The said hearing will take place Oll Tuesday, September 4,2007, at the Centerville City Hall, 1880 Main Street in the Council Chambers beginning at 6:30 p.m. or shortly thereafter. The Planning & Zoning Commission met on September 4,2007, to hold a public hearing to consider a request of Bennett & Koch Construction, LLC and property owner Will Lesard to operate a construction business at 3995 20th Avenue South. The neighboring property owners within 350 feet were mailed notice of hearing and the notice was published in the official paper. Comments from interested persons were considered in making these findings. Findings: 1) The applicants proposed business qualifies as a conditional use in the B-1 zoning district. 2) The Commission identified adverse impacts that can be mitigated by including additional conditions for a permit. FINDINGS AND RECOMMENDATION:. The Planning & Zoning Commission recommends that the conditional use permit be granted, finding specifically that the applicant can satisfy reasonable conditions that will mitigate the adverse impacts of approving the project and the conditional use permit. The recommended form of permit is attached for consideration by the City Council Dallas Larson, Administrator Draft Draft g) Limits on the noise emitted at the property line to not exceed 70 decibels. The land use categories are the framework upon which the official controls, such as the zoning ordinance and subdivision regulations, are based and provide implementation for growth management strategies. The plan elements contain the regulatory concepts for residential growth, commercial and industrial development and environmental protection. Growth management is dependent on a variety of land use strategies, including planned utility improvements, contiguous development patterns, housing alternatives, planned recreational facilities, continued viability of the existing commercial areas and older neighborhoods, commercial and industrial expansion and anticipated fiscal considerations. Growth Assumptions/Land Availahility Past and projected population and household growth for Centerville and the surrounding area are shown in Tables #1 and #2. An average of 43 new residential housing units was constructed in the City each year between 1986 and 1995. The Metropolitan Council's 1994 Blueprint forecasted the same rate of growth through the year 2020. The 1996 Blueprint forecasts were reduced to an average annual growth rate of 30 households. This plan illustrates a higher rate of growth, similar to the 1994 Blueprint forecasts. It is estimated there are currently 705 acres of vacant land in Centerville. This includes residential, commercial and industrial land inside and outside of the MUSA. Wetlands and floodplain encumber approximately 211 acres of this total. Future development in Centerville will be limited to less than 500 acres, before reaching saturation or optimum development. The Growth Management Plan (Figure #11) identifies the land use designations for optimum development in the City. Neatly 80% of the remaining gross vacant land will be dedicated to residential development, including future parks. The balance of vacant land includes 8% commercial land uses and 12% industrial uses. Net developable land includes 406 acres for residential dwellings, 33 acres for commercial development and 55 acres for industrial land uses. Staging of development should occur in logical, contiguous increments. Future development identified in the Growth Management Plan 1S dependent upon the extensions of public utilities. Five year staging plans will assist the City in evaluating cost effective utility expansions and should reflect the pace of development anticipated. Table #8 identifies the breakdown of vacant land acreage in the City by land use and a five year staging concept for MUSA additions. Right now Alliance Drywall currently spends about $30,000 a year on rent. This is how I justify building a new building for only temporary use. For example if! could temporarily use the property for 10 years that would be over $300,000 that Alliance Drywall would pay in rent. A 3,000 square foot building would be substantially cheaper. If the City of Centerville was willing to work with me on the design, I would be more than happy to make this building whatever size, length X width or out of whatever products necessary to help this building "fit" in the location. Commissioner Fehrenbacher asked Mr. Koch what would be stored outside. Mr. Koch replied trailers, a van, and a storage trailer. Vice-Chair Klennert-Hunt questioned whether the stored equipment would be located inside the fenced area. Mr. Lessard replied that the fence would act as a barrier between the stored materials and the street. Chair Hanson questioned whether the building met the fire codes. Mr. Koch commented that sprinklers were not required because an office would not be located in the building. Chair Hanson stated that the building would still need to meet fire code. City Administrator Larson replied that this would be addressed with the Fire Marshal. Mr. Lessard reported that the buildings did not have a sprinkler system. Commissioner Fehrenbacher requested that staff make sure a buffer separates the business from the residential area. Mr. Lessard expressed concern that the requirements might become cost prohibitive. He stated that he currently pays $17,000 per year in taxes. He indicated that they have been in CentervilIe for 27 years and actively support the community. He commented that he hoped the Planning and Zoning Commission and City Council would take this into consideration. He commented that when he sold some of the property to a developer several years ago, the developer was supposed to add plantings or trees to the berm; however, that did not happen. Vice-Chair Klennert-Hunt commented that she was pleased this business would not have a great deal of traffic in and out of the property. Chair Hanson commented that staff would ensure Mr. Lessard received a list of the requirements. City Administrator Larson recommended that paving the area to limit the dust be considered. Mr. Lessard replied that only about six cars enter and exit the area daily. Application of Multi Web Converting for a Pennit to Build in a B-1 Zoning District City Administrator Larson explained that staff received an application from Multi Web Converting for a permit to build a 12,000 square foot facility for their company's use. He explained that this is to be a printing business. He stated that the permit requires a site- plan review by the Planning and Zoning Commission and City Council. City Administrator Larson explained that the question to answer is whether this is an approved use in a B-1 zoning district. Mr. Dan Gabrielson, Multi Web Converting, described the company's products and expansion plans. Commissioner Fehrenbacher questioned if all production would be done at this location. Mr. Gabrielson replied yes, as it is all custom work. Vice Chair Klennert-Hunt questioned if the company was moving from another location. Mr. Gabrielson replied that they are moving from Roseville. He stated the Centerville site would be their only location. He commented that they are currently leasing and would now like to purchase a building. Chair Hanson requested the hours of operation. Mr. Gabrielson replied that they currently run two shifts and the front desk is manned during the day. Commissioner Fehrenbacher inquired about the number of jobs that would be added. Vice Chair Klennert-Hunt questioned if they did the printing also. Mr. Gabrielson replied that they would do all production operations once they move. Commissioner Fehrenbacher questioned who are the typical customers. Mr. Gabrielson commented that their customers are the end users of their products. Commissioner Love questioned what would be the difference between this business and a retail sales business. Discussion ensued. Consensus was that this business is an approved use for the B-1 Zoning District. Mr. Gabrielson commented that they would like to start construction as soon as possible. Council member Broussard suggested that a site plan review be scheduled for September 4,2007 with recommendations to the City Council for approval on September 12, 2007. VI. DISCUSSION ITEMS City Administrator Larson mentioned a letter was sent to Bobby and Steve's on July 27, 2007 to inform them to cease operating their business immediately. vn.
