In recent months, the city has received notification from SBM that beginning in January, 2026 they no longer want to operate two fire departments. This means that the City will need to determine the best past forward with respect to delivering fire services. The city has a few options, which are: 1.Contracting with SBM for the same services that we currently receive. 2.Having its own Fire Department 3.Partnering with a neighboring community for fire services (Columbus, Lexington, Lino Lakes). Staff is exploring each of the aforementioned options and will provide an update on these discussions at the July 9th council meeting. The Work Session took place prior to the City Council meeting, commencing at 5 p.m. The Council held their regular City Council Meeting at 6:30 p.m., in Council Chambers and the meeting was live streamed by North Metro TV. The council requested additional bids/quotes for repair. This item will be returned for additional discussion and action by Council later. 2. Brian Drive Pond Interim City Administrator Lewis informed the Council of action that had been taken by the previous Council, status of resident willingness for participation in lowering of the pond (2/4), and the two residents that were not in favor of the project were present. Both residents (1922 & 1932 Eagle Trail) provided reasoning for their unwillingness to be assessed or have the project go forward. They stated that they utilize the pond for ice skating, that their yards would be affected the greatest with infrastructure being installed between their yards and disruptions associated with removing (i.e. fencing, irrigation, planter box, electrical equipment and trees). Both residents felt that the property owners of 6996 Brian Drive purchased the home, being fully aware of the backyard situation, as they previously lived next door. Both residents felt that measures could be taken by the property owners of 6996 Brian Drive on their own accord (i.e. pond liner, re-enforcement of the foundation, etc.) 41 City of Centerville City Council Work Session, LBAE & Meeting Minutes April 23, 2025 Council direction was to forward certified letters to all four residents that abutted the pond (6996 Brian Drive, 1922, 1932 and 1940 Eagle Trail) informing them of the status of the proposed project (signed agreements, lack of signed agreements, engineering services in-house versus contracted services with the former Engineer no longer being with the City, implications to property owners and how to proceed) along with providing the property owners of 6996 Brian Drive an opportunity to appear before Council. Letters were forwarded to all property owners involved on May 14, 2025. 3.Procedures for Council Vacancy City Attorney Glaser reviewed the information contained in CouncilÓs packet. Brief discussion took place as no resignation had been received to date. He stated that they were concerned that the e-poll pads that have been utilized since 2018 by Anoka County municipalities had not received proper procedures for purchase, not voted on by the County or the municipalities and that he was concerned that the city could be held liable. He stated that these devices are utilized on election day for signing in electronically rather than on a paper roster. PUBLIC HEARING Mayor Golden opened the public hearing at 6:44 p.m. 1.Local Board of Appeal & Equalization Interim City Administrator Lewis stated that the Council is bestowed with the duties of acting as the Local Board of Appeal & Equalization along with contracted Assessors, Ms. Mary Wells, Misters Erik Skogquist (Commercial/Industrial/Apartments) and Chris Larson (Residential). Interim City Administrator Lewis introduced Ms. Wells. Ms. Mary Wells appeared before the Council and introduced herself to them. She stated that Mr. Erik Skogquist and Diana Stellmach, Senior Manager, Commercial/Industrial/Anoka County were present, but Mr. Larson was unable to attend. Ms. Wells reviewed her presentation that was included in CouncilÓs packet. Ms. Wells addressed the processes and timelines associated with setting the 2025 market values for taxes payable in 2026, State and County requirements, qualified and unqualified sales (59 with 48 being ÐqualifiedÑ similar to last year), sales periods utilized (October 1, 2023-September 30, 2024), inspections of properties being every five years, permits issued, new construction, changes in values from 2024 to 2025 in property types. She briefly discussed interactions (six) with residential property owners and (one) with a commercial property owner throughout the year. Ms. Wells answered several questions from Council Members. Ms. Wells stated that she received one appeal and explained the process. She stated that if the assessors resolve the concern of the property owner prior to 10 days prior to this eveningÓs meeting, the board does not need to be involved in the decision, and they make the decision, but if it is within the less than a 10-day period, it needs to be read into the minutes. She stated that the property owner called the day prior to the meeting and read into the minutes parcel # R23-31-22-21-0043, 7194 Clear Ridge, original valuation $342,900 and reduced to $332,300. Ms. Wells