~ 154.110 FENCES.
(A) Generalregulation~
(I) All fences shall be located entirely upon the property of the fence owner unless the ~ner
of the adjoining property agrees, in writing, that the fence may be erected on the property line of the
respective properties. This agreement shall be submitted at the time of building permit application. If
the adjoining property owner does not agree to the erection of the fence, the fence shall be set back a
minimum of two feet from all lot lines. No fence other than a decorative fetice may be constructed
along the side lot lines of a residential lot between the street and the front extension of the dwelling
house. As used herein, the term DECORATIVE FENCE means a wood vertical post and wood
horizontal rail fence with no more than three rails or a wood picket type fence with at least two inches
of open space between each picket.

(2) No residential fence may exceed six feet in height and no decorative fence in the front
yard may exceed 36 inches in height. Fencing in commercial/industrial zoning shall not exceed eight
feet in height.
(3) All fences shall be constructed and maintainediri a substanti~ workmanlike manner and
of material reasonably suited for the purpose for which the fence is proposed to be used. Every fence
shall be constructed so that the side containing the framing supports and cross-pieces face the interior
of the fence owner's lot. Any fence which does not comply with the provisions of this section or which
endangers the public safety, health or welfare shall be considered a public nuisance.
(B) Snow-stop fencing. Snow-stop fencing may be used from November one to April I. No
permit shall be required for temporary fencing.
(C) Electric and barbed wire fence. Electric fences, hog wire fencing,-barbed-wire fencing and
similar fencing will not be allowed, except in the R-I District.
(D) Visual obstructions. No fence may be erected which creates visual obstructions at any
intersection, alley, driveway or street for safe vehicular, bicycle or pedestrian movement.
(E) Swimming pool fencing. No private swimming pool with a water depth exceeding 24 inches
may be allowed, unless enclosed by a permanent wall or fence not less than four feet in height with
self-closing door and self-closing latch.

~ 154.120 HEIGHT.
(A) Structures. No structures or building may be erected to a height exceeding 35 feet without
the issuance of a conditional use permit.
(B) Excess height on a building. Upon the securing of a conditional use permit any building may
be erected to a height exceeding that specified for the respective district, providedthe front, rear and
side yards shall be increased one foot for each one foot by which the building exceeds the height limit
established for that district.
(C) Additional yard setback shall not be required for a structure that is any of the following:
television and radio towers, church spires, belfries, monuments, tanks, water and fire towers, stage
towers and scenery lofts, cooling towers, ornamental towers and spires, chimneys, elevator bulkheads,
smokestacks, conveyors, flagpoles, silos, and air conditioning and heating units; and that no tower,
gable, spire or similar structure shall be used for sleeping or eating quarters, or for any commercial
purpose except one incidental to the permitted uses of the main building.

~ 154.130 YARDS.
(A) General requirements. The minimum depths of front yard, rear yard and side yard for each
district shall be as defined in the schedule of regulations and conform to the following additional
regulations:
(1) All structures, whether attached to the principal structure or not, and whether open or
enclosed, including porches, carports, balconies or platforms above normal grade level shall not project
into any minimum front, side or rear yard;
(2) Lots which abut on more than one street shall provide the required front yards along each
street for the principal structure. Side yard setbacks for an accessory structure will apply to the
frontage that is not considered to be the required front yard;

NOTICE IS HEREBY GIVEN, that the Planning and Zoning Commission of the City
of Centerville will be holding a public hearing to consider Sedona Townhomes, LLC's
request for a conditiomu use permit (to exceed City Code requirement not to exceed 35'
in height by 7' and 11', on most of the proposed building and entrance respectively). To
also consider the fe-platting of the parcel from townhome-like office buildings previously
passed by Council and consider the proposed construction of one (1), three (3) story,
29,760 square foot Commercial building instead. The meeting will be held on Tuesday,

