Subject: Update on Outstanding Issues
The Bonestroo Trail Map Brochmes were on the April 16, 2002 EDC
Agenda to be considered as part of their next New Resident Packet No
decision was made, as the committee did not have a quorum. I will place it
on the next EDC Agenda. It should be noted, however, that we currently
have approximately 200 of the folders in stock which, will be used before
reordering, so this will not be something that is done in the near future
The City Council made a motion at the April 24, 2002 Council Meeting to
retwn the $1,913 to the Centerville Lions as it was given to the City of
Centerville and subsequently Parks & Recreation in error.
I have talked with Rhonda Lynch at Wargo Nature Center and we will have
a Registration Form to proof at the May 1, 2002 scheduled meeting. She
mentioned to me that the school is usually willing to distribute flyers, but
only if fees are waived for those unable to pay, or assistance is offered.
The balloons and weights were located and the buttons are available to the
Lions for Fete des Lacs.

Skate Park Attendants and the 2002 Park and Rec Budget

The Commission is looking for an opportunity to hire a skate park attendant because of
park vandall~ The staff received a copy of an e-mail that Mr. Wayne LeBlanc sent
discussing his ideas of the number of hours an attendant would be needed.
In reviewing the Park and Rec budget that is attached, you will find that there is a line
item under programming for wages and sa1aries at $19,344.00. Originally, the City
Council approved a summer intern for Parks and Rec whereby, the City would hire a
student to develop a summer program and this individual's wages would be paid from
this line item. Since then, the Council has rethought that idea and at this point has
decided to use most of those funds in the hiring of a financial director.
Also, Mr. LeBlanc indicated in his e-mail that beca1lse there was hardly an ice ~kS\fing
season, that there may be sufficient monies in the budget to cover a large portion of the
skate park attendant's salary. Staff's calculations indicate that there would be roughly
$1,200 for an attendant's salary at this point.
If the Committee would sit down and determine the number of hours a week they feel are
critical to having someone at the skate park, Staff could submit that recommendation to
the Council with suggestions on where to take the money :from to support this hiring. I
am also checking with the Police Chief to find out which daytime hours seem to have the
most caDs to the park. I hope to have that information attached to this memo, but if it is
not, I will present that information at the Park and Rec meeting on May 1.
Also, the issue of a shelter around the port-a-potties was brought to my attention. There
is approximately $11,500 in capital improvements that might be used for this
construction. Please discuss and have a recommendation for Council if this is a project
that you would like to pursue.

If my math holds up, there could be an attendant there 12 hours a day,
seven days a week, through the whole skating season for about
$16,128.00
That's a rate of $8.00 per hour. (good money for a young adult to hang
out at the park)
The ~bney that wasn't spent on the rink attendant this winter could
cover a large portion of that.
I think the skate park is a very nice attraction, I'd hate to see a few
bad apples spoil it for the others. It's too bad there isn't something
we could do to keep the trouble away.

MEETING MINUTES - April 3, 2002 .
Pursuant to due call and notice thereot: the Parks and Recreation Committee of the
City of Centerville held the regularly scheduled meeting on April 3, 2002, at City
Hall, 1880 Main Street.

~ OLD BUSINESS
1. Wargo Nature Center Summer Program Update
Ms. Peil gave an update on the information she had received from Mr. Murowski,
Wargo Nature Center Recreation Specialist, in regards to the Summer Park
Program. A tentative schedule and guidelines were supplied to the committee for
review. Mr. Murowski has a probable summer assistant so Wargo's staff shortage
should not affect the amount of days available to the city.

