Pursuant to due call and notice thereof, the City
Council of Centerville held a special meeting on
Tuesday, December 14, 1982 at 8:00 PM in City Hall
to discuss determination of fire service proposals.
Present: Mayor Gary Savela, Councilmen L'Allier,
Baumann and Wilharber; Fire Chief Englund, Norman
Fritchie and Dan Skoog.
Discussion was held on the fire service proposals
which are to be reviewed at a meeting on Saturday,
December 18, 1982 at Lino Lakes City Hall. Ten
representatives from Centerville will attend.
Motion by L'Allier, second by Baumann to adjourn
meeting, motion carried. Meeting adjourned at
9 : 1 5 PM.

Pursuant to due call and notice thereof, the City Council of
Centerville held their regular meeting on Wednesday, December
8, 1982 in City Hall. Mayor Savela called the meeting to
order at 7:00 PM. Present were: Baumann, L'Allier, Laska
and Wilharber.
The public hearing on Ordinance #8 was reconvened from October
27, 1982. Purpose of hearing is to adopt Ordinance #8, AN
ORDINANCE REGULATING THE SUBDIVISION AND PLATTING OF LAND
WITHIN THE CITY OF CENTERVILLE, MINNESOTA AND PROVIDING FOR
THE ADMINISTRATION AND ENFORCEMENT OF SUCH REGULATIONS.
Discussion held on items in question from October 27th hearing.
The following changes were made:
ARTICLE 1 - #15 - COMPLIANCE - First sentence is revised to
read: "Platting is required for all subdivisions creating
five (5) or more lots or parcels which are two and one-half
(2~) acres or less in size."
ARTICLE #3 - #38.04. SIDEWALKS. - Paved sidewalks four (4)
feet wide of portland cement concrete or asphaltic concrete
may be required on one or both sides of streets designated
as collector or arterial.
Motion by Wilharber, second by L'Allier to adopt Ordinance #8
with revisions, roll call taken: Wilharber, aye; L'Allier,
aye; Laska, aye; Baumann, aye; Savela, aye; motion carried.
Resolution was adopted approving text of the summary which
is attached to and made a part of these minutes.
Motion by Baumann, second by Wilharber to adjourn hearing,
motion carried. Hearing adjourned at 7150 PM.
Mayor Savela called the regular meeting to order at 7:52 PM.
Correction to November 10, 1982 meeting minutes: "Motion
by Wilharber, second by Savela to appoint Charles Baumann,
Jr., to fill the unexpired term of councilman; L'Allier,
aye; Laska, abstained; Wilharber, aye; Savela, aye; motion
carried". Motion by Wilharber, second by Baumann to
approve minutes of November 10, 1982, as amended, motion
carried.
PETITIONS AND COMPLAINTS: none.
Old Business: Communication from Walt Williams to Twin
Lakes Pavilion about manhole cover; not resolved as yet,
tabled until next meeting.

Chairman Kruger reported that eight boys had applied for
working as rink attendants at the Centerville rink; 5 from
Centerville and 3 from Lino Lakes. They are Joe Perkowski,
Larry Koch, Jr., Tony Marcello, Kyle Kruger and Ron L'Allier
from Centerville; Ron Burque, Greg Franzen and Jeff Santo
from Lino Lakes. Motion by Laska, second by Wilharber to
hire the following boys as rink attendants for winter of
82-83, Joe Perkowski, coordinator; Larry Koch, Jr., Tony
Marcello, Kyle Kruger and Ron L'Allier, with Ron Burque
as 1st alternate if needed, motion carried.
Fire Chief Bnglund reported on fire department activities.
Motion by L'Allier, second by Laska to cancel December 22
city council meeting, motion carried.
L'Allier requested Mike Ayers, 1793 Center Street, be
considered for appointment to P & Z for 1983.
Discussion on December 18th meeting at Lino Lakes to discuss
fire service proposals. Motion by Baumann, second by
Wilharber to hold special meeting on Tuesday, December 14
at 8:00 PM to discuss fire department service proposals,
motion carried.
Laska advised council on information he has on a mower/tractor
that is for sale.
Motion by L'Allier, second by Wilharber to pay current
claims, motion carried. Copy of Receipts and Disbursements
is attached to and made a part of these minutes.
L'Allier conveyed the council's thanks to Floyd Laska for
the years of service on the council and Park & Recreation
Committee.
Motion by Laska, second by Wilharber to adjourn meeting,

AN ORDINANCE REGULATING THE SUBDIVISION AND PLATTING OF LAND
WITHIN THE CITY OF CENTERVILLE, MINNESOTA AND PROVIDING FOR
THE ADMINISTRATION AND ENFORC~MENT OF SUCH REGULATIONS.
The City Council of the City of Centerville ordains:
It is the intent and effect of this Ordinance to assist
the orderly, efficient and integrated development of the
City, to provide uniform procedures and standards for all
subdivisions, to ensure consistency between future sub-
division development and the Centerville Comprehensive
Plan. This Ordinance also provides for the protection
and conservation of flood plains, shorelands, soils,
water, vegetation, energy, air quality, geologic and
ecologic features and agricultural lands. This Ordinance
further includes the penalty for violation of the
Ordinance which is a misdemeanor.
A printed copy of the Ordinance is available for
inspection by any person at the office of the City Clerk.
This summary is adopted this 8th Day of December, 1982.

RESOLUTION
CITY OF CENTERVILLE
WHEREAS, the City Council of Centerville held a public
hearing on October 27th and continued on December 8, 1982,
on ORDINANCE; #8, AN ORDINANCE REGULATING THE SUBDIVISION
AND PLATTING OF LAND WITHIN THn CITY OF CENTERVILLE,
MINNESOTA AND PROVIDING FOR TH~ ADMINISTRATION AND ENFORCE-
MENT OF SUCH REGULATIONS, and
WHEREAS, the City Council of Centerville adopted Ordinance
#8 on December 8, 1982, and
WHEREAS, the attached summary of Ordinance #8 will clearly
inform the public of its intent and effect.
NOW, THEREFORE, BE IT RESOLV~D that the City Council of
Centerville approve the text of the summary and hereby
determines that it clearly informs the public of the
intent and effect of Ordinance #8.

AN ORDINANCE REGULATING THE SUBDIVISION AND PLATTING OF LAND
WITHIN THE CI TY OF CENTERVILLE, MINNESO TA AND PROVIDING FOR
THE ADMINISTRATION AND ENFORCEMENT OF SUCH REGULATIONS.
THE CITY COUNCIL OF THE CITY OF CENTERVILLE, MINNESOTA ORDAINS:
ARTICLE 1. GEN~RAL PROVISIONS
11 . TI TLE . Thi s ordinance may be ci te d as the "C en terville
Subdivision Ordinance" and will be referred to herein as
"this ordinance".
12. JURISDICTION. The geographic jurisdiction of this
ordinance includes the entire area within the corporate limits
of Centerville, Minnesota.
13. DEFINED WORDS. Words used in a special sense in this
ordinance are defined in ARTICLE 6.
14. PURPOSE. This ordinance is adopted:
14.01. To assist the orderly, efficient and integrated
development of the City;
14.02. To provide uniform procedures and standards for
all subdivisions;
14.03. To ensure consistency between future subdivision
development and the Centerville Comprehensive Plan;
14.04. To provide for the protection and conservation of
flood plains, shorelands, soils, water, vegetation,
energy, air quality, geologic and ecologic
features and agricultural lands.
15. COMPLIANCE. Platting is required for all subdivisions
creating five (5) or more lots or parcels which are two and
one-half (2t) acres or less in size. Hereafter, no lot in a
subdivision may be sold, no permit to erect, alter or repair
any building upon land in a subdivision may be issued, and
no building may be erected in a subdivision, unless and until
a subdivision plan has been approved and, where required,
recorded, and until the improvements required by the Council
in connection therewith have either been constructed or
guaranteed, as herein provided.
16. CONFLICT. Where the conditions imposed by any provisions
of this ordinance are either more or less restrictive than
comparable conditions imposed by any other regulation, the
regulations which impose the higher standard or requirements
shall prevail.
17. SEVERABILITY. If any provlslon of this ordinance or the
application of any provision to particular circumstances is
held invalid, the remainder of the ordinance or the application
of such provision to other circumstances shall not be affected.

