Pursuant to due call and notice thereof, the City of CenteIVille held their regularly scheduled
meeting on January 23,2008, at City Hall, 1880 Main Street.

City Attorney Glaser recommended that "the proposed 20 percent assessments for 2009"
be changed to "the County Assessor Fees would increase by 20 percent for 2009" on

Mayor Capra questioned the reason for the request.
City Administrator Larson eXplained that the applicant requested an extension because
the utilities were not completed tmtil later than planned and stated that a six month
extension would be reasonable to complete construction.
Motion by Council Member Broussard-Vickers. seconded bv Council Member Lee
to approve Consent Al!enda Item 4. All in favor. Motion carried unanimouslv.

Council Member Lee questioned the dollar amount.
City Engineer Statz explained the items requiring payment were excluded from the last
payment request.
Council Member Lee stated that about 25% of the plantings would need to be looked at in
the spring and questioned whether enough money is being held for possible replacement
of this plantings.
City Engineer Statz replied stated that he feh that enough money for replacement of these
plantings has been held.
A.I. Ross Concrete & Masonry Request for Payment - Well House #1 -- $7.150
(Recommending 90% - $6.435)
City Administrator Larson explained that the project was not bid on a unit basis, so the
value of completed work is an estimate. As a precaution, staff is recommending that only
90% ofthe estimate be paid at this time.

Subiect to Filing of Maintenance Bond
City Administrator Larson explained that the applicant provided a maintenance bond and
recommended the City take over the perpetual improvements.
Council Member Lee questioned the process.
City Engineer Statz explained that cities generally accept a project automatically after a
period of time; however, Centerville requests official documentation to that fuct. He
stated that the developer provides a two year warranty and routine inspections have been
completed.

1. Resolution #08-004 - Supporting Local Franchising Pursuant to MN State
Statutes Chapter 238 & Federal Law & Opposing Anv Amendments to Same that
would liYiscerate Local Authority & Establish a Statewide Franchising sdwme.
Council Member Lakso explained that all cities are attempting to support local
franchising to maintain local authority.
Motion bv Council Member Lakso. scconded bv Council Member Paar. to approve
Resolution #08-004; a Resolution Supportinl!: Local Franchisine: Pursuant to MN

2. Resolution #08-005 - Authorizing the City to Act as Legal SJlclJlsor for the

City Administrator Larson reported that Finance Director Meyer has reviewed and
completed an application for submittal on behalf ofthc City.
Motion bv Council Member Lee. seconded bv Council Member Lakso. to approve
Resolution #08-005; a Resolution Authorizine: the City to Act as Lee:al Sponsor for
the Proiects Contained in the Redcvclopment Grant Prol!:ram & Submittal to DEED

3. CrtvSurv~~ults
Council Member Lee reported on the City Survey results. He stated that overall, the
residents are happy with the quality of lifc in Ccnterville with the exception of road
construction. There is also satisfaction in the Police Departmcnt and City statT; however
street lighting and communication wcrc issues of concern to residents.
Discussion ensued.
Council notcd that the survey has been reviewed and that additional revicw is needed.
4. Planning & Zoning Commission Recommendation for the Citv to Request the
Installation of Guard Rail Along the East Side of Centerville Road (CSAH 21)
from Center Street South for a Distance of Approximately 400 feet - Anoka
County Highway Department

5. Authorize Grant Application to Rice Creek Watershed District for Downtown
Stormwater Drllinllae Improvements
City Administrator Larson reported that the Rice Creek Watershed District has a grant
program to assisting cities with drainage projects relative to impaired lakes and waters.
He stated that Centerville Lake is on their list of approved projects.
City Engineer Statz stated that the submitted grant application is fur a matching (50%) of
the total costs of the proposed project.

6. Authorize Costs for Appraisals for the 2009 Street lmorovement Proiect
City Adminilltrator Larson reported that Staff from Bonestroo have been working on
project details. He stated staff hopes to do preliminary work relative to assumptions and
where properties stand on estimated assessments.
Motion by Council Member Lee. seconded bv Council Member Pan. to Authorize
Costs for Annraisals for the 2009 Street Imnroyement Proiect not to exceed $7.500
and desil!:Date the City Attornev's office to enl!:al!:e the needed services. AD in favor.

IX. ANNOUNCEMENTSIUPDATES
1. Citv Administrator Larson
City Administrator Larson discussed the County Assessor's fee increase for 2009 and the
possibility of hiring a private Assessor which could potentially save the City
approximately $4,000 per year based upon 2007 rates.

Council Memher Lakso reported that the response to the CERT Program has been very
good. She reported the training runs from March to May 2008. She encouraged residents
to contact her for more information.
h. Alexandra House
Council Member Lakso rcported she had attended the clccted official's open house held
recently at the Alexandra House. Council Member T ,akso felt that there was an increasc
in domestic abuse and requcsted that Council assign an individual to the Anoka County
Task Force that would assist in prevention and educating the public about domestic
abuse.
Discussion ensued.
Mayor Capra requested that Council Mcmber Lakso back additional information to
Council for further consideration.
c. LMC Conferencc
CowlciI Member Lakso reported that she had attended thc recent LMC Conference,
ethics were the major topic of discussion, and that she would hc bring information to
COlillcil at their next meeting.
Council Member Lee reported that the Police Commission has a new Chaiperson, Mr.
Dave Kelso from Circlc Pines; Council Member Lakso had made a great presentation on
the CERT program; and they approved sending Investigator Russ Blanck to the FBI
Academy. Council Member Lee also reported that the lillion contract was rejected and
mediation is to follow.
Mayor Capra reported that she gave an update at the Police Commission meeting on
mental health issues, Police Officer response, and the dangers involved.
Council Member Lee requcsted that Council consider rcvisiting Committee/Commission
appointments and appointing individuals under the age of 18 for City
Committees/Commissions because he has heen approached by individuals in this capacity
who would like to serve their community.
3. Police Report
Officer Aldridge reported on the following topics:
Frustration with procedures for handling individuals who are sutfering from mental
health issues.
Increased Traffic offenses and domestic calls over the past two months.
Promotion of Officer Chris Carlson to Investigator.