. The sessions will be scheduled for one (1) hour from 12:00-1:00 p.rn., except for
the biking/swimming activity which will remain two (2) hours from 12:00-2:00
p.rn. The programs will be scheduled each Tuesday beginning June 11, 2002 and
ending August 13,2002, excluding the week of July 2. Registration will be set up
through City Hall. There will be a limit of 30 children per session, if there are
more than 30 children interested, Mr. Murowski. will run another session from
1 :00-2:00 p.rn. The cutoff for registration will be the Friday prior to each session.
Discussion as to how to limit phone calls to City Hall and how' to most effectively
roll the excess children over into the second session once the maximwn is reached.
Ms. Pell will get together with Staff to determine what will work best. Open
enrollment will be closed to large groups to allow the general public to take
advantage of the programs. Second sessions may also be scheduled for large group
registrations such as Apple Academy.
The canoeing activity will be scheduled as an hour session also. There is an age
limit for this activity and Anoka County needs a waiver signed for each child for
both canoeing and swimming. Ms. Stephan will contact Rhonda Lynch at Wargo
to get more specifics on this and additional information on each program. The
activities that were selected are geared more for older kids, but because of staff
limitations the programs cannot be as creative as Mr. Murowski would have liked.
Because the Pond Study was so popular last year it will be offered multiple times.
The cost to the city will not increase this year, but remain at $50.00 each two (2)
hour program. Wargo will bill the city at the end of the season. A $2.00 minimwn
fee for each child per session was decided on. Prepaid fees will be collected at the
time of registration. It needs to be determined what will be the procedure if
children show up at the activity without being prepaid and registered.

The need for volunteers was discussed. It will be noted on the registration form
that adult volunteers would be appreciated and parent involvement is encouraged.
Volunteers are especially needed for the biking/swimming and canoeing activities.
The committee discussed various ways of advertising. Mr. Lee suggested sending
home information from school, but questioned whether the school would do that
because of secwity reasons. Suggestions were the City Hall sign, cable, the
website and possibly the local paper. Advertising should begin in May. Ms.
Devine will check into advertising in the paper and Ms Pell will do a flyer
announcement Council Member Capra said that the City Council was considering
,. taking out a ~ page add quarterly in the Quad and perhaps the Summer Park
Program could be included. Council Member Capra added the Parks & Recreation
Committee could kickoff this program by having a table at the April 27, 2002
Volunteer Recognition Day Celebratiop. which is scheduled from 10-1 :00 p.rn. at
City Hall. This celebration is to show appreciation to all volunteers and their
families and to help promote volunteerism within the community. It will also
include an award ceremony. Ms. Devine will need to let Council Member Capra
know if Mr. Porter will be presented with his recognition plaque at the award
ceremony on April 27, 2002. Council Member Capra would like the Parks and
Recreation Committee to be involved.
Motion was made by Ms. Peil, seconded by Mr. LeBlanc to accept the Wargo
Nature Center Summer Park Program as laid out by Mr. Murowski and
charge a $2.00 prepaid fee per child.
All in favor: Motion earried Unanimously.
Council Member Capra questioned where the balloons and balloon weights went
after the Fete des Lacs Festival. She would like to locate these for the Volunteer
Recognition Celebration. Ms. Peil asked if staff had received her e-mail requesting
the remaining buttons for Fete des Lacs. Ms. Stephan will check on these supplies.
COlmcil Member Capra reported the City of V'llinai~ Heights has a 'Party Trailer'
to rent to residents for a nominal fee, which includes tables, chairs and grills and
suggested perhaps Parks and Recreation would like to do something like that in the
future. Mr. Peterson will locate the Parks and Recreation banner.

