The attached, proposes a 3-year contract extension. There are two options presented, with increases in pricing earlier or later in the contract term, respectively. If the City Council finds one of these proposals acceptable, staff will move forward with drafting an official contract extension for consideration at an upcoming meeting. If not, we will need to move forward with drafting and distributing a request for proposals (RFP). COST AND SOURCE(S) OF FUNDING: No direct cost to the city. (I understand that you may not be working today) Please know that this is the lowest pricing we can offer the City of Centerville and based on market rates, both options are highly competitive. Since I provided the market comps in October, Brooklyn Park awarded Waste Management (incumbent) their recycling contract; WM was awarded an increase of an additional $1 per HH PLUS a Recycling Processing offset fee. Eureka also submitted a proposal, $6.73/HH for every other week recycling service. That rate may appear to be high but the startup costs (carts, trucks, drivers) have increased, along with the industry cost increases, and it’s simply not the same market it was 5 years ago when the City of Centerville went out for RFP . The project contained two lots of record (2050 and 2070). The lot at 2050 had already paid a park dedication fee when it was constructed. This fee was based on the square footage of property at 2070 Main Street, which had never paid a park fee. Curtis Ventures (the developer and land owner) is appealing the decision to pay this fee. Details of their appeal can be found in supporting documentation attached hereto. The City Council acts as an Appeal Board when someone feels that city staff has improperly applied the city code to an administrative decision. The development world has been busy and occupying my time. The original building permit for 2050 Main Street notes that a park fee was paid ($750) for that lot (see attached). However, since no building permit was ever issued for 2070 Main Street, a park fee was never charged. The park fee charged with your recent project is only applicable to 2070 Main Street (charged at the current fee of $2175/acre). This did not include any acreage from the 2050 lot. With this payment, there will be no further park dedication fee due if 2070 was to ever have a building constructed on it. The fee of $2175/acre is the more favorable, for you, of the two ways of calculating the park dedication fee, with the other being 10% of the value of the land. A park dedication fee of $5, 850.75 was imposed on a recent building permit because a fee was never collected on the undeveloped lot pictured on the right. The Council hears these appeals. ISSUE: The Buyer does not question that a fee is owed, he is claiming that he is not the party who must pay it. The Buyer already paid this fee to the City. He now asks for a refund. Many years ago, a park dedication fee was paid for the parcel on the left (as pictured) at the time the building permit was issued. At that time, the lot on the right remained undeveloped and no park dedication fee was paid until now. RULE: State law allows cities to impose park dedication fees. The law encourages cities to impose those on the party subdividing the property but cities are free to set their own standards for imposing and collecting these fees. Centerville traditionally allowed the party subdividing the property to either transfer that fee to other parties or wait until the time of building permit before collecting the fee. The City ordinance governing this question has changed throughout the years since fees were first collected on the “left” parcel of this property but the law always allowed for collection of the fee at times other than when the property was subdivided. ANALYSIS: The law allows for collection of a park dedication fee by the party who subdivides the property or by others in the chain of ownership. No park dedication fees have been paid for the parcel in question. When the Buyer’s developer asked for a building permit, this park dedication fee appeared on the permit and was paid. Prior to his purchase of the property, the Buyer’s closing company asked the City only to disclose whether there were any pending assessments against the property. The City accurately answered that question in the negative. Had the Buyer or his representative ask the City whether there were any unpaid fees on the property the City would have answered in the affirmative by disclosing the unpaid park dedication fee. Had the Buyer or his representatives properly conducted their pre-sale due diligence, this unpaid park dedication fee would have been apparent to them. This failure of pre-sale due diligence may leave the Buyer with recourse for collection of this fee from the Seller or the Buyer’s closing company. Accordingly, this fee was duly imposed and accurately collected by the City. I do not recommend offering the Buyer a refund. CURRENT CITY ORDINANCE § 153.15 GENERAL. Subdivision design shall comply with the following general design standards: (B)Land dedication. In all subdivisions, ten percent of the gross area subdivided shall be dedicated for public recreation space, with this ten percent being in addition to property dedicated for streets, alleys, easements, or