REQUEST:Variance – additional ground signs at Amazon Fulfillment Center st ADDRESS: 6985 21AvenueSouth PIDS: 24-31-22-32-0004, 23-31-22-41-0057, 23-31-22-41-0053 OWNER:Amazon.Com Services LLC INTRODUCTION thst The Amazon Fulfillment Centeris under construction on the 40-acre site between 20and 21 Avenues South, south of Commerce Drive, and north of Fairview Street. Thefacility includes a 140,000-sq-ftFulfillment Centerbuilding, employee parking on the east side, van parking and staging on the south side, and truck access and loading docks on the north side. When the project was approved, signage was left for review later according to the City’s sign ordinance. Ryan Companies has applied on behalf of Amazon for site signage, which includes ground signs at three entrances to the site. City sign regulations limit a site to one ground sign. Amazon is requesting a variance to allow two additional ground signs, for a total of three such signs. PROPOSED SIGNAGE The site plan is illustrated on the next page, showing the location of the three proposed signs: st Avenue S, at the NE corner of the site; At the truck entrance on 21 st At the employee entrance on 21Avenue S, on the east side of the site; st At the van entrance, the first driveway west of 21Avenue S off Fairview Street, on the south side of the site. The signs will each be 7 ft tall with a sign face 5 ft X 6 ft, or 30 sq ft, as illustratedon the next page. The application and narrative provide more rationale for the requested signs. Section 152.18(C)(2) notes permitted signs in the Industrial district, including: Ground signs. One (1) Ground sign ; provided, however, the sign does not exceed 200 square feet in area 15 feet in height and located a minimum of fifteen from any property lines. st The proposed signs meet the area and height dimension. The two signs proposed on 21Avenue South meet the required 15-ft setback, but the Fairview Street sign is shown at a setback of 10 ft to the street right-of-way. The applicant agreed this was a simple oversight and thesign can be movedback 5 ft to meetthe setback. VARIANCE CRITERIA Centerville’s Zoning Code has five criteria for considering variances, discussed below. (1)The variance is in harmony with the purposes and intent of the zoning chapter of this code; (2)The variance is consistent with the comprehensive plan; (3)The proposal puts the property to use in a reasonable manner; The first three criteria are fairly generalized. The zoning code and comp plan do not deal specifically with signage. Providing signage for a large facility in the industrial district is a reasonable use of the property, so we can say that the first three criteria are met. (4)There are unique circumstances to the property not created by the landowner; The unique circumstance with this property isthat it is a very large site with avehicle- intensive use. More typical development of this amount of property might have several businesses, each with their own signage. In this situation, Amazon has several hundred employees and several hundred vans accessing the site daily, so adequate signage is essentialfor safety and efficiency. Three signs on the street frontages serving this property is a reasonablerequest. (5)The variance, if granted, will not alter the essential character of the locality; The site is in the City’s industrial park, opposite similar industrial uses to the east in Lino Lakes, most of which are on much smaller sites, each with their own signage. The variance allowing three signs for this property would not alter the character of this area. RECOMMENDATION We recommend that the Planning & Zoning Commission recommend approval of the variance to allow three ground signs for the Amazon facility as illustrated on the submitted application and plans, with the following condition and findings: May 2, 2022 Centerville Planning & Zoning Commission Page 4of 5 RE: AmazonFulfillment Center, Sign Variance Condition for Approval 1)The location of the sign proposed on Fairview Street will be revised to meet the required 15- foot setback from the street right-of-way. Findings of Fact for Approval ofVariance 1)The proposed use –informational signs for the hundreds of vehicles serving the Amazon distribution facility –is reasonable and is in harmony with the intent of the zoning code and the comprehensive plan. 2)The Purpose and Intent section of the City’s signordinance includes the principlethat the public will not be “annoyed, distracted, or displeased” by “unnecessary” signage, and as such, the ordinance limits the number of ground signsper property in the industrial district. 3)The Amazon facility occupies a 40-acre site in the City’s industrial district where many of the businesses are on much smaller sites. If this propertywere developed with more typical lot sizes, each business with its own signage, there might have been many more signs on st 21AvenueSouth and Fairview Street than the three signs proposed by Amazon. 4)The size of the Amazon site and the number of vehicles it serves make it a unique property in the City. Meeting the ordinance requirement of only one sign on the site poses a serious practical difficultyto safe and efficient operation of the facility. 