AWARDS, PRESENTATIONS, APPEARANCES 1. 7075 21st Avenue – Conditional Use Permit City Planner Nathan Fuerst reviewed the staff report, noting that this is a request for a conditional use permit to allow flexibility with parking. The property is in the B-1 Commercial district, and the building is more industrial in nature. The use for this space is retail, primarily online, with a store front. Parking standards for the site require 72 stalls, and the applicant only needs 28 spaces for the proposed use, based on using 2,872 sq. ft. of the 12,000-sq. ft space. The bulk of the building will be used for warehousing, so staff are comfortable with fewer parking stalls. A condition of approval is site improvements to the existing parking lot. Approved City of Centerville Planning and Zoning Commission April 7, 2026 Page 2 of 4 Discussion ensued about the size of the parking stalls, striping and drainage. City Planner Fuerst noted that site improvements to the existing parking lot would be completed in coordination with our city engineer. Kale Haluptzok, the buyer, introduced himself and spoke about their current operations. The public meeting was opened and there were no public comments. The public meeting was closed. NEW BUSINESS 1. 7075 21st Avenue – Conditional Use Permit Administrator Lewis introduced this item, noting that discussion ensued during the public hearing portion of the meeting. City Planner Fuerst reviewed the findings of fact and conditions for the CUP. These are listed in the staff report; an excerpt from the staff report is shown below: Findings for Approval - CUP Standards City Code Sec. 156.320(B) outlines the standards and conditions for conditional uses as follows: (1) A Conditional Use Permit may be granted for the following uses only: a. Any use specifically listed as a Conditional Use in the regulations applicable to the district in which it is to be located or otherwise stated in this Chapter to be a conditional use; b. Any use which is the same or similar, and consistent with, a conditional use specified in the use district, the Planning Commission may consider and allow such conditional use. (2) A Conditional Use Permit shall be granted only if evidence is presented to establish: a. That the proposed building or use at the particular location requested is necessary or desirable to provide a service or a facility which is in the interest of the public convenience and will contribute to the general welfare of the neighborhood or city; b. That the proposed building or use will not have a substantial or undue adverse effect upon adjacent property, the character of the neighborhood, traffic conditions, utility facilities and other matters affecting the public health, safety and general welfare; and c. That the proposed building or use will be designed, arranged and operated so as to permit the development and use of neighboring property in accordance with the applicable district regulations. City of Centerville Planning and Zoning Commission April 7, 2026 Page 3 of 4 CUP Amendment Findings Staff recommend the following findings supporting approval of the CUP: 1. That the applicant has submitted requests to the City of Centerville for a Conditional Use Permit (CUP) in accordance with the procedures established by Centerville’s City Code; and 2. A Conditional Use Permit is required under City Code Section 156.166 (E) for property owners to receive flexibility to the number of required parking stalls in City Code; and 3. That the request for flexibility is consistent with the overall goals and objectives of the Centerville Comprehensive Plan; and 4. That the proposed flexibility is necessary to reasonably establish a new commercial retail use on the property, and the use is expected to contribute to the general welfare of the City; and 5. That the request would allow for flexibility to parking standards which will not have a substantial or undue adverse effect on adjacent property, the character of the surrounding neighborhood and the general health, safety, and welfare of the City; and 6. That the proposed flexibility, with conditions as imposed by the City, will allow for establishment of a retail use which is arranged and operated in accordance with applicable regulations. CUP Conditions Staff recommend the following conditions of approval for the CUP: 1. This Conditional Use Permit is intended to allow flexibility to the standards for retail uses only. Should another use requiring flexibility to the parking code be proposed, an amendment to the CUP is required. 2. The Retail use may include a maximum of 30% of the floor area for walk in customer sales. If a higher amount of floor area is desired for walk in sales, an amendment to the CUP is required. Discussion ensued about what would happen if the business wanted to expand. City Planner Fuerst noted that if they wanted to have more walk -in sales, they could amend their CUP. The proposed CUP is based on 30% of gross retail floor space for walk in business. The Commission is in favor of recommending that council approve the CUP, along with the findings of fact and conditions. Motion by Commissioner Thompson, seconded by Commissioner Seppala, to recommend the Council approve the request by FSG properties, LLC for a conditional use permit amendment allowing flexibility to parking standards with the findings and conditions proposed by staff. All in favor. Motion carried. VIII. APPROVAL OF MINUTES 1. April 7, 2026, Planning and Zoning Commission Meeting Administrator Lewis introduced this item as presented in the packet.
