Two conditions on the approved CUP require buildingand siteimprovements to be consistent with
approved plans. For this proposal to move forward, the Applicant is requestingapproval ofa CUP
Amendment and Site Plan Reviewwith updated plans.
Site Plan Review Required
Centerville City Code, Sec. 156.108(A) states the following:
For all land use applications or permit applications for commercial or industrial structures, or
whenever a site plan review is required by this ordinance, a site plan review is required by the
Planning and Zoning Commission.
The CUP amendment requestfor an industrial building expansion requires formal site plan review. The
Planning Commission may recommend findings and conditions of approval to ensure consistency with
the intent of the zoning ordinance.
Conditional Use Permit (CUP) Analysis
The applicant is requesting an amendment to the current CUP toexpand the existing industrial building.
As proposed, the project includes other site improvements related to parkingand loading, landscaping,
and a new outdoor accessory structure.
Zoning
The currentzoning for the subject property is Industrial District (I-1). The purpose of the Industrial
District is stated in Centerville City Code, Sec. 156.040(A) as follows:
It is intended that the I-1 District provide opportunities for light manufacturing and industrial
uses, trade businesses, machine shops and other more extensive land uses.
Comprehensive Plan
The future land use of the subject property is industrźğƌ ĬğƭĻķ ƚƓ ƷŷĻ /źƷǤƭ ЋЉЍЉ /ƚƒƦƩĻŷĻƓƭźǝĻ tƌğƓ͵
Chapter 9 of the Comprehensive Plan establishes goals for industrial development:
Expand the non-residential tax base.
Encourage clean and attractive industrial uses in the community.
Staff find the proposal to be consistent with these goals.
Land Use
Thecurrentand proposedland use is for a truck terminal, which was approved with a CUP in 2021. The
application statesthat the owners will continue to operate and maintain the truck terminal useon the
subject property.Surrounding land uses are also industrial.
Principal Use
A truck terminal is allowed as principaluse inthe I-1 Districtwith a CUP, as outlined in Table 156-A.1of
the City Code. Expansion of a conditional use triggers the need for a CUP amendment.

Accessory Uses
City Code Sec. 156.006 requires that accessory uses are customarily incidental and subordinate to the
principal use and located on the same lotas the principal structure. For the Sutton Transportation site,
these include:
Outdoor storage of trailers, equipment, and materials
Loading and staging service areas
Accessory structures
These accessory uses are permitted in the I-1 District if they meet all applicable zoning standards,
including but not limited to screening for outdoor storage and meeting required setbacks. Accessory
uses related to Truck Terminals can be managed through the CUP.
Proposed Uses
The applicant proposes to continue operating the truck terminal and associated activities under a
Conditional Use Permit(CUP), as may be amended. The proposalincludesan expansion to the building
and associated modifications to outdoor parking and loading areas,screening, landscaping, and a new
outdoor amenity areafor employees.
Existing CUP Conditions
The2021 CUPallowsthe property ownerto develop, construct, maintain, and operate a truck terminal
on the subject property. The CUP includes requirements related to site layout, designated parking areas,
outdoor storage areas, lighting, landscaping, and compliance with all applicable local, state, and federal
agency standards. The CUP also requires compliance with approved site and building plans, limits
commercial vehicle parking to marked areas, restricts employee parking to the northern lot, and
includes performance standards to mitigate noise, emissions, and nuisances.
The CUP issued for the subject property in 2021is provided as an attachment to this report.
CUP Amendment Overview
According to the applicant, the expansion request is driven by an increase in freight processing at the
truck terminal, due to regional consolidation to CentĻƩǝźƌƌĻƭ ƒƚķĻƩƓ ğƓķ ĭĻƓƷƩğƌƌǤ ƌƚĭğƷĻķ ŅğĭźƌźƷǤ͵ ŷĻ
applicant does not anticipate an increase in vehicle or truck traffic, but states that the objective of the
project is to increase freight layout space to improve operational efficiency for existing truck deliveries
within the terminal.
The proposal includes plans to construct a 16,560 sq. ft. additionto the existing 55,000 sq. ft. industrial
facility. The expansion would also include additionalsurface parking stalls anddocks at the truck
terminal, landscaping improvements, and a new outdoor amenity area.
The existing CUP regulates standards related to land use, zoning, and site design. Any building expansion
or layout changes require a formal CUP amendment. The Planning Commission may recommend
changesor additions to the conditions of approval to ensure consistency with zoning and CUP
requirements.

