Punsuant to due call and notice thereof, the City Council of the
City of Centerville held their regular meeting on Wednesday,
December 12, 1979 in the City Hall. Mayor Prachar called the
meeting to order at 7:00 pm. Present were Burque, L'Allier,
Laska, Savela and Attorney Hawkins.
Leon L'Allier made a motion to accept the minutes of the
December 3rd meeting, Gary 3avela seconded it, motion carried.
Fran Burque made a motion to accept the minutes of the November
28th meeting, Gary Savela seconded it, motion carried.
1980 fire contract with Lino Lakes was discussed. The matter
of the number of dwelling units in the area that Centerville
Fire Department covers was discussed. Clerk is to inquire of
the Lino Lakes Clerk if she has the number of dwelling units
on the streets in the Centerville covered area. Matter will
be discussed at the January meeting.
Mr. Al L'Allier appeared before council with request for a
variance on property he owns on Mill Road. Variance had
previously been approved by the P & Z. First variance would
involve the following: A lot created by metes and bounds
description would have the following legal description: The
South 63.2 feet of Lot 5, Block 2, L'Allier Estates, according
to the map or plat thereof on file and of record in the office
of the County Recorder in and for Anoka County, Minnesota,
lying East of the West 204 feet thereof and the East 191.31
feet of that part of the Lot 9, Auditor's Subdivision No. 47
Revised, according to the plat thereof on file and of record
in the office of the Register of ueeds in and for Anoka,
Minnesota, that lies East of the Southerly extension of the
West line of Lot 10, Auditor's Subdivision No. 47 Revised,
and that lies South of said Lot 10. This lot is lacking
the required 100 feet frontage under Ordinance #10, II
RESIDENTIAL (D), the required 15,000 square feet under the
same Section and Ordinance #15, S~CTION 6-LOT STANDARDS #10
for the metes and bounds description. Second lot is the
balance of Lot 5, Block 2, L'Allier Estates which does not
have the sufficient 100 feet frontage under Ordinance ~10,
II R~SIDENTIAL (D) but exceeds the square footage building
requirements. Floyd Laska made a motion to grant a variance
on both lots as P & Z recommended, Fran Burque seconded it,
motion carried. We are granting the split on Lot 5 because
the strip is of no particular value to anyone except the
owner of the remainder of Lot 9.
Proposed guidelines for rink attendants was discussed. The
City has received 5 names for rink attendants, Jerome Hughes,
Jo e Perkowski',. Dan Tourville, Jim Burque and Frank Marcello.
Consensus was to pay the attendants according to the Minimum
wage for Park & rlec employees, being $2.90 an hour. Mayor
will meet with attendants on Thursday afternoon setting up
the guidaines and show them how to flood the rink.

Mr. Short, City Planner, submitted a billing for services
from May to November in the amount of $3,733.25. City
Attorney advised Council that according to contract, if the
billing amount goes over $6,000., the City Planner needs
Council approval on the excess. According to the City
records, we have already paid the City Planner $5079.80
so we will submit $920.20 for partial payment. Clerk will
advise Mr. Short of the situation and also write the
Metro Council requesting additional funds to complete the
City Plan.
The billing for November from Blaine Midway All Pets was
discussed. Billing involved patrols that our contract does
not call for. Clerk will go over billing and reduce the
amount before remitting to Blaine Midway and advise them
of the contract specs. The contract for 1980 with Blaine
Midway was presented. The request for patroling will be
one (1) hour patrol per week. Also the impounding fee on
the contract was discussed. A Resolution increasing the
impounding fee from $15. to $17.50 was presented and
approved. A copy of Resolution is attached to and made
a part of these minutes. Gary Savela made a motion to
accept 1980 contract with Blaine Midway All Pets, Fran
Burque seconded it, motion carried.
The following applications for liquor licensing renewaJ
was presented: TWIN LAKES SUPP~R CLUB - On Sale liquor
Off Sale liquor, Sunday liquor, Off-Sale Non-Intoxicating
liquor, cigarette license and dance permit. Fran Burque
made a motion to approve the applications, Leon L'Allier
seconded it, motion carried.
Walt Williams was in attendance and discussion followed
on ~stimate #5 from Northern Asphalt for street project.
Leon L'Allier made a motion to pay ~stimate #5 in the
amount of $17,490.81, Floyd Laska seconded it, motion
carried. Walt Williams informed council that the amount
of approximately $46, 540. is being held back for work
not done or work poorly done.
Mr. Lawrence Krieger of ~ak Hill Gravel and Construction
requesting payment on the ditch work done on Mill Road.
Gary Savela made a motion to pay Oak Hill Gravel $1,657.50
minus $5.00 for telephone calls made from the City office,
Floyd Laska seconded it, motion carried.
Jerry Sundberg appeared before council with fire department
business.

Gary Savela made a motion to close the City office on
December 24th and December 31st, Floyd Laska seconded it,
motion carried.
Gary Savela made a motion to pay bills, Leon L'Allier
seconded it, motion carried. Copy of disbursements is
attached to and made a part of these minutes.
Fran Burque made a motion to adjourn meeting, Leon L'Allier
seconded it, motion carried. Meeting adjourned at 10:40 pm.

BE IT HnREBY R~SOLVnD, by the City Council of the City
of Centerville, that an impounding fee of $17.50 be
paid by the owner of an impounded dog to the dog
pound when reclaiming their dog. This fee is
payable commencing January 1, 1980.

FLOOD PLAIN MANAG~MENT ORDINANCn
S~CTION 1.0 STATUTORY AUTHORIZATION, FINDINGS OF FACT AND PURPOS~
1.1 Statutory Authorization. The Legislature of the State of
Minnesota has, in Minnesota Statutes Chapter 104 and M.S. Chapter
462 Section 462.357, delegated the responsibility to local govern-
mental units to adopt regulations designed to minimize flood losses.
Therefore, the City Council of the City of Centerville, Minnesota
do ordain as follows:
1.2 Findings of Fact
1.21 The flood hazard areas of Centerville, Minnesota are subject
to periodic inundation which results in potential loss of life,
loss of property, health and safety hazards, disruption of commerce
and governmental services, extraordinary public expenditures for
flood protection and relief, and impairment of the tax base, all
of which adversely affect the public health, safety and general
welfare.
1.22 Methods Used to Analyze Flood Hazards. This Ordinance is
based upon a reasonable method of analyzing flood hazards which
is consistent with the standards established by the Minnesota
Department of Natural Resources.
1.3 Statement of Purpose. It is the purpose of this Ordinance to
promote the public health, safety, and general welfare and to
minimize those losses described in Section 1.21 by provisions
contained herein.
S~CTION 2. 0 G~NERAL PROVISIOT~S
2.1 Lands to Which Ordinance Applies. This Ordinance shall apply
to all lands within the jurisdiction of City of Centerville shown
on the Official Zoning Map as being located within the boundaries
of the Floodway, Flood Fringe, or General Flood Plain Districts.
2.2 Establishment of Official Zoning Map. The Official Zoning
Map together with all materials attached, thereto is hereby adopted
by reference and declared to be a part of this Ordinance. The
attached material shall include the Flood Insurance Study for the
City of Centerville prepared by the Federal Insurance Administration
dated June, 1979, and the Flood Boundary and Floodway Maps and
Flood Insurance Rate Maps therein. The Official Zoning Map shall
be on file in the Office of the Centerville City Clerk, Anoka County
Auditor and the Centerville Zoning Administrator.
2.3 Regulator.y Flood Protection ~levation. The l~egula tory Flood
Protection Elevation shall be an elevation no lower than the
elevation of the regional flood plus any increases in flood elevation
caused by encroachments on the flood plain that result from
designation of a floodway.

2.4 Interpretation
2.41 _In their interpretation and application, the provlslons of
this Ordinance shall be held to be minimum requirements and shall
be liberally construed in favor of the governing body and shall
not be deemed a limitation or repeal of any other powers granted
by State statutes.
2.42 The boundaries of the zoning districts shall be determined
by scaling distances on the Official Zoning Map. Where inter-
pretation is needed as to the exact location of the boundaries
of the district as shown on the Official Zoning Map, as for
example where there appears to be a conflict between a mapped
boundary and actual field conditions, the Board of Adjustment
shall make the necessary interpretation based on elevations on
the regional (lOO-year) flood profile and other available
technical data. Persons contesting the location of the district
boundaries shall be given a reasonable opportunity to present
their case to the Board and to submit technical evidence.
2.5 Compliance. No structure or land shall hereafter be used
and no structure shall be located, extended, converted, or
structurally altered without full compliance with the terms
of this Ordinance and other applicable regulations which apply
to uses within the jurisdiction of this Ordinance.
2.6 Abrogation and Greater Restrictions. It is not intended
by this Ordinance to repeal, abrogate, or impair any existing
easements, convenants, or deed restrictions, However, where
this Ordinance imposes greater restrictions, the provisions of
this Ordinance shall prevail. All other ordinances inconsistent
with this Ordinance are hereby repealed to the extent of the
inconsistency only.
2.7 Warning and Disclaimer of Liability. This Ordinance does
not imply that areas outside the flood plain districts or land
uses permitted within such districts will be free from flooding
or flood damage. This Ordinance shall not create liability on
the part of City of Centerville or any officer or employee
thereof for any flood damages that result from reliance on this
Ordinance or any administrative decision lawfully made thereunder.
2.8 Severability. If any section, clause, provision or portion
of thIS Ordinance is adjudged unconstitutional or invalid by a
court of competent jurisdiction, the remainder of this Ordinance
shall not be affected thereby.
2.9 Definitions. Unless specifically defined below, words or
phrases used in this Ordinance shall be interpreted so as to give
them the same meaning as they have in common usage and so as to give
this Ordinance its most reasonable application.
Accessory Use or Structure - a use or structure on the same lot
with, and of a nature customarily incidental and subordinate to,
the principal use or structure.

Equal Degree of ~ncroachment - a method of determining the
location of floodway boundaries so that flood plain lands on
both sides of a stream are capable of conveying a proportionate
share of the flood flows.
Flood - a temporary increase in the flow or stage of a stream or
in the stage of a lake that results in the inundation of normally
dry areas.
Flood Frequency - the average frequency, statistically determined,
for which it is expected that a specific flood stage or discharge
may be equalled or exceeded.
Flood Fringe - that portion of the flood plain outside of the
floodway. Flood fringe is synonymous with the term "floodway
fringe" used in the Flood Insurance Study for City of Centerville.
Flood Plain - the areas adjoining a watercourse which have been
or hereafter may be covered by the regional flood.
Flood-Proofing - a combination of structural provisions, changes,
or adjustments to properties and structures subject to flooding,
primarily for the reduction or elimination of flood damages.
Floodway - the channel of the watercourse and those portions of
the adjoining flood plain which are reasonably required to carry
and discharge the regional flood.
Obstruction - any dam, wall, wharf, embankment, levee, dike, pile,
abutment, projection, excavation, channel modification, culvert,
building, wire, fence, stockpile, refuse, fill, structure, or
matter in, along, across, or projecting into any channel, water-
course, or regulatory flood plain which may impede, retard, or
change the direction of the flow of water, either in itself or
by catching or collecting debris carried by such water.
Reach - a hydraulic engineering term to describe a longitudinal
segment of a stream or river influenced by a natural or man-made
obstruction. In an urban area, the segment of a stream or river
between two consecutive bridge crossings would most typically
constitute a reach.
Regional Flood - a flood which is representative of large floods
known to have occurred generally in Minnesota and reasonably
characteristic of what can be expected to occur on an average
frequency in the magnitude of the lOO-year recurrence interval,
Regional flood is synonymous with the term "base flood" used in
tfue Flood Insurance Study.
Structure - anything constructed or erected on the ground or
attached to the ground, including, but not limited to, buildings,
factories, sheds, detached garages, cabins, mobile homes, and
other similar items.

S~CTION 3.0 ESTABLISHME~T OF ZONING DISTRICTS
The flood plain areas within the jurisdiction of this Ordinance
are hereby divided into three districts: Floodway District (FW),
Flood Fringe District (FF), and general Flood Plain District (GFP).
3.1 Flood way District. The Floodway District shall include those
areas designated as floodway in the Flood..lnsurance Study.
3.2 Flood Fringe District. The Flood Fringe District shall include
those areas designated as floodway fringe in the Flood Insurance
Study.
3.3 General Flood Plain District. The General Flood Plain District
shall include those areas designated as unnumbered A Zones on the
Flood Insurance Rate Map.
The boundaries of these districts shall be shown on the Official
Zoning Map. Within these districts all uses not allowed as
Permitted Uses or permissible as Conditional Uses shall be prohibited,
SECTIOK 4.0 FLOODWAY DISTRICT (FW)
4.1 Permitted Uses. The following uses have a low flood damage
potential and do not obstruct flood flows. These uses shall be
permitted within the Floodway uistrict to the extent that they are
not prohibited by any other ordinance and provided they do not
require structures, fill, or storage of materials or equipment.
In addition, no use shall adversely affect the capacity of the
channels or floodways or any tributary to the main stream or of
any drainage ditch, or any other drainage facility or system.
4.11 Agricultural uses such as general farming, pasture, grazing,
outdoor plant nurseries, horticulture, truck farming, forestry,
sod farming, and wild crop harvesting.
4.12 Industrial-Commercial uses such as loading area, parking
areas, and airport landing strips.
4.13 Private and public recreational uses such as golf courses,
tennis courts, driving ranges, archery ranges, picnic grounds,
boat launching ramps, swimming area, parks, wildlife and nature
preserves, game farms, fish hatcheries, shooting preserves,
target ranges, trap and skeet ranges, hunting and fishing area,
and single or multiple purpose recreational trails.

