City Clerk VIII.1 TITLE OF ISSUE: Res. #23-0XX - BACKGROUND AND SUPPLEMENTAL INFORMATION: Five (5) homes were sold during initial the assessment process for the project. A Re-Assessment Hearing was scheduled at your last meeting, legal notices were forwarded to the new owners of the property and contained in your packet is new resolution for those properties. The forwarding of the notices, mean that the new owners have been provided notice of the hearing and appeal avenues. Attached is a table and map showing existing and proposed no parking areas. The Planning & Zoning Commission discussed and held a public hearing on the issue. The minutes of those meetings are attached. Although no public comments were offered during the public hearing, a local landowner subsequently submitted his thoughts on the matter (also attached). The comments stem from discussions regarding trucks queuing on Main Street, waiting to enter the property. One of the options to solve this issue involves allowing on-street parking in our industrial district. (A) Every vehicle parked upon any street with a curb shall be parked parallel to the curb and with the right- hand wheels of the vehicle within 12 inches of the curb. On other streets, a vehicle shall be parked to the right of the main traveled portion thereof and parallel thereto and in a manner as not to interfere with the free flow of traffic. These requirements shall not apply, however, to any vehicle disabled upon any street, but any police officer may require the person in charge thereof to move it to a place of safety, and if the movement is not made or if any motor vehicle is left alone or abandoned in that position, the officer may provide for the removal of the vehicle to the nearest convenient garage or other place of safekeeping. (B) No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control device, in any of the following places: (1) On a sidewalk; (2) In front of a public or private driveway; (3) Within an intersection; (4) Within ten feet of a fire hydrant; (5) On a crosswalk; (6) Within 20 feet of a crosswalk at an intersection; (7) Within 30 feet upon the approach to any flashing beacon, stop sign or traffic-control signal located at the side of the roadway; (8) Between a safety zone, unless a different length is indicated by signs or markings; (9) Within 20 feet of the driveway entrance to any fire station and, on the side of the street opposite the entrance to the fire station, within 75 feet of the entrance when properly sign-posted; (10) Alongside or opposite any street excavation or obstruction when the stopping, standing or parking would obstruct traffic; (11) In the roadway side of any vehicle stopped or parked at the edge or curb of a street; or (12) At any place where official signs prohibit stopping. (C) No person shall, for camping purposes, leave or park a house trailer on any street or the right-of-way thereof. 61 |Page (D) No person shall stop or park a vehicle on a street when directed to proceed by any peace officer with authority to direct traffic. (E) No vehicle shall be parked on any street for the purpose of displaying it for sale. (F) (1) No vehicle, except an emergency vehicle on an emergency call, shall be parked between the hours of 3:00 a.m. and 7:00 a.m., and no vehicle shall in any case be parked upon any street in any one place for a longer continuous period than 24 hours. (2) However, these restrictions shall not apply to the parking of one vehicle on the street due to new construction during the months of March through May of each year. (G) (1) The City Administrator may issue temporary permits to park on streets during restricted times. (2) The permit shall state the duration and location for which the permit is valid. (3) A fee may be charged for such permits in accordance with a resolution adopted by the City Council. Penalty, see § 71.99 Ord. #16, adopted 06/06/1969, Ord. amended 02/09/1972, Ord. amended 03/28/1984, Ord. amended 12/12/1984 § 71.02 TOWING OF ILLEGALLY PARKED VEHICLES. Any vehicle parked in violation of the city code or in violation of state law may be removed by towing at the direction of the city police to a suitable place for storage until claimed by the owner or agent of the owner. The owner or other person responsible for such parking of the vehicle shall be liable for the reasonable cost of such towing and storage upon conviction for such illegal parking. The city shall in no way be liable for any damage to any vehicle which has been ordered towed away. Ord. 2d #24, amended 12/10/2008 § 71.99 PENALTY. Any person convicted of violating any provision of this chapter shall be guilty of a misdemeanor but if a minimum fine or imprisonment is prescribed by the State Highway Traffic Act for an offense, the penalty shall apply to a person convicted of the same offense under this chapter. The Commission favors licensing and would like to model LexingtonÓs ordinance; the item will be brought back to the P&Z in April for further review and feedback. 