Mayor Capra called the September 26,2007, City Council meeting to order at 6:47 p.m.

Mayor Capra removed Tax Increment Financing District 1-7 Plan in Development District
#1 from Public Hearings and New Business Item 4, same topic, due to the project having
been withdrawn By the applicant.
Mayor Capra added page 11 a to the Consent Agenda.

1. Superintendent Dr. ROller Womer School District #12 - AnnUAl District Report
Mayor Capra announced that the School Board nominated Dr. Womer as the
Superintendent of the Year for the State of Minnesota.
Dr. Womer presented the Centennial School District #12 Annual District Report. He
stated this report is available on the school district's web site. He presented the major

accomplishments to include: students excelled in achievement, attendance and behavior;
outstanding evidence of fiscal accountability; strategic plan completed; quality
compensation funded/impJemented; Language Arts/reading curricula adopted; world
language curricula adopted; and the all-day kindergarten implemented.
Dr. Worner reported that the operating levy referendum money paid for 27 new teaching
positions, ten statf and paraprofessionals, textbooks, supplies, activity fee reduction, extra
curricular programs, team transportation, an assistant principal, and gifted reinstatement.
2. Centerville Lions Club - Annual Haunted Ho,!se
Mr. Terry Sweeney, Lions, requested permission to run the annual haunted housc again
this year. He slated thi s would be the 15th year the Lions have hosted the annual haunted
house
Mayor Capra stated Council's concerns have been based on the recommendations of the
Fire Department.
Mr. Sweeney reported insurance has been obtained.
Councilmember Paar stated that if all the issues are addressed, he sees no reason why the
Lions could not do this.
Councilmember Lee inquired as to whether all the issues listed were addressed last year
and asked what prompted the additional items on the list
Mr Sweeney replied lhey were not.
Mr. Davc Bruder, Fire Inspector, stated that when he was informed last year that the house
would be med, he had time to address only the life safety issues. He commcnted that this

year he had additional time to inspect the housc.
Mayor Capra stated that in the event the building is used next year, meeting tire and safety
codes would be required.
Mr. Sweeney replied this building would not be used in the nlture.

CenterviIle Lions Club reQuest to host the Annual Haunted House based on the items
listed in the recommendations of the Fire Department and Building Official. All in

City Engineer Statz reported Bonestroo recommends payment of request #3. He stated
there would still be money withheld for the rain garden plantings, a swing bench, and the
five percent retainage fees He stated the amount owed after this payment would be
approximately $15,000.
Mayor Capra questioned if there was anything of concern still on the list.
Councilmember Paar commented on the plantings and stated that he would prefer to wait
until spring to plant and begin the one year warranty at that time He stated that he is
disappointed in the well. He stated his biggest concern is the shoreline restoration. He
indicated he is confident and trusts that Bonestroo would fix this.
City Engineer Statz stated that Bonestroo would take the responsibility for the shoreline
concerns and issues. He requested Viet receive payment as they performed per
specifications.
Council member Lee stated he ab'1'eed with Councilmember Paa!'. He believes the shoreline
was built as designed and the water feature built to function properly. He stated that he
believes Viet built per the design.
Motion by Council Member Broussard, seconded by Council Member Lakso, to
approve the Viet & Companv, Inc. Pay ReQuest #3 - Hidden Sprin\: Park
Improvements in the amount of $50,199.04 based on Council observations and the
recommendations ofthe City Enl!ineer. All in favor. Motion carried unanimously.
City Engineer Statz questioned if Council would prefer Bonestroo bring forward the final

Couneilmember Lee commented he preferred the contract be held over. He would also like
the shoreline restoration completed prior to the lake freezing over.

City Administrator Larson eXplained that this is a replacement to the previous agreement
He pointed out it references Police, Public Works, and the Fire Department.
City Attorney Glaser commented that this was honed down to emergency services.