5)Within the context of themany business sites in thesurrounding commercial and industrial area,the three proposed signs willnot alter the essential character of that locality. 60-DAY RULE The application wassubmitted on April 12, 2023. The deadline for final action by the City Council on the variance request per State statue 15.99 is June 12, 2023. The Planning and Zoning Commission shall recommend a variance and the Council shall order the issuance of the variance only if it conforms to the following standards: (1)The variance is in harmony with the purposes and intent of the zoning chapter of this code; (2)The variance is consistent with the comprehensive plan; and (3)The proposal puts the property to use in a reasonable manner; and (4)There are unique circumstances to the property not created by the landowner; and (5)The variance, if granted, will not alter the essential character of the locality; SIGN ORDINANCE 152.18 (C) Industrial District (I-1). Permitted signs: (1)Wall signs. Wall signs are permitted on each public street exposure or public parking exposure provided the signage does not exceed ten percent of the wall area. (2)Ground signs. One (1) Ground sign ; provided, however, the sign does not exceed 200 square feet in area 15 feet in height and located a minimum of fifteen from any property lines. (3)Area identification signs. One area identification sign is permitted per street frontage; however, the sign does not exceed 64 square feet in area and 20 feet in height, and is not placed within ten feet of any street right-of-way. (4)Billboard signs. As otherwise regulated in this Chapter. In Option A, the building is set back to the rear of the yard, with parking in front. Option B features a building in the front of the lot, with limited setback to the right-of-way and parking in the rear. Option C is a more elongated building, maximizing the front exposures. The ownership group does not wish to further explore Option C. Option A Option B With Option B, comes the complication of overhead power lines. The picture at the right shows these lines as viewed from Progress Street, looking southeast. The lines can be seen on the drawings shaded in yellow. For both safety and aesthetic reasons, the power lines would need to be either relocated or buried to accommodate Option B at a cost of between $25,000 to relocate and $60,000 to bury. With Option A, the power lines may not be as intrusive to the look of the development and could remain in place. Each option has pros and cons, and produces questions for the City Council and Planning Commission. For background, the property is zoned M-1 (Mixed Use Corridors). All development within the Mixed Use Districts is done via Planned Unit Development, allowing flexibility in the cityÓs zoning code. In these districts, the zoning code, relies heavily on the Downtown Master Plan and Development Guidelines. From the Downtown Master Plan and Development Guidelines: Building Placement and Setbacks: Mixed-Use Corridors allow recessed spaces for outdoor dining, other street level activities and variety of pedestrian environment. 80% of building facades should address the build-to lines; building features located at the intersection of Centerville Road and Main Street or where other streets intersect these two main roads. These locations will be seen from several directions and terminate views. They will become future landmarks and way finding icons as the Downtown Area develops; tween buildings. Limited driveway access and provisions for pedestrian connections through blocks are encouraged. Gaps between buildings to accommodate surface parking lots, greater building setbacks or other purposes are discouraged; s to create street-level interest, variety and enhance pedestrian scale along street frontage. Parking Strategies: Mixed-Use Corridors ily use that satisfy both quantity and location needs through a mix of on street and off-street parking solutions with a minimum of small surface lots; pal parking facilities that minimize total parking numbers by taking advantage of around the clock and peak/off-peak hours of operation for various uses within the core area; behind or to the side of primary buildings; surface parking lots along major street frontage are not allowed in the core area; ng facilities along major streets or side streets in order to maintain a pedestrian friendly environment within the Mixed-Use Corridors. Below, the two preferred options put forward by the developer are discussed and must be considered in relationship to the cityÓs zoning code and, by reference, the Downtown Master Plan and Development Guidelines. Option A Î Building in Rear, Parking in Front Pros: Maximizes potential for future expansion, should the property to the northeast become available. Offers safety and convenience to customers with parking spots closest to the front door. Allows for future drive-thru geometry if property to the northeast becomes available. Does not require power lines to be buried or relocated. Cons: Does not meet the intent of the Downtown Master Plan & Development Guidelines, with regard to: o Building placement at the build-to