4.Moratorium on Medical Facilities Î Discussion of Timeline/Next Steps Administrator Statz introduced this item, noting that this in response to people shopping around for locations for medical treatment facilities. The south side of Commerce Dr is wetlands and regional ponding, and is owned by the City of Centerville (Figure 2). It is unlikely the land south of Commerce Dr will ever be developed or need frequent vehicular access. Furthermore, Commerce Dr does not border any residenal uses or zoning districts. Finance Director Bruce DeJong responded with the good news regarding our building activity and financial results. This prompted a review which has upgraded our bond rating from AA to AA+. Our new rating is only one step below AAA. The rating increase is based on S&PÓs evaluation of the following factors: ¤ Centerville, about 15 miles north of St. Paul in Anoka County, is primarily residential with 30 new homes built over the past several years and 26 townhomes and commercial/retail development in the planning stage; ¤ Very strong reserves compared with expenditures with no planned drawdowns and a history of operational financial balance; ¤ Strong debt profile with no medium-term debt plans; and ¤ Good financial policies and practices under our financial management assessment methodology, highlighted by conservative budgeting practices, budget-to-actual reporting to the council monthly, fund balance policy, and a long-term capital and financial plan that is updated every year; and a strong institutional framework score. THC Regulations The Minnesota State legislative bodies have each passed their own version of a marijuana legalization bill, which will now be consolidated into one, through a bicameral reconciliation committee. Each version of the bill has slightly different allowances for city cost sharing and regulation authority. Once signed into law, staff will move quickly to formulate recommendations on how to exercise whatever discretion we may have. Amazon Sign Variance With a unanimous recommendation from the Planning and Zoning Commission, the City Council approved a variance for additional way-finding signs for the Amazon campus. Peltier-Centerville Backflow Feasibility Study If youÓve been wondering what that weird pile of equipment is doing between the lakes (see photo), you can read about it below. Centerville Lake does not meet MN State water quality standards and suffers from frequent and occasionally intense algae blooms. Monitoring data indicates an increasing trend in phosphorus and chlorophyll-a annual summer means. A significant portion of the annual phosphorus load for Centerville Lake (~40-50%, TMDL, 2013) is thought to be from Peltier Lake backflow. Peltier and Centerville Lake are connected by a pipe under County Highway 14 (See Project Area Map). Backflow is thought to occur when Peltier Lake's surface elevation rises above Centerville Lake's after snowmelt or rain events due to Peltier Lake's much larger watershed and drawn out time of concentration. However, the hydraulic relationship between the two lakes is not well understood. Further, the relative impact of potential backflow loading on water quality in Centerville Lake needs further development. If the impact on Centerville Lake is significant, alternatives for mitigating that impact should be developed. The primary purpose of this study is to quantify potential nutrient loading associated with backflow from Peltier Lake into Centerville Lake. A secondary purpose is to develop alternatives to mitigate potential backflow nutrient loading. Primary funding for this effort is provided by a BWSR Watershed-Based Funding Implementation Program grant. (9) Block 7 Property (Downtown) Lennar has submitted some conceptual sketches of various townhome layouts for Block 7, with a variety of products (home styles). The proposal is similar to previous proposals, in terms of layout and density. They are still in the process of pricing the project to see if it is viable. Ebert Construction has also expressed interest in the property and will be meeting with staff to discuss the development, shortly. Other developers have also expressed interest, but no formal plans have been brought forward. stnd (3)(4) Old Mill Estates 1 and 2 Additions The developerÓs contractor recently met with city staff to review some of the items. We expect action on these in the coming weeks. Other development-wide punch list items remain for the developer to complete. Construction of the gravel base for the trail between Old Mill Court and Laramee Lane is now complete. Concrete work will be completed in the spring to ensure the base has a chance to settle over the winter. (16) Centerville Storage The facility is now open for business. The developer has made progress to address drainage issues along the north side of the facility and will continue to work on minor clean-up items. (1) Bay View Villas (Waterworks Site) The developerÓs landscaping crew