Currently the property does not have a freestanding sign, and they wish th to construct a pylon sign along 20 Avenue. In §152.18 DISTRICT REGULATIONS of Centerville City code, a business may have one pylon sign, or one ground sign and it may be located at a minimum of 15 feet from any property line to the nearest supporting structure of the sign. The owner wishes to build a pylon sign that is less than 15 ft th from the property line along 20 Avenue and therefore requests a variance. PROPERTY & REQUEST th Avenue S, The applicants are requesting a pylon sign 3.5 ft from the right-of-way (ROW) of 20 instead of the required 15 ft, illustrated in the map from the applicant on the next page (north is to the left). The yellow property lines on the aerial photo show that Anoka County widened the ROW next to this property some time ago by 20 feet. The ROW was not widened on the property to the north (Shell station, Wise Guys Pizza, NyÔs Liquor, etc.) The smaller aerial photo on the next page (north up) shows the difference in ROW width Ï 20 ft. Without the ROW take, the owner(s) would have been able to place a pylon sign where they want it in their parking and easily meet the 15- foot setback. 13 May 6, 2025 Centerville Planning & Zoning Commission Page 2 of 6 th RE: 7087 20 Avenue South, Variance Ï Setback for Pylon Sign Requiring this applicant to meet the setback would require placing the sign within the parking lot, interfering with driving maneuvers and would reduce its visibility compared to the other businesses on this road. VARIANCE STANDARDS on The CityÔs standards for considering variances, based criteria in State statute, are in Section 156.310, excerpted at the end of this report. A variance is Ñpermission to break the rulesÒ and should only be granted if there are unique or extraordinary circumstances that justify it. (A) Standards. The Planning and Zoning Commission shall recommend a variance, and the Council shall order the issuance of the variance only if it conforms to the following standards (§ 156.310 VARIANCES): (1) The variance is in harmony with the purposes and intent of the zoning chapter of this code; The intent of the signage standards is to allow reasonable signage for businesses without being offensive or creating visual clutter. Here, the sign could have been placed in the requested location but for Anoka CountyÔs RWO acquisition. The sign itself is within the intent and purpose of the code. (2) The variance is consistent with the comprehensive plan; There are general policies in the Comprehensive Plan about creating cohesive signage standards in the City. The requested variance would be in line with those goals, even though it encroaches on the required setback. 14 May 6, 2025 Centerville Planning & Zoning Commission Page 2 of 6 th RE: 7087 20 Avenue South, Variance Ï Setback for Pylon Sign (3) The proposal puts the property to use in a reasonable manner; A pylon sign for a business in the commercial district is by itself a reasonable use. (4) There are unique circumstances to the property not created by the landowner; The Anoka County Highway Department acquired ROW along 20th Avenue S, pushing the property line west by 20 feet. This is unique to this property and not created by the applicant. (5) The variance, if granted, will not alter the essential character of the locality; and The variance aligns with the general character of the locality and neighboring pylon signs. RECOMMENDATION We recommend that the Planning Commission recommend approval of the variance for the th construction of the pylon sign 3.5 feet from the ROW of 20 Avenue S as requested by the applicant, Shuda Properties, LCC/ DBA Dreamscapes Landscaping and Design, published on April 22, 2025, with the following conditions and findings of fact: Conditions of Approval of Variance 1) The applicant will apply for a sign permit for a sign meeting this variance approval and the CityÔs signage area and height standards Ï it shall not exceed 200 square feet in area and 35 feet in height, and not less than six feet from the ground to the lowest part of the sign. Findings of Fact for Approval of Variance 1) Shuda Properties, LLC owns the existing lot at 7087 20th Avenue South. 2) The existing lot does not have a pylon sign. th 3) A portion of the property along 20 Avenue South was acquired by the Anoka County Highway Department, pushing their property line west by 20 feet. th 4) The applicant proposes to construct a sign that is 3.5 feet from the ROW of 20 Avenue South. 