Sedona, Standards For Granting Applications
The question has been asked: What is the standard for reviewing Sedona's new plans? Here is a
summary ofa few Code sections to help answer questions about approval or denial of their request
to exceed the maximum building height of35 feet. Here is what the Council must consider before
a Conditional Use Permit ("CUP") can be granted:
Step # I) Consider Standards & Conditions for conditional uses (see below). These must be proven
before the CUP can be granted. If not proven, then the CUP cannot be granted and the height of
, off - the building can be built, but no higher than 35 feet tall.
Step #2) Consider imposing additional conditions "to prevent or minimize injurious effects in the
neighborhood." (Landscaping, screening, buffer zone, ect.)

(A) Structures. No structures or building may be erected to a height exceeding 35 feet
without the issuance of a conditional use permit.
(B) Excess height on a building. Upon the securing of a conditional use permit any
building may be erected to a height exceeding that specified for the respective district, provided
the front, rear andsid~yards shall be increased one foot for each one foot by which the building
exceeds the height-limit established for that district.

Standards and conditions for conditional uses.

(2) A Conditional Use Permit shall be granted only if evidence is presented to establish:
(a) That the proposed building or use at the particular location requested is necessary
or desirable to provide a service or a facility which is in the interest of the public convenience and
will contribute to the general welfare of the neighborhood or city;
(b) That the proposed building or use will not have a substantial or undue adverse
effect upon adjacent property, the character of the neighborhood, traffic conditions, utility
facilities and other matters affecting the public health, safety and general welfare; and
(c) That the proposed building or use will be designed, arranged and operated so as
to permit the development and use of neighboring property in accordance with the applicable
district regulations.
(3) The Council may impose such conditions upon the premises benefitted by a conditional
use as may be necessary to prevent or minimize injurious effects therefrom upon other
property in the neighborhood.

(D) Buffer zone between commercial and residential districts. Where a commercial
district abuts a residential district, any new development shall include a buffer zone. There shall
be a protective strip of not less than ten feet in width. This protective strip shall contain no
structures, shall not be used for parking, off-street loading or storage, and shall be landscaped.
The landscape treatment shall include a compact screen wall or fence, but shall not extend within
15 feet of the street right-of-way. The planting or fence design must be approved by the site plan
review process. The site plan review process requires review by the Planning and Zoning
Committee and the City Council, as set forth in this chapter.
(E) Screening requirements. If the City Council requires any type of screening as a
condition for a variance or special use permit, ***
(F) Landscaping. A minimum of ten percent of any lot shall be green space. Three
percent of the surface area of the land within a parking area shall be landscaped with grass and
shrubbery or other approved ground cover. Landscaped areas will continue to be maintained by
the property owner on a continuous basis. Green areas within abutting street rights-of-way will
also be maintained by the property owner. Other requirements are set forth in this chapter.

SUMMARY OF APPLICATION:
A wetland replacement plan application has been submitted for the proposed filling of 0.21
acres of Type 6 wetland associated with a 6-lot subdivision and development of 6 acres of land
in Centerville. Proposed wetland impacts are due to grading for house pads, driveways, and
storm sewer pipes. Replacement for wetland impacts is proposed by creating 0.24 acres of
Type 1/2 wetland onsite (NWC) and utilizing 0.17 acres of PVC generated by the creation of
stormwater treatment areas.
INITIAL COMMENTS/CONCERNS:
District staff previously reviewed the wetland delineation in Fall 2006 and concurs with the
modified boundaries shown on the submitted plans and in the delineation report.
The District has concerns about the proposed wetland creation area. The southeastern portion
of the proposed NWC area would be dJrectly adjacent to the lawns of Lots 2 and 3. Past
experience has shown that these areas are subject to long-term wetland impacts due to
encroachments by future landowners during dry conditions. The District recommends that the
NWC area be re-designed to include a physical barrier between the proposed lawns and the 1~
replacement wetland. Such a barrier could include an extension of the stormwater pond to the
south and/or a permanent berm of some type.
