Chapter 156, Table of Allowed Uses, Request for Variance Î Pylon Sign 5/7/25 P&R Committee 3 CITY OF CENTERVILLE REQUEST FOR COUNCIL ACTION Agenda Item # Department: Requested Council Meeting Date: April 23, 2025 Public Works -WS 2.1 TITLE OF ISSUE: Irrigation at LaMotte Park BACKGROUND AND SUPPLEMENTAL INFORMATION: During the annual inspection of the variable frequency drive (VFD) service at LaMotte Park, a fault was identified in the system. The technician inspecting the service contacted Renner and Sons Pump to diagnose the problem. Renner and Sons confirmed that the motor needs to be replaced. There could also be a problem with the pump. The pump was replaced in 2004, serviced and installed in the LaMotte Park Water Reuse Irrigation System in 2010, and it has been in use since then. The attached quote is for the tormwater euse ystem at LaMotte Park. Both the motor and pump are included in the quote in case both parts need to be replaced. The contractor will need to tear apart the pump to determine if it works. The warranty for installation of a new pump and motor is 3 years and the labor is warrantied for 6 months. The discussion focused on yards of four homes located at: 1922, 1932, 1940 Eagle Trail and 6996 Brian Drive. The council discussed a proposal to lower the pond. Former Administrator Statz recommended getting signed waivers from the property owners, so the assessment hearing could be waived. To date, only two of the property owners have signed waivers. The other two are not interested in signing the waivers. This means that the council will need to determine if they would like to proceed with improvements to this pond. The cost for lowering the pond , a$5,000 for a feasibility report, should property owners be assessed. The project would lower the water level of a city- owned pond that is directly adjacent to the rear yards of four homes: 6996 Brian Drive and 1922, 1932, and 1940 Eagle Trail. The project would entail installing an outlet structure in the pond and connecting it to the existing stormwater system along the north curb line of Eagle Trail. The property owners at 6996 Brian Drive have requested a drainage project for several years. Statz estimated the project would cost approximately $45,000 with funding sources of $12,000 of special assessments ($6,000 from 6996 Brian Dr and $2,000 each from the Eagle Trail properties) and $33,000 from Storm Water Fund. Statz also stated that the pond does not have a piped outlet, only an outlet ditch at the northeast corner of the pond, which only takes drainage from the rear yards of the homes abutting the pond and does not take any drainage from public rights-of-way. He stated that most other stormwater ponds do have a piped outlet. It was anticipated that with the proposed project, the Normal Water Level of the pond would be around 902 (about 1.5 feet lower than the current level). Discussion among the council at that time was focused on the uniqueness of the situation, increasing the cost share due to issues with the development of properties, and not setting a precedent. Statz stated that he would determine whether a RCWD permit was needed, and he would return to the Council for a feasibility study to commence the project. On January 22, 2025, Statz proposed moving forward with the project, as no permit was needed with RCWD and Special Assessment Agreement & Waivers of Hearing and Appeals would be obtained by the affected property owners as all seemed amendable to the project. He stated that the estimated project cost did not include any indirect fees (e.g. feasibility study, assessment roll, public hearings, etc.) On February 10, 2025, all affected property owners received a proposed Special Assessment Agreement/Waiver of Hearing & Appeal. Two of the property owners signed the agreements: 6996 Brian Drive and 1940 Eagle Trail. 7 On February 28, 2025, staff emailed the proposed Special Assessment Agreement/Waiver of Hearing & Appeal to the 1922 & 1932 Eagle Trail property owners for the second time. No responses were received. On April 15, 2025, staff contacted both property owners via telephone to ascertain their interest in the project. The two property owners stated that they were not in favor of special assessments. These property owners are the ones most affected by the construction activities, as the equipment needs to be brought into their yards for the installation of the outlet and storm pipe. Both property owners stated that they had items in their yards that would need to be moved (fence, irrigation, planter box, trees, electrical box, etc.). Both property owners also felt that the property owner experiencing the drainage issue purchased the home knowing that it abutted a pond, and that individual solutions could be made by the property owner at 6996 Brian Drive. Glaser, City Attorney DATE: 4/17/2025 SUBJECT: Procedures for Councilmember Vacating Oice & Filling Vacancy This memorandum is provided to outline the rules and procedures applicable when a City Councilmember vacates their oice. I. Vacancy by Abandonment of Oice A councilmember who terminates residency in the City of Centerville is considered to have abandoned their oice prior to the end of their term. Under Minnesota law, termination of city residency is one of the recognized grounds for declaring an oice vacant. Other grounds include: A 90-day absence from oicial duties Acceptance of an incompatible oice (e.g., full-time employment with the City) Habitual drunkenness In cases where residency is in question (e.g., dual residency), the City Council may be required to determine the intent of the oicial as to continued residency in Centerville. II. Process for Declaring a Vacancy Once a councilmember vacates their position due to relocation outside of the City, the City Council must pass a written Resolution formally declaring the oice vacant. This is a required procedural step before a replacement may be appointed. III. Filling the Vacancy Following the declaration of vacancy, the City Council has the authority to appoint any quali ǎ ed individual to serve the remainder of the term, subject to the following: A quali ǎ ed successor must be a U.S. citizen, a resident of Centerville, a quali ǎ ed voter, and at least 21 years old. The appointment is made by majority vote of the Council, and standard quorum rules apply, except in a tie vote. The councilmember vacating the oice may not vote in the appointment of their successor. 