you conduct yourself in a professional, courteous manner, and refrain from the use of profanity. Failure to
abide by this policy may result in the loss of your privilege to speak. Persons wishing to speak will be required
to complete a sign-up sheet and give it to the Mayor or a Staff person prior to 6:15 p.m.

MEMORANDUM
TO: MAYOR AND CITY COUNCIL

SUBJECT: RULES AND PROCEDURES FOR FILLING A VACANT ELECTED
OFFICE
DATE: 5/23/25
An office of Mayor or City Council Member may become vacant prior to the expiration of
the term under the following circumstances:
Voluntary Resignation — The officeholder submits a written resignation before the end of
their term.
Abandonment of Office — The office may be deemed "abandoned" under any of the
following conditions:
a. Termination of residency within the City limits
b. Absence from official duties for a continuous period of 90 days
c. Acceptance of an incompatible office
d. Habitual drunkenness
Example. In cases of dual residency, the Council may consider whether the official maintains intent
to reside in the City.
PROCEDURE FOR DECLARING AND FILLING A VACANT OFFICE
Determination of Vacancy
a. Upon an official's resignation, failure to quaii£y for office, or potential abandonment, the
Council shall formally review the matter.
b. The Council must adopt a written Resolution Declaring a Vacancy, which includes
factual findings supporting the conclusion that the office is vacant.
Filling the Vacancy
a. There is no statutory deadline for filling a vacancy.
b. The Council shall appoint a qualified individual to serve for the remainder of the
unexpired term or until the next general election, as permitted by law.
c. A qualified successor must be a United States citizen, a resident of the City, a qualified
v.: -ter, and at least 21 years of age.

A RESOLUTION ACCEPTING THE RESIGNATION OF
COUNCILMEMBER DARRIN MOSHER
AND
DECLARING A VACANCY IN THE OFFICE OF COUNCILMEMBER
WHEREAS, Darrin Mosher honorably served the residents of the City of Centerville as
a member of the City Council.
WHEREAS, on , 2025, at the regular Centerville City Council meeting,
Councilmember Mosher announced his decision to resign from office effective
2025.
WHEREAS, on _, 2025, a formal letter of resignation, signed by
Councilmember Mosher was received by the City of Centerville, noting that his resignation
would be effective upon the Council's acceptance of said resignation at their regular meeting on
'2025.
WHEREAS, less than two years remain in the unexpired term of his office.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CENTERVILLE, ANOKA COUNTY, STATE OF MINNESOTA:
The Council accepts the resignation of Councilmember Darrin Mosher; and,
The Council declares that a vacancy exists in the Office of Councilmember effective on
2025; and,
The Council shall fill the vacant Office without a special election and by action of the
Council as set forth in Minnesota Statutes Sections 412.02 and 471.46.
