Ordinance Review - Ord. #130 Section 130.03 Discharge of Firearms
BACKGROUND AND SUPPLEMENTAL INFORMATION:
For a number of months, the Planning and Zoning Commission has been discussing potential changes to city
code surrounding the use of firearms. The initial intent was to simplify the code to make it easier for police
officers to communicate with the public on what is allowed and what is not. The current code allows the
discharge of firearms, with several notable restrictions. This web of restrictions can be complicated and up to
interpretation. In October, our City Attorney attended a meeting and discussed issues with outright bans on the
discharge of firearms. Now, a recent ruling by the US Supreme Court may make restricting gun use more
difficult. Mr. Glaser (City Attorney) has prepared a memo with his recommendations surrounding any changes
to our ordinances.

SUMMARY:
I recommend the Commission delay ordinance revisions regulating firearms unless the
Commission feels there is a public safety need to make revisions at this time.
DISCUSSION:
The U.S. Supreme Court recently dismissed a state law regulating firearms. In an opinion
written by the CourtÔs new majority of conservative justices, the Court indicated a
willingness to change the state of the law regarding the regulation of firearms. The relevant
law is now in a state of flux and appears as if it may change greatly from its current state.
The practical course of action is to wait until the courts have settled issues related to the
regulation of firearms before the Commission recommends revisions to the CityÔs
ordinances on the subject. I also recommend the Commission wait on these revisions in
order to reduce the risk of litigation.
One of my primary functions as a City Attorney is to avoid seeing the City embroiled in
litigation. The timing of when a City changes an ordinance can make it more likely to attract
litigation Ï especially when the law is in a state of flux and people are looking for a case to
test the unsettled law. Therefore, I also recommend the City take a wait and see attitude
before changing its ordinance as a means to reduce the risk of attracting potential litigation.
The CommissionÔs options are to either wait a few years before changing the ordinance,
draft something now and revisit it in a few years, or draft something in anticipation of the
court's rulings (which appear to remove most firearms regulation). I recommend waiting.

proposed ordinance restricting the discharge of firearms.

Temporary Dwellings and Structures
BACKGROUND AND SUPPLEMENTAL INFORMATION:
At their last meeting, the Planning and Zoning Commission reviewed the city's ordinance on Temporary
Dwellings and Structures. Staff was asked to bring back some language that allows temporary occupancy and a
incorporates provisions for proper notification to the city, compliance, and non-compliance. A summary of
proposed revisions is included in the packet, along with a marked-up draft and clean copy of the ordinance.

REQUESTED ACTION:
If the Commission wishes to further explore changes to the ordinance then a motion for a public hearing is
needed.

Site Plan Review - Amazon Electric Vehicle Charging Stations
BACKGROUND AND SUPPLEMENTAL INFORMATION:
As part of the approved Conditional Use Permit for a Planned Unit Development for Amazon, a requirement
was added to have the installation of Electric Vehicle (EV) Charging Stations come back to the Planning
Commission as part of a Site Plan Review. The approved plan included conduits for the EV equipment but did
not include details on the above-ground equipment, since Amazon had not yet committed to installing and using
EVs. Recently, Amazon contacted city staff and is now ready to install a number of EV Charging Stations.
Information provided does not indicate any issues with noise, stray voltage or other nuisance issues. The
electrical service to the site was designed to accommodate this electrical load and should not affect the local
grid's ability to serve the city.

2023 Planning and Zoning Commission Meeting Calendar
BACKGROUND AND SUPPLEMENTAL INFORMATION:
The Planning and Zoning Commission meets on the 1st Tuesday of the month, at 6:30 PM at City Hall for its
regular meetings. The commission should examine the calendar and determine if there are any of those
regularly scheduled meetings which should be rescheduled.
Staff would like the commission to consider moving the January 3 meeting back one week due to holiday
interruptions which will make packet assembly difficult. We would also point out the conflict for the July
meeting with the Independence Day Holiday. We are already showing that meeting as being moved to the
following week, but are open to discussion.

