Ordinance Review - Ord. #130 Section 130.03 Discharge of Firearms
BACKGROUND AND SUPPLEMENTAL INFORMATION:
A public hearing on this proposed ordinance change was held several months ago. However, the City Attorney,
advising against action on this ordinance by the City Council until such time as further case law exists in the
wake of a recent Supreme Court ruling on firearm restrictions.
In an effort to capture the discussions to this point, the Planning Commission has asked staff to prepare a final
version of the ordinance so that it can be "shelved" until the appropriate time. This should help avoid the need
to "start over" when we pick the issue up again.

No direct cost to the city.
REQUESTED ACTION:
Motion to recommend approval of the ordinance amendments, for action by the City Council at an appropriate
time.

SUMMARY:
The following proposed text revises the City’s existing ordinance governing the
discharge of firearms by incorporating input from the Commission and borrowing heavily
from the Lino Lakes ordinance governing the discharge of firearms.
PROPOSED REVISIONS:
§ 130.01(C) DEFINITIONS.
For the purpose of this section, the following definitions shall apply unless the context
clearly indicates or requires a different meaning.
BOW AND ARROW. Pointed tip arrow and bow.
FIREARM. A device designed to be used as a weapon, from which is expelled a
projectile by the force of any explosion or force of combustion.
MUZZLELOADER. A device (long gun or handgun) which cannot be loaded at the
breech of which a smooth-bore muzzleloader used is at least .45 caliber and a rifled
muzzleloader used is at least .40 caliber.
NON-FIREARM. A crossbow, a bow and arrow, pellet gun, BB gun and slingshots,
including wrist rockets.
RIFLE. A shoulder weapon with a rifle bore barrel and discharging a single shot or
pellet at a time.
SHOTGUN. A shoulder weapon with a smooth bored barrel or barrels and normally
discharging more than one pellet at a time, except when using a single slug.
WRITTEN CONSENT. A written record of consent to hunt upon a landowner's
property. The consent shall be signed by the owner and contain the following
information:
(a) Name, address and phone number of the landowner;
(b) Name, address, phone number and date of birth of the hunter;
(c) Description of the land upon which the hunter has consent to hunt and the date
that the consent begins and ends; and
(d) Hunters must have on their person a copy of the written consent with the above
information and picture identification.
§ 130.03 DISCHARGE OF FIREARMS WITHIN CITY LIMITS.
(A) DISCHARGE PROHIBITED.No person shall shoot, fire-off, discharge or explode
any firearm or non-firearm upon or onto any of the following:
(1) Any road, street, avenue, sidewalk or other public place in the city;
(2) Any city park or city owned lands;
(3) Any parcel smaller than 19 acers;
(4) Any lands within the city not owned by the person so using, unless the person
doing so has on his or her person the written consent of the owner of the lands, or is
lawfully hunting in a county park or on the waters of Centerville or Peltier Lakes;
(5) Within 750 feet of any residences or buildings upon property not owned by the
person so shooting, firing off, discharging or otherwise exploding any firearm or non-
firearm without written consent of the owner. In no event shall the person discharge a
bow and pointed-tip arrow, shotgun, or muzzleloader where a projectile leave the
premises upon which the person is authorized to hunt; or
(6) A private landowner or person with written consent from the landowner may use a
bow and pointed-tip arrow, shotgun, or muzzleloader lawfully appropriate for taking
game or waterfowl provided that no projectile used shall pass within 500 feet of any
building on adjoining property or occupied residence, without the consent of that
landowner, nor in any event create a nuisance or danger to the person.
(B) SINGLE BALL AMMUNITION.
(1) Prohibition. No person shall shoot, fire-off, discharge, explode or hunt with any
rifle or handgun, within the city except upon a licensed shooting range.
(2) Evidence. The following shall constitute prima facie evidence of the violation of §
130.03 (A) and (B)(1) of this section: the carrying of single ball ammunition on or about
the person while carrying a rifle, shotgun or handgun, openly or uncased, loaded or
unloaded, and which firearm is capable of discharging a single ball ammunition so being
carried.