other public ways. No areas may be dedicated for public use until the areas have been approved as being suitable and needed for the public health, safety, convenience and/or general welfare. If the city decides that real property dedication is not needed, or less than 10% of the real property is needed for dedication, the subdivider shall be required to pay a Park Dedication fee as per the schedule in effect at the time of Preliminary Plat approval in lieu of such dedication. The payment of the fee shall be due in conjunction with the recording of the plat. By agreement, the city may allow the subdivider to delay payment of Park Dedication Fees to the time of the building permit issuance on each lot. However, the agreement must hold the subdivider ultimately responsible for the payment of those fees if not paid by the builder. An escrow or other security may be required to secure those funds. For multi- family projects, each unit will be construed to be the equivalent of a “lot”. For group- living situations such as group homes, nursing homes and the like, each bed will be construed to be the equivalent of one-half (½) lot. He also stated that he is considering a career as an Electrician and joining the National Guard. He also stated that he enjoyed politics. He stated that his goal is staying true to the Constitution and not averting from its fundamental values. Discussion ensued regarding likes in music, controversy and handling of same, listening skills, hearing of the program through his History teacher, showing interest and a recommendation coming from the Principal. Discussion also took place regarding pay or a scholarship for the position. Outgoing Jr. Council Member Peterson stated that he would agree with compensation in some sort of form for the position. City of Centerville WS, City Council & Closed Exec. Meeting Minutes December 14, 2022 Council thanked Mr. Shaw for his interest in the position and attending this evening. 2. Staff Benefits – Cafeteria Plan Administrator Statz stated that he felt that the item would be best addressed at a Work Session so concerns if any could be discussed. He stated that employees are covered through a Cafeteria Plan that includes health, dental, minimal life, short and long term disability insurance coverage. He explained that each employee is given an allotment per month to fund those benefits at a single level. He also explained that several employees hired prior to a date may chose for excess funding to be placed in a Deferred Compensation account. He reported that employees also participate in a Health Care Savings Plan as they are covered under a High Deductible Plan which allows for this practice. He stated that with increases in health insurance and staff not receiving increases in the recent past that it seemed appropriate to increase the allotment to $1,100 which would be an increase of $100/employee. He stated that research was completed and that Centerville’s allotment was at the lower end as surrounding communities are approximately $1,300 – 1,400. Discussion ensued regarding partial funding, Union contract language, amounts paid annually, budget implications and consideration at the regular meeting. 3. Garbage & Recycling Contract Administrator Statz stated that Ms. Beverly Mathiasen, Municipal Services Manager, appeared before the Council the previous month and provided a large amount of information, including approximately a 15% increase in trash rates and 33% increase in recycling rates if the City where to choose an extension rather than going out for Requests for Proposals (RFPs) for 2024 and beyond with Republic Services. Discussion ensued regarding costs, economy, net sale of commodities, tipping fees, a new vendor with cart delivery, possible different collection days, servicing philosophies, etc. Possibilities for a year extension and associated pricing and providing Republic with an additional opportunity for another proposal. Administrator Statz will report back with additional information for Council consideration. 4. City Council Retreat Administrator Statz stated that he desired to have a strategy for a retreat with ideas of discussion being population 5,000, downtown redevelopment/EDA market study, Strategic Plan, etc. He stated that all current Council will be serving for at least two (2) more years. He also gave a brief update of hiring a facilitator in the past with the potential for same for 2023. It was discussed that the retreat take place in February or March coinciding with the market study initiated by the Economic Development Authority. 