COUNCIL SPECIAL MEETING I. CALL TO ORDER 8:00am Mayor Love called the meeting to order at 8:00a.m. ROLL CALL Not Approved PRESENT: Mayor, D. Love Council Member Russ Koski Council Member Darrin Mosher Council Member Steve King Council Member Raye Taylor Jr. Council Member Avery Sauber (non-voting) ABSENT: None STAFF: Mark Statz, Athanasia Lewis, Bruce DeJong, Paul Palzer, and Teresa Bender II. DISCUSSION ITEMS 1. 2024 Goals and Strategic Plan Staff led an ice breaker session to kick off the meeting. Discussion ensued about what council members promised their constituents and what they would like their legacy to be. Following the ice breaker roundtable discussion, the Council heard presentations from city departments. Staff were available for questions. Administrator Statz then introduced the topic of population 5,000; he reviewed a few development scenarios and discussion ensued about various build-out options, monies received for reaching a population over 5,000, preserving CentervilleÓs small-town feel, Tax Increment Financing (TIF) for a proposed development (LaLonde property), and planning for capital improvement projects, like a community center or monument. The Council discussed their 2024-2025 Strategic Plan and confirmed they are okay with their current plan. The direction to staff is to continue implementation of our stated goals and priorities, furthering development of programs such as CV Cares). The Council also directed staff to continue focusing on foundational resiliency, i.e., software, records retention before moving on. III. CALL TO ORDER Mayor Love called the meeting to order at 5:00 p.m. 1. Roll Call PRESENT: Mayor D. City Hall Staff Overtime Discussion Administrator Statz reviewed the information that was included in the CouncilÓs packet. He also stated that the CityÓs Personnel Policy allowed for 80 hours of accrual of overtime, that he felt that with a supervisorÓs prior approval, in some instances (i.e., scheduling, project, etc.), overtime was appropriate. Lengthy discussion was had regarding the item and consensus was that SupervisorÓs would limit the levels and oversee the projects, workloads, etc. accordingly. 3. Open Meeting Law Review City Attorney reviewed the information that was included in the CouncilÓs packet. III. ADJOURNMENT Mayor Love adjourned the meeting at 6:25 p.m. allowing for a 5-minute break prior to commencing Councils regular meeting. COUNCIL MEETING I. None. VI. APPROVAL OF THE MINUTES 1. February 14, 2024, City Council Work Session & Meeting Minutes Mayor Love provided an opportunity for Council to make modifications if needed. Council Member Sweeney stated that the last paragraph of page 2 should appropriately reflect that the city rented equipment and pumped the pond for several days. Motion by Council Member Taylor, seconded by Council Member Mosher to Approve the February 14, 2024 Meeting Minutes with the above stated modification. All in favor. Motion carried. Mayor Love stated that Council Member Sweeney noted that the memorandum associated with Item #4 needed clarification regarding the 10% balance regarding Charitable Gambling funds. Motion by Council Member Sweeney, seconded by Council Member Taylor Approve the Consent Agenda with the noted change in Item #4 as presented. All in favor. Motion carried. VIII. OLD BUSINESS 1.Development Security Release Request Î Kwik Trip Administrator Statz stated that the securities are held associated with developments along with smaller escrows for consulting, engineering and legal fees. He explained that the public improvements that were required by the DeveloperÓs Agreement have been accepted by the city and that there is a two-year warranty period required on same. He explained that the securities are held in case the developer fail to complete their requirements stated within the DeveloperÓs Agreement. He stated that it is customary for the city to refund 75% of the securities and retain 25% until the project is finalized and closed. Mayor Love asked Administrator Statz if there were any issues regarding noise from the car wash and he stated none. Administrator Statz stated that there were some concerns with vehicles cutting through MidwestOneÓs parking lot to gain access to Kwik Trip. He stated that Kwik Trip installed larger boulders and planted trees in the area to deter that passage. Brief discussion ensued regarding the hours of operation and ability to change if requested. Motion by Council Member Mosher, seconded by Council Member Sweeney to Approve the Release Development Security to $40,449 and Release the Remaining $881 of Escrow Funds as Requested. All in favor. Motion carried. 2.Reschedule Town Hall Administrator Statz stated that Council scheduled the Town Hall Open House during spring break and it was brought to staffÓs attention. He stated that maybe the last two weeks of the month would work better for the public. Council agreed to reschedule the meeting to March 25, 2024, 5-8 p.m. Page 3 of 5 City of Centerville City Council Meeting Minutes February 28, 2024 Assistant Administrator Lewis stated that there will be four different stations for discussions (i.e., LaLonde Property Concept and Tax Increment Financing (TIF), 2040 Comprehensive Plan Land Use Map, Civic Engagement/POLCO and Capital Projects/Unfunded Projects. Motion by Council Member Taylor, seconded by Council Member Sweeney to Approve March 25, 2024, 5-8 p.m. for the Town Hall Open House Meeting Date. All in favor. Motion carried. IX. NEW BUSINESS 1.None X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS 1.Administrator/Engineer Report Î Administrator Statz stated that his report was