HomeMy WebLinkAbout2023-01-17 P & Z Minutes - Approved Approved CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the Regular Meeting of the Planning and Zoning Commission held in Council Chambers on Tuesday, January 17, 2023 at 6:30 p.m. I. CALL TO ORDER The meeting was called to order at 6:30p.m. 1. Roll Call Present: Chair David Kubat Vice-Chair Krueger Commissioner Darrell (DJ) Olson, Jr. Commissioner Richard Nelson Commissioner Les Kuiper Commissioner Thompson Absent: Commissioner Gloria Semmelink Staff: Assistant City Administrator, Athanasia Lewis Council Liaison, Russ Koski II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA There were no changes to the agenda. Motion by Commissioner Olson, seconded by Commissioner Kuiper to Approve the Agenda as presented. All in favor. Motion carried. IV. PUBLIC HEARINGS (6:39 PM or shortly thereafter) Administrator Statz reviewed this item as presented in the packet. The public meeting was opened at 6:39pm. Motion by Chair Kubat, seconded by Commissioner Thompson to open the public hearing. All in favor. Motion carried. 1. Easement Vacation – 1844 Old Mill Court Mike Palmer at 1844 Old Mill Court agrees with Administrator Statz’s assessment of the easement vacation and wishes to move forward. There were no other public comments. Motion by Commissioner Kuiper seconded by Commissioner Nelson to close the public hearing. All in favor. Motion carried. Annual Appointment of Chair and Vice-Chair Administrator Statz introduced this item. Discussion ensued. Motion by Commissioner Thompson, seconded by Commissioner Kuiper to appoint David Kubat as Chair and Jon Krueger as Vice-Chair. All in favor. Motion carried. 2. Ordinance Review – # 156, Section 156, 104 Temporary Dwellings & Structures Administrator Statz introduced this item as presented in the packet. The current ordinance does not allow occupancy in RVs or tents. A summary of proposed revisions is in the packet, along with a redline version of proposed changes and a clean copy of the ordinance. A sample permit for self- permitting is also included in the packet. Chair Kubat noted that the language as written does not put a time limit on occupancy of a tent; he recommended adding language that adds limitation(s), such as no continuous occupancy of a tent. Motion by Chair Kubat, seconded by Commissioner Thompson to call for a public hearing in March on this ordinance. All in favor. Motion carried. 3. Issue Discussion – Moratorium on Cannabis Sales Administrator Statz reviewed the item as presented in the packet. He noted that some cities are waiting to see what others are doing. Discussion ensued about the sale and regulation of products (both online and in stores); issuing licenses like we do for tobacco and liquor. Other considerations include fees and limits on the number of licenses. Administrator Statz reported that he asked the schools to keep us posted on issues that may arise. Administrator Statz reviewed options for next steps, noting that we could do any of the following: study the issue, take public input, watch the legislature, stay in touch with League of MN cities, watch other cities, or draft an ordinance. Administrator Statz recommended making a list of what the Commission wants to see in an ordinance and our attorney will then draft one. This topic was for discussion only. No motion was made. VII. NEW BUSINESS 1. Accept Resignation of Commissioner Semmelink and Declaration of a Vacancy Page 2 of 3 City of Centerville Planning and Zoning Commission January 17, 2023 Administrator Statz introduced this item and reviewed next steps to fill the vacancy. Chair Kubat and other members of the Commission thanked Gloria for her service. Motion by Chair Kubat, seconded by Commissioner Thompson to accept Commissioner Semmelink’s resignation and declare a vacancy on the Commission. All in favor. Motion carried. 2. Easement Vacation – 1844 Old Mill Court Administrator Statz introduced this item prior to the public hearing being held and no other discussion ensued. Motion by Commissioner Nelson, seconded by Commissioner Kuiper to vacate the current easement and replace it with the proposed easement. All in favor. Motion carried. VIII. APPROVAL OF MINUTES 1. December 6, 2022 Planning & Zoning Commission Meeting Minutes There were no amendments to the minutes Motion by Chair Kubat, seconded by Commissioner Kuiper to approve the December 6, 2022 Planning and Zoning Commission minutes as presented. All in favor. Motion carried. IX. Announcements and Updates 1. Council Member Liaison Councilmember Koski reported that there was a fire steering committee meeting. He also expressed his appreciation of former councilmember Lakso and her years of service on the city council. 2. Administrator’s Report Administrator Statz reviewed the report as presented in the packet, adding that we have an opening on the Planning & Zoning Commission, Parks and Recreation Committee, and on City Council. Administrator Statz also reported that Tony Smith has filled the EDA vacancy, a downtown market study has been approved, and the owners of Kelly’s Korner are interested in redevelopment. 3. Planning and Zoning Action Items Tracker Administrator Statz reviewed the Planning and Zoning Action Items Tracking sheet, noting updates where needed. X. ADJOURNMENT Motion by Commissioner Olson, seconded by Commissioner Krueger to adjourn the meeting at 8:21 p.m. All in favor. Motion carried. Page 3 of 3
