"'d ., .. ., .. . -, . .. .".... , , ABSENT: None STAFF: City Administrator Dallas Larson City Engineer Mark Statz CALL TO ORDER - Local Board of Appeal and Eaualization Hearin2 Mayor Capra called the April 25, 2007 Anoka County Local Board of Appeal and Equalization Hearing to order at 6:30 p.m. Ms. Crystal Huss, Appraiser, explained the 2007 assessment is for home values and not taxes. She stated an assessment was done on 44 new homes or 2.8% in 2006. She explained that the State requires that homes be revalued every five years and this is the fifth year. She commented that Centerville had an increase of 5.4% estimated market value. She explained that the State requires that assessments be between 90 and 105% of the market value; Centerville is at 94%. She commented there were 75 home sales reported in 2006. Motion bv Council Member Paar, seconded by Council Member Broussard, to close the Local Board of Appeal and Eaualization Heario2 public hearin2 at 7:00 p.m. All in favor. Motion carried unanimously. I. CALL TO ORDER Mayor Capra called the April 25, 2007 City Council Meeting to order at 7:00 p.m. II. PUBLIC HEARINGS None / City of Centerville Meeting Minutes April 25, 2007 III. APPROVAL OF AGENDA Mayor Capra requested the addition of page 13a to Item 1. She also requested the additions of pages 22a-22g, Encroachment Agreement - Mr. & Mrs. Mark Cunningham, 7130 Brian Drive (Fence Encroachment) to Item 6, pages 22h-22k, Encroachment Agreement - Mr. & Mrs. Matt Dunn, 6961 Meadow Court (Fence Construction) to Item 7 of the Consent Agenda. Mayor Capra requested the removal of Item 2, Resolution #07- OXX, Establishing an Economic Development Authority (EDA) and Item 3, Appointment of EDA Members under Old Business. Motion carried unanimously. VI. A W ARDS/PRESENTATIONS/APPEARANCES 1. Mr. Greg Kieselhorst, Centerville Lion's - Fete des Lacs a. Special Event Permit Mr. Greg Kieselhorst, Centerville Lion's reported this is a special permit application for a temporary 3.2 Liquor License and noise permit for two evenings. He stated a live band would be added on Friday evening, as well as, the battle of the teen bands. He reported there would be a live band after the fireworks as well. He stated it is similar for Saturday night. Mr. Kieselhorst explained he is requesting an extra hour on the noise permit and an extra hour on 3.2 liquor sales. He stated this would recoup some of the cost for the main attraction. He commented fireworks would be held on Sunday night should one of the other nights be rained out. Councilmember Lee questioned if the fireworks came in at budget. Mr. Kieselhorst stated that the proposals were $4,000 for each night. He stated this is the third year of a three-year contract. Mayor Capra expressed concern with the noise extension to 1 :00 a.m. and liquor sales to 12:30 a.m. She stated midnight is palatable, but the neighbors might object to 1 :00 a.m. She questioned if the bands would be playing the entire time. Mr. Kieselhorst stated that Uncle Chunk would play for 120 minutes. He stated they are paying a set dollar amount for the bands. He commented the bands would play for the advertised times. Councilmember Lee questioned whether the extension was to recoup costs associated with the headline bands. Mr. Kieselhorst concurred. He commented there have not been significant issues in the past. Councilmember Lee asked if the later time was for Saturday evening. Mr. Kieselhorst concurred. Page 3 of7 ,3 City of Centerville Meeting Minutes April 25, 2007 Councilmember Lee stated he was inclined to agree, as it is only one night and other liquor establishments are open until 2:00 a.m. He stated he fully understood the reasonmg. Mr. Tom Peil commented from the audience that it is Centerville's 150th anniversary. He commented the Lions are not asking for this every year, just for this special occasion. Mayor Capra replied that the Lions and the City are both putting up a significant amount of money. Mr. Kieselhorst stated increased security would be provided for both Friday and Saturday to check identification. Discussion ensued regarding the requested additional hour for both the noise and liquor sales. Motion by Council Member Broussard. seconded by Council Member Lakso. to approve the temporary 3.2 Liquor License at Laurie LaMotte Park on Friday. AU2:ust 3. 