18. REPEAL. Ordinances including all prior subdivision
ordinances and amendments or parts thereof in force at the
time this ordinance shall take effect and inconsistent here-
with are hereby repealed, including Centerville Ordinance
No. 15. Nothing contained in this ordinance repeals or amends
any ordinance requiring a permit or license to engage in any
business or occupation.
ARTICLE 2 - DESIGN STANDARDS
21. GENERAL. 'S.ubdivision design shall comply with the
following general design standards:
21.01. NATURAL FEATURES: Existing natural features
which would add value to the subdivision and
the City such as trees, steep slopes, water-
courses, historic spots and similar irreplaceable
assets, shall be preserved, insofar as possible,
through harmonious design of the subdivision.
21.02. LAND DEDICATION. In all new subdivisions, ten
(10) percent of the gross area subdivided shall
be dedicated for public recreation space, with
such ten (10) percent being in addition to
property dedicated for streets, alleys, ease-
ments, or other public ways. No areas may be
dedicated for public use until such areas have
been approved as being suitable and needed for
the public health, safety, convenience, and or
general welfare. When the subdivision is too
small for practical dedication of public land
or if no land in the subdivision is suitable
for such use, the subdivider shall be required
to pay a fee as per schedule in effect per
lot created or ten (10) percent of the sub-
division land value, whichever is greater, prior
to subdivision; the value (market) of the land
shall be determined by negogiation between City
and developer. Lots created in any manner that
are larger than five (5) acres or three hundred
()OO) feet in width shall not be subject to
paying a fee in lieu of public land dedication,
but may be subject to dedication of land for
public use. A fee according to current schedule
will be charged on every building permit issued
pertaining to new housing units for parks and
playgrounds.
21.0). PLANNED UNIT DEVELOPMENT. The design standards
of this ordinance may be modified by the Council
in the case of a plan utilizing an unusual concept
of development which meets the requirements of
this section. The planned unit development

provision is intended to encourage original
and imaginative subdivision design which pre-
serves the natural amenities of the site and
provides for the general welfare of the City.
It shall conform with the planned unit develop-
ment requirements of the City Zoning Ordinance.
SOIL TESTS. The City Council may require soil
tests prior to the final approval of any plat.
These soil tests shall consist of test holes to
a depth necessary to determine the various types
of soil to be encountered before reaching a
stable base. Such test holes when ordered by
the City authorities, shall be drilled at the
expense of the owner or developer and the infor-
mation disclosed shall be furnished to the City
Council together with a copy of the proposed plat
showing the location of each test hole. The
information required by the City Council shall
include a report as to the various types of soil
encountered and their depths, the level of the
ground water and a seepage test and may include
additional information. The number of test
holes to be drilled and their location on the
property which is proposed to be platted will
be as directed by the City Councilor their
authorized representative. In questionable
cases, the owner shall be required to furnish to
the City Council a report from a recognized
engineering laboratory as to the safety and
practicability of the use of the area for
building construction, including the feasibility
for installation of sewage facilities.
RESTRICTIONS ON FILING AND RECORDING CONVEYANCES.
Minnesota Statute states that in a municipality
with adopted subdivision regulations, no convey-
ance of land shall be filed or recorded if the
land is described in the conveyance by:
Metes and bounds; or by
Reference to an unapproved registered land
survey after April 21, 1961; or by
An unapproved plat made after such regulations
become effective.
The above restrictions do not apply if the land
described in the conveyance:
Was a parcel of record on April 1,1945...; or
Was subject to a written agreement to convey
entered into prior to such time; or
Was a separate parcel of not less than 2.5 acres
in area and one hundred fifty (150) feet in width
on January 1, 1966; or

24.0). ALLEYS. The use of alleys in any block is to be
permitted only when absolutely necessary. Alleys
may be required in commercial areas where adequate
off-street loading space is not available.
25. LOTS. The lot and yard sizes shall conform with the
requirements of the City Zoning Ordinance No.4 and the lots
shall be designed in accordance with the following design
standards:
25.01. CORNER LOTS. The minimum corner lot dimensions
for single family detached dwelling developments
where permitted under the zoning ordinance shall be:
25.01-1 - One hundred ten (110) feet wide at the established
building setback line.
25.01-2 - Not less than one hundred fifty (150) feet in
depth and
25.01-J - Not less than sixteen thousand five hundred
(16,500) square feet.
25.02. SHAPE OF LOTS. Side lines of lots shall be
approximately at right angles to straight streets
and on radial line on curved streets. Some
variation from this rule is permitted when it is
clearly evident that such variation shall improve
the overall design. In no cases shall the rear
lot line of any lot be less than fifty (50) feet.
25.0). ACCESS'. Every lot shall be provided wi th access
adequate for the use of public safety vehicles
and other public and private purposes and shall
be served by a public or private street system,
improved in accordance with this ordinance and
connected to the general street system.
25.04. DOUBLE FRONTAGE LOTS. Double frontage lots shall
not be permitted, excepts
25.04-1 Where lots back upon a thoroughfare, in which
case vehicular and pedestrian access between the
lots and the thoroughfare shall be prohibited and
25.04-2 - Where topographic or other conditions render
sUbdividing otherwise unreasonable. Such double
frontage lots shall have an additional depth of
at least twenty (20) feet in order to allow
space for a protective screen-planting along
the back lot line and also in such instances
vehicular and pedestrial access between the
lots and the thoroughfare shall be prohibited.

25.05 NON-SEWERED LOTS. In areas which are not served by
public sanitary sewer systems, no lot shall be
developed for residential purposes unless it meets
the requirements set for lots outside the Urban
Service Area which is a minimum of ten (10)acres.
The preliminary plat shall show a feasible plan
for future re-subdivision by which lots may be
re-subdivided to meet the size and dimension
standards of lots in areas served by public sanitary
sewer system. Any preliminary plat not showing
such future re-subdivision plan shall not be re-
subdivided.
25.06. BUTT LOTS. Butt lots shall be platted at least
five (5) feet wider than the average interior lots
in the block.
25.07. DRAINAGE. Lots abutting upon a water course,
drainage way, channel, or stream shall have an
additional depth or width, as required, to assure
house sites that are not subject to flooding.
26. STREETS. No plat shall be approved unless all streets shown
thereon shall be of sufficient width and shall be so located
as to accommodate the probable volume of traffic thereon, afford
adequate light and air, facilitate fire protection, provide
access of fire fighting equipment to buildings, and provide a
coordinated system of streets conforming to the City street plan.
In addition, the street design must meet the following requirements:
26.01. In the case of subdivisions for commercial, indus-
trial and public purposes, no street giving access
upon a major street shall be located closer than
five hundred (500) feet, along the same side of
such major street, to any other driveway, public
or private street in the same or another subdivision.
26.02. Local streets shall be so planned as to discourage
through traffic.
26.oJ. Cul-de-sacs, when used, shall be held to as short a
distance as possible between the origin or main
street and the end of the cul-de-sac. Each cul-
de-sac shall have a terminus of nearly circular
shape and be a maximum allowable length of eight
hundred (800) feet.
26.04. The use of half width streets shall be prohibited,
except where essential to the reasonable develop-
ment of the subdivision in conformity with the
other requirements of these regulations and the
overall plan of the neighborhood in which the plat
is situated. Wherever a half street is adjacent to
a tract to be subdivided, the other half of the
street shall be platted within such tract.