(C) PERMITTED USES.
Nothing herein contained shall prohibit the use of firearms by duly authorized police
officers or law enforcement officers, or by persons engaged in the lawful defense of
person or property.
EXISTING CENTERVILLE ORDINANCE:
§ 92.01 DEFINITIONS.
For the purpose of this chapter, the following definitions shall apply unless the
context clearly indicates or requires a different meaning.
FIREARM. Any rifle, shotgun, pistol, B-B gun, pellet gun, As used in this
section, a device designed to be used as a weapon, from which is expelled a projectile
by the force of any explosion or force of combustion, or a slingshot, air rifle and bow
and arrow.
PUBLIC PARKS AND GROUNDS. Any real property owned or leased by the
city.
VEHICLE. Any vehicle or conveyance, whether motor-powered, animal-drawn
or self-propelled.
§ 92.11 DISCHARGE AND POSSESSION OF FIREARMS.
No person, except law officers in the discharge of their duties, shall discharge any
firearm in any public park or on any public grounds at any time. No person shall possess
a dangerous weapon or firearm in any public park or on any public grounds unless
licensed by a State or the Federal government authorizing possession of a firearm in a
public place.
§ 130.03 DISCHARGE OF FIREARMS WITHIN CITY LIMITS.
(A)It shall be unlawful to shoot, fire off, discharge or explode any gun, pistol,
revolver or other firearm or device which ejects a projectile upon or onto any
road, street, avenue, sidewalk or other public place, or inside any dwelling or
structure in the city except upon ranges permitted by the City Council.
(B)It shall be unlawful to shoot, fire off, discharge or explode any single ball
ammunition in the city except upon ranges permitted by the City Council.

(C)It shall be unlawful to own or operate a rifle or shooting range in this city unless a
permit therefore be issued by the City Council. The fee for the permit shall be
$15 and the fee shall be paid to the Administrator prior to issuance thereof.
(D)Nothing herein contained shall prohibit the use of firearms by duly authorized
police officers or law enforcement officers, or by persons engaged in the lawful
defense of person or property.

§156.104 TEMPORARY DWELLINGS AND STRUCTURES.
(A)The use and occupancy of a tent, recreation vehicle or other temporary dwellings for the purpose of
living quarters is not permitted in the city, except as approved by the City Council under special
circumstances.
(B)Applications for temporary dwellings shall be made in writing to the Administrator and it shall be the
Administrator’s duty to submit the application to the City Council at the next regular meeting thereof.
The City Council in its discretion shall grant or deny the permit and may require, as a condition to the
granting of the permit or any renewal permit, that the applicant appear in person before the City Council
and be examined as to his or her plans for a permanent dwelling and other matters relative thereto.
Permits shall in no event be granted for a period in excess of 90 days. At the expiration of the 90-day
period, the owner or occupant of any trailer so placed upon the premises in accord with this section shall
immediately remove the same, unless prior to the expiration of the 90-day period, the owner or occupant
shall obtain from the City Council a renewal permit. Application therefore may be made to the
Administrator as in the case of original permits, and must be submitted to the City Council prior to the
expiration of the original 90-day period. One renewal permit may be granted upon good cause shown,
but in no event shall a renewal permit be granted for a period in excess of 90 days and not more than one
renewal permit shall be granted.
(C)Temporary structures and trailers used in conjunction with construction work shall be permitted only
during the period that the construction work is in progress. Permits for temporary structures shall be
issued for a period not exceeding six months.
(D)Pursuant to authority granted by Minnesota Statutes, Section 462.3593, subdivision 9, the City of
Centerville opts-out of the requirements of Minn. Stat. §462.3593, which defines and regulates
Temporary Family Health Care Dwellings.