VI. OLD BUSINESS
1.Review of Designated No Parking Areas
Administrator Statz opened the discussion about designated no parking areas, noting that there is no
legal reason the city would need to designate no parking areas. Designated no parking areas are
typically adopted as a requirement of state aid highway and county aid highway funding that is
available in cities with populations over 5,000. The reason the P&Z is reviewing designated no
parking areas is because the city has designated no parking areas in the past; it’s also timely to
review these areas with the recent reconstruction of downtown. Administrator Statz reviewed the

no parking areas listed provided in the packet, noting any changes. The list will be updated and
brought back to the Commission for further consideration.
VII. NEW BUSINESS
1.Ordinance Review - §156.104 Temporary Dwellings & Structures
Assistant Administrator Lewis opened the discussion on Chapter 156.104 of the Zoning Ordinance,
noting that the Commission discussed the ordinance in 2020 and there has been renewed interest in
occupying temporary dwellings over the last couple of months. Assistant Administrator Lewis
reviewed what the cities of Lino Lakes, Hugo, Circle Pines and Lexington are allowing, as well as
concerns raised by staff (safety, enforcement, permitting, public health). Assistant Administrator
Lewis also reviewed a draft of proposed language (red-lined version). Discussion ensued and points
of interest include registration, type of structure (tent versus recreational vehicle), length of time,
permitting, compliance and non-compliance. The consensus is that the board supports allowing
overnight stays in recreational vehicles for a short period of time (14 days). The Commission would,
however, like to ensure the ordinance has strong language around enforcement, proper notification
to the city, compliance, and orderly conduct. Staff will discuss the ordinance internally and present
another draft to the Commission for their review at the December P&Z meeting. The Commission
will hold a public hearing on this ordinance in the near future.

hearing on the ordinance. All in favor. Motion carried.
There was a friendly amendment to the motion to have the public hearing at the next available
time – public hearings require public notice requirements.

Councilmember Koski reported that volunteer appreciation, held on October 25 went well. He also

reported that the Fire Steering Committee met on October 20 and the budget was discussed; in
particular the cost of fire trucks has significantly increased and there is a waiting period.
Councilmember Koski also discussed an apartment proposal came before the city council at their
last work session.
2.Administrator’s Report
The following items were added to the Administrator’s Report.
a.Letters of Interest for 2023
Administrator Statz reported that per city ordinance, commissioners are required to sign letters of
interest each year confirming their commitment to serve for the following year. Letters were
distributed to commissioners for their signature.

b.21 Avenue Apartment – Concept Plan
A Concept plan for 109-unit apartment building was presented to the city council at their October
work session. The proposed project is on the lot north of the new Norbella facility on a 5-acre site.
There is a small retail component included in the proposed project and there was no vote taken by
the council. Administrator Statz noted that if there is a submittal they will come before the Planning
and Zoning Commission.
c.Moratoriums
Administrator Statz reported that the city council enacted a moratorium on the sale of cannabis and
THC products, so the city would have more time to study this before further legislative action.
Administrator Statz reported that the city council enacted a moratorium on new medical facilities
that unfairly burden the taxpayers. (i.e. Understaffed facilities calling 911 to assist staff with
patients). The moratorium allows staff to study this issue before further legislative action.
d.Planning & Zoning Action Items Tracker
Administrator Statz reviewed the Planning & Zoning Action Items Tracker sheet as presented in the
packet. This tracking sheet is relatively new and intended to help commissioners stay updated on
their activity; the tracking sheet is not meant to serve as another agenda for meetings.