CenterviUe Townoffice Park Second Addition
Sedona T ownhomes, LLC, developer and builder of the Centerville
Office Park, 7029 20th Avenue, proposes to build on Outlot A, the
open area on the south end of the office park, a three story office
building. The building footprint would be 9,920 square feet, for a
total of29,790 square feet, and 149 parking stalls would be
available for the building. The open space surrounding the
building and parking would be landscaped with maple, ash, spruce
trees, flowering crab apple trees, Japanese tree lilacs, and viburnam
alfredos. Further, the landscaping in the center island of the
parking lot would include tables and benches. On the south end of
the new building there would be a large open patio with tables and
chairs for outdoor meals and socializing.
The exterior of the building would be concrete panels with
decorative colors, many windows, and architectural detailing
which would accent the entry, corners and rooflines.
As part of 20th Avenue reconstruction by Anoka County, a new
turn lane will be installed at the site entrance. As traffic enters the
office park the flow will be into the center of the parking lot and
disbursed around and in front of the buildings. It is expected that
the people coming to work would arrive during a one-hour time
frame in the morning, and leave with a similar disbursal.
The building setbacks from lot lines, roadways, neighboring
houses and businesses are quite adequate. There is much open
space created by Clearwater Creek on the south and west, the
office park retainage ponds on the west, the new city commercial
park on the east, and City Public Works on the north. Spruce trees
on the west will create an effective buffer between the new
building and the neighboring houses.
Site work and construction would commence once approvals are
obtained. The building would be ready for occupancy in the
summer of2007. Sedona Townhomes LLC requests your
recommendation for approval for this exciting project.

A variance is a use that is not generally permitted by the City's zoning ordinances but which is
allowed in special cases only. A request for a variance from the City's zoning ordinances will be
granted upon a showing of undue hardship by a property owner who is determined to have a unique
situation. "Undue hardship" means that the property cannot be put to a reasonable use if the
conditions of the zoning ordinances are followed, that the property owner's particular circumstances
are unique and not self-created, and that granting a variance will not alter the essential character of
the locality or neighborhood. Economic hardship alone will not constitute undue hardship if some
reasonable use currently exists under the terms of the City's zoning ordinance. If the property
owner purchased the property knowing that the City's zoning ordinances prohibited a use, the
property owner's circumstances are self-created.

Minnesota Statutes (MS 462.357, Subd. 6) and City Ordinances (0.4--114, Di. i~iull 1 ae-) require that
the following conditions must be satisfied for approval of this request. Please respond to these
conditions using additional sheets of paper if necessary.
1. Because of the particular physical surroundings, shape or topographical
conditions of the parcel or lot, the proposed variance would relieve an undue
hardship, as distinguished from a mere inconvenience, should the applicable
ordinance be strictly enforced.
2. The purpose of the proposed variance is not based exclusively upon a desire to
increase the value or income potential of the parcel of land, but would correct
extraordinary circumstances applicable to this property but not applicable to other
property in the vicinity or zoning district.
Centerville Townoffice Park Second Addition
Sedona Townhomes LLC requests a height variance for the three-story office building to
be built at the Centerville Office Park. The request is due to the soil conditions pre-
existing on the site, which includes a high water table. This determines the ordinary high
water elevation and the building lowest floor elevation is limited. In order to build a
three-story structure and comply with proper drainage, the ordinance limit is exceeded by
7' on most of the building and 11' on the front comer. The use of the variance would
allow the building to get built as designed.
The use of the site with a three-story office building is consistent with the zoning uses
and has significant setbacks on all four sides. On the west, the boundary is 155 feet from
the building. The use of 6' to 7' tall spruce trees, fifteen feet apart in a staggered row
(refer to the landscape plan exhibit for placement) in addition to Clearwater Creek, will
effectively screen the building from the neighborhood houses. The south boundary is
over 200 feet to the commercial business, on the west is the boundary of 20th ave. at 89
feet, and on the north is the Centerville Office Park, to the north of that is Centerville
Public Works building and City water tower.
3. The alleged difficulty or hardship is caused by the City Ordinance and has not
been created by any persons presently having an interest in the parcel of land.
4. The variance will not adversely affect public health, welfare and safety and will
not be detrimental or injurious to property or improvements in the neighborhood.
5 . Variances will not be granted that allow a use that is otherwise not a permitted use
in the zoning district that the subj ect property is located.

