The regularly scheduled meeting (6:30 p.m.) was live streamed by North Metro TV. WORK SESSION (5:00 PM) I.CALL TO ORDER Mayor Golden called the meeting to order at 5:00 p.m. 1. She stated that this would cover anticipated projects for Fund 402 Î Park Dedication, 409 Î Capital Replacement, 452 Î Street Improvement, 601 Î Water, 602 Î Sewer and 603 Î Storm Water. Finance Director DeJong reviewed the information contained in the council packet. He stated that the information would assist in a comprehensive understanding of the capital needs for the five-year term. He stated that it has been past practice to review the plan on an annual basis. He felt that with several newer members, he would assist them in the processes and understanding of the Capital Improvement Plan. Additional discussion ensued. Finance Director DeJong answered questions posed by the council. 2. Civic Engagement Interim City Administrator Lewis reviewed the information contained in the council packet. She stated that the council has expressed an interest in exploring new avenues to increase civic engagement and/or provide opportunities for the council to meet with the public to receive fresh ideas, concerns, etc. It was stated that there were several upcoming events that members could participate in (e.g. Main Street Market, City of Centerville City Council Meeting Minutes May 28, 2025 Fete des Lacs, Night to Unite, etc.) Additional suggestions were: subscription-based engagement, volunteer opportunities and others. Interim City Administrator Lewis stated that Council had been exploring ways to increase civic engagement and a few ideas have been brought forward, such as Coffee with Council, have Council at Main Street Market, Council Night Out, to name a few. APPOINTMENTS & PRESENTATIONS Page 2 of 8 City of Centerville City Council Meeting Minutes May 28, 2025 1.Mr. Jon Gilbertson Î MWP Recreation Î LaMotte Play Structure Interim City Administrator Lewis introduced Mr. Jon Gilbertson, MWP Recreation. Mr. Gilbertson reviewed the presentation materials contained in the Council packet. He stated that with the design that they proposed for the site, the playground would qualify as a National Demonstration Site, which incorporates at least two of the following designations: promoting physical activity, physical and social inclusion, outdoor adult fitness, and natural grounds integrating living landscape with manufactured equipment and integrates play into walkable, bikeable, shared use community pathway networks to attract use, frequency and duration. He stated that the play structure/site would have a QR code providing visitors an opportunity to share their experience while at the park. The QR code would take the visitor to CORE Data Service Lab where they would be asked to participate in a short survey about the park, equipment, and their experience, etc. He stated that the three site-specific reports provided by CORE Data Service Lab would integrate local and site-collected data to demonstrate the impact, engagement, and park user sentiments. Each report aligns with the seven indicators of community vitality to provide a holistic view of the health and wellness outcomes of the site and how they contribute to the community. 2. P & R Chairperson, Heidi Errickson-Grahek Î Disc Golf Course Chairperson Errickson-Grahek introduced herself to the Council and reviewed the presentation that was contained in the Council packet. She explained that Disc Golf was an amenity that was brought forward during the cityÓs Community Priorities study completed in 2024. She stated that the course would need a minimal amount of funding to be constructed. She stated that there was available space at Laurie LaMotte Memorial Park, and the course could be installed around the outer ring of the park utilizing unused space. She stated that the Public Works Staff have be instrumental in its proposed location and would be key in the installation process. She stated that the Committee had been working diligently on several new offerings to the park during the past year, with this being one of them (i.e. Pickleball and the Accessible Play Structure). Discussion ensued as Council Member Rios stated that Chairperson Errickson-Grahek requested that the Disc Golf Course amount be changed to an amount not to exceed $11,000. Motion carried. VIII. OLD BUSINESS. 