Rezoning from Single-Family R-2 to Single-Family R1. The minimum lot size for zoning in the Single-Family R-1 District is 10 acres, so the property is ineligible to be rezoned under the current code. If the City Code is amended to lower the minimum lot size requirement from 10 acres to 4 acres, then property owners whose lot size meets the 4-acre minimum could request to be rezoned. Zoning requests are reviewed by the Planning and Zoning Commission, and these requests can either be granted or denied by the Commission and City Council. 3. Interim Use Permit (IUP) An Interim Use Permit could be issued to the property owner with the following conditions: (1) Feedlots shall be limited to 1 animal unit as defined by the Minnesota Department of Health. (2) Feedlots shall have 20-foot setbacks from wells and water bodies; and comply with Minnesota Pollution Control Agency, Department of Health, and Department of Natural Resources regulations. (3) Animal pens, feedlots, and runs shall maintain 100-foot setback from all adjacent properties without written permission. With written and signed neighbor permission pens, feedlots, runs, and accessory structures shall maintain a setback of no less than 20 feet. (4) Accessory buildings shall continue to follow existing zoning regulations (R-2) (5) The IUP expires after multiple complaints from neighbors. (6) The IUP expires when any adjacent neighborÓs property further subdivides. (7) The IUP expires with the sale of any adjacent property. Staff Recommendation The staff recommendation is to entertain an application for an IUP with conditions 1-8 listed above and any other conditions that are appropriate after holding a public hearing. Since the city has limited vacant land for development and all land in the city is planned for eventual urban uses, staff feels that limited agricultural uses could be permitted until such time that adjacent properties further develop. Because of the limited duration anticipated for agricultural uses in the city and the incompatibilities which often exist between agricultural and nonagricultural uses, permitted uses in the R-1 District will not reflect intensive commercial agricultural uses. (A) Purpose. The purpose of the R-1 District is to allow agricultural activities and nonsewered residential dwellings as interim uses of the land. The city has limited vacant land for development and all land in the city is planned for eventual urban uses. Because of the limited duration anticipated for agricultural uses in the city and the incompatibilities which often exist between agricultural and nonagricultural uses, permitted uses in the R-1 District will not reflect intensive commercial agricultural uses. (B) Permitted uses. See Table 156-A.1. (C) Special requirements. Agricultural uses are permitted in the R-1 District subject to the following requirements: (1) Feed lots, runs, pens and similar intensively used facilities for animal raising and care shall not be located within 300 feet of a neighboring property; and (2) Accessory farm buildings shall not be erected within 100 feet of a neighboring property. In some cases, the language could have been more detailed or clear. In others, there were seemingly conflicting passages. Still others appeared to just be typos. The purpose of this public hearing and discussion is to work towards a clean-up of as many of these issues as we can. Issue 1 Î Table of Allowed Uses Multi-Family Uses th While reviewing a building permit for 7353 20 Avenue (existing home being converted to a duplex), staff noticed that the newly approved zoning (R2A) did not allow ÐSingle- Family attached dwellings with up to two dwelling units per buildingÑ. On this line in the Table of Allowed Uses, it shows a ÐPÑ in the R2 District, but not in the R2A District. This is clearly a typo, as the purpose of the R2A is to support duplex style development. This style of development is and has not been allowed, historically, in the R2 zone. Staff is recommending that the P for the ÐSingle-Family attached dwellings with up to two dwelling units per buildingÑ use category be moved from the R2 column to the R2A column as has always been intended. Mixed Use Residential A use category labeled ÐSingle-family attached or detached dwellings where in combination with multi-family dwellings on the development property meet the district density goalÑ is show as a allowed use via PUD in the R3 district. However, this use would also be compatible with the M1 and M2 districts, as a PUD. Staff recommends adding a ÐPUDÑ designation in the M1 and M2 district columns for this use category. Eating and Drinking Establishments in the Mixed Use Districts Staff has noticed that the use category ÐEating and Drinking EstablishmentsÑ does not indicate that they are allowed in the Mixed Use districts. Of course, we wish to have these facilities in our downtown, Central Business District, which is zoned M1/M2. Staff is recommending that a PUD indicator be placed in the M1 and M2 district columns for the ÐEating and Drinking EstablishmentsÑ use category. Issue 2 Î Definitions Multi-Family Uses There are a number of terms, dealing with homes which are