krueger stated he thinks it is a good place to have in the City and is interested to see the plans they have for lighting and fencing once they are ready for review. Administrator Statz stated they will work with the consultants to review the landscape plan with Mr. CarlsonÓs proposed items in mind. City Planner Carlson stated according to the code a yard is in the setback and it states if the loading dock is adjacent to the street it must be screened so those are things they will take into account when reviewing the plans. Commissioner Kubat stated it seems well suited for the space. He stated he is only concerned about the use itself. He asked how the applicants feel about the proposed idea to turn the building and what they would plan for screening in that case and noted he is concerned about trash pickup if everyone is individually responsible for their own. City Planner Carlson stated to maintain the drive aisle needed, they would have to slim down 2 or 3 spaces to accommodate it. He noted the CityÓs interest is in public safety and they would want to make sure the parking does not overflow to public streets or cause excessive traffic and congestion. He stated he does not think traffic at this site will be an issue or problem. Commissioner Nelson stated the parking is the only thing he was questions about and looks forward to seeing what they come up with for their customers. Chairperson Broussard-Vickers stated she is concerned about the application stating maxi- storage and the ordinance states mini-storage; she just wants to make sure that is corrected if it needs to be to avoid any issues or confusion down the line. She noted they should keep the landscaping requirements similar across these types of businesses. Administrator Statz stated the storage facility across the street from this proposed site is zoned differently so there is some flexibility in the landscaping and screening requirements for the Mini-Storage facility. City Planner Carlson stated that signage is not included in the CUP. He stated that is applied for later on for approval through the City. City Planner Carlson asked Mr. Anderson and Mr. Ly how much they have invested in this site. Mr. Ly stated the budget is about $1.3M for phase 1, which is the first building and after the second phase/second building the total investment is about $2M. Ordinance Review Î Chapter 130, Section 130.03 - Discharge of Firearms within City Limits Administrator Statz introduced this item and noted this is a discussion item only. He stated they are looking for guidance on what the Commission would like to see updated in this ordinance. Chairperson Broussard-Vickers stated she was involved in the drafting of the ordinance about 20 years ago and knows there is a lot to update and change. She noted she would like to see that rural and city areas be differentiated when deciding what if any types of these items can be used. Commissioner Kubat stated he thinks there is definitely room to improve the ordinance. He stated they should be specific about types of items allowed or not because there are obvious items like projectile firearms and bows that can cause serious harm. He stated then there are things like air soft guns that are much safer and an item kids are into right now. He stated they will also need to look at where hunting will be allowed. Commissioner Krueger stated he would like to see the ordinance be similar to Lino Lakes, which says something like hunting on the lake cannot take place within 500 ft of any structure. He noted they should have a public hearing on this and snowmobiles as they are both hot topics. Commissioner Olson stated he does not have a lot to add as most of his thoughts have been mentioned already. He noted he would like there to be a distinction between dangerous items that should be prohibited and things such as water balloon launchers that can be used because he likes to use those from time to time. Commissioner Kuiper stated he appreciates the Police ChiefÓs comments and he is on board with limiting and banning firearms in the City limits or refining the line under those terms that the police stated. Initiatives include: Regional Broadband Efforts, Marketing at 2022 Events, Regional Business Retention & Expansion Initiative and Community Support. A number of events are in the process of being planned for this year, including: ACRED Business & Banking Summit and ACRED Up River Real Estate Event. The dates have not been confirmed. A number of sponsored events are also being planned Î more information can be found on the ACRED website. EDA The EDA reviewed their 2021-2022 Strategic Plan at their th February 16 meeting. The Commissioners talked about past accomplishments (success with the CenterStage and Blue Logo programs as well as business engagement). The focus for this year, although not exclusively, will be on developing a plan for downtown and the waterfront, Business Retention and Expansion visits, Community Outreach, Intersection of th 20 and Main. The EDA is also weighing their options regarding their involvement with vacant properties. COMMUNITY DEVELOPMENT Block 7 Property (Downtown) Î ÐSorel QuarterÑ Centra Homes will appear in-person at the March 1 Planning and Zoning Commission to review exterior finishes. They will have physical samples to present and updated renderings. As always, the public is welcome to attend this meeting. This will be the last opportunity to give input on the design of the homes. A DeveloperÓs Agreement and draft HomeownerÓs Association Documents will be presented to the Planning Commission and City Council in the coming weeks. Centerville Elementary School Expansion A few supply chain issues in addition to a sanitary sewer service issue, are producing challenges for the contractor, in meeting their original schedule. An expected completion date is unknown at this time. stnd Old Mill Estates 1 and 2 Additions The developer has requested a Letter of Credit reduction. A warranty bond for the improvements has now been received by the city, allowing the reduction request to be processed. The City is in discussion with the homeowner near the cul-de-sac on Old Mill Court, exploring alternative routes for the trail. The city will continue to hold security for the completion of the trail until this process plays out and the trail link is completed. th Centerville Storage (20Ave. Mini Storage) A few items remain to be completed prior to allowing the facility to be opened, including some fence work. Bay View Villas (Waterworks Site) The vast majority of the project work is now done. Some lakeshore plantings and final landscaping items remain. Mailboxes are now in and the pond has been dredged to final grade. Atlas Villas Memory Care Project (1825 Main Street) Contractors have been experiencing delays due to material shortages but they anticipate being open by April 1, 2022. Development Inquiries Developer looking