Attached, you will find, their applications, proposed plat, plans, project narrative and memos from our City Attorney, Engineer and Planner. The memos from our Attorney and Engineer are from previous submittals and have not been modified, since the submitted plan is the same as that of previous submittals. Previous submittals went through several iterations with the the Planning Commission and city staff. The versions of the plans and plat that are a part of this proposal represent the final version of those plans, after addressing earlier comments. These plans were approved by the Planning Commission. This does not, however, obligate this Planning Commission in any way. Finished lots will be sold to Sharper Homes (of the same owners), who will complete the townhome builds. Sharper Homes has a long history of building homes in Centerville, and we’re excited to get this new project under way. It is our intention to tailor this project to suit the property as best as possible. Due to minimal upland space as well as limited availability of fill material, this property is best suited for slab on grade housing. The preference for slab-on-grade helps us determine the best house style and ideal clientele, and ultimately the requirement for a planned unit development. Detached townhomes work very well in this situation. Our ideal clientele are small families or “empty nest” parents looking to downsize without the need, or desire, of a basement space or large yard. In this case, the association-maintained exterior is a major selling point. These clients are looking for a smaller, but still upscale, home in a community they are excited to be a part of. REQUEST: CUP for PUD Development Plan, Preliminary Plat Ï Peltier Estates th Avenue ADDRESS: 7357 20 PIDS:1001 4-31-22-41-0 OWNER: BMR Family Limited Partnership ZONING: R-2 INTRODUCTION Sharper Homes applied to the City in 2021 to plat the 18.7-acre parcel known as the property at the north end of the City into 24 home lots. The property is challenging to develop Ï it has large areas of scattered wetlands that make efficient development difficult. They have applied for a planned unit development (PUD) to allow smaller lots along a single cul-de-sac street. The plan was shelved until now and they are re-applying for preliminary plat and PUD approval. The plan being considered now in 2024 is identical to the 2021 plan. The property is zoned R-2 and guided LowDensity Residential in the Comprehensive Plan. PROCESS The process and details of the code requirements are summarized in the attached memorandum from City Attorney Kurt Glaser from February 25, 2021. Those same facts apply for this application. In Centerville a PUD is processed as a conditional use permit (CUP), with criteria in the code for reviewing a PUD, discussed below. City standards can be modified within a PUD if there are conditions that warrant it, which there are for this property and this project, with the following comparison to the R-2 zoning standards: April 2, 2024 Centerville Planning & Zoning Commission Page 2 of 5 RE: CUP for PUD Development Plan, Preliminary Plat Ï Peltier Estates Minimum lot area Ï 15,000 sq ft minimum required; proposed lot sizes range from about 4,100 to 5,600 sq ft Lot width Ï 100 ft minimum required; proposed widths are about 49 ft to 66 ft Front setback Ï 35 ft required; 13 ft average proposed Rear setback Ï 25 ft required; 10 ft average proposed (backing up to common open space, not adjacent property) Side setback Ï 10 ft required; 5 ft proposed Overall, the residential density is only about 1.3 units/acre, owing to the large areas of wetland, open water, and common open space. This is a classic example of the application of a PUD Ï to design the property as a whole, allowing flexibility in the strict application of zoning standards. PLAT The preliminary plat consists of 25 lots and a public street ROW: 24 small home lots along a new th street, Peltier Court, a cul-de-sac about 820 ft in length, and a 25lot encompassing all of the rest of the property as common open space, including all the wetlands. All of Lot 25 is a drainage and utility easement. The plat is illustrated below. April 2, 2024 Centerville Planning & Zoning Commission Page 3 of 5 RE: CUP for PUD Development Plan, Preliminary Plat Ï Peltier Estates TRAIL A feature of the plan from 2021 is a trail connection with a boardwalk between the end of the new cul-de-sac of Peltier Court to the cul-de-sac of Brian Drive south of the property. This connection is important for bike and pedestrian access between the neighborhoods and will be a condition of approval, although not shown on the plat itself Ï it will be recorded as a separate easement with the County. A street connection is not feasible given the extent of the wetlands. PUD STANDARDS Section 156.210 of the zoning code has the general requirements for a PUD. That section says the City may approve the PUD if it satisfies all the following standards: (A)The development shall be planned so that it is consistent with the city comprehensive plan; (B)The PUD is an effective and unified treatment of the development possibilities on the project site and the development plan provides for the preservation of unique natural amenities such as streams, stream banks, wooded cover, rough terrain and similar