At the last meeting, the P&Z held a public hearing to receive input on proposed revisions to the Zoning
Ordinance. The proposed revisions provide clarification on select definitions and intent regarding placement of
accessory structures.

OVERVIEW
Recently the Planning and Zoning Commission discussed a variance request that brought up issues of
interpreting various definitions and standards in the Zoning Code related to setbacks, accessory buildings,
and swimming pools. These were further discussed at the JunePlanning & Zoning Commission meeting.
Further changes were discussed at the JulyPlanning & Zoning Commission meeting.The previously
discussed changes are summarized later in this report.
In addition, related to another variance request, the Council has directed the commissioners to look at
accessory structure requirements, in particular the size limits and allowances currently within code.
Past Discussion
In CentervilleÓs current code a ÐyardÑ is synonymous with Ðsetback.Ñ When the code references a yard, it
most often means the setback (but not always). Most readers think the word ÐyardÑ is anywhere on the
property around the house. The commissioners reviewed a draft ordinance at the July meeting, which
includesreplacing most instances of the word ÐyardÑ with Ðsetback.Ñ
Staff also recommended adding a column into Appendix A, Table 1, to call out the Shoreland Setback,
which will help readers understand that the setback from a lake is a separate setback requirement.
Based on discussion with the commission, staff recommended a new definition for lots that abut lakes,
which resulted in a new definition Î Lot, Lakeshore. This allows the city to set different standards for
lakeshore lots and differentiate these lots from other properties in the city. In particular, accessory
structures were proposed to be able to be located within the front yard of a lakeshore lot, provided that the
minimum front setback for principal buildings is met, there is screening between the structure and the right-
of-way, and that all other required setbacks are met.
The commissioners suggested adding a definition to the code for swimming pools, as there is not one
currently. Staff revised the language for swimming poolsto clarify that the precedent and intent of the city is
to only allow them within the rear yard.
Staff also revised the language regarding the requirements for fences, to better clarify the cityÓs intent that
fences between the house and the front lot linecannotexceed 36 inches in height.
The commissioners also reviewed options for where accessory structures on residential lots canbe located.
The consensus was to allow them to be built to the side or rear of a house, but not permit them to be closer
to the front lot line than the front of a house.

Front Lot Line and Setbacks
The commissioners asked staff to investigate the definition of front lot lines and front setbacks. The code
currently states the following definitions, as well as the requirements for required yards below. The
proposed changes as discussed previously are included below in blue. These are also shown in Figure 1.
LOT LINE, FRONT. On an interior lot, the lot line abutting a street; on a corner lot, the lot lines abutting a
street; on a through lot, the lot line abutting the street providing the primary access to the lot; or, on a flag lot,
the interior lot line most parallel to and nearest the street from which access is obtained.
YARD SETBACK, FRONT. A yard extending across the full width of the front lot between side lot lines and
extending from the front property line to the depth required in the yard regulations of the district in which the
lot is located. On a corner lot, both street frontages shall be considered the front. The area extending along the
full length of a front lot line between side lot lines and to the depth required in the setback regulations for the
district in which it is located.
Lots which abut on more than one street shall provide the required front yards setbacks along each street
for the principal structure and for any accessory building;

As shown in Figure 1, a corner lot would have two ÒfrontÓ lot lines, and therefore have a front setback from
each. In residential areas, the minimum front setback varies between 30 feet (R-2A, R-3) and 35 feet (R-1,
R-2, R-4, R-5), depending on the zoning district. All residential zones have a minimum side setback of 10
feet, and a minimum rear setback of 25 feet.
The current requirement makes it easy for staff to determine and administer, and would result in a
consistent built form. The downside is that a property owner of a corner lot is unable to use a large amount
of their lot due to the front setback requirement. One remedy to this is that the other two lot lines of a corner
lot are considered ÒsideÓ lot lines, as having two ÒrearÓ lot lines would result in much of the lot being within
either a front or rear setback. This is not explicitly mentioned in the current code but appears to have been
past practice; if the city keeps the front lot line definition and application staff would recommend adding
language stating that a corner lot has two front lines and two side lot lines.
Options the commissioners discussed in July included having the front lot line be the lot line having the
legal street address, or where the access/driveway is located be the ÒfrontÓ lot line. Both options can be
straightforward for square or rectangular shapes. Figure 2 shows how a corner lot would be impacted
differently by such a change.