at City-owned 1737 Main Street Rehbein Commercial Infrastructure work is now, largely complete, with the sewer, water and stormwater having been installed. The street (Michaud Way) has been constructed up through the base course of asphalt. The wearing course will be installed next year if there are no settlements or other issues. The contractor is working through punch list items and will be completing the trail and sidewalks next year. Kwik Trip Staff has been working with Kwik TripÓs staff to get securities and other agreements in place. The owner has communicated that construction could begin by mid-summer, 2022. Norbella Senior Living Norbella has now broken ground on the site, installing utilities and excavating for the foundation and parking lot. Work will continue within the building through the winter. Peterson Shores The developer has signed necessary agreements and is authorized to file the plat. Rehbein Industrial Work on the extension of Fairview Street has been completed, up through the gravel base of the road, including sewer, water and stormwater utilities. Curb and paving will follow in the Spring. Sutton Transport The site has been graded and is ready for construction, once agreements are finalized. 2050/2070 Main Street A permit has been issued for roofing of the building in preparation of the tenant. Staff has been working with the developerÓs representatives on final due diligence items and recently helped them measure the depth of some existing storm ponds to facilitate their permit application to Rice Creek Watershed District. A rezoning and Conditional Use Permit were approved, pending the sale of the property to a Building Material Supply Center. The user would largely sell to builders and contractors, but will have a public showroom and sales counter. If the sale goes through, we would expect to see a site plan review application soon. Max Storage (Fairview Street) A public hearing was held on February 1 to review an application for a Conditional Use Permit (CUP) to operate what is being termed a ÐMaxi StorageÑ facility. The proposed development would consist of 2 buildings, each with 8 for-lease units which would include a large overhead door, and enough space (50Ó x 208Ó) to house equipment for small contractors working in the trades. The heated units may also be available for rental to store personal items, such as RVs, boats and other large equipment. The Planning and Zoning Commission had a number of comments and questions for the applicants to address, including landscaping, operational and building code issues. The public hearing for the project has been left open to allow for further public comment. We anticipate st the applicant addressing the comments at the next P&Z meeting on March 1. The US Treasury has now finalized their guidance on lost revenue, which provides a flat amount for recovery by each city, which is well above CentervilleÓs allotment. If funds are allocated for lost revenue, they must simply be spent on general government expenses. Council has not made formal commitments yet. Annual Audit The cityÓs Auditors will be engaging with city staff and elected official in mid-March this year to complete our annual audit. This process ensures the cityÓs policies and procedures are operating properly and that the cityÓs finances are in good standing. PUBLIC WORKS Snow Plow Season At the last meeting the city's snow plowing policy was discussed. Council had a few more questions about when snowplowing operations begin and the order in which streets, sidewalks, and trails are plowed. Also discussed was a desire for consistency between City Code and our Policy. Revisions to our policy have been made in an effort to address those issues. STORMWATER/WETLAND The Minnesota Pollution Control Agency (MPCA) will be conducting a random audit of our stormwater operations system during the third week in March. MPCA audits are routine for municipalities that hold NPDES MS4 permits; the permit that authorizes cities to operate stormwater systems. The purpose of the audit is to verify the city is fulfilling its regulatory paperwork requirements, as well as its environmental education program requirements. SEWER AND WATER Commercial Water Connection Fee Assistance As part of the cityÓs ongoing effort to help businesses through the pandemic, a new program was introduced, cutting connection fees for city water in half, for commercial properties. If you own a commercial property in Centerville that is not currently hooked to city water, and are interested in learning more, please call City Hall. The program is offered for a limited time only and is subject to conditions. Wellhead Protection Plan Staff has been working to secure bids on the well sealing for which a grant was obtained. Water Usage Report The city recently submitted its annual water usage report to the Department of Natural Resources (DNR). In 2021, our community used over 120 Million Gallons of water. 115 Million gallons (MG) of that was used by residential customers and itÓs estimated that almost 47 MG of that was for lawn irrigation. Yes, over 40% of our water use went to keeping the grass green. We know this by comparing our summer month usage to our winter month usage. In July, we used over 21 MG of water, as compared to a typical winter month of 5.5 to 6 MG, representing an increase of more than 3 and a half times. Obviously, last year was a tough year for our lawns, but it also highlighted our need for conservation efforts related to our drinking water supply. If our community continues to use water at this rate, the DNR could impose restrictions on our permit. While our city is not bound by any of the lawsuit mandates that some cities are facing, it is likely that we will be more heavily scrutinized due to our proximity to those who are. Check out DNRÓs water conservation tips for lawn care below: PUBLIC SAFETY Centennial Fire District On February 8, 2022 Centennial Fire Department assisted SBM on a working fire in Blaine. Engine 11 was first to arrive on scene and emergency personnel aggressively responded to the fire. There were no injuries reported. The swift response to this fire is a perfect example of why mutual aid is important. Centennial responded on a first box alarm and because the incident was on the boarder of the fire district, E-11 arrived quickly. Outstanding job to the Centennial Fire Department!! Centennial Emergency Responders on scene at a fire in Blaine on February 8, 2022 Centennial crews also were among the first to respond to the large fire at the Blaine Fleet Farm on Thursday, February 17. Centennial Lakes Police Department Chief Mork and his staff continue to focus on keeping adequately staffed through the pandemic, staggering shifts and making other adjustments to their operations. They have also been busy preparing their annual report, to be presented to the Police Governing Board at an upcoming meeting.
