Capra, Mayor Roland Parrucci Dallas Larson, City Administrator November 30, 2007 Memo to Planning & Zoning Commission: Please plan to discuss the following issues for possible rule changes. - 1) 154.006 Definition of Front Yard. Current definition is basically the front 35 feet of a residentia110t. Thus, if the home were set back further than the required setback, an accessory building could be in the front of the principal structure. This isn't a factor in much of the city as most lots are the minimum setback anyway. But on a number of lake lots the home is setback much further than the minimum. In this situation you could construct a detached building in what appears to be the front yard of a home. An alternative to prevent this would be to define front yard as the area between the front of the principal structure and the front property line. 2) 154.023 Site plan review process. I suggest removing the 30 day requirement in (A). Also, the number of copies to submit should change. We do not need sixteen copies. We are better off with a much smaller number of paper copies in addition to electronic versions. .. 3) 154.024 Include language in (B). "Every lot shall receive a minimum of 4 inches of topsoil and all unpaved areas shall be sodded from the curb to the rear line of the principal building. The balance of the lot shall be properly seeded to prevent erosion." 4) 154.110 Fence side setback. A number of people have objected to the requirement to place a fence two feet from the property line where they cannot get the adjoining property owner to agree to a boundary line fence. We hear: "this is a waste of two feet of my property." 5) 154.110 Fences in front yards of commercial and industrial uses. Current rules allow 8 foot fences in front yards of commercial-industrial uses. Do you really intend to allow this? 6) 154.110 Fences in front of residential structures. We may want to refer to front yard rather than front of building. This would clearly indicate that the comer lots may not have a privacy fence in either front side. If this is too restrictive, you may want to limit the long comer side to one-half of the distance from the principal structure to the front property line. 7) 154.110 (C) Barbed wire and electric fencing. Allowed in R-l zone. You may want to restrict this to animal holding areas and not allow it to be used as a boundary fence. 8) 154.110 (E) Swimming pool fencing. Required for any pool with water depth over 24 inches. This may be too broad. 9) 154.130 (A) (2) Language is confusing. 10) 154.150 (M) (1) Do you really want to include the M-1 district? 11) 154.150 (M) (2) I would remove the hearing language regarding site plan review. Other places refer to site plan review, this is the only reference to a hearing. 12) 154.171 Tree planting. Trees should best be planted in the front yard a minimum of 15 feet from the curb line and shall not be planted in a manner that interferes "-- with any current or planned utility line. Trees may not be planted under a power line except those approved by the City for such. 13) 154.130 (A) (3) & 154.140 (B) (1) Setback from ordinary high water mark of lakes and streams. We do not match RCWD 100 foot requirements. 14) 154.170 (I) (Ordinance #19, Second Series) Add requirement for striping of parking stalls on all parking lots for more than five or more stalls. 15) 154.310 City Attorney will be modifying this section to more closely match state law. 16) General enforcement. You wanted to discuss the degree to which ordinances are enforced. If anyone has any other items, we can add them to this list. Thank you. Hansen/Marshall Request for SubdivisionlRe-Platting of Lot Lines (1588 and 1580 Sorel Street) City Administrator Larson explained City Administrator Larson displayed a preliminary and final plat proposal depicting the two lots. He stated this is a logical request to make the square footages and lake frontages equal. He commented there are easements allowed for drainage and other City required easements. He indicated the lots would not meet the normal lot width standard. Chair Hanson opened the Public Hearing at 6:30 p.m. Page lof3 City of Centervill.e Planning and Zoning Commission November 13, 2007 Mr. Alan LaMotte, 1643 Heritage Street, stated he had no problem with this proposal. He stated that his only concern is that the survey seemed to be off by about two feet. He stated the lot lines did not coincide with their lot line. He stated his property was surveyed in 2006. City Administrator Larson explained how the lot lines were determined. He stated if there is a discrepancy, the entire block would likely shift. Mr. Lloyd Hansen, 1588 Sorel Street, stated the surveyor discovered a cement monument and that is where the survey line started. He stated three different surveys were done. Discussion ensued. Mr. Erick Marshal~ 1580 Sorel Street, commented on the lot lines. Mr. LaMotte provided photos of the location of the monument. Mr. LaMotte and Mr. Hansen agreed to meet with the surveyors to sort this out and come to an agreement on the lot lines. Council member Broussard pointed out that a number of properties on the south part of the city were offby two feet when surveyed. City Administrator Larson pointed out there could be easement and/or setback issues should the lot line shift. He noted a variance exists for the lake frontage as it is under the 100 foot requirement. Discussion ensued. Broussard questioned if the non-conforming lot is created, whether it would cause problems for future sale of the property and mortgage requirements. City Administrator Larson replied that it would not be an issue because the variance is part of the proposal being considered. Chair Hanson asked what the benefit is to the applicants for the request. Mr. Marshall replied equal square footage for both lots is the benefit. Commissioner Love volunteered to be the Vice Chair. Motion by Commissioner Wood. secooded by Commissioner Fehrenbacher to elect Commissioner Love as the Vice Chair for the PlaoninS! and Zooin!!