Councilmember Broussard referred to Item 4 and recommended the City Attorney make
sure that, relative to waivers of subrogation, what is asked for could to put on the League
of Minnesota City's policy.
City Administrator Glaser stated that he would check on this.
Mayor Capra commented that looking for mutual aide from much farther away is a better
idea as more than one city within the county could be affected.
2. North Metro Telecommunications Commission Model Additional Franchise
Template
a. Resolution #07-034 Model Franchise Ordinance Utilized by Competitive
Cable Franchise Applicants
City Administrator Larson reported that communities are trying to respond positively and
one allegation from cable companies is that cities impede their ability to provide services.
He stated that all communities would be approving the template and would expect that all
franchisees abide by the same ordinance.
Councilmember Lakso provided additional information and stated the benefits of
approving this resolution.

Mr. John Meyer, Finance Director, explained the process of general obligation bonds for
Fairview Street, CSAH 14, and Old Mill Road.

Councilmember Broussard stated that even though she is voting for this, it goes against
what she originally voted for except for Old Mill Road.

City Administrator Larson explained that Sedona Homes requests a reduction of the
security amount for the Public/Private Improvements completed.
City Engineer Statz reported that there is about $25,000 left for londscaping and paving

6 PutJIic Information Meeting
Mayor Capra reported that this is in relation to the notice thot at the City Engineer would
make a presentation at 4:30 p.m. and a repeat prescntation at 7:00 p.m (and extended to
SOO pm. jf required) on October 4, 2007 on the 2009 street project
City Administrator Larson stated that he spoke to North Mctro about taping the
presentation and making it available to rcsidents

City Administrator Larson called attention to the trees that have been cut down near City
Hall. He statcd that this is in preparation of the pond construction behind City Hall.
Mayor Capra stated that a resident reported the contractor cutting trees was very courteolls.

Mayor Capra reported that a great deal was done at the last meeting. She stated a visitor
from the Coalition to the Unweave the Weave met with the 135 Coalition and asked that
everyone work together as everyone bas the same desire to move traffic. She reported that
Anoka and Washington Counties requested that they look at projects the 135 Coalition
would want to prioritize. She stated that they are requesting a statement with regard to the
Coalition, why the City Council is a member of the Coalition, and the expectations. She
reported that the Coalition agreed to meet in two months and work with the City
Administrators She encouraged City Administrator Larson to work with Mr. Mike
Erickson on a statement for the Comprehensive Plan.
3. ComDrehensive Plan Update
City Administrator Larson reminded Council of the joint meeting on October 2, 2007 with
the Planning and Zoning Commission. He stated the focus would be primarily on the
zoning map.

Planning & Zoning Commission. My name is Dan-in Mosher and l reside at 1949 Eagle
TraiL
I have been a Centerville resident for 14 years and I have a strong desire to contribute to
the well being of the City and its citizens. I have served the City in the capacity of
Committee member on the Parks & Recreation Committee for one year. I believe that I
have been an aggressive participant in the Committee; however, I strongly desire to be
considered for a Commissioner seat on the Planning & Zoning Commission.
I previously participated in the interview process for the committee/commission selection
process a year ago and at that time showed interest in the Commission
Please consider my application for the Planning & Zoning Commission. I believe J
would bring a strong work ethic, knowledgc of the City, have the ability to deal with

Attached is a request from the Centennial Youth Hockey Association for the use of Laurie LaMotte
Memorial Park Hockey Rink for the 2007-2008 season. Following, for your review, is the
recommendations to City Council from the Parks & Recreation Committee for the previous season and
a copy of the signed waiver for 2007-2008. Due to timing this has not gone to Parks & Recreation
Centennial Youth Hockey Association - Use of Laurie LaMotte Memorial Park Hockev Rink for
Drv Land Practice
The Parks & Recreation Committee discussed the use of the facilities for dry land practice and agreed
to the usage with the following conditions:
. A schedule of usage, as well as a contact list of coaches responsible during the time it is being
used will be provided by the association.
. There will be no use of the facilities after 9 p.m. daily.
. The nets will be padlocked when not in use. The key to the lights and padlock will be supplied
in a lock box by Public Works.
. The Centennial Youth Hockey Association will sign a waiver releasing the City of Centerville
from any liability and will take responsibility for any damage occurring while the association is
using the facilities.
The following recommendation was made by the Parks & Recreation Committee at the August 2, 2006
Parks & Recreation Committee Meeting.
Motion was made by Committee Member Amundsen, seconded by Committee Member Seeley to
recommend to City Council approving the Centennial Youth Hockey Association's use of dry
land time with the use of the park lights at Laurie LaMotte Memorial Park with the above
conditions. All in Favor: Motion passed unanimously.