5. Final 2023 Budget Items & Levy Buy-Down Scenarios Discussion Administrator Statz stated that this will be Council’s last opportunity to make changes (decreases) from the proposed 3.7% levy increase for 2023. He stated that Finance Director DeJong would discuss additional opportunities for options for decreasing the levy if Council desired. Page 2 of 11 City of Centerville WS, City Council & Closed Exec. He stated that this evening’s meeting does not have to do with property values. He stated that Finance Director DeJong would be providing the presentation and as stated during the Work Session it was stated that a Preliminary 2023 Budget & Levy were set in September and amounts could not increase but decrease. Finance Director DeJong reviewed the presented materials contained in Council’s packet and answered questions. Discussion ensued regarding new properties and their placement on the tax rolls, placement being delayed due to the County’s procedures and completion of building, engineering fees for new construction which are typically covered by the developer being removed from the budget, bonds, debt service and interest and half of the budget being due to public safety. Mayor Love desired to draw attention to the loss of Local Government Aid and the importance of living in a safe community. He explained that the previous ordinance called for a $50/day fee which seemed unreasonable if utilized for a lengthy period. He stated that the fee was changed to $50 for the first day and $5/day for each additional. He also stated that a change in sewer fees and structure were made to more align charges that the City receives from Metropolitan Council for treatment. Council Member King requested clarification on “Phase I” of a tree inventory which would mean that a Phase II would also be coming in the future. Administrator Statz stated that at this time, the Committee was recommending an inventory within the park areas that were open and not those that were wooded which may come in the future. He stated that the inventory would contain the species, size, GPS coordinates, etc. He stated that the intent of the inventory would be to ascertain the information which would assist in diversification, planning, purchasing, etc. Council Liaison Lakso to the Parks & Recreation Committee stated that the “Phase I” portion is part of a larger tree management plan which would take into consideration Emerald Ash Borer and associated ramifications to all areas within the parks. Administrator Statz stated completion of Phase I would be completed first and consideration in the future for Phase II of which would come before Council for consideration. Council Member Koski stated that he appreciated the comments on both items from Council Member King as the more he listens to those same comments it assists all in clarification and thoughts/recommendation. Res. #22-0XX – Adopting Final Property Tax Levy and Budget Finance Director DeJong stated that the 2023 Budget and Tax Levy were reasonable, affordable and responsible for the long-term health of the City. Mayor Love stated that Council had robust conversations throughout the process with Staff addressing concerns and making adjustments throughout. Brief discussion was had regarding buy down proposals submitted during the Work Session, new construction coming on the tax rolls for 2024, lack of public participation in the 2023 Budget & Truth- in-Taxation Public Hearing, Council and Staff’s due diligence and anticipation for lower tax amounts in the future. Additional brief discussion was held regarding the removal of Local Government Aid and its impacts on City’s. Res. #22-0XX – Declaring the Amount to be Assessed and Directing the City Clerk to Prepare an Assessment Roll Administrator Statz briefly explained the Improvement/Assessment (MN State Statute requirements 429) with Council and stated that all residential properties that were benefited by the 2022 Thin Mill & Overlay Project would receive an assessment of $650/lot. He stated that there were several commercial/public parcels that the assessments were calculated on front footage and their assessments may be slightly higher. Administrator Statz stated that brief discussion was had with several residents prior to awarding the project and during the project, but once clarification was provided along with an estimate of fees affected property owners were comfortable and felt that it was a good return on their money. Discussion ensued regarding the inclusion of the City Hall parking lot potentially being confused with assessments. Administrator Statz stated that Staff has made every attempt to distinguish the fees associated with each project and these assessments do not include that project. Res. #22-0XX – Adopting the 2023 Pay and Benefit Plan Administrator Statz stated that this is an annual resolution for consideration as Union Members usually receive a modest cost of living increase and non-union members generally receive the same. He stated that discussion was held at the Work Session regarding a proposed $100/employee increase in cafeteria allotment which would contain all full-time employees. He also stated that the resolution addressed pay for several part-time positions (i.e. Custodial, Election Judges, Warming House Attendants and seasonal staff). Res. #22-0XX – Supporting Extension of the JLEC Levy Administrator Statz provided a brief summary of the Joint Law Enforcement Commission Levy and stated that it was enacted 10 years ago. He stated that it allowed for such items as dispatch equipment along with other items needed associated with public safety. He stated that there have recently been issues with the County and Members of the Commission but felt that it remained a valuable asset. He stated that it is felt that the levy benefited everyone in the County and should be extended an additional 10 years. He also stated that the City of Centerville was the last city or township to adopt the resolution. He reported that both Chiefs from