Residential uses such as lawns, gardens, parking areas, and
areas.
4.2 Conditional Uses. The following open space uses require
accessory structures (temporary or permanent), or fill or storage
of materials or equipment. These uses may be permitted in the
Floodway District only after the issuance of a Conditional Use
Permit as provided in Section 10.4 of this Ordinance. These uses
are also subject to the provisions of Section 4.3, which applies
to all floodway Conditional Uses.

4.21 Structures accessory to open space uses.
4.22 Placement of fill.
4.23 ~xtraction of sand, gravel, and other materials.
4.24 Marinas, boat rentals, docks, piers, wharves, and water
control structures.
4.25 Railroads, streets, bridges, utility transmission lines,
and pipelines.
4.26 Storage yards for equipment, machinery, or materials.
4.27 Other uses similar in nature to uses described in Sections
4.1 and 4.2 which are consistent with the provisions set out in
Sections 1.J and 4.0 of this Ordinance.
4.J Standards for Floodwa Uses
4.J1 All uses. No structure temporary or permanent), fill
including fill for roads and levees, deposit, obstruction,
storage of materials, or equipment, or other uses may be allowed
as a Conditional Use which, acting alone or in combination with
existing or reasonably anticipated future uses, adversely affects
the capacity of the floodway or increases flood heights. In
addition, all floodway Conditional Uses shall be subject to the
standards contained in Section 10.45 and the following standards
(Sections 4.J2-4.J6).
4.32 Fill
(1) Any fill deposited in the floodway shall be no more than
the minimum amount necessary to conduct a Conditional Use listed
in Section 4.2. Generally, fill shall be limited to that needed
to grade or landscape for that use and shall not in any way
obstruct the flow of flood waters.
(2) Spoil from dredging or sand and gravel operations shall
not be deposited in the floodway unless it can be done in
accordance with (1) of this Section.
(J) Fill shall be protected from erosion by vegetative cover.
4.J3 Accessory Structures (temporary or permanent) permitted as
Conditional Uses by Section 4.21.
(1) Accessory structures shall not be designed for human habitation.
(2) Accessory structures, if permitted, shall be constructed and
placed on the building site so as to offer the minimum obstruction
to the flow of flood waters.
(a) Whenever possible, structures shall be constructed with
the longitudinal axis parallel to the direction of flood
flow, and,
(b) So far as practicable, structures shall be placed approx-
imately on the same flood flow lines as those of adjoining
structures.
(3) Accessory structures shall be flood-proofed in accordance
with the State Building Code.
4.34 Storage of Materials and Equipment
(.1) The storage or processing of materials that are, in time
of flooding, flammable, explosive, or potentially injurious to
human, animal, or plant life is prohibited.
(2) Storage of other materials or equipment may be allowed
if readily removable from the area within the time available
after a flood warning.

4.35 Structural Works for Flood Control. Levees, dikes, and flood-
walls shall not be constructed within the limits of the Floodway
District. Other structural works for flood control such as dams
and channel enlargements that will change the course, current, or
cross=section of a public water shall be subject to the provisions
of Minnesota Statutes, Chapter 105.
SECTION 5.0 FLOOD FRING~ DISTRICT (FF)
5.1 Permitted Uses. The following uses shall be permitted uses
within the Flood Fringe District to the extent that they are not
prohibited by any other ordinance:
5.11 Any use permitted in Section 4.1.
5.12 Accessory structures provided they comply with the provisions
of Section 4.33 of this ordinance.
5.1] Residences and other structures constructed on fill so that
the basement fluvr or first floor, if there is no basement, is at
or above the Kegulatory Flood Protection Elevation. The finished
fill elevation shall be no lower than the Regulatory Flood Protection
elevation and shall extend at such elevation at least fifteen (15)
feet beyond the limits of any structure or building erected thereon.
Fill shall be compacted and the slopes shall be protected by riprap
or vegetative covering. Eesidences constructed on fill shall be
subject to the vehicular access requirements in Section 5.31.
No use shall be permitted which will adversely affect the capacity
of the channels or floodways of any tributary to the main stream,
or of any drainage ditch, or any other drainage facility or system.
5.2 Conditional Uses. Other uses are permitted only upon applica-
tion to the Zoning Administrator and the issuance of a Conditional
Use Permit as provided in Section 10.4 of this ordinance and
subject to the following provisions:
5.21 Residences. Where existing streets, utilities, and small
lot sizes preclude the use of fill, other methods of elevating
the first floor (including basements) above the Regulatory Flood
Protection Elevation may be authorized, provided that the residence
is flood-proofed in accordance with the State Building Code.
5.22 Non-Residential Structures. Commercial, manufacturing, and
industrial structures shall ordinarily be elevated on fill so that
their first floor (including basement) is above the Regulatory
Flood Protection ~levation but may in special circumstances be
flood-proofed in accordance with the State Building Code.
Structures that are not elevated to above the Regulatory Flood
Protection Elevation shall be flood-proofed to FP-l or FP-2
classification as defined by the State Building Code. Structures

5.] Standards for Flood Fringe Uses
5.31 Residential Uses. Residences that do not have vehicular
access at or above an elevation not more than two feet below
the Regulatory Flood Protection Elevation shall not be permitted
unless granted a variance by the Board of Adjustment. In granting
a variance the Board shall specify limitations on the period of
use or occupancy of the residence.

5.32 Commercial Uses. Accessory land uses, such as yards,
railroad tracks, and parking lots may be at elevations lower
than the Regulatory Flood Protection ~levation. However, a permit
for such facilities to be used by the employees or the general
public shall not be granted in the absence of a flood warning
system that provides adequate time for evacuation if the area
would innundate to a depth greater than two feet or be subject
to flood velocities greater than four feet per second upon
occurrence of the regional flood.
5.33 Manufacturing and Industrial Uses. Measures shall be taken
to minimize interference with normal plant operations especially
along streams having protracted flood durations. Certain
accessory land uses such as yards and parking lots may be at
lower elevations subject to requirements set out in Section 5.J2
above. In considering permit applications, due consideration
shall be given to needs of an industry whose business requires
that it be located in flood plain areas.
SECTION 6.0 G~NnRAL FLOOD PLAIN DISTRICT
6.1 Permitted Uses. Permitted uses shall include those uses
permitted by Section 4.1 of this Ordinance.
6.2 Conditional Uses. All other uses are Conditional Uses
and are permitted only upon the issuance of a special permit
as provided in Section 10.4. The General Flood Plain District
includes the entire flood plain and does not differentiate between
those areas that are floodway and those areas that are flood
fringe. Because of this the City Council shall determine whether
the proposed use is in the floodway or flood fringe using pro-
cedures established in Section 10.4J. If it is determined that
the use lies in the floodway, the provisions of Section 4.0 of
this Ordinance shall apply. If it is determined that the pro-
posed use lies in the flood fringe, the provisions of Section
5.0 of this Ordinance shall apply.
S~CTION 7.0 SUBDIVISIONS
No land shall be subdivided which is held unsuitable by City
Council for reason of flooding, inadequate drainage, water supply
or sewage treatment facilities. All lots within the flood plain
districts shall contain a building site at or above the Regulatory
Flood Protection Elevation. All subdivisions shall have water
and sewage disposal facilities that comply with the provisions
of this Ordinance and have road access both to the subdivisions
and to the individual building sites no lower than one foot
below the Regulatory Flood Protection ~levation.
In the General Flood Plain District, applicants shall provide
the information required in Section 10.43 of this Ordinance.
The City Council shall evaluate the subdivision in accordance
with procedures established in Section 10.43 and standards
contained in Section 10.45 of this Ordinance.

SECTION 8.0 PUBLIC UTILITIES, RAILROADS, ROADS, AND BRIDGnS
8.1 Public Utilities. All public utilities and facilities such
as gas, electrical, sewer, and water supply systems to be located
in the flood plain shall be flood-proofed in accordance with
the State Building Code or elevated to above the Regulatory
Flood Protection Elevation.
8.2 Public Transportation Facilities. Railroad tracks, roads,
and bridges to be located within the Floodway District shall
comply with Sections 4.31 and 4.32 of this Ordinance. Elevations
to the Regulatory Flood Protection Elevation shall be provided
where failure or interruption of these transportation facilities
would result in danger to the public health or safety or where
such facilities are essential to the orderly functioning of the
area. Minor or auxiliary roads or railroads may be constructed
at a lower elevation where failure or interruption of transport-
ation services would not endanger the public health or safety.
SECTION 9.0 MOBILE HOM~S AND MOBILE HOME PARKS
9.1 New mobile home parks and expansions to existing mobile
home parks shall be subject to the provisions placed on sub-
divisions by Section 7.0 of this Ordinance.
9.2 Mobile homes in existing mobile home parks that are located
in flood plain districts are non-conforming uses and may be re-
placed only if in compliance with the following conditions:
(1) The mobile home lies in the Flood Fringe District.
(2) The mobile home is anchored with tiedowns that comply
with requirements of Minnesota Regulations MoH 450.
(3) The mobile home owner or renter is notified that the
mobile home site lies in the flood plain and may be
subject to flooding.
(4) The mobile home park owner develops a flood emergency
plan consistent with the time available after a flood
warning. The plan shall be filed with and approved by
the City Council.
9.3 Individual mobile homes not located in mobile home parks may
be permitted if allowed by other applicable ordinances and if
they comply with the provisions of Section 5.1] of this Ordinance.
S.ECTIOr 10.0 ADMINISTRATION
10.1 Zoning Administrator. A Zoning Administrator designated by
the City Council shall administer and enforce this Ordinance. If
he/she finds a violation of the provisions of this Ordinance he/she
shall notify the person responsible for such violation, indicating
the nature of the violation, and ordering the action necessary
to correct it.

10.2 Use Permit
10.21 Use permit Required. A Use Permit issued by the Zoning
Administrator in conformity with the provisions of this Ordinance
shall be secured prior to the erection, addition, or alteration
of any building, structure, or portion thereof; prior to the
use or change of use of a building, structure, or land; prior
to the change or extension of a non-conforming use; and prior
to the placement of fill or excavation of materials within the
flood plain.
10.22 Application for Use Permit. Application for a Use Permit
shall be made in duplicate to the Zoning Administrator on forms
furnished by him/her and shall include the following where
applicable: plans in duplicate drawn to scale, showing the nature,
location, dimensions, and elevations of the lot! existing or pro-
posed structures, fill, or storage of materials; and the
location of the foregoing in relation to the stream channel.
10.23 State and Federal Permits. Prior to granting a Use
Permit or processing an application for a Conditional Use
Permit or Variance, the Zoning Administrator shall determine
that the applicant has obtained all necessary State and Federal
permits.
10.24 Certificate of Zoning Compliance for a New, Altered or
Nonconforming Use. It shall be unlawful to use, occupy, or
permit the use or occupancy of any building or premises or part
thereof hereafter created, erected, changed, converted, altered,
or enlarged in its use or structure until a Certificate of
Zoning Compliance shall have been issued by the Zoning Admin-
istrator stating that the use of the building or land conforms
to the requirements of this Ordinance. Where a nonconforming
use or structure is extended or substantially altered, the
Certificate of Zoning Compliance shall specifically state the
manner in which the nonconforming structure or use differs from
the provisions of this Ordinance.
10.25 Construction and Use to be as Provided in Applications,
Plans, Permits, and Certificate of Zoning Compliance. Use
permits, Conditional Use Permits, or Certificates of Zoning
Compliance issued on the basis of approved plans and applications
authorize only the use, arrangement, and construction set forth
in such approved plans and applications, and no other use,
arrangement, or construction. Any use, arrangement, or con-
struction at variance with that authorized shall be deemed
violation of this Ordinance, and punishable as provided by
Section 12.0 of this Ordinance. The applicant shall be required
to submit certification by a registered professional engineer,
registered architect, or registered land surveyor that the
finished fill and building elevations were accomplished in
compliance with the provisions of this Ordinance. Flood-proofing
measures shall be certified by a registered professional engineer
or registered architect.

10.26 Record of First Floor Elevation. The Zoning Administrator
shall maintain a record of the elevation of the first floor
(including basement) of all new structures or additions to existing
structures in the flood plain districts. He/she shall also main-
tain a record of the elevations to which structures or additions
to structures are flood-proofed.

10.3 Board of Adjustment. A Board of justment is hereby established.
10.Jl Rules. The Board of Adjustment shall adopt rules for the
conduct of business and may exercise all of the powers conferred
on such Boards by State law.
10.J2 Administrative Review. The Board shall hear and decide
appeals where it is alleged there is error in any order, requirement,
decision, or determination made by an administrative official in
the enforcement or administration of this Ordinance.
10.3J Variances. The Board may authorize upon appeal in specific
cases such variance from the terms of this Ordinance as will not be
contrary to the public interest, where, owing to special conditions,
literal enforcement of the provisions of the Ordinance will result
in unnecessary hardship so that the spirit of the Ordinance shall
be observed and substantial justice done. No variance shall have
the effect of allowing in any district uses prohibited in that
district, permit a lower degree of flood protection than the
Regulatory Flood Protection Elevation for the particular area, or
permit standards lower than those required by State law.
10.]4 Hearings. Upon filing with the Board of Adjustment of an
appeal from a decision of the Zoning Administrator, or an application
for a variance, the Board shall fix a reasonable time for a hearing
and give due notice to the parties in interest. The Board shall
submit by mail to the Commissioner of Natural Resources a copy of
the application for proposed Variances sufficiently in advance so
that the Commissioner will receive at least ten days notice of the
hearing.

