To also consider the re-platting of the parcel from townhome-like office buildings previously passed by Council and consider the proposed construction of one (1), three (3) story, 29,760 square foot Commercial building instead. The building footprint would be 9,920 square feet, for a total of 29,790 square feet, and 149 parking stalls would be available for the building. The open space surrounding the building and parking would be landscaped with maple, ash, spruce trees, flowering crab apple trees, Japanese tree lilacs, and viburnam alfredos. Further, the landscaping in the center island of the parking lot would include tables and benches. On the south end of the new building there would be a large open patio with tables and chairs for outdoor meals and socializing. The exterior of the building would be concrete panels with decorative colors, many windows, and architectural detailing which would accent the entry, comers and rooflines. As part of 20th Avenue reconstruction by Anoka County, a new turn lane will be installed at the site entrance. As traffic enters the office park the flow will be into the center of the parking lot and disbursed around and in front of the buildings. It is expected that the people coming to work would arrive during a one-hour time frame in the morning, and leave with a similar disbursal. The building setbacks from lot lines, roadways, neighboring houses and businesses are quite adequate. There is much open space created by Clearwater Creek on the south and west, the office park retainage ponds on the west, the new city commercial park on the east, and City Public Works on the north. Spruce trees on the west will create an effective buffer between the new building and the neighboring houses. Site work and construction would commence once approvals are obtained. The building would be ready for occupancy in the summer of 2007. A request for a variance from the City's zoning ordinances will be granted upon a showing of undue hardship by a property owner who is determined to have a unique situation. "Undue hardship" means that the property cannot be put to a reasonable use if the conditions of the zoning ordinances are followed, that the property owner's particular circumstances are unique and not self-created, and that granting a variance will not alter the essential character of the locality or neighborhood. Economic hardship alone will not constitute undue hardship if some reasonable use currently exists under the terms of the City's zoning ordinance. If the property owner purchased the property knowing that the City's zoning ordinances prohibited a use, the property owner's circumstances are self-created. {!},dI'/~r /.5lJ Minnesota Statutes (MS 462.357, Subd. 6) and City Ordinances (Ol~, Di.i:siun 18&) require that the following conditions must be satisfied for approval of this request. Please respond to these conditions using additional sheets of paper if necessary. 1. Because of the particular physical surroundings, shape or topographical conditions of the parcel or lot, the proposed variance would relieve an undue hardship, as distinguished from a mere inconvenience, should the applicable ordinance be strictly enforced. 2. The purpose of the proposed variance is not based exclusively upon a desire to increase the value or income potential of the parcel of land, but would correct extraordinary circumstances applicable to this property but not applicable to other property in the vicinity or zoning district. Centerville Townoffice Park Second Addition Sedona T ownhomes LLC requests a height variance for the three-story office building to be built at the Centerville Office Park. The request is due to the soil conditions pre- existing on the site, which includes a high water table. This determines the ordinary high water elevation and the building lowest floor elevation is limited. In order to build a three-story structure and comply with proper drainage, the ordinance limit is exceeded by 7' on most ofthe building and 11' on the front comer. The use of the variance would allow the building to get built as designed. The use of the site with a three-story office building is consistent with the zoning uses and has significant setbacks on all four sides. On the west, the boundary is 155 feet from the building. The use of 6' to 7' tall spruce trees, fifteen feet apart in a staggered row (refer to the landscape plan exhibit for placement) in addition to Clearwater Creek, will effectively screen the building from the neighborhood houses. The south boundary is over 200 feet to the commercial business, on the west is the boundary of 20th ave. at 89 feet, and on the north is the Centerville Office Park, to the north of that is Centerville Public Works building and City water tower. 3. The alleged difficulty or hardship is caused by the City Ordinance and has not been created by any persons presently having an interest in the parcel of land. 4. The variance will not adversely affect public health, welfare and safety and will not be detrimental or injurious to property or improvements in the neighborhood. 5 . Variances will not be granted that allow a use that is otherwise not a permitted use in the zoning district that the subject property is located. Complete the application for the specific request and pay the fee. 2. Submit a complete survey and site plans (including measurements, dimensions), showing lot lines and building footprint, driveways, sidewalks, curb cuts, ingress, egress, etc. on the property and its relation to adjacent properties. 3. Explanation of materials that will be used and plans for screening, landscaping, fencing and dumpster enclosures. 4. Drawings of completed buildings, if appropriate to the project, and materials used. 5. Storm water retention and drainage plans. The Rice Creek Watershed District and/or other water management organizations may need to be notified of the project. 