Centennial Youth Hockey Association - Use of Laurie LaMotte Memorial Park Hockev Rink for
the 21l06-2007 Season
CYHA would like to use the rink for outdoor ice as they have in the past and are requesting extended
dedicated hours. Thc committee discussed the association's request for additional ice time and opted
to keep the days and hours the same as in the past seasons, allowing Centerville residents access to the
ice with the exception of 8:00 - 9:00 p.m. Monday through Thursday.
Motion was made by Committee Member Seeley, seconded by Committee Member Amundsen to
recommend to City Council approving the Centennial Youth Hockey Association's use of the
hockey rink for the 21l1l6-2007 season with a dedicated half sheet of ice from 7:00 - 8:00 p.m. and
a dedicated full sheet of ice from 8:00 - 9:00 p.m. Monday through Thursday. All in Favor:
Motion passed unanimously.

The CYHA would like to fonnally request to use laMotte Park outdoor hockey rink for
the upcoming 2007-2008 hockey season. As the Oute/oor Ice Coordinator, I will take care
of the initial scheduling of the rinks for outdoor practices and scrimmages. I will pass that
information on to you, as well as the final coaches list, once the scheduling is complete.
The scheduling should be completed by mid December. Also, the coaches/parents will
once again be asked to help shovel the ice surface before and/or after using it.
If at all possible, we would like to extBnd the time available for CYHA, allowing whole
sheets of ice for both hours. At a minimum, we would like to reserve the same hours at
laMotte Park for the 2007-2008 season, as we did in 2006-2007. Any additional ice time
CYHA can schedule would be much appreciated. The days and times from the 2006-2007
season are as follows:

The following waiver is in regards to the use of the Laurie LaMotte Memorial Park ice rink and
access to the utility room for the purpose of using the rink lights. The Centennial Youth
Hockey Association (CYHA) will take all responsibility for any damages which may occur to
the above mentioned property and/or equipment during the scheduled usage. The coach
responsible for each designated time period will ensure the lights are off and the building and
nets are secure. The City of Centerville requests the CYHA notice the city at the termination of
the dry land portion of time so a walk through can be done and botb parties will agree on the
condition of the property at the end of the usage. The CYHA will provide a schedule of use
and a list of coaches using the property to the city before use begins.

We are excited to announce that the upcoming 2008 season will be Centennial Lakes Little
League's 50'h anniversaryl We will be celebrating 50 years of offering basebali and softball
programs to the youth of our community Our League, which began in 1958 with only four
baseball teams and has grown into a complete youth baseball/softball program serving over
1,100 children each summer. In addition to offering children the chance to participate in one of
America's most popular pastimes, our programs have provided participants with opportunities to
develop qualities of citizenship through teamwork and discipline, along with a sense of physical
well being. All of these qualities contribute to making our communities a great place to live'
We believe it is important for an organization to recognize its successes and our 50th
anniversary ments such a time to celebrate the success of our collaboration with local
communities We are forming a committee to coordinate our 50'-' anniversary celebration
activities and we are asking the communiTies we serve to conSider making a donation to offsel
some of the associated costs. It would be so helpful If the City of Centerviile would conSider
making a contribution of $1,000
At this point we envision the actiVities to include a picnic with fun contests games and prizes for

