Please note the following:
· You are not authorized to begin site work until all pending items are satisfied as
enumerated in the attached Engineer's Report. If project is initiated without
obtaining an RCWD Permit, the project will be stopped by the District Inspector
until the permit is obtained.
. You have 12 months from the date of Board action to submit/satisfy all pending
items and receive a permit. Otherwise the conditional approval expires and a
new application will need to be submitted and considered by the Board. RCWD
staff is not authorized to grant extensions.
· To satisfy pending items, applicants may submit electronic files (.pdf or .jpg
format) to permits@ricecreek.org or 2 paper copies of all submittal items to the
District with the exception of plan sheets. Plan sheets must include 2 full-sized
copies, and 1 reduced size (11 by 17 inches or smaller) or an electronic file.
· Surety - for surety amounts of $5000 or less, the applicant must submit a check
made out to the RCWD. For surety amounts over $5000, the applicant must
provide the first $5000 in the form of a check and has the option of providing the
remainder of the surety amount in the form of a Letter of Credit (see website for
template).
. Easements - if an easement is required per your list of pending items in the
attached Engineer's Report, then the legal descriptions of these easements must
be prepared by the applicant, reviewed and approved by the District, and then
submitted to the County Recorder's Office for recording. An easement template
is on the website.
. Wetland Conservation Act Forms - For projects involving wetland impacts and
replacement, State law requires the preparation and recording of Wetland Legal
Forms for replacement wetlands. Instructions for completing and recording these
forms are included in the wetland legal forms document on the website. The
wetland legal documents require the applicant to prepare legal descriptions of all
replacement wetlands. These legal descriptions and the forms must be reviewed
and approved by the District prior to submittal to the County Recorder's Office for
recording.
. Stormwater Operation & Maintenance - For projects involving stormwater
ponds and infiltration features, applicants must complete and record a
Stormwater Operation and Maintenance Agreement (see website for template)
for these features unless a City assumes the maintenance responsibilities of
these features as indicated in a letter to the District. An exhibit and/or legal
description that clearly delineates and identifies all stormwater and infiltration
features must accompany the stormwater operation and maintenance
agreement. A draft of this agreement with accompanying exhibit must be
submitted to the District for review and approval prior to submission to the
County Recorder's office.

Stormwater Management
1. Revised Grading Plan identifying the eXIstmg FES located
southeast of the onsite wetland serving as the outlet to the
storm water pond located 1,000:1: LF west of this site AND
revising the invert elevations of the proposed culvert at the
south end of the site to be 898.7 to maintain drainage from the
offsite pond.
Floodplain
2. Revised Grading Plan eliminating grading from the drainage
and utility easement along the southern property boundary (see
Finding 4 for further discussion).
3. Revised existing and proposed floodplain' quantification
demonstrating compliance with District 1: 1 replacement
requirements (if necessary per Pending Item 2).
4. Revised SWPPP specifying native deep-rooted vegetation for

Findings:
1. The proposed project entails a 5,000:1:: SF daycare facility on 1.83:1::
'acres. This site is tributary to Anoka County Ditch (ACD) 47.
2. Under existing conditions, runoff sheet flows to the onsite wetlands
prior to discharge to ACD 47. Since less than an acre of total
impervious is proposed, District rate control and water quality
treatment requirements may be waived if infiltration practices are
incorporated to the maximum extent possible.
The proposed stormwater management plan routes parking lot runoff
to a biofiltration basin at the eastern site boundary and roof runoff to
a small infiltration basin / water quality basin in the northwest site
corner. The submitted geotechnical soil borings indicate onsite soils
are not conducive to infiltration; therefore, biofiltration in lieu of
infiltration is acceptable. The water table is expected to be
approximately 895.5:1::, which provides the minimum of 3-foot
separation between the bottom of the basins and the water table.
However, the northwest basin is directly adjacent to the onsite
wetland and is set too low in the landscape to allow for an
underdrain. Therefore, this feature will exhibit more of a wet
meadow-wetland treatment area. Both basins are sized in
accordance with District infiltration requirements and satisfy District
requirements.
EOR surveyed the ACD 47 ditch system and surrounding tributaries
as part of the Lino Lakes Resource Management Plan effort. A 12-
inch stormsewer pipe was identified as part of this survey which
serves as the outlet for the pond located afproximately 1,000 feet
west of this site within the Center Oaks 2" Addition SFRD. This
storms ewer pipe is located within the existing 10-foot offset drainage
and utility easement along the southern site boundary and its outfall

is approximately 200 LF west of the intersection of 20th Ave. and the
driveway south of this site. The survey identified this FES to be
898.65. Therefore, a revised grading plan is required identifying the
existing FES southeast of the large onsite wetland. Additionally, the
inverts for the culvert proposed at the south end of the site below the
parking lot must be lowered to be no higher than 898.7 to maintain
drainage from the existing FES as well as overflow from the
wetland.
3. The submitted wetland delineation report identifies two Type 2
wetlands onsite. The District Wetland Specialist has reviewed and
approved the delineated wetland boundaries.
This project proposes 1,831 SF of Type 2 wetland onsite which is
eligible for the WCA deminimis exemption of 2,500~ SF. The
WCA comment period has expired and all TEP comments have been
addressed. District staff recommends approval of the wetland
exemption based on evaluation of the application in light of
applicable WCA rules.
4. The RCWD regulatory 100-year flood elevation for this site is 904.0
(ACD 47, 1998 RCWD Calibration Study). Floodplain fill is
proposed. The Applicant submitted a floodplain volume cut/fill
analysis for existing and proposed conditions, indicating that
sufficient compensatory storage is provided to satisfy the District's
1: 1 replacement criteria. However, grading for floodplain
compensatory storage extends into the existing drainage and utility
easement along the southern property boundary and it appears that
this would potentially remove the necessary cover on the existing
stormsewer pipe. Therefore, a revised grading plan is required
eliminating grading from within the existing drainage and utility
easement. Revised existing and proposed floodplain quantification
is required demonstrating compliance with District 1: 1 replacement
requirements as necessary per the required grading plan revisions.
The grading plan specifies a proposed lowest floor elevation of
907.0, which satisfies District freeboard requirements over the
regional 100-year flood elevation and the proposed infiltration basin
HWLs and EOFs.
5. An acceptable erosion and sediment control plan has been submitted
including silt fence downslope of disturbed areas, a rock
construction entrance, riprap at stormsewer outfalls, revegetation
specifications and an implementation schedule.