§156.105 PUBLIC UTILITIES REQUIRED.
All residential, commercial, industrial, public, institutional or other uses, which include plumbing
facilities, shall be connected to the public sewer and water system when available.
§156.106 RELOCATED BUILDINGS OR STRUCTURES.
(A)No existing building or structure may be relocated anywhere in the city without a permit. A permit for
the relocation of any building or structure may not be issued without site plan approval by the city.
(B)The Planning and Zoning Commission shall not recommend approval of a site plan without certifying
the following:

§ 156.006 DEFINITIONS.
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates

Minnesota Statutes. Other words not so defined shall have the meaning customarily associated with them.

RECREATIONAL VEHICLES. A mobile vehicle, including boats, used for recreational purposescapable of
being towed or being self-propelled.

§ 71.01 PARKING PROHIBITIONS.
(A)Every vehicle parked upon any street with a curb shall be parked parallel to the curb and with the right-
hand wheels of the vehicle within 12 inches of the curb. On other streets, a vehicle shall be parked to
the right of the main traveled portion thereof and parallel thereto and in a manner as not to interfere with
the free flow of traffic. These requirements shall not apply, however, to any vehicle disabled upon any
street, but any police officer may require the person in charge thereof to move it to a place of safety, and
if the movement is not made or if any motor vehicle is left alone or abandoned in that position, the
officer may provide for the removal of the vehicle to the nearest convenient garage or other place of
safekeeping.
(B)No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic
or in compliance with the directions of a police officer or traffic-control device, in any of the following
places:
(1)On a sidewalk;
(2)In front of a public or private driveway;
(3)Within an intersection;
(4)Within ten feet of a fire hydrant;
(5)On a crosswalk;
(6)Within 20 feet of a crosswalk at an intersection;
(7)Within 30 feet upon the approach to any flashing beacon, stop sign or traffic-control signal
located at the side of the roadway;
(8)Between a safety zone, unless a different length is indicated by signs or markings;
(9)Within 20 feet of the driveway entrance to any fire station and, on the side of the street opposite
the entrance to the fire station, within 75 feet of the entrance when properly sign-posted;
(10)Alongside or opposite any street excavation or obstruction when the stopping, standing or
parking would obstruct traffic;
(11)In the roadway side of any vehicle stopped or parked at the edge or curb of a street; or
(12)At any place where official signs prohibit stopping.
(C)No person shall, for camping purposes, leave or park a house trailer on any street or the right-of-way
thereof.

(D)No person shall stop or park a vehicle on a street when directed to proceed by any peace officer with
authority to direct traffic.
(E)No vehicle shall be parked on any street for the purpose of displaying it for sale.
(F) (1) No vehicle, except an emergency vehicle on an emergency call, shall be parked between
the hours of 3:00 a.m. and 7:00 a.m., and no vehicle shall in any case be parked upon
any street in any one place for a longer continuous period than 24 hours.
(2) However, these restrictions shall not apply to the parking of one vehicle on the street
due to new construction during the months of March through May of each year.
(G) (1) The City Administrator may issue temporary permits to park on streets during restricted
times.
(2) The permit shall state the duration and location for which the permit is valid.
(3) A fee may be charged for such permits in accordance with a resolution adopted by the
City Council.

§ 71.02 TOWING OF ILLEGALLY PARKED VEHICLES.
Any vehicle parked in violation of the city code or in violation of state law may be removed by towing
at the direction of the city police to a suitable place for storage until claimed by the owner or agent of the
owner. The owner or other person responsible for such parking of the vehicle shall be liable for the reasonable
cost of such towing and storage upon conviction for such illegal parking. The city shall in no way be liable for
any damage to any vehicle which has been ordered towed away.

§ 71.99 PENALTY.
Any person convicted of violating any provision of this chapter shall be guilty of a misdemeanor but if a
minimum fine or imprisonment is prescribed by the State Highway Traffic Act for an offense, the penalty shall
apply to a person convicted of the same offense under this chapter. For continuing violations, each day the
violation exists shall be considered a separate offense.