contained in the packet and that he would be happy to address any questions from the Council. He provided the Council with a brief review. He stated that he and Jr. Council Member Sauber would be attending City Day on the Hill. 2. Council Reports Junior Council Member Sauber stated that she attended a recent EDA meeting where they discussed incubator spaces, the construction of a building that could provide that space, placing flags along Main Street and that she was excited to participate in City Day on the Hill. She reported that she also attended a school board meeting and found it interesting how different the meetings were compared to CouncilÓs. She reported that the boys swimming and dive team were at Stated along with the boys wrestling team. She stated that the boysÓ hockey team was in the section finals. a. Taylor Î (i) Economic Development Authority Î Council Member Taylor gave no report. (ii) Police Governing Board Î Council Member Taylor gave no report. b. Mosher Î (i) Economic Development Authority Î Council Member Mosher stated that Junior Council Member Sauber was in attendance and that he would provide her with the opportunity to provide the recap. He reported that Mr. Mike Brass appeared before them to discuss 1737 Main Street and its potential for incubator space and also stated that the Page 4 of 5 City of Centerville City Council Meeting Minutes February 28, 2024 committee was attempting to assist Max Storage with providing ease to potential tenants for allowable uses. (ii) Police Governing Board Î Council Member Mosher gave no report. e. Love Î (i) North Metro Telecommunications Commission Î Mayor reported that they spoke about NSPN (local cable sports networking). He also reported that the commission was able to broadcast the last three State tournament football games due to the relationship. He stated that their home movie transfer services grossed $7,000 which was their most profitable month (December, 2023) and for their annual services $23,000. He stated that they continue to find new ways to make money as they recently filmed two football games for Cottage Grove and made $7,000. He also stated that they would be contracting their engineering/consulting services with the City of Cambridge for $250/hr. He stated that the total franchise fees for the year were $150,000 of which the CityÓs portion would be $5,367.02 which should be received shortly. (ii) Police Governing Board Î Mayor Love gave no report. (iii) Other Mayoral Reports Î Mayor Love reported that ÐClearopathraÑ was named and he had participated in a photo opportunity with the winner. He stated that North Metro TV completed the photo op. and a cable segment of the event. He reported that City Day at the Capital was taking place on March 7, 2024, and that the Town Hall Open House was now scheduled for March 25, 2024. He stated that he had an appointment to meet with a Scout member which would assist the individual in obtaining their merit badge. XI. In some cases, the language could have been more detailed or clear. In others, there were seemingly conflicting passages. Still others appeared to just be typos. The purpose of this public hearing and discussion is to work towards a clean-up of as many of these issues as we can. Issue 1 Î Table of Allowed Uses Multi-Family Uses th While reviewing a building permit for 7353 20 Avenue (existing home being converted to a duplex), staff noticed that the newly approved zoning (R2A) did not allow ÐSingle- Family attached dwellings with up to two dwelling units per buildingÑ. On this line in the Table of Allowed Uses, it shows a ÐPÑ in the R2 District, but not in the R2A District. This is clearly a typo, as the purpose of the R2A is to support duplex style development. This style of development is and has not been allowed, historically, in the R2 zone. Staff is recommending that the P for the ÐSingle-Family attached dwellings with up to two dwelling units per buildingÑ use category be moved from the R2 column to the R2A column as has always been intended. Mixed Use Residential A use category labeled ÐSingle-family attached or detached dwellings where in combination with multi-family dwellings on the development property meet the district density goalÑ is show as a allowed use via PUD in the R3 district. However, this use would also be compatible with the M1 and M2 districts, as a PUD. Staff recommends adding a ÐPUDÑ designation in the M1 and M2 district columns for this use category. Eating and Drinking Establishments in the Mixed Use Districts Staff has noticed that the use category ÐEating and Drinking EstablishmentsÑ does not indicate that they are allowed in the Mixed Use districts. Of course, we wish to have these facilities in our downtown, Central Business District, which is zoned M1/M2. Staff is recommending that a PUD indicator be placed in the M1 and M2 district columns for the ÐEating and Drinking EstablishmentsÑ use category. Issue 2 Î Definitions Multi-Family Uses There are a number of terms, dealing with homes which are not ÐSingle Family DetachedÑ that are used interchangeably, creating a lot of confusion. Additionally, some of these terms have meanings within the building code. Staff is looking to create consistent use of various terms throughout the city code. Those terms include: Dwelling Unit Single Family Dwelling, Attached Single Family Dwelling, Detached Two-Family Dwelling Multiple Dwelling Duplex Building Apartment Staff is recommending a number of changes to certain sections of Chapter 156. A red- lined version of the code will be presented at a late date. Autor Repair Autor Repair is listed on our table of allowed uses a