not ÐSingle Family DetachedÑ that are used interchangeably, creating a lot of confusion. Additionally, some of these terms have meanings within the building code. Staff is looking to create consistent use of various terms throughout the city code. Those terms include: Dwelling Unit Single Family Dwelling, Attached Single Family Dwelling, Detached Two-Family Dwelling Multiple Dwelling Duplex Building Apartment Staff is recommending a number of changes to certain sections of Chapter 156. A red- lined version of the code will be presented at a late date. Autor Repair Autor Repair is listed on our table of allowed uses a number of times, and is carefully zoned, due to the noise, odors, waste, aesthetic and other issues it may create. However, several uses akin to auto repair, but which do not carry with them the same concerns have become more popular. They include, auto detailing, accessory installation, auto glass repair/replacement and other such activities. These uses should be considered for less restrictive use in both commercial and industrial districts. Staff is recommending some changes to the city code which will be presented at a later date. Issue 3 Î Appendix A Î District Regulations Lot and Yard Requirements R2A Î High Density Single-Family Residential District Despite the intent of the R2A District being to allow ÐÈhigher-density single-family detached, attached and multiple-dwellingÈÑ uses, Table 1, in Appendix A of the City Code, does not appear to have a set of setbacks for ÐSingle Family AttachedÑ or ÐMulti- DwellingÑ uses. Further, the term ÐMulti-DwellingÑ equates to an apartment, according to our codeÓs definition section. Looking at the prevalence of the R2A zoning in the city, it is apartment that the intent of that zoning district is NOT for apartments, but rather for both Single Family Detached and Attached homes, with Attached homes being duplexes or twin homes. The commission should discuss whether multi-plexes such as 3, 4+ attached row or townhome style homes should be a part of this district. Staff is recommending that rows be added, for ÐR2A Single-Family AttachedÑ and ÐR2A Two FamilyÑ be established with further discussion on setbacks and other standards. These types of development, are often handled through PUD, so it may make sense to simply note that in the table. R3 Î High Density Multi-Family Residential District The R3 district discusses a Ð...density goal..Ñ of 12 units per acre. This does not provide staff with specific guardrails on minimums or maximum densities. It is the intent of this district to provide opportunities for high density townhome or row homes, in addition to apartments. Again, the setbacks in Table 1 of Appendix A could be reconsidered as many of these projects are done through a PUD. Staff recommends setting the minimum density at 12 units per acre and the maximum at 45 units per acre. It has been subdivided into two plats (see below). All the lots have been sold except Lot 8 and 80% of the homes are built. The third addition is 4 lots, 3 of which sit back inside a wetland area on large lots (see below). This proposed plat was always part of the whole plan for the land. Utility services were stubbed out to service this area without removing any part of the street. The homes will be $600,000 and up. We plan to start construction in June of 2024. The Property is owned by Elmcrest Vistas. Above is the first and second addition of Old Mill Estates Above is the third addition of Old Mill Estates. Zoning Code Use Interpretation Requests Î Max Storage a. Bulk Water Delivery Î Proposal 1 Administrator Statz introduced the item as presented in the packet. As stated in the staff memo, the proposed business would store water tanker trucks capable of delivering bulk water for filling of swimming pools, flooding of hockey rinks and other similar uses, including those common to the construction industry, such as for dust control or to water sod or seed for turf establishment. Administrator Statz noted that no further action is needed by the Planning and Zoning Commission. b. Auto Detailing Î Proposal 2 Administrator Statz introduced this item as presented in the packet, noting that the proposed business consists of auto detailing (intense interior and exterior cleaning), window tinting and the installation of other auto accessories, such as protective films, etc. No vehicle repair would be done. Activities involved could be considered closely similar to a car wash, which is permitted use in the Industrial district. The owner of the auto detailing business addressed the Planning and Zoning Commission and confirmed the information that was provided by Administrator Statz. Staff recommends that the planning and Zoning Commission take formal action to endorse this recommendation or make a different interpretation. c. UTV Outfitter Î Proposal 3 Administrator Statz introduced this item as presented in the packet, noting that the proposed business installs lights, decals, and other accessories on Utility Terrain Vehicles (UTVs), as required to outfit them for use by public safety agencies (police, fire, etc.). No vehicle repair is done. Activities involved in