also stated that there was an appellant in the room and that a motion could need to be made regarding this residential valuation reduction and the appellant at the same time or separate motions. Mr. Wright provided Council with a handout. st Mr. Wright stated that Amazon had a facility within the city located at 6985 Î 21 Avenue. He stated that what they are asking is to have the Board consider correcting the property taxes and not lowering the property taxes. He stated that they felt that the valuations following their research show that the building is overvalued. He stated that the valuation may have been derived from permits rather than market information. He reviewed the information that was provided to Council. Mayor Golden stated that she would like to hear from the contracted Assessors prior to making any decisions and what Mr. Wright was requesting was rather a large reduction in the valuation of the property from $33,885,800 to $18,300,000. Mr. Erik Skogquist introduced himself to the council and stated that throughout this process he has worked with Brandon and the Anoka County AssessorsÓ office, tax court and supreme court cases, he explained the process for evaluation, that it was a new facility, and that additional analysis was needed in this case. He recommended that the Board act on this as a no change, which would allow for additional analysis and the appeal process through the Anoka County Board allowing additional guidance or an agreement. Mr. Skogquist answered several questions from the council. City Attorney Glaser stated that this was a super-calculated tax valuation, and these types of issues need to go with a large amount of study and that this Board was not equipped to complete the task. He stated that the CityÓs Assessor stated no change this evening but would get studied to length and that it is not uncommon that they go to tax court because it is such an unusual property and many other factors. Mr. Wright stated that it was a community decision to make, they provided additional information, and they wanted to avoid court. The council thanked Mr. Wright and stated that they appreciate Amazon, their materials and their willingness to understand that they are not equipped to decide on this issue. The discussion focused on yards of four homes located at: 1922, 1932, 1940 Eagle Trail and 6996 Brian Drive. The council discussed a proposal to lower the pond. Former Administrator Statz recommended getting signed waivers from the property owners, so the assessment hearing could be waived. To date, only two of the property owners have signed waivers. The other two have not signed the waivers. The cost for lowering the pond was estimated to be and there would be an additional $5,000 for a feasibility report, should property owners be assessed. The Council directed staff to contact the resident to to advise if they are still interested in the project since there was not a consensus among the neighbors. The residents at 6996 Brian Dr. will be in attendance at the council meeting. The project would lower the water level of a city- owned pond that is directly adjacent to the rear yards of four homes: 6996 Brian Drive and 1922, 1932, and 1940 Eagle Trail. The project would entail installing an outlet structure in the pond and connecting it to the existing stormwater system along the north curb line of Eagle Trail. The property owners at 6996 Brian Drive have requested a drainage project for several years. Statz estimated the project would cost approximately $45,000 with funding sources of $12,000 of special assessments ($6,000 from 6996 Brian Dr and $2,000 each from the Eagle Trail properties) and $33,000 from Storm Water Fund. Statz also stated that the pond does not have a piped outlet, only an outlet ditch at the northeast corner of the pond, which only takes drainage from the rear yards of the homes abutting the pond and does not take any drainage from public rights-of-way. He stated that most other stormwater ponds do have a piped outlet. It was anticipated that with the proposed project, the Normal Water Level of the pond would be around 902 (about 1.5 feet lower than the current level). Discussion among the council at that time was focused on the uniqueness of the situation, increasing the cost share due to issues with the development of properties, and not setting a precedent. Statz stated that he would determine whether a RCWD permit was needed, and he would return to the Council for a feasibility study to commence the project. On January 22, 2025, Statz proposed moving forward with the project, as no permit was needed with RCWD and Special Assessment Agreement & Waivers of Hearing and Appeals would be obtained by the affected property owners as all seemed amendable to the project. He stated that the estimated project cost did not include any indirect fees (e.g. feasibility study, assessment roll, public hearings, etc.) On February 10, 2025, all affected property owners received a proposed Special Assessment Agreement/Waiver of Hearing & Appeal. Two of the property owners signed the agreements: 6996 Brian Drive and 1940 Eagle Trail. 