All developers or property owners must submit the following information to the City of
Centerville by the Tuesday that is 30 days PRIOR to the meeting of the Planning and Zoning
Commission or the City Council meeting at which the request will be heard at a public hearing.
1. Complete the application for the specific request and pay the fee.
2. Submit a complete survey and site plans (including measurements, dimensions),
showing lot lines and building footprint, driveways, sidewalks, curb cuts, ingress,
egress, etc. on the property and its relation to adjacent properties.
3. Explanation of materials that will be used and plans for screening, landscaping,
fencing and dumpster enclosures.
4. Drawings of completed buildings, if appropriate to the project, and materials used.
5. Storm water retention and drainage plans. The Rice Creek Watershed District
and/or other water management organizations may need to be notified of the
project.
6. A letter explaining the reason for the variance request. The letter must also
demonstrate the variance will not impact the surrounding properties nor impact
the characteristic of the neighborhood in any manner.

1. Permit. Subject to the terms and conditions set forth herein, the City of Centerville
hereby grants approval of a use permit for:
Applicant: Launderville's Auto Repair. 7139 - 20th Avenue. Centerville,
Minnesota.
2. Property. The permit is for the following described property:

3. Background. On March 25, 1998. a Special Use Permit was issued to Performance
Auto to operate an auto-truck repair business at 7139 - 20th Avenue. Performance Auto
was a lessee of the building and on or about January 1. 2006, ceased operations at the
address. Current applicant, Launderville's Auto Repair has requested to operate a similar
business at the location, also as a lessee of the property. The Special Use Permit did not
impose any specific conditions on the operation of Performance Auto. even though the
location abuts a residential area. The Planning and Zoning Commission has
recommended that the applicant be allowed a transfer of the Special Use Permit on the
condition the operation would be reviewed in six months and if it is determined at that
time that conditions should be imposed on the permit to mitigate impacts on surrounding
residential areas. that pennit would either be rescinded or reissued with conditions.

A variance is a use that is not generally permitted by the City's zoning ordinances but which is
allowed in special cases only. A request for a variance from the City's zoning ordinances will be
granted upon a showing of undue hardship by a property owner who is determined to have a unique
situation. "Undue hardship" means that the property cannot be put to a reasonable use if the
conditions of the zoning ordinances are followed, that the property owner's particular circumstances
are unique and not self-created, and that granting a variance will not alter the essential character of
the locality or neighborhood. Economic hardship alone will not constitute undue hardship if some
reasonable use currently exists under the terms of the City's zoning ordinance. If the property
owner purchased the property knowing that the City's zoning ordinances prohibited a use, the
property owner's circumstances are self-created.
Minnesota Statutes (MS 462.357, Subd. 6) and City Code 154, Section 154.310 require that the
following conditions must be satisfied for approval of this request. Please respond to these
conditions using additional sheets of paper if necessary.
1. Because of the particular physical surroundings, shape or topographical
conditions of the parcel or lot, the proposed variance would relieve an undue
hardship, as distinguished from a mere inconvenience, should the applicable
ordinance be strictly enforced.
2. The purpose of the proposed variance is not based exclusively upon a desire to
increase the value or income potential of the parcel of land, but would correct
extraordinary circumstances applicable to this property but not applicable to other
property in the vicinity or zoning district.
3. The alleged difficulty or hardship is caused by the City Ordinance and has not
been created by any persons presently having an interest in the parcel of land.
4. The variance will not adversely affect public health, welfare and safety and will
not be detrimental or injurious to property or improvements in the neighborhood.
5. Variances will not be granted that allow a use that is otherwise not a permitted use
in the zoning district that the subject property is locat /)

All developers or property owners must submit the following information to the City of
Centerville by the Tuesday that is 30 days PRIOR to the meeting of the Planning and Zoning
Commission or the City Council meeting at which the request will be heard at a public hearing.
1. Complete the application for the specific request and pay the fee.
2. Submit a complete survey and site plans (including measurements, dimensions),
showing lot lines and building footprint, driveways, sidewalks, curb cuts, ingress,
egress, etc. on the property and its relation to adjacent properties.
3. Explanation of materials that will be used and plans for screening, landscaping,
fencing and dumpster enclosures.
4. Drawings of completed buildings, if appropriate to the project, and materials used.
5. Storm water retention and drainage plans. The Rice Creek Watershed District
and/or other water management organizations may need to be notified of the
project.
6. A letter explaining the reason for the variance request. The letter must also
demonstrate the variance will not impact the surrounding properties nor impact
the characteristic of the neighborhood in any manner.

