I suggest removing the 30 day requirement in (A). Also, the number of copies to submit should change. We do not need sixteen copies. We are better off with a much smaller number of paper copies in addition to electronic versions. 2) 154.110 Fence side setback. A number of people have objected to the requirement to place a fence two feet from the property line where they cannot get the adjoining property owner to agree to a boundary line fence. We hear: "this is a waste of two feet of my property." 3) 154.110 Fences in front yards of commercial and industrial uses. Current rules allow 8 foot fences in front yards of commercial-industrial uses. Do you really intend to allow this? 4) 154.110 Fences in front of residential structures. We may want to refer to front yard rather than front of building. This would clearly indicate that the comer lots may not have a privacy fence in either front side. If this is too restrictive, you may want to limit the long comer side to one-half of the distance from the principal structure to the front property line. 5) 154.110 (C) Barbed wire and electric fencing. Allowed in R-1 zone. You may want to restrict this to animal holding areas and not allow it to be used as a boundary fence. 6) 154. 110 (E) Swimming pool fencing. Required for any pool with water depth over 24 inches. This may be too broad. 7) 154.130 (A) (3) & 154.140 (B) (1) Setback from ordinary high water mark of lakes and streams. We do not match RCWD 100 foot requirements. 8) 154.006 Definition of Front Yard. Current definition is basically the front 35 feet of a residential lot. Thus, if the home were set back further than the required setback, an accessory building could be in the front of the principal structure. This isn't a factor in much of the city as most lots are the minimum setback anyway. But on a number of lake lots the home is setback much further than the minimum. In this situation you could construct a detached building in what appears to be the front yard of a home. An alternative to prevent this would be to define front yard as the area between the front of the principal structure and the front property line. 9) 154.130 (A) (2) Language is confusing. New language for consideration: (2) Lots which abut on more than one street shall provide the required front yards along each street for the principal structure. A front yard setback of 25 feet shall apply for an accessory structure to the frontage that is not considered to be the required front yard~ The definition of Yard Front should be amended as well: YARD, FRONT. A yard extending across the full width of the front lot between side lot lines and extending from the abutting street right-of-way line to a depth required in the yard regulations of the district in which the lot is located. On a corner lot the street address or narrowest street dimension of the street shall be the required FRONT YARD. Other places refer to site plan review, this is the only reference to a hearing. 12) 154.171 Tree planting. Trees should best be planted in the front yard a minimum of 15 feet from the curb line and shall not be planted in a manner that interferes with any current or planned utility line. Trees may not be planted under a power line except those approved by the City for such. 13) 154. 170 (I) (Ordinance # 19, Second Series) Add requirement for striping of parking stalls on all parking lots for more than five stalls. 14) 154.024 Include language in (B). "Every lot shall receive a minimum of 4 inches of topsoil and all unpaved areas shall be sodded from the curb to the rear line of the principal building. The balance of the lot shall be properly seeded to prevent erosion. " 15) 154.310 City Attorney will be modifying this section to more closely match state law. 16) General enforcement. You wanted to discuss the degree to which ordinances are enforced. Roll Call n. APPEARANCES/PRESENTA TION(S) None III. PUBLIC HEARING(S) None. IV. OLD BUSINESS Code Revisions. The Commission reviewed a memo dated November 30, 2007, from Administrator Larson detailing sixteen issues for consideration. The Commission reviewed each of the issues in an effort to identify any that should be pursued for changes in the City Code. The items will be placed in a priority order for more detailed discussion at the next meeting. Commissioners will email the Administrator with their opinions on prioritizing the list. The Commission reviewed a draft meeting schedule prepared by the City's consulting engineer, which moved some of the regular meetings because of caucuses, elections and holidays.