Site Design
Landscaping and Screening
Sec. 156.040(G) creates requirements for green space and landscaping. The project plans are consistent
with the landscaping and screening approved for the first phase of the project on this site. Outside of
grass lawn areawhere the building expansion is located, nolandscaping or green spaces are proposed
for removal. Trees that may be impacted by construction will be moved or replaced.No additional
screening appears to be necessary on the site as existing plantings and site design were planned for this
expansion.
Storage
At present,60 stalls are provided for on-sitestorage of trailers, with 30trailer stallsfound on either side
of the existing building. The design proposes an additional32 trailer storage stallscontinuing south
along either side of the building.The use of these stalls is considered incidental to the principal use.
Parkingand Loading
There are currently 93surface parking stalls (including 4 ADAspaces) along the north property boundary
abutting Fairview St. An additional 13 stalls will be provided with the expansion, providing atotal of 106
stalls. When taken with the trailer storage stalls, there are 198 spaces available on site. This is consistent

note that typical vehicle parking stalls are 9 ft by 20 ft in size. Trailer storage stalls appear to be roughly
10 ft by 60 ft in size.
Section 156.040(L) requires that loading facilities be located on the side of rear yards and adequately
screened from adjacent public streets.This expansion is consistent with that standard.
The applicant stated that there are at least four designated areas for snow storage during the winter.
The terminal manager is responsible for maintaining parking and drive areas and contracting with snow
haulers when necessary.In winter months, snow storage appears to be partly in the building expansion
area. With more impervious area, Staff expectsnow storage be managed by the property owner such
that the site can still meet applicable parking requirements. Staff propose a condition that snow storage
cannot take place in anypublic rights of way and snow piles may take up no more than 10 percent of the
required parking on site.
Access,Circulation, and Traffic
st
There are several access points including two driveways on the east property frontage on21Ave S and
a driveway on the north frontage fromFairview St.No changes are proposed to current access locations.
The design proposes concrete paving throughout expansion areas, including the replacement of some
existing curb and pavement. Sidewalks are 4 ft in width.
Per the applicant, traffic is not expected to increase meaningfully as a result of the expansion. The
expansion is primarily intended to increase the indoor freight laydown space.

Lighting
An electrical plan was submitted with the application as part of the interior improvements. New lighting
is not proposed on site outside of what is affixed to the new building. is required to be downcast, cutoff
type fixtures that do not produce glare onto adjacent properties.
Signage
The Centerville City Code allows a ground or monument sign up to 200 sq ft, maximum 15 ft in height,
and setback at least 15 ft from property lines. Wall signs are allowed up to 10% of the wall surface area.
There is currently a wall sign shown above the office entrance in the plans, but a signage plan was not
submitted. If new signage is proposed on site, a sign plan and permit will be required.
Fencing
Fencing is proposed and allowed as an encroachment on setbacks along property lines. Plans for fencing
must be approved by the City Council. Thesubmitted ALTA survey notes that fences currently lie on or
ƓĻğƩ ƦƩƚƦĻƩƷǤ ƌźƓĻƭ ΛǞźƷŷźƓ Љ͵Џ ƚŅ ƭƚǒƷŷ ĬƚǒƓķğƩǤΜ͵ It is the responsibility of the property owner to
maintain the fence and ensure it is located on or within property lines.
Outdoor Amenity Area
There is a proposed outdoor amenity area which
includes a pavilion structure with tables and seating.
The pavilion structure wouldhave a peak height of
13 feet, which is below the maximum height of 15 ft
for accessory structures.The pavilion area as
proposed is approximately 24 by 30 feet.
The applicant provided an example photograph but
noted that the color has not been finalized yetand
will match the principal structure. Given what was
proposed, Staff find the accessory structure to be of
similar type and appearance as the principal
structure, as required by Sec. 156.040(H) and the
CUP.