5) Centerville Zoning Code standards require a 15-foot setback for signs from any property line. 6) The requested sign placement will not significantly impact surrounding properties and meets the standards for approval of variance in § 156.310 of the Centerville Zoning Code. 60-DAY DEADLINE The applications were received on March 31, 2025. This chapter shall be known as the Centerville Signage Ordinance, except as herein referred to as this chapter. Ord. #39, adopted - § 152.02 PURPOSE AND INTENT. It is the purpose of this chapter to: (A)Establish a set of standards for the fabrication, erection, use and maintenance for signs, symbols, markings, advertising devices or other items that serve as visual communication media; 263΋tğŭĻ 17 (5)Portable signs may not exceed 80 square feet. Ord. #39. § 152.18 DISTRICT REGULATIONS. § 152.18 DISTRICT REGULATIONS. (A)Residential/Public Districts (R-1, R-2, R-2A, R-4, R-5, P-1, M-1, M-2). Permitted signs: (1)Residential identifications. Not more than two square feet per single family dwelling or six square feet in area for each multiple-family building. (2)Institutional identifications. Churches, schools, parks etc. allowed up to 48 square feet; not taller than eight feet. (3)Business signs. Home-based businesses may have a sign that is no larger than four square feet. The sign may not be an interior-illuminated sign. (4)Noncommercial opinion or message signs. On-premise noncommercial opinion or message signs are permitted as follows: In residential districts, each dwelling unit is permitted one additional sign which is no larger than six square feet and no higher than six feet tall. In medium and high density districts, the sign must be attached to the dwelling. No permit fee is required for a sign authorized under this paragraph. (5)Area Identification Signs. One area identification sign is permitted in conjunction with a development or subdivision, however the sign shall not exceed 48 square feet in area and 8 feet in height and shall only be permitted when a homeowner association or other responsible entity has been established that agrees in writing to maintain the sign and adjoining property. (B)(B)Commercial / Main Street Commerical District (B-1 & B-2).Commercial / Main Street Commerical District (()B-1 & B-2). Wall signs are permitted on each public street exposure or public parking exposure, provided the signage does not exceed ten percent of the wall area. (2)Canopy signs. Signs on these structures are allowed as long as the sign area does not exceed ten percent of the wall area. (3)Ground signs. One ground sign is permitted per street frontage; however, the sign does not exceed eight feet in height and 32 feet in area. (A) (1) A comprehensive sign plan is required at the time of Planning and Zoning Commission review of any proposed new commercial or industrial development. This plan shall indicate the location, size, height, color, lighting and orientation of all proposed signs and shall be submitted for approval pursuant to the regulations of the city. (2) Building permits and inspections are necessary as required by Building and Electrical Code. They want to build a new accessory structure in front of the house and are requesting a variance to the front setback for the structure. There was informal discussion of this request at a previous Planning and Zoning Commission meeting with analysis of ÑyardsÒ, setbacks, and definitions of setbacks on lakeshore lots. Those questions are handled in a separate memorandum for this P&Z meeting. For this request, we will rely on the CityÔs precedent in dealing with accessory structure setbacks in 156.107(A)(4): Ñ no accessory structure shall be erected or located within any required yard other than the rear yardÒ. This standard has been interpreted over the years to mean that no such structures are allowed in the front of the lot without a variance and can only be allowed in the rear yard. One of the questions that came up with this request is, where is the rear yard? There was discussion of the common law provision that lakeshore lots consider the front yard to face the water. The City Attorney has clarified that the City of Centerville has authority within its zoning regulations to define and regulate placement of structures, including where the front and rear yards are. City zoning regulations would supersede the common law provision. The Centerville Zoning Code defines the front yard as having frontage on the street and the rear yard is opposite the front. For lakeshore lots like 1421 Mounds Trail which front on a street with the lake behind, the street side is the front, and the lake side is the rear, although there are different, more restrictive setbacks from the lake (75 ft) that would supersede the standard rear yard setback of 25 ft. 34 May 6, 2025 Centerville Planning & Zoning Commission Page 2 of 6 RE: 1421 Mound Trail, Variance Request Ï Accessory Structure Setback The property is a lakeshore lot on Centerville Lake, about 105 ft wide by 350 ft deep. The house is situated about 100 ft from the lakeshore, leaving a ÑfrontÒ yard about 200-220 ft deep between the house and Mound Trail right-of-way. The Ñrear yardÒ (green shaded area to the right) is defined as between the rear lot line and the rear line of the building. There is little room on the lakeshore side to put in a new structure meeting the lakeshore setback. The request is therefore a variance to the front setback, the only reasonable place to put the structure on this lot. VARIANCE CRITERIA The standards for considering a variance are excerpted at the end of this report and summarized below. (1) The variance is in harmony with the purposes and intent of the zoning chapter of this code; (2) The variance is consistent with the comprehensive plan; The request does not directly relate to issues in the comprehensive plan or zoning code, other than the required setback, which is the request here. (3) The proposal puts the property to use in a reasonable manner; Building an accessory structure of this scale is a reasonable use of residential