Recent Reserve Recognition Dinner/Goal Setting session honoring eleven reserve
officers.
Recent meeting with the Mexican Consulate on immigrant identification.

WHEREAS, the Centervi11e City Council authorized the above stated special assessment; and
WHEREAS, the above stated assessment was for delinquent utilities for the year 2006 and 2007; and
WHEREAS, the City of Centervi11e gave proper notification of such; and

WHEREAS, Anoka County Property Tax Division bas aclmowledged and certified $753.78 for the year 2008;
and
WHEREAS, the Council bas directed the City Clerk or Finance Director to make l\ request of Anoka County to
abate the above stated special assessment due to the acceptance and receipt of payment in the amount of
$753.78 from HSBC on November 26, 2007; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCll. OF CENTERVILLE,

~ 31.01 ESTABLISHl\lliNT OF PLANNING AND ZONING COl\lMISSION, ECONOMIC
DEVELOPMENT COMMITTEE AND PARKS AND RECREATION COMMITTEE.
(A) This section establishes a City Planning and Zoning Commission, an Economic Development
Committee for the purpose of promoting economic development and a Parks and Recreation Committee.
The purpose of these Committees is advisory and they may make recommendations to the City Council
for consideration regarding matters relating to this Committee.
(B) Forthe purpose of this chapter, the terms Commission and Committee are used interchangeably.
Policy refers to Commissioners and Committee Members alike.

~ 31.02 BYLAWS FOR COMMITTEES.
(A) Authority. The Commiuee has the authority to conduct ilwestigations and to make
recommendations; however, it may not make decisions on behalf of the Council. Committees are subject
to the same rules as the City Council under the open meeting laws. The Council's final decision,
however, and not the Committee's recommendation, binds the city. The Committee may not enter into
a contract, employ workers or authorize expenditures.
(B) Eligibility.
(1) Any resident of the city is eligible to apply as a Committee Member. This individual is
welcome to serve on one committee at a time.

(2) Additionally, the Economic Development Committee (EOC) may recommend to Council
the appointtnent of business owners or principals to the Committee who are not residents but own
businesses within the city.
(C) Appointments.
(I) Each member of the Committee will be appointed by the City Council via a letter of interest
submitted to the City Administrator. This letter will be received by the City Administrator no later than
November 1 of each year. This same action will take place if a vacancy should happen. On an annual
basis, the City Administrator would ascertain those who desire to remain on the Committee.
(2) Seven members shall be appointed to each City Committee.
/
(0) Appointment of officers. At the fIrst meeting of the year, the Committee will appoint by
majority vote a Chair and a Vice-Chair.
(E) Officers' duties.
(1) (a) The Chairperson shall preserve order, enforce the rules of procedure herein prescribed
and determined without debate, subject to the fmal decision of the Commission/Committee on appeal,
all questions of procedure and order. The Chairperson will also give leadership; sign reports; write
correspondence to be signed by either the City Administrator or the Mayor; compile or assist in the
preparation of the agenda as authorized by the Committee; and appoint task forces as authorized by the
City Council.
(b) The Vice-Chairperson shall support and assist the Chairperson; preside over the
Committee meetings in the absence of the Chairperson; and fIll the office of the Chairperson if a vacancy
should arise.
(2) Any Committee Member may appeal a decision of the Chair. To do this, a Committee
Member states, "!appeal the decision of the Chair," immediately after the Chair announces the decision.
Recognition from the Chair is not necessary when making an appeal. The appeal must be seconded, is
debatable and cannot be amended. After the debate, the Committee votes on the Chair's decision. A
majority of "yes" votes upholds the decision of the Chair and a majority of "no" votes overrule the
decision. A tie vote sustains the ruling. The Chair may vote to uphold his or her own ruling. If no one
appeals a ruling as soon as the Chair makes it, it becomes the rule of the Committee.
(F) Meetings.
(1) Regular meetings. Regular meetings of the Committee shall be held on the same day of
each calendar month at the same time, set by the Committee and approved by the Council. Any regular

meeting falling upon a holiday shall be rescheduled by the Committee for an alternative date, Witll
enough time to be properly noticed to the public. The Administrator shall maintain a schedule ofregular
meetings. This schedule shall be available for public inspection during regular bnsiness hours at the
Administrator's office. All meetings, including special emergency meetings, shall be held at City Hall
unless otherwise specifically noticed.
(2) Special meetings. Any three members of the Committee may call a special meeting of the
Committee upon at least 72 hours' written notice to each member of the Committee and Administrator.
This notice shall be delivered personally to each member, or left at the member's place of residence.
Similar written notice shall be mailed at least three days prior to the meeting date to those who have
requested notice of special meetings. This request must be in writing and filed with the Administrator,
designating an official address where notice may be mailed. The request wi11 be valid for one year.
(3) Rmergency meetings.
(a) Any three members of the Committee may call an emergency meeting oftlle Committee
when circumstances require the immediate consideration of the Committee.
(b) Notice may be in writing personally delivered to Committee members or may be in the
form of personal telephone communication. Notice must include the date, time, place and purpose of
the meeting. Where practical, the Administrator shall make an effort to contact news-gathering
organizations that have filed a request to receive notice of special mcetings.
(G) Public notice and open meeting.
(1) Public notice. The Administrator must post written notice of the date, time, place and
purpose of the meeting on the City Hall bulletin board. Notice of meetings must be posted at least three
days before the date of the meeting.
(a) When tJ.'1e performance of an act is ordered within a fixed period of time, the time is
computed as excluding the first day and including the last day of the prescribed or fixed time period,
unless the last day falls on a Saturday, Sunday or legal holiday. For example, if a meeting is scheduled
for a Thursday, notice has to be given on Monday to meet the tllfee-day notice provision. In this
scenario, Tuesday is day one, Wednesday is day two and Thursday is day three. Monday is not included
in the time computation. Similarly, if a special meeting is planned for Monday, notice must be given
on Friday; Saturday and Sunday are included in the time computation since they are not the last day of
the fixed period.
(b) If the Committee meets where a quorum is in attendance, the city must make public
notice.

