A public hearing was held at the P&Z meeting and there were no public comments. Prior to city council review, however, the owner of 2050 Main Street approached the city requesting that on-street parking be allowed on Fairview and Commerce Drive; the property owner obtained letters of support from surrounding property owners in the industrial district. The issue is that trucks are queuing on Main Street while they wait to enter the property. City Council discussed possible solutions, such as allowing n-street parking along the south side of Commerce, or neighboring business permit seasonal parking. Re-striping Commerce 2 lane (see attached drawing). Council is sending this back to the P&Z for further consideration. (A) Every vehicle parked upon any street with a curb shall be parked parallel to the curb and with the right- hand wheels of the vehicle within 12 inches of the curb. On other streets, a vehicle shall be parked to the right of the main traveled portion thereof and parallel thereto and in a manner as not to interfere with the free flow of traffic. These requirements shall not apply, however, to any vehicle disabled upon any street, but any police officer may require the person in charge thereof to move it to a place of safety, and if the movement is not made or if any motor vehicle is left alone or abandoned in that position, the officer may provide for the removal of the vehicle to the nearest convenient garage or other place of safekeeping. (B) No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control device, in any of the following places: (1) On a sidewalk; (2) In front of a public or private driveway; (3) Within an intersection; (4) Within ten feet of a fire hydrant; (5) On a crosswalk; (6) Within 20 feet of a crosswalk at an intersection; (7) Within 30 feet upon the approach to any flashing beacon, stop sign or traffic-control signal located at the side of the roadway; (8) Between a safety zone, unless a different length is indicated by signs or markings; (9) Within 20 feet of the driveway entrance to any fire station and, on the side of the street opposite the entrance to the fire station, within 75 feet of the entrance when properly sign-posted; (10) Alongside or opposite any street excavation or obstruction when the stopping, standing or parking would obstruct traffic; (11) In the roadway side of any vehicle stopped or parked at the edge or curb of a street; or (12) At any place where official signs prohibit stopping. (C) No person shall, for camping purposes, leave or park a house trailer on any street or the right-of-way thereof. 61 |Page (D) No person shall stop or park a vehicle on a street when directed to proceed by any peace officer with authority to direct traffic. (E) No vehicle shall be parked on any street for the purpose of displaying it for sale. (F) (1) No vehicle, except an emergency vehicle on an emergency call, shall be parked between the hours of 3:00 a.m. and 7:00 a.m., and no vehicle shall in any case be parked upon any street in any one place for a longer continuous period than 24 hours. (2) However, these restrictions shall not apply to the parking of one vehicle on the street due to new construction during the months of March through May of each year. (G) (1) The City Administrator may issue temporary permits to park on streets during restricted times. (2) The permit shall state the duration and location for which the permit is valid. (3) A fee may be charged for such permits in accordance with a resolution adopted by the City Council. Penalty, see § 71.99 Ord. #16, adopted 06/06/1969, Ord. amended 02/09/1972, Ord. amended 03/28/1984, Ord. amended 12/12/1984 § 71.02 TOWING OF ILLEGALLY PARKED VEHICLES. Any vehicle parked in violation of the city code or in violation of state law may be removed by towing at the direction of the city police to a suitable place for storage until claimed by the owner or agent of the owner. The owner or other person responsible for such parking of the vehicle shall be liable for the reasonable cost of such towing and storage upon conviction for such illegal parking. The city shall in no way be liable for any damage to any vehicle which has been ordered towed away. Ord. 2d #24, amended 12/10/2008 § 71.99 PENALTY. Any person convicted of violating any provision of this chapter shall be guilty of a misdemeanor but if a minimum fine or imprisonment is prescribed by the State Highway Traffic Act for an offense, the penalty shall apply to a person convicted of the same offense under this chapter. For continuing violations, each day the violation exists shall be considered a separate offense. Thereisadequatespacewithintheyardtohosttrucksandunloadthem,butthenumberoftruckstaking deliverysimultaneouslyisoutpacingthelabor/capacityonsite.Freightlogisticsandmaterialsupplyisstill lumpy.Usersareexperiencingafamineandgluttonycyclelikewhatishappeninghere.Daysgobywhere nothingarrives,andtheneverythingarrivesatonce. 