Mr. Lynn Johnson - Request for Public Works Diartment's Assistance with Snow Plowing the Waterworks Parking Lot for the 26 Annual LIOn's Ice Fishing Contest. Mr. Johnson presented his request for assistance with snow plowing for the annual Lion's Ice Fishing Contest. Councilmember Broussard-Vickers requested a written authorization from the landowner. Consider Approval of Power Line Relocation on Heritage Street City Administrator Larson provided the background information on the power line relocation on Heritage Street. He stated meetings have been held with the affected property owners. He recommended that an additional letter would be sent to these property owners after it is approved. Councilmember Paar questioned whether the City would have adequate right of way in this location. City Attorney replied the City always has a right of way in the front yards and that the city has more authority with regard to tree trimming and tree removal if they interfere with the us of the right of way. Discussion ensued. Motion by Council Member Lee. seconded by Council Member Paar. to authorize the Power Line Relocation on Beritaee Street. AU in favor. Motion carried unanimouslv . vm. NEW BUSINESS 1. Resolution #08-001 - Authorizing Appointments for 2008 Mayor Capra stated she spoke to the City Clerk about the Health Officer and to see whether Anoka County had a Heath Nurse that would act as Centerville's Health Officer. Each appointment was reviewed and confirmed. Councilmember Broussard-Vickers was authorized to sign checks in case of the absence of City Administrator Larson. Councilmember Paar was added as the alternate on the Police Joint Powers Agreement Committee. City Attorney Glaser requested that only his name be listed as his partner (Burstein) is leaving the firm. Fire Marshall Milo Bennett will be retiring; consequently, and a new appointee will be required later this year Motion by Council Member Lee. seconded by Council Member Lakso. to aoorove Resolution #08-001. a Resolution Authorizine Aooointments for 2008. City Administrator Larson City Administrator Larson reported the Beard Group requested they be part of the Council Work Session on Feb 13, 2008. Mayor Capra requested this work session be held after the City Council Meeting. City Administrator Larson reported the February 12, 2008 Planning and Zoning Commission meeting would include a review of the draft Comp Plan. He stated a copy would be circulated to Council members as well. City Administrator Larson suggested a joint meeting of the City Council and Planning and Zoning Commission be held on this date to review the draft. Mayor Capra requested that another joint meeting be held in March, 2008 also for a meeting of all committees and the Council. City Administrator Larson reported that Anoka County sent a letter announcing the proposed 20010 increase in assessments for 2009. City Administrator Larson reported that direct deposit was implemented for City employees. 2. Other Councilmember Lee stated the Code of Ethics must be sent to the committees for signatures. Councilmember Lakso reported a resolution from the Cable Commission would come before Council at a future meeting. Mayor Capra reported she would attend the Rush Line Corridor meeting on January 10, 2008. Mayor Capra reported she would attend a medical conference January 19-20, 2008. Mayor Capra reported she attended a Fire Department meeting and training exercise on January 8, 2008. She encouraged Council members to attend these. Mayor Capra reported the Police Commission met January 7, 2008. Councilmember Lee reported the Parks and Recreation Committee met last on January 2, 2008. He reported the approval for modifications of Tracie McBride Park were discussed. Their request states in part: "This request is being made due to improvements not being completed until December 2007. . . " I believe that their request is reasonable and recommend that the Council approve the six- month extension. Dallas Larson, Administrator January 14,2008 Dear City Administrator, Weare formally requesting an extension for the front setback variance that was granted on March 6th. 2007. The variance was approved subject to: 4. This variance shall expire if the approved plan is not implemented and the home constructed within twelve months of the date of the approval by the City Council. This request is being made due to improvements not being completed until December 2007, prohibiting the start of the structure as outlined in the developer's agreement (section 24 D). Houle tervi{{e 'Esta6{isfred 1857 1880 ~ain Street, Centerviffe, ;MW 55038 651-429-3232 or 'Fax.. 651-429-8629 STATE OF MINNESOTA COUNTY OF ANOKA CITY OF CENTERVILLE RESOLUTION #08 - 0_ SUPPORTING LOCAL FRANCHISING PURSUANT TO CHAPTER 238 OF MINNESOTA STATUTES AND FEDERAL LAW AND OPPOSING ANY AMENDMENTS TO CHAPTER 238 THAT WOULD EVISCERATE LOCAL AUmORITY AND ESTABLISH A STATEWIDE FRANCHISING SCHEME WHEREAS, the City Council of the City of Centerville, Minnesota ("City") is the official governing body elected to preserve, promote and protect the public welfare, health, safety and interest of the City and its citizens; and WHEREAS, the City is a franchising authority that is empowered to award non- exclusive franchises for cable communications systems pursuant to Chapter 238 of Minnesota Statutes and federal law; and WHEREAS, Chapter 238 establishes certain requirements with which all cable operators in the state must comply and promotes the fair and equitable treatment of all cable operators; and WHEREAS, Chapter 238, as currently written, establishes certain safeguards and powers for local governments with regard to: (i) compensation for the utilization of valuable and scare public rights-of-way; (ii) local control over the use of public rights-of- way, including (but limited to) permitting, code enforcement, removal of abandoned property and restoration of public property; (iii) the build-out of important broadband networks constructed by cable operators; and (iv) channel capacity and other support for public, educational and governmental access programming; and WHEREAS, Chapter 238, as currently written, establishes a simple and efficient process by which telephone companies and other entities may apply for and receive a local cable franchise from the City and other local franchising authorities; and WHEREAS, the City supports competition in the delivery of multichannel video programming services and is ready to accept and evaluate cable franchise applications from any entity, consistent with federal, state and local laws, policies and requirements; and WHEREAS, numerous competitive cable franchises have been granted by local franchising authorities throughout the State of Minnesota pursuant to Chapter 238; and WHEREAS, statewide cable franchising in other states has not resulted in vigorous wireline video competition, lower prices, improved customer service or the widespread deployment of advanced broadband networks; and WHEREAS, the City does not believe amendments to Chapter 238 are needed to promote competition at this time, and that any such amendments could. among other things, destroy PEG access facilities and programming thereby eliminating a primary source of media diversity, result in forced access to public rights-of-way, eliminate local government authority to ensure that advanced services and networks are widely available, reduce or eliminate bargained for compensation for the use of local public rights-of-way, cause local cable-related needs and interests to go unmet, impair existing local government contracts with cable operators and cause the quality of service to decrease. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Minnesota that: 1. The City will support efforts directed against unwarranted amendments to Chapter 238 of Minnesota Statutes; and 2. The City urges the Minnesota Legislature and its appropriate committees in the strongest possible manner to oppose any effort to amend Chapter 238 of Minnesota Statutes at this time; and 3. Local cable franchising should be maintained, consistent with applicable law, as a proven means of ensuring that local cable-related needs and interests are met, protecting consumer interests, public safety, public rights-of-way and public property, promoting meaningful multichannel video competition and ensuring that broadband networks and advanced services are available throughout Minnesota communities, to the maximum extent feasible and consistent with applicable law; and 4.
