HomeMy WebLinkAbout2022-10-12 CC Minutes - Approved Approved CITY OF CENTERVILLE CITY COUNCIL MEETING OCTOBER 12, 2022 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled City Council meeting on October 12, 2022 in Council Chambers of City Hall and also live streamed by North Metro TV. COUNCIL MEETING I. CALL TO ORDER 6:30 p.m. Mayor D. Love called the meeting to order at 6:30 p.m. ROLL CALL PRESENT: Mayor D. Love Council Member Russ Koski Council Member Darrin Mosher Council Member Steve King Council Member Michelle Lakso Junior Council Member Danny Peterson (Non-Voting) ABSENT: None STAFF: City Administrator Mark Statz Assistant City Administrator Athanasia Lewis City Attorney Kurt Glaser II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Mayor Love provided an opportunity for others to add or delete any items. Motion by Council Member Koski, seconded by Council Member Mosher to Approve the Agenda as Presented. All in favor. Motion carried. IV. APPOINTMENTS/PRESENTATIONS 1. None. V. PUBLIC HEARINGS 1. None. City of Centerville City Council Meeting Minutes October 12, 2022 APPROVAL OF THE MINUTES 1. August 24, 2022 Work Session, City Council Meeting & Closed Executive Session Minutes Mayor Love provided an opportunity to Council to make modifications if needed. Council Member Lakso ask for clarification as to the style of minutes on how to note changes and or annotations on who stated what if they wanted specifically on record. It was agreed by Council to say for the record and their name would be added to what was stated. Motion by Council Member Lakso, seconded by Council Member Koski to Approve the August 24, 2022 Work Session, City Council Meeting & Closed Executive Session Minutes as Presented. All in favor. Motion carried. 2. September 14, 2022 City Council Meeting & Closed Executive Session Minutes Mayor Love provided an opportunity to Council to make modifications if needed and it was corrected that the date of the minutes on the agenda was incorrect. nd Council Member Koski stated on page 15 in the packet near bottom of page, 2 paragraph, last sentence, it stated “Administrator Statz stated that they that it is in the budget but projected (project)” He stated that the sentence should be clarified. He stated should it be no particular budget was projected – should it be project. Mayor Love asked if Administrator Statz would like to clarify what was said. Administrator Statz stated it should read “Administrator Statz stated that it is in the budget, but no particular project was budgeted for those funds as of yet” Motion by Council Member Koski, seconded by Council Member King to Approve the September 14, 2022 City Council Meeting with the Above Stated Modifications. All in favor. Motion carried. VII. CONSENT AGENDA Mayor Love provided an opportunity for others to add or delete any items. 1. City of Centerville Claims through October 12, 2022 (Check #35420-35461), & (1952E- 1925E) 2. Centennial Lake Police Department Claims through October 6, 2022 (Check #14488- 14498), (E2022072-E2022074) & Payroll (Check #14486-14487) 3. Centennial Fire District Claims through September 27, 2022 (Check #9381-9387) & (E2022012) 4. Request for Payment #1 – 2022 Thin Overlay Program & City Hall Parking Lot Improvements 5. Encroachment Agreement, 7257 Brian Drive (Fence) 6. Membership in MN Small Cities Council Member King pulled Item #6. Page 2 of 7 City of Centerville City Council Meeting Minutes October 12, 2022 Motion by Council Member Lakso, seconded by Council Member Mosher to Approve the Consent Agenda Items #1-5 as Presented. All in favor. Motion carried. Item #6 – Council Member King stated that he was wondering about the small cities and what they share in common and what do we gain from them versus the metro cities. Are we paying for extra lobbying for the same thing, is this basically all this is? Administrator Statz stated both are lobbyist groups. We are sharing the cost of lobbyist group. Both groups are affiliated with League and they know what they are both up to so they do overlap their efforts. He feels that this is a nice separation. Council Member King stated most things that the small cities have are outside of MUSA area. How many small cities do we have in here? He wanted to know what they are going to give us because we are inside the MUSA District where most of them are outside. Administrator Statz stated this is why we have not been a member before. The number 1 thing he stated is local government aid, but more specifically, state aid for streets. They lobbied for us to get some funding through that program. Council Member King stated that being that we are inside MUSA, we do not receive extra benefits or discriminate against because of the size of our community because we are in this district. Administrator Statz stated often its either MUSA or population not the combination of the two in most policies. Motion by Council Member King, seconded by Council Member Lakso to Approve Consent Agenda Item #6 as Presented. All in favor. Motion carried. VIII. OLD BUSINESS nd 1. Ord. #126, Second Series – Chapter 111 – Liquor Regulations (2 Reading) Attorney Glaser stated that this is a simple change removed proximity requirement and this would encourage new businesses in to town. Motion by Council Member Mosher, seconded by Council Member Koski to Adopt Ord. #126, Second Series – Chapter 111 – Liquor Regulations as Presented. All in favor. Motion carried. nd 2. Ord. #127, Second Series – Chapter 91 – Nuisance & Abatement (2 Reading) nd Administrator Statz stated that this is the 2 Reading for Ord. #127, Second Series – Chapter 91 – Nuisance & Abatement dealing with addition of Emerald Ash Borer to the ordinance but instead we decided to do addition by subtraction by making the ordinance generic as to diseased trees with no specific types of diseases and if its dead or dying trees needs to be taken down. A lengthy discussion ensued regarding who is going to make the call of a dead/diseased tree, complaints, safety, process (how many letters get sent out before any action is taken), time frame as to taking tree down, if and when an arborist should be hired, cost, who is going to be the designated officer, and etc. Motion by Council Member King, seconded by Council Member Mosher to Table Ord. #127, nd Second Series – Chapter 91 – Nuisance & Abatement (2 Reading). All in favor. Motion carried. 