1. Sedona Homes - Preliminary Plat & Conditional Use Permit Request
Chair Hanson opened the public hearing at 6:30 p.m.
Paul Keleher, Chief Manager for the project, explained the plans for the site. Mr.
Keleher stated that they plan for a 30,000 sq. ft. office building for a single tenant located
near the public works building. He explained that Brian Bourassa, from the engineering
fIrm, and Mike Thomas, from the architectural fIrm, were present to help answer
questions. He stated that their hope for this building is to bring people to town to use the
existing services such as gas stations, dry cleaners, and insurance agencies. He stated
that he feels this development will also stimulate other growth in the area. He explained
their landscaping plans to provide a buffer between their property and the surrounding
properties. He also reviewed the parking plans and security lighting plans. He stated that

there are 149 stalls designated for new building and 42 stalls dedicated for the existing
townhome buildings. He stated that the security lights will be downcast so the light will
not leave the site. He stated that their plans meet City ordinances.
Commission Wright asked for clarification of the parking stall location for the new
buildings.
Mr. Keleher stated that they will have an association which will address the cross
easements needed for the parking situation.
Commissioner Klennert Hunt confirmed that with the new building requirements, Lot 1
will not be short on their required parking.
Mr. Kelehner confirmed that Lot 1 will still meet their parking requirements per City
ordinance.
Mary Capra, 1810 Fox Run, asked if the building would be a 3 story brick building.
Mr. Keleher stated that it will be a 3 story building made with concrete tip up panels.
Mayor Capra asked if this material met with City ordinance requirements.
Mr. Larson stated that he believes concrete material does meet with the City ordinance
for allowed building materials.
Mayor Capra asked if this project had received Watershed approval and if the association
for this building would be separate from the existing townhomes. She stated that this is a
big difference from their original proposal and her biggest concern is that this building
will dwarf the townhomes and not aesthetically match the existing buildings.
Mr. Keleher stated that there will only be one association for all the buildings. He stated
that they conducted a market survey for what types of buildings would fit the area and
had originally proposed 18 townhome office sites. He stated that they platted half of
them, but were then approached by a client and asked to build a different type of office
building for them. He stated that he feels that there are other buildings in the City made
of similar materials, so this should fit in.
Commissioner Klennert Hunt asked if the buildings would be similar in color to the
existing buildings.
Mr. Thomas stated that the new building will have a wainscot of cultured stone similar to
the existing buildings, but not be the same color.
Mayor Capra asked who the tenant is for the new building.
Mr. Keleher stated that it is the Eagle Brook Church offices.

Commissioner Love asked what the distance would be between the new building and the
existing buildings.
Mayor Capra asked why a trail wasn't included and asked Mr. Larson to research this
issue because she seems to remember money being set aside for a future trail.
Brian Bourassa stated that there will be 65 feet between the buildings.
Chair Hanson asked what the distance is between building 2 and building 3.
Brian Bourassa stated that there is 80 feet between those buildings. He stated that the
Watershed District has given them a conditional approval pending receipt ofa few minor
changes. He stated that they have also followed up with the Highway Department and
noted that Mr. Larson has copies of both the Watershed District and Highway
Department replies.
Mr. Larson confirmed that he did have this documentation and stated that the Highway
Department has stated that they will not allow a second entrance and expect a turn
lanelbypass lane to be installed.
Brian Bourassa noted that they are planning a 3 lane access driveway with one lane going
in and 2 lanes exiting the property.
Commissioner Klennert Hunt asked if the townhome sites were fully occupied.
Mr. Keleher stated that they are not fully occupied but they are happy with the progress
in filling the units.
Chair Hanson asked if Eagle Brook Church would own the building or lease the space.
Mr. Keleher stated that this is still under negotiations, but he expects that they will
occupy the entire space.
Chair Hanson reviewed a memo sent from Paul Pa1zer and some concerns and questions
he had about the project. He stated that one of his concerns is the location of the HV AC
unit and possible screening.
Mr. Thomas stated that it will be one rooftop unit located towards the front of the
building that will not be seen with "eyeline sighting".
Commissioner Pangell asked if any of the neighbors behind this development would be
able to see the HV AC unit from their second story window.
Mr. Thomas stated that it was possible they would see the unit.