26.05. Reserve strips controlling access to streets are
prohibited.
26.06. The minimum distance between center lines of
parallel or approximately parallel streets
intersecting a cross street from opposite
directions shall be one hundred fifty (150) feet.
26.07. Intersections of more than two (2) streets at one
point shall be avoided.
26.08. Dead end streets shall be prohibited unless pro-
vided with a turn-around or cul-de-sac arrangement.
26.09. Right-of-way requirements may be increased for
specific thoroughfares if existing or anticipated
traffic flow warrants it, or if drainage easements
parallel such thoroughfares. Such increased width
will be set by the Council under the advisement
of the Planning Commission and City Engineer.
26.10. Minimum right-oi-way widths, paving widths, angle
of intersection, curb radius, horizontal alignments,
vertical alignments, as well as maximum grades
shall be in accordance with the following table:

ERTICLE 3 - CONSTRUCTION AND IMPROVEMENTS
31. GENERAL CONDITIONS. Upon receipt of the preliminary plat
approval by the Council and prior to Council approval of the
final plat, the subdivider shall make provision, in the manner
hereinafter set forth, for the installation at the sole expense
of the subdivider of such improvements as shall be required by
the City, which improvements may include, but are not limited
to, streets, sidewalks, public water systems, sanitary sewer
systems, surface and storm drainage systems, and public utility
services. The installation of said improvements shall be in
conformity with approved construction plans and specifications
and all applicable standards and ordinances.

32. DEVELOPER'S AGREEMENT. Prior to the installation of any
required improvements and prior to approval of the final plat,
the subdivider shall enter into a contract with the City which
contract shall require the subdivider to construct said
improvements at the sole expense of the subdivider and in
accordance with approved construction plans and specifications
and all applicable standards and ordinances. Said contract
shall provide for the supervision of construction by the City
Engineer, and said contract shall require that the City be
reimbursed for all costs incurred by the City for engineering
and legal fees and other expenses in connection with the making
of such improvements. The performance of such contract shall
be financially secured by a cash escrow deposit or performance
bond as hereinafter set forth.
33. FINANCIAL SECURITY. The developer's agreement shall
require the subdivider to make a cash escrow deposit or in
lieu thereof to furnish a performance bond in the following
amounts and upon the following conditions:
33.01. ESCROW DEPOSIT. The subdivider shall deposit
with the Treasurer a cash amount equal to one
hundred fifty (150) percent of the total cost
of such improvements as estimated by the City
Engineer, including the estimated expense of
the City for engineering and legal fees and
other expenses incurred by the City in connection
with the making of such improvement.
33.02. PERFORMANCE BOND. In lieu of a cash deposit,
the subdivider may furnish a performance bond,
with a corporate surety satisfactory to the
City, in a penal sum equal to one hundred fifty
(150) percent of the total cost of such improve-
ments as estimated by the City Engineer, in-
cluding the estimated expense of the City for
the engineering and legal fees and other expenses
incurred by the City in connection with the
making of such improvements. Release of the
performance bond will be determined by Council
resolution.
3J.OJ. CONDITIONS. The developer's agreement shall
provide for a completion date on which all of
the required improvements shall be fully installed,
completed and accepted by the City. The comple-
tion date shall be determined by the Council after
consultation with the City Engineer and the sub-
divider, and shall be reasonable in relation to
the construction to be performed, the seasons of
the year and proper correlation with construction
activities in the subdivision. The developer's
agreement shall provide that in the event the
required improvements are not completed within
the time allotted, the City shall be allowed to
exercise its power to recover on the performance

bond or utilize the escrow deposit to complete the
remaining construction to City standards and
specifications. In the event the amount of funds
recovered is insufficient to cover the cost of
construction, the Council may assess the remaining
cost to the lands within the subdivision.
34. CONSTRUCTION PLANS. Construction plans and specifications
for the required improvements conforming in all respects with
the standards and ordinances of the City shall be prepared
at the expense of the subdivider by a professional engineer
registered by the State of Minnesota. Such plans and
specifications shall be approved by the City Engineer and
shall become a part of the developer's agreement. Two prints
of said plans and specifications shall be filed with the Clerk.
35. INSPECTION. All required improvements shall be inspected
during the course of construction by the City Engineer and
acceptance of said improvements by the City shall require prior
written certification by the City Engineer that said improvements
have been constructed in compliance with the plans and specifica-
tions.
36. PRIOR IMP~OVEMENTS. Improvements which have been completed
prior to application for final plat approval or execution of
the developer's agreement shall be accepted as equivalent
improvements provided the City Engineer shall certify in
writing that said improvements conform to City standards.
37. AS BUILT PLANS. Upon completion of installation of all
required improvements, the subdivider shall file with the Clerk
a reproducable tracing and two copies of plans and specifications
showing all improvements as finally constructed and installed.
All as builts plans will be prepared by City Engineer and the
time billed to the developer.
38. IMPROVEMENT CONSTRUCTION.
38.01. GENERAL. All of the required improvements specified
in this Article shall be constructed in accordance
with the City standards and all other applicable
City, County and State regulations.
38.02. MONUMENTS AND MARKERS. Concrete monuments shall
be set at the intersection of all lines forming
angles in the boundary of the subdivision. Iron
or steel markers shall be set at the beginning
and ending of all curves along street property
lines; at all points where lot lines intersect
curves, either front or rear; at all angles in
property lines of lots and at all other lot corners.
38.03. STREETS. The streets shall be graded if required by
the Council to the grades and dimensions shown on
plans and profiles and approved by the Council
and shall include the following improvements:

J8.06. WA~R SUPPLY. Where public water supply is
aval~a?le, as determined by the Council, the
subdlvlder shall connect to such public water
supply and construct a system of watermains
with a connection for each lot. The minimum
size of watermains shall be six (6) inches
and the minimum size of private water services
s~all be one (1) inch. Watermains and ser-
Vlces for commercial and industrial uses or
for the extension of major trunks shall be
determined by the City Engineer.
J8.06-1 - Where public water is not available the
subdivider shall supply acceptable ~vidence
of the availability of water. The subdivider
may be required to make one or more test
wells in the area to be platted if such
evidence is deemed not acceptable. Copies
of well logs from said test wells which
are obtained shall include the name and
address of the well driller and shall be
submitted with the plan to the Council.
J8.06-2 - If a.privat~ i~d~vidual water supply is
permltted, lndlvldual private wells shall
be located at least twenty-five (25) feet
from property lines; fifty (50) feet from
all septic tanks; approximately one hundred
(100) feet from all tile disposal fields and
other sewage disposal facilities; ten (10)
feet from all cast iron sewer lines; thirty
(30) feet from any vitrified sewer tile lines;
and shall not be located within any floor plan.
38.07. SEWERS. All plats within the Urban Service Area
shall be connected to the municipal sewer system.
38.08. UTILITIES. Every lot in a subdivision shall be
capable of being served by utilities, and ease-
ments a?ceptable to the utility companies shall
b~ pr~vld~d. ~lectric, gas and other utility
dlstrlbutlon llnes shall be installed within
public rights-of-way or within properly desig-
nated easements. To the fullest extent possible
u~de:ground ~tility lines shall be installed '
wlthln the rlght-of-way adjacent to but not
beneath existing and proposed paved areas.
J8.09. TREES. One (1) tree per lot shall be planted in
the front yard. The location and types of trees
must meet the approval of the Council.

