The meeting was also live streamed by North Metro TV. COUNCIL MEETING I. CALL TO ORDER Mayor D. Love called the meeting to order at 6:30 p.m. ROLL CALL* PRESENT: Mayor D. Love Council Member Steve King Council Member Darrin Mosher Council Member Russ Koski Council Member Michelle Lakso ABSENT: None STAFF: City Administrator Mark Statz City Attorney Kurt Glaser *Note that “present” is construed to mean that the noted individuals were visibly and audibly present on the videoconference call. II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Mayor Love provided an opportunity for others to add or delete any items. Motion by Council Member King, seconded by Council Member Lakso, to Approve the Agenda as Presented. A roll-call vote was taken. APPROVAL OF THE MINUTES City of Centerville Council Meeting Minutes October 27, 2021 1. July 28, 2021 City Council Work Session, Meeting and Closed Executive Session Minutes Mayor Love provided an opportunity for Council to make modifications to the minutes if desired. Council Member Lakso would like the record to state City Council were supportive. City Administrator Statz questioned whether City staff could make the adjustment or does City Council require approval for the adjustments. Motion by Council Member King, seconded by Council Member Mosher, to Approve the July 28, 2021 City Council Work Session, Meeting and Closed Executive Session Minute as Amended. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. VII. CONSENT AGENDA 1. City of Centerville Claims through October 27, 2021 (Check #34640-34673), (1766-1781E) & Voided Check #34638 2. Centennial Lake Police Department Claims through October 21, 2021 (Check #14042-14052), Payroll Check #14053-14054 & (2021055-2021056E) 3. Centennial Fire District Clams through October 12, 2021 (Check #9184-9191, E202102) 4. Endorsement of Metro Cities’ 2022 Legislative Policies & Appointing City Administrator as a Voting Representative This item was removed from the consent agenda. 5. Encroachment Agreement, 1784 Meadow Lane – Fence This item was removed from the consent agenda. Mayor Love provided an opportunity for the Council to add or remove any item(s) to/from the consent agenda. Mayor Love inquired whether endorsing legislative policies is a practice the City Council partakes in. City Administrator Statz stated it has been done but sometimes the timing of these policies do not coincide with City Council meetings. Mayor Love also wondered if City Administrator Statz will be the sole voting member. Council Member Koski questioned if City Administrator Statz could explain the function and purpose of the Metro Cities group. City Administrator Statz explained Metro Cities is an arm of the League of MN Cities, focusing on the metro area to provide lobbying services at the legislative level. Metro Cities tracks legislation through the process. Legislators tend to listen to this group because of its large size. Mayor Love added this is a great opportunity for city officials to become involved and help set policies. Motion by Council Member Koski, seconded by Council Member King, to Approve Consent Agenda Items #1-3. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. 4. Endorsement of Metro Cities’ 2022 Legislative Policies & Appointing City Administrator as a Voting Representative Council Member King wondered how often this group meets and number of people on the Committee. City Administrator Statz stated they meet twice a year for bi-annual meetings and policy adoptions. They also allow members to make motions when policies are not agreed upon by all participants. City Administrator Statz also commented anyone could choose to sit on this Committee. Mayor Love inquired more details of Metro Cities’ purpose. City Administrator Statz explained he would have the opportunity to help set policies to help grow the city of Centerville. These policies then go out to all of the cities in the group for approval. Council Member Mosher thanked Mayor Love for the explanation of this process. City Administrator Statz emphasized this is how policies are made and brought to the Legislature. He also noted he could get you in contact with the appropriate legislative representative to discuss further concerns. Motion by Council Member Lakso, seconded by Council Member Mosher, to Approve Consent Agenda Item #4. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. 5. Encroachment Agreement, 1784 Meadow Lane - Fence City Administrator Statz stated City code requires fencing around an outdoor pool. Council Member Lakso wondered about requirements of property owner if existing fence had to be moved. City Administrator Statz stated removal of a fence in a drainage and utility easement is usually temporary. Council Member King was concerned residents may not understand the definition of this city code. City Administrator Statz provided a variety of options for the property owner during this process. Mayor Love provided other options such as fencing around only the pool or use pool covers. Council Member King questioned if tabling this until City Council members have a complete understanding of this agreement. Motion by Council Member Lakso, seconded by Council Member Koski, to Approve Consent Agenda Item #5. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. VIII. OLD BUSINESS 1. Sutton Transport Page 3 of 6 City of Centerville Council Meeting Minutes October 27, 2021 a. Site Plan b. Conditional Use Permit c. Final Plat Administrator Statz explained nothing has changed since this was originally shown to the City Council. Sutton Transport is looking to complete the process by approving the permits and plans that have been shared but not yet approved. Council Member Lakso noted no issues were directed to Planning and Zoning back in August. Council Member Koski questioned why the approvals are delayed. City Administrator Statz stated disagreements between the property and land owner pushed it back a month and it never was approved. City Attorney Glaser added participants had to close on the agreement before the City could approve the plans. Council Member Koski wondered if all three can be approved in one motion. He also wanted clarification on differences between the resolution and the Conditional Use Permit. City Administrator Statz requested a separate motion to approve the Conditional Use Permit and also stated the Resolution has to come before the motion to approve the Conditional Use Permit. City Attorney Glaser advised City Council to remove the Conditional Use Permit from the motion and clarified he has authority to make small changes only to the Development Agreement. Mayor Love and Council Member Koski stated they were glad this agreement is complete. Motion by Council Member Koski, seconded by Council Member King, to Approve the Sutton Transport Final Plat and Site Plan. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. Motion by Council Member Koski, seconded by Council Member Lakso, to Approve the Resolution Granting the Conditional Use Permit by Sutton Transport. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. IX. NEW BUSINESS 1. The Shores Outlot a Tax Forfeiture/Anoka County Tax Forfeit 2021 Classification Property for Sale City Administrator Statz received a letter from Anoka County asking if Centerville wanted to purchase the forfeited property. He noted City staff recommended the County take it over. Council Member Lakso inquired about the designated easement on this property. City Administrator Statz noted this is part of the Native American Community and they do not want signage or publicity regarding this piece of property. Page 4 of 6 City of Centerville Council Meeting Minutes October 27, 2021 Motion by Council Member Koski, seconded by Council Member King, to Communicate to the County that the City is Not Interested in Purchasing the Property and Would Like the County to Retain It. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. City Attorney Glaser further explained if the County were to sell the property, City Council does not need to be notified. 2. Wellhead Protection Joint Powers Agreement City Administrator Statz explained Centerville is currently involved in a Joint Powers Agreement with cities that have similar well priorities. The City is required to have a Wellhead Protection Plan. The Wellhead Protection Plan includes community outreach, education and map making. He stated other cities get together and add or delete the revised agreement to meet all the needs of the participants. Council Member King wondered the difference with this agreement. City Administrator Statz stated changes were minimal. He also stated cities can now join without City Council approval. Council Member Koski wondered is there an annual fee and if so, who pays that. City Administrator Statz believes there is no an annual fee to be a part of this group. Council Member Mosher noted an annual report would be helpful and informative. Motion by Council Member Koski, seconded by Council Member Lakso, to Approve Wellhead Protection Joint Powers Agreement. A roll-call vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in favor. Motion carried. X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1. Administrator’s/Engineer Report – City Administrator Statz stated commercial and residential developments are wrapping up. The mini storage developer is waiting on fence supplies and will rent units this fall. 2. Council Reports a. Lakso  Parks and Recreation Committee – Referred the Council to the agenda. – Volunteer Appreciation Night was well attended and many people were recognized. Local vendor provided food.  Anoka County Fire Protection Council – b. Koski – nd  Planning & Zoning Commission – None. Will meet Nov 2, public hearing for Block 7 preliminary request for rezone and Conditional Use Permit for 2050 and 2070 Main Street  Fire Steering Committee – 6:00 pm tomorrow night c. Mosher  Economic Development Authority – discussed parking lot and Brew Pub, reviewed holiday decorations big wreaths at entrance points to the city Police Governing Board e. Love  Police Governing Board  Fire Steering Committee - tomorrow evening  North Metro Telecommunications Commission  Other Mayor Reports - thanked all the volunteers for participating. Talked to high school principal to get the youth more involved in City government, Centerville Cares using social media to focus on programs to help residents in need. XI.