2. Fund RaisinglLittle League - Concessions at Laurie LaMotte Park
The Lion's Branch Club volunteered to sell concessions at Lamie LaMotte Park
during Little League games 3 days per week. There are games 4 nights per week.
Ms. DeVme requested committee members consider selling concessions the
additional day. Mr. Lee said it was a possibility for him, but the other committee
members were otherwise committed. The games are scheduled from 6:30 - 8:00
p.m. and the Lion's Branch Club would open the stand at 6:00 p.m. Mr. Walters
reported there is not a schedule published as of yet, but the games start Monday,
. May 4th. Discussion was held as to what percentage of the profits would be
donated back to the city. Council Member Vickers suggested 50% in following
charitable gambling currently being run by Dead Broke Saddle Club and the
Spring Lake Park Lions. Ms. Devine suggested on the nights the Branch Club runs
the concession stand they would donate 20% of the profits to Parks and Recreation
and if committee members opt to run the stand on the additional night the Branch
Club would then increase the percentage for that night Council Member
Broussard-Vickers stated that council will want reporting that profits are used in
community, either going to Parks and Recreation or another community fimction.
There was discussion as to asking Little League if they were interested in the
additional night, but the consensus was it would become too complicated involving
Little League. Mr. Peterson was concerned about clean up issues and who would
have keys. Ms. De Vme said the Branch Club would ensure cleanup took place and
they would only require one (1) key and would share it
Motion was made by Mr. Lee, seconded by Mr. Walter to recommend to the
City Council that the Centerville Lion's Branch Club run concessions at
Laurie LaMotte Park during Little League games donating 20% of the
proceeds to the Parks and Recreation Committee. Ayes - 5, Nays - 0, Abstain
- 2 (De Vme, Pei.l}o Motion carried. ~
3. Enclosures for Satellites
Discussion as to how much money was actually in the capitol improvement
account and is this where the money for the satellite enclosures would come from.
The financials show $11,500 currently in this account. Council Member
Broussard-Vickers reported that anything in capital improvement would not

necessarily be approved as the city may have an unexpected expendinn-e, and the
summer intern money will probably be used to upgrade the computers in the office
as they are beginning to have serious problems. More information will be available
by the next scheduled meeting. Ms. Stephan will get clarification on the financial
reports as they are not easily understood.
Ms. DeVme said that the committee had Previously considered and rejected the
idea of preformed satellite enclosures. Mr. Walters will get accurate measurements
and figures for .the price of enclosures. Discussion as to whether Acorn Creek
Park: will be done in same place as last year? Mr. Peterson reported they all have
. to be done the same or not at all. Mr. Peterson also reported Public Works has only
ordered 4 satellites this year because of the dRmRge done to Royal Meadow Park:
last year, there will not be a satellite there this year. There will not be any picnic
tables at Royal Meadows Park either because of the damage done. Mr. Peterson
will price auger rental and get a concrete estimate to report at the next meeting.
Ms. DeVme suggested a spring tour of the parks as a group to familiarize Ms.
Seeley with the parks and check out situating for satellites. It was decide to meet
on April 27, 2002 at 8:30 a.m. at Acorn Creek Park. This will be prior to the
Volunteer Recognition Celebration.
4. Trail Grants (Update) DNR Grant
Discussion was held as to when/how the committee should start looking into grants
for 2003, as it is too late for this year. Ms. DeVme would like to see the money
that is being collected from the Spring Lake Park Lion's charitable gambling to be
used as a matching grant This fall the committee will meet with City
Admini~trator Ms. Moore-Sykes to pursue grant options.
5. The Shores Trail (Update) CenterviUe 4-Lane Highway
Mr. leBlanc sent all committee members e-mail on his findings with Anoka
County. The 4-lane highway is coming through and the chances of stopping it are
zero. Mr. leBlanc reported the Highway Department did not know about The
Shores, but they do now. The amount of easement The Shores is going to dedicate
is already adequate. Counc.il Member Broussard-Vickers said the City Council is
setting up meetings to try and have some input and that the cost of acquisition will
determine where exactly the road will go. Anoka County representative John