3. Res. #22-28, Approving Summary Publication of Ordinance #125, Second Series – Storm water Management Page 3 of 7 City of Centerville City Council Meeting Minutes October 12, 2022 Administrator Statz stated that just to be clear the amended Ordinance was previously approved. However, Staff felt it appropriate to publish a summary of the ordinance as it was very lengthy and costly to publish in its entirety. He reported that the revised Ordinance had been forwarded to the PCA as required. Council Member King stated that there were numerous pages contained in the previous packet and that it would be very lengthy to explain all changes and how would the public review it. Administrator Statz stated that the actual changes were contained in the previous packet, that they would be available to the public at City Hall or if requested. Council Member King stated that if he was present at the previous meeting, he would not have voted in favor of adoption of the amendments. Motion by Council Member Koski, seconded by Council Member Lakso to Approve Res. #22-028, Approving Summary Publication of Ordinance #125, Second Series – Storm Water Management All in favor. Motion carried. IX. NEW BUSINESS 1. Anoka County Recycling Contract City Clerk Bender appeared before Council and stated that the contract before them this evening is City City’s request for SCORE Fund for the upcoming year. She also stated that the contract is renewed annually and is customary. She reported that additional programs/offerings were taken into consideration and enhancements such as additional containers being installed throughout the parks for the upcoming year. The amount that they are requesting from Anoka County is $41,671.50. Motion by Council Member Koski, seconded by Council Member Lakso to Approve the 2023 Agreement Residential Recycling Program with Anoka County Contract# C0009406 as presented. All in favor. Motion carried. 2. Council Meeting Schedule a. Scheduling Special City Council Meeting on Wednesday, November 16, 2022 at 6:00 p.m. to canvas election results. b. Cancellation of November 23, 2022 City Council Meeting and Work Session c. Addition of Work Session to December 14, 2022 City Council Meeting Administrator Statz stated that Staff is recommending that scheduling a Special Council on Wednesday, November 16, 2022 at 6:00 p.m. for canvassing election results. He stated that the time frame of this does not align with our regular council meeting. Mayor Love stated that he is not available November 16, but would be available November 15. Mayor Love stated that there will be four Council Members available that day to canvas the results. Mayor Love stated that he will be talking about scheduling our City Administrator’s Performance Review and work on that meeting in next few weeks and find opportunity to get done. Motion by Council Member King, seconded by Council Member Mosher to Approve the Scheduling of Special City Council Meeting on Wednesday, November 16, 2022 at 6:00 pm to canvas the election results, as presented. All in favor. Motion carried. Administrator Statz asked if Council was comfortable with cancelling the November 23, 2022 Council Page 4 of 7 City of Centerville City Council Meeting Minutes October 12, 2022 meeting as it falls on the day before Thanksgiving. If needed, an emergency meeting could be called. Administrator Statz also recommended cancelling the November 9, 2022 scheduled work session as a Veteran’s Day Event was scheduled prior to the meeting and recommended scheduling it for December 14, 2022. Motion by Council Member Lakso, seconded by Council Member Mosher to Approve the Cancellation of the November 23, 2022 City Council Meeting and Work Session, as presented. All in favor. Motion carried. Administrator Statz asked to move the work session to be schedule for December 14, 2022 at 5:00 p.m. just prior to the City Council Meeting. Mayor Love asked why they were not considering cancelling the second meeting in December. Administrator Statz stated that in the past, the date scheduled could be cancelled on a later date but if determined needed it is scheduled. Motion by Council Member Lakso, seconded by Council Member Koski to Approve the Addition of Work Session to December 14, 2022 City Council Meeting, as presented. All in favor. Motion carried. 