10:00 a.m. to 11:30 p.m.. Councilrnernber Broussard asked if the individuals hired for security would give a certificate of insurance to the Lions. She explained what and how certificates of insurance should transpire regarding insurance. Mr. Kieselhorst replied he would find out. DSU/Bonestroo Contract - Comprehensive Plan Amendment City Administrator Larson reported DSU/Bonestroo submitted an updated proposal for the comprehensive plan amendment for $3,000 less. Mr. Larson stated that they would bill per hourly rate which may result in a greater decrease in the amount. City Engineer Statz explained a one-page addendum was written to the contract rather than rewriting the entire contract. Motion by Council Member Lakso. seconded bv Council Member Lee. to approve the DSU/Bonestroo Contract and the Addendum. Comprehensive Plan Amendment. All in favor. Motion carried unanimouslv. 2. Resolution #07-0xx. - Establishing an Economic Development Authority (EDA) This item was removed from the agenda. 3. Appointment of ED A Members This item was removed from the agenda. 4. Resolution #07-0xx., Rescheduling Public Hearing for Construction of Street Improvements - Old Mill Road City Administrator Larson reported Council, at its last meeting, scheduled a public hearing for May 9, 2007 for the Old Mill Road Project and authorized an appraisal to measure the value of the property. He reported staff did not have the appraisal information at this time. He stated staff is requesting a two-week postponement and extend the hearing to May 25, 2007. Motion by Council Member Lakso. seconded bv Council Member Paar. to approve Resolution 07-0XX. a Resolution Rescheduline: a Public Hearine: for Construction of Street Improvements. Old Mill Road. All in favor. Motion carried unanimouslv. 5. Schedule Public Hearing for Amending and Restating Resolution #06-046 City Administrator Larson stated Council adopted a resolution establishing the EDA, however, in the original establishing resolution; the outside two members were limited to city residents. He stated the amendment could not be completed without a public hearing. A discussion on the amended resolution ensued. Motion bv Council Member Lee. seconded by Council Member Lakso. to approve Calline: a Public Hearine: for Amendine: and Restatine: Resolution 06-046. All in favor. Motion carried unanimously. 6. Acceptance of Submitted Bid for the Purchase of the 1986 Ford CC CDL Plow City Administrator Larson stated one bid was received for the 1986 Ford CC CDL plow truck in the amount of $9,611.00. He recommended Council approve the bid offer. Discussion ensued regarding the bid process. Motion by Council Member Lakso. seconded by Council Member Paar. to Accept the Submitted Bid for the Purchase of the 1986 Ford CC CDL Plow in the amount of $9.600.00. All in favor. Motion carried unanimously. VIII. NEW BUSINESS None IX. ANNOUNCEMENTSIUPDATES 1. City Administrator Larson City Administrator Larson reported Centerville received grants amounting to $788,000.00 towards Phase I. He commented additional grants would be submitted at a later date for Phase II as part of a livable communities' project. City Administrator Larson reported the relocation of utility lines should happen in early June. He commented Anoka County has not made bid notices for CSAH 14 yet as the State approval has not been obtained. Mayor Capra reported the traffic count on 20th Avenue was completed over Easter weekend and the result indicated it did not warrant a second eastbound left turn traffic lane. 2. Centerville Sesquicentennial a. LaCompany Mayor Capra reported she received a letter from them and they have agreed to participate on August 4 & 5, 2007 with the understanding that they provide an interpretive fur trade event. LaCompany has requested to camp on site at the park for the event and they would be cooking outdoors.both Friday and Saturday evening. Mayor Capra indicated Page 6 of7 10 City of CenterviIle Meeting Minutes April 25, 2007 that a fire permit would need to be issued for their cooking event. She commented that LaCompany would serve fresh squeezed lemon aide on site. She commented the cost is $350 per day for their services. Councilmember Lee asked if the Council would be interested in having other reenactment activities. Mayor Capra replied if space is available. Mayor Capra indicated this would be on the next agenda for approval. b. Aerial Photo Project Mayor Capra stated she would talk to the photographer about aerial photos and report back at the next meeting. 