One item to consider is that part of the lot is now no longer within the setback, and could be built in; this is
shown in green in Figure 2. If we assign the side lot lines on a corner lot the same as an interior lot, a large

amount of the lot along one street could be built in. This could lead to situations where the built form of a
corner property will stand out compared to other adjacent lots; does the city have issues with this or not? If
yes, an option to consider would be to create a Òstreet sideÓ setback, which would be less restrictive than the
front setback requirement, but not as small as the side setback. For example, a 20-foot street side setback
could lessen the change from a 30- or 35-foot setback to a 10-foot setback; this is shown in Figure 3.

Situations where a lotÓs address is different than where the access or front of a house is from, or lots with
curved or irregular shapes could create complicated or unique issues. In addition, there are a few lots in the
city who do not abut or have frontage along the roads their address or access is derived from. Staff would
recommend that peculiar situations warrant having the Zoning Administrator determine which lot line would
be the ÒfrontÓ.
Creating a street side setback could also impact the non-residential zones in the city (B-1, B-2, I-1, and P-
1). The side and rear setbacks are not very different from the front setback in the B-1, B-2, and P-1 zones;
the street side setback in these zones could be the same as the front, or similar to the current side or rear.

If the commission wants to base the front lot line on address, and include a street side setback, staff
recommends the following revisions to the definitions and yards sections.

street which is the lotÓs legal street address; on a through lot, the lot line abutting the street providing the
primary access to the lot; or, on a flag lot, the interior lot line most parallel to and nearest the street from
which access is obtained. A lot line along a curved street, or cul-de-sac, shall be considered one continuous
lot line.

Lots which abut on more than one street shall provide the required front yards setbacks from the lot lines
abutting the street which is the lotÓs legal street address along each street for the principal structure and for
any accessory building. Lots which do not abut any streets, or do not abut the street from which the lotÓs legal
address is derived shall have their lot lines designated by the Zoning Administrator;
Appendix A, Table 1 will also need to be revised to include a minimum street side setback, see below.

In addition, staff would recommend revising references to encroachments into the front setback to also
include the street side setback. For fences, staff would recommend replacing references to front yard or
setback to Òbetween the edge or building line of the principal structure and a lot line abutting a street.Ó
The commission should discuss whether to move forward with changes to the front lot line definition, or to
keep the current standards in place.
Accessory Structures
If the city pursues changes to front lot lines and creates a street side setback, staff recommends further
revisions to the Accessory Structure section. These are shown below:
(4) For an interior lot, no detached garage accessory structure shall be erected or located within any
required yard other than the rear yard so that any edge or building line of the structure is in
front of the principal building. Any detached accessory structure that is not a garage shall be
located only within the rear yard. For a corner or interior lot that is a lakeshore lot, a detached

garage or accessory building shall be permitted closer to the front lot line than the front
building line or edge of the principal building, provided that the minimum front setback for
principal buildings is met Ͻ϶there is screening between the structure and the right-of-way, and
that all other required setbacks are met.
(5) Detached accessory buildings must have a minimum of a 5-foot interior side setback and a 10-
foot rear setback. Where a rear or side yard abuts a street For a corner or through lot, a detached
accessory building shall be to the side or rear of the principal building, and shall adhere to the
required street side setback as established in Appendix A, Table 1 set back a minimum of 20
feet from any lot line abutting a road the street property line. No structure may be placed in an
easement, except bridges by written permit approved by the City Council.
Accessory Structure Sizes
After reviewing a previous variance, the Council asked the commissioners to look at accessory structure
requirements for residential zones, in particular the size limits and allowances currently within code. Below
are the current standards found in § 156.107(A):
(1) No more than two detached accessory buildings are permitted on any single-family, detached
dwelling parcel located in any district except R-1. Combined aggregate square footage for detached
accessory structures shall not exceed 200 square feet or 2% of the lot area, whichever is greater, except if
the lot has no attached garage, the largest detached structure may not exceed the square footage of the main
floor dwelling.
(2) In no event may any accessory building exceed the square footage of the main level of the principal
structure, except in the R-1 District.
(9) Detached parking garages for residential uses may be allowed to exceed the area limitations above, but
only with a finding that underground or attached parking is impractical or infeasible.
Staff reviewed the standards in nearby communities, to identify what neighboring cities permit. Some cities
base their requirements on zoning district, while other cities have a Òsliding scaleÓ, where the amount and
number of detached accessory structures is based on the size of the lot. Staff finds that this is a common
approach in the Twin Cities region. For example, the city of Hugo does the following:

Given the development pattern of Centerville, a Òsliding scaleÓ like above could be used with different lot
size breakdowns (such as using the minimum lot sizes in each zone) and size limitations/allowances. The
current limit of 2% of the lot area acts as a sort of sliding scale already; does the city find that number low

though? For example, a lot that is 11,000 SF in size would be permitted 220 SF. Using the 2% as a starting
point, a potential new breakdown could look like the following as shown in Table 2. The commission should
discuss whether the proposed are appropriate for the city.

The commission should discuss whether something along the lines of Table 2 would be appropriate for the
city.
RECOMMENDATION
If there is consensus among the Planning and Zoning Commission on the previously reviewed issues
presented here, the Planning and Zoning Commission can recommend the proposed amendments to the
City Council for approval or denial. Included is a Draft ÒA,Ó with changes as reviewed at the June and July
meetings. Draft ÒBÓ includes potential changes to the definition of a front lot line and the introduction of a
street side setback.
If there is a consensus among the Planning and Zoning Commission on whether to move forward with
changes to the standards for detached residential accessory structures, staff would recommend holding a
public hearing to review a draft ordinance at a future meeting.

SECOND SERIES
AN ORDINANCE TO REVISE CHAPTER 156 - ZONING CODE
The City Council of the City of Centerville hereby ordains:
Section 1. Revisions to § 156.006 DEFINITIONS.
BUILDABLE AREA. The space remaining on a zoning lot after minimum yard setback and open space
requirements have been met, unless as otherwise specified.
BUILDING LINE. A line, parallel to a lot street line, that passes through the point of the principal building
nearest the front said lot line.
LOT, CORNER. A lot abutting on and at the intersection of two or more streets. A corner lot shall have two
or more front lot lines, and two or more side lot lines, and shall not have a rear lot line.
LOT, LAKESHORE. A lot bordered on one side by a river, stream, or lakeshore, and another side by a
right-of-way. Lakeshore lots may also be corner lots or interior lots. Also referred to as a riparian lot.
LOT LINE, FRONT. On an interior lot, the lot line abutting a street; on a corner lot, the lot lines abutting
the street; on a through lot, the lot line abutting the street providing the primary access to the lot; or, on a
flag lot, the interior lot line most parallel to and nearest the street from which access is obtained. A lot line
along a curved street, or cul-de-sac, shall be considered one continuous lot line.
SETBACK. The minimum horizontal distance between a lot line and a building line or use. A required
open space on a lot which is unoccupied and unobstructed from the ground upward, except as otherwise
provided for herein. The measurement of a SETBACK shall be construed as the minimum horizontal
distance between the lot line and the building line or edge of a structure.
YARD SETBACK, FRONT. A yard extending across the full width of the front lot between side lot lines
and extending from the front property line to the depth required in the yard regulations of the district in
which the lot is located. On a corner lot, both street frontages shall be considered the front. The area
extending along the full length of a front lot line between side lot lines, and to the depth required in the
setback regulations for the district in which it is located.
YARD SETBACK, REAR. The portion of the yard on the same lot with the principal building located
between the rear line of the building and the rear lot line and extending for the full width of the lot. The
area lying along the full length of the rear lot line between side lot lines and extending inwardly to the
depth required in the setback regulations for the district in which the lot is located.