areas; (C)The planned unit development proposal appears to harmonize with both existing and proposed development in the area surrounding the project site; (D)The tract of land shall be under unified control at the time of application and scheduled to be developed as one unit. In addition, the development plan must include provisions for the preservation of natural amenities; (E)Each phase of the proposed development, as it is proposed to be completed, is of sufficient size, composition and arrangement that its construction, marketing and operation are feasible as a complete unit, and that provision and construction of dwelling units and common open space are balanced and coordinated; (F)The PUD will not create an excessive burden on parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the district; (G)The proposed total development is designed in a manner as to form a desirable and unified environment ithin its own bounda wries; (H)The plans required under this section must be submitted in a form which will satisfy the requirements of Chapter 153 for the preliminary and final plats; (I)Permission to develop specific parcels of land under the provisions which follow shall be binding on all construction. Any change in the development plan after approval by the City Council shall be resubmitted for consideration; and (J)Subdivision review under the subdivision chapter shall be carried out simultaneously with the review of a under this sectio PUDn. As discussed above, the overall design and layout of the plan satisfies these standards Ï the plat works around the wetlands and is a unified whole resulting in a reasonable plan. April 2, 2024 Centerville Planning & Zoning Commission Page 4 of 5 RE: CUP for PUD Development Plan, Preliminary Plat Ï Peltier Estates ENGINEERING ISSUES The plans were reviewed and approved in concept by the City Engineer previously in 2021 relative to grading, drainage, stormwater management, street design, and provision of City utilities. The current proposal will follow those plans and is acceptable. RECOMMENDATION I recommend that the Planning & Zoning Commission recommend approval of the PUD Concept Plan and Preliminary Plat for Peltier Estates as submitted with the following conditions and findings of fact: Conditions of Approval of the PUD Concept Plan and Preliminary Plat 1)The final plat will be reviewed and approved by the City Engineer and City Attorney and will follow the approved preliminary plat unless City staff determines that any changes are not significant deviations from the preliminary approval. 2)Grading, utility, and other plans will be reviewed and approved by City staff prior to issuance of permits for the project. 3)The right-of-way for Peltier Court will be dedicated to the City. 4)A 20-foot-wide trail easement will be recorded with the County in favor of the City for the trail connection as shown in PlannerÔs report of April 2, 2024, to be reviewed and approved by the City Attorney and City Engineer. Findings of Fact for Approval of PUD Concept Plan and Preliminary Plat th 1)The property at 7357 20 Avenue (the ÑPropertyÒ) is owned by the BMR Family Limited Partnership, consisting of approximately 18.7 acres. 2)The Property is zoned R-2 Single Family Residential. 3)Sharper Homes, Inc. has applied for Planned Unit Development (PUD) Concept Plan approval and preliminary plat for Peltier Estates for a residential subdivision of 24 home lots. 4)The proposed plat for Peltier Estates consists of 25 lots in one block Ï 24 lots for single family homes and a common lot encompassing wetlands and common area under a drainage and utility easement. 5)The proposed plat is a unified treatment of the property resulting in an overall density of tely 1.3 units per acre approxima. 6)The proposed plan satisfies the standards for approval of a CUP for PUD Concept Plan in Section 156.210 of the Centerville Zoning Code. April 2, 2024 Centerville Planning & Zoning Commission Page 5 of 5 RE: CUP for PUD Development Plan, Preliminary Plat Ï Peltier Estates 7)The proposed plat of Peltier Estates satisfies the conditions for approval of a preliminary Section 153, the Centerville Subdivision Ordinance. 60-DAY DEADLINE There are separate deadlines for the CUP/PUD and preliminary plat applications Ï 60 days for the PUD zoning request per MN Statute 15.99, 120 days for the preliminary plat per MN Statute 462.358 Subd. 3b. The application was received March 8, 2024. The 60-day deadline for final action on the PUD/CUP is May 8, 2024; the 120-deadline for the preliminary plat is July 7, 2024. MEMORANDUM TO: PLANNING AND ZONING COMMISSION FROM: KURT B. GLASER, CITY ATTORNEY PHIL CARLSON, CITY PLANNER SUBJECT: PELTIER ESTATES - PUBLIC HEARING FOR PLANNED UNIT DEVELOPMENT DATE: 2/25/2021 CC: MARK STATZ, CITY ADMINISTRATOR The applicant, Sharper Communities, LLC, asks the City for a Planned Unit Development for Peltier Estates. This memo describes the procedure and standards for granting a PUD. Procedure for acting on a request for a Planned Unit Development (ÐPUDÑ) A conditional or interim use permit shall be required of all PUDs. The city may approve the PUD if it finds the development is consistent with the following principals: (A) The development shall be planned so that it is consistent with the city comprehensive plan; (B) The PUD