3. Business Appreciation Dinner - Schedule Date Discussion ensued regard the event date and consensus was to hold the Dinner on June 14,2007 with an alternate date of June 12,2007. Discussion ensued on the speakers, agenda, and logistics. Mayor Capra reported a study for the Rush Line Commuter Bus line was approved. She indicated public meetings would be held on June 19 and June 21,2007. She stated details would be forthcoming. City Administrator Larson questioned whether Council desire to have a commemorative souvenir for the City's Sesquicentennial. Discussion ensued regard a souvenir and consensus was reached to research items. x. Present were Mayor Mary Capra, Council members Linda Broussard, Michelle Lakso, Tom Lee and Jeff Paar. Also present was Administrator Dallas Larson. The purpose of the closed meeting was to complete the annual personnel evaluation of City Administrator Dallas Larson. The Council reviewed their evaluations of Dallas Larson each giving high marks for his work and all expressed their satisfaction with his performance. Mr. Larson expressed his appreciation for their remarks and confidence. Larson was excused from the meeting briefly while the Council discussed compensation issues. The meeting was reopened to the public at 8:20 p.m. A motion was made by Council member Lee that Larson be given a satisfactory review and that due to exceptional performance and in recognition of the council's satisfaction with Larson's work, that his salary be increased to Step 9 in pay grade 14, effective July 1, 2007. The motion was seconded by Council member Broussard-Vickers, all present voted in favor. The motion was declared passed. This area has been neglected for the last few years. Mr. Weigel would like to redesign the retaining wall making a compete oval with two layers. He would then add natural grasses and flowering plants, along with mulch. The basic time line of this project would be to have it completed by August. City Staff has been looking at a variety of vendors for a City entrance sign, park sign for Hidden Spring Park and to replace the other park monument signs. Mr. Weigel would remove the old sign and install the new one. Mr. Weigel would do fund raising for approximately half of the project. This project needs to be approved by the Eagle Scout Council, which Mr. Weigel felt would take place next week. He will then submit a complete proposal with a budget. Motion was made by Vice-Chairperson Amundsen, seconded by Chairperson Seeley to recommend to City Council supporting Mr. Weigel's Eagle Scout project as presented with potential for funding of half of the project not to exceed $500. II MEMO TO: Honorable Mayor and City Council Members FROM: Kim Stephan ~ DATE: May 4, 2007 SUBJECT: Ollie & Co., Proposal for Skate Park Competition Penny Evenson, Ollie & Co., an indoor skateboard park located in Ham Lake, had contacted City Staff regarding potential for a skateboard competition to be held at Wheels Skate Park and asked to be put on the Agenda for the May meeting. Attached is the proposal, as well as a copy of their Certificate of Liability, the waiver that they require be signed by each competitor over 18, and parents of each competitor under 18, and the proposed methods of advertising for the event. The event is being proposed for Saturday, June 16, 2007 with an alternate rain date of the following Saturday, June 23, 2007. The usual number of participants is 30 - 50 competitors. Ollie and Co. staff will include 3 of their 5 man competition team that recently finished 12th in the nation. This team will provide demonstrations, as well as be the judges. Each competitor will be given two (2) individual runs. Prizes are provided and a nominal fee is charged for each participant of $5. Ollie and Co. insurance covers participants, staff and property. Helmets are required of all participants and will be proved by Ollie & Co. if necessary. First aid kits are on hand. Ollie & Co. Staffwill clean the area following the event. Ollie & Co. also does camps, parades, and demonstrations if this is something the City would be interested in. The purpose of these events is to provide role models for the kids interested in this type of activity, give guidance and exposure to the indoor skate park. We provide 12,000 sq. ft. of indoor skateboarding rush! Our facility is also friendly to inline rolJer blading and BMX biking. Our park features many quarter pipes, 2 wall rides, various hubbas, 8-stair, double set stairs wI down rail, manual platforms, a bank-to-bank ride, mini ramp, as well as down rails and flat rails. We have ramps that welcome the beginning skateboarder and ramps that chalJenge even the most experienced rider. Ollie & Co. offers a year 'round, structured indoor skateboard arena that always has adult supervision. It gives parents a great satisfaction to know that their children can skateboard in a healthy arena that offers social relationships and new friendships with others, physical activity, and supervision. We would like to bring this concept to your outdoor skate park. In an effort to continue promoting great social relationships and physical activity for skateboarders who use your community park, we ask the Council to allow us the opportunity to host a skateboard competition at your skateboard site. This competition will give area kids the opportunity to have fun in a competition-style