10.35. Decisions. The Board shall arrive at a decision on such
appeal or Variance within 14 days. In passing upon an appeal the
Board may, so long as such action is in conformity with the pro-
visions of this Ordinance, reverse or affirm wholly or in part, or
modify the order, requirement, decision or determination appealed
from. It shall make its decision in writing setting forth the
findings of fact and the reasons for its decisions. In granting
a Variance the Board may prescribe appropriate conditions and
safeguards such as those specified in Section 10.47, which are in
conformity with the purposes of this Ordinance. Violations of such
conditions and safeguards, when made a part of the terms under which
the Variance is granted, shall be deemed a violation of this
Ordinance punishable under Section 12.0. A copy of all decisions
granting Variances shall be forwarded by mail to the Commissioner
of Natural Resources within ten (10) days of such action.

10.36 Appeal to the City Council and District Court. Appeals
from any decision of the Board may be taken by any person or
persons, jointly or severally, aggrieved by any decision of the
Board, or any taxpayer, officer, department, board, or bureau
of the municipality, to the City Council. The decision of the
City Council may be appealed to the district court, of this
jurisdiction as provided in Minnesota Statutes 462.361.
10.4 Conditional Uses. The City Council shall hear and decide
applications for Conditional Uses permissable under this Ordinance.
Applications shall be submitted to the Zoning Administrator who
shall forward the application to City Council for consideration.
10.41 Hearings. Upon filing with the City Council an application
for a Conditional Use Permit, the City Council shall submit by
mail to the Commissioner of Natural Resources a copy of the
application for proposed Conditional Uses sufficiently in
advance so that the Commissioner will recieve at least ten days
notice of the Hearing.
10.42 Decisions. The City Council shall arrive at a decision
on a Conditional Use within 30 days. In granting a Conditional
Use Permit, the City Council may prescribe appropriate conditions
and safeguards, in addition to those specified in Section 10.47
which are in conformity with the purposes of this Ordinance.
Violations of such conditions and safeguards, when made a part
of the terms under which the Conditional Use Permit is granted,
shall be deemed a violation of this Ordinance punishable under
Section 12.0. A copy of all decisions granting Conditional Use
Permits shall be forwarded by mail to the Commissioner of Natural
Resources within ten (10) days of such action.
10.43 Procedures for ~valuating Proposed Conditional Uses within
the General Flood Plain District.
(1) Upon receipt of an application for a Conditional Use Permit
for a use within the General Flood Plain District, the applicant
shall be required to furnish such of the following information
as is deemed necessary by the City Council for the determination
of the Regulatory Flood Protection Elevation and whether the
proposed use is within the floodway or flood fringe.
(a) A typical valley cross-section showing the channel of the
stream, elevation of land areas adjoining each side of the
channel, cross-sectional areas to be occupied by the pro-
posed development, and high water information.
(b) Plan (surface view) showing elevations or contours of the
ground, pertinent structure, fill, or storage elevations;
size, location, and spatial arrangement of all proposed
and existing structures on the site; location and elevations
of streets; photographs showing existing land uses and vegetation
upstream and downstream; and soil type.
(c) Profile showing the slope of the bottom of the channel
or flow line of the stream for at least 500 feet in either
direction from the proposed development.

(2) One copy of the above information shall be transmitted to a
designated engineer or other expert person or agency for technical
assistance in determining whether the proposed use is in the
floodway or flood fringe and to determine the Regulatory Flood
Protection ~levation. Procedures consistent with Minnesota
Regulations NR 86-87 shall be followed in this expert evaluation.
The designated engineer or expert shall:
(a) Estimate the peak discharge of the regional flood.
(b) Calculate the water surface profile of the regional flood
based upon a hydraulic analysis of the stream channel and
overbank areas.
(c) Compute the floodway necessary to convey the regional
flood without increasing flood stages more than 0.5 feet.
An equal degree of encroachment on both sides of the
stream within the reach shall be assumed in computing
floodway boundaries.
(3) Based upon the technical evaluation of the designated engineer
or expert, the City Council shall determine whether the proposed
use is in the floodway or flood fringe and the Regulatory Flood
Protection Elevation at the site.
10.44 Procedures to be Followed by the City Council in Passing
on Conditional Use Permit Applications within all Flood Plain Districts.
(1) Require the applicant to furnish such of the following infor-
mation and additional information as deemed necessary by the City
Council for determining the suitability of the particular site for
the proposed use:
(a) Plans in triplicate drawn to scale showing the nature,
location, dimensions, and elevation of the lot, existing or
proposed structures, fill, storage of materials, flood-proofing
measures, and the relationship of the above to the location
of stream channel.
(b) Specifications for building construction and materials,
flood-proofing, filling, dredging, grading, channel improvement,
storage of materials, water supply and sanitary facilities.
(2) Transmit one copy of the information described in subsection (1)
to a designated engineer or other expert person or agency for
technical assistance, where necessary, in evaluating the proposed
project in relation to flood heights and velocities, the seriousness
of flood damage to the use, the adequacy of the plans for protection,
and other technical matters.
(3) Based upon the technical evaluation of the designated engineer
or expert, the City Council shall determine the specific flood hazard
at the site and evaluate the suitability of the proposed use in
relation to the flood hazard.
10.45 Factors Upon Which the Decision of the City Council shall
be based. In passing upon Conditional Use applications, the City
Council shall consider all relevant factors specified in other
sections of this Ordinance, and

(1) The danger to life and property due to increased flood heights
or velocities caused by encroachments.
(2) The danger that materials may be swept onto other lands or
downstream to the injury of others.
(J) The proposed water supply and sanitation systems and the
ability of these systems to prevent disease, contamination, and
unsanitary conditions.
(4) The susceptibility of the proposed facility and its contents
to flood damage and the effect of such damage on the individual
owner.
(5) The importance of the services provided by the proposed
facility to the community.
(6) The requirements of the facility for a waterfront location.
(7) The availability of alternative locations not subject to
flooding for the proposed use.
(8) The compatibility of the proposed use with existing develop-
ment and development anticipated in the foreseeable future.
(9) The relationship of the proposed use to the comprehensive
plan and flood plain management program for the area.
(10) The safety of access to the property in times of flood for
ordinary and emergency vehicles.
(11) The expected heights, velocity, duration, rate of rise, and
sediment transport of the flood waters expected at the site.
(12) Such other factors which are relevant to the purposes of
this Ordinance.
10.46 Time for Acting on Application. The City Council shall
act on an application in the manner described above within ]0
days from receiving the application, except that where additional
information is required pursuant to Sections 10.4J and 10.44 of
this Ordinance. The City Council shall render a written decision
within 14 days from the receipt of such additional information.
10.47 Conditions Attached to Conditional Use Permits. Upon
consideration of the factors listed above and the purposes of
this Ordinance, the City Council may attach such conditions to
the granting of Conditional Use Permits as it deems necessary
to fulfill the purposes of this Ordinance. Such conditions may
include, but are not limited to, the following:
(1) Modification of waste disposal and water supply facilities.
(2) Limitations on period of use, occupancy, and operation.
(J) Imposition of operational controls, sureties, and deed
restrictions.
(4) Requirements for construction of channel modifications,
dikes, levees, and other protective measures.
(5) Flood-proofing measures, in accordance with the State
Building Code. The applicant shall submit a plan or document
certified by a registered professional engineer or architect that
the flood-proofing measures are consistent with the Regulatory
Flood Protection Elevation and associated flood factors for the
particular area.

SECTION 11.0 NONCONFORMING US~S
11.1 A structure or the use of a structure or premises which was
lawful before the passage or amendment of this Ordinance but which
is not in conformity with the provisions of this Ordinance may
be continued subject to the following conditions:
11.11 No such use shall be expanded, changed, enlarged, or
altered in a way which increases its nonconformity.
11.12 No structural alteration or addition to any nonconforming
structure over the life of the structure shall exceed 50 percent
of its assessed value at the time of its becoming a nonconforming
use, unless the entire structure is permanently changed to a
conforming use or unless the alteration or addition would
substantially reduce potential flood damages for the entire
structure.
11.13 Any alteration or addition to a nonconforming use which
would result in substantially increasing the flood damage potential
of that use shall be flood-proofed in accordance with the State
Building Code.
11.14 If any nonconforming use is discontinued for 12 consecutive
months, any future use of the building premises shall conform
to this Ordinance. The assessor shall notify the Zoning Admin-
istrator in writing of instances of nonconforming uses which
have been discontinued for a period of 12 months.
11.15 If any nonconforming use is destroyed by any means,
including floods, to an extent of 50 percent or more of its
assessed value, it shall not be reconstructed except in conformity
with the provisions of this Ordinance. However, the City Council
may issue a Conditional Use Permit for reconstruction if the use
is located outside the floodway and, upon reconstruction, is
adequately flood-proofed elevated, or otherwise protected in
conformity with Section 10.47.
11.16 Uses or adjuncts thereof which are or become nuisances
shall not be entitled to continue as nonconforming uses.
SECTION 12.0 P~NALTI~S FOR VIOLATION
Violation of the provisions of this Ordinance or failure to comply
with any of its requirements (including violations of conditions
and safeguards established in connection with grants of Variances
or Conditional Uses) shall constitute a misdemeanor. Any person
who violates this Ordinance or fails to comply with any of its
requirements shall upon conviction thereof be fined not more than
$500 or imprisoned for not more than 90 days, or both, and in
addition shall pay all costs and expenses involved in the case.
Each day such violation continues shall be considered a separate
offense.
Nothing herein contained shall prevent the City Council from taking
such other lawful action as is necessary to prevent or remedy any
violation.

SECTION 1].0 AMBNDMENTS
The flood plain designation on the Official Zoning Map shall
not be removed from flood plain areas unless it can be shown
that the designation is in error or that the area has been
filled to or above the elevation of the regional flood and
is contiguous to lands outside the flood plain. Special
exceptions to this rule may be permitted by the Commissioner
of Natural Resources if he determines that, through other
measures, lands are adequately protected for the intended use.
All 'amendments to this Ordinance including amendments to the
Official Zoning Map must be submitted to and approved by the
Commissioner of Natural Resources prior to adoption. Changes
in the Official Zoning Map also require prior approval by the
Federal Insurance Administration.

Gary Savela made a motion to adjourn hearing, Leon L'Allier
seconded it, motion carried. Hearing adjourned at 7:50 pm.
City Council met with the Park & Recreation Committee at
8:00 pm in the City Hall. Present were City Council members,
Park Committee representatives Floyd Kruger, Larry Koch and
Don Fitch. Purpose of meeting was to discuss guidelines for
skating rink attendants and proposed purchase of parcel for
City Park Use.
Danny Tourville appeared before Council interested in being
rink attendant for the winter season. He was advised that he
would either be called by clerk about being hired and the
guidelines to follow or request his attendance at the December
12th Council meeting.
A Centennial Hockey Association representative was in attendance
requesting It hour use of rink on week nights and game to be
scheduled for Saturday or Sunday afternoons. Association will
furnish the Clerk with a schedule and also coaches names and
telephone numbers.
Balance of meeting was spent discussing the proposed parcel
of ground the City is interested in purchasing for park use.
Park Committee were brought up to date on the area where the
parcel is located and the price quoted from the City to the
LaMotte family for the sale. LaMotte family had several things
to consider; the street assessment against the parcel, the green
acre restoration and survey costs. Matter was tabled until
further notice by LaMotte's.

Pursuant to due call and notice thereof, the City Council of the
City of Centerville held their regular meeting on Wednesday,
November 28, 1979 at 7:00 pm in City Hall. Mayor Prachar called
the meeting to order at 7:00 pm. Present: Burque, L'Allier,

Leon L'Allier made a motion to accept the minutes of meeting
held November 14, Fran Burque seconded it, motion ckrried.
Discussion was held on the property the City is interested in
purchasing for a park. Consensus was to inform Bob LaMotte
that the City is interested in the westerly 10 acres of the
22 acre parcel off of LaMotte Drive, offering $2,000. an acre,
terms to be discussed later. Clerk will advise Mr. LaMotte
of same for discussion to be held on Monday, December 3 at 8:00 pm
with the Park Committee and Council. If December ]rd date is a
problem, discussion on subject will be put on the 12th of December
meeting agenda.
Council will be meeting on Monday, December 3rd at 7:00 pm for
public hearing on the Flood Plain Management Ordinance and
at 8:00 pm with the Park Committee.
Mayor Prachar gave an update on the progress of the Center
Oaks #1 project.
Discussion was held on the letter from Mrs. Hentges, 7397 Mill
Road on the problem she has with hunters in the area.

Discussion was held on the proposed guidelines for the rink
attendants at the Centerville skating rink. Clerk is to
post notice requesting persons interested in being a rink
attendant to attend a meeting on Monday, December )rd in
the City Hall at 8:00 pm. Clerk will also contact Circulating
Pines for same notice but with the interviews being held on
the 12th of December at the regular meeting.
Fran Burque made a motion to renew the Business Auto Policy
with Beulke Agency, Inc. for a one-year period, Leon L'Allier
seconded it, motion carried.
Mayor read communications from Rep. Oberstar and Cecilia Nadeau.
Mayor read request from Anoka County referring to a letter from
Governor Quie asking for the communities to designate a 24
hour housing center in cases of emergency and a 24-hour
referral phone number. Council consensus was the City Hall
being designated as the 24-hour housing shelter and referral
number would be the Lino Lakes Police Department. Clerk will
advise the County and Police Department of same.

November 14, 1979 in City Hall. Mayor Prachar called the meeting

PETITIONS AND COMPLAINTS: Burgoons still parking their cars
in the NO PARKING area, cars parked in front of 7071 Centerville
Road instead of using driveway, numberous complaints on the
street project, all noted by Walt Williams.
Gary Savela made a motion to contribute $400. to the Centennial
School District #12 Summer Recreation Program, Fran Burque
seconded it, motion carried.
Discussion was held on the 22.3 acres of property proposed for
purchase for City park area. Council will get together on
Saturday to look at location.
Gary made a motion to adopt amendments to Ordinance JIO as
stated as October 24 meeting, Floyd Laska seconded it, motion
carried. Copy of amendments to Ordinance are attached to and
made a part of these minutes.
Mayor Prachar advised council of vacancy on the P & Z Board
due to Jerry Sundberg's resignation and suggested the name of
Archie Gay. Leon L'Allier made a motion to appoint Archie Gay

Public Hearing on the proposed Flood Plain Management Ordinance
will be held on Monday, December ], 1979 in City Hall at 7:00 pm.