is an effective and unified treatment of the development possibilities on the project site and the development plan provides for the preservation of unique natural amenities such as streams, stream banks, wooded cover, rough terrain and similar areas; (C) The planned unit development proposal appears to harmonize with both existing and proposed development in the area surrounding the project site; (D) The tract of land shall be under unified control at the time of application and scheduled to be developed as one unit. Next, the Commission must consider the facts presented during the public hearing. The relevant information follows. The ApplicantÓs PUD request APPLICABLE R-2 STANDARDS The following standards apply in a R-2 zoning district: Minimum lot area is 15,000 square feet. Minimum lot width is 100 feet. Front setback is 35 feet. Rear setback is 25 feet. Side setback is 10 feet. REQUESTED VARIANCES This development is in an R-2 zoning district. The land is comprised of large areas of wetland interspersed with high ground suitable for development. These large tracks of wetland are a challenge to develop. The planners needed to alter the wetlands to join areas of high ground suitable to build houses with streets to access those homes. These areas follow the existing contours of the land. This minimizes the areas where land infill is necessary to join areas of high ground. The developer now asks for variances related to lot size and building placement to accommodate the challenge of developing this land. The developer asks for a variance from each of the R-2 standards stated above. Given the undulating nature of the proposed lots and lot configurations, there is no uniformity in their requested variances. The developer proposes to define the variances for each lot on a diagram. (This diagram will be drawn once approvals are recommended. This diagram is similar to the Grading & Drainage Plan included with this memo.) Generally stated, the requested variances are as follows. Minimum lot area. The proposed lots vary in area from 4,166 to 5,557 square feet. Minimum lot width. The proposed lot widths vary from 48.9 to 65.7 feet wide. Front setback. As proposed, the average front setback is approximately 13 feet. Rear setback. As proposed, the average front setback is approximately 10 feet. Side setback. As proposed the side setbacks are 5 feet. LOT SIZE AND SETBACKS During the design process in 2017, lot location, size, setbacks and backyard requirements were negotiated and discussed. The layout of the development shown is the result of those discussions. The developer is not proposing any changes to that layout with this application. NOTABLE FACTS In 2017, the City rezoned this parcel from R-1 to R-2. The City rezoned this parcel to accommodate this proposed development and lot configuration which are the subject of this PUD request. The Rice Creek Watershed District approved the proposed plat configuration where homes and roads follow the existing areas of high ground. It is an important goal of the City to have an interconnected roadway system. The proposed street within Peltier Estates does not connect to Brian Drive. Creating this connection through the existing wetland would be cost prohibitive and resulted in large wetland impacts that could disturb the natural function of the larger wetland complex. The developer proposes a trail and boardwalk to create a pedestrian connection with the rest of the City, enabling residents to access nearby parks and trails without walking on the county highway. The boardwalk connection minimizes wetland impacts. COMPREHENSIVE PLAN The CityÓs Comprehensive Plan (Growth Management Plan) guides the property for Low/Medium Density Residential. The R-2 zoning district is a low-density residential district. These 24 lots are consistent with the density aspect of the Comprehensive Plan and the R-2 district, given the undevelopable wetland portions of this plat. The density of this plat will not change since the wetlands will be protected by easement against future development. CITY OF CENTERVILLE, ANOKA COUNTY, MINN. Findings and Decision regarding Conditional Use Permit/Planned Unit Development The Planning & Zoning Commission met on March 3, 2021 to hold a public hearing to consider a request of Sharper Communities, LLC for a Planned Unit Development of their property. FINDINGS: 1) The property is currently described as: The North Half of the Northeast Quarter of the Southeast Quarter of Section 14, Township 31 North, Range 22 West, Anoka County, Minnesota, except the following described property: That part of said North Half of the Northeast Quarter of the Southeast Quarter of Section 14, Township 31 North, Range 22 West, Anoka County, Minnesota, described as follows: Beginning at the Southeast corner of said North Half of the Northeast Quarter of the Southeast Quarter; thence North 125 feet along the east line of said Section 14; thence westerly 348.5 feet on a line parallel to the south line of said North Half of the Northeast Quarter of the Southeast Quarter; thence southerly 125 feet to a point on the south line of said North Half of the Northeast Quarter of the Southeast Quarter; thence easterly 348.5 feet to the place of beginning. 