has finished sod work near the cul-de-sac and has just a few items from the punch list remaining. Commercial Water Connection Fee Assistance At the last City Council meeting, the Council voted to extend the program through the end of 2023. The program offers half-priced hook-up charges for businesses hooking to city water. th 20 Avenue (CSAH 54) Corridor Study The consultant has signed a supplemental agreement with the county to facilitate a public engagement component for the project, which will allow stakeholders to give input on concept maps, potential intersection treatments, access modifications, street cross sections, speed limits, and pedestrian routes. st The study is examining 20th Avenue from Birch Street to 80th Avenue, and the intersection of 21 Ave. and Main Street, aimed at identifying improvements needed in the short and long-term to accommodate regional growth. Wellhead Protection Plan The Minnesota Department of Health held a kick-off meeting with city staff and consultants for the implementation of the cityÓs Part-2 Wellhead Protection Plan. The group reviewed items in the documents and the timelines associated with various activities. Staff will be following up on the action items over the course of the next few months. City staff recently completed final paperwork and receive reimbursement from the Department of Health associated with a grand for sealing of a well in the downtown at no cost to the city or resident. With the completion of this grant, the city can now apply for other grants related to the Wellhead protection plan. 2022 Thin Overlay Program and City Hall Parking Lot Improvements A public hearing will be held on May 24, 2023 at 6:30 p.m. in Council Chambers to provide an opportunity for five (5) property owners to appeal their special assessment amounts. These five (5) property owners purchased property in between the two (2) previous public hearings held for the project and have been provided with the required hearing notifications. City Hall Parking Lot Lighting The City Council awarded a contract to complete the parking lot lighting project, contingent upon a grant award through the Occupational Safety and Health Administration (OSHA). The City was unsuccessful in obtaining the first round of awards but will be submitting again in a month or two. City Hall Security Upgrades The new system is up and running. Staff is very impressed with the ease of the new improvements. Staff is entertaining additional work, by receiving quotes of minimal cost for consideration. The assessing staff physically inspected 349 properties during the quintile review process for the 2023 assessment. The appraisal staff also inspected 94 properties where building permits were issued for improvements, remodeling, or deconstruction projects during 2022. st There were 97 total sales recorded in the 2023 assessment study period, which is October 1, 2021, through September 30, 2022. 90 sales were residential classification and 7 were commercial, industrial or apartment (CIA) classification. Most of the CIA sales were vacant land (R&R leasing sales, Rehbein, etc.). There were 53 residential sales that met the criteria as Ñqualified salesÒ, according to the MN Department of Revenue. Those sales were the base for adjustments made to the residential properties. The low number of improved commercial, industrial and apartment sales within the city, prompted those classification valuations to be guided by overall County trends, with local adjustments made as appropriate. The 2023 assessment for the City of Centerville is based on 1,667 parcels of property within the city. The preliminary total estimated market value is $661,749,100, an increase of 7.67% from 2022. New construction valuation in the amount of $23,497,400 made up 3.82% of the total increase. After subtracting out the new construction value, the overall city value was $638,251,700 a 3.88% increase. The chart below illustrates change in the total estimated market value of the City of Centerville for 2018 through 2023. Revised 5.19.23 2023 Value Changes by Property Type Non Waterfront Single family home values were fairly flat since 2022, with the total estimated market value increasing less than a half of a percent. The waterfront single family homes experienced the largest increase for all residential properties. The total market value for these properties increased 16.77%. Townhomes saw a modest 2.73% increase. Estimated market values for commercial, industrial and apartment properties increased considerably for the 2023 assessment. Commercial/Industrial total market value increased by 21.00% and apartment values increased by 22.14%. All cities in Anoka County, as well as several surrounding counties, experienced large increases on these property types. The chart below depicts the total aggregate change in estimated market value as a percentage for each property type. Each property within the city is valued based on its specific features and location.