On Wednesday, November 3, staff/Election Judges assisted 19 voters in the Absentee – Envelope phase
of the voting process and released custody of those ballots to Anoka County for running through their
counting equipment per State Statute. The same staff/Election Judges have assisted 137 voters in
theAbsentee – Direct Balloting phase. These results will be modemed to Anoka County on Monday
eveningfollowing the close of the process at 5 p.m.
PARKS AND RECREATION
Halloween Hustle 5K/Trunk or Treat Event
The Parks & Recreation Committee/EDA’s first ever event “Trunk or
Treat” event was held on October 29, 2022 at the Centerville Elementary
School following the Centennial Community Educations Halloween 5K
Hustle. The weather was pleasant and some of the Trunks reported over
200 kids participated. The Committee and EDA would
like to extend their gratitude to all that participated. A
special thank goes to those that handed out candy and
promotional items: Carbone’s; the Parks & Recreation
Committee; Centerville Lions; Cubscout Pack 3065, who
brought their inflatable archery; Chef Hot Hands; the Bald
Eagle Water Ski Club; J-Mar Builders Home Improvement,
LLC, who brought a live chicken; Laurie’s School of Dance;
the City of Centerville, for providing a snowplow; M Health
Fairview, for providing an ambulance and crew; and the Centennial Fire District
for providing a fire engine.
Volunteer Appreciation Event
The event took place on October 25, 2022. Volunteers from the Scouts, the Planning & Zoning
Commission, Parks & Recreation Committee, City Council, election judges, park monument volunteers,
5/8K run volunteers, Music in the Park and the Bald Eagle Water Ski Club were represented by individuals
that attended. The Mayor and Council Member Koski attended and spoke with volunteers expressing the
city’s appreciation for their donated time and stating that the city is a better place because of them.
Volunteers were provided a meal, refreshments and cookies along with the opportunity to network with
other volunteers.

Ordinance Reviews
Nuisances – Diseased Trees
The Commission will revisit its suggested language changes to the diseased tree section of the city’s nuisance
ordinance. At the City Council’s October 12 meeting, there were questions raised about the suggested language
and existing code language regarding the authority of the designated staff person who would determine if trees were
dead, dying or diseased. The Council tabled the proposed ordinance change to allow staff and the Planning
Commission to address these concerns. The issue will be discussed at the December 6 P&Z Commission meeting.
Temporary Dwellings and Structures
With input from the city’s Building Official, Police Chief and Fire Inspector, the Commission examined the city’s
code regarding Temporary Dwellings and Structures. There was consensus that temporary occupancy, with proper
notification to the city, and compliance with city code is okay; the Commission discussed adding language
pertaining to permitting, enforcement, non-conforming conditions. The Commission will hold a public hearing at
the next available Planning and Zoning Commission meeting.
No Parking Areas Review
At their November 1 meeting, the Planning and Zoning Commission reviewed a map of the City’s existing no
parking areas and designated parking areas, as well as parking on one side of the street, etc. This was brought to the
Planning and Zoning Commission for discussion because of the recent reconstruction of downtown; post-
construction, there may be room for parking on one side of the street. Previously in downtown, the streets were very
narrow, there was no curb and gutter, and a mix of no parking areas. The Commission discussed overnight parking,
seasonal overnight parking, no parking areas, designated parking areas, and signage. The Commission agreed to
bring this item back for discussion in December and hold a public hearing in January or February.
Amazon Fence Change Request
The city has received communication from Amazon’s representatives that they do not intend to seek changes to the
Conditional Use Permit for a Planed Unit Development to allow the addition of barbed wire to their planned fence
around the truck docks on the west side of the building.
CENTERVILLE CARES
We would like to express our sincere appreciation to the veterans who have served this country. We thank
you for your time, bravery and sacrifice, for which we will be forever grateful. We hope that you will
partake in the many veterans day cermonies in the area, and we would love to see you at our celebration
on November 9 from 5pm-7pm (see the invitation above).
We would also like to let veterans know that there are many resources available, and we have professionals
in the area who can help. In Anoka County, veterans can contact a County Veteran Services Officers
(CVSO’s) who can assist help veterans and their families undertand state and federal benefits. CVSO’s
stay up to date on State and Federal regulations and they are eager to help.
The Anoka County Veterans Office is open to in-person services, by appointment. To meet with a Veteran