J8.0J-l - Suitable drainage structures, culverts, storm
sewers, ditches and related installations shall
be provided to insure adequate drainage of all
points along the streets. There shall be no
surface or at grade cross street drainage.
38.0J-2 - Concrete curbs and gutters will be required
on all streets.
J8.0J-J - The base course shall consist of latest Minnesota
Department of Hi~hways approved material,
bearing a seven (7) ton design.
38.0J-4 - "Blacktop" paving as specified by the City
Engineer shall be required on all streets
after water distribution lines, storm sewers
and sanitary sewers have been installed.
38.0J-5 - The boulevards shall receive three (3) inches
of topsoil and be seeded.
38.04. SIDEWALKS. Paved sidewalks four (4) feet wide of
portland coment concrete or asphaltic concrete may
be required on one or both sides of streets
designated as collector or arterial.
38.05. STORM DRAINAGE. The construction of a storm
drainage system shall conform to the following
requirements:
J8.05-1 - Drainage ditches or channels shall have a
minimum gradient of one (1) percent.
38.05-2 - Open watercourses shall have adequate capacity
and erosion control to insure safe and healthful
disposal of storm water.
38.05-J - When topsoil has been removed from the surface
of a lot on a slope where erosion will cause
a displacement of loose material, the subdivider
shall be required to seed or provide other means
to prevent the wash from damaging adjacent
property or accumulating on street surfaces.
J8.05-4 - Design of storm drainage facilities shall be
compatible with adjacent areas including the
extension of abutting existing storm sewers.
Design of all drainage structures shall be based
on the five (5) year occurrence for design
intensity using run-off co-efficients and con-
centration times as determined by the City
Engineer.
J8.05-5 - The storm sewer design shall also meet the
requirements of the Rice Creek Watershed.

38.10. ST~~T LIGHTING. In single and multiple family
developments, the developer shall install resi-
dential ornamental street lights and custom poles
as recommended by City Engineer. In commercial
or industrial developments, the developer shall
install commercial or industrial metal poles
and fixtures as recommended by the City Engineer.
38.11. STREET NAME AND TRAFFIC CONTROL SIGNS. In single
and multiple family developments, the developer
shall install all street name signs and traffic
control signs as deemed necessary by the City
Engineer. In commercial or industrial develop-
ments, the developer shall install all street
name signs and traffic control signs as deemed
necessary by the City Engineer.
ARTICLE 4 - PLAT SPECIFICATIONS AND PROCEDURE
41. GENERAL. In a subdivision for residential use of less than
five (5) lots and where the lots abut existing public roads
and utilities, the Council may waive certain requirements such
as topographic, street and utility specifications, in the
instance such information is not required.
42. SKETCH PLAN. The subdivider shall prepare a sketch plan
to present to the Planning Commission at the advisory meeting.
This plan may be drawn as a freehand pencil sketch and does
not require precise dimensions or any special sheet size. This
sketch plan may be used to show the commission the location,
proposed street and lot layout and any other significant
features of the proposed subdivision.
43. PRELIMINARY PLAT. The following maps and data shall be
submitted with the application for preliminary plat approval.
These maps and data may be on separate sheets or combined
on one sheet, depending on the size and complexity of the
proposed subdivision. The overall size of the sheets shall
be determined by the City Engineer.
43.01. LOCATION MAP. A map of the proposed subdivision
showing:
43.01-1 - Boundary lines of proposed subdivision, clearly
indicated;
43.01-2 - Existing zoning of the tract and adjacent properties;
43.01-3 - Total approximate acreage in said plan;
43.01-4 - Location, widths and names of all existing or
previously platted streets or other public ways,
showing types of improvements, if any, railroad
and utility rights-of-way, parks, and other public
open spaces, pernament buildings and structures,
easements, and section and corporate lines within
the tract and to a distance of one hundred (100)
feet beyond the tract.

4J.02. SITE MAP. A map of the proposed subdivision and all
lands within five hundred (500) feet of its boun-
daries showing:
43.02-1 - Contours of the site at vertical intervals
of two (2) feet;
4J.02-2 - Character and location of natural or artifical
features existing on the land which would affect
the design of the subdivision, such as wooded
areas, drainage ditches, direction and gradient
of ground slope, embankments, retaining walls,
buildings, or non-residential usage of land;
43.02-3 - Names of owners of properties adjacent to the
subdivision;
43.02-4 - Existing and proposed streets and rights-of-way,
including widths and purposes;
4J.02-5 - Existing and proposed easements, including
widths and purposes;
4J.02-6 - Utilities, including the size, capacity, and
location of sanitary sewers, storm sewers,
drainage facilities, water lines, gas mains and
power lines;
43.02-7 - Areas subject to periodic overflow of flood or
storm waters;
4J.02-8 - Tract boundary lines by calculated distances
and bearings;
4J.02-9 - Title, graphic scale, north point and date.
43.03. SUBDIVISION PLAT. A plat of the proposed sub-
division drawn on an overlay of the topography
at a scale no smaller than one hundred (100) feet
to one (1) inch showing:
43.03-1 - Proposed name of subdivision, which name shall
not duplicate the name of any plat theretofore
recorded in the County;
43.0J-2 - Location by section, town and range, or by
other legal description;
43.0J-3 - Names and addresses of owner and subdivider,
and the names of the city planner, land planning
consultant or surveyor who prepared the plan;
4J.OJ-4 - Street pattern, including the names (which shall
not duplicate existing streets in the City unless
it is an extension of an existing street), widths
of rights-of-way of streets, approximate length
of streets and widths of easements for alleysj

4J.03-5 - Indication of the proposed storm water runoff
through use of arrows or notes;
4J.oJ-6 - Layout of lots, including dimensions, square
footage, numbers, building setback lines or
front yard lines; location and widths of
easements;
4J.03-7 - Location and area of parcels of land to be
dedicated or reserved for schools, parks, play-
grounds or other public or community use;
4J.03-8 - Legend, notes graphic scale, north point and date.
4J.04. ENGINEERING PLANS. ~ngineering plans prepared by
a registered engineer for the proposed subdivision
may be requested by the City Engineer during the
subdivision process and shall include but not be
limited to the following:
4J.04-1 - Show location and invert elevations of proposed
sanitary sewer on preliminary plat;
4].04-2 - Show storm sewer pipe, catch basins and invert
elevations on proposed plat. Indicate back-
yard drainage with arrows;
4J.o4~3 - Show_ proposed street grades everyone hundred
(100)feet on preliminary plat.
4J.05. RESTRICTIONS. A draft of the protective covenants
or private restrictions to be incorporated in
the final subdivision plat.
44. FINAL PLAT. The final plat shall be drawn at a scale no
smaller than one hundred (100) feet to one (1) inch. The final
plat shall show:
44.01. Subdivision name, name and address of owner and
subdivider, source of title of land as shown by
the books of the County Register of Deeds, graphic
scale, north point, date, certificate of approval
of Council.
44.02. Survey data showing:
44.02-1 - Accurate angular and lineal dimensions for all
lines, angles, and curvatures used to describe
boundaries, streets, easements, area to be
reserved for public use and other important
features. Lot lines to show dimensions in feet
and hundredths.

