TITLE OF ISSUE: Variance Request - 7021 LaMotte Drive (Driveway) BACKGROUND AND SUPPLEMENTAL INFORMATION: The resident at 7021 LaMotte Drive would like to talk with the Planning Commission about requesting a variance or text amendment to the City Code that would thereby allow him to widen his driveway beyond what is currently allowed in the existing regulations. Please see the attached drawings of what the resident would like to do (which is outside of the current regulations). Mr. McCall's garage is 31' and his existing driveway is 24', e can widen to 31' but he would like an additional 7' or 10'. He is willing to concrete his driveway to replace what he currently has, which is rock. Mr. McCall's request for a variance for this proposal was not supported by the P&Z in May 2024. A loading space shall have minimum dimensions of not less than 12 feet in width, 50 feet in length, exclusive of driveways, aisles and other circulation areas. One off-street loading space shall be provided and maintained on the same lot for each commercial and industrial use requiring regular delivery of goods and having a modified gross floor area of more than 10,000 square feet. One loading space shall be provided for each additional 25,000 square feet or fraction thereof. No off-street loading space shall be located in any required yard adjoining any residential use. Required off-street loading space shall not be included as off-street parking space in computing required off-street parking space. Vehicles utilizing this loading space shall not project into the public right-of-way. (H)Fractional space. When an application of the standards of this chapter with respect to number of off- street parking spaces results in the need to provide a fraction of one space, any fraction of one-half or less shall be disregarded and any other fraction shall be construed as one. (I)Uses not mentioned. For any use not specifically mentioned in the schedule of off-street parking and loading requirements, the number of spaces required should be that required for that use named in the schedule which is determined by the Planning and Zoning Commission to be most similar. (J)Spaces for five or more automobiles. Parking areas consisting of five or more off-street parking spaces shall have individual spaces so marked by pavement striping, the perimeter of lot shall be surrounded by curbing, and shall be so designed, maintained and regulated that no parking or maneuvering incidental to parking shall be on any public street, walk or alley and so that any vehicle may be parked and unparked without moving another vehicle. (K)Improvement and maintenance. Required parking and loading spaces, together with driveways, aisles and other circulation areas, shall be improved in a way as to provide a durable and dust-free surface asphalt, concrete, pavers, cobblestone or similar material according to minimum city specifications, excluding R-1 Districts. All parking and loading areas shall provide for proper drainage of surface water to prevent the drainage of the water onto adjacent properties or walkways. The owner of any parking or loading area shall maintain the area in good condition without holes and free of all dust, trash and other debris. Parking and access drives shall be located a minimum of five feet from any property line. Parking spaces shall be a minimum of nine feet wide and 18 feet deep. (L)Driveway Access. TITLE OF ISSUE: Variance Request - 1421 Mound Trail BACKGROUND AND SUPPLEMENTAL INFORMATION: The resident at 1421 Mound Trail is requesting a variance(s) to build an accessory structure in the front yard to be used as a garage/pool house, equipped with a bathroom and utilities (gas, water, sewer); the resident's proposal includes building an in-ground pool, enclosed by a fence, in the front yard. The resident understands that his request for variances (building & pool) may not be granted, however, he would like to address the Commission to discuss his proposed project. Supporting documentation (project narrative, survey, sketch, and aerial map are included in the packet for the Commission's review. There are three "tests" that are needed to obtain a variance: 1. The property owner proposes to use the property in a reasonable manner. 2. Concept Review Î Old Mill Estates 3 Addition stnd Staff introduced this item, noting that the concept plan for Old Mill Estates 1 and 2 edition were reviewed at the Planning Commission meeting in March 2024. No formal action was taken at that meeting, but there was consensus of the Commission to support the plan. The developer was hoping to complete the project in the summer 2024, however, wetland permitting issues took longer than expected Î those issues have been resolved. The third edition is a replating of Lot 1 into 4 separate lots. Three of the lots would share one access to the street with a professionally drawn joint maintenance agreement with the sewer and water lines in that access. The shared access would be asphalt paved, 16 feet wide. Each lot would receive one park fee upon sale by us. The developer addressed the Commission to answer questions. VI. OLD BUSINESS 1. Table of Allowed Uses Assistant Administrator Lewis introduced this item as presented in the packet. Discussion ensued about the revised definition of light manufacturing, to include Ðfabrication, and assemblyÑ in the definition. The word ÐlightÑ was added before ÐmanufacturingÑ on the Table of Allowed Uses. Discussion ensued about the recommended definition for automotive detailing; the Commission discussed the Ðinstallation of accessoriesÑ and if the intent is to allow pinstriping and bug shield lights. The term restoration was also discussed to clarify activities such as repairing hail damage (light refinishing done with a hammer) versus heavy body work. The Commission noted that there is some overlap of categories on the Table of Allowed Uses (notably in retail sales and services) and Assistant Administrator Lewis noted that in time the Table will be updated to clean up some of the overlap. The Commission requested further clarification on the definition for automotive detailing and agreed the proposed revision could be taken to council for approval. Motion by Commissioner Olson, seconded by Commissioner Carciofini to recommend approval of the proposed changes to the Table of Allowed Uses, with revisions further clarifying the definition for automotive detailing. All in favor. Motion carried. 2. Downtown Master Plan Changes Assistant Administrator Lewis introduced this item as presented in the packet, noting that the only change to the document, since the last Commission meeting, is adding an addendum outlining examples of French-Canadian architecture. Administrator Statz reviewed his memo explaining why a Comprehensive Land Use Amendment is not needed to bring the density in the M-2 from 12-45 units/acre to 12-30 units/acre. Administrator Statz noted that as long as all the zoning districts are within the 12-45 unit/acre range, there is no need for a change; he added that if the Commission wanted to lower one of the districtÓs bottom thresholds, that would require a Comprehensive Land Use Amendment, because it would be out of range. Discussion ensued about a few text amendments in the Downtown Mater Plan to include the following: Downtown Neighborhood (M-2) page 20 Î remove the Ðlow-density and mid-rise housingÑ Off-Street Parking Î Retail/Office page 23 Î change ÐanticipatedÑ to ÐrequiredÑ Building Height page 28 Î add Ð35 feetÑ to the 2-story building Motion by Commissioner Seppala, seconded by Commissioner Carciofini to make a recommend the adoption of the revised Downtown Master Plan and Development Guidelines with the text amendments, findings of the Planning Commission and a separate action to lower the density in the City Code from 12-45 to 12-30 to be consistent with the Downtown Master Plan.