Olson had made promises that they wouldn't proceed on this without input from
city, but they did. Council Member Broussard Vickers . suggested the committee
. give some thought to having The Shores developers give the money to Parks and
Recreation for the cost of the trail in lieu of the trail. The city would use engineers
and county standards to determine specs and this would then go into the
developer's agreement Mr. Peterson questioned as to when the park dedication fee
would increase and would Parks and Recreation receive those fees or would they
go into the general fund? Council Member Vickers reported Pheasant Marsh
dedication fees are at $1,800, but Phase n will be at the new rate of $3,000. It is
uncertain at this time where these monies will go.
Motion was made by Ms. PeU, seconded by Mr. Lee to recommend to City
Council to accept monies in lieu of a trail.
Motion earried unanimously.
6. Bonestroo Trail Maps (Update)
Mr. Peterson was unable to reach Ms. Scheller from the EDC committee, but Ms.
Stephan include the request for the EDC Committee to consider publishing the trail
maps in the New Resident Packet on the April 16, 2002 EDC Agenda. Mr.
Peterson will get the maps to Ms. Stephan.
7. Spring Lake Park Lion's Donation
Council Member Broussard-Vickers informed the committee that the Spring Lake
Park Lion's donation would be returned to the Lions as it had been given to the
City of Centerville in error. Also reported was the discussion at the last council
meeting directing the Lions to set up some other type of fund where they could
direct the contributions from charitable gambling to, as the council prefers it no
longer come through the city. The Lion's intent was that the money be used for a
Park Shelter/Concession Stand, but the City Council does not have to use it for that
pwpose. While the City Attorney said it would be good politics to follow the
wishes of the Lions, it is not necessary to do so. Mr. Peterson presented plans and
ideas for a play structure at Lamie LaMotte Park and would like to pursue
charitable gambling :funds as a way of financing the play structure. Mr. Peterson's
estimAtp. for the play equipment is $22,700. There is currently $26,000 from the

Spring Lake Park Lion's charitable gambling donations and Parks and Recreation
could also apply for this money. Council Member Vickers also suggested
contacting the Dead Broke Saddle Club. Mr. Peterson will pursue how to apply for
fimds. Some discussion as to where the play structure would be situated There
would need to be netting over it to protect it from the fields. Ms. De Vme asked
Mr. Peterson to figme out fall zones for room, perhaps using Royal Meadows as an
example. Ms. DeVme suggested leaving the $26,000 alone to use for matching
grants this fall.
8. Goetz Landscaping Tree Payment (Update)
Ms. Stephan informed the committee that Mr. Goetz had over billed the city and
that a refund would be forthcoming. The money will be placed back into the
account the trees were paid for from.
~ NEW BUSINESS
1. Wheels Skate Park for Upcoming Year
Lengthy discussion was held as to the best way to prevent problems at the Wheels
Skate Park in the upcoming season. There are concerns with hiring attendants such
as; is there money in the budget, what hours are the most important to cover, can
enough people be hired, will teenagers be able to handle the problems that were
occurring last year? More police patrols are desirable, but not practical. It was
suggested that there be age restrictions or limited hours for specific age groups,
such as 1-4:00 p.rn. reserved for younger children, but the problem would be in
enforcing it. Mr. Peterson questioned who would hire and superviSe the rink
attendants and what were the chances of finding adults for the position? In looking
at the financial statements supplied to the committee it was \Dlclear as to which line
item applied to the attendants. Ms. Stephan will get additional information on this
item for the next scheduled meeting. Council Member Broussard-Vickers
questioned whether anyone had talked to the police department about their feelings
towards the skate park? Mr. Peterson said that Chief Heckman would prefer
Centerville did not have a skate park as it has caused so many problems. The
police don't have the time, fimds or desire to give any more support. Council
Member Broussard-Vickers asked the committee if they could get $20,000 by
selling it the equipment and if the money would go back into a park fund opposed

to the general fimd, would the committee sell the equipment? The committee
agrees the city cannot go the entire year with problems such as last year and the
rules should be clear from the beginning, any incidents and the ramps will be sold,
closing the park Council Member Broussard-Vickers suggested putting out the
equipment, posting signs with clear expectations, not hiring attendants, but solicit
adult/parental vobmteers and give the park: a trial month. Mr. Peterson said after
the equipment was removed this fall hockey players used the rink extensively and
there was never a problem. Perhaps put some of the ramps out and leave the
hockey roller bladers on the south end, with a separation net. It was suggested to
open the park for mon~ evaluate after the month and if there are problems, sell it.