2) The applicant has submitted a request for a Planned Unit Development in conjunction with applications for subdivision. The proposed development provides for 24 units of detached townhomes. 3) City Code Sec 156.210 specifies that approval of a Planned Unit Development be in substantially the same form as for approval of a conditional use permit. 4) The Commission finds that the unique characteristics of this property make development difficult due to numerous wetlands on the property. 5) The Commission finds that the development could not occur at a reasonable density without some flexibility in the design of the plat, lot size, and building placement. 6) The Commission finds that development will benefit the City by granting variances to the following standards which apply in the R-2 zoning district: a) Minimum lot area of 15,000 square feet. b) Minimum lot width of 100 feet. 1 c) Front setback of 35 feet. d) Rear setback of 25 feet. e) Side setback of 10 feet. 7) The Commission finds that each element of City Code Sec 156.210, as required for approval of a Planned Unit Development, has been met by the proposed plan. RECOMMENDATION: rd The Planning & Zoning Commission, by its action on this 3 day of March 2021, recommends that the council grant approval of the Planned Unit Development, subject to the following: 1) Developer shall execute a Planned Unit Development agreement to be approved by City Council. 2) Staff recommendations are forwarded to Council with this recommendation. 3) The elements of the Planned Unit Development shall be enforced by a Conditional Use Permit which includes the following: a. The variances approved in these findings shall be set forth in a detailed survey drawing. b. Easements governing the wetlands on the Plat, for their perpetual maintenance by the homeowners, and with prohibitions against future development. c. Construction and perpetual maintenance by the homeowners of a trail connecting the development to Brian Drive. 2 CITY OF CENTERVILLE ANOKA COUNTY, MINNESOTA CONDITIONAL USE PERMIT APPROVAL OF PLANNED UNIT DEVELOPMENT 1. Permit. Subject to the terms and conditions set forth herein, the City of Centerville hereby grants approval of a Planned Unit Development for: Applicant, Sharper Communities, LLC, to develop the described property into 24 units of detached townhomes. Each lot on the Property and each townhome unit may be constructed pursuant to variances as to the following standards. Minimum lot area. Minimum lot width. Front setback. Rear setback. Side setback. The extent of each variance has been granted in the manner set forth in Exhibit A. This Permit is granted to complete the development subject the conditions set forth below. 2. Property. ENGINEERING TH 20 Avenue (CSAH 54) Corridor Study Open House OnMarch 26, from 4:30 – 6:30 PM at Centerville City Hall, Anoka County and the Cities of Lino Lakes and Centerville will be hosting an open house to look at th draft layouts for the 20 Avenue corridor study. This study outlines how the roadway will look in the 5-to-10-year future. As businesses and residents are added to the area, this route has matured to the point where it has outgrown its current configuration. Come and be a part of designing its upgrade. PUBLIC WORKS We’re Hiring Seasonal Public Works/Parks Maintenance Worker This is a summer position assisting in general maintenance of city facilities (parks, streets, etc.). Requires valid driver’s license and good driving record, high school diploma or GED, experience with maintenance quipment; ability to lift 25 lbs and occasionally up to 75 lbs. Must have personal transportation to work. Hourly pay: $16.30/hr. We have received about a dozen applications for the position. Interviews of top candidates are being scheduled with the goal of having a hiring recommendation to the City Council by the second meeting in April. MN Department of Health Annual Inspection th Brian with the Department of Health performed his annual audit March 14 which consists of reviewing the Water system operation, water usage, operators’ licensures, and yearly reports. The city has completed the Lead Service Line Assessment Program and submitted it to the Health Department. Samples were taken for the well entry points and tower for analysis. The city is compliant with all requirements of the water system. A follow-up report will be sent in 3-4 weeks detailing the visit, sample results and any recommendations. Centerville Lake Water Quality Project The Rice Creek Watershed District was awarded a $954,500 Clean Water Fund grant for an alum treatment on Centerville Lake. Matt Kocian, Lake and Stream Program Manager, said: “We’re very excited for this project, and confident that it will improve water quality conditions.” If possible, the goal would be to complete the first “dose” of treatment as early as April of 2024, with a second dose programmed for the spring of 2026. The watershed plans to hold some public informational meetings in the coming months as part of a larger public engagement strategy, including social media posts and appearing at city meetings, among other things. Mr. Kocian presented information at the January 24 City Council meeting and answered questions on project logistics. The watershed is seeking partner participation on the cost of the project from the two cities and the county parks department. Centerville’s share is estimated