HomeMy WebLinkAbout2022-10-04 P & Z Minutes - Approved Approved CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the Regular Meeting of the Planning and Zoning Commission held in Council Chambers on Tuesday, October 4, 2022 at 6:30 p.m. I. CALL TO ORDER The meeting was called to order at 6:30p.m. 1. Roll Call Present: Chair David Kubat Vice-Chair Krueger Commissioner Darrell (DJ) Olson, Jr. Commissioner Richard Nelson Commissioner Les Kuiper Commissioner Bruce Thompson Absent: Commissioner Gloria Semmelink Staff: City Administrator, Mark Statz Council Liaison, Russ Koski II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA The agenda was approved as presented. Motion by Commissioner Thompson, seconded by Commissioner Kuiper to Approve the amended Agenda. All in favor. Motion carried. IV. PUBLIC HEARINGS (6:34 PM or shortly thereafter) None V. AWARDS, PRESENTATIONS, APPEARANES None VI. OLD BUSINESS 1. Ord. #130, Section 130.03 – Discharge of Firearms – Kurt Glasser Administrator Statz introduced the item, noting that the ordinance is being reviewed because the city receives calls from residents who are concerned about safety; inquiries often refer to activities like duck hunting within the city limits and using bows and arrows in backyards, etc. Attorney Glasser noted that there are overlapping regulations and second amendment rights to consider as revisions are made. Discussion ensued about banning the discharge of firearms and projectiles versus restricting and/or regulating them. Points of interest include designating hunting areas (the lake, certain areas of the city, etc.). Attorney Glasser suggested using language that nearby cities Page 1 of 3 City of Centerville Planning and Zoning Commission October 04, 2022 have and filling in the variables; for example, the city could add language that bans hunting, except on the lake or parcel greater than 40 acres and with the owner’s permission; an overlay to this could be that there must be a 750 ft radius from structure, parks public land or right-of-way or boundary to a parcel. Attorney Glasser mentioned looking at the City of Lino Lakes’ language to ensure consistency in regulations with the Department of Natural Resources (DNR), noting that this could make enforcement easier. Chair Kubat reviewed that the Board would like to continue supporting hunting on the lakes, not in an agricultural area. There is also a consensus for a prohibition related to distance from lot lines and structures. Finally, there is consensus to use the State Statute for archery, muzzle loader and firearms. Attorney Glasser will revise the ordinance and this item will be brought back to the P&Z for further discussion. VII. NEW BUSINESS 1. Fence Plan Revisions – Amazon This item was discussed out of order, before Old Business. Administrator Statz introduced this item, noting that Amazon is requesting a variation in their fence plan. Amazon would like to install barbed wire on top of the 8ft security fence for the truck court. The City Code prohibits barbed wire and electric fences, except in the R-1 District and then may only be used in conjunction with agricultural activities. Also, fencing in commercial/industrial zoning districts shall not exceed 8 ft in height. A PUD allows some flexibility. Discussion ensued and members had mixed opinions about whether to amend the PUD. Reasons include aesthetics and safety. The representative for Amazon will take feedback received back to Amazon. No formal motion was made by the P&Z at this time. VIII. APPROVAL OF MINUTES 1. September 13, 2022 Planning & Zoning Commission Meeting Minutes The minutes were tabled because the section on the discharge of firearms was not included in them. The minutes will be revised and then brought back for approval. Motion by Chair Kubat, seconded by Commissioner Thompson to table the September 13, 2022 Planning and Zoning Commission minutes to amend them to include the discussion on the Discharge of Firearms. All in favor. Motion carried. IX. Announcements and Updates 1. Council Member Liaison Councilmember Koski reported that it is budget time and the city just approved a 3.7% levy increase for 2023. The increase is due to public safety and the loss of Local Government Aid (LGA). 2. Administrator’s Report City Administrator Statz reviewed the administrator’s report as presented, highlighting that Page 2 of 3 City of Centerville Planning and Zoning Commission October 04, 2022 voting participation is good – there have been about thirty (30) people so far. Administrator Statz also announced board vacancies and upcoming events: Trunk or Treat, Volunteer Appreciation, and Veterans Day. Administrator Statz also reviewed the P&Z tracker that was recently created. X. ADJOURNMENT Motion by Commissioner Kuiper, seconded by Commissioner Olson to adjourn the meeting at 8:27 p.m. All in favor. Motion carried. Page 3 of 3