review comments are provided as an attachment to this report.
Key comments are summarized as follows:
The proposed building and parking expansions are not expected to impact traffic on adjacent
City streets; however, if construction activities affect public roadways, a Traffic Control Plan and
City approval will be required prior to disturbance.
The project is required to comply with the Stormwater Pollution Prevention Plan (SWPPP), and
the applicant must submit a copy of the NPDES Construction Permit to the City prior to the start
of construction.

Apermit will be required bythe RCWD prior to construction beginning on site. The applicant is required
to coordinate as needed.
Findings for Approval
CUP Standards
City Code Sec. 156.320(B) outlines the standards and conditions for conditional uses as follows:
(1)A Conditional Use Permit may be granted for the following uses only:
a.Any use specifically listed as a Conditional Use in the regulations applicable to the
district in which it is to be located or otherwise stated in this Chapter to be a conditional
use;
b.Any use which is the same or similar, and consistent with, a conditional use specified in
the use district, the Planning Commission may consider and allow such conditional use.
(2)A Conditional Use Permit shall be granted only if evidence is presented to establish:
a.That the proposed building or use at the particular location requested is necessary or
desirable to provide a service or a facility which is in the interest of the public
convenience and will contribute to the general welfare of the neighborhood or city;
b.That the proposed building or use will not have a substantial or undue adverse effect
upon adjacent property, the character of the neighborhood, traffic conditions, utility
facilities and other matters affecting the public health, safety and general welfare; and
c.That the proposed building or use will be designed, arranged and operated so as to
permit the development and use of neighboring property in accordance with the
applicable district regulations.
CUPAmendment and Site Plan Approval Findings
Staff suggest the following regarding the CUP Amendmentand Site Plan Reviewrequests:
1.That the applicant has submitted requests to the City of Centerville for a Conditional Use Permit
(CUP) Amendmentand site plan reviewin accordance with the procedures as established by

5.The proposed use by the Landowner provides for reasonable and adequate parking,
landscaping, building design, lighting, screening of outdoor parking and storage, and other
issues; and
6.The project as proposed meets the criteria for granting a Site Plan Review approval in Section
156.108 of the Zoning Code and a Conditional Use Permit in Section 156.320 of the Zoning Code;
and
7.That the proposed CUP Amendmentand Site Plan Reviewisconsistent with the overall goals
and objectives of the Centerville Comprehensive Plan.
CUP Amendment Conditions
Staff recommend the following conditions of approval for a CUP Amendment:
1.All conditions established inthe CUP for a Truck Terminal use as approved by the City of
Centerville on October 27, 2021 for the subject property shall remain in complete effect.
2.Property Owner shall revise the project plansand provide any additional informationas
required by the City Engineering Memo dated March 25, 2026, as may be amended, prior to
issuance of a building permit for the improvements.
3.Property Owner shall construct and maintain the Subject Property and improvements contained
thereon in accordance with the approved plans, which are attached to this report, and hereby
incorporated as conditions of this Permit.
4.Snow storage cannot take place in any public rights-of-way,and snow piles may take up no
more than 10 percent of the required parking on site.
5.The Landowner is responsible for all of the conditions set forth in this Permit.
6.In addition to all civil penalties and remedies for violation of this Permit, violation of this permit
is a misdemeanor criminal offense.

We have reviewed the site plan dated December 12, 2025 and received March 6, 2026 for the proposed

building and parking lot expansion for the Sutton Transport facility located at 6855 21 Avenue South. The
following are our initial engineering comments for the proposed expansion:
Comments
General
1. It does not appear that the proposed improvements will impact traffic on the adjacent city streets. If
this were to change, the applicant shall prepare a Traffic Control Plan and obtain City approval prior
to any impacts to local roadways.
2. Final approval by the Rice Creek Watershed District must be attained before any site grading or
activity may commence.
Erosion Control/SWPPP
1. Compliance with the SWPPP shall be required for construction. Application shall submit a copy of
the NPDES Construction permit to the City prior to the start of construction activities.
Site Plan
1. The plans should clarify where the standard duty and heavy duty bituminous pavement sections
shall be used.
2. Applicant shall confirm that the proposed concrete pavement section matches the existing concrete
pavement section.