48 On February 28, 2025, staff emailed the proposed Special Assessment Agreement/Waiver of Hearing & Appeal to the 1922 & 1932 Eagle Trail property owners for the second time. No responses were received. On April 15, 2025, staff contacted both property owners via telephone to ascertain their interest in the project. The two property owners stated that they were not in favor of special assessments. These property owners are the ones most affected by the construction activities, as the equipment needs to be brought into their yards for the installation of the outlet and storm pipe. Both property owners stated that they had items in their yards that would need to be moved (fence, irrigation, planter box, trees, electrical box, etc.). Both property owners also felt that the property owner experiencing the drainage issue purchased the home knowing that it abutted a pond, and that individual solutions could be made by the property owner at 6996 Brian Drive. To build the detached garage as proposed, there are three separate standards to which variances would be needed: 1) Total area of accessory structures, as required under Section 156.107(A)(1). a. The total area of accessory structures would be approximately 604 square feet (SF): the existing shed is 123.2 SF; the proposed garage would be 480 SF. Section 156.107(A)(1) limits the square footage of all accessory structures to 2% of the lot area. This lot is 15,010 SF, allowing up to 300 sq ft of accessory structures. The applicant wants to keep the existing shed plus have the new garage. 2) Location on the lot, as required under Section 156.107(A)(4). a. The proposed garage is in front of the front edge of the house. Section 156.107(A)(4) of the code requires accessory structures to be in the rear yard only. 3) Distance from the house, as required under Section 156.107(A)(7). a. The proposed garage would be located 1Ô-8đÒ (or 1.70833 feet) from the house. Section 156.107(A)(7) of the code requires a six-foot separation between the house and a detached accessory structure. The commissioners opened the public hearing on this item at the June 3 Planning & Zoning Commission meeting and continued the hearing to a future date to allow the applicant time to st submit additional information and plans. The commissioners reviewed the request at their July 1 meeting, and recommended approval of the request, with conditions. The subject property is outlined in red. The subject property is 15,010 SF in size, per a 2020 survey submitted by the applicant. The house on the site was recently remodeled, and is located approximately 83.6 feet from the front property line. The existing gravel driveway was recently hard-surfaced as well, utilizing the location of an existing curb cut for access. An existing shed is located near the southeast corner of the subject property, and per the 2020 survey is nonconforming to current setback requirements. The 2020 survey also shows a well south of the house, and a gas meter on the south façade of the house. The applicantÔs site plan shows the front of the proposed garage will be 16 feet in front of the existing house, which would place it approximately 67.6 feet from the front lot line (the front lot line abuts the right-of-way (ROW) of Centerville Road). The house and proposed garage are both set farther back from the front lot line than the two adjacent houses, so the proposed garage would not stick out in front of the edge of the existing houses on that block (see Figure 2). REQUIREMENTS Chapter 156 of the Centerville City Code houses the zoning regulations for the city. The subject property is zoned MIXED USE NEIGHBORHOOD DISTRICT (M-2). 156.107(A) outlines the requirements for accessory structures and uses for residential uses. 156.107(A)(1) through (7) of these requirements are also listed below in italics, with staff comments following. (1) No more than two detached accessory buildings are permitted on any single-family, detached dwelling parcel located in any district except R-1. Combined aggregate square footage for detached accessory structures shall not exceed 200 square feet or 2% of the lot area, whichever is greater, except if the lot has no attached garage, the largest detached structure may not exceed the square footage of the main floor dwelling. a. The applicant could remove the detached shed from the property, and this requirement would be met. Alternatively, the garage could be attached to the house. 60 July 2, 2025 Centerville City Council Page 4 of 8 RE: 7064 Centerville Road, Variances for New Detached Garage (2) In no event may any accessory building exceed the square footage of the main level of the principal structure, except in the R-1 District. a. This is met. (3) No accessory structure may be constructed on a parcel without a principal structure. a. This is met. (4) No accessory structure shall be erected or located within any required yard other than the rear yard. a. The city has interpreted this to mean a detached accessory structure must be within the rear yard. While it may be expensive, the applicant could meet this requirement by moving both the gas meter and well to different locations, and shifting the garage further back/east into the lot. Another option would be to place the proposed garage elsewhere on the lot, such as