(2) Open meeting law. Under the Minneso.ta Open Meeting Law, all city committee meetings
. must be o.pen to. the public.
(a) The o.pen meeting law serves three vital purpo.ses:
1. To. pro.hibit actio.ns fro.m being taken at a secret meeting where the interested public
canno.t be fully info.rmed o.f the decisio.ns o.f public bodies o.r detect improper influences;
2. To. ensure the public's right to. be info.rmed; and
3. To. give the public an o.ppo.rtunity to. present its views.
(b) The law prohibits the use o.f telepho.ne co.nversatio.ns, e-mail o.r letters in a
decisio.n-making process amo.ng a quorum o.f members designed to. avo.id an open meeting.
(c) Any perso.n who. intentio.nally vio.lates the o.pen meeting law is subject to. perso.nal
liability in the fo.rm o.f a civil penalty. The public body may no.t pay the penalty.
(H) Minutes. The Co.mmittee must keep a full and accurate reco.rd o.f its actio.ns at every Co.mmittee
meeting. The Administrato.r records the Co.mmittee pro.ceedings in a minute bo.o.k. In the absence o.f
the city staff member to. take the minutes, the Co.mmittee sho.uld delegate the duty o.ftaking minutes fo.r
that meeting.
(1) The minutes should be written in language and in terms the average citizen understands.
(2) If the Co.mmittee finds a mistake in the minutes o.fthe previo.us meeting, the minutes will
be co.rrected during the current meeting and reflected in the minutes.
(3) Once the Co.mmitteehas fo.rmally approved the minutes o.f any meeting, the minutes sho.uld
no.t be changed under any circumstances.
(4) Minutes are o.fficial papers o.fthe city. Minute bo.o.ks are public reco.rds, shall be kept o.n
me with the Administrato.r and must be available for public view at any reaso.nable time.
(5) The fo.llo.wing info.rmatio.n should be included in the minutes:
(a) The time and place o.f the meeting;
(b) The membets present;

(c) A summary of all decisions made by the Committee, including a copy of each motion
exactly as stated, whether or not the motion had a second and, if the motion was seconded, whether or
not the Committee adopted it, and the names of the people who made and seconded the motion; and
(d) The names of the Committee Member who voted either for or against each motion.
(1) Order of business. Each meeting of the Committee shall convene at the time and place
appointed.
(I) Committee business shall be conducted in the following order:
(a) Call to order;
(b) Approval of agenda;
(c) A wards/presentations/ appearances;
(d) Public hearings;
(e) Committee business;
(t) Consent agenda;
(g) Approval of Committee minutes;
(h) Announcements/updates; and
(i) Adjournment.
(2) The order of business may be varied by the presiding officer, but all public hearings shall
be held at the time specified in the notice of the hearing.
(3) The Chairperson/stall' liaison shall prepare an agenda of business for each regular
Committee meeting and file a copy in the oflice of the Administrator. The agenda shall bc prepared in
accordance with the order of business and copies shall be delivered to each Committee member and to
others as far in advance of the meeting as time for preparation will permit. No item of business shall
be considered unless it appears on the agenda for the meeting or is approved for addition to the agenda
by majority vote of the Committee present.

(4) (a) The Chairperson/staff liaison shall see that at least one copy of printed materials
relating to agenda items is available to the public in the meeting room while the Committee considers
the subject matter.
(b) The agenda item shall not be considered unless this provision is complied with.
(c) This section does not apply to those materials that are classified as other than public
under the Minnesota Data Practices Act or materials from closed meetings.
(1) Motions.
(1) Generally. The Committee transacts business through motions made by Committee
Members. These motions are seconded, and subsequently passed or rejected by Committee vote.
(a) The Committee Member states his or her motion (usually in the following form: "I
move . . . [text of the motion]"). The Committee Member making a motion does not need to favor it
or vote for it. The Committee Member may wish to put the issue before the Committee so a decision
can be made.
(b) Another Committee Member then seconds the motion by saying: "I second the
motion. "
(c) The Chair recognizes the motion and opens the pending motion to discussion. The
presiding officer calls for the vote at the end of the discussions and announces the result of the vote.
(2) Motion to reconsider. This motion enables a Committee to set aside a vote it previously
took, and to reconsider the matter as though it had not voted on the issue. Only a person who originally
voted on the prevailing side may move to reconsider. Make the motion by saying, "I move to
reconsider. . . [stating the motion to be reconsidered]." The Committee may debate the motion. If the
Committee passes the motion to reconsider, it must then reconsider the original motion and take another
vote. If the Committee defeats a motion to reconsider, no further action is necessary.
(3) Motion to postpone indefinitely. There is an important difference between the motion to
postpone indefinitely and the motion to postpone temporarily. The motion to postpone temporarily is
more commonly called a motion to "lay on the table" or "to table." The motion to postpone postpones
consideration of the motion until some undetermined, future time. The Committee may consider a tabled
motion whenever a majority of the members decide to do so. A motion to postpone indefinitely,
however, is the equivalent to a negative vote on the main motion. Thus, the issue can be raised again
only by a motion made by someone on the prevailing side of the vote since, unless someone changes his
or her mind, the motion to postpone will once again prevail.