Mayor Capra asked about noise from the HV AC unit. She asked if there had been any
studies done on the units. She stated that she is concerned about noise because it abuts
the residential area and reminded the applicants that there is a noise ordinance in the City.
Mr. Thomas stated that he should be able to get information from the manufacturer on the
noise levels of the unit.
Commissioner Love stated that on the variance application it talks about a wall to help
screen the unit. He asked if this was the portion of the building that was higher in front.
Mr. Thomas confirmed that is for screening but also to give the building some
architectural character.
Commissioner Love asked if there was any planned screening on the back side for the
residents.
Mr. Thomas stated that they had not planned to screen the HV AC unit from the back also.
Chair Hanson asked about screening plans for the garbage/dumpster area.
Mr. Keleher stated that they have not designed the specifics for the enclosure yet, but
they should be similar to the building material used on the building itself
Commissioner Love asked where the loading dock area will be located.
Mr. Thomas stated that it will be an 8 x 8 garage door, not a loading dock area. He stated
that the church will receive office type deliveries only during the day when they are on
site.
Mayor Capra stated that she has heard the word variance discussed tonight, but the public
hearing notice only stated that this discussion is for Preliminary Site Plan and Conditional
Use Permit.
Mr. Larson explained that the form used included the word variance, but that this is just
for Conditional Use, not a variance. He stated that the applicant meets the requirements
for a Conditional Use Permit. He stated that Chapter 154 of the code discusses masonry
construction and appears to allow the type of material Sedona Homes is proposing.
Chair Hanson stated that he feels a similar color scheme would look better than the
drawings that they have presented.
Commissioner Love questioned whether the City had any say in the colors allowed.
Mr. Larson stated that as part of the Conditional Use Permit, we could add a provision
that the look of the building must fit in with the surrounding areas.

Chair Hanson expressed concern about the metal portion of the building front and
possible sun reflection issues.
Mr. Thomas stated that it is a textured type metal and will not cause reflection issues.
Commissioner Klennert Hunt asked why there will be two signs rather than one
combined site for the buildings.
Mr. Keleher stated that the existing 6 x 12 sign is not big enough for both and separate
signage will allow them their own separate identity.

Chair Hanson stated that he would really like to see the noise study on the HV AC units.
Commissioner Love asked if notice was sent to area residents.
Mr. Larson stated that notice had been sent to everyone within 350 feet of this
development.
Mr. Kelehner stated that they also sent out a letter after the last meeting to the residents
nearby inviting them to come take a look at the plans, but has not heard back from them.
He stated that the construction process will be fairly quick because of the tip up panel
construction
Commissioner Klennert Hunt stated that she would also like to see some sort of
complimentary color scheme to help bring the whole development together. She stated
that she realizes these choices are subjective, but noted that the City is working hard to
clean up this part of town.
Commissioner Love stated that he supports this development for two reasons, one that he
wants to bring businesses into Centerville and the other is that he is a member of Eagle
Brook Church and would personally like their offices to be located in town.
Mr. Keleher stated that they would like to begin site work as soon as possible and begin
installing the tip up panels in January so the offices could be occupied by mid-summer.
Mayor Capra stated that she would like our City Engineer to give photo samples of the
materials used to give a better idea of what the actual building will look like because it is
hard to envision from the drawings. She stated that she would also like a photo of what
the metal portion of the building will look like.
Mr. Thomas stated that the planned building materials are very similar to what is
currently on the Eagle Brook Church building.