1. Brian Drive Culvert Interim City Administrator Lewis stated that the item was previously before council, council requested complete engineering review with the inclusion of alternatives upon the outcome of the inspection. Ms. Kellie Schlegel, City Engineer, stated that the bridge had been inspected in 2022 by a consultant, on behalf of Anoka County. The results were that the bridge was found to be structurally deficient. She stated that in February, the Council directed Stantec to perform an analysis on potential solutions. She stated that there were four potential options: two of the options were to increase the depth of cover over the existing roadway above the culvert with either bituminous or concrete pavement. She explained that Page 4 of 8 City of Centerville City Council Meeting Minutes May 28, 2025 if using bituminous, nine inches would be needed and if utilizing concrete four inches would be needed. Ms. Schlegel stated that if the road thickness was modified, curb and gutter would need reconstruction (approximately 200 feet). She explained that the third option would be to rehabilitate the existing interior culvert with steel plate liners, which would not necessitate any roadway modifications. She stated that there were concerns that it would decrease the water flow due to decreasing the openings of the culverts. Ms. Schlegel stated that this option would need thorough analysis by a qualified contractor. Ms. Schlegel also stated that the fourth option would be a complete replacement of the bridge. Ms. Schlegel said that they have had discussions with MNDOT, and this is their preferred option due to the deterioration of the culvert. She reviewed the costs, option 1 Î raising the grade with asphalt, approximately $335,000; option 2 Î raising the grade with concrete, approximately $325,000; option 3 Î steel plate liners, approximately $320,000; and option 4 Î replace the culvert, approximately $650,000. She stated that option 4 would be eligible for State funding. She reviewed the funding options available and stated that there are likely to be two sources of funding: local funds or State Bridge Funds. If the City wishes to pursue options 1 or 2, they would be funded by the Street Fund. She stated that currently there were no bridge funds available, but stated that the State legislature had regularly appropriate funds for bridges. As a city with a population of 5,000 or less, Centerville would be eligible for 100% of the engineering design and bridge replacement construction costs, less $10,000 match for engineering and $10,000 matching for construction. To be eligible for funding appropriation, engineered design and construction plans must be completed and approved by MNDOT. If funding is not available at that time, the project will be added to the waitlist. Discussion ensued and consensus was for moving forward with option 4. Motion by Mayor Golden, seconded by Council Member Koski, to have staff collect the information to move forward with option #4, complete reconstruction of the culvert so it can be shovel ready along with continuance of researching funding. All in favor. Motion carried. 2.City Hall Irrigation Interim City Administrator Lewis stated that the city had received a matching grant from Rice Creek Water Shed District (RCWD) for the installation of a reuse irrigation system to be located at City Hall. The estimated cost of the project would be $50,000 ($25,000 from RCWD and $25,000 from the city). She stated the project bids came in under $50,000. Ms. Schlegel stated that the project would utilize the stormwater from the pond behind city hall for irrigation of the lawn. She stated that staff had received quotes from two contractors to install the system (Irrigation Doctor, Inc. - $34,350 with an alternate quote for an additional $3,000) and (Peterson Companies - $41,720 with an alternate quote for an additional $4,806). Ms. Schlegel stated that in addition to the installation of the irrigation system, the city would be required to provide a power source for the system. The city received a quote from Aid Electric for the power source - $4,195. She stated that the grant also required that the design plan and specifications be prepared and signed by a licensed engineer or landscape architect. She explained that the total estimated cost of the project would fall within the $50,000 grant amount previously authorized by the council for either the base bid or the base bid plus the alternate. She also stated that the next step would be for the city to sign the grant agreement, request plans and specifications to be prepared and provide a contractor of the CouncilÓs choice along with a contract for services. Ms. Schlegel stated there would need to be an educational component and signage stating that the area was being irrigated from a storm pond similar to that at Laurie LaMotte Memorial Park. He stated that the low bidder was a responsible bidder and reliable contractor. Interim City Administrator Lewis stated that the contract with RCWD needed to be signed the next day and that she would follow up with RCWD to ensure that if the bid/costs were less than $50,000 it would remain a matching grant. The consensus was to accept the grant at a 50/50 cost share. Motion by Council Member Koski, seconded by Council Member Rios to authorize Stantec to prepare plans and specifications with an estimated hourly fee but not exceeding $4,000 and to approve the quote from Irrigation Doctor, Inc.Ós base bid of $34,350, excluding the alternate, and the bid from Aid Electric, with the intent of clarifying with Rice Creek regarding the grant amount remaining a 50/50 cost share even if the cost was less than $50,000. Motion carried. 