to the north/northwest of the house. The applicant noted that without redoing the driveway entirely, this would require extending the driveway around the house to serve the garage. b. The applicant cites other properties in the city that have garages closer to the road than the house. This includes 1740 Heritage, 7046 Centerville, and 7060 Goiffon. i. Progress Road was originally platted to extend further south; 1740 Heritage appears to have been platted to front this road before it was vacated. Staff cannot verify at the time of writing this report the applicable requirements for accessory structures when this structure in question was built; if this structure were built prior to todayÔs requirements it would be legally nonconforming. ii. 7046 Centerville is a corner lot, and therefore can have an accessory structure 20 feet from the street property line per 156.107(A)(5). iii. 7060 Goiffon has a detached accessory structure that is not in the rear yard, but it is not closer to the road than the house. Staff cannot verify the setback between the garage and house is less than six feet. (5) Detached accessory buildings must have a minimum of a 5-foot interior side setback and a 10-foot rear setback. Where a rear or side yard abuts a street, an accessory building shall be set back a minimum of 20 feet from the street property line. No structure may be placed in an easement except bridges by written permit approved by the City Council. a. This requirement is met. (6) In case an accessory structure is attached to the main building, it shall be made structurally a part of the main building and shall comply in all respects with the requirements of this chapter applicable to the main building. a. N/A (7) An accessory building, unless attached to and made a part of the main building, shall not be closer than 6 feet to the main building, except as otherwise provided in this section. a. The applicant is proposing 1.70833 feet between the house and detached garage. Another option would be to place the proposed garage elsewhere on the lot, such as to the north/northwest of the house. b. This includes 1740 Heritage, 7046 Centerville, and 7060 Goiffon. staff cannot verify at this time the applicable i. As noted previously, requirements for accessory structures when the detached garage on 1740 Heritage was built; if this structure were built prior to todayÔs requirements it would be legally nonconforming. ii. Staff cannot verify the setback between the garage and house is less than six feet on 7060 Goiffon. Attached vs Detached The commissioners discussed whether the applicant could attach the structure to the house, and whether the applicant would still need any variances from the city. Attaching the garage to the house would remove the need for the three variances currently being requested. Staff reviewed whether attaching the garage would trigger any other variances. The site is zoned M-2, which permits residential uses with a density of 12-30 units per acre; a single- family residence is therefore a nonconforming use. Since the house is nonconforming to the M-2 zone, the requirements of 156.052(C)(1) apply; see below in italics. Existing uses that are not in conformance with this section may not be expanded, but may continue as nonconforming uses. Additions to a nonconforming single-family residential structure may be allowed, provided the square footage of the main floor of the home is not increased by more than 33% from that which existed on January 11, 2006. Also, accessory buildings or uncovered decks and porches may be constructed in conjunction with nonconforming single-family uses, provided they meet all of the conditions, including setbacks, as required in the R-2 Single Family District. Since the house is nonconforming, no addition could increase the square footage of the main floor of the home (i.e., the footprint of the house) by more than 33%. It is staffÔs understanding that 156.052(C)(1) would allow an addition of more living space, provided the footprint of the house does not increase by more than 33%. Attaching a garage onto the applicantÔs house would not increase living space, and therefore could be permitted. If they (or a future owner) wish to convert any of the attached garage into living space, though, the increase could not exceed 33% of the houseÔs current footprint of 480 SF. The commission also discussed how rezoning the site could alleviate this. 62 July 2, 2025 Centerville City Council Page 6 of 8 RE: 7064 Centerville Road, Variances for New Detached Garage 156.052(C)(1) further states that accessory buildings (or decks/porches) can also be constructed, if they meet the requirements of the R-2 zoning district. The proposed garage is set back five (5) feet from the south side lot line; the R-2 zone requires a ten-foot setback from the side lot line for principal structures (such as the house). If the garage were attached, the applicant would either need to reduce the width of the garage or request a variance from the side setback. VARIANCE STANDARDS The processes and procedures for variances are covered under 156.310. The standards or criteria the Planning and Zoning Commission and City Council consider when reviewing variances