The City Council of the City of Centerville, Minnesota,
ordains as follows:
SECTION 1. REGULATIONS ADOPT~D BY REF~Rnf\~CE
Sections 1.0109 through 1.0111 of 3 Minnesota Code of Agency
Rules, Department of Agriculture, Shade Tree Program (1978
Edition) together with amendments thereof to date, are
hereby adopted by reference and made a part of this ordinance
as if set out here in full, except as hereinafter provided.
A copy of said agency rules herewith incorporated is on
file in the office of the Tree Inspector.
S~CTION 11. The stockpiling of bark bearing elm wood within
the control area in the City limits of the City of Centerville
shall be permitted during the period from September 15 through
April 1 of any given year. Any such wood not utilized by
April 1 of any year must then be removed and disposed of as
provided by this ordinance and the regulations incorporated
thereby.
S~CTION 111. Where the provlslons of this ordinance conflict
or are inconsistent with any other ordinance of the City,
the provisions of this ordinance shall supercede except in
instances where one regulation is more restrictive than
another in which case the more restrictive shall apply and
control.
SnCTION 1111. Any person who shall violate any provlslons
of this ordinance shall, upon conviction thereof, be deemed
guilty of a misdemeanor, as defined by State law.
S~CTION 11111. This ordinance shall become effective upon
its due passage and enactment and publication according to law.

Floyd Laska made a motion to accept the minutes of the October
10 meeting, Fran Burque seconded it, motion carried.
PETITIONS AND COMPLAINTS: the sodding done on the previous
Saturday and the question of re-blacktopping Mound Trail.
Clerk read a request from Mr. David Mc~velly for an extension
on the final plat of CLEARWATER CR~EK ~STATES. Leon L'Allier
made a motion to grant an extension on the final plat presenta-
tion of Clearwater Creek ~states until February 11, 1980, Gary
Savela seconded it, motion carried.
Presentation was presented to the Council from representatives
of Centennial School District #12 on their summer recreation
program. They are asking for a donation from the City. Matter
was tabled until the next meeting.
Russell Almendinger, representing PQT Company, was in attendance
thanking the City for receiving the planting of seedling trees
in Centerville project under the Shade Tree Program.
Discussion was held with Mr. Almendinger concerning the quote
on the parcel of land the City is interested in purchasing for
park property. PQT Company's price to the City will be $3,000.
an acre (parcel involving 9 acres) and in one payment. Matter
was tabled until further investigation can be made by the
Council.
Hearing was o~ened at 9:30 pm on the proposed amendments
to Ordinance #10 dealing with size of lots for duplexes.
Discussion was held and consensus was to amend the ordinance
as follows, per clerk checking with city attorney:

type up new estimate reducing #4 under Part II from $66,150. to
$35,953.47 making a total estimate of $50,615.20. Gary Savela
made a motion to pay Northern Asphalt Estimate #3 in the amount
of $50,615.20, Leon L'Allier seconded it, motion carried.

Centerville Lions Club President Arnold Drewlo was in attendance
advising council that the Lions Club would like to commit both
financial and physical assistance in any projects that the city
should undertake in connection with the purchase of park property.
Joe LaCasse appeared before council with discussion on the grading
and excavating permit which he will need for the work he's doing
on his property.
Jim Husnick appeared before council with respect to building
permits for Peltier Hills Addition and advising when the utilities
will be put in the Addition. Leon L'Allier made a motion to
authorize the clerk to issue building permits for Peltier Hills
Addition, Fran Burque seconded it, motion carried.
Clerk read a letter from Mr. & Mrs. Frank Hentges with respect
to their building a pole barn to house a riding horse. They are
requesting a variance to Ordinance #10, Section I. V. Animals
because their property is only four acres. Leon L'Allier made
a motion to issue a special use permit for an indefinite period,
subject to review if needed, Fran Burque seconded it, motion carried.
Clerk brought council up to date on the proposed flood plain
ordinance. Floyd Laska made a motion to authorize the clerk to
change the wording in the ordinance as suggested by DNR to reflect
the elimination of the l' freeboard and submit to them for approval,
Fran Burque seconded it, motion carried.
Loitering ordinance was discussed. Floyd Laska made a motion
to adopt Ordinance #32, AN ORDINANCE DiFINING AND PROHIBITING

CITY OF CENT~RVILL~
AN ORDINANC~ D~FINING AND PROHIBITING LOIT~RING
DEFINITIONS: For the purpose of this ordinance, the following
words shall have the following definitions or meanings.
SECTION I. ( 1) LOI T~RING. The wo rd "10 i tering" is defined as the
failure or refusal on the part of any person to vacate or leave any
premises after being requested or ordered either orally or in
writing to do so, for cause, by the owner, agent, manager or person
in charge thereof, or by any law enforcement agent or official, and
shall also include the return at any time thereafter to any such
premises after having been so requested or ordered to vacate or
leave such premises, or the failure or refusal when requested or
ordered as herein provided to stop or cease the behavior, act or
conduct set forth in Section I (2); provided, however, that this
definition shall not include any person on such premises who may
be the owner or tenant of any part thereof, nor shall it include
the wife, children employee, or tenant of such owner or occupier.
(2) CAUSE. The word "cause" is defined as any behavior, act or
course of conduct on the part of any person which mayor is likely
to result in a disturbance of the peace, including but not limited
to the following: the making or production of any unnecessary
noise by shouting or by any other means or mechanisms including
the blowing of any automobile or other vehicle horn; any improper
use of flash or spot lights; the drinking or display of any beer
or intoxicating liquor or wine in or about any premises in which
such drinking or display is prohibited by law; the defacement or
destruction of, or causing otherwise of damage to any premises
or of any property located thereon; the strewing, scattering,
littering, throwing, disposal or deposit of any refuse, garbage
or rubbish on or unto any premises, except into receptacles
provided for such purpose; the discharge of any fireworks, caps,
pistols, firearms or any other device or mechanism designed to
create noise; the use of profane, abusive, indecent or threatening
language towards any person including peace officers; inciting
to or committing assault or battery; soliciting for any illegal
or immoral purposes; any unexplained lingering in or about
premises after closing hours; any obstruction of traffic either
pedestrian or vehicular except in cases of emergency; spitting
on a public or private sidewalk; standing or lingering about
the doorway of any building in such a manner as to obstruct or
partially obstruct the free and uninterrupted ingress to or egress
from such building or in such manner as to annoy the owner or
occupant thereof or the owner or occupant of any adjacent premises;
lingering on, near, under or about any public bridge, including
approaches thereto or abutments thereof,; lingering near or about
any public building, reservoir, dam, or public works; or any other
behavior which is otherwise forbidden by law.

(3) PR~MISES. The word "premises" is defined as any land, lot,
parcel, sidewalk, boulevard, street, highway, alley, thorough-
fare, park, playground, restaurant, cafe, church, school, car
or parking lot, drive-in, building used for business, commercial
or industrial purposes, place, washroom or toilet, apartment
hallway or other location whether public or private in the City
of Centerville.
(4) LOIT~RING PROHIBIT~D. Loitering in the City of Centerville
is prohibited.
S~CTION II. P~NALTY. Any person violating this ordinance shall
be guilty of a misdemeanor, as defined by State Law.
~ffective date. This ordinance shall be in force and effect
upon passage and publication. Adopted this loth day of

Pursuant to due call and notice thereof, the City Council of
the City of Centerville held a special meeting on Thursday,
September 27, 1979 at 7:00 pm. in the City Hall. Present:
Burque, L'Allier, Laska, Savela and Engineer Williams.
Purpose of meeting was to discuss change order on the
720' of Mill Road which was to have road mix and is now
proposed to have 1" of plant mix. Proposal would be for
1" of plant mix at an addi tional cost of $750. to the Ci ty.
Leon L'Allier made a motion for the engineer to draw up
change order for 720' of Mill Road to have 1" of plant mix
at approximately $1.20 per yard, Gary Savela seconded it,
motion carried.

Floyd Laska made a motion to accept the minutes of the September
12 meeting, Fran Burque seconded it, motion carried.
Petitions and complaints concerned the blacktop on Mound Trail
and the height of curbs on driveways in the City.
Clerk read the Resolution certifying the amount of $50,960.68
to the County for tax levy on the sanitary sewer payable in
1980. Leon L'Allier made a motion to approve Resolution,
Gary Savela seconded it, motion carried. A copy of rleso1ution
is attached to and made a part of these minutes.
Clerk has received one quote on the re-roofing of the new
portion of the city hall. She is to receive another quote
and will be taken up at the next meeting.
Clerk read communication from Mrs. Seashore of Peltier Lake
Drive concerning some trees on the right-of-way and the ditch
in front of her property.
Discussion on the lumber pile left over from the skating rink.
There is approximately 2000' of 2 x 12. Clerk is to get some
quotes, if possible and bring to October lOth meeting.
Leon L'Al1ier made a motion to place one street light at the
intersection of County Road #14 and Mound Trail and one on the
cul-du-sac on Mound Trail, Gary Save1a seconded it, mot~on
carried. Clerk will contact Jerry Bowman at NSP about same.
Leon L'Allier made a motion to approve the final plat of
Rehbein Estates, Floyd Laska seconded it, motion carried.
Balance of meeting was spent on the 1980 City Budget. After
considerable discussion, Gary Savela made a motion to accept
the following property tax levy for the City of Centerville
payable in 1980 as follows:

The City Council met on Wednesday, September 26, 1979
at 7:00 pm in the City Hall with Russ Almendinger, his
brother and a partner to discuss a 10 acre parcel of
land off of Heritage Street that the City is interested
in purchasing for park use.
After discussion concerning parcel, clerk was to ask
Joe LaCasse for an appraisal on the parcel and Walt
Williams to look at parcel to see what work had to
be done on it such as leveling and grading. Report
from both parties to be at the October lOth meeting
of the council.

Pursuant to due call and notice thereof, the City Council of
the City of Centerville held their regular meeting on Wednesday,
September 12, 1979 in the City Hall. Mayor Prachar called the
meeting to order at 8:00 pm. Present: L'Allier, Laska, Savela
absent; Burque.
Gary Savela made a motion to accept minutes of meetings held
August 22, August 29 and September 10 hearing, Floyd Laska
seconded it, motion carried.
Mr. Arthur Raudio was in attendance requesting an extension
on the final plat of Center Oaks #2. He plans to attend the
March 1980 council meeting to discuss the timing of developing
this plat. Leon L'Allier made a motion to extend the plat
presentation of Center Oaks #2 until the June 11, 1980 council
meeting, Floyd Laska seconded it, motion carried. Mr. Raudio
also requests the city to write a letter for FHA informing
them that we accept the blacktop streets, sanitary sewer lines,
street signs are in and that we are holding a $10,000. bond
in reserve for the finishing work to be done on the drainage
swales. Gary Savela made a motion to accept all parts of the
project that are completed; blacktop streets, sanitary sewer
lines and street signs and are are holding a $10,000. bond in
reserve for completion of the finishing work on the drainage
swales, Leon L'Allier seconded it, motion carried.
Gerald Rehbein appeared before council for discussion on his
plat Rehbein ~states. Walt Williams advised council that the
city would have to send a Resolution to the Waste Control
Commission requesting a change in the urban service area to
include the plat known as Rehbein Estates, and a map revision
would have to be made by the Engineer. Leon L'Allier made a
motion to revise the urban service area to include the area
known as Rehbein Estates and a new map drawn up by the Engineer,
Floyd Laska seconded it, motion carried. Mr. Rehbein will have
to attend a future meeting when he has acquired the easements
necessary for the plat, payment of the park fee agreed upon
and the signing of the development contract.
Mayor Prachar informed council of Mr. Rehbein's realtor requesting
a letter from the city stating there will be no problem in
putting up duplexes in the Rehbein Estates plat. Recommendation
from P & Z and city planner was that lot size for duplexes should
be increased to 22,500 square feet instead of our 15,000 square
foot lot size. Attorney Hawkins advised council we will have
to hold a public hearing if we are to change Ordinance #10 to
cover this situation. Clerk is to publish notice for hearing
on amendments proposed for Ordinance #10 and date will be
October 24 at 9:]0 pm. in the City Hall. This is also our

Messrs. Granger and Husnick appeared before council for discussion
on Peltier Hills Addition. Council and parties discussed
placement of street lights in plat and were noted on the clerk's
copy of the plat. Attorney advised that the completion date
for improvements to be made in plat had expired as of July 1,
1979. Floyd Laska made a motion to extend the completion date
time for improvements to November 1, 1979 and for Messrs.
Granger and Husnick to have their letter of credit in the
city office by October 5 to cover these items, Gary Savela
seconded it, motion carried.
Meeting on the city budget for 1980 will be Monday, September
17th at 7:00 pm in the city hall.
On recommendation of the Engineer, residents are hereby advised
that the City established the sanitary sewer system and the
city is not responsible for maintenance of the old storm
sewer system existing in the City.
Jerry Sundberg went over fire department items.
Clerk informed council of past due utility bills which will
be certified to the Auditor in October.
Loitering ordinance tabled until next meeting.