44.02-2 - An identification system for all lots and blocks.
44.02-3 - True angles and distances to the nearest
established street lines or official monuments
(not less than two), which shall be accurately
described in the plat.
44.02-4 - Municipal, township, county or section lines
accurately tied to the lines of the subdivision
by distances and angles.
44.02-5 - Radii, internal angles, points and curvatures
and lengths of all acres.
44.02-6 - Accurate location of all monuments. Pipes or
steel rods shall be placed at the corners of
each lot and at each intersection of street
centerlines.
44.02-7 - Accurate outlines, legal descriptions of any
areas to be dedicated or reserved for public
use, or for the exclusive use of property owners
within the subdivision with the purposes indicated
therein.
44.02-8 - Certifications by a registered land surveyor,
to the effect that the plat represents a survey
made by him and that monuments and markers shown
thereon exist as located and that all dimensional
and geodetic details are correct.
44.oJ. Limitations of easements and restrictions which will
run with the land and become covenant in the deeds
for lots.
44.04. Notarized certification by owner, and by any mortgage
holder of record, of the adoption of the plat and
the dedication of streets and other public areas.
45. PROC~DUR~ FOR SUBMISSION OF PLATS.
45.01. GEN~RAL: The preliminary plat of the proposed sub-
division must be approved by the Council before any
person, firm or corporation proposing a subdivision
shall proceed with any grading and improvements for
streets or installation of public utilities. The
final plat of the proposed subdivision must be
approved by the Council and recorded in accordance
with the provisions hereof before any person, firm
or corporation proposing a subdivision shall sell,
agree to sell, transfer lease or otherwise convey
any lot, parcel or tract in a subdivision, or construct
or commence the construction of any building in a
subdivision.

45.02. ADVISORY MEETING. A person or corporation desiring
approval of a plat of a subdivision shall appear
before the Planning and Zoning Commission to discuss
his proposal before filing an application for pre-
liminary plat approval. No fee or formal application
is required for this meeting. Its purpose is to save
the subdivider time and money. The subdivider shall
be prepared to discuss the details of his proposed
subdivision, including such items as the proposed use,
existing features of the area, existing covenants,
land characteristics, availability of community
facilities and utilities, size of development,
play areas or public areas, proposed protective
covenants, proposed utilities and street improvements.
The Commission will answer any questions from the
subdivider and may suggest professional advice.
45.0> PRELIMINARY PLAT. After the advisory meeting, the
subdivider shall submit an application for approval
of a preliminary plat to the Clerk. The application
shall be accompanied by the following:
(1) Ten (10) copies of all maps and data set forth
in these regulations.
(2) A certified check or money order in an amount
to cover the scheduled preliminary fees.
45.03-1 - ACTION BY THE CLERK. The developer should submi t
plans to Clerk ten (10) days before meeting to
provide adequate time for review. The clerk shall
send one (1) copy of each of the maps and data to
the City Engineer, the City Planner and members of
the Planning and Zoning Commission for review.
45.03-2- lCTION BY COMMISSION. The Planning & Zoning
Commission shall review the preliminary plat and
shall set a public hearing on the preliminary plat,
the time and place to be published in the official
newspaper at least ten (10) days before the day
of the hearing. Following such hearing the
Commission shall recommend approval or disapproval
of the preliminary plat with such changes and
conditions as it may suggest and shall transmit
its recommendations, the Commission shall determine
whether the proposed- plat is consistent with the
regulations specifiea in this ordinance and with
the comprehensive plan of the city and whether
the proposed development will advance the general
welfare of the area and the city.

45.03-3 - ACTION BY COUNCIL. Upon receipt of the reco-
mmendations of the Planning Commission, the
Council shall consider the application and
after holding such public hearings as it deems
desirable, shall approve or disapprove the
application, shall approve or disapprove the
application with such changes or conditions,
if any, as it may deem appropriate. This may
include the requirement for a development con-
tract between the city and the applicant.
Refusal of any of the changes or conditions shall
constitute denial of the application by the
City Council. Failure of the applicant to
notify the City Council of his acceptance or
refusal of the modifications to the preliminary
plat constitute acceptance of these conditions.
The City Council shall approve or disapprove the
plat within one hundred twenty (120) days from
the application by the subdivider unless the time
period is extended by agreement.
45.04. FINAL PLAT. Within one hundred eighty (180) days
from receiving the last required approval of the
preliminary plat by the City Council, the developer
shall submit an application for final approval
to the Clerk, as set forth in these regulations.
The application shall be accompanied by:
One (1) copy of the plat which is to be recorded.
Four (4) prints of the plat for city records.
A certified check or money order in an amount to
cover the final fees.
A certificate that all improvements required by
these regulations and all other applicable City
ordinances have been installed in strict accordance
with the standards of construction of the City; or
a guarantee that the improvements will subsequently
be installed by the owner, in the form of a bond that
will cover the cost of improvements as estimated by
the City Engineer or Council. Failure to provide
such data within the ninety (90) day period shall
render null and void the approval of the preliminary
plat. An extension of this time period may be
granted by the City Council on request of the developer.
Final plat will not be approved until developer gets
approval from Rice Creek Watershed.

45.04-1 - ACTION BY CLERK. The clerk shall send one (1)
copy of each of the final data to the City
Engineer and City Attorney for review.
45.04-2 - ACTION BY COUNCIL. Upon receipt of the reports
of the City Engineer and City Attorney, the
Council shall consider approval of the final plat.

45.04-2 - ACTION BY COUNCIL - continued.
Following approval by the Council, the mayor or
other authorized person shall endorse the plat
and the clerk shall return it to the applicant.
If the final plat is not in substantial compliance
with the regulations and conditions set forth,
the clerk shall return the final plat to the
applicant with an attached statement identifying
the areas of non-compliance. The City Council
shall approve or disapprove the plat within
sixty (60) days of staff reports.
45.04-J - RECORDING. The subdivider shall present a copy
of the approved final plat to the Register of
Deeds of the County. Unless the plat is duly
recorded within sixty (60) days from the date
of final plat approval, the City approval of the
plat is void.
45.04-4 - NON-COMPLIANCE. In the event the final plat
as submitted for final approval is returned
for non-compliance:
1. The applicant may treat such notification as denial
of final approval;
2. The applicant may re-submit the plan so it does
comply with the regulations and conditions set forth;
J. The applicant may file a written request for a hearing
before the Council, unless having previously been
heard by the Council.
ARTICLE 5 - ADMINISTRATION AND ENFORCEMENT.
51. GEN~RAL.
51.01. ADMINISTRATOR. The City Clerk shall serve as the
administrator who shall be responsible for the
administration of this ordinance and shall:
51.01-1 - Administer the provisions of this ordinance
in accordance with its literal terms and
regulations.
51.01-2 - Collect the fees as established by resolution
of the City Council.
51.01-3 - Maintain permanent and current records per-
taining to this ordinance, including but not
limited to maps, amendments, appeals, and
applications therefor.
51.01-4 - Receive, file, and forward petitions for appeals,
amendments or other action to the appropriate
official bodies.

51.02. PUBLIC HEARING. Before acting on any subdivision
plan, the Planning and Zoning Commission shall
arrange for a public hearing thereon, after giving
notice of the time and place in the official
newspaper of the City at least ten (10) days prior
to the day of the hearing.
51.0]. VARIANCES. The Council may grant a variance upon
receiving a report from the Planning Commission
in any particular case where the subdivider can
show that by reason of exceptional topography
or other physical conditions, the strict compliance
with these regulations, could cause unnecessary
hardship. Application for such a variance shall
be made in writing by the subdivider at the time
the preliminary plat is filed with the Clerk. A
variance thus granted shall be recorded in reso-
lution form entered in the minutes of the Council
setting forth the reasons which justified the
action.
51.04. INSPECTION. When the plans of streets and other
improvements have been approved as provided in this
ordinance, the subdivider shall first notify the
Clerk of his intention to proceed with the con-
struction or installation of said streets and
improvements-, notification shall be made at least
twenty-four (24) hours before any such construction
or installation shall commence so as to give the
City officials an opportunity to inspect the site
prior to commencement of work and to inspect
installation or construction of said streets and
improvements during the course of work being per-
formed. In order to defray a part of the costs
incurred by the City in inspecting the installation
of the improvements required by the ordinance, the
subdivider shall, before he proceeds with any
construction or installation present a certified
check or money order made payable to the city in
an amount equal to three percent (3%) of the City
Engineer's estimate of the cost of the improvements.
51.05. MAINTENANCE BOND. After the utilities and streets
are approved, the developer shall furnish the City
with a one (1) year maintenance bond equal to
twenty (20%) percent of the construction costs.
During the one (1) year maintenance bond period,
the City will perform routine maintenance. Any
unusual problems shall be corrected by the developer.
After one (1) year, the City Engineer will inspect
the utilities and streets. If everything is
acceptable, the City will accept full responsibility
from that point on.