Grading/Stormwater
1. It appears that the existing contours shown on Sheet C2 do not match the existing contours shown
on Sheet C5. Plans should be updated accordingly. The existing grading should reflect as-built
conditions.
2. It appears that the proposed improvements will disturb slightly more than 1 acre and create
additional impervious area. The application shall obtain a permit from the watershed for the
proposed improvements and provide a copy of the permit to the city prior to approval.
3. A stormwater management plan shall be provided to confirm that stormwater management is in
accordance with City of Centerville and Rice Creek Watershed District Standards.
a. If the proposed expansion was accounted for under the stormwater management plan
submitted with the initial development, please submit that plan to the City for review.
4. All walls higher than 4Ó shall be designed by a certified engineer and the design and certification of
those walls shall be provided to the city.
Other Comments
1. The applicant shall provide the City a detailed work schedule. The City shall be provided at least
48 hours notice prior to any work commencing, including grading and utility work.

City Planner Nathan Fuerst reviewed the staff report, noting that this is a request for a conditional
use permit to allow flexibility with parking. The property is in the B-1 Commercial district, and the
building is more industrial in nature. The use for this space is retail, primarily online, with a store
front. Parking standards for the site require 72 stalls, and the applicant only needs 28 spaces for the
proposed use, based on using 2,872 sq. ft. of the 12,000-sq. ft space. The bulk of the building will
be used for warehousing, so staff are comfortable with fewer parking stalls. A condition of approval
is site improvements to the existing parking lot.

Discussion ensued about the size of the parking stalls, striping and drainage. City Planner Fuerst
noted that site improvements to the existing parking lot would be completed in coordination with
our city engineer.
Lukas Peters, the property owner, introduced himself to the Commission and confirmed that
everything that was presented is accurate.
Kale Haluptzok, the buyer, introduced himself and spoke about their current operations.
The public meeting was opened and there were no public comments.

CUP Amendment Findings
Staff recommend the following findings supporting approval of the CUP:
1. That the applicant has submitted requests to the City of Centerville for a Conditional Use
Permit (CUP) in accordance with the procedures established by CentervilleÓs City Code; and
2. A Conditional Use Permit is required under City Code Section 156.166 (E) for property
owners to receive flexibility to the number of required parking stalls in City Code; and
3. That the request for flexibility is consistent with the overall goals and objectives of the
Centerville Comprehensive Plan; and
4. That the proposed flexibility is necessary to reasonably establish a new commercial retail
use on the property, and the use is expected to contribute to the general welfare of the City;
and
5. That the request would allow for flexibility to parking standards which will not have a
substantial or undue adverse effect on adjacent property, the character of the surrounding
neighborhood and the general health, safety, and welfare of the City; and
6. That the proposed flexibility, with conditions as imposed by the City, will allow for
establishment of a retail use which is arranged and operated in accordance with applicable
regulations.
CUP Conditions
Staff recommend the following conditions of approval for the CUP:
1. This Conditional Use Permit is intended to allow flexibility to the standards for retail uses
only. Should another use requiring flexibility to the parking code be proposed, an
amendment to the CUP is required.
2. The Retail use may include a maximum of 30% of the floor area for walk in customer sales.
If a higher amount of floor area is desired for walk in sales, an amendment to the CUP is
required.
Discussion ensued about what would happen if the business wanted to expand. City Planner Fuerst
noted that if they wanted to have more walk-in sales, they could amend their CUP. The proposed
CUP is based on 30% of gross retail floor space for walk in business.
The Commission is in favor of recommending that council approve the CUP, along with the findings