(4) Motion to limit debate. A COI11ll1ittee may limit debate by placing a time limit on debate,
such as a limit of three minutes to consider a particular motion; or limiting the number of people who
may speak for and against a certain motion, such as a limit of three speakers in favor and three speakers
opposed.
(5) Motion to amend. COI11ll1ittee Members may offer amendments to a main motion at any
time. In addition, it is possible to amend an amendment currently under consideration. Beyond this,
Committee Members can offer no further amendments. When a member has made a motion to amend,
the vote on the amendment must precede the vote on the original motion. After the Committee has
accepted or rejected the amendment, another vote on the original motion is necessary.
(6) Motion to substitute. This is a motion to replace one motion with another on the same
subject. A Committee Member may move to substitute a main motion or an amendment to a main
motion. One form for making a substitute motion is to say, "I wish to introduce the following substitute
motion. . . [present the substitute motion]." When a substitute motion is before the Committee, the
Committee must decide which of the two motions, the original motion or the substitute motion, to
consider. The Committee must vote on the question. A "yes" vote favors considering the substitute
motion. A "no" vote favors considering the original motion. The Committee must then discuss and vote
on the selected motion.
(K) Quorum. At all Committee meetings, a majority of the appointed members shall constitute a
quorum for the transaction of business, but a smaller number may adjourn frollltime to time.
(L) Voting. The votes oftlle members on any questions may be taken in any manner which signities
the intention of the individual members, and the votes of the members on any action taken shall be
recorded in the minutes. Any member that is present but does not vote, the minutes as to that member's
name shall be recorded as an abstention.
(M) Council liaison. The Committee may request from the Council a liaison to attend their
meetings. Council may elect to appoint a Council Liaison to the Committee. The liaison will act as a
communicator to and from the CounciI/CoI11ll1ittee, .
(N) Removal from Committee panicipation. Any member of the Committee may remove himself
or herself from participation in the Committee by a letter of resignation being submitted to the City
Administrator. Any member of the Committee may be removed by Council.
(0) Attendance. Any member who fails to attend three consecutive or four meetings in one year
will be removed by the City Council.

(P) Compensation. All Committee Members shall serve without compensation unless a stipend has
been set by Council for meeting attendance and at the Council's pleasure.
(Q) Budget. On or before the end of July, the Committee shall submit to Council a budget request
for anticipated expenditures for the upcoming year.
(R) Expenditures.
(1) The Committee is not allowed to expend funds, order any items or contract with vendors
for services.
(2) All requests will be forwarded to the City Administrator for Council approval and
subsequent ordering by city staff. The Finance Director will submit to the Committee a report setting
forth in detail a complete report of all expenditures incurred during the year.
(5) Referral and repol1s. Any matter brought before the Committee for consideration will be acted
on promptly and forwarded to Council for consideration.
(T) Ethics Policy. Committee members shall be subject to the City of Centerville Ethics Policy.
(U) Incompatible offices. If a Committee Member receives a certificate of election to the City
Council or Mayor's office, the individual is considered to have resigned from the Committee.
(V) Amendment of rules. The city reserves the right to change the provisions of these bylaws from
time to time without notice.

League of Minnesota Cities 2008 Transportation Funding Policy Statement
.
Issue: The League of Minnesota Cities recognizes that all Minnesota residents and businesses
benefit from a sound transportation system that offers diverse modes of travel. Current funding
for roads, bridges and transit systems across all government levels in the state is inadequate, and
Minnesota's transportation system is failing to meet needs pertaining to public safety, population
growth and economic development.
Due to fi.mding challenges, the state has delaycd regionally significant road construction and
reconstruction projects. Urban areas are experiencing growing congestion and are lagging behind
other regions in making transit investments. Rural roads are not being upgraded to meet modem
safety standards and are not serving the needs of industries that depend on the ability to transport
heavy loads.
Local roads, bridges, sidewalks and trails are critical components of Minnesota's transportation
infrastructurc. Cities, like the state, have inadequate resources to preserve and reconstruct aging
transportation infrastructure, and to build transportation infrastructure to servc ncw development.
Existing funding mechanisms such as municipal state aid (MSA), specialassessments and
bonding have limited applications, making it difficult for cities to address growing necds.
Further, as the state funding shortfall has grown, the trunk highway project co~;t participation
requirements imposcd on local units ofgovemment have increased dramatically. This burden
has been exacerbated by the state's use of trunk highway bonds as a funding source, because
under Minnesota's constitution, trunk highway bond dollars cannot be spent on local components
of trunk highway projects, and the bond dollars are not distributed through the Highway User
Tax Distribution Fund formula. Cost participation requirements put added prcssure on local
budgets, contributc to property tax increases and divcrt local resources from the over 39,000 lanc
miles in Minncsota under municipal jurisdiction.

Response: More resources must be dedicated to all components ofthe state's transportation
system, and local units of government must have access to resources and funding tools to
meet growing needs. The League of Minnesota Cities supports the following:
. acceleration ofthe phase-in ofthe constitutional dedication oflOO percent ofthe
motor vehicle sales tax (MVST) to transportation purposes;
. MVST distribution of 60 percent for roads and bridges, and 40 percent for transit;
. dedication ofthe sales tax on leased vehicles to transportation purposes;
. a permanent increase in the gas tax;
. indexing of the gas tax, provided there is a limit on how much the tax can be
increased for inflation in a given amount of time;
. increases in vehicle registration taxes (tah fees);
. trunk highway bonding, provided the Legislature implements reasonable
restrictions on the amount of debt service the state will incur, and provided the
Legislature appropriates funding to assist with local costs related to projects funded
with trunk highway bonds;
. general obligation bonding for local roads and bridges, particularly for routes of
regional significance;
. a sllles tax increase to fund tmnsportation needs;

. funding to assist cities burdened by cost participation responsibilities imposed by
improvement projects on the state's principal arterial system and on the county
state aid highway (CSAH) system;
. funding for transportation components of economic development and
redevelopment projeets of regional significance;
. full funding for all components of state highway projects, including related
stol'mwater management systems, through state sources;
. funding to build roads to standards that can accommodate tbe year-round
transport of heavy loads;
. a sales tax exemption for materials purchased for state and local road, bridge,
sidewalk, trail and transit construction projects;
. authority for cities to impose development impact fees; and
. local funding options that would aJlow cities to raise revenues for roads, bridges,
sidewalks, trails and transit.

