Suggestions for priorities from members was a bit light (nonexistent), so I recommend
that we concentrate our discussion on resolving the first six items of my rearranged list,
which primarily relate to fences, and do more if time permits.
I) 154.023 Site plan review process. I suggest removing the 30 day requirement in
(A). Also, the number of copies to submit should change. We do not need sixteen
copies. We are better offwith a much smaller number of paper copies in addition to
electronic versions.
2) 154.110 Fence side setback. A number of people have objected to the requirement
to place a fence two feet from the property line where they cannot get the adjoining
property owner to agree to a boundary line fence. We hear: "this is a waste of two
feet of my property."
3) 154.110 Fences in front yards of commercial and industrial uses. Current rules
allow 8 foot fences in front yards of commercial-industrial uses. Do you really
intend to aitow this?
4) 154.110 Fences in front ofresidentiai structures. We may want to refer to front
yard rather than front of building. This would clearly indicate that the corner lots
may not have a privacy fence in either front side. If this is too restrictive, you may
want to limit the long comer side to one-haif of the distance from the principal
structure to the front property line.
5) 154.110 (C) Barbed wire and electric fencing. Allowed in R-l zone. You may
want to restrict this to animal holding areas and not allow it to be used as a
boundary fence.
6) 154.110 (E) Swimming pool fencing. Required for any pool with water depth over
24 inches. This may be too broad.
7) 154.130 (A) (3) & 1S4.140 (8)(1) Setback from ordinary high water IDIIIk of Jakes
and streams. We do not match RCWD 100 foot requirements.
8) 154.006 Definition of Front Yard. Current definition is basically the front 35 feet
of a residential lot. Thus, if the home were set bac:k further than the required
setback, an accessol)' building could be in the front of the principal structure. This
isn't a fiIctor in much of the city as most lots are the minimum setback anyway. But
on a number oflake lots the home is setback much further than the minimum. In
this situation you could construct a detached building in what appears to be the
front yard of a home. An alternative to prevent this would be to define front yard as
the area between the front of the principal structure and the front property line.
9) 154.130 (A) (2) Language is confusing.
New language for consider8tion:
(2) Lots which abut on more than one street shall provide the required
front yards along each street for the principal structure. A front yard
setback of 25 feet shall apply for an accessory structure to the frontage
that is not considered to be the required front yard;
The definition of Yard Front should be amended as well:
YARD, FRONT. A yard extending across the full width of the front lot
between side lot lines and extending from the abutting street right-of-way
line to a depth required in the yard regulations of the district in which the
lot is located. On a comer lot the street address or narrowest street
dimension of the street shall be the required FRONT YARD. The other
street frontage will be considered a FRONT YARD for principal structure

10) 154.150 (M) (1) Do you really want to include the M-I district?
11) 154.150 (M) (2) 1 would remove the hearing language regarding site plan review.
Other places refer to site plan review, this is the only reference to a hearing.
12) 154. 171 Tree planting. Trees should best be planted in the front yard a minimum of
15 feet from the curb line and shall not be planted in a manner that interferes with
any current or planned utility line. Trees may not be planted under a power line
except those approved by the City for such.
13) 154.170 (I)(Ordinance #19, Second Series) Add requirement for striping of parking
stalls on all parking lots fur more than five stalls.
14) 154.024 Include language in (8). "Every lot shall receive a minimum of 4 inches of
topsoil and all unpaved areas shall be sodded from the curb to the rear line of the
principal building. The balance of the lot shall be properly seeded to prevent
erosion >>
15) 154.310 City Attorney will be modifYing this section to more closely match state
law.

(D) Visual obstructions. No fence may be erected which creates visual obstructions
at any intersection, alley, driveway or street for safe vehicular, bicycle or pedestrian
movement.

Centerville City Council
Myself and many other citizens of Centerville are troubled
by the city's "selective enforcement" of various city ordinances,
however it might serve those who are favored or benefitted.
I wish at this time to cite Chapter 93.03 "Mailbox Place-
ment and Installation" passed as Ordinance 48 on 5-24-1989.
Under (B) "Grouping mailboxes and paper boxes", it states mail-
boxes shall be clustered in groups of not less than four nor
more than six. There are countless clusters in the city that are
in violation of this (more than six). Public Works did the
grouping qa the end of Mayor early June of 1989. I know, because
I closed on my home on 5-31-89, and my single stand was removed
and the box clustered. The city's usual answer is that something
is "grandfathered"; that won't work here as the homes to the
north of mine were built in 1990 or later.
Also, as it relates to item (B) in Chapter 93.03, the mail-
boxes installed on the Hanzal lots on Old Mill Road do not meet
the code. Less than four mailboxes are permitted if more than
250 feet from the properties they serve. They do not meet the
distance criteria.
As with any statute or set of standards it doesn't do any
good to say what we do unless we do what we say.

Code Revisions. The Commission reviewed a memo dated January 4, 2008, from
Administrator Larson detailing a number of issues for consideration.
1) 154.023 The Commission agreed that submitting application materials five business
days in advance of a meeting should be satisfactory, as long as city staff determines
that the application is complete. The Commission determined that three copies of the
materials would be sufficient as long as an electronic copy is included in order that the
City can make additional copies as needed.
2) Fence setback from property line. There was considerable discussion on whether the
two foot setback from a property line was excessive. Commissioners Mosher and

Parucci requested that the setback be reduced or eliminated, but the majority agreed
that the setback was appropriate.
3) 154.110 The Commission determined that this section should be rewritten to not
permit privacy or security fences in front yards. Staff will submit proposed code
revisions.
4) 154.110 Considerable time was spent discussing the appropriate restrictions on fences
in residential districts particularly those in the street frontage of comer lots. The
consensus of the Commission was that staff should draft new language that provides:
a. Where a comer lot abuts an adjacent property's front yard, the fence should be
set back a minimum of 10 feet, unless the fence is a decorative fence.
b. A decorative fence should be defined as a fence not exceeding a height of 36
inches that is picket type fence, wrought iron, or split rail.
c. All fences shall be set back a minimum of two feet from any property line,
except adjoining lot lines where an agreement with a neighbor may permit
construction on a boundary line, but in no event shall any fence be closer than
fifteen feet to a curb or street pavement.
d. Comer lots shall only have one front yard for the purpose of fences and that
should be the side that has the front entrance to the home.
5) 154.110 (C) The Commission agreed to leave the regulations on barbed wire and
electric fencing as they are.
The balance of the discussion items were tabled.
V. NEW BUSINESS
Commissioner Love suggested that the City should try to get a guard rail installed along
Centerville (CSAH 21) immediately north of Center Street. The ditch is very deep. A motion was
made by Commissioner Love that the Planning & Zoning Commission recommend to the City
Council that a request be made by the City for a guard rail along the east side of Centerville Road
(CSAH 21) from Center Street south for a distance of approximately 400 feet. The motion was
seconded by Commissioner Fehrenbacher, all present voted in favor of the motion. The motion
carried unanimously.
VI. DISCUSSION ITEMS
The next meeting will be a ioint meeting with Council to discuss the draft of the 2008
Comprehensive Plan. The draft will be distributed about February 1. 2008. for the meeting
on February 12.