format and to win great skateboard prizes! Kids love competitions that alJow them to perform at their ultimate level and show others their super tricks, etc! Ollie & Co's Skate Team will also be on hand to judge the competition and to skate with the kids. It's a great way for kids to learn from positive role models and to realize the importance of developing healthy and productive skills. The competition format gives each skateboarder a 1.5-minute individual "run". Each run is scored on a scale from 1-10. Totals of both runs are used in determining the final winners. Prizes would include skateboard decks, skateboard accessories (bearings, wheels, etc), t-shirts, and discount coupons. A small product toss would be held after the event. A "product toss" is when our skate team throws skateboard accessories (bearings, wheels, stickers, skate magazines, skate tools, etc) into the crowd. There would be a nominal registration fee of $5-10 per entrant in order to help Ollie & Co. recover some costs. /) . I acknowledge that skateboarding, in-line skating and/or riding BMX bicycle at a skate park entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: Collision with other participants, the walls and other fixed objects; falling down; my own equipment; failure or the failure of other's equipment; my own or others negligence; and objects or conditions on the surface that may cause me fall; broken bones, sprains, head and back injuries, abrasions, and bruises. Furthermore, US employees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction. 2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in the activity is purely voluntary, and I elect to participate in spite of the risks. 3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless US from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of US's equipment or facilities, including any such claims which allege negligent acts or omissions of US. 4. The committee considered Centerville Park as a tribute to Centerville and Centerville Lake, but thought there would also be confusion as many people refer to the beach at the Anoka County Chain of Lakes Regional Park as Centerville Beach. The committee felt Centerville Heritage Park was too long and did not feel the use of the word 'landing' would be appropriate as there is no landing and did not want to misrepresent the park as having a boat landing. The committee's vision for this park has the theme of educating the public in eco-conservation, environmentally friendly and ecologically sound ways to preserve our green spaces. The committee plans to use rain gardens, permeable, porous type materials for trails, lake shore restoration with native plantings and the use of the artesian well in some type of natural fashion, perhaps having the water run into a swale or a pond. The committee would like to name the park after the artesian well that was found on the property and call it Hidden Spring Park. Motion was made by Vice-Chairperson Amundsen, seconded by Chairperson Seeley to recommend City Council consider naming the park at 1601 LaMotte Drive Hidden Spring Park. All in favor. However, this lot has a substantial drainage easement in the rear yard, leaving insufficient space for the proposed deck. In accordance with your policy, I told the property owner that the City would not be able to issue a permit for construction of the deck in the drainage easement but that they could request that the easement be reduced if the engineer determines we not utilize the entire easement in the future. The property owner provided a deposit to cover the engineering cost of the review and Mark Statz was requested to examine the situation. Mark determined that the City would not utilize the entire easement area and that it would be possible to release a portion back to the property owner allowing the proposed deck to be constructed. You may recall that we did one of these releases a couple of years ago. At the time, the City Attorney (Jim Hoeft) determined that the City could do a simple release of easement much like a quit claim deed. The current City Attorney has a different take. He believes that State Statute requires an easement to be vacated much like we do with a street. That process requires a public hearing and the process takes about 45 days to complete. The property owner wishes to proceed with vacating a portion of the easement but would like to begin construction of the deck in the interim. That could be allowed by approving an encroachment agreement if the Council desires to accommodate the request. This is on the agenda for your consideration. Enclosed is the build out with the features of the truck. The cost for these trucks is $22,640.00 plus tax and license. The dealer, Elk River Ford is