Ms. Stephan said utility bills were going out in the following week and a flyer
requesting volunteers could be included. The committee decided to try this and
evaluate at the next meeting, including in the flyer that if enough volunteers were
not fomd the opening of the park may be delayed. The hours decided on are 8

Always follow the label instructions of lawn care products and properly dispose of product

Do not apply lawn care products to frozen ground - wait until grass starts growing;

Homeowners can be sure they are using a zero phosphorus fertilizer by looking at the N-P-K
numbers on the product label. The middle number will be zero on phosphorus-free products.
Homeowners should also keep in mind that there are a smaIl number of lawns that may be
phosphorus-deficient, and in such cases, it may be suitable to use phosphorus. To determine
if a lawn is phosphoms defioient, homeowners can get a soil test by calling the University of
Minnesota Extension Service's INFO-U at 612-624-2200, message 468, or by logging on to
www.extension.umn.edu and searching for "Soil Testing Lavvns" for testing information.

MDA says new phosphorous law is good news for MDm.esota lakes and streams
ST. PAUL, Minn. - The future is looking a bit clearer for Minnesota's 10,000 lakes today after
governor Jesse Ventura signed into law a bill restricting the use of phosphorus fertilizer in Anoka,
Carver, Dakota, Hennepin, Ramsey, Scott and Washington Counties and setting a 3 percent (by
weight) limit outside the metro area.
Phosphorus is an important nutrient for plant growth, but soils in many parts of the state already
have an abundance of it. When excess phosphoms is applied to soil, it can wash off into nearby
lakes, streams and rivers where it accelerates algae growth. Excessive algae growth dimini!ilbes
water quality and can cause problems for fish and other aquatic life. The new law is designed to
reduce unnecessary use of the nutrient, but it provides exemptions for farm land and golf courses.
It also allows phosphorus to be applied to new sod and to phosphorus-deficient soils.
The rv1innesola Department of Agriculture (MDA) regulates fertilizer sales and use. As such, the
l\.IDA worked closely with lawmakers and interest groups for the past three years to develop
sensible phosphorus legislation. Given the clear benefIts of reducing unnecessary phosphorus use,
. MDA Commissioner Gene Hugoson said the new phosphorus law is good news for the entire state.
.
"This new law is the result of several years of work on this issue," Commissioner Hugoson said
"Several years ago, we put together a program in south Minneapolis to build awareness of
phosphorus issues among homeowners near Lake Hmiet. We had encouraging results, and this law
extends the benefits statewide."
\Vhile the phosphorus law will help boost water quality, there are many other lawn care practices
homeowners can take to reduce phosphorus runoff into lakes and streams. Yard materials such as
soil, tree leaves, grass clippings and pet -waste are other major sources of phosphorous. When these
materials move off the landscape and onto streets or driveways, they can be washed into storm
drains that lead directly to nearby lakes or streams.
The MDA says the following practices can help keep Minnesota~s lawns and lakes healthy:
Keep storm drains clear and do not rake lawn debris onto the street;
Sweep. up sand for reuse or contact your citY for proper disposal;
Direct water from downspouts onto your lawn and away from the house and paved surfaces~
Mow high and often, keep mowing height between 2~ and 311z inches; _
When mowing, discharge grass clippings into the lawn and away from paved surfaces;
Sweep up any grass clippings that land on sidewalks, driveways or other hard surfaces;
Reseed bare spots in your la"'"D and keep seeded areas moist for tbree to four weeks;

Charitable Gambling Fund/Ordinance
I requested a tabling of the charitable gambling fund disbursement of monies until we had
a chance to review information from the Minnesota Gambling Comol Board regar~
this issue. .
Today I spoke with Alice Jacobs a comp1ian~ specialist with the Minnesota Gambling ~
Control Board. According to Ms. Jacobs the city will need to review and correct the .
wording in its ordinance. Under Section 4. Profit~ we need to state the trade area in . ~..~...
which ~e 50% profits ~ be used for la~ purpo~s. Base~ on !he ~t that we have % ~ 0.:.,.,
an ordinance we have to mclude the coDlDlDDity ofLmo Lakes m this ordinance. ". . ~ ~ ~
We also should only be receiving a payment of 10% to the city based on Minnesota ,,~ II( J~I{ .f,
Statue and this amount has restrictions on how it can be used. Please refer to the attach~.~ .wr .