are found in 156.310(A)(1). These are listed below in italics, with staffÔs findings following. (1) The variance is in harmony with the purposes and intent of the zoning chapter of this code; a. This is not met. The current requirements are to have detached structures in the rear yard, and a minimum distance from the primary residence. There are other areas of the property that could be utilized for the proposed detached accessory structure that would comply with city code. In addition, the applicant could remove the existing shed on the site, further bringing the property into code compliance and removing the need to vary from the limit on aggregate accessory structure space. (2) The variance is consistent with the comprehensive plan; a. This is met. The 2040 Comprehensive Plan does not explicitly discuss accessory structures. (3) The proposal puts the property to use in a reasonable manner; a. This is met. A detached accessory structure is permitted with residential uses. (4) There are unique circumstances to the property not created by the landowner; a. This is not met. While the houseÔs location deep in the lot and the gas meter existed prior to the current owner, the applicant is proposing the proposed location of the detached garage. There are other areas of the property that could be utilized for the proposed detached accessory structure that would comply with city code. (5) The variance, if granted, will not alter the essential character of the locality; a. This is met. There are other properties within the city that have detached accessory structures within the front yard. The proposed location would not Óstand outÔ when compared to the locations of the houses on the properties to the north and south. (6) Any person filing a petition requesting a variance or an amendment of the zoning chapter rezoning property or changing regulations within any use district shall pay a fee according to the schedule established by resolution or ordinance of the City Council. The fee is payable at the time of filing a petition and is not refundable. a. (1) Approve the request, with findings and with/without conditions of approval. (2) Deny the request, with findings for denial. (3) Table the request for further review/study. RECOMMENDATION Denial If the City Council denies the request, staff would recommend the following findings for denial: (1) The variance is not in harmony with the purposes and intent of the zoning chapter of this code. The current requirements are to have detached structures in the rear yard, and a minimum distance from the primary residence. There are other areas of the property that could be utilized for the proposed detached accessory structure that would comply with city code. In addition, the applicant could remove the existing shed on the site, further bringing the property into code compliance and removing the need to vary from the limit on aggregate accessory structure space. (2) There are no unique circumstances to the property not created by the landowner. While the houseÔs location deep in the lot and the gas meter existed prior to the current owner, the applicant is proposing the proposed location of the detached garage. There are other areas of the property that could be utilized for the proposed detached accessory structure that would comply with city code. Approval The Planning and Zoning Commission recommended the City Council approve the request, with the following findings: (1) The intent of the code is for a detached garage to be a set distance from the house, to have such structures behind the house, and to limit the amount of accessory space on a lot. The applicant can meet building code requirements to ensure the proximity of the proposed detached garage to the house is not an issue. The proposed garage would be set back further from Centerville Road than neighboring structures, and would not Óstand out.Ô The existing shed predates the applicant. (2) A detached garage is not in conflict with the cityÔs 2040 Comprehensive Plan. (3) The proposed use is a reasonable use. A detached accessory structure such as a garage is permitted with residential uses. (4) The location of the house, gas meter, well, and curb cut all predate the current applicant. The circumstances were not created by the landowner. (5) The variance will not alter the essential character of the area. There are other properties within the city that have detached accessory structures within the front yard and/or closer to the house than six (6) feet. (1) The applicant is permitted to construct a detached garage on the property in accordance with the plans received with this request. a. (2) The proposed garage shall adhere to all applicable local, county, state, or federal requirements. (3) The applicant shall acquire all applicable local, county, state, or federal permits required for the project. (4) The applicant shall pay any fees or escrows required as part of this request. 60-DAY DEADLINE The application was received May 15, 2025. The 60-day deadline for action by the City Council per State statute 15.99 is July 15, 2025. If the Council tables the request, the city can extend the timeline an additional 60-days per State statute 15.99.