1 10 IV. Special Election Requirements A special election is not required if: The vacancy occurs on or after the ǎ rst day to ǎ le aidavits of candidacy for the next regular city election, or Fewer than two years remain in the unexpired term. In such cases, the appointee serves the remainder of the term. A special election is required if: The vacancy occurs before the ǎ ling period for the next regular city election, and More than two years remain in the unexpired term. The assessing staff physically inspected 354 properties during the quintile review process for the 2025 assessment. The appraisal staff also inspected 146 properties where building permits were issued for improvements, remodeling, or demolition projects during 2024. st There were 59 total sales recorded in the 2025 assessment study period, which is October 1, 2023, through September 30, 2024. The number of sales was similar to last yearÔs assessment sales study (54 sales). Of the 59 sales, 57 were residential classification and 2 were commercial classification. There were 48 residential sales that met the criteria as Ñqualified salesÒ, according to the MN Department of Revenue. Those sales were the basis for adjustments made to the improved residential properties throughout the city. There was one commercial sale that was ÑqualifiedÒ. Given the lack of sales of commercial, industrial and apartment sales in Centerville, those valuations were guided by overall County trends, with local adjustments made as appropriate. The sales summary list is at the end of this report, which shows the reason codes for a sale being ÑunqualifiedÒ and a count for each reason code from this sales study period. The 2025 assessment for the City of Centerville is based on 1,664 parcels of property within the city. The preliminary total estimated market value is $716,095,200, an increase of 1.7 % from 2024. The new construction valuation for the year was $1,665,500. After subtracting out the new construction amount, the overall city value is $714,429,700, an increase of 1.5% - this increase is due to market forces (sales prices being slightly higher year over year). The chart below illustrates changes in the total estimated market value of the City of Centerville for 2018 through 2025. 2 22 2025 Value Changes by Property Type The property type that has the largest increase in total market value is single family waterfront properties. Sales of homes on the lakes in Centerville and throughout Anoka Conty on water (lakes and rivers), remain in high demand with low inventory so sale prices continue to increase significantly. Agricultural properties total value increased 4.6%, although there are only a few parcels in Centerville with this classification. The total market value of single-family non-waterfront properties and townhomes are fairly stable (+.67% and -.95% respectively). The total market value of commercial properties remains fairly stable from last year with just a .34% increase. Industrial property values increased 1.18% overall and apartments down slightly at -.70%. The table below depicts the total change in estimated market value from 2024 to 2025 as a percentage for each property type. Specific properties may have an increase or decrease in estimated market value that are not necessarily representative of the aggregate value change for that property type. The previous few years the market share of commercial and industrial properties grew due to the addition of several new businesses. Mass appraisal is the practice of determining individual values based on statistical analysis of a group of sales for a large area. The values are determined as of a specific date and are based on arms-length transactions that occurred during a specified sales period. Market Value Defined As in private appraisal, Market Value is defined as: The most probable price that a property should bring in a competitive and open market under all conditionÔs requisite to a fair sale, the buyer and seller each acting prudently and knowledgeably, and assuming the price is not affected by any undue stimulus. Implicit in this definition are the consummation of a sale as of a specified date and the passing of title from seller to buyer under conditions whereby: buyer and seller are typically motivated: both parties are well informed or well advised, and acting in what they consider their own best interests; a reasonable time is allowed for exposure in the open market; payment is made in terms of cash in U.S. dollars or in terms of financial arrangements comparable thereto; the price represents the normal consideration for the property sold unaffected by special or creative financing or sales concessions granted by anyone associated with the sale (a foreclosure sale or a short sale \[a sale to avoid foreclosure\] is not considered an arms- length transaction). Assessment Process Timeline In Minnesota it is the duty of the Assessor to value and classify property. This is done annually nd as of the assessment date of January 2. Each year's assessment is based on arms-length transactions (sales that meet the criteria of an open market transaction) that occurred from stth October. 