Bennett and Koch Construction has beenin business since
September 4,2003. It is a construction business that does residential and
commercial construction projects. The building that we would like to lease
will be used for storing construction tools, supplies, equipment, etc. The
outside of the building will be used to park construction vehicles and trailers.
There will be approximately three people coming and going from the
building. The employees could be coming and going Monday through
Friday; 7:00 am- 6:00 pm andpccasionally. onthe.weekendthe owner may
be at the building.

scheduled meeting on July 3, 2007, at 6:30 p.m.

Chair Hanson opened the public hearing at 6:3S p.m.
Chair Hanson noted that no representatives from Bobby &; Steve's were in attendance;
therefore, Plartning Commission questions could not be answered. He asked for
comments ftom. the audience on this subject.
Mr. Brad Olson, 1983 South Robin Lane, stated that he is concerned about the hours of
operation, the lack of a noise barrier, and future plans for the property. He reported that
he bad problems with the property since Performance Auto leased the space.

city Clerk Bender reported that Bobby" Steve's is operating without a Conditional Use
Permit (CUP).
Chair Hanson reiterated that no representative of Bobby " Steve's is present to answer
questions.
Vice-Chair Klennert-Hunt stated that the next step is to stop any business activity as they
are operating without a CUP.
Commissioner Love stated that this would give the City an opportunity to clean up the
neighborhood, and create a buffer from the residential area. He commented that he also
has an issue with the tact they have not appeared before the Planning Commission.

Mr. Brian Clancy, 1882 Center Street, questioned the Planning Commission about the
variance application process. He stated that he is unsure how a hardship is proven. He
pointed out that when the house was built, the home was built in the current location due
to a flood plain; however, the property is no longer in a designatM flood plain. He
commented that.because the house is not centered on the property, he could not add the
stallIstorage without a variance, as could his neighbors. He asked the PlAnning
Copnnission what information they would like ftom him.
Commissioner Fehrenbacher questioned whether building a detached garage was an
option.

Mr. Clancy replied that a detached garage is not an option due to drainage and cost. He
stated that his neighbor to the west does not have a problem with their desired
construction plans.
Chair Hanson stated that this would not be unique to his property, as he believes several
other homes would have similar issues. He remarked that it would be bard for Mr.
Clancy to meet the variance requirements.
Commissioner Fehrenbacher commented that he understands there are unique situations
in this case; however, he bad a bard time justifying this request for fear of setting
precedence. .
Commissioner Love questioned whether there is any way to document that the house was
set off' center due to the flood plain when originally built.
Mr. Clancy replied that he could provide documentation. He commented that the
distance between his garage and the neighbor's property is SO feet.
City Clerk Bender stated that there are no drainage or utility easements identified on the
Certificate of Survey.
Discussion ensued.
Chair Hanson stated that he would have a hard time granting the Clancy's request.
Commissioner Pangell commented that if the neighbors are in agreement, he would be
more in line to consider it; however, there are standards set that must be considered.
Commissioner Love agreed with Commissioner Pangell; however, if the house was built
in the current location due to a flood plain, consideration should be given now that the
flood plain designation has changed.
Vice-Chair Klennert-Hunt stated that the opportunity would be to look at the hardship
created by the flood plain and what the Rice Creek Watershed District would allow.
Chair Hanson directed Mr. Clancy to look at the flood plain issue and contact the Rice
Creek Watershed District on options.
Mr. Matt Collova, Collova Building, commented that the C1ancys have been thinking
about this pretty bard. He commented that the cu.rrent plan is by far the best solution for
the Clancy's life style. He stated that, from a design point, the livability issue would be
best with the third stall added to the garage.

city Clerk Bender reported that many pools without fences exist in Centerville. She
requested that the Planning and Zoning Commission consider what types of pools should
be fenced. She stated there is information in the City Ordinance that references fence
requirements around a pooL She questioned how enforcement would be carried out.
Discussion ensued.
City Clerk Bender stated that the pool and fence issue would appear on the August
pl,-nning and Zoning Commission agenda.

Purpose
Thls memo Is intended to describe the purpose of the next joint meeting of the P1aMIng Commission and
City Coondl as part of the Comprehensive Plan Update, and remind recipients to review the draft of the
updated Goals and polldes sec.tlon of the Plan.
Preparation for August ."., MeetIng
At the next meeting for the Comprehensive Plan Update, Bonestroo wiD facilitate a discussion about the
draft of the updated Goals and PolJcles section of the Plan. This draft Is attached to this memo. The
Planning Commission, along with the Park and Recreation Board, have already reviewed the Goals and
Policies section from the 1997 Comprehensive Plan and recommended changes. In the attached draft,
these changes are shown in red text.
Bonestroo was asked to review the updated Goals and Policies and identify arry potential gaps or
necessary additions based on our knowledge of the City and feedback from the Planning Commission
and City Coundl we have received since the beginning of the process. We have made suggestions for
changes to make the goals and poJldes more concise and specific, with a focus on the ultimate
Implementation of the policies. In the attached draft, these changes are shown In blue text.
In preparation for the next meeting, we encourage members of the Planning Commission and City
Coondl to review the attached draft and think about the following questions:
1. Is there a topic missing among the goals and potIdes (the Olrrent topics are land use,
residential, commerdal, Industrial, transportation, parks and recreation, natural resources and
community facUlties and servIces)?
2. Is there a planning Initiative missing (for example, promoting senior houslng)?
3. Is there a goal or policy you don't agree with?
At the meeting, we will facilitate a dlsOlsslon about these questions, and using your Input, draft a final
version of the Goals and Policies that win be used as part of the 2008 Comprehensive Plan.

It is the goal of the City of CenterviDe to:
. Promote safe neighborhoods and low ccit:ne in the community.
. ~ Maintain and improve the quality of life in the C()t'nl'ftunity.
. Provide efficient and responsive services to residents and businesses.
. Maintain the quality of education available to relIi~.

It is the policy of the City of CenterviIle to:
. Compare the level of administrative. maintenance and emergency response services
to cornnn..,..ity' wide needs and objectives.
. Explore potential joint service initiatives through continued communication and
cooperation with City. County and School officials.
. Promote effective conununication with residents. business owners. educators and
volunteer organi2:ations to maintain an understanding of community goals and
objectives and participatI: in community affairs.
. A~ually evaluate the level of public services provided and the associated costs of
senices.
. Design public utility systems for optimum development or saturation in the
community and establish cost effective staging or sequencing of utility sysUlnlS.
. Establish priority for basic services to ensure the highest levels of safety and
accessibility are provided in the CQWf1)11nity.
. Expand efforts for effective communication and cooperation with surrounding cities on
atea growth Issues and common conc:ems.

. Require that development proposals are consistent with planned extensions of public
utilities and incotpotate necessaty extensions of core factJttie-'l.
. Prohibit development with private utilities.
. Require that the installation of all public infrastructure is designed and
const:ructed according to City standards and sped6catinos.

. Establish ordinance provisions which require connection of existing homes and bus mess es
with private utilities to public utility systems, within a reasonable time after public:

connected.
. Enforce provisions of MPCA Chapter 7080 for the licensing, design,
installation and _~llnce of private on-site waste treatJnMlf'systems.
. Establish design and construction standards for sanitary sewer installation and
maintenan.ce to minimw,e potential sow:ces of inflow/in6ltration in the sewer coJlection system.
. Continue monitoring potential sources of inflow/infiltration to reduce
ineffi~ in the metropolitan wastewater treatment system.
