HomeMy WebLinkAbout2022-01-12 CC Minutes - Approved CITY OF CENTERVILLE CITY COUNCIL MEETING January 12, 2022 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled City Council Meeting on January 12, 2022. The meeting was also live streamed by North Metro TV. COUNCIL MEETING I. CALL TO ORDER Mayor D. Love called the meeting to order at 6:30 p.m. PRESENT: Mayor D. Love Council Member Steve King Council Member Darrin Mosher Council Member Russ Koski Approved Council Member Michelle Lakso Junior Council Member Danny (Non-Voting) ABSENT: Administrator Mark Statz STAFF: City Attorney Kurt Glaser II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Mayor Love provided an opportunity for others to add or delete items. Mayor Love added remote meetings as item 5 under New Business. He also noted the Snow Plowing Policy as item 4 under New Business. City Attorney added check numbers 9209-9231, 9208 under consent; check 9125 was voided. Motion by Council Member Lakso, seconded by Council Member King to Approve the Agenda as Amended. All in favor. Motion carried. IV. APPOINTMENTS/PRESENTATIONS 1. Special Guest Speaker - There was a special presentation from the League of MN Cities to honor Mayor Love for his leadership with the League. Brad Wersom, Mayor of Minnetonka, and former LMCIT Board spoke about the mayor’s devotion to his family and community. Dave Kalister, Plymouth City Manager, and Chair of LMCIT Board provided additional comments to honor the mayor; he also thanked the mayor, his wife, and the city for sharing him with the League. Council Member Koski thanked the mayor from the city and citizens, adding that the mayor has been a great role model for him. The meeting stopped for a technical cable issue at 6: 32. The Mayor declared a recess, and resumed the meeting at 6:38 p.m. City of Centerville Council Meeting Minutes January 12, 2022 VI. APPROVAL OF MINUTES 1. None V. PUBLIC HEARING 1. None VII. CONSENT AGENFDA Mayor Love provided an opportunity for others to add or delete any items from the consent agenda. Item #5: Parks and Rec. Recommendation to contract with Langer Tree Service for Removal of Trees in Eagle Park was removed from the consent agenda. Mayor Love highlighted the proclamation for School Choice Week. Motion by Council Member Koski, seconded by Council Member Lakso to approve Items #1-4 and 6-7 of the Consent Agenda. All in favor. Motion carried. Discussion ensued about leaving the stumps during tree removal in Eagle Park. Liability and maintenance concerns were brought up. Motion by Council Member Koski, seconded by Council Member Mosher to table Item #5. Parks and Rec. Recommendation to contract with Langer Tree Service for Removal of Trees from Eagle Park. All in favor. Motion carried. VIII. OLD BUSINESS 1. Resolution #22-0XX - Adopting the 2022 List of Appointments Discussion ensued about the appointees, and the council agreed on the list as presented with the following changes: Acting Mayor Acting Mayor Koski CFD Steering Committee Council Member King Parks and Rec. Add: Committee Member Emem Akpan Planning & Zoning Council Member Liaison Lakso as alternate Page 2 of 6 City of Centerville Council Meeting Minutes January 12, 2022 Motion by Council Member Koski, seconded by Council Member Lakso to Adopt Res. #22- 001 as outlined in the List of Appointments. All in favor. Motion carried. 2. Ord. #122, Second Series - 2022 Fee Schedule Motion by Council Member Lakso, seconded by Council Member Mosher to Adopt Ordinance #122, Second Series - 2022 Fee Schedule as Presented. All in favor. Motion carried. 3. Sorel Quarter a. Preliminary Plat b. Preliminary Conditional Use Permit for a Planned Unit Development. Sorel Quarter is the townhouse project on Block 7 in downtown. The development consists of 26 townhomes and six (6) buildings. The revised plat includes minor revisions, with the basic concept remaining the same – townhomes on two sides of the block that face Centerville Road between Sorel and Heritage Street. Minor revisions include alignment of trail on the west side of the site, added decorative lighting at each end of the trail, an added entry monument/gateway feature at the corner of Sorel and Centerville Road, and minor changes to the landscape plan to address the balance between good looking landscaping, and ease of maintenance between the areas. Approving the preliminary plat would divide the current eight (8) lots into new lots and outlots for the townhouse complex. Approving the Conditional Use Permit for the Planned Unit Development (PUD) allows there to be negotiation for a creative plan that integrates the site. Discussion ensued about the development. Points of interest include aesthetics (as presented in the original and revised elevation drawings), drainage, an inquiry about target demographic market, and the escrow process. Council Member Koski asked attorney Glaser if a combined motion could be made. Attorney Glaser suggested that the motion provided by Planner Phil Carlson be used since it outlines the conditions of approval for the