51.06. BUILDING PERMITS. No building permit shall be issued
for the construction of any building, structure or
improvement to the land or any lot within a sub-
division as defined herein which has been approved
for platting, until all requirements of this
ordinance and all provisions for street construction
and land improvement have been complied with in full.
Furthermore, no building permit will be issued for the
construction of any building structure on any lot
within the city which does not abut on a publicly
dedicated and maintained street.
52. AMENDMENT.
52.01. IN GENERAL. This ordinance may be amended by
following the procedure specified in this section.
52.02. INITIATION. An amendment may be initiated by the City
Councilor the Planning Commission or by the petition
of a resident to the City Council. An amendment not
initiated by the Planning Commission shall be referred
to the Commission for study and report, and the Council
shall not act on the amendment until it has received
the recommendation of the Planning Commission or until
sixty (60) days have elapsed from the date of
reference of the amendment without a report by the
Commission.
52.0). ACTION BY COMMISSION. Before any amendment is adopted,
the Planning Commission shall hold at least one (1)
public hearing thereon after a notice of the hearing
has been published in the official newspaper at
least ten (10) days before the hearing. Following
the hearing, the Planning Commission shall make a
report of its findings and unless the amendment has
been initiated by the Commission and the Commission
determines not to recommend it to the Council, it
shall file a copy with the City Clerk within fourteen
(14) days of the meeting at which the date of the
hearing was set. When the amendment has not been
initiated by the Commission, the report shall, in
any event, be filed no later than sixty (60) days
from the date of reference of the amendment to the
Commission. Failure of the Planning Commission so
to report on an amendment not initiated by it is
deemed to be approval by the Commission of the
amendment.
52.04. COUNCIL ACTION. Upon the filing of such report, or
upon the failure of the Planning Commission to file
such a report within the time prescribed by Section
52.0] on an amendment proposed by petition or by the
Council, the City Council shall hold such public
hearings as it deems advisable. After the conclusion
of the hearings, if any, the council shall act upon
the request within forty-five (45) days to adopt the
amendment or any part thereof in such form as it
deems advisable.

52.05. FEE. Any person filing a petition requesting an
amendment to this ordinance shall pay a fee
according to the schedule established by the City
Council. The fee is payable at the time of filing
and is not refundable.
53. APPEALS. The City Council shall have the power and duty
of hearing and deciding appeals where it is alleged that there
is an error in any order, requirement, decision or determination
made in the administration or enforcement of this ordinance.
53.01. PROCEDURE. An appeal for administrative review may
be taken to the Council by any person, firm or
corporation or any city officer, department, or
agency affected by an adverse decision in the
administration or enforcement of this ordinance.
Such an appeal shall be taken by filing a notice
of appeal specifying the grounds thereof with the
City Clerk and the Council within thirty (30) days
after the decision. If the appeal is not taken by
the owner of the property which is the subject
matter of the decision appealed from, the notice
shall not be so filed until after it has been served
upon such owner either in person or by mail. The
City Clerk shall forthwith transmit to the Council
all papers constituting the record upon which the
action appealed from was taken. An appeal for an
administrative review stays all proceedings, in-
cluding criminal proce~dings, in furtherance of
the action appealed from unless the administrator
certifies to the Council that by reason of facts
stated in the certificate a stay would, in his
opinion, cause immipent peril to life or property.
In that case the proceedings shall not be stayed
otherwise than by a restraining order granted by
a court of competent jurisdiction. The Council
shall at its next regular meeting after the filing
of an appeal to it from a decision, set a date
for hearing thereon, which shall be not later than
sixty (60) days after the meeting. After hearing
the oral or written views of all interested persons,
the Council shall make its decision at the same
meeting or at a specified future meeting thereof.
The decision of the Council may be appealed to
the County District Court.
53.02. FEES. There shall be no fee charged for appeals.
54. PENALTY. The penalty for violation of this ordinance shall
be as defined in Ordinance No. 19.

ARTICLE 6 - D~FINITIONS
For the purpose of this ordinance, certain words and terms are
hereby defined as follows:
61.01. Alley is a public right-of-way which affords a secondary
means of access to abutting property.
61.02. BLOCK: A tract of land bounded by streets or a
combination of streets, parks, cemeteries, railroad
rights-of-way, shorelines, waterways or corporate
boundary lines of the City.
61.0). BOUNDARY LIN~S: The lines indicating the bounds or
limits of any tract or parcel of land.
61.04. BUILDING LINES: The line also referred to as setback
line means the line beyond which property owners or
others have no legal or vested right to extend a
building or any part thereof without special permission
and approval of the proper authorities.
61.05. BUTT LOT: A butt lot is a lot, the side line of
which coincides with the back line of one or more
other lots.
61.06. COMPR~HENSIVE PLAN: The comprehensive development
plan made and adopted by the City of Centerville,
Minnesota, indicating the general locations recommended
for major thoroughfares, streets, parks, public buildings,
zoning districts and other public improvements.
61.07. CONTOUR MAP: A map on which irregularities of a land
surface are shown by lines connecting points of equal
elevations. Contour intervals is the vertical height
between contour lines.
61.06. CORN~R LOTS: The lot or lots within a plat and
situated at the corners thereof so that they are
bounded on two sides by streets. This term applies
to any lot within the plat at street intersections
and bounded on two sides by streets.
61.09. CROSS WALK: A right-of-way, municipally owned, which
cuts across a block to furnish access for pedestrians
to adjacent streets or properties.
61.10. CUL-D~-SAC: (Court or Dead-~nd Street) A short
minor street having one end open to traffic and
being permanently terminated by a vehicular turn-
around.
61.11. EAS~MENT: A grant by the property owner to the use of
a strip of land by the public, a corporation, or persons
for specific purposes.
61.12. FRONTAG~: The width of a lot or building site measured
on the line separating it from a public street or way.
61.13. HALF STREET: A street divided longitudinally by a
property line.
61.14. LAND SURV~YOR: A registered land surveyor capable of
preparing engineering plans for land subdivision plats.
61.15. LOT: A portion of a subdivision, or other parcel of
land intended as a unit for transfer of ownership
or for development capable of being occupied by one
or more structures.
61.16. LOT D~PTH: The mean horizontal distance between the
front and rear lines of a lot.
61.17. LOT DOUBL~ FRONTAGn: A lot, the generally opposite
ends of which both abut on streets.
61.18. LOT WIDTH: The mean width measured at right angles
to the depth.
61.19. NATURAL WATnRWAY: Any natural passageway in the
surface of the earth so situated and having such a
topographical nature that surface water flows through
it from other areas before reaching a final ponding
area. The term also means to include any and all
drainage structures that have been constructed or
placed for the purpose of conducting water from one
place to another.
61.20. OWN~R: The person having legal title, his duly
authorized agent or attorney in fact, a purchaser,
devisee, fiduciary and a person having a vested
interest in the property in question.
61.21. P~D~STRIAN WAY: A public or private right-of-way
across a block or providing access within a block,
to be used by pedestrians and for the installation
of utility lines.
61.22. PLAT: A map or chart indicating the subdivision or
re-subdivisions of land, intended to be filed for record.
61.23. RIRHT-OF-WAY: The land covered by a public road or
other land dedicated for public use or for certain
private use of such as land over which a power line
passes.
61.24. RESERV~ STRIPS: Narrow strips or narrow strips of
land usually withheld from the street right-of-way
to form a barrier between certain property and the
public street or oc thoroughfare.