COMPREHENSIVE ROAD AND TRANSIT FUNDING
WHEREAS, all Minnesota communities bcnefit from a sound, efficient and adequately
funded transportation system that offers diverse modes of travel; and
WHEREAS, thc integrity of Minnesota's transportation infrastructurc is dcpcndent upon
long-term planning and ongoing maintenance, both of which require dedicated and
sustainable revenue sources; and
WHEREAS, Minnesota leaders have not increased dedicated funding levels for roads,
bridges and transit systems to keep pacc with growing costs and changing needs; and
WHEREAS, transportation analysts in consultation with the Minnesota Department of
Transportation (MnDOT) estimate Minnesota will have to invest an additional $1.5
billion per year in transportation inlrastructurc for thc ncxt ten years in order to meet
identified needs on Minnesota's state highways and bridges, county roads, city strccts,
metro and rural transit systems and local bridges; and
WHEREAS, Minnesota's transportation system is failing to meel the capacity needs
necessary to sustain population growth and promote economic development; and
WHEREAS, congestion, inefficient transportation systems and lack of transportation
choices lead to greater dependence on foreign oil, incrcascd environmental degradation,
and economic disadvantages for Minnesota's businesses and residents; and
WHEREAS, many rural roads are not built to modem safety standards and are not
meeting the needs of industries that depend on the ability to transport heavy loads; and
WHEREAS, local cost participation requirements for trunk highway and cOlmty projects
are onerous and are contributing to strains on city budgets; and
WHEREAS, transportation infrastructure maintenance and improvement costs
significantly contribute to rising property taxes; and
WHEREAS, insufficient state funding has delaycd regionally significant road
construction and reconstruction projects across Minnesota; and
WHEREAS, current funding for roads, bridges and transit systems across all government
levels in Minnesota is inadcquate, and this under-investment diminishes quality of life for
Minnesota residents and hinders Minnesota's progress as a national business, economic
and civic leader.

that this Council requests that the Minnesota
Legislature pass a comprehensive and balanced transportation funding package that
permanently increases dedicated funding for transportation; and
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF
that this Council requests that Governor Tim
Pawlenty allow a comprehensive and balanced transportation funding package that
permanently increases dedicated funding for transportation that is passed by the
Legislature to become law; and
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF
that this Council requests that a comprehensive and
balanced transportation funding package be based upon multiple revenue sources, which
may include but not be limited to general obligation and trunk highway bonds; and
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF
that this Council supports funding options including,
but not limited to, the following:

Introduction
The City of Centerville is seeking an update to the Met Council 2030 forecasts for households,
population, and employment. The City has developed a plan that achieves Met Council policy
objectives outlined in the Regiooal Developmeot Framework. The plan includes a variety of
housing options, locates high density housipg along transportation corridors, protects natural
resources areas, establishes an efficient land use pattern to connect housing, jobs, and retail, and
achieves the Met Council density guideline of 3.0 units per net acre. However, to achieve the
City's objectives, including the development of a high-density, mixed-use downtown and a
sustainable population of over 5,000, the Comprehensive Plan needs to identify areas suitable for
more intense development. This new plan increased the number of projected households for the
City of Ceoterville. Therefore the City of Ceoterville is requesting that the Met Council increase
its forecasts to allow the City to plan flexibly and efficiently for future growth.
Background
The City of Centerville has been working over the past few months with the Planning
Commission and City Council to develop a draft future land use to guide growth to 2030. Part of
this effort includes incorporating the final Downtown master plan which was completed as part of
a separate planning effort. This plan includes the addition of roughly 370 new units in a mixed-
use downtown setting that also include retail and office uses. The goals, plans and design
framework for the new downtown can be found on the City's website, www.centervillemn.com.
During a goal-setting exercise conducted as part of the Comprehensive Plan update, the Planning
Commission and City Council ideotmed the developmeot of a vibrant, mixed-nse downtown as a
key goal to guide the developmeot of land use alternatives. The Syst\:m Statemeot for Centerville
was issued prior to the completion of the Downtown Master Plan and therefore likely does not
reflect this change in planned land use.
Another goal identified during the plan update is a sustainable population over 5,000. The City
desires to reach and or exceed this population goal in order receive Minnesota State Aid for
roadway projects and other benefits a City of this population may be eligible for. This effort
provides the City greater ability to serve not only existing residents but future residents with
additional funds to complete necessary projects. A number of land nse alternatives were

developed with varying densities assigned to the remaining vacant land in the City and a final
"build-out" population was calculated. A preferred land use alternative that met all other City
goals and resulted in a sustainable population over 5,000 was identified by the Planning
Commission and City Council, and reviewed by the public at an open house in December of
2007.
Forecasts
The plan results in an increase in the number of households for Centerville compared with the
forecasts provided by the Metropolitan Council in the System Statement for Centervi 11e. The
System Statement forecasts are presented below in Table I:

To estimate build-out population, the number of new units that could be built on the remaining
vacant land given the planned densities was first calculated. Given the City's preferred densities
for remaining land, 1,110 new units could be constructed. The City currently has] ,352 units, the
vast majority of which are inside the sewered area. This results in a total of 2,455 households by
2030 under the preferred land use alternative. Using the household size estimate given by the
Metropolitan Council in Table I, the 2030 population is estimated at 6,236. These estimates arc
show in Table 2.