6. A letter explaining the reason for the variance request. Sedona Homes - Preliminary Site Plan & Variance Request City Administrator Larson explained that this is not a variance request but a CUP as additional height is permitted by conditional use. Mr. Keleher of Sedona Homes presented the Concept Plan for their three-story office building. Page 1 of5 City ofCenterville PImming & Zoning Meeting Minutes October 3, 2006 Mr. Barasa provided an engineering overview of the Concept Plan for the three-story office building. City Administrator Larson asked the dimension from curb to curb in the parking area. Mr. Barasa explained that the standard is 9 x 18 and their stalls are a little bit deeper and they are aiming for 26 feet wide. He then explained that they went a little bigger than code requirements to give a little more room. Commissioner Wood asked if the developer has considered making it a one way around the main office building to have them come in from the west side and loop around and turn right to exit. Mr. Barasa indicated that they had considered that but in the end they felt that for ease of traffic flow the two-way traffic would provide a better and safer way to move traffic on the site. Chair Hanson asked why two-way traffic would be safer than one-way traffic. Mr. Barasa indicated that whenever there is perpendicular parking to the driveway it is safest for line of sight. Commissioner Love asked if the County gave any feedback as to why they did not feel that two entrances would be allowed. City Administrator Larson indicated that no information or explanation was given but Staff speculates that the reason is due to entrance spacing onto the County road. Mr. Barasa indicated that they did discuss a right in right out for the second entrance but the County was not interested in allowing a second entrance. City Administrator Larson asked why the entire tract is not a single lot with one building and why is the open space under a separate legal description. Mr. Keleher indicated that he would need to discuss that with the surveyor. Mr. Barasa indicated that the surveyor can change it but the surveyor said that it is the cleanest and simplest way to move forward with this plat. Chair Hanson indicated that you cannot build in drainage easements without approval from the City so anytime you modify anything you would need to come back to the City for approvals. City Administrator Larson commented that if there are not multiple owners there is no need for the other property to make it a separate lot. Page 2 of 5 City ofCenterville Plaooiog &. Zoning Meeting Minutes October 3, 2006 Chair Hanson asked whether it is against Code to have the separate outlot completely land locked. Mr. Barasa agreed to go back to the surveyor to have the plat amended to combine Lots 1 and 2. Chair Hanson asked whether it would be possible to have a double lane access with left and right turn lanes for better traffic flow. Mr. Barasa said that is what they are planning to do is a three lane entrance. Commissioner Pangell asked whether the buffer zone has to have a compact screen wall and whether it has to be a fence or can be vegetation. Commissioner Wood asked how tall the buffer trees are planned to be. The landscaper indicated that the evergreens against the west wall will range from 7 to 9 feet because of the terrain because they cannot get the very large tree spades into those areas. The Architect provided an overview of the architecture of the building and location of the existing buildings on the site. He then noted that the building height will be 42 feet, which is 7 feet higher than allowed, and then another four feet in the front for an additional 11 feet. Commissioner Klennert Hunt asked about a garbage enclosure. The Architect indicated they have not addressed it but win add one to the plan. Chair Hanson asked whether this building needs its own hydrant or if there is one already existing. Mr. Barasa indicated that there are two hydrants shown on either end of the building. Commissioner Hanzal asked whether there would be any signs on the exterior of the building. Mr. Keleher indicated he is not contemplating one at this time. Chair Hanson asked if there is lighting on top of the building shining down on the parking lot. Mr. Barasa explained that there would be street lights on the ends of the island and the back comers of the lot with downcast lighting. The Architect indicated there would be decorative lighting on the front near the entrance. Comprehensive Plan Review City Administrator Larson suggested reviewing the goals and objectives and policies rather than a full revision since the City does not have much in the way of undeveloped land. He then explained that the City would not have a Planner on board until the first of the year and there would be a lot of work for that person to do to ensure that the Metropolitan Council requirements are met. Commissioner Pangell asked when this deadline is. City Administrator Larson indicated the deadline is near the end of 2008. Chair Hanson indicated that he would like to look at rezoning property along Main Street to commercial as well as property along 20th Avenue to commercial. The Commission and Staff discussed rezoning property along 20th Avenue and agreed to consider rezoning the property north of the creek to commercial. Commissioner Klennert Hunt said that she would like to find out what is going on across the border in Lino Lakes to match it and make it attractive to locate in Centerville. City Administrator Larson asked the Commission to review and bring forward any goals, objectives or priorities that should be removed or updated. v. NEW BUSINESS 1.
