Session Meeting Minutes - Approved Approved CITY OF CENTERVILLE CITY COUNCIL MEETING & CLOSED EXECUTIVE SESSION September 14, 2022 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled City Council meeting and Closed Executive Session on September 14, 2022 in Council Chambers of City Hall and the meeting was also live streamed by North Metro TV. COUNCIL MEETING I. CALL TO ORDER Mayor D. Love called the meeting to order at 6:31 p.m. ROLL CALL PRESENT: Mayor D. Love Council Member Darrin Mosher Council Member Steve King Council Member Michelle Lakso Junior Council Member Danny Peterson (Non-Voting) ABSENT: Council Member Russ Koski STAFF: City Administrator Mark Statz City Attorney Kurt Glaser II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Mayor Love stated there is an addition item under Approval of Minutes, we are adding the July 11, July 27, and August 10 minutes. Under the Consent Agenda City of Centerville claims through 9-14-22 adding checks #35350 through #35970 and E-Checks #1942E-1944E and voided check #35333. Mayor Love provided an opportunity for others to add or delete any items. Administrator Statz pointed out that there is also a Public Comment that they added to Appointments and Presentations from resident Mr. Tony Smith, 7370 Peltier Circle. Motion by Council Member Lakso, seconded by Council Member King to Approve the Agenda with the noted changes, as presented. All in favor. Motion carried. IV. APPOINTMENTS/PRESENTATIONS Mr. Tony Smith, 7370 Peltier Circle, stated that he is a concerned citizen about the process of obtaining a permit for an accessory structure on the side yard of his house. He stated that he wanted to build a small garden shed for his wife. He stated that he turned in his application and plans and it was denied by the Building Inspector because the placement of the shed. He stated he spoke to a new Planning and Zoning member and spoke to Ms. Bender and said Ms. Bender was great and City of Centerville Council Meeting & Closed Executive Session September 14, 2022 helped him understand the process. He stated that Administrator Statz explained to him that part of the code is subject to interpretation and only real issue is that it’s too close to the property line. Mr. Smith stated that it doesn’t seem that there is uniformity throughout the community as to sheds. Mr. Smith is asking for this process to be improved, asking the City Administrator for all the records for accessory structures permits and variances that have been recorded in the 5 years and asking all the community member to act in a fair and responsible way. Mayor Love reaffirmed that this was brought Planning and Zoning. City Administrator explained there were 2 issues: First, if he needed a variance for the side yard and second, the placement of the shed within 5 feet of the property line. He stated that initially the permit was denied by the Building Inspector because of the structure being in the side yard. Administrator Statz stated that he is working with Mr. Smith without action from any other board and if the placement of the shed is less than the 5 feet then there would be a variance process. V. PUBLIC HEARINGS 1. None. VI. APPROVAL OF THE MINUTES 1. June 21, 2022 City Council Work Session & Meeting Minutes Mayor Love provided an opportunity for Council to make revisions if they desired. Council Member Lakso stated on page 2 of 6 under the item Absent, after the Roll Call, her name was there. Double check to make sure that she was there because there were a lot of motions made by her and the minutes reflect that she was not absent for meeting. She stated that she was at the Work Session. Motion by Council Member Mosher, seconded by Council Member Lakso to Approve the June 21, 2022 City Council Work Session & Meeting Minutes with the noted change. All in favor. Motion carried. 2. July 11, 2022 City Council Meeting Minutes Mayor Love provided an opportunity for Council to make revisions if they desired. Motion by Council Member Mosher, seconded by Council Member Lakso to Approve the July 11, 2022 City Council Meeting Minutes as presented. King abstained. All in favor. Motion carried. 3. July 27, 2022 City Council Work Session & Meeting Minutes Mayor Love provided an opportunity for Council to make revisions if they desired. Mayor Love stated that did not call the meeting to order. He was at the Work Session via zoom but was not for the Council Meeting. Page 2 of 7 City of Centerville Council Meeting & Closed Executive Session September 14, 2022 Motion by Council Member Lakso, seconded by Council Member Mosher to Approve the July 27, 2022 City Council Work Session & Meeting Minutes as King abstained. Motion carried. 4. August 10, 2022 City Council Meeting Minutes Mayor Love provided an opportunity for Council to make revisions if they desired. Motion by Council Member Lakso, seconded by Council Member Mosher to Approve the August 10, 2022 City Council Meeting Minutes as presented. King abstained. Motion carried. VII. CONSENT AGENDA Mayor Love provided an opportunity for others to add or delete any items. 