A RESOLUTION ESTABLISHJNG MINIMUM HOOK-UP CHARGE TO CITY
OF CENTERVlLLE WATER AND/OR SEWER MAINS
WHEREAS, the City installed various street improvements and it was determined that
certain property did not receive immediate benefits from such improvements or a lot split
has been accomplished creating a building site which receives unanticipated benefits
from municipal utilities not previously assessed.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCD.. OF
CENTERVILLE. MINNESOTA:
1) Should these unassessed or newly divided parcels request access to City
water and/or sewer mains, the property shall only be allowed to connect
after paying a hook-up charge in lieu of assessment to be detennined by
the Council at the time of hook-up, but in no event shall the hook-up
charge be less than the amounts listed as follows:

Sanitary Sewer............... ............ h.... ...."... $ 7,000
2) If requested by the property owner at the time of hook-up, such charges
may be paid in annual installments with taxes over a period not exceeding

estate taxes.
3) These charges are in addition to the normal Sewer Access & Water Access

Dear Mayor Capra:
In accordance with the provisions of Minn. Stat. 1038.227, Anoka County in October 2007 will
publish notice of a future vacancy due to the expiration of a term on the Rice Creek Watershed
District Board of Managers. The notice publication requirement applies because Rice Creek
Watershed District is considered to be a watershed management organization. The published notice
must state that persons interested in being appointed may submit their names to the appointing
authority which is the county board for a watershed district appointment. For your information, a
copy of the notice which is to be published is attached.
In appointing a manager to the Rice Creek Watershed District, Minn. Stat. I03D.311 is also
applicable. This statute requires a county board, upon the expiration of a term, to appoint managers
for a watershed district from a list of persons nominated jointly or severally by the cities and
municipalities within the district if a list(s) is submitted 60 days before the manager's term of office
expires or to appoint a manager who resides in a city that fails to submit a list. If there is a desire to
jointly submit a list for the manager appointment, you may wish to confer with affected cities and
jointly submit the list. The cities with territory located in the Rice Creek Watershed District are
Blaine, Centerville, Circle Pines, Columbia Heights, Fridley, Lexington, Lino Lakes, Spring Lake
Park, and Columbus.
In order for names submitted to the county to be considered a list under the statutory definition, the
list must contain the names of at least three nominees eligible to be appointed. To be eligible for an
appointment, a nominee must reside within the watershed district boundaries, be eligible to vote in
the district, and not be a public officer of the county, state, or federal government (except that a soil
and water conservation supervisor can be appointed).

In making watershed appointments, there is an additional factor which is to be considered by a
county board. Minn. Stat. 103D.311 requires watershed district managers to be appointed to fairly

NOTICE IS HEREBY GIVEN pursuant to Minn. Stat. 1 03B.227 and 1 03D.311 that a vacancy will
occur on the Rice Creek Watershed District Board of Managers due to the expiration on January 17,
2008, of the term of Don Steinke. Term of appointment is for three years. Managers are eligible to
be reappointed. Persons interested in being appointed to serve on the Rice Creek Watershed
District Board of Managers may submit their names for consideration to the Anoka County Board of
Commissioners, the appointing authority. Minn. Stat. 1 03D.311 permits the cities and towns in the
district to submit a list(s) of nominations to the county board. If a valid list(s) containing at least three
eligible nominees for a manager's position is submitted at least 60 days prior to the expiration of the
terms, the Anoka County Board of Commissioners is required to make appointments either from the
Iist(s) or to appoint a manager who resides in a town or city that fails to submit a list. Since a list
may be submitted, persons interested in being considered for appointment may wish to contact their
city or town to request to be included on a list of nominations. In the absence of a valid list, the
Anoka County Board of Commissioners may appoint any voting resident of the Rice Creek
Watershed District who is not a public officer of the county, state or federal government.