Also notice that the employment figures for Centerville are significantly larger than the System
Statement figures, The 2010 figure is based on the current supply of commercial and industrial
land in Centcrville. This estimate uses the assumption that there are 9 employees per gross acre
of commercial or industrial land. Much of the additional commercial development is planned for
the cast side of the City, near the interchange with 1-35. Ccnterville is aware the significant
commercial development may occur in Lino Lakcs between the interchange and Centerville and

Conclusion
The City feels that an update to its forecasts based on the draft land use plan forecasts presented
above would be appropriate, given that the City's plan achieves the objectives established in the
Regional Development Framework for a developing community. Objectives listed in
CenterviIle's System Statement include: developing transition strategies to increase density and
encouraging infiIl development. These two goals are addressed directly through CenterviIle's
current planning effort. An update to the forecast will provide the City with the flexibility
necessary to adequately plan for and respond to growth and market conditions and achieve local

. Believe in being a strong advocate on behalf of the taxpayers. Based upon
feedback fi-om taxpayers & City officials, there appears to be a positive sense of
public relations. I have no knowledge of any complaints or dissatisfaction on the
part of any citys' taxpayers.
. Board of Review in the cities I represent have seen minimal petitions for
valuation appeal. I attribute this to a prompt response to any question a taxpayer
may have, as well as full resolution to any taxpayer dispute. In general, I always
take the time to listen and take whatever time is necessary. I consider myself a
public servant.
. It is my responsibility to stay informed on all legislation, provide the City with the
methodology associated with the generation of market values as well as an annual
compilation of changes in the City's property tax assessment fiom year to year.
. Provide an annual report summarizing the different elasses of property, their
respective contribution to the City's overall tax base, tax-capacity market value
projections for the upcoming budgetary process, a;; well as working with the
finance department through this process.

. Being available throughout said budgetary process, as wen as the truth in taxation
process, to answer taxpayers' questions as they relate to market value, and assist
the finance dept. through this process.
. Personally inspect at least 20% of the City's parcels annually as well as
statistically revalue all parcels in the City annually based upon the current sales
ratio analysis of the different property types within the City.
. Analyze and maintain a valid ratio study of recent sales within the City through
the use of regressive analysis as well as well as price related differential,
coefficient of dispersion as well as working with Anoka County and the
Minnesota Dept. of Revenue Sales Ratio Unit. The sales ratio is the basis for the
statistical measure of the quality of the City's property tax assessment. This
information is contained in the annual report provided the City at its annual Board
of Review.
. Process all Tax Court Petitions filed and report accordingly, also available to
serve as witness if necessary.
. Good communication and writing skills combined with a good working
relationship with the Minnesota Dept. of Revenue, Anoka County, the City Staff
as well as the general public.
. Knowledge of most Microsoft applications including; Word, Excel (spreadsheet),
Access, PowerPoint, as well as the Anoka County system currently in place.

Accompanying this letter is a new Joint Powers Agreement for Assessment of
Property between Anoka County and the City of Centerville. The Agreement
covers Assessment Years 2009 through 2013, taxes payable 2010 through 2014.
The agreement has very few changes with the exception of the per parcel billed
rate structure.
The current rates have been in place since 2002 and are listed as follows;

The line item for Manufactured Homes is new and will affect only those
jurisdictions with Manufactured Home Parks within their boundaries. Anoka
County has added this charge because of the quantity of units in our county and
the difficulty of appraising and administering them.
At first blush, the rate increases look large, however, the timeline covered runs
from 2002 to 2014 and is reflective of the increase in salaries and benefit costs as
well as the cost of automobiles, fuel, equipment, maintenance and training

incurred by Anoka County today and what we expect to deal with in the years to
come. Anoka County values OUT relationship with the City of Centervillc and

JOINT POWERS AGREEMENT
BETWEEN THE CITY OF CENTERVILLE AND
COUNTY OF ANOKA FOR ASSESSMENT OF PROPERTY
THIS AGREEMENT is made and entered into this _ day of
2008, by and between the City of Centerville, 1 BBO Main St, Centerville MN 5503B-9794, hereinafter
referred to as the 'Municipality,' and the County of Anoka, a political subdivision of the State of
Minnesota, 2100 Third Avenue, Anoka, Minnesota 55303, hereinafter referred to as the "County.'
WITNESSETH:
WHEREAS, pursuant to Minn. Stat. ~ 273.072, any county and city, lying wholly or partially
within the county and constituting a separate assessment district, may, by agreement entered into
under Minn. Stat. !} 471.59, provide for the assessment of property in the city by the county
assessor; and
WHEREAS, pursuant to Minn. Stat. ~ 273.03, subd. 2, the agreement may provide for the
abolition of the office of the city assessor when the assessment of the property within the city is to be
made under an agreement by the county assessor; and
WHEREAS, it is the wish of the County to cooperate with the Municipality to provide for a fair
and equitable assessment of the property within the Municipality; and
WHEREAS, said work will be carried out in accordance with the provisions of Minn. Stat.
~ 471.59.
NOW, THEREFORE, in consideration of the mutual covenants herein contained, it is agreec!
as follows:
.
I. That said Municipality constitutes a separate assessment district which lies wholly
within the County and that all property in the geographical boundaries of this district shall be
assessed by the County Assessor of the County beginning with the assessment year 2009, provided
this Agreement is approved by the Commissioner of Revenue.
II. Pursuant to Minn. Stat. ~ 273.072, subd. 2, the office of the city assessor in the
Municipality shall cease to exist on January 16, 200B, but not before the end of the term of the
current city assessor, if serving for a fixed term, or when an earlier vacancy occurs; provided,
however, that upon the termination of this Agreement, the office of city assessor shall be
automatically reestablished and shall be filled as provided by applicable law or charter in
accordance with Minn. Stat. ~ 273.072.
III. The term of this Agreement shall be from January 16, 200B, through assessment
services performed in the year 2013, unless earlier terminated as provided herein.