1. Such proposed assessment, a copy of which is attached hereto
and made a part hereof, is hereby accepted and shall constitute
the special assessment against the lands named therein, and each
tract of land therein included is hereby found to be benefited
by the proposed improvement in the amount of the assessment levied
against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of 20 years, the first of the installments
to be payable on or before the first Monday in January, 1980 and
shall bear interest at the rate of 8 per cent annum from the date
of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from
the date of this resolution until December 31, 1980. To each
subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior
to certification of the assessment to the county auditor, pay the
whole of the assessment on such property, with interest accrued to
the date of payment, to the city treasurer, except that no interest
shall be charged if the entire assessment is paid within 30 days
from the adoption of this resolution; he may thereafter pay to the
county treasurer the installment and interest in process of col-
lection on the current tax list, and he may pay the remaining
principal balance of the assessment to the city treasurer. In
either case payment must be made by November 15 in order to avoid
interest; December J1 of the next succeeding year.

4. The clerk shall file the assessment rolls pertaining to this
assessment in her office and shall certify annually to the county
auditor on or before October 10 of each year the total amount

Council discovered an error in letter to James Husnick from
our city attorney. Clerk will advise Mr. Husnick to appear
at the September 12th meeting for discussion on his development
contract for Peltier Lake Hills Addition.
Disucssion held on area at end of Sorel Street to use for
communter parking for the people riding the bus to St. Paul.
The council and engineer went over the assessment roll for
the street restoration project. Senior citizen deferrments
on the project were discussed. Leon L'Allier made a motion
to include the assessment for street improvements in our
senior citizen deferrment pOlicy, Fran Burque seconded it,
motion carried.
Discussion held on the excavating and grading permits which
are to be issued under Chapter 70 of the Uniform Building Code.

to be Assessed and Ordering Preparation of Proposed Assessment,

and the expenses incurred or to be incurred in the making of
such improvement amount to $56,974.46 so that the total cost
of the improvement will be $304,073.69; and of this cost the
city will pay $49,478.66 as its share of the cost.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
CENTERVILLE, MINNESOTA:
1. The cost of such improvement to be specially
assessed is hereby declared to be $197,994.64.
2. The city clerk, with the assistance of the city
engineer shall forthwith calculate the proper amount to be
specially assessed for such improvement against every
assessable lot, piece or parcel of land within the district
affected, without regard to cash valuation, as provided by
alw, and she shall file a copy of such proposed assessment
in her office for public inspection.
3. The clerk shall, upon the completion of such proposed
assessment, notify the council thereof.

Pursuant to due call and notice thereof, the City Council of the
City of Centerville held their regular meeting on Wednesday,
August 8, 1979 in the City Hall. Mayor Prachar called the
meeting to order at 8:00 pm. Present were: L'Allier, Laska,
Savela, Assistant Attorney Burke and Engineer Williams. Absent:
Burque.
Floyd Laska made a motion to accept the minutes of the July 25
meeting, Gary Savela seconded it, motion carried.
PETITIONS AND COMPLAINTS: Discussion held on the culvert and
other debris laying on the Peltier Lake Hills Addition property.
Kids are playing in culvert and could get hurt. Development
contract with Husnick/Granger was discussed. According to
contract, all improvements were to be completed by July 1, 1979.
Assistant Attorney Burke was directed to write Husnick and request
his attendance at next meeting to extend the development contract
to a later date and that there will be no additional building
permits issued until the contract is taken care of.
Mr. Krieger of Oak Hill Sand & Gravel was in attendance and
discussion held on the ditch work to be done on Mill Road. If
weather holds, Kreiger estimated the work to be done at an
hourly rate of approximately $40. and would take 8-16 hours,
cost would be determined if fill dirt could be used off of Lot 4,
Block 2, Peterson's Old Homestead Addition. Mayor was to check
with realtor concerning Lot 4. Also discussion on the concrete
slab work to be done on two manholes on Mill Road at a cost of
approximately $1,000.
Council viewed the Brian Drive change order work to be done
before meeting and Leon L'Allier made a motion to extend the
tee on Brian Drive about 75' to make it more feasible, cost
approximately $1,000., Floyd Laska seconded it, motion carried.
Discussion held on amendment to Ordinance #10 relating to ditches
on city streets. Leon L'Allier made a motion to adopt amendment
to Ordinance #10, Floyd Laska seconded it, motion carried. Copy
of amendment to Ordinance #10 is attached to and made a part of
these minutes.
Mary Jane Johnson realtor, representing Russel Ritter appeared
before council for discussion of problem between Ritter and
Mr. and Mrs. Harold Leibel.
Preliminary plat of Clearwater Creek Estates was presented to
council. It had previously been presented to P & Z with no
additions or corrections. Park fee was discussed and developer
wishes to pay 10% of subdivision land value which in this case
is $4,000. or $160. per lot. Floyd Laska made a motion to
approve preliminary plat of Clearwater Creek Estates, contingent
on Rice Creek Watershed approval, Leon L'Allier seconded it,
motion carried.

Charlotte Peterson had appeared before P & Z on August 7
with request for variance on lots she owns in Centerville.
One variance involved Lot IJ, Block 1, Peterson's Addition
to Centerville and Lots 1 and 2, Block 2, Peterson's Addition
to Centerville. The lots are 50 x 150 and by addition of
more land to each parcel, they would be more feasible for
selling of property. Floyd Laska made a motion to grant
variance to Ordinance #15, Section 6, paragraph 10 on the
following described property, legal description now reading
Lot 13, Block 1, Peterson's Addition to Centerville and now
reading: That part of the Southwest quarter of the Northeast
quarter, Section 23, Township 31, Range 22, south of Peterson's
Addition to Cenerville and North of the centerline of Clear-
water Creek and west of the west line, if extended, of Lot
13, Block 1, Peterson's Addition to Centerville excepting
an easement for ingress and egress, in, over and upon, that
part of the Southeast Quarter of the Northeast Quarter

as follows: Beginning at the SE corner of Lot 1, Block 2,
Peterson's Addition to Centerville thence South along the

Budget meeting is set for Monday, September 17 at City Hall.
Clerk read items of concern from the Fire department.

Pursuant to due call and notice thereof, the City Council
of the City of Centerville held a special meeting on
Monday, July 16th in City Hall. Mayor Prachar called the
meeting to order at 7:)0 pm. Present were Burque, L'Allier,
Laska; absent, Savela.
Discussion on the park fee arrangement for Rehbein Estates
plat was held. Consensus was for the 10 acre, 20 lot plat
the park fee would be $50. a lot totaling $1,000. payable
before the plat is signed by the mayor and clerk. Clerk
will advise Gerald Rehbein of same.
Gunnar Pederson of the Metropolitan Inspection Service
appeared before the council for being hired as the city's
building inspector/official. Mr. Pederson advised council
of his location and how his operation works as per telephone
calls for inspection, he would collect 80% of the building
permit fee, one-half of the building permit fee would be
collected as a plan inspection fee. His associate is
Edward Lebus. Floyd Laska made a motion to hire Gunnar
Pederson dba Metropolitan Inspection Service as our city's
building official for the balance of 1979, Leon L'Allier
seconded it, motion carried.
Mr. Pederson would take over as per the July permits and
Mr. Mobley would be responsible for the January to June
permits already issued.
Meeting adjourned at 8:40 pm.

Pursuant to due call and notice thereof, the City Council of the

Complaints were heard on Northwestern Bell Te~hone Company
when they are in Centerville doing work and not cleaning up
afterward.
The fence between the hall and Olson property was discussed.
Leon L'Allier made a motion to check prices for a 42- crowd
control fence, Floyd Laska seconded it, motion carried. Clerk
will check with Metropolitan Fence and report at next meeting.
Amendment to Ordinance #10 concerning the riding of horses or
other animals in the City. Leon L'Allier made a motion to
adopt amendment to Ordinance #10 which is attached to and made
a part of these minutes, Floyd Laska seconded it, motion carried.
Final plat of James Commercial Addition was presented to
council for approval. This plat is for a superette and proposed
gas pumps. After discussion of the plat and looking at the
drainage plan, James Refrigeration would like to go on record
opposed to utilizing that drainage eastment by draining platted
property to the north, especially if someone comes in and
utilizes the existing ditch, making it difficult to get around.
Gary Savela made a motion to accept the final plat of James
Commercial Addition, Floyd Laska seconded it, motion carried.
Report of Park & Rec Committee that Don Fitch of 7241 Mill
Road will be replacing Jerry Lovegren on the Park & Rec Committee
for the balance of 1979.
Discussion was held on the ditch grades on Mill Road. Clerk
is to advise parties taking out building permits for PETERSON'S
OLD HOMESTEAD ADIDITION of the ditch grades and that the City
requirements on same. Copy of letter concerning this is attached
to and made a part of these minutes. Floyd Laska made a motion
to authorize the City Engineer to institute change order on
Mill Road if costs are $1,000. or less. If over $1,000., City
Engineer is instructed to come back to the council for approval,
Leon L'Allier seconded it, motion carried.

STATE OF MINNESOTA
AN ORDINANCE ADOPTED MAY 9,1972 AND ENTITLED "AN
ORDINANCE FOR A ZONING PLAN AND BUILDING REGULATION"
IS AMENDED TO READ:
SECTION I V. ANIMALS
SECTION 3. No person owning, in possession of, or in
charge of any horse, mule or donkey shall ride or lead
said animal or knowingly permit another to ride or lead
said animal on any boulevard, public street, highway,
public park, beach or schoolyard except in such areas
duly designated as a trail way or hitching area within
the City of Centerville.
SECTION 4. PENALTIES. Any person who violates or
fails to comply with any provision of this ordinance
shall be guilty of a misdemeanor and, upon conviction
thereof, shall be punished by a fine defined by Minnesota
States or by imprisonment not to exceed ninety days.
SECTION 5. This amendment to Ordinance #10 shall be
in full force and effect from and after its passage
and publication as provided by law.

the City of Centerville held their regular meeting on Wednesday,
July 11, 1979 in the City Hall. Mayor Prachar called the
meeting to order at 8:00 pm. Present were Burque, L'Allier,

Fran Burque made a motion to accept minutes of meeting held
June 27, Floyd Laska seconded it, motion carried.
PETITIONS AND COMPLAINTS: Status of street restoration
project and the dust problem caused by the detour.
Discussion on ponding areas required by Rice Creek Watershed
on plats submitted to the Council for our approval. Consensus
of council is to make them a part of the plat so that the
city can maintain the ponding area from time of final plat
approval.
Shade Tree Program for 1979 was discussed. Council was
advised as to the replanting program for the City. Resolution
on the program was approved by Council and is attached to
and made a part of these minutes.
Flood Plain ordinance was discussed along with discussion
on the bill which was passed in the recent legislative session
concerning DNR's ruling on the l' free board. This was tabled
until the next meeting.
Mining ordinance was discussed and consensus of council was
to see if the adoption of Chapter 70 takes care of our problem
for the present and if not, the mining ordinance will be taken
up at a later date. Walt Williams will put together form
for excavating permit for submission by applicant to the city.
Discussion was held on the vacation of Westview Street. Con-
sensus is to vacate the street but still exercise physical
control. Mayor is to talk to Mr. Vidrin of the ASWS and report
at next meeting.
The matter of our Building Inspector not being certified was
discussed. Our attorney advised that we should retain a
certified building inspector as soon as possible. Leon
L'Allier made a motion for the clerk to call the State Building
Division to help us find a building inspector to replace Mr.
Mobley, Floyd Laska seconded it, motion carried.
Horse ordinance was tabled until next meeting.
Mr. Neil Petrowske appeared before council with request for
a variance on his lat at the corner of Main Street and 20th
Avenue. P & Z has recommended variance be granted on the
above lot. Leon L'Allier made a motion to grant a variance

to Ordinance #10, Section I, #11 Residnetial, G-Rear Yard
requirements because of his home being only 16 feet away
from the rear yard property line, Floyd Laska seconded it,
motion carried. Floyd Laska made a motion to grant variance
to Ordinance #10, Section 2, Residential, D-Building Site
Regulations, because the lot does not meet square footage
requirements, Fran Burque seconded it, motion carried. This
variance applies only to PLAT 2782)-PARCEL 0095, which is
the corner lot with address 7105 20th Avenue.
Gary Savela made a motion to grant a 60 day extension of
final plat presentation to James Refrigeration for their
James Commercial Addition plat, making the extension granted
to September 11, 1979, Leon L'Allier seconded it, motion carried.
Fran Burque made a motion to issue a special use permit to
Orville Hughes and Archie Gay for removal of the sewer
treatment plant on school property, Floyd Laska seconded
it, motion carried.
Floyd Laska made a motion to increase the mileage allowance

Floyd Laska made a motion to accept the final plat of Rehbein
Estates with the following stipulations: (1) Confirmation
by attorney of clear title and execution of development

Clerk is to write Olsons a letter advising them of the
council decision to place fence between their property and
City Hall.
Jerry Sundberg appeared before council with request for
variance giving Jerry Peterson a 10xx150 foot piece of his
existing lot because Peterson's deck and sewer line is too
close to his present lot line. Floyd Laska made a motion
to grant variance to Ordinance #10, Section 6, Lot Standards,
because of reason stated, Leon L'Allier seconded it, motion
carried. Variance had previously been recommended by P & z.