3. Waiver of Service of Summons – Outlot A: Rehbein Commercial Attorney Glaser explained that there is an issue with the lines on Outlot A and asked Rehbein Commercial to sue the City, (a friendly lawsuit). He is asking Council to authorize Staff to accept the services of the legal process and voluntarily default in a legal action brought by R&R Leasing (aka Rehbein). He stated that Rehbein is correcting legal issues with lots at the corner of 21st and Main and they must use a legal action to register a lot as Torrens property. He stated that the City spotted this problem and required Rehbein to use this legal action as a condition of their Development Agreement with the City. This legal action will allow Rehbein to combine lots. Ultimately, these lot combinations will facilitate future development of the site. Attorney Glaser stated that he has examined the title to this property and confirmed that the City does not have any issue or objection to this action by Rehbein. He stated that this will save money for all parties. Motion by Council Member Koski, seconded by Council Member King of the Approve of Waiver of Service of Summons from Rehbein – Outlot A; Rehbein Commercial, as presented. All in favor. Motion carried. X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1. Administrator/Engineer Report – Administrator Statz stated that his Administrator’s Report was included in the packet and that he would be happy to answer any questions. He reported on Elections, Planning & Zoning, the Parks Department is looking for a member, Trunk or Treat Event, the website up and running. He stated that we have Veterans’ ceremony planned before the November 9 meeting. He stated that there will be a display in council chambers in the display window where some local veterans lent some items and Anoka County Historical Society is helping with that and give our Veterans the honor that they deserve. This takes place at 5:00 on November 9, 2022. He stated this week was Fire Prevention Week with was highlighted in Centerville Cares tips for family. Administrator Page 5 of 7 City of Centerville City Council Meeting Minutes October 12, 2022 Statz stated that Mr. Montain brought new AED. We were awarded grant to by all new AEDs for and City Hall and PD and other public buildings. He reported that half of the City was paved in the last two weeks explaining that with the City projects and the completion of Michaud Way, Fairview Street and Sutton Transport paving their parking lot there was a large amount of asphalt laid. He stated that City Hall received an additional handicap parking space and moved Purple Heart parking space. He reported that Kwik Trip is going up rapidly and Amazon is moving along. Assistant City Administrator Lewis - EDA would be having a vacancy shortly and its posting would happen the following week. Junior Council Member Peterson reported that the Cougars won the homecoming game and that the Boy’s and Girl’s Soccer teams would be headed to section playoffs. 2. Council Reports a. Lakso -  Parks & Recreation – Council Member Lakso stated that the Volunteer Appreciation Event would be held shortly and that her schedule did not allow her attendance of the meeting. She stated that Alternate, Council Member King would provide a report.  Anoka County Fire Protection Council – No report was given. b. Koski – Council Member Koski thanked Battalion Chief Montain for his work associated with obtaining grants that benefit the residents of Centerville and Circle Pines.  Planning & Zoning Commission – Council Member Koski stated that Amazon was looking to change landscaping on the fence by adding barbed wire. He stated that barbed wire fencing in not allow by code that that their representatives may come back with an alternative request. Administrator Statz stated that they could ask because of PUD and could accommodate because of relaxed code. He stated that there has been discussion regarding discharge of firearms and modifications to the code.  Fire Steering Committee – c. King -  Economic Development Authority – Council Member King reported that a restaurant had recently shown interest in Centerville, that the Business Appreciation Event took place and approximately eight (8) businesses attended with Anoka County Open to Business on hand to discuss the economic climate and business assistance, the Committee held interviews for a vacancy and Ms. Chris Swenson was appointed and that Anoka County Regional Economic Development had a new director, Mr. Gregory Frahm-Gilles.  Fire Steering Committee – Council Member King gave no report.  Parks & Recreation Committee – Council Member King stated that Mr. Jacob Hart, rd provided the Committee with a presentation for a crosswalk to be located at 73 Street th and 20 Avenue. He provided statistics and possible crossing that could be utilized. He stated that he will be attending college and works on the other side of the freeway. He thth stated that crossing 20 Avenue is extremely dangerous. Mr. Hart was aware that 20 Page 6 of 7 City of Centerville City Council Meeting Minutes October 12, 2022 Avenue was a County Road, but requested that support be given to the County from both the Committee and Council. Council Member King reported that the Volunteer Appreciation Event was scheduled for October 25, 2022 at 6:30 p.m. and that the Trunk or Treat Event co-sponsored by the Committee and EDA would be taking place on October 29, 2022 from 10-12 p.m. at the school. d. Mosher -  Economic Development Authority – No report was given.  Police Governing Board – No report was given. e. Love – Mayor Love reported that he attended a local Chili contest and the Business Appreciation Event. He thanked staff for their involvement in organizing. He stated that he would be attending nd the Norbella grand opening and visiting with 2 Graders at the Elementary School. He also reported that he would be visiting with the High School football team prior to their game on Friday. He wished the Boy’s and Girl’s soccer teams the best in their upcoming games.  North Metro Telecommunications Commission – No report was given.  Police Governing Board – No report was given.  Other Mayoral Reports - No report was given.