the installation of lights, decals and accessories seem to most closely mirror that of machine and repair shops (indoors), which is a permitted use within the zoning district. StaffÓs recommendation is to allow the use as a permitted use with the finding that it is closely similar to Machine and Repair Shops (indoor) uses, which is a permitted use on the Table of Allowed Uses in the City Code. d. Cabinet Maker Î Proposal 4 Administrator Statz introduced this item as presented in the packet, noting that the proposed business intends to store company trucks inside the bay. Woodworking and cabinet manufacturing and assembly will also take place within the building. Provisions for dust collection have been made and the unit is equipped with fire suppression equipment. The Zoning Administrator has determined that the cabinet making, and assembly portion of the business is a Conditional Use, allowed via a Conditional Use Permit (CUP) under the Manufacturing, processing, assembly except recycling and waste use category. Administrator Statz added that a CUP application should be submitted for consideration as required by the city code and the buildingÓs recorded CUP (conditions 3 & 4). No further action is needed by the Planning and Zoning Commission at this time. Council Member Liaison Council member Koski reported that there was a Fire Steering Committee meeting held on January 18 and they reviewed the budget; both revenues and expenditures were higher than budgeted and the budget is about $25,000 - $30,000 higher than expected (year-end analysis is being finalized). Council member Koski also reported that he recently attended the Anoka County Local Government officials meeting (meetings are held quarterly). He reported that in 2023 the legislature passed a bill on highways trunks that prohibit improvements from increasing traffic volumes. While there is not a trunk highway in Centerville, Council Member Koski noted legislation like this could impact development. 2. Centerville Lake Water Quality Project The Rice Creek Watershed District was awarded a $954,500 Clean Water Fund grant for an alum treatment on Centerville Lake. Matt Kocian, Lake and Stream Program Manager, said: ÐWeÓre very excited for this project, and confident that it will improve water quality conditions.Ñ If possible, the goal would be to complete the first ÐdoseÑ of treatment as early as April of 2024, with a second dose programmed for the spring of 2026. The watershed plans to hold some public informational meetings in the coming months as part of a larger public engagement strategy, including social media posts and appearing at city meetings, among other things. Mr. Kocian presented information at the January 24 City Council meeting and answered questions on project logistics. The watershed is seeking partner participation on the cost of the project from the two cities and the county parks department. CentervilleÓs share is estimated at $35,000. The City Council will consider their support of this cost at an upcoming meeting. ENGINEERING th 20 Avenue (CSAH 54) Corridor Study The technical advisory panel for the corridor study met on January 23 to review initial design options for several intersections within the corridor. Other design elements, such as turn lanes, medians, trails and other pedestrian accommodations were also discussed. Public input meetings will be held soon to gain input on the ultimate design. Stay tuned for updates on how to weigh in. Northeast Metro Water Supply Planning Workshops The next workshop in this series of meetings regarding water supply will be on February 29. City Engineer Statz plans to attend and give input. We are also tracking a bill at the legislature that aims to make Water Supply a ÐRegionalÑ issue, giving authority to Met Council to oversee issues related to the topic. Our legislative advocates at Metro Cities and the League of Minnesota Cities are working to oppose this bill and any further regional overreach by Met Council. Ebert Companies is now working to prepare an application for a Preliminary Plat and PUD as the next step in the entitlement process. The city is seeking feedback on the proposed development. An inspection of the seeding will take place in the spring to wrap up the initial items on the Interim Use Permit. stnd Old Mill Estates 1 and 2 Additions The developer has had surveyors working on site to complete necessary documentation for close-out of the developmentÓs Rice Creek Watershed District Permit, which is the main remaining item to be addressed before we can look at closing out the development escrow. The city continues to work with the developer and builders on site clean-up items. Centerville Storage The facility is now open for business. The developer has completed drainage corrections along the north side of the facility and will continue to work on watershed permit close-out. Rehbein Commercial Developer securities have been received by the city for 35% of the initial project costs and will be held through the 2-year warranty period, which will end in 2024. Kwik Trip The release or reduction of site securities is on this City Council agenda for consideration.
