Reauest for Conditional Use Permit (Bennett & Koch ConstructionfLake Area Utilities) - 6995 - 20th Avenue South Mr. Will Lessard, 6995 20th Avenue, stated that he had a perspective tenant interested in renting his property to operate a warehouse and store vehicles and trailers associated with operating a construction business. City Administrator Larson asked if the property behind this area would be part of the lease. Mr. Lessard replied that it would not be part of the leased property. City Administrator Larson stated that the City has the right to state the appropriate standards that protect the community; therefore, paving and screening could be required. Commissioner Wood commented that he was one ofthe adjoining properties and asked if other equipment would be stored on the property. Mr. Lessard replied that it would be a case of unloading equipment and moving it into the building during normal business hours. Chair Hanson questioned if the building would be used for vehicle maintenance. Mr. Lessard replied that the shop is equipped with an oil separating system and he assumed minimal maintenance would occur in the building. Mrs. Susan Love, 1953 Eagle Trail, commented that the previous tenant o~ the property created a junkyard in her back yard. She requested that a berm or other barrier be created between the business and what they look at every day. Commissioner Love questioned whether an agreement on specific business bours would exist. Councilmember Broussard commented that if a CUP is issued and the tenant did not follow the conditions, the property owner has leverage to evict the tenant. City Administrator Larson commented that the City controls the enforcement and could take action to impose the permit conditions. AU in favor. Motion carried unanimouslv. IV. OLD BUSINESS 1. Site Plan Review - Multi-Web Processing (Stone Construction) Mr. Lessard replied that this company did not work weekends. Discussion ensued. Chair Hanson inquired about paving the area. Mr. Lessard replied that paving is cost prohibitive. He commented that the minimal access into and out of the property did not justify paving the area. Commissioner Love inquired about landscaping plans. Mr. Lessard replied that screening such as a privacy fence was considered. Chair Hanson asked if all debris from previous tenant bad been removed. Mr. Eric Bladholm, Stone Construction, provided updated site plans and discussed the same. Mrs. Jennifer Anderson, 1965 Center Street, requested that an eight-foot cedar privacy fence be built. She stated she would like some of the trees saved also. Mr. Bladholm agreed to provide appropriate landscaping and a privacy fence. Mr. Lessard replied that there are a few items left to clean up. Consensus reached to require the building design fit into a commercial district. Discussion ensued. The Planning and Zoning Commission recommended that Stone Construction come back with a plan with the recommended changes to include the roofline, entrance, fencing, landscaping, road improvements, lighting, windows, and verification of the property dimension. City Administrator Larson requested that Mr. Bladholm submit the new site plan to him for review and comments to make sure nothing has been missed. He stated that he would send this to the Commissioners for review also to speed up the process. 2. Site Plan Review - Mr. Grell; Watson Construction Design/Build (Davcare Facility at 6907 20th Avenue South Mr. Greg Watson, 6907 20th Avenue South, presented the site plan and described the project details. He commented that a conditional approval was received from the Rice Creek Watershed District. He reported that he is working with Anoka County on the driveway location. Discussion ensued. Council member Broussard pointed out that this is a unique opportunity to share ideas on the looks of this building and the building being built by Stone Construction. Consensuses reached to require Mr. Watson bring back a site plan with the recommended changes to the roof, softening of the exterior, and a balanced appearance. Commissioner Love questioned whether it would be appropriate to look at changing the building requirements in the code so builders have an idea of the standards. City Administrator Larson replied that would be a good idea. J. Review Tax Increment Financing Plan for Kendall Howard Proiect City Administrator Larson explained that the Minnesota law requires this be reviewed by the Planning Commission to determine if the proposal meets the comprehensive plan. He stated the belief is that the Kendall Howard project would qualify for grants and other funding; given that, the TIF amount would decrease. Discussion ensued. Inc. at 6716 CenterviUe Road Mr. Brent Meyer addressed his needs and the reason for the Interim Use Permit request. He stated the business is smaIl with the typical equipment and two staff. Consensus reached that approving this would create a spot zone situation that could set precedence for other properties.
