Permitted Encumbrances
a. Building and zoning laws, ordinances, state and federal regulations.
b. Restrictions relating to use or improvement of the Property without effective forfeiture

Sedona Townhomes, LLC, developer and builder of the Centerville
Office Park, 7029 20th Avenue, proposes to build on Outlot A, the
open area on the south end of the office park, a three story office
building. The building footprint would be 10,000 square feet, for a
total of 30,000 square feet, and 150 parking stalls would be
available for the building. The open space surrounding the
building and parking would be landscaped with maple, ash, and
spruce trees. Further, the landscaping in the center island of the
parking lot would include tables and benches. On the south end of
the new building there would be a large open patio with tables and
chairs for outdoor meals and socializing.
The exterior of the building would be concrete panels with
decorative colors, many windows, and architectural detailing
which would accent the entry, corners and rooflines.
As part of 20th Avenue reconstruction by Anoka County, a new
turn lane will be installed at the site entrance. As traffic enters the
office park the flow will be into the center of the parking lot and
disbursed around the buildings. It is expected that the people
coming to work would arrive during a one-hour time frame in the
morning, and leave with a similar disbursal as well.
The building setbacks from lot lines, roadways, neighboring
houses and businesses are quite adequate. There is much open
space created by Clearwater Creek on the south and west, the
office park retainage ponds on the west, the new city commercial
park on the east, and City Public Works on the north. With the
screening, spruce trees on the west, an effective buffer will be
created between the new building and the neighboring houses.
This is a concept site plan for review purposes and Sedona
Townhomes LLC seeks your input for this exciting project.

ORDINANCE #12,
SECOND SERIES
AN ORDINANCE AMENDING CBAPfER 152 OF THE
CENTERVILLE CITY CODE BY MODIFYING REGULATIONS TO PERMIT AREA
IDENTIFICATION SIGNS IN RESIDENTIAL DISTRICTS
THE CITY OF CENTERVILLE ORDAINS:
Section 1. Code Section 152.18 shall be amended by adding a section 152.18, (A) (5) to
read as follows:
(5) Area Identification Signs. One area identification sign is permitted in conjunction with a
development or subdivision; however, the sign shall not exceed 64 square feet in area and 12 feet
in height and shall only be permitted when a homeowner association or other responsible entity
has been established that agrees in writing to maintain the sign.
Section 2. Effective Date. This ordinance shall be effective immediately upon its passage
and publication according to law.

City Administrator Larson stated this was a property the City had acquired on the east
side of town, which was available for resale. He noted this proposal would create three
industrial lots. He indicated the ponds would be managed separately for maintenance.
He asked for any comments or concerns before it was moved along for any decisions. He
indicated this did not need to get scheduled for a public hearing next month, so the
Commission could take their time in looking at this. He asked if the zoning should be
industrial or commercial. He noted right now it was zoned industrial. He stated if it were
commercial it might make a lot of sense.
Chair Hanson asked if this had been rezoned industrial recently.
City Administrator Larson responded they had rezoned this area as industrial.
Commissioner Hanzal asked if there was any benefit to having this split into three lots
instead of keeping it one lot.
City Administrator Larson replied the ditch was going to be relocated between proposed
lots 1 and 2, which made this a natural division. He noted if they wanted, Lots 2 and 3
could be combined into one lot.
Chair Hanson stated the concern would be keeping kids off of the road when they were
going to Dairy Queen.
City Administrator Larson responded the construction plan did not have sidewalks, but it
might be possible to bring them in. He indicated, however, this might not be the best
place to put pedestrian traffic.
Commissioner Wood stated what would happen was the pedestrians would make the best
use.
Commissioner Hanzal asked if they could construct a bike path keeping the pedestrian
traffic away from the road. He noted this might be cheaper than a sidewalk.
City Administrator Larson stated while the City owned the lot, it might be possible to
create a pedestrian access by the ditch between Lots 1 and 2.
Commissioner Hanson stated if this was a commercial development that would lend itself
to pedestrian traffic also.
City Administrator Larson stated people always wanted to take the shortest route.
Chair Hanson stated they could always put the responsibility on the developer of the
property to put a sidewalk in as a part of the development.