YARD SETBACK, SIDE. A yard between the side line of the lot and the nearest line of the building and
extending from the front yard to the rear yard. The area lying between the side lot line and extending
inwardly to the depth required in the setback regulations for the district in which the lot is located, and
which lies between the front and rear setbacks, or other applicable setbacks.
SETBACK, STREET SIDE. The area extending between the front setback and the rear setback, and to the
depth required in the setback regulations for the district in which it is located.
SWIMMING POOLS. Any pool, tank, or other structure, above or below ground, which shall cause or has
the capacity to retain water at a depth greater than 30 inches, and is designed to be used for swimming,
wading, or immersion purposes by individuals.
YARD. A required The open space on a lot which is unoccupied and unobstructed from the ground upward,
except as otherwise provided for herein. The measurement of a YARD shall be construed as the minimum
horizontal distance between the a lot line and the a building line or edge of a structure line.
YARD, REAR. The portion of the yard on the same lot with the principal building located between the rear
line edge or building line of the building and the rear lot line, and extending for the full width of the lot.
YARD, SIDE. A yard between the side lot line of the lot and the nearest edge or building line of the
building and extending from the front setback yard to the rear setback yard.
Section 2. Revisions to § 156.040(C) INDUSTRIAL DISTRICT (I-1).
(C) Setbacks. Specific setbacks are set forth in Appendix A, Table 1, District Regulations Lot and
Yard Requirements. In addition, side yards facing streets on corner lots shall be considered the
same as a front lot line yards. Where a front setback yard or side setback yard of a corner lot faces
a residential district across a street, the setback from the street shall be not less than 60 feet.
Section 2. Revisions to § 156.107(A)(4-5), (10), and (B)(4) ACCESSORY STRUCTURES
AND USES.
(4) For an interior lot, no detached garage accessory structure shall be erected or located within
any required yard other than the rear yard so that any edge or building line of the structure is
in front of the principal building. Any detached accessory structure that is not a garage shall
be located only within the rear yard. For a corner or interior lot that is a lakeshore lot, a
detached garage or accessory building shall be permitted closer to the front lot line than the
front building line or edge of the principal building, provided that the minimum front setback
for principal buildings is met, there is screening between the structure and the right-of-way,
and that all other required setbacks are met.
(5) Detached accessory buildings must have a minimum of a 5-foot interior side setback and a
10-foot rear setback. Where a rear or side yard abuts a street For a corner lot, a detached
accessory building shall be to the side or rear of the principal building, so that any edge or
building line of the detached accessory building or structure is not located closer to a lot line
abutting a road than the principal structure and set back a minimum of 20 feet from the street
property line. No structure may be placed in an easement, except bridges by written permit
approved by the City Council.

(10) Swimming pools may only be located in the rear yard of any lot, and may exceed the size
requirements for accessory structures, but shall not exceed 50% of the area of the rear yard.
(B)(4) No accessory structure shall be erected or located within the front setback yard.
Section 3. Revisions to § 156.111(A)(1)(b), (A)(2), and (F) FENCES AND SPECIAL
PRIVACY SCREENING.
(A)(1)(b) No fence other than a decorative fence may be constructed between the edge or building line of
the principal structure and a lot line abutting a street in a front yard. As used herein, the term
DECORATIVE FENCE means a wrought iron fence, wood or vinyl vertical post and wood horizontal rail
fence with no more than three rails or a wood or vinyl picket type fence with at least two inches of open
space between each picket. All decorative fences shall have at least 40% of the surface area of the fence
open.
(2) No residential fence may exceed six feet in height and. No decorative fence between the edge or
building line of the principal structure and a lot line abutting a street in the front yard may exceed 36 inches
in height.
(a) Where a corner lot abuts an adjacent propertyÓs front setback yard, the fence shall be set back a
minimum of 10 feet from the adjoining property line, unless the fence is a decorative fence not
exceeding three feet in height.
(b) Residential corner lots shall only have one front setback yard for the purpose of fences and that
shall be the side that has the front entrance to the home.
(F) Fencing in commercial/industrial zoning districts shall not exceed eight feet in height. Fences, except
decorative fences not exceeding three feet in height, shall not be placed in a front setback yard of an
industrial or commercial lot.
Section 4. Revisions to § 156.122(A)(1-4) and (B)(1-3) YARDS.
(A) General requirements. The minimum depths of front yard, rear yard, and side yard setback for
each district shall be as defined in the schedule of regulations and conform to the following
additional regulations unless otherwise permitted:
(1) All structures, whether attached to the principal structure or not, and whether open or
enclosed, including porches, carports, balconies or platforms above normal grade level
shall not project into any minimum front, side or rear yard setback.
(2) Lots which abut on more than one street shall provide the required front yards
setbacks from the lot lines abutting along each street for the principal structure and for
any accessory building, unless otherwise permitted. Lots which do not abut any streets, or
do not abut the street from which the lotÓs legal address is derived shall have their lot
lines designated by the Zoning Administrator.
(3) Any principal structure situated on lands contiguous to or abutting any portion of the
public lakes in the city shall maintain yard setbacks of 75 feet from the lake. Where
adjacent structures have yard setbacks different from these requirements, the minimum
setback from the lake shall be the average setback of the adjacent structures to a
minimum of 50 feet; and See also Floodplain Chapter and additional requirements for
shorelands.
(4) The minimum side or rear yard setback depths for the following nonresidential
structures or uses which abut any lot in any residential district shall be:
(B) Computing front yards setbacks. For the purpose of computing front yard setback dimensions,
measurements shall be taken from the nearest point of the front wall of the building to the street
right-of-way line subject to the following qualifications:

(1) Cornices, canopies or eaves may extend into the required front yard setback a distance
not exceeding two feet, six inches;
(2) A covered or uncovered landing place, steps, or stoop may extend into the required
front yard setback to a distance not exceeding six feet, if its floor is no higher than the
entrance floor of the building. An open railing no higher than three feet may be placed
around the structure. Such permitted encroachment shall not be enclosed with walls,
screens, windows, etc. but must be completely open and if covered, the cover may be
cantilevered or supported with columns and must be constructed in similar quality and
appearance as the building and may not be constructed with metal roofs or metal
columns;
(3) The above enumerated architectural features may also extend into any side or rear
yard setback to the same extent, except that no porch, terrace or outside stairway shall
project more than three feet into any side yard setback and then, in the case of an outside
stairway, only if it is unroofed and unenclosed above and below the steps. In no case shall
a porch, stair landing or any other architectural feature extend closer than four feet to the
side property line; and
Section 5. Revisions to § 156.166(M)(6) PARKING AND DRIVEWAY REQUIREMENTS.
(6) A driveway may include a paved parking or turnaround area not more than 8 feet by 18-feet
adjacent to a driveway connecting a roadway to a garage or front setback yard.
Section 6. Revisions to § 156.167 TREE PLANTING.
Required trees should be planted in the front setback yard and out of the right of way and a
minimum of 15 feet from the curb line and shall not be planted in a manner that interferes with
any current or planned utility line. Trees may not be planted under a power line except low
growing varieties approved by the City for such locations.
Section 7. Revisions to § 156.178(A)(2) LANDSCAPING.
NOTES:
1 Trees shall be deciduous and planted off the boulevard but in the front setback yard area.

SECOND SERIES
AN ORDINANCE TO REVISE CHAPTER 156 - ZONING CODE
The City Council of the City of Centerville hereby ordains:
Section 1. Revisions to § 156.006 DEFINITIONS.
BUILDABLE AREA. The space remaining on a zoning lot after minimum yard setback and open space
requirements have been met, unless as otherwise specified.
BUILDING LINE. A line, parallel to a lot street line, that passes through the point of the principal building
nearest the front said lot line.
LOT, LAKESHORE. A lot bordered on one side by a river, stream, or lakeshore, and another side by a
right-of-way. Lakeshore lots may also be corner lots or interior lots. Also referred to as a riparian lot.
LOT LINE, FRONT. On an interior lot, the lot line abutting a street; on a corner lot, the lot lines abutting
the street which is the lotÓs legal street address; on a through lot, the lot line abutting the street providing
the primary access to the lot; or, on a flag lot, the interior lot line most parallel to and nearest the street from
which access is obtained. A lot line along a curved street, or cul-de-sac, shall be considered one continuous
lot line.
LOT LINE, STREET SIDE. The lot lines abutting a street that are not a front lot line.
SETBACK. The minimum horizontal distance between a lot line and a building line or use. A required
open space on a lot which is unoccupied and unobstructed from the ground upward, except as otherwise
provided for herein. The measurement of a SETBACK shall be construed as the minimum horizontal
distance between the lot line and the building line or edge of a structure.
YARD SETBACK, FRONT. A yard extending across the full width of the front lot between side lot lines
and extending from the front property line to the depth required in the yard regulations of the district in
which the lot is located. On a corner lot, both street frontages shall be considered the front. The area
extending along the full length of a front lot line between side or street side lot lines, and to the depth
required in the setback regulations for the district in which it is located.
YARD SETBACK, REAR. The portion of the yard on the same lot with the principal building located
between the rear line of the building and the rear lot line and extending for the full width of the lot. The
area lying along the full length of the rear lot line between side lot lines and extending inwardly to the
depth required in the setback regulations for the district in which the lot is located.