1. Pheasant Marsh 3n1 Addition (000616-03134-0). The only item left to be completed is the
removal and replacement of the bike path trail to correct the ponding O1'eas, which is scheduled
to be completed within the next week or so.
1. Hunten Crossing 3'" Addition (000616-0S141-0), The wear course paving was being
completed at the time of this report. The developer has been contacted and has been sweeping
the roods as they will need to be clean prior to paving.
3. 21" AvenueJBackage Road (000616-05143-0). We are working with the county's contractor
to obtain the remaining fiU for Parcel D from the CSA// /4 project. We Sf!nt the contractor a
letter outlining the conditions/specifications for the soil placement. He is currently reviewing
those conditions and should get back to us soon.
4. Old Mill Road Improvements (000616-06147-0). The Contractor is currently working on the
Installation 0/ water main and services. The pond arfNl Is complete eJWept for the final
placement of topsoil and permanent seeding. Storm sewer construction is expected next week.
The Contractor's schedule has been challenged by utility relocations. We will be drafting a
formal change order to extend the completion date to October Jljh.
5. Fairview Street Improvements (000616-06148-0). The Contractor recently finished the
gravel shouldering along the turn lane and completed the proper striping and signing. Only a
few punch list items remain to be completed
6. Block 7 Redevelopment Grading and Utility Improvements (000616-06152-0). A portion of
the sanitary sewer will be pressure tested to ensure its integrity. The remaining punch list
items will be addressed after the completion of the testing.
7. Centerville Townoffice Park 2nd Addition (000616-06152-0). A project walk-thru will be
completed within a couple of weeks once the Contractor has things ready for an inspection.
8. Clearwater Creek Estates (Banzai Property) (000616-06154-0). Grading is substantially
complete.
9. Hidden Spring Park (000616-07155-0). All items on our list discussed at the last council
meeting should be completed by the 12th with the exception of the rain garden plant
replacements which will be held over until spring. The shoreline will receive some temporary
fixes this fall with plant replacements next spring.
10. Downtown Overhead Power Relocation (000616-07156-0). While we have an easementfrom
Chauncey Barett, there are trees off of the easement that would overhang the line. Xcel is not
okay with that. Property owners have not been especially cooperative because they do not wish
to lose their trees. We are meetinv with R.l <Trant tomorrow to see if we can move the line tn the
Herilaxe Street right of way. The city at/omey helieves we have greater al/thorily there and Ihis
may be all alternative ihai gets the reroute done. The line may /ICed to be moved later, but that
could be done by the developer iJl phase 2. We will know more soon.
11. Comprehensive Plan (000616-07157-0). The Planning Commission alld City Council
reviewed alternative land use scenarios at an October 2nd joint meeting The meeting focused
on discussion of how Centerville will look at filii build-out and how the City could meet and
sustain a population of over 5,000 people. Some discussion also occurred on glliding more
landfor commercial development near the interstate. The next step is a Imblic open house to
presenr all the work done to date on the Comprehensive Plan and solicit feedhack from
residents. The Planning Commissioll and City Council will then review this information and
recommend a preferred alternative. TIlis Open IIouse will he held 011 November 13th
12.2009 Street and Utility Improvements (000616-07158-0). A public open house for the
project is scheduledfor October 4th
13. CSAH 14 Construction Services (000616-07159-0). The Contractor has finished installing
the water main between the lakes, and the residellls along Mounds hail are no longer in
seniice with a temporm}' water main. fhe Contractor is cnrrently installinR the sanilary sewer
forcemain, which is expectcd to he complete and in sen'ice hy early next week.
14. New Pnblie Works Facility (000616-07160-0). We have reviewed the site plan and submitted
our comments to the City The City should decide if there are any of these comments which
they would like addressed by the Owner's engineer before the site is finished. We are assisting
Mr. Larson with wetland issues on the site and will formulate some recommendations for
proceeding with any associated work
IS. Downtown Redevelopment Comprehensive Infrastructure Plan (000616-07161-0). We
presented a draft of the report to City sta}f and the developer. fhe plan is heing revised based
on the COJl1mellts of both parties. Other TORis/icaT andfinancing issues are heing worked out.
