Centerville Townoffice Park Second Addition
Sedona T ownhomes, LLC, developer and builder of the Centerville
Office Park, 7029 20th A venue, proposes to build on Outlot A, the
open area on the south end of the office park, a three story office
building. The building footprint would be 9,920 square feet, for a
total of29,790 square feet, and 149 parking stalls would be
available for the building. The open space surrounding the
building and parking would be landscaped with maple, ash, spruce
trees, flowering crab apple trees, Japanese tree lilacs, and vibumam
alfredos. Further, the landscaping in the center island of the
parking lot would include tables and benches. On the south end of
the new building there would be a large open patio with tables and
chairs for outdoor meals and socializing.
The exterior of the building would be concrete panels with
decorative colors, many windows, and architectural detailing
which would accent the entry, comers and rooflines.
As part of 20th A venue reconstruction by Anoka County, a new
turn lane will be installed at the site entrance. As traffic enters the
office park the flow will be into the center of the parking lot and
disbursed around and in front of the buildings. It is expected that
the people coming to work would arrive during a one-hour time
frame in the morning, and leave with a similar disbursal.
The building setbacks from lot lines, roadways, neighboring
houses and businesses are quite adequate. There is much open
space created by Clearwater Creek on the south and west, the
office park retainage ponds on the west, the new city commercial
park on the east, and City Public Works on the north. Spruce trees
on the west will create an effective buffer between the new
building and the neighboring houses.
Site work and construction would commence once approvals are
obtained. The building would be ready for occupancy in the
summer of2007. Sedona Townhomes LLC requests your
recommendation for approval for this exciting project.

A variance is a use that is not generally permitted by the City's zoning ordinances but which is
allowed in special cases only. A request for a variance from the City's zoning ordinances will be
granted upon a showing of undue hardship by a property owner who is determined to have a unique
situation. "Undue hardship" means that the property cannot be put to a reasonable use if the
conditions of the zoning ordinances are followed, that the property owner's particular circumstances
are unique and not self-created, and that granting a variance will not alter the essential character of
the locality or neighborhood. Economic hardship alone will not constitute undue hardship if some
reasonable use currently exists under the terms of the City's zoning ordinance. If the property
owner purchased the property knowing that the City's zoning ordinances prohibited a use, the
property owner's circumstances are self-created.

Minnesota Statutes (MS 462.357, Subd. 6) and City Ordinances (OIlk-#4, Di ,i:siUH-l-&B-) require that
the following conditions must be satisfied for approval of this request. Please respond to these
conditions using additional sheets of paper if necessary.
I. Because of the particular physical surroundings, shape or topographical
conditions of the parcel or lot, the proposed variance would relieve an undue
hardship, as distinguished from a mere inconvenience, should the applicable
ordinance be strictly enforced.
2. The purpose of the proposed variance is not based exclusively upon a desire to
increase the value or income potential of the parcel of land, but would correct
extraordinary circumstances applicable to this property but not applicable to other
property in the vicinity or zoning district.
Centerville Townoffice Park Second Addition
Sedona Townhomes LLC requests a height variance for the three-story office building to
be built at the Centerville Office Park. The request is due to the soil conditions pre-
existing on the site, which includes a high water table. This determines the ordinary high
water elevation and the building lowest floor elevation is limited. In order to build a
three-story structure and comply with proper drainage, the ordinance limit is exceeded by
7' on most ofthe building and 11' on the front comer. The use of the variance would
allow the building to get built as designed.
The use of the site with a three-story office building is consistent with the zoning uses
and has significant setbacks on all four sides. On the west, the boundary is 155 feet from
the building. The use of 6' to 7' tall spruce trees, fifteen feet apart in a staggered row
(refer to the landscape plan exhibit for placement) in addition to Clearwater Creek, will
effectively screen the building from the neighborhood houses. The south boundary is
over 200 feet to the commercial business, on the west is the boundary of 20th ave. at 89
feet, and on the north is the Centerville Office Park, to the north of that is Centerville
Public Works building and City water tower.
3. The alleged difficulty or hardship is caused by the City Ordinance and has not
been created by any persons presently having an interest in the parcel of land.
4. The variance will not adversely affect public health, welfare and safety and will
not be detrimental or injurious to property or improvements in the neighborhood.
5. Variances will not be granted that allow a use that is otherwise not a permitted use
in the zoning district that the subject property is located.

ApPLICANTS, PLEASE NOTE:
All developers or property owners must submit the following information to the City of
Centerville by the Tuesday that is 30 days PRIOR to the meeting of the Planning and Zoning
Commission or the City Council meeting at which the request will be heard at a public hearing.
I. Complete the application for the specific request and pay the fee.
2. Submit a complete survey and site plans (including measurements, dimensions),
showing lot lines and building footprint, driveways, sidewalks, curb cuts, ingress,
egress, etc. on the property and its relation to adjacent properties.
3. Explanation of materials that will be used and plans for screening, landscaping,
fencing and dumpster enclosures.
4. Drawings of completed buildings, if appropriate to the project, and materials used.
5. Storm water retention and drainage plans. The Rice Creek Watershed District
and/or other water management organizations may need to be notified of the
project.
6. A letter explaining the reason for the variance request. The letter must also
demonstrate the variance will not impact the surrounding properties nor impact
the characteristic of the neighborhood in any manner.

scheduled meeting on September 5, 2006, at 6:30 p. m.