Ms. Jacobs stated we cannot disburse monies to the Centerville Lions Club and directed ~
me to the Gaming News issue for December 2001 for examples of issues regarding
problems with doing.so. She will hopefully fax to the city further information regarding
funds and local Lions Club OrganirJltion issues to be concerned about regarding the
same.
Ms. Jacobs stated ~e have the right to request from the Spring Lake Parks Lions
Organi7J1t1on and the Dead Broke Saddle Club their" Schedule A" which is submitted
monthly to the MinnesOta Department of Revenue. This form includes all profits from
the establishment such as Kelly's, Trio or WISe Guys. In addition we can request a
"Schedule CID" which is sent to the Minnesota Gambling Control Board. This form will
show all disbursement of the 50% profit funds disbursed by these organizations. Please
note if no disbursements had been made in a given month no form would be submitted.
After spt'SIking with Ms. Jacobs I personally believe we need to further investigate this
rl1a1:ter before taking any action regarding this money and we need to amend our
ordinance.
I would also like to request the above-mentioned information for review from all parties
operating charitable gambling with the City of Centerville. .

3. the ordinance must specify the percentage of lawful purpose expenditures which must be expenQed within
the trade area

Subd. 24. Lawful gambling. "Lawful gambling" is the
operation, conduct or sale of bingo, raffles, paddlewheels,
tipboards, and pull-tabs.
Subd. 25. Lawful paxpose. (a) "Lawful purpose" means
one or more of the following:
(1) any. expenditure by or contribution to a 501(c) (3) or
festival organization, as defined in subdivision 15a, provided
that the organization and expenditure or contribution are in
conformity with standards prescribed by the board under section
349.154, which standards must apply to both types of
organizations in the same manner and to the same extent;
(2) a contribution to an individual or family suffering
from poverty, homelessness, or physical or mental disability~
which is used to relieve the effects of that poverty,
homelessness, or disability;
(3) a contribution to an individual for treatment for
delayed posttraumatic stress syndrome or a contribution to a
program recognized by the Minnesota department. of human services
for the education, prevention, or treatment of compulsive
gambling;
(4) a contribution to or expenditure on a public or private
nonprofit educational institution registered with or accredited
by this state or any other state;
(5) a contribution to a scholarship fund for defraying the
cost of education to individuals where the funds are awarded
through an open and fair selection process;
(6) activities by an organization or a government entity
which recognize humanitarian or military service to the United
States, the state of Minnesota, or a community, subject to rules
of the board, provided that the rules must not include mileage
reimbursements in the computation of the per occasion
reimbursement limit and must impose no aggregqte annual limit on
the amount of reasonable and necessary expenditures made to
support:
(i) members of.a military marching or color guard unit for
activities conducted within the state;
(ii) members of an organization solely for services
performed by the members at funeral services; or
(iii) members of military marching, color guard, or honor
guard units may be reimbursed for participating in color guard,
honor guard, or marching unit events within the state or states
-contiguous to Minnesota at a per participant rate of up to $35
per occasion;