5. CSAH14maybe"noparking"butmyunderstandingisthevehiclesaremerelystoppedwiththedriversbehind thewheel.Thisactivityappearstobelegalsincethere'snosignageindicating"nostopping." 6. Noting what a tent is not, i.e., a lean to, car port, etc., is often helpful too. The discussion focused on establishing a timeline to determine our path forward, noting that the city should think about what is best for the city: licensing, regulating, or remaining hands-off and going with what the legislature decides. The Commission favors licensing and would like to model LexingtonÓs ordinance; the item will be brought back to the P&Z in April for further review and feedback. 4.Moratorium on Medical Facilities Î Discussion of Timeline/Next Steps Administrator Statz introduced this item, noting that this in response to people shopping around for locations for medical treatment facilities. The city published a moratorium on October 31, 2022, so there is one year to get the right regulations in place, such as buffers for schools, child care facilities, etc. Staff will review existing language and reach out to other cities to see how they are regulating medical treatment facilities. The south side of Commerce Dr is wetlands and regional ponding, and is owned by the City of Centerville (Figure 2). It is unlikely the land south of Commerce Dr will ever be developed or need frequent vehicular access. Furthermore, Commerce Dr does not border any residenal uses or zoning districts. IV.PUBLIC HEARING (6:30 PM or shortly thereafter) 1.Variance Application Î 1746 Dupre Road Administrator Statz introduced this item, noting that the city has received an application for a variance from the homeowner at 1746 Dupre Road for reconstruction of a shed. The existing shed pre-dates the cityÓs current zoning ordinance and the existing shed is grandfathered because it was legally established before the effective date of the ordinance change that prohibits it. If the owner were to tear down and reconstruct a shed in the exact same footprint, there would be no need for a variance. However, since the homeowner wants to reconstruct a larger (2 ft longer and 2 feet wider) shed, a variance is needed. Michael Lee, the homeowner at 1746 Dupre Road, answered questions about the use of the new shed and materials (siding to match his house) he would be using. Public Comments Neighbors of Mr. Lee communicated their support for reconstruction of the new shed. 2.Interim Use Permit Application Î 7087 Centerville Road Chair Kuiper opened a public hearing at 7:50pm. Administrator Statz introduced this item, noting that the owner approached the city about a new business occupying the building; since there is a change in use from a catering business to a salon, an Interim Use Permit (IUP) is needed. The city and property owner worked together to develop a plan that would allow a new business to operate temporarily, while making improvements, such as paving the parking lot, installing curb and gutter around the parking lot, and mitigating run-off issues. Discussion ensued about parking, greenspace, signage, length of the IUP and future redevelopment. Public Comments Owner, Patrick Walsh, advised that renters will have designated assigned parking spaces. There were no other public comments. 3.Preliminary Plat & Planned Unit Development Application Î 1737 Main Street Chair Kuiper opened the public hearing at 6:37 p.m. Administrator Statz introduced this topic as presented in the packet, noting that the city owns this property and that site plan B, with the building located in the rear of the property is the preferred option. Administrator Statz reviewed the issues outlined in the staff memo, including parking in the right- of-way, etc. Public Comments Andy Fraley, one of the owners of the Guys and Dolls Salon in Hugo, reviewed their proposed site plan for the new salon, noting there will be 12 chairs and that three of them will be used for cosmetic services. Discussion ensued about parking for employees and patrons, French architectural components, and a narrative explaining how the design meets the Downtown Master Plan and Guidelines. Staff recommended tabling the item so the applicant can work with their architect and engineer on a few details regarding architecture and related items. Planner Carlson noted that it would be good to find funding for this if possible. Administrator Statz noted that relocating the poles to the back side of the site would be counter-productive - they would have to be buried. Council liaison Love stated that if the city were to find money for burying the utility lines, the proposal would have to start over to push the building back up to the lot line. The applicant updated the Commission on their timeline, noting they are waiting on civil drawings, geotechnical work, etc. and will be brining the revised plat back to the Commission next month.