willing to give the city $17,500.00 trade-in on our current 2005 Chevy trucks that have 5,xxx and 7,xxx miles on them. Actually resale value is probably higher, but the work truck market is currently not strong. The original cost of the 2005 Chevy trucks was $22,942.00 plus tax and license. If the city chooses to trade the current trucks for the new 2008 Fords. our total cost will have been $6,034.00 per truck for two years with a new basis in the 2008 Fords of $23,010.00. The other option would be to put the current trucks out for bid on ebay or similar and try to receive more than $18,800.00 to break even on the equivalent trade-in scenario. History In 2003, the City commissioned a Pavement Management Study which evaluated the condition of all streets in town and set a recommended schedule of improvements including, seal coats, overlays, and reconstructions. Also considered in the study, were streets which were not yet serviced with City water main. Street improvement projects were proposed to coincide with those utility installations. The study proposed two seal coat projects, one in 2004 and the other scheduled for 2006. In 2004, the city seal coated most streets recommended for said improvements in that year. The streets scheduled for seal coating in 2006 have not yet been completed. The study also laid out two street improvement projects, one scheduled for 2004, and the other for 2009, In 2004, the city undertook a larqe street and utility improvement project covering most streets desiqnated for that year by the study. Feasibility Study In order to ensure recommendations of the 2003 study are still appropriate four years later, it would be worthwhile to reevaluate all streets not reconstructed as part of the 2004 project. A feasibility study should be ordered by the Council to do the following: . Evaluate the condition of all streets not reconstructed in 2004 and older than 3 years, The City Engineer, with the Public Works Director should conduct this investigation, % St. Paul St. Cloud Rochester Milwaukee Chicago City of Centerville 2009 Street and Utility Improvements Project Page 2 April 79, 2007 . Review sidewalk needs (both new and repair) with staff. Does not include inventory/evaluation. . Determine areas in need of water main improvements . Evaluate existing sanitary sewer condition through a review of recent televising tapes/reports. Recommend areas in need of repair or replacement. . Determine areas in need of storm sewer improvements. . Review other utility needs with public works staff. . Incorporate the results of the 2006 drainage study. . Determine size, type and specific proposed locations for infiltration BMPs. This does not include easement negotiation or on-site meetings with property owners. . Determine an appropriate level of improvement for each street segment. In general, the improvements would range as follows: o No improvements o Seal Coat o Edge Mill and Overlay o Full Bituminous Removal and Replacement, add drain tile o Full Road Bed Reconstruction - Curbs Remain In-Place, add drain tile o Full Reconstruction to City standard road section . Estimate rough per-foot costs for each type of improvement. . Estimate assessments ranges for each type of improvement. . Determine properties to be assessed. This will require significant cooperation with City staff. . Produce a color coded map showing each street segment and its associated recommended improvement. . Outline a complete project schedule. The Feasibility Study would not require extensive preliminary survey work and would not produce detailed drawings or evaluate detailed street grades. Permitting would not be possible at this preliminary stage and would need to wait until plans and specs were produced. Public Open House In order to engage the public in discussions regarding the scope of the project, the information contained in the Feasibility Study should be shared with them. The best way to do this is to hold a public open house where a short presentation could be given and then the meeting would be broken down into an informal setting where several tables could be set up with City staff and engineering staff members available to answer questions on a one on one basis. At the public hearing we would present graphics showing the proposed improvements in a general way. We would also provide the public with estimated assessment ranges and a proposed project schedule. Fees Our fee estimate is based on our past experience with these types of projects and on our early estimates which put the project between $6 and $ 7 million dollars. In order to produce the feasibility study, cost estimates and graphics needed to take the project through the Public Open House, we estimate our fees to be $45,000. f/p .