Centennial Elementary School Mayoral Visit
Mayor D. Love recently visited Centennial Elementary School to talk
with second graders about what he does as mayor. The spoke about
his role as mayor and as part of the city council.
The kids were very engaged and asked a lot of really great questions.
Everyone had a great time with Mayor Love and from the picture
shown on the left, it’s hard to tell who’s having more fun – mayor
Love or the second graders who are all paying close attention to the
mayor.
Mayor for A Day Essay Contest
The League of Minnesota Cities (LMC) has announced
that the Mayor for a Day Essay Contest is Back. School-
aged children in grades four, five, and six are being asked
to submit essays explaining what they would do for a day
as mayor. The winner will win $100.00 and the
opportunity to have their essay published in Minnesota
Cities Magazine. Essays can be submitted online, printed

Project Map
Staff has prepared a map of all active developments to help everyone get a better picture of what’s
happening around our community. The number you see at the heading of each item in this section
corresponds to a number on the map, which is attached to the end of this report.
(9) Block 7 Property (Downtown)
The city approved a purchase agreement with a developer (Schifsky Companies) who continues to explore
the viability of the site for a townhome style development. City staff continues to provide information to
the prospective developer as questions come up.

(3)(4) Old Mill Estates 1 and 2 Additions
The developer has finished black dirt and seed work in boulevards and around ponds. They continue to
work to finalize wetland and other watershed permits.
Construction of the gravel base for the trail between Old Mill Court and Laramee Lane is now complete.
Concrete work will be completed in the spring to ensure the base has a chance to settle over the winter.
(16) Centerville Self Storage
The facility is now open for business. The developer has made progress to address drainage issues along
the north side of the facility and will continue to work on minor clean-up items.
(1) Bay View Villas (Waterworks Site)
The developer’s landscaping crew has finished sod work near the cul-de-sac and has just a few items
from the punch list remaining.
(8) Atlas Villas Memory Care Project (1825 Main Street)
Details for a late November open house are being finalized.
(10-14) Rehbein Commercial

The sidewalk on the north side of Main Street, between 20 Avenue and 21 Avenue will be graded in
the coming weeks and if weather permits, the concrete will be poured. Other punch list items remain.
(13) Kwik Trip
Construction on the building and site continues. Concrete pavement installation is in full swing now that

(19) Sutton Transport
The 50,000 square foot trucking and warehousing facility is now fully operational with a few dozen

(15) 2050/2070 Main Street – American Roofing Supply
The rehabilitation of the once-vacant, 40,000 sf building on Main Street is not complete and American
Roofing Supply is up and fully operational. Welcome to Centerville!
(18) Max Storage (Fairview Street)
A building permit has now been issued for construction of Building #1 of 2. The developers expect their
contractor to be on site within a week or so.
(17) Amazon Fulfillment Center
Foundation work on the main building is now complete. Site work continues, including pond grading,
parking lot construction and small utility installation.
A kick-off meeting for the Corridor Study has been held. The study will prioritize area-wide transportation
improvements to address increased traffic from Amazon and surrounding growth. The study will examine

20th Avenue from Birch Street to 80th Avenue, and the intersection of 21 Ave. and Main Street.
PUBLIC WORKS
Commercial Water Connection Fee Assistance
At the last City Council meeting, the Council voted to extend the program through the end of 2023. The
program offers half-priced hook-up charges for businesses hooking to city water.
Wellhead Protection Plan
The Minnesota Department of Health held a kick-off meeting with city staff and consultants for the
implementation of the city’s Part-2 Wellhead Protection Plan. The group reviewed items in the documents
and the timelines associated with various activities. Staff will be following up on the action items over
the course of the next few months.
Well #2 Repairs
City staff has applied for a reimbursement grant from Xcel Energy for the installation of the Variable
Frequency Drive (VFD), used in the repairs for Well #2.
2022 Thin Overlay Program and City Hall Parking Lot Improvements
An Assessment Hearing will be scheduled in January to finalize individual assessments for the overlay
portions of the project.
City Hall Parking Lot Lighting
The City Council reviewed and approved plans for proposed lighting at City Hall. The work would be
quoted for construction in the spring of 2023 in an effort to allow time to secure a grant through the
Occupational Safety and Health Administration (OSHA).