(7) recreational, community, and athletic facilities and
activities intended primarily for persons under age 21, provided
that such facilities and activities do not discriminate on the
basis of gender and the organization complies with section
349.154;
(8) payment of local taxes authorized under this chapter,
taxes imposed by the United States on receipts from lawful
gambling, the taxes imposed by section 297E.02, subdivisions 1,
4, 5, and 6, and the tax imposed on unrelated business income by
section 290.05, subdivision 3;
(9) payment of real estate taxes and assessments on
permitted gambling premises wholly owned by the licensed
organization paying the taxes, not to exceed:
(i) for premises used for bingo, the amount that an
organization may expend under board rules on rent for bingo; and
(ii) $35,000 per year for premises used for other forms of
lawful gambling;
-(10) a contribution to the United States, this state or any
of its political subdivisions, or any agency or instrumentality
thereof other than a direct contribution to a .law enforcement or
prosecutorial agency;
(11) a contribution to or expenditure by a nonprofit
organization which is a church or body of communicants gathered
in common membership for mutual support and edification in
piety, worship, or religious observances;
(12) payment of the reasonable costs of an audit required
in section 297E.06, subdivision 4, provided the annual audit is
filed in a timely manner with the department of revenue;
(13) a contribution to or expenditure on a wildlife
management project that benefits the public at-large, provided
that the state agency with authority over that wildlife
management project approves the project before the contribution
or expenditure is made;
(14) expenditures, approved by the commissioner of natural
resources, by an organization for grooming and maintaining
snowmobile trails and all-terrain vehicle trails that are (1)
grant-in-aid tr~ils established under section 85.019, or (2)'
other trails open to public use, including purchase or lease of
equipment for this purpose; or
(15) conducting nutritional programs, food shelves, and
congregate dining programs primarily for persons who are age 62
or older or disabled; or
, .
(16) a,contribution to a community arts organization, or an
expenditure to sponSor arts programs in the community, including
but not limited to visual, literary, performing, or musical arts.
(b) Notwithstanding paragraph (a), ~lawful purposeD does
not include:
-,
(1) any expenditure made or incurred for the purpose of
influencing the nomination or election of a candidate for public
office or for the purpose of promoting or defeating a ballot
question;
(2) any activity intended to influence an election or a
governmental decision-making process;
(3) the erection, acquisition, improvement, expansion,
repair, or maintenance of real property or capital assets owned
or ieased by an organization, unless the board has first
specifically authorized the expenditures after finding.that (i)
the real property or capital assets will be used exclusively for
one or more of the purposes in paragraph (a); (ii) with respect
to expenditures for repair or maintenance only, that the
property is or will be used extensively as a meeting place or
event location by other nonprofit organizations or community or
service groups and that no rental fee is charged for the use;
(iii) with respect to expenditures, including a mortgage payment
or other debt service payment, for erection or acquisition only,
that the erection or acquisition is necessary to replace with a
comparable building, a building owned by the organization and
destroyed or made uninhabitable by fire or natural disaster,
provided that the expenditure may be only for that part of the
replacement cost not reimbursed by 'insurance; (iv) with respect
to expenditures, including a mortgage payment or other debt
service payment, for erection or acquisition onl~, that the
erection or acquisition is necessary to replace with a
comparable building a building owned by the organization that
was acquired from the organization by eminent domain or sold by
the organization to a purchaser that the organization reasonably
believed would otherwise have acquired the building by eminent
domain, provided that the expenditure may be only for that part
of the replacement cost that exceeds the compensation received
by the organization for the building being replaced; or (v) with
respect to an expenditure to bring an existing building into
compliance with the Americans with Disabilities Act under item
(ii), an organization has the option to apply the amount of the
board-approved expenditure to the erection or'acquisition of a
replacement building that is in compliance with the Americans
with Disabilities Act; ,
(4) an expenditure by an organization which is a
contribution to a parent organization, foundation, or affiliate
of the contributing organization, if the parent organization,
foundation, or affiliate has provided to the contributing
organization within one year of the contribution any money,
grants, property, or other thing of value;
(5) a contribution by a licensed organization to another
licensed organization unless the board has specifically
authorized the contribution. The board must authorize such a
contribution when requested to do so by the contributing
organization unless it makes an affirmative finding that the
contribution will not be used by the recipient organization for
one or more of the purposes in paragraph (a)i or
(6) a contribution to a statutory or home rule charter
city, county, or town by a licensed organization with the
knowledge that the governmental unit intends to use the
contribution for apens!on or retirement fund.