Chair Kubat noted that the language as written does not put a time limit on occupancy of a tent; he
recommended adding language that adds limitation(s), such as no continuous occupancy of a tent.

3.Issue Discussion – Moratorium on Cannabis Sales
Administrator Statz reviewed the item as presented in the packet. He noted that some cities are
waiting to see what others are doing. Discussion ensued about the sale and regulation of products
(both online and in stores); issuing licenses like we do for tobacco and liquor. Other considerations
include fees and limits on the number of licenses. Administrator Statz reported that he asked the
schools to keep us posted on issues that may arise.
Administrator Statz reviewed options for next steps, noting that we could do any of the following:
study the issue, take public input, watch the legislature, stay in touch with League of MN cities,
watch other cities, or draft an ordinance.
Administrator Statz recommended making a list of what the Commission wants to see in an
ordinance and our attorney will then draft one.

2.Easement Vacation – 1844 Old Mill Court
Administrator Statz introduced this item prior to the public hearing being held and no other
discussion ensued.
Motion by Commissioner Nelson, seconded by Commissioner Kuiper to vacate the current
easement and replace it with the proposed easement. All in favor. Motion carried.

on the Planning & Zoning Commission, Parks and Recreation Committee, and on City Council.
Administrator Statz also reported that Tony Smith has filled the EDA vacancy, a downtown market
study has been approved, and the owners of Kelly’s Korner are interested in redevelopment.

where needed.

Second Annual Skate/Sled Nights

the above items. The event will again be held at Laurie LaMotte Memorial

PLANNING & ZONING
Temporary Dwellings and Structures
The Planning & Zoning Commission discussed Temporary Dwellings and Structures at their meeting on
January 17, 2022. This ordinance deals with the occupancy of things like RV’s and tents. The city’s current
ordinance does not allow occupancy of these, for any length of time. The commission is considering:
For RVs
Stay up to 14 days/year/parcel w/no winter stays
No exchange of money allowed
Must have principal structure on lot
Must be parked in driveway
Self-service permit required
For Tents
Limited stays
No permits necessary
A public hearing will be held on March 14 at 6:30 p.m. at City Hall, or you may submit comments at

THC Regulations
Centerville, along with many cities across the state, issued a moratorium on the sale of THC products after
the state legalized edibles in July of 2022, with few restrictions. Those included:

Max 5 mg/serving, max 50 mg/package
No marketing to children
As required by a moratorium, the city is studying the issue by talking with our law enforcement and school
officials, watching what other cities are doing to see what is working and what is not, and soliciting input
from the public. Some of the regulations other cities are considering include:

Buffers around schools and daycares
No mobile or vending machine sales

The kick-off meeting for the downtown redevelopment market study was held on Monday, January 30. Staff
met with the consultant to review the project timeline, establish key deliverable dates, discuss citizen engagement,
and provide background information about the city and previous development studies.
CENTENNIAL LAKES POLICE DEPARTMENT
Our newest police officer, Cole Henjum will be starting his pre-service training on Monday, January

30. Cole is a graduate of St. Francis High School. Cole earned his bachelor’s degree in criminal justice

from St. Cloud State University, and recently served in the U.S. Army with the 101 Airborne Division at
Fort Campbell, Kentucky. While in the Army, Cole was in Ranger School focusing on Tactical Combat
Casualty care. We are very pleased to have Cole join our department and we are very excited to work with
him in the months and years to come. Welcome to the Centennial Lakes Police Department Cole!
CENTENNIAL FIRE DISTRICT
Firefighting is a difficult job to begin with, but you can do your part to
make it easier by clearing snow from around fire hydrants. This saves
precious time for our crews, leading to better outcomes.
COMMUNITY DEVELOPMENT
Project Map
Staff has prepared a map of all active developments to help everyone get
a better picture of what’s happening around our community. The number
you see at the heading of each item in this section corresponds to a
number on the map, which is attached to the end of this report.
(9) Block 7 Property (Downtown)
The city approved a purchase agreement with a developer (Schifsky Companies) who continues to explore
the viability of the site for a townhome style development. City staff recently met with Mr. Schifsky to look
at ways to more efficiently engineer the site’s stormwater infrastructure.