Pursuant to due call and notice thereof, the City Council of
the City of Centerville held their regular meeting on Wednesday,
June 27 in the City Hall. Mayor Prachar called the meeting to
order at 8:00 pm. Present were: Burque, L'Allier, Laska and
Savela.
Leon L'Allier made a motion to accept the minutes of the June
13 meeting with the following correction: Paragraph 6 - Burque
abstained from motion, Gary Savela seconded it, motion carried.
PETITIONS AND COMPLAINTS: Complaints on the dusty roads, black-
topping not moving along the way the city feels it should.
The placement of the fence between Olson/Hall property was
discussed and tabled until next meeting.
Engineer had checked on the stump situated on Main Street
across the street from Ivan Barott's property and found it
to be on County right of way. He is going to contact County
about removing it. .
Mining ordinance was tabled until the July 11th meeting.
Shade Tree Reimbursement program was discussed. Clerk to check
with Russ Almendinger about the replanting program portion.
Floyd Laska made a motion to grant a 60 day extension on the
Center Oaks #2 final plat making the date August 27th for
presentation, Fran Burque seconded it, motion carried.
Leon L'Allier made a motion to issue a 3.2 Beer permit to
the St. Genevieve's Church for their annual picnic on Sunday,
August 19, 1979, hours of sale being 12:00 Noon to 8:00 pm.,
Fran Burque seconded it, motion carried.
Clerk is to advise property owners of 1724 Main Street,
7129 Main Street and 1587 Peltier Lake Drive by certified
letter that they have 30 days from June 28th to connect to
the City sanitary sewer or the $300. penalty will go in
effect.
Mr. Neil Petrowski appeared before council for discussion
of his problem in obtaining a building permit to build a
home on the corner of Main Street and 20th in Centerville.
Clerk is to check with County Auditor concerning lot and
whether it's registered or not.
Letter read letter from the State Building Code Division
advising the City that Mr. Mobley is not a certified building
inspector. Clerk is to check with attorney concerning this.
Sample ordinance concerning horses being riden on city streets
was discussed. Tabled until July 11th meeting.

PETITIONS AND COMPLAINTS:
Problem with boats being raced and demonstrated on Peltier Lake.
Clerk is to check with Water Patrol of Anoka County on same.
Several residents voiced concern with the dust and chuck hole
problem on the city streets and ways to solve it.
Leon L'Allier made a motion that the City give consideration
in the form of a variance on set back requirements where it is
partially built up basically on county roads where there has
been a change in the right of way, Fran Burque seconded it,
motion carried.
The request of Messrs. Schmidt and Schifsky on rezoning of
parcel from industrial to commercial for purpose of mobile
home facility was discussed. Clerk read recommendation of
P & Z and Gary Savela made a motion to follow the P & Z
recommendation and reject the rezoning request, Leon L'Allier
seconded it, roll taken as follows: Savela, aye; L'Allier,
aye; Laska, aye; Burque, aye, Prachar, aye, motion carried.
Discussion on fence placement between Olson property and City
Hall was held. Leon L'Allier will look into the matter and
report at next meeting.
Request from Mr. Glenn Wong for ].2 Beer permit for the House
of Chu was taken up. Leon L'Allier made a motion to issue
a 3.2 Beer permit for the balance of 1979 to the House of
Chu, Floyd Laska seconded it, motion carried.
Mr. Tramm of Mardon Homes appeared before council with request
for a 5' variance to Ordinance #10, Section I, Ill-Residential,
Grear yeard requirements, because of the shape of the lot and
the rear yard requirements are 25' from the property line and
his footings are approximately 2]' from the line. Mr. Ed
LaBossiere was also in attendance who owns the property abutting
1594 Peltier Lake Drive and voiced his opinion on the matter.
Clerk read the recommendation of the P & Z board. Leon L'Allier
made a motion to grant a variance on the above Ordinance to Mr.
Tramm because of the lot being platted such a long time ago
and the City considered it a buildable lot, Floyd Laska
seconded it, motion carried.

The matter of stump removal on Main Street across the street
from Ivan Barrot's house was discussed. Engineer Williams
will look into the matter of whose property stumps are situated
on and who is to remove them if necessary.
Sample copy of mining ordinance was discussed and tabled until
next meeting.
Gerald Rehbein appeared before council with presentation of
Rehbein Estates final plat. There was some errors on the plat
that have to be taken care of and Leon L'Allier made a motion
to grant a JO day extension to Mr. Rehbein for his presentation,
Fran Burque seconded it, motion carried.
Discussion held on the two CETA employees Centerville will
have working for them this summer. Primary work will be done
on the skating rink and Harvey will supervise them for approx-
imately one hour a day. They will be reporting on Monday,
June 18 at the City Hall.
Request has been made by Delores Ann Anderson of White Bear Lake
to obtain a license from Centerville in order for her to operate
a cab service out of the airport. Request denied because the
City does not have any ordinance governing this situation and
she should be advised to apply through another city for license.
Discussion of Center Oaks #1 was held. Engineer bro~ght the
Council up to date on the progress of the development and
Council felt that the blacktopping that should be done by
July 1st of this year and probably won't be completed, makes
it necessary for the attorney to advise Northwestern National
Bank and First Guaranty that building permits will not be
issued after June JO from the City office.
Mayor reminded council of the meeting on June 14th in the
City Hall with Rice Creek Watershed Board members. Clerk is
to advise P & Z members of same meeting.
The matter of the culverts and planks which the City has
for sale should be placed in the Circulating Pines next week
in the form of an advertisement and bids opened on same at
the June 27th meeting.
Clerk advised Council we do not have a Tree Inspector for
the City for 1979 and she is checking with the Tree Inspector
in Lino Lakes to see if he is willing to be the Inspector for
Cen tervill e and at what co st to us.'

have asked that the following items be considered by the City
Council:
(1) The monies now in the Equipment Fund and monies that
will be deposited in same through the balance o~ 1979 be
used for construction of the new fire hall.
(2) Fire Department will pay for the initial cost of drawing
up the plans and specifications for the fire hall.
(3) Council give authority to Fire Chief if and when he
takes firemen outside the mutual aid area for drills and
training, that they would be covered under the workmen's
compensation policy. Clerk will check with insurance
carrier on this.
Fran Burque made a motion to pay general fund disbursements,
Floyd Laska seconded it, motion carried. Copy of same is
attached to and made a part of these minutes.

Leon L'Allier made a motion to accept the minutes of the May
9 meeting with the following correction to paragraph #9:
The City stated that the area she was considering was outside
the sewered area and it is not our intention to ask for addi-
tional sewer at the present time. Also, she should come to
a P & Z meeting with definite proposal and request a variance
to Ordinance #30 for trailer park,

PETITIONS AND COMPLAINTS:
Discussion was held on the Zerwas property clean-up. Floyd
Laska stated that he would stop at the Zerwas home and inform
them to put up fence within five days or animals will have to go.
Leon L'Allier made a motion for the City to reimburse the
Centerville Lions Club $178.55 for additional bill which
exceeded their $1500. donation to the construction of the
hockey rink, Fran Burque seconded it, motion carried.
Clerk requested the Fire Department members to clean up the
City Hall after their meetings and drills so it looks presentable.
Mayor read letter from the Anoka Soil and Water Conservation
District concerning funding for programs controling soil
erosion in the community. Mayor was to contact them on our
Westview Street problem.
Discussion was held on the quote from Metropolitan Fence
consisting of 42- crowd control 11 gauge wire fence, approxi-
mately 200 feet; $400. for material and $166. for install-
ation. Matter tabled until next meeting.
Gary Savela made a motion to adopt Appendix, Chapter 70,
~xcavation and Grading of the Uniform Building Code, Leon
L'Allier seconded it, motion carried. Copy of Amendment to
Ordinance #10 is attached hereto and made a part of these
minutes. Gary also requested clerk to make copies of sample
ordinance on Mining ~xtraction and distribute to council
for their review before next council meeting.
Clerk advised council on her conversation with Mr. Healy
and his attorney concerning the sewer hook up at the Park
Lane Service.
Clerk informed oouncil Ivan Barrot has registered complaint
about sewage water running on his property and wants the
problem taken care of before he will pay his utility sewer
bill.

plat for dairy store current with the council, has requested
the City to write a letter to the Department of Energy to go
along with their request for gas allocation and why the gas

Council consensus is to give Clerk authority to issue 3.2 Beer
permits to parties requesting them if they have followed all
the rules and regulations of the City. A Resolution is attached
to and made a part of these minutes listing the rules to be
followed for issuance of such permits. A copy of resolution
will also be sent to the Police Department.
Leon L'Allier made a motion to approve applications from the
Twin Lakes Gold Softball team for 3.2 beer permits along with
tournaments on June 2 & 3 and July 28 & 29 weekends at Twin
Lakes Ballfield, Floyd Laska seconded it, motion carried.
Letter from the Department of Housing and Urban Development
on the flood insurance study for Centerville was discussed.
Residents should be made aware that anyone having an existing
dwelling at an elevation higher than the flood plain requirement
may be protected from inundation by the base flood. If they
can show evidence of topographic survey and file an appeal with
HUD, they will be sent a letter advising them of elimination
from the flood insurance requirement.
Presentation was made before council by Dan Tourville for a
44 x 40 foot addition to the City Garage for the housing of
fire department equipment.

ADOPTION OF THE APPENDIX, CHAPTER 70, EXCAVATION & GRADING
The Uniform Building Code, 1973 Edition, Appendix,
Chapter 70, Excavation and Grading, as amended, is
hereby adopted as part of the Building Code of the
City of Centerville and is incorporated into the
Building Code of the City of Centerville by reference.
Ordinance No. 10 of the City of Centerville is hereby
amended to read as follows:
All provisions of or Ordinances of the City of Centerville
which conflict with the provisions of the Uniform Building
Code, Appendix, Chapter 70 as adopted, are hereby repealed.

Clerk read the public hearing notice on amendment to Ordinance
No. 10. Floyd Laska made a motion to adopt amendment to
Ordinance # 10, Fran Burque seconded it, motion carried. Copy
of amendment is attached to and made a part of these minutes.
Mrs. Donald Zerwas, 6892 Centerville Road was in attendance
requesting variance to Ordinance #10 concerning her animals
housed on their property. Floyd Laska made a motion to grant
variance to Ordinance #10, Section 1, V. Animals (a) and that
the animals have to be fenced in and the ~5 chickens butchered
on or before November 1st of this year, Fran Burque seconded
it, motion carried. Mrs. Zerwas advised council that the pony
is for sale and would be sold as soon as possible. Mayor
Prachar informed Mrs. Zerwas that the council requests no
increase in the number of animals now on the property, which
consists of 25 chickens, 5 ducks and 4 geese.
Gary Savela made a motion that the City Council meeting hours
for convening conform with daylight saving time; 8:00 pm April
through October; 7:00 pm November through March, Fran Burque
seconded it, motion carried.
Marcel Rivard appeared before council for discussion on Sorel
Street extension and water problem on his property.
Discussion on fence between City/Olson property. Floyd Laska
and Clerk were to get some prices and report at next meeting.
Clerk was instructed to write Park Lane Service and ask for
attendance at next meeting to advise COllncil on his sewer
hook-up at 1724 Main Street.
Rosalyn stanton of 20-20 Realty presented council with
request of Lyle Czeck to construct a mobile home park in
Centerville.
Leon L'Allier made a motion to adopt Resolution approving
award of the 1978-79 local planning assistance grant funds,
Fran Burque seconded it, motion carried. A copy of the
Resolution is attached to and made a part of these minutes.
As of this date, load limits are off the city streets, except
for Mill Road which will remain until conditions warrant
removing the load limits.

AN ORDINANCE AMENDING ORDINANCE NO. 10 ADOPTED MAY 9,
1972 and entitled" AN ORDINANCE FOR A ZONING PLAN
AND BUILDING REGULSTION".
The City Council of the City of Centerville does ordain:
SECTION 1. Section 1, V. ANIMALS (a) adopted on the
14th of January, 1976 is amended to read:
V.
ANIMALS
(a) In all zoning districts established by this
ordinance, no non-domestic animals shall be allowed
on a single parcel of land less than five (6) acres
in area. Non-domestic animals are animals and
poultry commonly kept on a farm such as horses,
cattle, hogs, sheep, goats, chickens and other
similar animals.
SECTION 2. This amendment to Ordinance #10 shall
become effective from and after its passage at
publicat~on.

GENERAL OBLIGATION IMPROVEMENT BONDS OF 1979;
FIXING THEIR FORM AND SPECIFICATIONS;
DIRECTING THEIR EXECUTION AND DELIVERY;
AND PROVIDING FOR THEIR PAY~!ENT.
BE IT RESOLVED By the City Council of the City of
Centerville, Minnesota, as follows:
1. The bid of Juran and Moody, Inc.
to purchase $215,000 General Obligation Improvement Bonds of
1979, of the City described in the notice of sale thereof is
hereby found and determined to be the highest and best bid
received pursuant to duly advertised notice of sale and shall be
and is hereby accepted, such bid being to purchase such bonds at
a price of $211,000.00 plus accrued interest to date of
delivery, such bonds to bear interest as follows:
1981-1984 5.50% 1990-1991
1985-1986 5.60% 1992-1994
1987 5.70% 1995-1997
1988 5.80% 1998-2000
1989 5.90%
The sum of $00 , being the amount bid in excess of
$211,000, shall be credited to the bond sinking fund hereinafter
created. The City Clerk-Treasurer is directed to retain the good
faith check of the successful bidder pending completion of the

Constitution and laws of the State of Minnesot2, including
Minnesota Statutes, Chapter 429, and is paY2ble primarily from
special assessments against property specially benefited thereby,
but constitutes a general obligation of the City and, to provide
moneys for the prompt and full payment of said principal and
interest as the same become due, the full faith and credit of the
City is hereby irrevocably pledged, and the City Council will
levy ad valorem taxes, if required for such purpose, which taxes
may be levied on all of the taxable property in the City without
limitation as to rate or amount..
IT IS HEREBY CERTI~IED AND RECITED that all acts,
conditions and things required by the Constitution and laws of
the State of Minnesota to be done, to hap?en and to be performed
precedent to and in the issuance of this bond have been done,
have happened and have been performed in regular and due form,