61.25: STR~ET: A right-of-way which affords the principal
means of access to abutting property. A street may be
designated as a highway, thoroughfare, parkway,
boulevard, road, avenue, lane, drive, place or other
appropriate name. A street may also be identified
according to type of use as follows:
(a) Arterial Street or Highway: Streets providing
for traffic movements between traffic generation
areas.
(b) Collector Streets: Streets providing connection
primarily between arterial streets or arterial
and local streets.
(c) Local Streets: Streets serving primarily as
access to abutting properties and not intended
as major streets or highways carrying through

Pursuant to due call and notice thereof, the City Council of
Centerville held their regular meeting on Wednesday, November
10, 1982 in City Hall. Mayor Savela called the meeting to
order at 7:00 PM. Present were: L'Allier, Laska and Wilharber.
Motion by Wilharber, second by L'Allier to approve the minutes
of the October 27 meeting, motion carried. Motion by Wilharber
second by Laska to approve the canvass of ballots on November
3, 1982, motion carried.
Council considered the following letters of intent for the
unexpired term of councilman: Dan Tourville, Jr., Walter
Prachar and Charles Baumann, Jr. Motion by L'Allier, second
by Laska to appoint Dan Tourville to fill the unexpired term,
L'Allier, aye; Laska, aye; Wilharber, nay; Savela, nay,
motion failed. Motion by Wilharber, second by Savela to
appoint Charles Baumann, Jr., to fill the unexpired term
of councilman, L'Allier, nay; Laska, abstained; Wilharber,
aye; Savela, aye; motion carried. Charles Baumann, Jr.,
was given the oath of office by clerk. Term of position
will expire on December 31, 1984.
PETITIONS AND COMPLAINTS: Contact firm to move heater that
blows on top of fire truck in adjacent room, hot water heater
not working properly, purchase six barrels for placing debris.
OLD BUSINESS: Letter from Engineer was referred to concerning
complaints of October 27th meeting. #1 - manhole in low spot
on east side of Pavilion parking lot; request owner of Twin
Lakes to adjust it according to engineer specifications; #2 -
storm sewer on Shad Avenue - Harvey will take care of placing
covers on storm sewer; #3 - additional gravel on portion of
Heritage Street west of LaMotte Drive - motion by Wilharber,
second by Laska to purchase 15 yards of gravel for same,
motion carried. Letter from James McBride, 1759 Peltier
Lake Drive was distributed concerning complaint of debris
and van in yard and residing in home before occupancy permit
has been issued. Request Police to check city park property
periodically for kids riding three wheel vehicles in area;
ask Dan Tourville if City can house snow plow truck in one of
his buildings for winter.
Motion by Wilharber, second by L'Allier to cancel November
24th City Council meeting, motion carried. Next meeting will
be December 8th, 7:00 PM.
Fire Chief requested seating capacity of Twin Lakes Pavilion
be checked. Consensus was to have all establishments checked.
Requested two members of council to be on committee with fire
department representatives to work on contract with Lino Lakes
for long range fire protection. Council representatives -
Charles. Baumann, Jr., Tom Wilharber and Gary Savela.
Motion by Laska, second by L'Allier to pay current claims,
motion carried. Clerk amended claims to add council salaries.
Motion by Wilharber, second by Baumann to adjourn meeting,
motion carried. Meeting adjourned at 8:00 PM.

pursue the project.
Letter frmm S'pringsted, Inc., concerning issuance of bonds
for new municipal building was discussed. Clerk is to check
on Springsted fee schedule and discount figure on bond sale.
Information from attorney Hawkins on feasibility of "sewer
sludge" ordinance for city was discussed. Mayor will call
Mr. George Johnson of PCA and request his attendance at
October 27th meeting to discuss further.
Floyd Laska advised council Centerville Lions Club have
purchased the bases for both ballfields in the park, cost
being $319.00.
Consensus of council to participate in Federal Surplus
property membership program, cost being $25.00 for period
October 1, 1982 through September 30, 198].

Pursuant to due call and notice thereof, the City Council
of Centerville held their regular meeting on Wednesday,
September 22, 1982 in City Hall. Mayor Savela called
the meeting to order at 8:00 PM. Present were: L'Allier,
Laska, Murray and Wilharber. Motion by Wilharber, second
by Laska to approve minutes of September 8, 1982 meeting,
motion carried. Motion by L'Allier, second by Wilharber,
to approve minutes of Revenue Sharing hearing, motion
carried.
PETITIONS AND COMPLAINTS: None
Information on the monies available from the Metropolitan
Council on land planning grants was discussed and clerk
was instructed to apply for same.
#2 under Old Business was tabled until next meeting.
#3 under Old Business - Attorney Hawkins is currently
working up ordinance for both Lino Lakes and Centerville
on sewer sludge spreading in communities.
Messrs. Holmen and O'Brien were in attendance and gave
brief report on 1982 summer recreation activities in
District #12.
Mr. Laska presented council with quote on bases for both
ballfields amounting to $155.70. Matter will be dis-
cussed with Park Committee before decision is made.
Motion by Wilharber, second by Laska to ask Hank Miers
to mow the grass in the park area once more this year,
motion carried.
Messrs. Frank Zimny and Dan Skoog were in attendance
and discussed municipal building proposed which has
now been increased in size to 50 x 100. Mr. Zimny
drew diagram on blackboard setting out inside dimensions
of all space involved. Clerk was to request Springsted
draw up new figures on building and taxes working on
the $110,000.00 figure. Motion by L'Allier, second by
Wilharber to approve the concept (50 x 100) of this
municipal building, motion carried.
Motion by L'Allier, second by Laska to approve Resolution
setting forth tax levy for Sanitary Sewer assessment
Code #12, motion carried.
Motion by Wilharber, second by Laska to approve Resolution
setting forth tax levy for Improvement #80-1 assessment,
Code #16, motion carried.

meeting minutes the request for letters of intent from
residents to fill the vacancy on the council.

Pursuant to due call and notice thereof, the City Council
of Centerville held their regular meeting on Wednesday,
September 8, 1982 in City Hall. Mayor Savela called the
meeting to order at 8100 PM. Present were: L'Allier,
Laska, Murray and Wilharber. Minutes of August 25, 1982
were discussed; motion by L'Allier, second by Murray to
approve minutes of August 25, 1982 meeting, motion carried.
PETITIONS AND COMPLAINTS: Complaints on yards on Peltier
Lake Drive; cars parked on property on Peltier Lake Drive
with proper license and the weed situation on lot on
Heritage and Goiffon Streets.
Mayor Savela advised council of conversation with Lino
Lakes Administrator concerning the petition on sewer
sludge and Administrator will get back to Mayor after
discussion at the next Lino Lakes meeting.
Mr. James McGregor appeared before council with request
to extend Sorel Street to Clearwater Road. Mr. McGregor was
advised that the parcels in question would require sewer
service and blacktop street constructed before building
would take place. The Mayor or clerk was to contact Engineer
about situation and request cost figures on same.
Letter from Metropolitan Council on land planning grant
funds available to Centerville, was discussed. Clerk is
to check on this and report at next meeting.
Communication from Lester Betts was read by council.
Item #4 on agenda was cancelled at this time.
Floyd Kruger reported on the progress of Centerville
Park. He advised council additional fence would have to
be placed in front of player benches and also asked that
bases be purchased for both ballfields. Motion by Laska,
second by L'Allier for city to purchase bases for ballfields
at this time, motion carried.
Fire Chief reported on fire department business.
Motion by Laska, second by Wilharber to pay current
disbursements, motion carried. Copy of Receipts and
Disbursements is attached to and made a part of these
minutes.