(3)(4) Old Mill Estates 1 and 2 Additions
The developer has finished black dirt and seed work in boulevards and around ponds. They continue to
work to finalize wetland and other watershed permits.
Construction of the gravel base for the trail between Old Mill Court and Laramee Lane is now complete.
Concrete work will be completed in the spring to ensure the base has a chance to settle over the winter.
(16) Centerville Self Storage
The facility is now open for business. The developer has made progress to address drainage issues along
the north side of the facility and will continue to work on minor clean-up items.
(1) Bay View Villas (Waterworks Site)
The developer’s landscaping crew has finished sod work near the cul-de-sac and has just a few items from
the punch list remaining.

The sidewalk on the north side of Main Street, between 20 Avenue and 21 Avenue will be graded and
poured in the spring. Other punch list items remain. Record plans have been submitted and reviewed.
(13) Kwik Trip
Construction is complete with the exception of some punch list items and the sidewalk along Main Street,
in the spring. The store is now open!
(17, 19) Rehbein Industrial
Record Plans for the project have been submitted and reviewed. Once permit closure is achieved, the project
can be closed out.
(18) Max Storage (Fairview Street)
A building permit has now been issued for construction of Building #1 of 2. The developers have decided
to wait until spring to begin construction.
(17) Amazon Fulfillment Center
The building shell is now up and work on the van loading area canopy has begun. Site work will continue
in the spring. Interior work on the building continues.
A second meeting for the Corridor Study was held on December 12. Stakeholders heard from the consultant
on their initial data gathering and analysis. Next steps will be developed, looking at intersection evaluations
and other more specific corridor issues. The study will prioritize area-wide transportation improvements to
address increased traffic from Amazon and surrounding growth. The study will examine 20th Avenue from

Birch Street to 80th Avenue, and the intersection of 21 Ave. and Main Street.

Work on the 21 Avenue Floodway Impacts study has now been authorized, through an agreement with the
Rice Creek Watershed District. The study will supply required documentation to the Federal Emergency
st
Management Administration (FEMA), to demonstrate that the culvert placed under 21 Avenue with the
Distribution Alternatives project did not affect the flood elevation in the area. Once complete, the study and
resulting paperwork will clear the way for Amazon’s Flood-fringe excavations.

PUBLIC WORKS
Commercial Water Connection Fee Assistance
At the last City Council meeting, the Council voted to extend the program through the end of 2023. The
program offers half-priced hook-up charges for businesses hooking to city water.
Wellhead Protection Plan
The Minnesota Department of Health held a kick-off meeting with city staff and consultants for the
implementation of the city’s Part-2 Wellhead Protection Plan. The group reviewed items in the documents
and the timelines associated with various activities. Staff will be following up on the action items over the
course of the next few months.
City staff recently completed final paperwork and receive reimbursement from the Department of Health
associated with a grand for sealing of a well in the downtown at no cost to the city or resident. With the
completion of this grant, the city can now apply for other grants related to the Wellhead protection plan.
2022 Thin Overlay Program and City Hall Parking Lot Improvements
An Assessment Hearing was held on Wednesday, January 25, 2023 at 6:30 p.m. in Council Chambers to
finalize individual assessments for the overlay portions of the project. Benefiting/abutting property owners
should have received a mailed notice with a specific amount to be assessed. The adoption of the assessment
roll was tabled for verification of correct assessment amounts and will again be considered at Council’s
February 8, 2023 City Council meeting.
Overlay Program
City staff have evaluated the roads and determined that no overlay project will be completed in 2023.
City Hall Parking Lot Lighting
The City Council reviewed and approved plans for proposed lighting at City Hall. The work would be
quoted for construction in the spring of 2023 in an effort to allow time to secure a grant through the
Occupational Safety and Health Administration (OSHA).