1 to September 30 (see below). When the assessment is completed the local taxing jurisdictions begin their budgeting process for the following year. They use the total assessment to determine their tax base and develop their tax rates. All aspects of the assessment, including but not limited to the assessment date, sales period and property tax classification, are dictated by state statute and under the oversight of the Minnesota Department of Revenue. The Minnesota Department of Revenue also uses these same techniques to test for equity between counties. The primary statistics used are: Median Ratio: This is a measure of central tendency that is the midpoint of a group of sales ratios when arrayed from low to high. The median is a useful statistic as it is not affected by extreme ratios. Aggregate Ratio: This is the total market value of all sale properties divided by the total sale prices. It, along with the mean ratio, gives an idea of our assessment level. Within the city, we constantly try to achieve an aggregate and mean ratio of 94% to 95% to give us a margin to account for a fluctuating market and still maintain ratios within state mandated guidelines. Also referred to as the Weighted Mean. Mean Ratio: The mean is the average ratio. We use this ratio not only to watch our assessment level, but also to analyze property values by development, type of dwelling and value range. These studies enable us to track market trends in neighborhoods, popular housing types and classes of property. Coefficient of Dispersion (COD): The COD measures the accuracy of the assessment. It is possible to have a median ratio of 93% with 300 sales, two ratios at 93%, 149 at 80% and 149 at 103%. Although this is an excellent median ratio, there is obviously a great inequality in the assessment. COD indicates the spread of the ratios from the mean or median ratio. The goal of a good assessment is a COD of 10 to 20. A COD under 10 is considered excellent and anything over 20 will mean an assessment review by the Department of Revenue. Price Related Differential (PRD): This statistic measures the equality between the assessments of high and low valued property. A PRD over 100 indicates a regressive assessment, or the lower valued properties are assessed at a greater degree than the higher. A PRD of less than 100 indicates a progressive assessment or the opposite. A perfect PRD of 100 means that both higher and lower valued properties are assessed exactly equal. 2025 Residential Statistics The following statistics are based upon ratios calculated using qualified residential sales made during the period Oct 1, 2023 through Sept 30, 2024 for the City of Centerville. The residential sales are compared to the residential assessed values for the current year and adjusted accordingly. This is the basis for citywide equalization, checking assessment accuracy, and predicting trends in the market. Median Ratio: 95.20% COD: 4.83 PRD: 100.5 # of Qualified Sales 48 7 27 Appeals Procedure Each spring Anoka County sends out a property tax bill (based on the prior year assessment) along with the Notice of Valuation and Classification. Three factors that affect the tax bill are: ΐȁ The amount your local governments (town, city, county, etc.) spend to provide services to your community. Αȁ The estimated market value of your property. Βȁ The classification of your property (how it is used). The assessor determines the final two factors. You may appeal the value or classification of your property as described below: Informal Appeal Property owners are encouraged to call the appraiser or assessor whenever they have questions or concerns about their market value, classification of the property, or the assessment process. Almost all questions can be answered during this informal appeal process. When taxpayers call questioning their market value, every effort is made to make an appointment to inspect properties that were not previously inspected. If the data on the property is correct, the appraiser can show the property owner other sales in the market that support the estimated market value. If errors are found during the inspection, or other factors indicate a value reduction is warranted, the appraiser can easily make the changes at this time. Local Board of Appeal and Equalization The Local Board of Appeal and Equalization is typically made up of city council members or township board members. In some jurisdictions, a special board is appointed and typically consists of real estate professionals. The Local Board meets in mid-April to early May. The Centerville meeting is April 23, 2025. Taxpayers can make their appeal in person or by letter. If an interior inspection is denied, no adjustment can be made to value per MN Statute. The assessor is present to answer any questions and present evidence supporting their value. County Board of Appeal and Equalization The Anoka County Board of Appeal and Equalization meeting is on June 16, 2025. The technician inspecting the service contacted Renner and Sons Pump to diagnose the problem. Renner and Sons confirmed that the motor needs to be replaced. There could also be a problem with the pump. The pump was replaced in 2004, serviced and installed in the LaMotte Park Water Reuse Irrigation System in 2010, and it has been in use since then. The attached quote is for the Stormwater Reuse System at LaMotte Park. Both the motor and pump are included in the quote in case both parts need to be replaced. The contractor will need to tear apart the pump to determine if it works. The warranty for installation of a new pump and motor is 3 years and the labor is warrantied for 6 months. Staff is requesting that council accept the quote and authorize the work to be performed to repair the irrigation system.