YARD SETBACK, SIDE. A yard between the side line of the lot and the nearest line of the building and
extending from the front yard to the rear yard. The area lying between the side lot line and extending
inwardly to the depth required in the setback regulations for the district in which the lot is located, and
which lies between the front and rear setbacks Ͻ϶or other applicable setbacks.
SETBACK, STREET SIDE. The area extending between the front setback and the rear setback, and to the
depth required in the setback regulations for the district in which it is located.
SWIMMING POOLS. Any pool, tank, or other structure, above or below ground, which shall cause or has
the capacity to retain water at a depth greater than 30 inches, and is designed to be used for swimming,
wading, or immersion purposes by individuals.
YARD. A required The open space on a lot which is unoccupied and unobstructed from the ground upward,
except as otherwise provided for herein. The measurement of a YARD shall be construed as the minimum
horizontal distance between the a lot line and the a building line or edge of a structure line.
YARD, REAR. The portion of the yard on the same lot with the principal building located between the rear
line edge or building line of the building and the rear lot line, and extending for the full width of the lot.
YARD, SIDE. A yard between the side lot line of the lot and the nearest edge or building line of the
building and extending from the front setback yard to the rear setback yard.
Section 2. Revisions to § 156.040(C) INDUSTRIAL DISTRICT (I-1).
(C) Setbacks. Specific setbacks are set forth in Appendix A, Table 1, District Regulations Lot and
Yard Requirements. In addition, side yards facing streets on corner lots shall be considered the
same as front yards. Where a front setback yard or street side setback yard of a corner lot faces a
residential district across a street, the setback from the street shall be not less than 60 feet.
Section 2. Revisions to § 156.107(A)(4-5), (10), and (B)(4) ACCESSORY STRUCTURES
AND USES.
(4) For an interior lot, no detached garage accessory structure shall be erected or located within
any required yard other than the rear yard so that any edge or building line of the structure is
in front of the principal building. Any detached accessory structure that is not a garage shall
be located only within the rear yard. For a corner or interior lot that is a lakeshore lot, a
detached garage or accessory building shall be permitted closer to the front lot line than the
front building line or edge of the principal building, provided that the minimum front setback
for principal buildings is met, there is screening between the structure and the right-of-way,
and that all other required setbacks are met.
(5) Detached accessory buildings must have a minimum of a 5-foot interior side setback and a
10-foot rear setback. Where a rear or side yard abuts a street For a corner or through lot, a
detached accessory building shall be to the side or rear of the principal building, and shall
adhere to the required street side setback as established in Appendix A, Table 1. set back a
minimum of 20 feet from the street property line. No structure may be placed in an easement,
except bridges by written permit approved by the City Council.