City Administrator Larson stated they would be better off putting a sidewalk on the north
side, even though pedestrians would be crossing driveways. He noted if they were going
to provide a sidewalk, they would need the appropriate land for an easement.
City Administrator Larson asked if the Commission would consider this as a commercial
use.
Chair Hanson asked if they should consider rezoning the area across the road also.
City Administrator Larson stated they could look at this and check with the property
owners to see if they had any issues with being rezoned commercial.
Commissioner Wright asked if they rezoned the property to commercial, would this
affect their taxes.
City Administrator Larson responded he did not believe there would be any affect.
Chair Hanson asked if the City could talk to the property owners to see if they had any
issue with being rezoned to commercial for the next meeting.
City Administrator Larson stated he would put this back on the agenda for the next
meeting.
VI. DISCUSSION ITEMS
1. Comprehensive Plan Update
City Administrator Larson stated the City was required to update the Comprehensive Plan
by 2008. He noted the last plan was dated 1998. He stated in order to get the Plan
updated, they would need to schedule some public meetings and possibly have a
consultant compile everything. He believed part of it should have a consultant update
some of the factual material. He stated they could view this as starting from scratch or
they could assume that what they had should be amended.
Commissioner Wood believed the information could be updated without much effort. He
noted the Plan had a good foundation they could work off of
City Administrator Larson stated perhaps they might ask the Council to include in the
budget for next year some planning dollars to get through the process and get a planner
involved. He indicated in the Plan they needed to figure out how to maximize the land
they had remaining.
Chair Hanson asked what was the threshold.
City Administrator Larson responded a population of 5,000 was the threshold.

Commissioner Hanzal stated he believed they needed to get planner who knew what they
were doing.
Commissioner Wood agreed, but noted they could cut costs by doing a lot of the initial
work themselves.
Council member Terway asked if they knew how many hours they would need a planner
for.
City Administrator Larson stated he did not have that information at this time, but now
that he knew what the Planning Commission wanted, he would research this.
Commissioner Hanzal asked if they could come up with a list of items that they wanted to
start handling.
City Administrator Larson noted they should start their review on Page 29 forward and
look at updating this information on their own.
Motion bv Commissioner Banzai. seconded bv Commissioner Wood. to recommend
Council include fundin2 in the 2007 bud2et for a olanner consultant to uodate the
Comorehensive Plan. All in favor. Motion carried.
2. Monument Signs
City Administrator Larson stated in the Code under Sign Regulations, he did not see any
allowance for residential subdivision identification signs in the Code. He indicated that
there are several those signs in the City and if they wanted those types of signs to be
allowed, the Code should be amended.
Commissioner Hanzal stated he believed they should make an amendment adding an area
identification sign, coming up with a square footage.
Chair Hanson stated they needed to put something in the Code that limits the number of
SIgns.
Commissioner Wood stated they could put the limit on the developer.
City Administrator Larson noted an issue would be the maintenance of the signs. He
stated they needed to consider this if there was not a homeowners' association.
Commissioner Hanzal asked if they could put in the requirement that the signs be made
of maintenance free materials.
City Administrator Larson stated they could draft some language for their next meeting.
He asked if they should limit these types of signs to a homeowners' association only.

The Commissioners agreed by consensus that these signs should apply to only
homeowners' associations.
Commissioner Hanzal asked if they had some signs on non-homeowners' association
property. He asked what would happen to those signs.
Commissioner Wood responded he believed those were pre-existing signs and therefore
would be grandfathered in.
City Administrator Larson stated they might want to limit the signs to locations where
there were collector streets.
The Commissioners agreed this should be limited.
Council member Terway asked if this could be part of the plat approval process as to the
location of the sign.
City Administrator Larson responded this was a possibility.
Commissioner Wright stated they also had to ensure the signs were not placed in the site
triangle.
City Administrator Larson stated he would bring a draft back at the next meeting.
VII. CONSIDERATION OF MINUTES

No changes were made to the July 11 2006 Planning and Zoning Meeting Minutes.
Motion by Commissioner Love. seconded by Commissioner Pan2ell. to approve the
Minutes of July 11. 2006. as presented. Commissioner Wood and Chair Hanson
abstained. Motion carried.