number of times, and is carefully zoned, due to the noise, odors, waste, aesthetic and other issues it may create. However, several uses akin to auto repair, but which do not carry with them the same concerns have become more popular. They include, auto detailing, accessory installation, auto glass repair/replacement and other such activities. These uses should be considered for less restrictive use in both commercial and industrial districts. Staff is recommending some changes to the city code which will be presented at a later date. Issue 3 Î Appendix A Î District Regulations Lot and Yard Requirements R2A Î High Density Single-Family Residential District Despite the intent of the R2A District being to allow ÐÈhigher-density single-family detached, attached and multiple-dwellingÈÑ uses, Table 1, in Appendix A of the City Code, does not appear to have a set of setbacks for ÐSingle Family AttachedÑ or ÐMulti- DwellingÑ uses. Further, the term ÐMulti-DwellingÑ equates to an apartment, according to our codeÓs definition section. Looking at the prevalence of the R2A zoning in the city, it is apartment that the intent of that zoning district is NOT for apartments, but rather for both Single Family Detached and Attached homes, with Attached homes being duplexes or twin homes. The commission should discuss whether multi-plexes such as 3, 4+ attached row or townhome style homes should be a part of this district. Staff is recommending that rows be added, for ÐR2A Single-Family AttachedÑ and ÐR2A Two FamilyÑ be established with further discussion on setbacks and other standards. These types of development, are often handled through PUD, so it may make sense to simply note that in the table. R3 Î High Density Multi-Family Residential District The R3 district discusses a Ð...density goal..Ñ of 12 units per acre. This does not provide staff with specific guardrails on minimums or maximum densities. It is the intent of this district to provide opportunities for high density townhome or row homes, in addition to apartments. Again, the setbacks in Table 1 of Appendix A could be reconsidered as many of these projects are done through a PUD. Staff recommends setting the minimum density at 12 units per acre and the maximum at 45 units per acre. Love, Councilmember Raye Taylor, and Administrator Statz attended the City Day on the Hill on March 7. Throughout the day, council members and staff learned about legislative issues impacting cities and had the opportunity to meet with our state legislators to discuss them. Governor Walz was also in attendance and made a few remarks. Before making his exit, the governor took a few minutes to meet with Avery Sauber, our Junior Councilmember. During our visits with legislators, we expressed our concerns regarding various bills which look to preempt local zoning control by allowing, by right, the construction of duplexes, triplexes, and other multifamily structures in single family residential neighborhoods. Other provisions of these proposed laws prohibit cities from establishing parking minimums, landscape requirements, architectural standards, and a host of other things. While well-intended, these rules, seem to set aside a cityÓs comprehensive plan and ignore the hard work of planning commissions and city planners across the state. ENGINEERING TH 20 Avenue (CSAH 54) Corridor Study Open House On March 26, from 4:30 Î 6:30 PM at Centerville City Hall, Anoka County and the Cities of Lino Lakes and Centerville will be hosting an open house to look th at draft layouts for the 20 Avenue corridor study. This study outlines how the roadway will look in the 5 to 10 year future. As businesses and residents are added to the area, this route has matured to the point where it has outgrown its current configuration. Come and be a part of designing its upgrade. ELECTIONS 2024 Presidential Primary City Staff processed five absentee envelope ballots, and ten direct ballots during the 45-day period prior to Election Day. The Election Judges assisted four individuals in registering and processed 333 registered voters on Election Day. These numbers are extremely low for the registered public of Centerville, but not a horrible turn-out for the Presidential Primary where most voters are not active. The city was honored with training two new Election Judges and the work of our returning judges. Without these individuals, elections could not happen. Thank you! We will see you in August for the Primary Elections. PUBLIC WORKS WeÓre Hiring The city is hiring for two different job categories. We have one position open for a Full time Public Services Technician and have four positions open for our Seasonal Public Works/Parks Maintenance Workers. Public Services Technician (Full Time) The Public Services Technician will work in the Public Works Department under the direction of the Public Works Director. Duties include but are not limited to: installs or maintains and repairs main water and sewer lines, manholes, catch basins, wells, lift stations, water meters, cement work, buildings, parks, park equipment, property and related equipment and facilities. Also maintains roadways, including patching, filling potholes, paving, sweeping and snow removal (streets, sidewalks, and trails). Also monitors and maintains the cityÓs water and sewer systems. Position requires the ability to respond to public inquiries in a courteous manner, providing information within the scope of knowledge or refers inquires to the Public Works Director or City Administrator. Click here for an employment application packet Lead Service Line Replacement Mandate New laws require cities to inventory and create a plan for replacement of lead service lines (even if the city does not own the portion on the private property). Luckily for Centerville, we were able to document that none of our cityÓs service lines are lead or galvanized. This is because all of our water system was put in after 1984, when lead service lines and fittings were outlawed. Our inventory and other documentation have been submitted to the State Department of Health, well ahead of the October 16, 2024 deadline. Centerville Lake Water Quality Project The Rice Creek Watershed District was awarded a $954,500 Clean Water Fund grant for an alum treatment on Centerville Lake. Matt Kocian, Lake and Stream Program Manager, said: ÐWeÓre very excited for this project, and confident that it will improve water quality conditions.