City Administrator Larson recommended delaying this item to allow time to resolve
outstanding issues.
Chair Hanson indicated he would like the City to discuss rezoning with Comfort Heating.

v. NEW BUSINESS
1. Review Proposed Site Plan - Sedona Homes
Mr. Barasa from MFRA Engineering appeared before the Commission on behalf of
Sedona Homes and provided an overview of the replat of Centerville Office Plaza to add
a 10,000 square foot footprint building with three floors for a total of 30,000 square feet
of additional office space.
Mr. Barasa indicated that they can meet all of the City's requirements with this plan but
noted that they would like to exceed the 35 foot height requirement.
City Administrator Larson indicated that granting a CUP for height requires one foot
additional setback on all sides for every foot of additional height.
The Architect indicated that they are looking at a minimum of 38 feet with a little bit
more height at the front entrance.
Chair Hanson asked what the setbacks are as proposed.
Mr. Barasa indicated that the setback is 70 feet or so. Mr. Barasa indicated that they meet
all requirements other than height.
City Administrator Larson asked the Developer to explain how they intend to handle
separation within the site.
Mr. Barasa explained that the owner would work with the City on signage and is willing
to address it in the Developer's Agreement. He then said that there will be staggered
hours to eliminate some congestion on the site.
Commissioner Love asked if the City should require more than one access point for
emergencies and to alleviate congestion on the site.
Mr. Barasa explained that due to the constraints on the site it is not possible to have
another entrance/exit. He then explained that Anoka County would most likely not allow
a second access due to their minimum spacing requirements.
Commissioner Klennert Hunt indicated that secondary access was discussed for this site
previously but there did not seem to be a way to do it.
Chair Hanson suggested a right in, right out to alleviate traffic congestion.
Commissioner Pangell asked whether this would be one tenant or more than one.

The Developer indicated that they are in negotiations and not at liberty to discuss their
tenant at this time.
City Administrator Larson suggested discussing a second access that lines up with the
access across the street with Anoka County to see if they would be willing to consider it.
Commissioner Hanzal asked when final plans would be brought to the City for
consideration.
The Developer indicated that they would like to be ready to go for next month.
City Administrator Larson explained that the CUP would require a public hearing. He
then asked for an explanation of the proposed subdivision for the site.
Mr. Barasa explained the subdivision plans and noted it would take legal and survey
work to accomplish.
The Commission, Staff and the Developer discussed setting the public hearing for next
month.
Commissioner Hanzal indicated that he would be concerned about doing so without
further information on the actual height being requested and the setback information.
Commissioner Klennert Hunt indicated that she would like police and fire to review the
plan.
City Administrator Larson indicated that Rice Creek Watershed District would need to
review the plans. He then suggested that the Developer look into whether the entire site
was approved with the first phase because that may save time with this portion of the site.
Commissioner Hanzal indicated that he would prefer to wait to schedule the public
hearing until all the information is available for review.
The Commission agreed noting that some of the required information was dependent
upon other agencies and they may not be able to meet a tight time requirement.
City Administrator Larson indicated that Staff would require a proposed plat with the site
laid out exactly as proposed.
Commissioner Hanzal recommended that the Developer ask Rice Creek whether an
administrative approval would be possible for this project rather than full board review.

City Administrator Larson indicated that this matter would not require a public hearing
and noted that the Commission could forward this directly to Council with a
recommendation.
City Administrator Larson reviewed and explained the proposed change to allow area
identification signs in residential areas as the Code does not currently do so.
Chair Hanson indicated he would like to change the size of the sign to 48 x 8 as is
allowed for institutional signs.
The Commission and Staff discussed the size of the sign and the Commission agreed to
the 48 x 8 size.
Motion by Commissioner Hanzal. seconded by Commissioner Pan2ell. to
recommend Council approval of the Amendment to Chapter 152 as amended to
48x8. All in favor. Motion carried.
VI. DISCUSSION ITEMS
The Homeowner at 6817 Grouse Hollow appeared before the Commission and indicated
that he would like the City to consider granting him a variance to construct a garage/shed
in his yard. He then explained that a variance would be needed as most of his yard is in a
drainage easement.
Staff and the Commission explained that the City would require that the homeowner pay
for the City Engineer to conduct a study to determine whether it would be possible to
reduce the size of the easement to allow for the construction of the garage/shed. The
Homeowner agreed to contact Staff to discuss the matter.
City Administrator Larson informed the Commission of the upcoming Council work
sessions to discuss downtown redevelopment and indicated that Commissioners are
welcome to attend.

I. August L 2006 Planning and Zoning Meeting Minutes
Motion by Commissioner Pan2ell. seconded by Commissioner Wood to approve the
Minutes of AU2ust 1.2006. as presented. All in favor. Motion carried unanimously.