property. (4) There are unique circumstances to the property not created by the landowner; The unique circumstance here is the arrangement of structures on the lot Ï the house is set very far back from the street leaving a very large front yard but almost no rear yard where an accessory structure would typically be. This is a situation not created by the property owner and is relatively unique, even among lakeshore lots. 35 May 6, 2025 Centerville Planning & Zoning Commission Page 3 of 6 RE: 1421 Mound Trail, Variance Request Ï Accessory Structure Setback (5) The variance, if granted, will not alter the essential character of the locality. There are several properties in the immediate area that have accessory structures in the front yard, similar to what is proposed on this lot, illustrated below. The proposed structure would not alter the Ñessential characterÒ of the area, i.e., it would not look out of place. 36 May 6, 2025 Centerville Planning & Zoning Commission Page 4 of 6 RE: 1421 Mound Trail, Variance Request Ï Accessory Structure Setback HEIGHT The proposed building will meet the Centerville Zoning Code standards for the height of an accessory building. The definition of ÑheightÒ in the Centerville is typical of many zoning ordinances in that it considers the height of a pitched roof to be the average between the eaves and the peak (ÑridgeÒ in CentervilleÔs code). This is because the perceived height of a pitched roof is less than that of a flat roof. The height of accessory buildings is limited to 15 feet, unless it matches the slope of the principal structure (the house). That is the case here: the new building has a roof pitch similar to the house and its height is calculated as 16.55 ft according to the definition, as illustrated below, therefore no variance is needed for the height of the structure. SIZE OF STRUCTURE The size of accessory buildings is limited to 2% of the lot size. The lot at 1421 Mound Trail is approximately 40,075 sq ft in area, which would allow a structure of 802 sq ft, exactly what is proposed by the applicants. RECOMMENDATION I recommend that the Planning and Zoning Commission recommend approval of the variance to the front yard setback for an accessory building at 1421 Mound Trail as depicted on the submitted materials from applicant Jim Heron, with the following conditions and findings of fact: Conditions for Approval 1) The new accessory building will match the style, color and roof slope of the existing house on site. The house is situated on the south part of the lot near the lake, leaving only a very small rear yard where an accessory building would typically be required to be located, not enough space for a reasonable structure. There is ample room in the front of the lot, which is where the Applicants propose the new structure. I'm not trying to be a "difficult" neighbor, but I do need to protect our financial interests and I hope we can jointly come to an agreement that satisfies all parties. I first learned of the variance through attendance at the 4/1/25 P&Z Commission Meeting, and I understand this topic has been scheduled for Public Hearing on May 6, 2025. Approval of this project would result in a very large Recreational Structure (Pool House/Entertainment Area/Garage/Wet Bar/Covered Patio) and Swimming Pool/Deck/Fence in a front yard on Mound Trail. I am concerned by the Commission's consideration of the variance request(s) as this project: 1) Clearly alters the essential character of the locality, a condition that should in itself result in denial. 2) Is in opposition to previous Commission decisions upholding the Zoning Code of Ordinances over the past 20+ years. 3) Violates common practice and diminishes property value. 1 45 I have included details on each of these points below, as well as attachments covering: (A) Current Front Yard Structures on Mound Trail and (B) Commission decisions on Residential Variance Requests from 2005 - present. In summary, I respectfully request the Commission: Modify the 1421 Mound Trail variance request to: o Exclude the outdoor covered patio, as was done for the 1313 Mound Trail variance in 2021. o Limit the size of the proposed structure to comply with the Zoning Code and lessen impact to the essential character of the locality. Deny in its entirety any swimming pool/deck/fence built between the main structure and the street I understand we are relative newcomers to the neighborhood and community, and there are deep personal and professional relationships with interest in this project's approval. However, we also understand the Commission will act in accordance with the Code and State Statute in its evaluation as it has done in the past. Please let me know if you have any questions. I would also like some information on time allotment to speak at the 5/6/25 hearing (should I be able to attend) and details on the appeal process/timing should this variance request be approved by the Commission. Judging by the presence of various parties, including the City, in our yard this week marking various lines for the "garage and pool," it appears the applicant believes the Public Hearing is a formality. Covered patio expressly denied in 2021 variance request. The 7 precedent garages could not reasonably be used as dwellings. There are no front yard fences on Mound Trail. The 1421 Mound project would require a 4 foot fence in a front yard, also outside of Zoning Code. 6 of 7 garages were built decades ago, and the Commission considered location of structure, character of locality, and impact to neighboring properties before approval. 