at $35,000. The City Council will consider their support of this cost at their March 27th meeting. ENGINEERING Northeast Metro Water Supply Planning Workshops The next workshop in this series of meetings regarding water supply will be on February 29. City Engineer Statz plans to attend and give input. We are also tracking a bill at the legislature that aims to make Water Supply a “Regional” issue, giving authority to Met Council to oversee issues related to the topic. Our legislative advocates at Metro Cities and the League of Minnesota Cities are working to oppose this bill and any further regional overreach by Met Council. COMMUNITY DEVELOPMENT New Planning & Zoning Commissioners The Planning & Zoning Commission will have two new members sworn in at their April 2 meeting. Matt McCabe and Jeannie Seppala have been formally appointed by the City Council and are being brought up to speed on everything going on in terms of development proposals around the city. 1687 Westview Street (LaLonde Property) A Memorandum of Understanding was approved at the December 13 City Council meeting, outlining the various facets of a potential development deal involving Tax Increment Financing in support of a 110-unit market rate apartment building. The development was also presented to the planning commission for a sketch plan review on January 2, 2024. Ebert Companies is now working to prepare an application for a Preliminary Plat and PUD as the next step in the entitlement process. The developer for the LaLonde Proposal will be on hand at the Town Hall Open House on Monday, March 25th to answer questions regarding their proposed development. Recent updates to the site plan have the building shifted more to the south, to accommodate a fire lane along the north side of the building. Additionally, the parking lot on the west side of the building has been eliminated in lieu of more underground parking. This eliminates the need for improvements to Westview Street. Peltier Estates Sharper Homes has submitted an application for a Preliminary Plat and Planned Unit Development for the th 19 acres in the northeast portion of the city along 20 Avenue, just north of Deer Pass. The development th proposal features 24, detached townhomes served by a cul-de-sac off 20 Avenue. A trail connection to the sidewalk on the west side of Brian Drive will be made from the end of the cul-de-sac. A public hearing on nd the development will be held on April 2 , at the Planning & Zoning Commission meeting (6:30 PM at City Hall). The proposal is substantially the same as what was proposed in 2017 and again in 2021. rd Old Mill Estates 3 Addition rd The developer of Old Mill Estates is proposing a 3 Addition concept that went before the Planning & Zoning Commission for a “Concept Review” at their th March 4, meeting. This subdivision was always a st part of the discussion when Old Mill Estates (1 and nd 2 Additions) was platted. However, the developer needed more time to work out wetland and power line easement issues. With some of those issues more in hand, the proposed subdivision would break up Lot 8, Block 2, into 4 lots (3 new lots). We anticipate a formal application for Preliminary Plat, leading to a public hearing in May. Block 7 Property (Downtown) Kennedy Property Development Staff has not received any meaningful response from Kennedy Development. Other Interested Parties Our realtor has been speaking with a developer who is interested in exploring up to 50 townhome units on the site. Their product involves 3-story buildings, in a high-density arrangement, like row-homes. 1737 Main Street (Block 3) An interested party contacted the city, wishing to explore a retail/office storefront for a real estate business with apartments above. 7087 Centerville Road – Connor James Salon (Block 8) The required fencing has been installed along the west edge of the parking lot. An inspection of the seeding will take place in the spring to wrap up the initial items on the Interim Use Permit. stnd Old Mill Estates 1 and 2 Additions The developer has had surveyors working on site to complete necessary documentation for close-out of the development’s Rice Creek Watershed District Permit, which is the main remaining item to be addressed before we can look at closing out the development escrow. The city continues to work with the developer and builders on site clean-up items. Centerville Storage The facility is now open for business. The developer has completed drainage corrections along the north side of the facility and will continue to work on watershed permit close-out. Rehbein Commercial Developer securities have been received by the city for 35% of the initial project costs and will be held through the 2-year warranty period, which will end in 2024. Drilling Estates The owner of the westernmost two lots on Mound Trail is looking to shift the common lot line between the two. After some discussion, all parties agree that platting the property (it’s not currently platted) would be the best way to accomplish this. An application for preliminary plat has now been received and a public hearing will be held at the May Planning and Zoning Meeting. The plat would not create any new lots. The plat will be jointly signed by Centerville and Lino Lakes, since the properties straddle the municipal boundary.