1. City of Centerville Claims through September 14, 2022 (Check #35350-35398), (E1942-1944E) & Voided Check #35333 & 35371 2. Centennial Lakes Police Department Claims through September 8, 2022 (Check #14448-14470), (E2022064-2022069) & Payroll Check (1444-14447) 3. Res. #22-0XX – Apply Park & Recreation Expenditures to Charitable Gambling Proceeds 4. Election Judge Pay Council Member Lakso pulled Item #3. Administrator Statz stated due to vacation schedule, all checks were added. They are all normal expenditures. The voided check and reissue check was an escrow reimbursement made to the title company which was voided and a new check cut to homeowner with the title company’s permission. Motion by Council Member Lakso, seconded by Council Member King to Approve Item # 1, 2 and 4 on the Consent Agenda as Presented. All in favor. Motion carried. Item #3, Council Member Lakso – Just for clarification, the Charitable Gambling proceeds was this for the two light pole. Administrator Statz stated that was for the pleasure rink and they were place to light that and the playground a year ago. He stated this was for allocation. Council Member Lakso asked how long the lights were on Parks and Recreations capital plan. Administrator Statz stated that is has been a while. Council Member Lakso appreciated that language that is in the resolution where it read, “NOW THEREFORE, BE IT RESLOVED,” that all charitable gambling proceeds collected in 2020 and 2021 are hereby applied towards operating and capital expenditures for Parks and Recreation functions that are activities and facilities for youth. She asked looking ahead to 2022 is the same going to be applied. Administrator Statz stated that it is in the budget, but no particular project was budgeted for those funds as of yet. Council Member Mosher asked can we compound the “rebate” by saving for another year, if bad year in gambling funds. City Attorney stated that he knows enough to be dangerous and knows that there are limitation but would like to look it up before comment on that. All in favor. Motion carried. VIII. OLD BUSINESS 1. Plans & Specifications for City Hall Parking Lot Lighting Administrator Statz stated that this is a chance for Council to see the plans for lighting for design of parking lot. We were hoping to put it in the ground this fall and hoping to use grant money from OSHA, but the grant money ran out for 2022. He stated we will apply again in January 2023 when they have funds available and we would be successful getting the $10,000 grant from OHSA. Our lighting cost will need to exceed $20,000 for a match and if it does not we will add in some security cameras for the City Hall. We are going to wait on all of the issues to correlate with this grant. He is asking Council to review the plans for lighting and authorize staff to solicit quotes for construction in 2023. A discussion ensued about the security cameras, where they are positioned, timing, adding an outlet for holidays lights, flag or banners, if there will be a timer switch, and motion sensors for the lights. Motion by Council Member Lakso, seconded by Council Member King Approve the Plans & Specifications for City Hall Parking Lot Lighting. All in favor. Motion carried. 2. Purchase Agreement with Schifsky Companies Administrator Statz reported on a purchase agreement with Schifsky Companies that is in packet. They are a contractor/excavator that is working with Team Boo to do a development on Block 7. Schifsky Companies are the ones that will be signing this Purchase Agreement and they will ultimately be the developer but Mr. Boo will acting on their behalf. He stated if Council was in agreement with this Purchase Agreement tonight, they would move forward and getting more due diligence done their part to see if they can make this project work. Their intent is to take Centra Home’s plan and build this project. This gives them 6 months to decide whether or not they are going to move forward on this project. On May 1, 2023, they would closed on the property. Administrator Statz stated what they anticipate is that they will sign the agreement within a month or two, we would see an application for a Preliminary Plat from them, and then we would move through the preliminary plat process. Once through the process, we would recommend the Plat & PUD and finalize purchase of property. Hopefully, construction would begin in the spring of 2023. A discussion ensued regarding the purchase agreement for the land, holding them to the contract, developer’s agreement, Centra Home’s plans, CBDG components and county oversights and protections in the agreement when the land sale goes up. Motion by Council Member Lakso, seconded by Council Member King to approve the Purchase Agreement with Schifsky Companies. All in favor. Motion carried. IX. NEW BUSINESS Page 4 of 7 City of Centerville Council Meeting & Closed Executive Session September 14, 2022 1. None