Mr. Keleher stated that they can bring a sample board to the Council meeting.
Mr. Thomas distributed a picture ofthe Eagle Brook Church that showed a more accurate
portrayal of the two colors planned for this building.
Mr. Larson reviewed the conditions recommended by the Commission.

V. NEW BUSINESS
1. Request for Lot Split - Mr. Erick Marshall, 1688 Sorel Street
Mr. Larson noted a letter that the City Attorney had submitted regarding this request and
his opinion that this lot split should not be approved.
Mr. Marshall stated that he bought the property in June of 2005 and had it surveyed at the
time with the intention of splitting the lot. Mr. Marshall reviewed his history in working
with the City to split the property. He stated that the City has changed the zoning rules
twice since he purchased the property and he feels this has adversely affected the
marketability of his property. He stated that John Mayer has offered to purchase the
property, but not at the lot split value. He stated that he would be willing to sell if it is
purchased at its appraised value. He stated that if the City will not purchase the land, he
would like the lot split to be allowed under the original zoning rules when he purchased
the property.
Mr. Larson stated that John Mayer was trying to establish a price for the property to
possibly pursue grant money. He stated that there has been no action by the City Council
authorizing the purchase of this property. He stated that the City is working with a
developer for the downtown area and are hopeful that the developer will have a plan that

will implement the development guidelines the City has adopted. He stated that it is
possible that the developer, at that time, would be interested in purchasing this property.
He stated that it is not the Planning Commission's decision on whether or not the City
will purchase Mr. Marshall's land, but on whether or not to allow the lot split.
Mr. Marshall stated that he understands the rezoning plans, but feels that he was lead to
believe that the City would buy his property at the lot split value. He stated that he feels
he was strung along while the City changed their plans. He stated that is why he is
asking for the laws to be reinstated from when he originally purchased the land.
Chair Hanson stated that he understands this situation has created a hardship for Mr.
Marshall, but the City cannot set a precedent by reverting to previous rules.
Mr. Marshall stated that he feels he has been in an ongoing process with the City since he
purchased the land.
Commissioner Klennert Hunt asked if a lot split application was submitted.
Mr. Larson stated that there was not a formal lot split request submitted.

Mr. Larson stated that there were three letters of interest in filling the vacancy on the
Planning Commission. He stated that the Commission can make a recommendation to
the Council on who they would like to see appointed.
Darin Mosher introduced himself to the Commission and expressed his interest in serving
on the Commission. Mr. Mosher left the Commission meeting.
The Commission discussed the applicants.

City Administrator Larson suggested that the Planning Commission begin reviewing the
Comprehensive Plan on page 29.
The Commission discussed wording changes to Section 3 of the Comprehensive Plan.
Chair Hanson suggested that the Commissioners review pages 29 - 37 on their own and
make notes to bring for more detailed discussion at the next meeting.
Mayor Capra suggested that Mr. Larson break down the Comprehensive Plan and
distribute the appropriate sections to the various Commissions for their input. She
suggested that an all Commission meeting be held to discuss the Comprehensive Plan so
everyone is on the same page.

Planning & Zoning Commission Report and Recommendation.
The Planning & Zoning Commission met on November 14, 2006, and considered a
request of Erick Marshall to approve a lot split for Lots 8 & 13 in Block 7, Centerville.
The Planning and Zoning Commission reviewed a memo from City Attorney Kurt Glaser
outlining concerns and issues that impact the proposed split.
Findings:
1) The applicant proposed a lot split but does not show how the split will facilitate a use
that complies with the requirements of the zoning district which requires densities of
12-30 units per acre.
2) The Commission identified that adverse impacts are likely and specifically that a lot
split creating smaller parcels will frustrate the intents of the City Zoning Code and the
Master Plan and Development Guidelines for Downtown Centerville (Master Plan)
adopted by the Council on January 11,2006.
DECISIONIRECOMMENDATION:
The Planning and Zoning Commission finds that splitting the lot will not facilitate
compliance with the zoning code and the adopted Master Plan of the City and specifically
that the split will make it more difficult to accomplish the City's goals. The Planning &
Zoning Commission denies the lot split recommends that the City Council sustain their
action.