3.Succession Council Member Vacancy & Res. #25-0XX Î Accepting Resignation of Council Member Darrin Mosher & Declaring a Vacancy Attorney Glaser explained the rules and procedures for vacating a seat. He stated that Council Member Mosher, at some point, would no longer qualify as a Council Member if residing in a different state. He also stated that Council Member Mosher could voluntarily resign, or the council could declare his seat vacant. Attorney Glaser explained that if the council found that Council Member Mosher was no longer a resident of Centerville or the State of Minnesota, the council could approve Findings of Fact and then declare his seat vacant. Under both options, the council needs to go forward to create a resolution, which is in the packet, assuming that Council Member Mosher resigns. He explained that the situation was a candidacy issue, and a resolution would be needed in either circumstance. Attorney Glaser also stated that he attempted to contact Council Member Mosher but did not receive a call back. He stated that he is aware that the council and the public have a lot of questions about the current situation. He stated that typically, candidacy issues are very personal, but in a case like this, the council could declare his seat vacant if he no longer is a resident. Attorney Glaser stated reviewed the memorandum and resolution contained in CouncilÓs packet. Council Member Mosher had said that eventually he would no longer be a resident of Centerville or Minnesota, but he did not formally declared that. He explained that the resolution is in preparation. Discussion ensued, Council Member Koski felt that Council Member Mosher would declare his resignation upon the sale of his home and Council Member Rios concurred. Interim City Administrator Lewis stated that she has had numerous conversations with Council Member Mosher with his preference being to continue his Zoom attendance for meetings. She stated that she has not engaged him on his future plans on the council. Council Member Koski stated that it would be public information if/when he sold his home in Centerville. Mayor Golden stated that Council Member Mosher stated that he does have an offer on his home with a contingency offer on a new residence out of state. She stated that they have come up with a plan that is cost effective and have reviewed options with the Public Works staff. She stated that the Committee determined that the best location for installation of three courts on the north side of the existing basketball court located within the hockey rink at Laurie LaMotte Memorial Park. She stated that the committee considered pickleball mats and determined that they were costly and would need to be moved indoors annually to retain their life cycle. The committee determined stripping of the courts could be achieved relatively inexpensively ($3,000) and three nets would cost approximately $5,400. She reported that the nets were removeable for special events (Fete des Lacs, etc.) and the winter. Chair Errickson-Grahek answered council questions as posed. Ms. Schlegel stated that the city received an application to participate in the cityÓs backyard drainage program. She stated that the program was established to assist residents with drainages issues within their yards. She stated that she has met with the applicant and city staff to discuss the issue. Ms. Schlegel stated that the application does meet the requirements of the program. She stated that the applicant did receive, and solicited two quotes for the proposed improvements, as required. She stated that the proposed solution is to run a drainpipe from the existing sump discharge at the rear of the home and extend it to the west through the neighboring yard where it would outlet adjacent to the cityÓs right of way. The city has received two signed encroachment agreements from property owners and a right of entry. She reported that the drainpipe will exist within the cityÓs existing perimeter of drainage easements and gives the city access to the pipes. She stated they reviewed the application materials but recommended two conditions that contractors provide proof of being bonded and insurance with the city named as additional insured. A discussion ensued and Mayor Golden stated that this property belongs to Council Member Rios and reviewed this program and stated that it was available to all residents with a project that qualifies. I. SERVICES TO BE PROVIDED. Said Services shall be provided as described in ContractorÓs proposal attached as Exhibit A (collectively, the ÐServicesÑ). II. COST OF SERVICES. A. Contractor shall perform the Services outlined in this Agreement and its proposal at the fee set forth in Exhibit A. Contractor shall invoice the City on a monthly basis for the Services performed by Contractor. The invoice must include the number of hours and a description of the Services performed by Contractor. Payment to Contractor by the City shall be due within 30 days