The Bonds when fully executed, shall be delivered by the City
Clerk-Treasurer to the purchaser thereof upon receipt of the
purchase price, and the said purchaser shall not be obligated to
see to the proper application thereof.
7. The Bonds shall be payable from the General
Obligation Improvement Bonds of 1979 Fund hereby created, and the
proceeds of general taxes, if any, hereafter levied and special
assessments to be levied for the improvements (the
"Improvements") financed by the Bonds are hereby pledged to said
fund. If any payment of principal or interest on the Bonas shall
become due when there is not sufficient money in said fund to pay
the same, the Clerk-Treasurer shall pay such principal or
interest from the general fund of the City and such fund may be
reimbursed for such advances out of proceeds of assessments for
the Improvements when collected.
8. It is hereby determined that the estimated
collections of special assessments for the pay~ent of said bonds
will produce at least 5% in excess of the amount needed to meet,
when due, the principal and interest payments on the Bonds and
that no tax levy is needed at this time. The Clerk-Treasurer is
directed to file a certified copy of this resolution with the
County Auditor of Anoka County and to obta.in the certificate
required by Minnesota Statutes, Section 475.63.

financed by the Bonds will directly and indirectly benefit the
abutting property, and the City hereby covenants with the holders
from time to time of the Bonas as follows:
(a) The City will cause the assessments for the
Improvements to be promptly levied so that the first
installment will be collectible not later than 1980 and
will take all steps necessary to assurE' pr01TIpt
collection. The City Council shall cause all further
actions and proceedings relative to the making and
financing of the Improvements to be taken with due
diligence that are required for the construction of
each Improvement financed wholly or partly from the
proceeds of the Sonds and for the final and valid levy
of special assessments and the appropriation of any
other funds needed to pay the obligations and interest
thereon when due.
(b) In the event of any current or anticipated
deficiency in said special assessments, the City
Council will levy ad valorem taxes in the amount of
said current or anticipated deficiency.
(c) The City will keep complete and accurate
books and records showing all receipts and
disbursements in connection with the Improvements, the
taxes levied and the assessm~nts levied therefor and
other funds appropr.iated for their payment, and all
collections thereof and dlsburse~ents therefrom, moneys
on hand and balance of unpaid assessments.
(d) The City will cause its books and records to
be audited at least annually by qualified public
accountants and will furnish copies of such audit
reports to any interested person upon request.
10. The officers of the City arE~ hereby authorized and
directed to prepare and furnish to the purchaser of the Bonds and
to the attorneys approving the same, certified coples of
proceedings and records of the City relating to the Bonds and to
the financial condition and affairs of the City, and such other
certificates, affidavits and transcripts as may be requ.ired to
show the facts within their knowledge or as shown by the books
and records in their custody and under their control, relating to
the validity and marketability of the Bonds and such instruments,
including any heretofore furnished, shall be deemed
representations of the City as to the facts stated therein.
11. The Mayor and Clerk-Treasurer are hereby
authorized and directed to certify that they have examined the
official statement or prospectus prepared and circulated in
connection with the issuance and sale of the Bonds and that to
the best of their knowledge and belief said statement is a
complete and accurate representation of the facts and
representations made therein as of the date of said official
statement or prospectus as it relates to the City.
The motion for the adoption of the foregoing resolution
was duly seconded by Councilmember Savela , and upon
vote being taken thereon, the following voted in favor thereof:

Pu~suant to due call and notice thereof, the City Council
of the City of Centerville held their regular meeting on
Wednesday, April 25, 1979 in the City Hall. Mayor Prachar
called the meeting to order at 7:00 pm. Present were:
Burque, L'Allier, Laska and Savela.
Gary Savela made a motion to accept the minutes of the
April 11 meeting, Floyd Laska seconded it, motion carried.
Discussion was held on the acquiring of the Anoka County
Garage facility. Leon L'Allier made a motion to refund
the County $1867. which was their sewer assessment on
the garage facility, Floyd Laska seconded it, motion carried.
Consensus was to send Resolution to the County Board of
Commissioners expressing the City's appreciation for the
acquirement of the facility and enclosing the $1867. refund
the sewer assessment. Copy of Resolution is attached to and
made a part of these minutes.
Discussion was held on placing a fence along the Olson/City
property lines. Matter tabled until next meeting.
Mrs. Mary and Mrs. Wendy Zerwas were in attendance concerning
the problem of cleanup on the property at 6892 Centerville
Road. Mrs. Mary Zerwas advised council on the disposing of
the animals now on the property and Gary Savela made a motion
giving them 15 days from this date to clean up the property,
Floyd Laska seconded it, motion carried.
Discussion held on the flood insurance bill received from
Rep. Valento. Leon L'Allier made a motion to advise Rep.
Valento and Senator Knaak of the Council's views and ask
that they support the bill which is H. F. IJ26 (S.F. 124J) ,
Floyd Laska seconded it, motion carried. Copy of Resolution
advising same is attached to and made a part of these minutes.
Mrs. Betty Berg, 7129 Main Street appeared before council
requesting the $300. late connection penalty be waived in
her case. Leon L'Allier made a motion to waive the $300.
late connection penalty because of her financial situation
but also giving her until May 25th to connect to the sewer,'
Gary Savela seconded it, motion carried.
Council consensus is to ask Gene Mobley, Building Official
to attend the Rice Creek Watershed District seminar on
individual sewage treatment systems to be held on May 11
in Shoreview. Clerk will make request.
Letters from Mill Road residents residing in the urban
service area to the north city limits concerning the
street restoration were discussed.
Ordinance concerning consultant fees was discussed and tabled
until next meeting.

Discussion was held on residents requesting speed limit
change on Centerville Road. Clerk read letter from Police
Chief Myhre on subject. Gary Savela made a motion to
adopt Resolution requesting the Minnesota State Highway
Department to investigate traffic safety and speed limit
on Centerville Road and request reducing the speed limit
to 30 miles per hour to the City limits, Leon L'Allier
seconded it, motion carried. Copy of Resolution is attached
to and made a part of these minutes.

RESOLUTION
WHEREAS, the Anoka County Board of Commissioners have on
April 10, 1979 passed a Resolution conveying county property
located in the City of Centerville at Lot Fourteen (14) and
the Westerly fifty (50) feet of Lots One (1) and Two (2)
and Three (3), all in Block Seven (7) to the City of Center-
ville for purposes of storing City properties and other
recreational purposes, and
WHEREAS, the City Council of the City of Centerville
gratefully acknowledges the receipt of said Resolution
and accepts said property on behalf of the City of Center-
ville and thereby express the City's appreciation to the
Board of County Commissioners for action taken, and
WHEREAS, the City of Centerville has assessed in the amount
of $1867. for improvements to said property to the County
of Anoka, said assessment being paid in full, and
WHER~AS, the County of Anoka has not made use of said
improvement to date
NOW, THEREFORE, BE IT RESOLVED that the City Clerk of
City of Centerville is hereby instructed to transmit to
the County of Anoka monies in the amount of $1867. as a
token of the City Council's appreciation for the County
Board of Commissioners recent Resolution #79-34.

was adopted by our Ci ty Council on Wedne'sday, April 25,

Pursuant to due call and notice thereof, the City Council of
the City of Centerville held their regular meeting on Wednesday,
April 11, 1979 in City Hall. Mayor Prachar called the meeting
to order at 7:00 pm. ~resent were: Burque, L'Allier, Laska
and Savela.
Leon L'Allier made a motion to accept the minutes of the
March 28 meeting, Floyd Laska seconded it, motion carried.
Floyd Laska made a motion to close the City office on Friday,
April 13, Fran Burque seconded it, motion carried.
Mrs. LeRoux appeared before council for discussion on the
drainage concerning Lots 3 and 4 of LeRoux Addition. Con-
sensus of council was to have Building Official advise parcel
owners of Lots 3 and 4 of drainage problem for landscaping
purposes when they build their homes.
Preliminary plat of James Commercial Addition was presented
to council. The legal description of property being: Lots
1 and 2, Block 1, James Commercial Addition. Leon L'Allier
made a motion to approve the preliminary plat of James
Commercial Addition, Gary Savela seconded it, motion carried.
Clerk read letter from Floyd Kruger to Chairman of the District
Memorial Hospital Board in Forest Lake resigning as a member
of the Hospital Board as of this date, April 11, 1979. Council
thanked Mr. Kruger for his years of service as the Centerville
representative to the Board and Fran Burque made a motion to
recommend Marita Haberman to fill the balance of Mr. Kruger's
term of office, Floyd Laska seconded it, motion carried. Clerk
will advise Chairman of Hospital Board of council's recommenda-
tion.
Discussion was held on the problems the City are having with
the Zerwas property at 6892 Centerville Road. Leon L'Allier
made a motion to instruct the attorney to advise the Zerwas'
they are in violation of Ordinance 10, Section I, V. Animals,
paragraph A and give them until April 25th to cease violation
or they will be issued a citation, Fran Burque seconded it,
motion carried.
A public hearing will be held on Wednesday, May 9, 1979 in
City Hall at 7:00 pm to amend Ordinance #10, Section I,
V. Animals, paragraph A.
Ms. Roselyn Stanton of 20-20-Realty presented council with
resume on Lyle Czech, who is interested in developing a
mobile home park in Centerville.
Mr. John Daubney, Attorney, representing Messrs. Schmitz
and Schifsky, appeared before council with request for
rezoning of parcels on Corner of Main Street and 20th Avenue

in Centerville from industrial to commercial and a special
use permit for same property. This is property 80 acres
in size and proposed use would be for a mobile home park
involving 250 units. Frank Zimny, Chairman of the P & Z
advised council on their recommendations. Mayor requested
views from council on the above concept with 3 not favoring
pruposal, one in favor. Fran Burque made a motion to refer
the proposal back to the P & Z, Floyd Laska seconded it,
motion carried.
Barton-Aschman correspondence was discussed. Floyd La$ka
made a motion to retain Barton-Aschman in an advisory
capacity on new plats, commercial ventures such as platting
and rezoning, Leon L'Allier seconded it, motion carried.
Gary Savela made a motion to pay bills as per attached
sheet, Floyd Laska seconded it, motion carried.

Pursuant to due call and notice thereof, the City Council of
the City of Centerville held their regular meeting on Wednesday
March 28, 1979 in the City Hall. Acting Mayor Francis Burque
called the meeting to order at 7:00 pm. Present were: Burque,
L'Allier, Laska and Savela. Absent: Mayor Prachar.
Gary Savela made a motion to accept minutes of meeting held
March 14, 1979, Floyd Laska seconded it, motion carried.
Clerk reported on her Clerk's Conference in Brainard she attended
last week.
Harvey Cartier appeared before council with request for an
increase in his wages from $4.50 an hour to $5.50 an hour.
Floyd Laska made a motion to increase Harvey's wages to $5.50
an hour, effective April 1st, 1979, Gary Savela seconded it,
motion carried.
Gerald Determan appeared before council with concern over
resident on his street raising bees. Clerk will look into
situation and report at next meeting.
Engineer Walt Williams was in attendance and presented council
with copies of City of Centerville map showing streets, existing
pIa ts.
Mr. Gerald Shannon of Springsted, Inc., presented council with
recommendations for the Issuance of $215,000 General Obligation
Improvement Bonds of 1979. Floyd Laska made a motion to adopt
Resolution authorizing the sale of bonds and setting the sale
for April JO, 1979 at 7:JO pm in the City Hall, Leon L'Allier
seconded it, roll call taken: Laska, aye; L'Allier, aye;
Savela, aye and Burque, aye, no nays heard, motion passed.
Discussion was held on the feasibility report on Change Order
#1 (78-1), Rehbein Addition, City of Centerville.
Acting Mayor Burque read communications from Centennial School
District thanking the City for the contribution to the summer
recreation program and Metropolitan Council advising us of our
1979 local planning assistance grant in the amount of $2,756.
Mr. Gene Mobley, Building Official, appeared before council
for discussion on the Donald Zerwas property located at
6892 Centerville Road. Clerk was instructed to advise Police
Chief to give them )0 days to clean up their property and tow
unlicensed truck off of property, give them copies of ordinances
dealing with animals and junk-nuisance and Building Official
would advise them on the disposal of various buildings on the
rear of the property.
Clerk was instructed to request opinion from the Atorney General's
office on the City's Ordinance #31.