Ñ If possible, the goal would be to complete the first ÐdoseÑ of treatment as early as April of 2024, with a second dose programmed for the spring of 2026. The watershed plans to hold some public informational meetings in the coming months as part of a larger public engagement strategy, including social media posts and appearing at city meetings, among other things. Mr. Kocian presented information at the January 24 City Council meeting and answered questions on project logistics. The watershed is seeking partner participation on the cost of the project from the two cities and the county parks department. CentervilleÓs share is estimated at $35,000. The City Council will consider their support of this cost at an upcoming meeting. ENGINEERING Northeast Metro Water Supply Planning Workshops The next workshop in this series of meetings regarding water supply will be on February 29. City Engineer Statz plans to attend and give input. We are also tracking a bill at the legislature that aims to make Water Supply a ÐRegionalÑ issue, giving authority to Met Council to oversee issues related to the topic. Our legislative advocates at Metro Cities and the League of Minnesota Cities are working to oppose this bill and any further regional overreach by Met Council. COMMUNITY DEVELOPMENT 1687 Westview Street (LaLonde Property) A Memorandum of Understanding was approved at the December 13 City Council meeting, outlining the various facets of a potential development deal involving Tax Increment Financing in support of a 110-unit market rate apartment building. The development was also presented to the planning commission for a sketch plan review on January 2, 2024. Ebert Companies is now working to prepare an application for a Preliminary Plat and PUD as the next step in the entitlement process. City staff and the developer continue to work on design issues, such as fire lanes, landscaping, traffic issues and architecture. A recent iteration of the buildingÓs exterior shows a nod to Old Centerville School. While this sketch does not represent the final architectural plans for the building, it does give an idea of the types of things being explored. Peltier Estates Sharper Homes has submitted an application for Preliminary Plat and a Planned Unit Development for the th 19 acres in the northeast portion of the city along 20 Avenue, just north of Deer Pass. The development proposal features 24, detached townhomes. A public hearing on the development will be held at the April 2 Planning and Zoning Commission meeting (6:30 PM at City Hall). The proposal is substantially the same as what was proposed in 2017 and again in 2021. rd Old Mill Estates 3 Addition rd The developer of Old Mill Estates is proposing a 3 Addition concept that went before the Planning and Zoning Commission for a ÐConcept ReviewÑ at their March 4 meeting. This subdivision was always a stnd part of the discussion when Old Mill Estates (1 and 2 Additions) was platted. However, the developer needed more time to work out wetland and power line easement issues. With some of those issues more in hand, the proposed subdivision would break up Lot 8, Block 2, into 4 lots (3 new lots). Block 7 Property (Downtown) Kennedy Property Development Staff has not received any meaningful response from Kennedy Development. Other Interested Parties Our realtor has been speaking with a developer who is interested in exploring up to 50 townhome units on the site. Their product involves 3-story buildings, in a high-density arrangement, like row-homes. 1737 Main Street (Block 3) A restaurant owner has expressed interest in the site, through our realtor. He will be exploring building layout options. 7087 Centerville Road Î Connor James Salon (Block 8) The required fencing has been installed along the west edge of the parking lot. An inspection of the seeding will take place in the spring to wrap up the initial items on the Interim Use Permit. stnd Old Mill Estates 1 and 2 Additions The developer has had surveyors working on site to complete necessary documentation for close-out of the developmentÓs Rice Creek Watershed District Permit, which is the main remaining item to be addressed before we can look at closing out the development escrow. The city continues to work with the developer and builders on site clean-up items. Centerville Storage The facility is now open for business. The developer has completed drainage corrections along the north side of the facility and will continue to work on watershed permit close-out. Rehbein Commercial Developer securities have been received by the city for 35% of the initial project costs and will be held through the 2-year warranty period, which will end in 2024. Kwik Trip The city council approved a reduction in the developmentÓs security, with the final escrow release coming at the end of the 2-year warranty period (Dec.