Centennial Lakes Police and Centennial Fire District were in support of the resolution and the continued levy. Additional discussion took place regarding problems with the current dispatch system, pagers not working and communications. Outgoing Jr. Council Member Peterson stated that serving is a rather large commitment for someone who has homework, needs to attend two meetings per month, works part-time, etc. He stated that he felt compensation of some sort would be good. Discussion ensued that either a scholarship or stipend was discussed upon inception of the program a year ago and should be considered again, an amount of $1,000-$2,000 or amount per meeting attendance, that Mr. Shaw as a great applicant, $50/meeting attended, City Attorney Glaser’s approval of either a scholarship or meeting attendance pay being allowable, making the payment at the end of the term and compensating outgoing Jr. Council Member Peterson also for his service. Motion by Mayor Love, seconded by Council Member Lakso to Appoint Mr. Rowan Shaw as the 2023 Jr. Council Member with a stipend of $50/meeting to be paid at the end of the term and to provide a stipend of $50/meeting attended by outgoing Jr. Council Member Danny Peterson. Discussion ensued regarding if a stipend is determined then it should be paid on a monthly basis for meeting attendance. Discussion also included taxable amounts on the stipend versus scholarship, if a scholarship and distributing payment directly to them a policy would be needed and funding coming from the general fund. Council Member Mosher opposed. Motion carried (4/1). X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1.Administrator/Engineer Report – Administrator Statz stated that the Administrator Report would be coming out shortly but numerous things were happening such as Kwik Trip’s Ribbon Cutting on January 4, 2023 from 10 a.m. – 12 p.m. and the Centerville Lions’ Christmas in the park on Saturday. He stated that he would take questions if Council had any. Junior Council Member Peterson gave an update on the High School sport teams (volleyball, basketball and hockey). Finance Director DeJong stated that from this evening’s meeting to the end of the year regular disbursements would be made and Council would receive them in January. He thanked all service organizations (police, fire, military, etc.) for serving, especially during the holidays. He reported that it was the first event of its kind for the Lions and that approximately 500 individuals attended. He reported that Council Member Koski attended along with Mayor Love and his wife Susan. He believed that the Lions would be holding the event annually going forward. This uncertainty has been cleared up. The mailed notices, correctly showed the proposed assessments, matching those in the assessment roll. The council should now consider adopting the assessment roll for the project. The attached resolution details payment terms. The council may consider lowering, but not raising assessments, from those proposed and may adjust interest rates or the length of repayment to be more favorable to residents. NOW THEREFORE, BEIT RESOLVED BYTHE CITY COUNCILOFCENTERVILLE, MINNESOTA: 1.Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2.Such assessment shall be payable in equal annual installments extending over a period of three (3)years, the first of the installments to be payable on or before the first Monday in January, 2024, and shall bear interest at the rate of five (5) percent per annum from January 1, 2024. To the first installment shall be added interest on the entire assessment from January 1, 2024 until December 31, 2024. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. 3.The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he/she may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. The commission is considering: For RVs Stay up to 14 days/year/parcel w/no winter stays No exchange of money allowed Must have principal structure on lot Must be parked in driveway Self-service permit required For Tents Limited stays No permits necessary A public hearing will be held on March 14 at 6:30 p.m. at City Hall, or you may submit comments at info@centervillemn.com THC Regulations Centerville, along with many cities across the state, issued a moratorium on the sale of THC products after the state legalized edibles in July of 2022, with few restrictions. Those included: 21+ to purchase Max 5 mg/serving, max 50 mg/package No marketing to children As required by a moratorium, the city is studying the issue by talking with our law enforcement and school officials, watching what other cities are doing to see what is working and what is not, and soliciting input from the public. Staff met with the consultant to review the project timeline, establish key deliverable dates, discuss citizen engagement, and provide background information about the city and previous development studies. CENTENNIAL LAKES POLICE DEPARTMENT Our newest police officer, Cole Henjum will be starting his pre-service training on Monday, January th 30. Cole is a graduate of St. Francis High School. Cole earned his bachelor’s degree in criminal justice st from St. Cloud State University, and recently served in the U.S. Army with the 101 Airborne Division at Fort Campbell, Kentucky. While in