(10) Swimming pools may only be located in the rear yard of any lot, and may exceed the size
requirements for accessory structures, but shall not exceed 50% of the area of the rear yard.
(B)(4) No accessory structure shall be erected or located within the front or street side setback
yard.
Section 3. Revisions to § 156.111(A)(1)(b), (A)(2), and (F) FENCES AND SPECIAL
PRIVACY SCREENING.
(A)(1)(b) No fence other than a decorative fence may be constructed between the edge or building line of
the principal structure and a lot line abutting a street in a front yard. As used herein, the term
DECORATIVE FENCE means a wrought iron fence, wood or vinyl vertical post and wood horizontal rail
fence with no more than three rails or a wood or vinyl picket type fence with at least two inches of open
space between each picket. All decorative fences shall have at least 40% of the surface area of the fence
open.
(2) No residential fence may exceed six feet in height and. No decorative fence between the edge or
building line of the principal structure and a lot line abutting a street in the front yard may exceed 36 inches
in height.
(a) Where a corner lot abuts an adjacent propertyÓs front setback yard, the fence shall be set back a
minimum of 10 feet from the adjoining property line, unless the fence is a decorative fence not
exceeding three feet in height.
(b) Residential corner lots shall only have one front setback yard for the purpose of fences and that
shall be the side that has the front entrance to the home.
(F) Fencing in commercial/industrial zoning districts shall not exceed eight feet in height. Fences, except
decorative fences not exceeding three feet in height, shall not be placed in a front or street side setback yard
of an industrial or commercial lot.
Section 4. Revisions to § 156.122(A)(1-4) and (B)(1-3) YARDS.
(A) General requirements. The minimum depths of front yard, rear yard, and side yard setback for
each district shall be as defined in the schedule of regulations and conform to the following
additional regulations unless otherwise permitted:
(1) All structures, whether attached to the principal structure or not, and whether open or
enclosed, including porches, carports, balconies or platforms above normal grade level
shall not project into any minimum front, side or rear yard setback.
(2) Lots which abut on more than one street shall provide the required front yards
setbacks from the lot lines abutting the street which is the lotÓs legal street address along
each street for the principal structure and for any accessory building. Lots which do not
abut any streets, or do not abut the street from which the lotÓs legal address is derived
shall have their lot lines designated by the Zoning Administrator.
(3) Any principal structure situated on lands contiguous to or abutting any portion of the
public lakes in the city shall maintain yard setbacks of 75 feet from the lake. Where
adjacent structures have yard setbacks different from these requirements, the minimum
setback from the lake shall be the average setback of the adjacent structures to a
minimum of 50 feet; and See also Floodplain Chapter and additional requirements for
shorelands.
(4) The minimum side or rear yard setback depths for the following nonresidential
structures or uses which abut any lot in any residential district shall be:
(B) Computing front yards setbacks. For the purpose of computing front yard setback dimensions,
measurements shall be taken from the nearest point of the front wall of the building to the street
right-of-way line subject to the following qualifications:

(1) Cornices, canopies or eaves may extend into the required front or street side yard
setback a distance not exceeding two feet, six inches;
(2) A covered or uncovered landing place, steps, or stoop may extend into the required
front or street side yard setback to a distance not exceeding six feet, if its floor is no
higher than the entrance floor of the building. An open railing no higher than three feet
may be placed around the structure. Such permitted encroachment shall not be enclosed
with walls, screens, windows, etc. but must be completely open and if covered, the cover
may be cantilevered or supported with columns and must be constructed in similar
quality and appearance as the building and may not be constructed with metal roofs or
metal columns;
(3) The above enumerated architectural features may also extend into any side or rear
yard setback to the same extent, except that no porch, terrace or outside stairway shall
project more than three feet into any side yard setback and then, in the case of an outside
stairway, only if it is unroofed and unenclosed above and below the steps. In no case shall
a porch, stair landing or any other architectural feature extend closer than four feet to the
side property line; and

Thursday, October 9, 2025. The regularly scheduled meetings will stay the same, with regular meetings
starting at 6:30 p.m. and work sessions beginning at 5:00 p.m. Staff have confirmed that all consultants
involved will be available with this new meeting schedule.

While visiting the market crafters/artisans and food vendors, please then swing in to watch the Bald Eagle
Waterski Show, which is a short walk to Trailside Park. Their show starts at 7 p.m.

Movie in the Park
At the Parks & Recreation Committee meeting of August 6,
2025, they chose the movie ÐThe Wild RobotÑ for their
annual Movie in the Park scheduled for September 13, with
a rain date of September 20, 2025. The movie will be shown
at Laurie LaMotte Memorial Park, 6970 LaMotte Drive,
commencing at sunset (approx. 7:30-8 p.m.). The committee
will be on site to assist you with any questions that you may
have, and to provide participants with free lemonade/hot
chocolate and popcorn. Please bring your lawn chairs,
blankets, etc. Invite your family, friends, kids, etc.