2021 variance had size and height of garage reduced by Commission Commission History of Honoring Zoning Code I reviewed every single P&Z Commission Meeting Minutes document published from 2005-Present. Residential variance decisions made by the Commission over the past 20 years demonstrate consistency in enforcement of the Zoning Code of Ordinances and do not support this project. Attachment B details the Commission's Decisions 2005-2025. There are 3 accessory structures which were approved for front yards on lake properties, as noted in Rust color on the supporting document. One of these is for the garage at 1313 Mound Trail and two are for storage sheds. ALL considered the essential character of the locality and neighboring properties before approval. ALL were within Code size requirements or modified by the Commission. 4 48 During this two decade time period, I also noted 5 variance requests approved for "hardship," "practical difficulties," or "unique property," as is asserted in the 1421 Mound Trail proposal. These are highlighted in Green on the supporting document. Of these approved variances: 4 of 5 approvals resulted from actions outside the applicant's control, i.e., caused by the City or County, and which were not present when the homeowner purchased the property. For example, the addition of a City Trail in a yard. The other approval was for a situation which existed upon purchase; however, it was for a property with no residential neighbors. ALL approvals assessed the impact on neighboring properties and ensured the project did not alter the essential character of the neighborhood. At the same time, many similar proposals were denied citing: Commission consensus to not set precedent Variance was in opposition to Code Applicant was not being denied reasonable use of the property without the variance Applicant purchased the property with the "hardship" in place Neighbor opposition due to several above factors Given the outcomes of previous variance requests, approval of the 1421 Mound Trail project would be a significant departure from past Commission decisions, as well as in opposition to the Zoning Code as written at both the City and State level. Violates Common Practice and Diminishes Property Value There are communities which define lakeshore homes as having their "front" yards facing the lake and "rear" yards as those between the structure and the street. However: In all communities contacted, this definition is applied where properties are aligned, i.e, all properties in the vicinity have the lake on one side and the street on the other. In this case, 1407 Mound Trail is not on the lake while 1421 Mound Trail is, and direct next door neighbors would have different definitions of front and rear yards. Minnesota cities that define lakeshore properties as having their "rear" yards between the main structure and the street limit accessory structures in these areas to garages and storage sheds. Swimming pools are expressly prohibited from being built between the main structure and the street. Swimming pools are not allowed in viewable yards as they are widely regarded as having a negative impact on neighborhood aesthetics and property values. In defining the Centerville Zoning Code, Commissioner Wood stated, "from a real estate perspective, pools actually devalue property." (P&Z Meeting Minutes 6/6/2006). As this project would be built in a yard directly abutting 1407 Mound Trail home, it would devalue this neighboring property as well. 5 49 There are currently 0/25 swimming pools in Centerville located between the main structure and the street. There are 2-3 properties on Mound Trail and several more on Centerville Lake alone which would have a case for precedence should this project proceed. In summary, the 1421 Mound Trail proposed variance alters the essential character of the locality, is in opposition to previous Commission decisions upholding the Zoning Code of Ordinances, does not qualify as a unique circumstance or practical difficulty, violates common practice and diminishes neighboring property value, and would set a negative precedence for future proposals in Centerville. Discussion also ensued about common law in Minnesota on the lakeshore, with the lake being the front yard and the yard facing the road being the rear yard. Phil noted that there is no question that over the years the interpretation has been different than his, noting that the Council ultimately determines whether a variance is granted. The Commission expressed non-binding support (informal review only) for the garage/pool house as long is it meets height and size requirements; there was less support for the pool due to the CommissionÓs interpretation of Ðfront yard.Ñ The resident intends to submit variances for the garage/pool house and the pool. The Commission requested that the City Code be revised to provide clearer definitions of yard, front yard, frontage, etc., and that the intent of the Code reflects that pools should be restricted to the rear yard. 2.