line (right-of-way) o Placement of parking in the rear Option B Î Building in Front, Parking in Rear Pros: Meets the intent of the Downtown Master Plan & Development Guidelines, with regard to: o Building placement at the build-to line (right-of-way) o Placement of parking in the rear Requires power lines to be buried or relocated. Cons: Should the property to the northeast become available, future expansion would be limited to the construction of a second, stand alone building, which may reduce efficiencies in site design, etc. Raises safety concerns, with customers needing to park in the rear and walk around the building to the front door. This may also be viewed as an inconvenience to customers, especially those with disabilities. Does not allow for drive-thru geometry. Analysis, Recommendations, and Next Steps: The prospective developer would like to reach an understanding with the city on a path forward by arriving at a mutually agreeable building location. The next step for them is to have their engineer and architect fully develop a building and site plan schematic. The placement of the building is essential to both. While the developer is open to either location, their preference is for Option A (building in the rear). They feel this option gives them the most flexibility for future expansion and offers the safest, most convenient layout for their customers. They have also expressed concern with the cost of relocating power lines to accommodate Option B. Given the small scale of this development, it is likely they would not be able to absorb this unanticipated expense. The City Council and Planning Commission should weigh in on the two options, considering the practical elements of each and their alignment with the vision for downtown. Possible conclusions might be: Option A Î The city finds that the logistical issues and cost implications of a building- forward design necessitate Option AÓs placement of the structure towards the rear of the site. While the aesthetic of this option may not directly align with the vision outlined in the Downtown Master Plan, if architectural considerations can be made to maximize adherence to other elements of the plan, the overall impact of the project can still advance the progress towards a revitalized downtown. Additionally, landscaping and other site design elements should be considered to offset the site layout, by emphasizing the streetscape and other placemaking opportunities. Option B Î The city finds that Option B best aligns with the cityÓs Downtown Master Plan and will best position us to attract similar style developments on adjacent blocks in the future. Given the importance of this development as the first to implement the Master PlanÓs design guidelines, the city is willing to be a partner and explore options for removal of the power lines as a public expense. In an effort to give the developer timely feedback, staff has placed this item on this weekÓs work session agenda for discussion. However, we would typically request input from the Planning and Zoning (P&Z) Commission first. Therefore, we have also placed it on the May 2, agenda for the P&Z Commission to consider. Linda Broussard-Vickers has offered to be a part of the commission begining in June or July with the a commitment through December. Ms. Broussard-Vickers is a resident of Centerville, but winters in the south for several months. Given the fact that the commission is down two members and Ms. Broussard-Vickers has previous experience on the commission, staff recommends considering this offer. Ms. Broussard-Vickers does not wish to chair the committee as she has in the past, such that her potentially temporary position would be less disruptive. She is also willing to step down should two qualified candidates step forward. COST AND SOURCE(S) OF FUNDING: N/A REQUESTED ACTION: Motion to recommend appointment of Linda Broussard-Vickers to the Planning and Zoning Commission, waiving the requirement for a formal application, given Ms. Broussard-Vickers recent participation on the commission. Moratorium on Medical Facilities Î Study Update Page 1 of 3 City of Centerville Planning and Zoning Commission April 4, 2023 Assistant Administrator Lewis introduced this item as presented in the packet, noting stacking issues identified by staff at the City of Woodbury. Discussion ensued about placement of a medical treatment facility in Centerville, as well as proposed language revisions in the cityÓs Zoning ordinance. Staff will continue to research what other communities are doing and bring some additional information back to the Commission in May. VII. NEW BUSINESS 1. City Code Chapter 156, including Table 156.A.1 (Allowed Uses) This item was discussed during the public hearing portion of the meeting. Motion by Commissioner Kuiper seconded by Commissioner Thompson to accept the proposed changes to City Code Chapter 156, including Table 156.A.1 as presented. All in favor. Motion carried. 2. Resignation of Commissioner Kubat Administrator Statz introduced this item. Commissioners expressed their appreciation for David KubatÓs service and his valuable contribution to the Planning and Zoning Commission.