IV. In consideration of said assessment services, the Municipality shall pay to the County
an annual payment as follows:
2009 Assessment services payable on or before January 15, 2008
2010 Assessment services payable on or before January 15, 2009
2011 Assessment services payable on or before January 1S, 2010
2012 Assessment services payable on or before January 1S, 2011
2013 Assessment services payable on or before January 1S, 2012
V. For year 2009 assessment services, the Municipality shall pay the County as follows:
A. Ten Dollars and SO/100s ($10.50) for each improved parcel of residential,
seasonal recreational residential and agricultural type property;
B. Sixty Dollars and 00/1 OOs ($60.00) for each improved and unimproved parcel
of commercial, industrial and public utility type of property;
C. Sixty Dollars and 00/1 OOs ($60.00) for each improved and unimproved parcel
of apartment and mobile home park type property;
D. Three Dollars and 50/1 OOs ($3.50) for each unimproved parcel of residential,
seasonal recreational residential and agricultural type property; and
VI. For year 201 0 assessment services, the Municipality shall pay the County as follows:
A. Twelve Dollars and 50/1 OOs ($12.S0) for each improved parcel of residential,
seasonal recreational residential and agricultural type property;
B. Four Dollars and 50/1 OOs ($4.50) for each unimproved parcel of residential,
seasonal recreational residential and agricultural type property;
C. Eighty Dollars and 00/100s ($80.00) for each improved and unimproved
parcel of commercial, industrial and public utility type of property;
D. Eighty Dollars and 00/100s ($80.00) for each improved and unimproved
parcel of apartment and mobile home park type property; and
E. Six Dollars and 00/1 ODs ($6.00) for each manufactured home.
The same procedure shall be used, as described above, in the computation of the
assessment payments due in 2011 through 2013, provided, however, that the cost for each type of
parcel shall be increased according to the County Assessor's increase in operating costs, cost of
living and merit adjustments established by the Anoka County Board of Commissioners for January
1 to December 31 in the year prior to the date of the assessment.

VII. Notwithstanding Section III. above, the County and/or Municipality shall have the right
to terminate this Agreement by providing, at a minimum, two years written notice by certified mail,
which notice shall be sent prior to January 2 of any year to terminate assessment services to be
performed two years from such date (I.e. to terminate this Agreement for assessment services in the
year 2010, the party must provide written notice of termination by not later than January 2, 2008).
IN WITNESS WHEREOF, the parties have hereunder set their hands on the dates written
below.

MONTHL Y ENGINEER'S REPORT
For February 13, 2008 City Council Meeting

1. 21" AvenuelBackage Road (000616-05143-0). Retainage has been reduced and the contract
will remain open until the topsoil pile is removed.' Remaining work by the Contractor will be
finished in the spring. Also when the snow and ice melt we wiJ/ complete the survey to fulfill the
Rice Creek Watershed District requirements. Once aJ/ work has been approved the project will
be recommendedfor Final Payment.
2. Old Mill Road Improvements (000616-06147-0). Project punch list has been created and
forwarded to the Contractor. Punch list correction work is anticipated to be completed in the
Spring of 2008 along with the bituminous wear course. Record Plan work will be started soon
and Final Drawings will be tumed into the City for Final Review.
3. Centerville Townoffice Park 2nd Addition (000616-06152-0). Project punch list has been
created and forwarded to the Contractor. Punch list correction work is anticipated to be
completed in the Spring of 2008.
4. Clearwater Creek Estates (BanzaI Property) (000616-06154-0). All work is complete.
Seed germination will be evaluated in the spring prior to release of surety.
5. Hidden Spring Park (000616-07155-0). Corrective work to the rain garden and shoreline will
take place in the spring.
6. Downtown Overhead Power Relocation (000616-07156-0). The south ROW of Heritage
Street has been staked. A final notice was sent to homeowners to let them know we are
proceeding with construction of the power lines along the south side of Heritage St.
7. Comprehensive Plan (000616-07157-0). The drqft plan has been submitted to staff and
elected officials for review. A meeting with the City Council and Planning Commission will be
held to review the draft plan.
8. 2009 Street and Utility Improvements (000616-07158-0). Survey crews have completed
most of the work needed to evaluate design alternatives on Mill Road and Center Street. These
alternatives have been evaluated The alternatives have been refined, and cost estimates have
been completed
A second Open House is slated for February 21st to inform the public of project scope changes
which resulted from input received at the last meeting and the preliminary design work. After
this meeting, the feasibility study will be finalized with any final changes suggested by the
public and/or council. This would begin the formal Chapter 429 assessment process.
9. CSAH 14 Construction Services (000616-07159-0). Shop Drawings for the downtown
streetscape work have been received Once we finish reviewing and approving them we will
hold a pre-construction meeting with the County and the Contractor to review the specialty
work that will take place downtown this summer.
10. Downtown Redevelopment Comprehensive Infrastructure Plan (000616-07161-0). The
Beard Group is set to update the Council on the progress of the project on February] Jlh Afler
this meeting, we will evaluate the needed infrastructure and begin the process to get those
facilities designed and constructed.
We were notified of our succes!iful grant application for some of the storm water improvements
in the downtown area. The grant is through the Clean Water Legacy Act and will fund
$249,500 worth of storm ponds, pipe and rain gardens!
11. Miscellaneous
. We have updated the City's storm water base map to reflect the CSAH 14
improvements. Paul is using this updated map to outline a pond maintenance plan.