the Army, Cole was in Ranger School focusing on Tactical Combat Casualty care. We are very pleased to have Cole join our department and we are very excited to work with him in the months and years to come. Welcome to the Centennial Lakes Police Department Cole! CENTENNIAL FIRE DISTRICT Firefighting is a difficult job to begin with, but you can do your part to make it easier by clearing snow from around fire hydrants. This saves precious time for our crews, leading to better outcomes. COMMUNITY DEVELOPMENT Project Map Staff has prepared a map of all active developments to help everyone get a better picture of what’s happening around our community. The number you see at the heading of each item in this section corresponds to a number on the map, which is attached to the end of this report. (9) Block 7 Property (Downtown) The city approved a purchase agreement with a developer (Schifsky Companies) who continues to explore the viability of the site for a townhome style development. City staff recently met with Mr. Schifsky to look at ways to more efficiently engineer the site’s stormwater infrastructure. stnd (3)(4) Old Mill Estates 1 and 2 Additions The developer has finished black dirt and seed work in boulevards and around ponds. They continue to work to finalize wetland and other watershed permits. Construction of the gravel base for the trail between Old Mill Court and Laramee Lane is now complete. Concrete work will be completed in the spring to ensure the base has a chance to settle over the winter. (16) Centerville Self Storage The facility is now open for business. The developer has made progress to address drainage issues along the north side of the facility and will continue to work on minor clean-up items. (1) Bay View Villas (Waterworks Site) The developer’s landscaping crew has finished sod work near the cul-de-sac and has just a few items from the punch list remaining. (10-14) Rehbein Commercial thst The sidewalk on the north side of Main Street, between 20 Avenue and 21 Avenue will be graded and poured in the spring. Other punch list items remain. Record plans have been submitted and reviewed. (13) Kwik Trip Construction is complete with the exception of some punch list items and the sidewalk along Main Street, in the spring. The store is now open! (17, 19) Rehbein Industrial Record Plans for the project have been submitted and reviewed. Once permit closure is achieved, the project can be closed out. (18) Max Storage (Fairview Street) A building permit has now been issued for construction of Building #1 of 2. The developers have decided to wait until spring to begin construction. (17) Amazon Fulfillment Center The building shell is now up and work on the van loading area canopy has begun. Site work will continue in the spring. Interior work on the building continues. A second meeting for the Corridor Study was held on December 12. Stakeholders heard from the consultant on their initial data gathering and analysis. Next steps will be developed, looking at intersection evaluations and other more specific corridor issues. The study will prioritize area-wide transportation improvements to address increased traffic from Amazon and surrounding growth. The study will examine 20th Avenue from st Birch Street to 80th Avenue, and the intersection of 21 Ave. and Main Street. st Work on the 21 Avenue Floodway Impacts study has now been authorized, through an agreement with the Rice Creek Watershed District. PUBLIC WORKS Commercial Water Connection Fee Assistance At the last City Council meeting, the Council voted to extend the program through the end of 2023. The program offers half-priced hook-up charges for businesses hooking to city water. Wellhead Protection Plan The Minnesota Department of Health held a kick-off meeting with city staff and consultants for the implementation of the city’s Part-2 Wellhead Protection Plan. The group reviewed items in the documents and the timelines associated with various activities. Staff will be following up on the action items over the course of the next few months. City staff recently completed final paperwork and receive reimbursement from the Department of Health associated with a grand for sealing of a well in the downtown at no cost to the city or resident. With the completion of this grant, the city can now apply for other grants related to the Wellhead protection plan. 2022 Thin Overlay Program and City Hall Parking Lot Improvements An Assessment Hearing was held on Wednesday, January 25, 2023 at 6:30 p.m. in Council Chambers to finalize individual assessments for the overlay portions of the project. Benefiting/abutting property owners should have received a mailed notice with a specific amount to be assessed. The adoption of the assessment roll was tabled for verification of correct assessment amounts and will again be considered at Council’s February 8, 2023 City Council meeting. Overlay Program City staff have evaluated the roads and determined that no overlay project will be completed in 2023. City Hall Parking Lot Lighting The City Council reviewed and approved plans for proposed lighting at City Hall. The work would be quoted for construction in the spring of 2023 in an effort to allow time to secure a grant through the Occupational Safety and Health Administration (OSHA).