preliminary plat and preliminary conditional use permit for the planned unit development. Motion by Council Member Koski, seconded by Council Member King to Approve the preliminary plat and associated conditions for Sorel Quarter and to Approve the Preliminary Conditional Use Permit for the Planned Unit Development with Associated Conditions for Sorel Quarter. All in favor. Motion carried. IX. NEW BUSINESS 1. Resolution #22-0XX - Approving Participation in Opioid Litigation Settlements Attorney Glaser reported that the State of MN has sued the opioid manufacturers and distributors and the cities that want to participate in the settlement need to approve the settlement agreement. Page 3 of 6 City of Centerville Council Meeting Minutes January 12, 2022 Attorney Glaser is not sure what the amount of money to a city would receive. For cities with a population under 10,000, monies will come through the County. Anoka County will be receiving 17 million. Monies can be used to subsidize COPD and prosecution operations. Motion by Council Member Mosher, seconded by Council Member Lakso, to Adopt Resolution #22-002 – Approving Participation in Opioid Litigation Settlements as Presented. All in favor. Motion carried. 2. Ordinance #120, Second Series, Amendments to the Sign Ordinance (First Reading) Attorney Glaser reported that the amendments to the sign ordinance clean up the language and include the new zoning district the city has adopted (B-2, Main Street Commercial District). First reading, so no action was taken. 3. Ordinance #121, Second Series, Amendments to Land Dedication Ordinance (First Reading) Attorney Glaser reported the changes to parkland dedication fees clarify obligations when paying fees; the changes should provide clarity with commercial development. First reading, so no action was taken. 4. Snow Plowing Policy Mayor Love welcomed discussion about the snow plowing policy, receiving feedback since it has been a while since the policy has been reviewed. Discussion ensued about what triggers ice control operations (volume of snow and location such as sidewalks and trails, etc.). Inconsistencies in the policy with the 1.5 inches in some sections of the policy. Consensus is that clarification is needed in the policy. Motion by Council Member King, seconded by Council Member Mosher to Table the Presented Snow Plowing Policy. All in favor. Motion carried. 5. Remote Meetings Attorney Glaser provided an update about remote meetings. Meetings can be hybrid, however if quorum is present then old rules apply and members must publish their addresses. The statute the attorney is referencing pertains to remote meetings during a pandemic, not remote meetings for general purposes. If committees feel they need to declare emergency meetings, they need to have option of a hybrid meeting so members can dial in and be a part of the meeting. Attorney, City Administrator, or Committee Chair can declare an emergency. No action was taken. Page 4 of 6 City of Centerville Council Meeting Minutes January 12, 2022 X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1. Administrator’s/Engineer Report – Attorney Glaser is filling in for Administrator Statz who was sick. Attorney Glaser reported that they are going back to full courts, which is good because of the back log of work. It is highly likely they will be working from home again soon due to the pandemic. Attorney Glaser thanked the board for reappointing him and let the council know that he enjoys his working with them. 2. Council Reports a. Lakso - i. Parks and Recreation Committee – Upcoming skate/sled night & planning for music in the park, and the Fete des Lacs meeting. ii. Anoka County Fire Protection Council – No report was given. b. Koski - i. Planning & Zoning Commission – Council Member Koski stated Discussion topics were outside storage in residential areas. One of the points of contention at the public hearing was how far away from the curb can vehicles be parked. Liquor requirements were also discussed (establishments cannot be within 500 feet of a church or school). ii. Fire Steering Committee - Council Member Koski stated that there has not been a meeting; however, there may be one later in the month. c. King - Economic Development Authority – No report was given. d. Mosher - i. Economic Development Authority – No report was given. ii. Police Governing Board – No report was given. e. Love - i. Police Governing Board – No report was given. ii. Fire Steering Committee – No report was given. iii. North Metro Telecommunications Commission - No report was given. iv. Other Mayor Reports – Mayor Love welcomed Jr. Council Member Danny Peterson; he also thanked all the Council Members for their service. Mayor Love also mentioned that he had an opportunity to talk with members in other communities about the importance of civility and the importance of “push positivity.” XI. ADJOURNMENT Motion by Council Member King, seconded by Council Member Lakso to Adjourn the Regularly Scheduled Council Meeting at 8:38 p.m. All in favor. Motion carried.