AN ORDINANCE REGULATING LAWFUL GAMBLING WITH THE CITY OF CENTERVllLE.
The City Council of the City ofCenterviJle does ordain:
ARTICLE 1. ADOPTION.

Chapter 349 of the Minnesota Statute is adopted by reference the same as if it were ful1y .
set forth herein.
ARTICLE 2. PROFIT.
The gross receipts from the operation of gambling devices and the conduct of rafftes, less
reasonable sums expended for prizes, local licensing fees, taxes, maintenance costs fur the
devices, purchase of gambling supplies, state and federal tax, all necessary bonds, salaries and
clerical supplies.
ARTICLE 3. RECORDS AND REPORTS.
A copy of all applications and reports applicable to the City of Centerville require by and
submitted to the Minnesota Charitable Gambling Control Board shall also be submitted to the
City of Centerville within seven (7) days after they were submitted to said board.
ARTICLE 4. PROFITS. 1> ~

Subsection 2. Permit Fee.
No Organi'7.mion my conduct a gambling event which would otherwise be allowed pursuant to
the exemptions set forth in Minnesota Statutes section 349.214, without first securing a permit
from the City and paying a permit fee in an amount to be determined by the City Council in the
form of a resolution.
ARTICLE 6. PENALTY.
Any person violating any provision of this Ordinance is guilty of a misdemeanor and
upon conviction thereof sba1I be punish~ as defined by State Statute. -

WHEREAS, the City ofCenterville met at its regularly scheduled meeting date of March 29,
2000; and
WHEREAS, the Centervi11e City Council discussed the application .from the Spring L~ Lions
to conduct charitable gambling at Kelly's Komer, 7098 Centerville Road; and .
WHEREAS, the City ofCenterville HAS conducted an investigation of the Spring Lake Lions
Organization; and
WHEREAS, the Spring Lake Lions would be in compliance with City Ordinance #51; and
WHEREAS, the Spring Lake Lions appear to take into consideration the best interests of the
City ofCenterville;
NOW, THEREFORE, BE IT RESOLVED THAT the City ofCenterville hereby approves
charitable gambling by the Spring Lake Park Lions at Kelly's Korner;
Whereupon said resolution was declared duly passed and adopted by the Centerville City
Council on March 29, 2000.

Lorentz Bus Service - Tom Thumb Parking Lot
Mr. March stated he received a call from Tom Thumb Corporate Office who
indicated Lorentz Bus Service currently uses the Main Street Tom Thumb parking
lot for "park and ride" services. The "park and ride" has grown. over the past
couple years and the Tom Thumb parking lot is now to small for the program.. Tom
Thumb is requesting the City's guidance in resolving this concern. Tnn March will
pass along the church parking lot as a suggestion.
Cbaritabl~ Gambling License - Spring 4J<e Park Lions
Mr. March stated the Spring Lake Park Lions Club is looking to receive approval to
conduct charitable gambling at Kelly's Komer.

Special Vse Perm.itlLot Split - First Class Concrete
Mr. Scott Byrkit and Mr. Arnie Larson were present on behalf of First Class
Concrete Inc. Mr. Byrkit and Mr:. Larson are requesting permission for a Special
Use Permit to construct an 19,800 sqwire foot speculative commercial building
between Reel ~umcturing and R & R Leasing.

T.aMotte Park - Outdoor Recreation Grant
. Mr. March stated the LaMotte Park grant application has been revised, although
there are not any dollars expected to be allotted to the program this year. The DNR
has encouraged organizations to submit the application regardless of the lack of
funding to show outside interest in this type of ~

Main Street Speed Study
Mr. Travis read a letter addressed to Mayor W"Ilharber from 17 year old Jessica
Spanjers who was writing about a speed limit she believes needs to be lowered. Her
proposal is that the speed limit on Main Street, between the school and 20th Avenue
should not be 45mph. It should be lowered to 30mph immediately. Ms. Spmgers