Bidders may not specify more than 10 rates each of vlhich must be in aI1 integral

same maturity must bear a single rate from the date of issue to maturity. No rate
may exceed the rate specified for any subsequent maturity by more than 1.5% per
annum. Additional coupons may not be used. The net effective average rate of the
Issue may not exceed 7% per annum.

the addition of any discount to or the deduction of any premium from the total
interest on all Obligations from their date to their stated maturity, as computed on

Obligations. The Issuer reserves the right to reject -any and all bids, to waive
informalities and to adjourn the sale.
PAYING AGENT
Within 48 hours after the sale the Purchaser may name the Paying Agent for whose
services the Issuer will pay customary and reasonable fees. An alternate Paying
Age.nt may also be named by the Purchaser provided that there is no additional cost
to the Issuer by reason thereof.
CUSIP NU~,lBERS
It is anticipated that if the Obligations qualify for assignment of CUSIP nllmbers
such CUSIP numbers will be printed on the Obligations, but neither the failure to
print such numbers on any Obligation nor any error \vith respect thereto sh~11
constitute cause for failure or refusal by the Purchaser to accept delivee~y of the
Obligations. The CUSIP Service Bureau charge foe the assignment of CUSIP
identification numbers shall be paid for by the Purchaser.
SETTLEl\IENT
The Obligations \vill be delivered \vithout cost to the Purchaser at a place mutually
satisfactory to the Issuer and the Purchaser \vithin 40 days follo\ving the date of
their a\vard. Delivery will be subject to receipt by the Purchaser of an approving
legal opinion of LeFevere, Lefler, Pearson, O'Brien and Dra\vz of Minneapolis,
Minnesota, which opinion will be printed upon the Obligations, and of customar~7
closing papers, including a no-litigatioTl certificate. On the date of settlement
payment for the Obligations by the Purchaser must be made in a manner and in
such funds as will reasonably enable the Issuer to invest the proceeds as of the
same day.
At settlement the Purchaser \vill be furnished VJith a certificate signed by
appropriate officers of the Issuer on behalf of the Issuer to the effect that the
Official Statement prepared for the Issue did not and does not contain any untrue
statement of a material fact or omit to state a material fact J1eCessary in order to

Mr. Richard Carpenter appeared before council with discussion
on his sewer hook-up at 7095 Centerville Road. He has not as
yet had the work done and requests another extension. After
considerable discussion, Leon L'Allier made a motion to permit
the 4 remaining sewer hook-ups to have an extension until April
14th, 1979, Floyd Laska seconded it, motion carried.
The preliminary plat of Rehbein Estates was presented to council.
This plat consists of 10 acres, 20 lots, legal description as
follows: Part of the east 24 rods of the Nwi, N~i, Section 2J,
Township 31 North, Range 22 west, Anoka County, Minnesota.
Leon L'Allier made a motion to approve the preliminary plat with
the following stipulations:
Approval contingent on the drainage plan being approved
by the Rice Creek Watershed; (~lm Street) or the north
street easement be blacktopped for turnaround 75' from
the center of the tee and 16' wide
Fran Burque seconded it, motion carried.
Discussion was held on change order on the street project
concerning Brian Drive. The tee on Brian Drive be blacktopped
20' past the right-of-way on Gerald Rehbein's side of the street.
1979 Police contract with Lino Lakes was discussed. Floyd Laska
made a motion to approve contract for $19,121.80, Fran Burque
seconded it, motion carried.
Discussion on the pending bill from Carley & Associates on
the street restoration project. Floyd Laska made a motion to
pay debt of Milner W. Carley & .Associates in the amount of $9,875.58,
Fran Burque seconded it, motion carried.
Discussion was held in advising the 6 landowners on Mill ~{oad
having property in the urban service area of changing the
surface of the road during the street project. Gary Savela
made a motion to contact the 6 landowners relative to the
possibility of a change in the road surfacing from the $4. oil-
mix material to the $9.25 bituminous material, Fran Burque
seconded it, motion carried. Clerk will advise landowners by
letter and ask for reply by April 30th.

Pursuant to due call and notice thereof, the City Council
of the City of Centerville held their regular meeting on
Wednesday, February 28, 1979 in the City Hall. Mayor
Prachar called the meeting to order at 7:]0 pm. Present
were: L'Allier, Laska and Savela. Absent: Burque.
Gary Savela made a motion to accept the minutes of meeting
held February 14, 1979, Floyd Laska seconded it, motion carried.
Discussion was held on the park land area the City was
interested in purchasing.
Mr. Clement Schmitz and Mr. Jim Schifsky appeared before
council with plan for a mobile home park off of 20th Avenue
and Main Street. Discussion followed and they were advised
to come to a Planning and Zoning meeting with sketches of
proposed park including location of units, recreational
facilities and parking area.
Discussion was held on the City ~ngineer drawing up an
official map of Centerville showing all existing_ plats
and streets and adding to it as plats are approved, costing
approximately $200. Consensus was to have such map drawn
up and clerk will advise Walt Williams.
Clerk advised council that bids will be opened on the
street restoration project on Tuesday, March 6, 1979 at
2:00 pm in the City Hall.
Discussion was held on the 4 easements on Mill Road that
are necessary for the street restoration project.
The Centennial School District summer recreation program
was discussed and Leon L'Allier made a motion to contribute
$]00. to the program, Floyd Laska seconded it, motion carried.
Clerk advised council on the status of the Fire Department
Fund Certificate which has matured and information is found
on the attached sheet which is a part of these minutes.
Mayor informed council of communication from the City of
Roseau concerning the flood plain management legislation.
Complaint was received by council on the crab apple tree
in front of 7097 Centerville Road. The branches on the
tree are hanging over the sidewalk and need to be trimmed.
Clerk will advise owner of property on same.

The Fire Department fund certificate #3363 matured on
February 22, 1979 for an amount of $6,902.10.
Clerk redeemed certificate and placed in the General Fund.
She purchased a $10,000. money market certificate from
Twin City Federal Savings and Loan on February 28, 1979
for a six month period at 9.62%.
Clerk did not place one-half of the contract money from
1977 and 1978 into the Fire Department Savings Account so:

Pursuant to due call and notice thereof, the City Council
of the City of Centerville met on Wednesday, February 14,
1979 in the City Hall. Mayor Prachar called the meeting to
order at 7:00 pm. Present were Burque, L'Allier, Laska
and Savela.
Leon L'Allier made a motion to accept minutes of meeting
held January 24, Fran Burque seconded it, motion carried.
Easements for the street restoration project were discussed.
The easements involve properties of Jerry Parent, James
Schilling, John Brinkman and Ray Murray. Letters would be
sent to Messrs. Schilling and Parent advising them of the
situation and Gary Savela would speak to Messrs. Murray and
Brinkman.
Discussion was held on purchase of park property for the City
from Mrs. John Peterson. Clerk was to contact chairman of
the Parks and Rec committee to look at property in question
with members of the council and matter would be discussed at
February 28th meeting.
Mr. William Healy appeared before council with information
concerning his sewer connection at 1724 Main Street. Clerk
read letter from his attorney and Fran Burque made a motion
to grant a variance to Ordinance d30, Section 23, pending
settlement of the matter between Harold Rivard and William
Healy on above property, Floyd Laska seconded it, motion carried.
Mrs. Betty Berg appeared before council with request for
variance to Ordinance #30, Section 23 concerning her sewer
connection for 7129 Main Street. Gary Savela made a motion
to grant variance to Ordinance #30, Section 23 concerning
sewer connections for the following described properties:

Gary Savela made a motion to authorize the City to enter
into agreement with Anoka County concerning the street
restoration project involving a portion of CSAH #21, from
Heritage Street to CSAH #14 (Main Street), for an estimated
cost of $67,114 of which the County's share would be $55,007.40,
Fran Burque seconded it, motion carried.
Discussion was held on the Fire Department ~quipment Fund
certificate which matures on February 22, 1979. Matter
will be looked into and taken up at next meeting.
Clerk is to ask Police Chief to check into matter of bus
situated on Manning property and cars and domestic animals
housed at the Zerwas property on Centerville Road.
Gary Savela made a motion to pay disbursements from checks
#3769-3803 as per attached sheet, Leon L'Allier seconded
it, motion carried.

10, 1979 meeting, Leon L'Allier seconded it, motion carried.
The 1979 Engineering contract between the City of Centerville
and Milner W. Carley & Associates was discussed. Floyd Laska
made a motion to authorize the Mayor and Clerk to execute
contract with Milner W. Carley & Associates, Fran Burque seconded
it, motion carried.
Discussion was held on the warming house and rink attendant
situation.
Discussion of Outdoor Research and Development to be the
Centerville Tree Inspector for 1979 was discussed. Leon L'Allier
made a motion to authorize the Mayor and Clerk to execute
contract with Outdoor Research & Development, Fran Burque
seconded it, motion carried.
Discussion of the 1979 Animal Control Contract with Blaine
Midway All Pets was held. Fran Burque made a motion to authorize
the Mayor and Clerk to execute contract with Blaine Midway All
Pets, Gary 3avela seconded it, motion carried.
~lerk read proposed Resolution designating the week of February
26-March 2 as Minnesota Cities Week. Leon L'Allier made a
motion to adopt Resolution, Floyd Laska seconded it, motion
carried. Copy of Resolution is attached to and made a part
of these minutes.
Mayor informed council Walter Kuchinski has requested a variance
to Ordinance #30, Section 23, concerning sewer connection for
the property at 1724 Heritage Street. He will not have the
connection done by February 9, 1979, but requests an extension
until March 9, 1979. Floyd Laska made a motion to grant
extension on the following request, but if not completed by
March 9th, the $300. late connection penalty applies, Leon
L'Allier seconded it, motion carried. Clerk will prepare
letter stating same and have Mr. Kuchinski sign it.
Ken Carpenter appeared before council for discussion on the
sewer connection for his father's property at 7095 and 7097
Centerville Road. He was concerned about the 7095 Centerville
Road connection, stating that it could not be done at this
time because of the frost. Gary Savela made a motion that we
continue with the $300 late connection penalty on February 9,
assess an additional $300. penalty on June 1st for any hookups
that have not been made, an additional $300. for each 3-month
period after that which would be September 1st and December 1st,
Floyd Laska seconded it, motion carried.
Mr. Bill Healy from Park Lane Service appeared before council
with request for variance to Ordinance #30, Section 23 and
matter was tabled until further meeting.

Walt Williams was in attendance with the plans and specifications
for the street restoration project. Council went over the
specifications and decision made on opening bids March 6,
1979, 2:00 pm at the City Hall. Eesolution approving plans
and specifications and ordering advertisement of bids was
read by clerk. Floyd Laska made a motion to adopt Resolution,
Fran Burque seconded it, roll call was taken: Burque, aye;
L'Allier, aye; Laska, aye; Savela, aye; Prachar, aye; motion
carried. Copy of Resolution is attached to and made a part
of these minutes.
Discussion was held on purchasing a 50' piece of property
from Dorscher's on the east side of the City Hall. Leon L'Allier
made a motion to purchase that portion of property east of the
City Hall, 50 x 100, which would be the west 50' of Lots 5 and 6,
Block 7, Village of Centerville for $5,000., Floyd Laska seconded
it, motion carried.
Mayor informed council he has discussed the Anoka County
garage situation with Commissioner Burman. We will hear
from Mr. Burman in about a month with a decision.
Gary Savela made a motion to extend the existing contractor's
licenses for sewer installation until March 9 as long as they
have proof of bond coverage, Fran Burque seconded it, motion
carried.

Fran and Floyd Kruger will check with their committees to see if
the members are willing to serve another year.
Mr. Richard Carpenter appeared before council with request for
clarification from the Circulating Pines reporter on an article
printed in the January 4 issue of the Pines. A short discussion
was held on when he was going to have his sewer installations
done on his two properties in Centerville.
Preliminary plat of Center Oaks #2 was presented to council.
This plat consists of 26.1J2 acres and 44 lots. A number of
changes in the plat were discussed as follows:

1. Name change on streets: Mill Road and the two circles will
be changed.
2. There should be storm sewer installed to drain the MillRoad-
Center Street intersection and the Oak Circle-Center Street
intersection.
]. The lift station should be located on the park property to
the west of Lot 1, Block 5. (Invert elevation should equal
+895.50 so it can be served by gravity in the future).
4. The sanitary sewer in Center 3treet running east from the
lift station should be 12" and installed at minimum grade.
5. A (20'-0") drainage easement will be required along the back
lot lines of Lots 4, 5, 10 and 11 of Block 6. This section
of storm sewer could be ditched rather than piped. Also,
a drainage easement would be required across the exception.
6. Ponding areas will be required to meet the Rice Creek Water-
shed requirements.
7. The developer will be required to run Center Street through
to County Road 54 and install the necessary storm drainage
at that intersection.
Fran Burque made a motion to approve the preliminary plat of
Center Oaks #2 with the exception that that area south of Center
Street designated as Park would not be accepted by the City as
park land if it is to be used as a ponding area and also approval
is contingent on the council's approval of the Watershed plan
after it is drawn up, Floyd Laska seconded it, motion carried.
Clerk will advise Mr. Raudio and Surveyor of above action.
Final plat of Peltier Lake Hills Addition was presented to
council consisting of 20 lots. A Park Fee was accepted by
the council in the amount of $2,000. in lieu of park land
dedication. Floyd Laska made a motion to approve the final plat
of Peltier Lake Hills Addition and authorize the Mayor and Clerk
to enter into a Development Contract with the developers, Husnick
and Granger, Fran Burque seconded it, motion carried. Fran Burque
made a motion that when the assessment is made on the street
project, Lot 1, Block and Lot 1, Block 2 would be assessed
on the basis of 228 feet, Floyd Laska seconded it, motion carried.
Several residents in attendance stated their reasons why Milner
W. Carley & Associates should not be considered as the City
Engineer for 1979~ Floyd Laska made a motion to appoint Milner
W. Carley & Associates, our City ~ngineer for 1979, Leon L'Allier
seconded it, motion carried. Leon L'Allier stated that he would
like the council to look into hiring another engineering firm
if things are not done correctly.
Fran Burque made a motion for the engineer to prepare the necessary
papers for the easement and construction methods for the south
ditch on Mill Road as part of the street project, Floyd Laska
seconded it, motion carried.
Mayor informed council of letter from North Central Public
Service informing us of a rate increase in gas rates in our area~.

Clerk read letter from Floyd Kruger to the Centerville Lions
Club thanking them for their help on the skating rink con-
struction.
The 1979 Fire Contract with Lino Lakes was discussed. The
amount of the standby fee would be increased from 1978 to
$6,066.15. Fran Burque made a motion to approve the 1979
Contract, Gary Savela seconded it, motion carried.
Discussion was held on the construction of an addition to
the County Garage for the fire department.
Engineer Williams presented council with proposed agreement
between the City and Anoka County concerning the construction
costs for the street restoration project on Centerville Road
between Main Street and Heritage Street.
Discussion was held on advising the remaining 15 parties
who have not connected to the City Sanitary Sewer that it
must be done by February 9, 1979 and if not, a Late Connection
Fee of $)00. will be required on all connections made after
the deadline date.
Leon L'Allier made a motion to pay disbursements from General
Fund, #3708 - 3731, Floyd Laska seconded it, motion carried.
Leon L'Allier made a motion to adjourn meeting, Gary Savela
seconded it, motion carried. Meeting adjourned at 11:30 pm.