of the date of the invoice. B. The attached Schedule of Fees shall apply for services provided. Hourly rates may be adjusted by CONSULTANT on an annual basis thereafter to reflect reasonable changes to its operating costs. Adjusted rates will become effective January 1 each subsequent year. C. The City shall not be responsible for payment for any additional costs or work performed by Contractor that are outside the scope of this Agreement that are not expressly pre- approved by the City. III. CITYÓS REPONSIBLITIES. Upon request, the City shall provide Contractor with all available relevant materials pertaining to completion of the Services. IV. TERM AND TERMINATION OF AGREEMENT. The term of this Agreement shall commence, and Contractor shall commence performing the Services on August 18, 2025. This Agreement may be terminated earlier by either party by giving 30 daysÓ written notice to the other party. Upon termination, Contractor shall be paid by the City for all Services rendered by Contractor and all other pre-approved costs incurred by Contractor as of the date of the termination for which Contractor has not yet been compensated. V. INDEPENDENT CONTRACTOR. All Services provided pursuant to this Agreement shall be provided by Contractor as an independent contractor and not as an employee of the City for any purpose. Any and all officers, employees, subcontractors, and agents of Contractor, or any other person engaged by Contractor in the performance of the Services pursuant to this Agreement, shall not be considered employees of the City. Any and all actions which arise as a consequence of any act or omission on the part of Contractor, its employees, subcontractors, or agents, or other persons engaged by Contractor in the performance of Services pursuant to this Agreement, shall not be the obligation or responsibility of the City. Contractor, its employees, subcontractors, or agents shall not be entitled to any of the rights, privileges, or benefits of the CityÓs employees, except as otherwise stated in this Agreement. VI. INDEMNIFICATION. Contractor, and subcontractors of Contractor, shall indemnify, defend, and hold harmless the City and its officials, employees, contractors and agents from claims, losses, liabilities, and expenses (including reasonable attorneysÓ fees and expenses of litigation) caused by any negligent act or omission by Contractor, engaged by Contractor in the performance of the Services pursuant to this Agreement. Likewise, the City agrees that it will indemnify, defend, and hold harmless the Contractor, and its employees, subcontractors, and agents of Contractor against any and all claims, losses, liabilities, and expenses (including reasonable attorneysÓ fees and expenses of litigation), which the Contractor may hereafter sustain, incur, or be required to pay arising out of the actions of the City pursuant to this Agreement. VII. INSURANCE. Contractor agrees to maintain, at its expense, statutory workersÓ compensation insurance coverage. Contractor also agrees to maintain, at its expense, general liability insurance coverage insuring Contractor against claims for bodily injury, death, or property damage arising out of ContractorÓs general business activities (including automobile use). The liability insurance policy shall provide coverage for each occurrence in the minimum amount of $2,500,000. Upon request of the City, Contractor shall provide the City with certificates of insurance, showing evidence of the required coverage and listing the City as an additional insured. VIII. MISCELLANEOUS PROVISIONS. A. Entire Agreement. This Agreement shall constitute the entire agreement between the City and Contractor and supersedes any other written or oral agreements between the City and Contractor. This Agreement can only be modified in writing signed by the City and Contractor. B. Data Practices Act Compliance. Data provided, produced, or obtained under this Agreement shall be administered in accordance with the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13. Contractor will immediately report to the City any requests from third parties for information relating to this Agreement. Contractor shall comply with Data Practices requests. All data produced or maintained by the Contractor in the course of performing services under this Agreement shall be deemed jointly owned by the Contractor and the City. The Contractor shall maintain and store such data in accordance with all applicable data retention schedules and legal requirements. Upon termination of this Agreement, and upon the CityÓs request, the Contractor shall promptly transfer to the City all data maintained and stored pursuant to this Agreement. C. Choice of Law and Venue. This Agreement shall be governed by and construed in accordance with the laws of Minnesota. Any disputes, controversies, or claims arising under this Agreement shall be heard in the state or federal courts of Minnesota and the parties waive any objections to jurisdiction. D. No Assignment.