X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1. Administrator/Engineer Report Administrator Statz commented on the upcoming elections, the processes and polling places. He stated that there are still open seats on EDA and Parks & Rec. Committees. He reported that Planning and Zoning has no seat available and the new members had their first meeting last night. He stated that the Planning Commission did addressed some of the coding issues that were mentioned. He commented on the construction going on around town. Kwik Trip and Amazon building pads are prepped or poured. The tanks have been installed for gas at the Kwik Trip and both are on schedule. Both the assistant living and memory care facilities have received their Certificate of Occupancy. They are waiting to hire staff and licensing through the county. He commented on nice the American Roofing Supply looks and noticed that the Mini-Storage has done some improvements and corrected the drainage issues and repaved, added a retaining wall and landscaping. On the residential developments most punch list items have been addressed with the builders. Council Member Lakso asked if we were still going to put on our website job listings and what’s going on in our community. She also mentioned that the school was hiring. She asked when the website was going live. Administrator Statz stated that we have been going through hours of training but was unsure as to when the site was going live. Council Member King asked who was constructing the fence near the water tower. Administrator Statz stated the City was and that Public Works is completing the work to be cost effective. Attorney Glaser requested that Council do a motion regarding cancelling the closed session as mentioned. Motioned by Council Member Lakso, seconded by Council Member Mosher to cancel the Closed Executive Session as noticed. All in favor. Motion carried. Junior Council Member Peterson stated that all freshman started school on Tuesday and the rest on Wednesday last week, fall sports started, the girl’s volleyball team won, football game is an away game at Totino Grace on Friday. Council Member King stated that he looks forward to first day of school for the freshman because all the seniors line up and cheering them on – he said there was no such thing this year, do you know why? Mr. Peterson stated no, but did mention that there were Seniors and Juniors as peer leaders that were helping the freshmen. 2. Council Reports a. Lakso – Page 5 of 7 City of Centerville Council Meeting & Closed Executive Session September 14, 2022  Parks & Recreation – Council Member Lakso stated that she was not at meeting but has an update from staff. She stated for Music in Park they discussed what to do when a food vendor doesn’t show up and came up with a backup plan to have ice cream or freeze pop. She reported on the Bands and how they give them a good deals, ways to enhance and discussing increasing pay. Movie in Park is on Saturday, September 19 at 7 p.m. or dusk and the movie is “The Mitchells versus Machine. She stated for some of the upcoming events, they are trying to get sponsors. She stated on October 29 the Fire Department, Police Department, Snow Plow and maybe the Mayor and Council Members are doing an event, called “Trunk or Treat” in the school parking lot. She talked about the Ship Grant (Statewide Help Initiative Program) and it looks like they are targeting some bike fix it station, drinking fountains that have the water bottle filler and dog station. Also stated that Parks & Rec need a mixer board for Music in the Park and during events the committee members will wear the same color t-shirts with their the logo.  Anoka County Fire Protection – No report was given. b. Koski –  Planning & Zoning Commission – No report was given.  Fire Steering Committee – No report was given. c. King -  Economic Development Authority – No report was given.  Fire Steering – No report was given d. Mosher –  Police Governing Board – Council Member Mosher did not give a report.  Economic Development Authority – Council Member Mosher did not give a report but stated he will be speaking of Market Fest at the next meeting. e. Love – Mayor Love stated that this month World Alzheimer’s Month. He thanked everyone this past week was for attending Patriot’s Day. We had some of our Fire Fighter stand out in front of the station FD out for most of the day, holding a flag and an ax. He stated as he watch people would drive by and honk in appreciation. He mentioned that he was reading through the police report on Centerville and there was an uptick in a neighborly discourse. He took the opportunity to say Centerville has a rich history about caring about neighbors and treating other right in a fair, kind and respectful way.  North Metro Telecommunications Commission – Mayor Love stated that there was a North Metro meeting next week. ADJOURN Council chose not to open the Closed Executive Session that was scheduled as it was determined not to be needed.