Myself and many other citizens of Centerville are troubled
by the city's "selective enforcement" of various city ordinances,
however it might serve those who are favored or benefitted.
I wish at this time to cite Chapter 93.03 "Mailbox Place-
ment and Installation" passed as Ordinance 48 on 5-24-1989.
Under (B) "Grouping mailboxes and paper boxes", it states mail-
boxes shall be clustered in groups of not less than four nor
more than six. There are countless clusters in the city that are
in violation of this (more than six). Public Works did the
grouping ~a the end of Mayor early June of 1989. I know, because
I closed on my home on 5-31-89, and my single stand was removed
and the box clustered. The city's usual answer is that something
is "grandfathered"; that won't work here as the homes to the
north of mine were built in 1990 or later.
Also, as it relates to item (B) in Chapter 93.03, the mail-
boxes installed on the Banzal lots on Old Mill Road do not meet
the code. Less than four mailboxes are permitted if more than
250 feet from the properties they serve. They do not meet the
distance criteria.
As with any statute or set of standards it doesn't do any
good to say what we do unless we do what we say.

Dear Mr. Larson,
The Rice Creek Watershed District (RCWD) is once again seeking applications for our
Citizen Advisory Committee and we are asking the communities within our district for
their help. RCWD is eager to work with the citizens and government bodies in the Rice
Creek drainage toward a more comprehensive and integrated water resource management
paradigm. To that end, we are asking your assistance to spread the word.
The Rice Creek Watershed District board appoints Advisory Committee members for
one-year terms. Our Advisory Committee currently meets once a month, the first
Wednesday, at 5:00 p.m. in our Blaine office. The purpose of the citizen Advisory
Coimmittee is to advise and assist the managers on all matters affecting the interests of
the watershed district and make recommendations to the managers on all contemplated
projects and improvements in the watershed district. Members are also asked to keep
current on water-related issues in their community and relay this information to the board
and staff.
We would appreciate any thoughts you might have or knowledge of individuals who
could serve on the Advisory Committee for the District. For anyone seeking more
information or who would like to request an application to serve on the Citizen Advisory
Committee they can contact the Rice Creek Watershed District Office at (763) 398-3070.
We intend to make our 2008 appointments our Citizen Advisory Committee early in late

SectioD 1. The City Code is hereby amended by inserting Chapter 33 as follows:
CHAPTER 33: SPECIAL ASSESSMENTS
33.01 Deferment of Special Assessments for Senior Citizens.
A. The Council may defer the payment of any special assessment on homestead property owned
by a person who is 6S years of age or older, or who is retired by virtue of permanent and total disability,
and the Clerk is hereby authorized to record the deferment of special assessments where the following
conditions are met:
1. The applicant must apply for the deferment within ninety days of when the assessment
is adopted by the Council.
2. The applicant must be 6S years of age, or older, or retired by virtue of permanent and
total disability.
3. The applicant must be the owner of the property.
4. The applicant must occupy the property as hislher principal place of residence.
5. The applicant's income from all sources shall not exceed the low income limit as
established by the Department of Housing and Urban Development as used in determining the
eligibility for Section VITI housing.
B. The deferment shall be granted for as long a period of time as the hardship exists and the
conditions as aforementioned have been met. However, it shall be the duty of the applicant to notifY the
Clerk of any change in hislher status that would affect eligibility for deferment. Interest shall not accrue
during the deferment period. [Alternative: "During the deferment period, interest shall accrue from the
date of the adoption of the special assessment until paid, at the same interest rate as for those assessments
adopted against other properties for the project that were not deferred.'l
C. The entire amount of deferred special assessments shall be due within sixty days after loss of
eligibility by the applicant. If the special assessment is not paid within sixty days, the Clerk shall add
thereto interest at 8% per annum from the due date through December 31 of the following year and the
total amount of principal and interest shall be certified to the County Auditor for collection with taxes the
following year. Should the applicant plead and prove, to the satisfaction of the Counci~ that full
repayment of the deferred special assessment would cause the applicant particular undue financial
hardship, the Council may order that the applicant pay within sixty days a sum equal to the number of
installments of deferred special assessments outstanding and unpaid to date (including principal and
interest) with the balance thereafter paid according to the terms and conditions of the original special
assessment.
D. The option to defer the payment of special assessments shall terminate and all amounts
accumulated plus applicable interest shall become due upon the occurrence of anyone of the following:
1. The death of the owner when there is no spouse who is eligible for deferment.
2. The sale, transfer or subdivision of all or any part of the property.
3. Loss of homestead status on the property.
4. Determination by the Council for any reason that there would be no hardship to
require immediate or partial payment.
Section 2. Effective Date. This ordinance shall be effective immediately upon its passage
and publication according to law.

1. Plumbing Penn its
A. The charge shall be five dollars ($5.00) for each plumbing fixture, device or connection to the sewer or
plumbing system, with a minimum charge of twenty-nine dollars and fifty cents ($29.50)
B. For any alteration, repair or extension to an existing plumbing system, where the work is of such a
nature that the permit fee charge cannot be determined from the above schedule, the penn it fee shall be

Street, Centerville, MN, or will be mailed to anyone requesting it by telephone (651) 429-3232.
NOTICE IS FURTHER GIVEN that the general purpose of the ordinance is to adopt fees and charges
for various purposes.
Section 1.
This section adopts fees and charges including fees related to garbage/utility account certification, utility
mtes and charges, animal licensing, burning permits, fees for use of right-of-ways and excavations in streets, fees
for business licensing, fees and deposits related building activities, fees for sign permits, development fees
including fees in lieu of park dedications, plarming and zoning fees. and fees for services including supplying
copies and maps, and fees for vacation of streets and easements.
Section 2.
This section authorizes this summary of the ordinance be published in lieu of the entire text of the
ordinance.
Section 3.
This section provides that the ordinance is effective on publication of this summary.