Centerville held their regular meeting on Wednesday, August
25, 1982 in City Hall. Mayor Savela called the meeting to
order at 8:00 PM. Present were: L'Allier, Laska, Murray
and Wilharber. Motion by Wilharber, second by L'Allier to
approve minutes of August 11, 1982 meeting, motion carried.
PETITIONS AND COMPLAINTS: Ken Carpenter of 6885 20th Avenue
South, Centerville presented council with petition and two
pictures stating "We the undersigned are totally against
the dumping, stock piling or spreading of sludge in the
village or city of Centerville" consiting of 121 household
signatures of Centerville, 5 signatures from Lino Lakes
property owners. Petition will be on file with city clerk.
Discussion followed. Motion by L'Allier, second by Wilharber
to notify PCA that we have received petition and send them
copy and also inform them the City is going to work on an
ordinance prohibiting spreading and stockpiling of sludge
in Centerville, motion carried.
Roof bids for city hall were viewed and matter tabled at this
time.
Mr. Steve Hulback of 1736 Center Street appeared before
council concerning a variance for his garage at 1736 Center
Street. Clerk read minutes of May 12, 1982 meeting when
variance request was denied. Mr. Hulback was requested to
reduce size of garage because of side yard setback. Motion
by Wilharber, second by Laska to grant variance to Ordinance
#4, TABLE B - SCHEDULE OF DISTRICT REGULATIONS LOT AND YARD
REQUIREMENTS, R-2 Single Family Residential - Side Yard
Setback, after building inspector views property, motion
carried. Variance is granted because of irregular dimensions
of lot.
Laska reported talking to Hank Miers about cutting grass in
city park area; clerk was to contact Pat Fruth on same
and report at next meeting.
Application for 3.2 beer permit for softball tournament on
August 28 and 29 at Twin Lakes Ballfield was submitted for
approval. Motion by Laska, second by L'Allier to issue 3.2
beer permit to the Down Under Bar for softabll tournament
August 28 and 29 at the Twin Lakes Ballfield, 2 ayes; 3 nays,
motion did not carry, request denied.
Fire Department members were in attendance to discuss erection
of new fire hall. Material from Springsted, Inc., was discussed
pertaining to debt service of city and mill rate increase.
Motion by Laska to hold special election on November 2, 1982
stating "Shall the City of Centerville issue general obliga-
tion bonds in an amount not to exceed $100,000. for the
purpose of providing money for a new fire hall and maintenance
building", no second; Laska withdrew his motion.

Council discussed Frank Tuckner request for extension of
Sorel Street to provide access for his lots adjacent to
Centerville Lake. Council consensus was to have engineer
advise TucKner that a single family residence would be
allowed without upgrading Sorel Street with a private
driveway off of the parking lot next to the rectory; if
more than one privately owned residence was allowed on
this property, the City would require Sorel Street to be
upgraded to city standards.
Motion by Wilharber, second by L'Allier to issue grading
permit to Joe LaCasse for property described as follows:
East ~ of the North ~ of the North i of the SE~ of
Section 23, Township 31, Range 22, Anoka County which
lies south of the North 330' thereof, motion carried.
Copy of permit is on file in clerk's office.
Budget meeting set for September 15th at 8:00 PM.

A RESOLUTION DETERMINING TO ISSUE BONDS FOR THE PURPOSE OF A
NEW MUNICIPAL BUILDING AND PROVIDING FOR AN ELECTION THEREON
BE IT RESOLVED by the City Council of the City of Centerville,
Minnesota, as follows:
1. It is hereby determined to issue general obligation bonds
for the purpose of providing money for a new municipal building.
2. The amount proposed to be borrowed shall not exceed $110,000.
3. The proposal to issue such bonds shall be submitted to the
voters of the city at a special elsction to be held on Tuesday,
November 2, 1982. Polling place and judges shall be the same
as the last general election. The polls shall be opened at
7:00 AM and shall close at 8:00 PM.
4. The city clerk shall give notice of election as required
by law by two week's published notice in the official news-
paper and posting in three public places in the city at least
ten days prior to the election.
5. The clerk shall cause ballots to be printed in substantially

11, 1982 in City Hall. Acting Mayor L'Allier called the
meeting to order at 8:00 PM. Present were: Laska and
Wilharber. Absent: Savela and Murray. Motion by Laska,
second by Wilharber to accept minutes of July 28, 1982
meeting, motion carried.
Messrs. Louie LeTendre, Marc Rivard and Ray Houle representing
the Centerville Lions Club presented the City with a check
for $1,750.00 as contribution to the Centerville City Park
development. Acting Mayor L'Allier thanked the Lions Club
for their funds and also number of manhours spent on develop-
ment. Discussion on the completion of park at this time.
Motion by Wilharber, second by Laska to go ahead with fencing
for the wings of the two back stops as per bid of $l,JOO.,
motion carried.
Discussion on speed limit changes on Centerville Road. Clerk
will check with County on final decision made on same,
Resolution introduced pertaining to Ordinance #4 publication.
Motion by Wilharber, second by Laska to adopt Resolution
authorizing the publication of Ordinance #4 in summary form,
motion carried. Copy of Resolution is attached to and
made a part of these minutes.
Motion by Wilharber, second by Laska to adopt Resolution
appointing election judges for September 14th primary election,
motion carried. Copy of Resolution is attached to and made
a part of these minutes.
Clerk read letter from Peltier Lake Drive residents concerning
condition of yard at 1567 Peltier Lake Drive. Clerk was to
write owner about condition and advise him to clean it up
within ten days from receipt of letter, also letters to
1862 Main Street and 1759 Peltier Lake Drive.
Mr. Jeff Nottum of 7238 Main Street appeared before council
with reference to variance request for front yard setback.
He was advised to appear befor8 P & Z for their recommendation
on request.
Frank Tuckner appeared before council with reference to
access to the property, Lots 4, 5, and 6, Block lJ and
Lots 7 & 8, Block 12. Clerk will consult Engineer and
Attorney on matter.
Mr. George Johnson of Minnesota Pollution Control Agency
was in attendance to discuss application of W & G Rehbein
Bros., to spread sludge on parcels of property in Centerville.
After lengthy discussion, motion was made by Wilharber, second
by Laska to table matter until full council can discuss it
further, motion carried.

The City Council of the City of Centerville ordains:
It is the intent and effect of this Ordinance to regulate
dwellings arld establish zoni11g districts and district
regulations throughout the City of Centerville. That such
Ordinance further adopts a map entitled the Centerville Land
Use Map which shows the official zoning classifications for
all property within the City of Centerville. The Ordinance
designates the permitted accessory and special uses within
such zoning districts. The Ordinance regulates signing,
setback requirements, parking requirements, lot size
requirements, non-conforming uses of property and procedures
for special use permits, rezonings, planned unit development
approvals, and variances. The Ordinance further includes
the penalty for violation of the Ordinance which is a
misdemeanor.

Pursuant to due call and notice thereof, the City Council of
Centerville held a public hearing on Ordinance #4. Acting
Mayor L'Allier presided over hearing. Present were~ Wilharber
and L'Allier. (Murray, Laska and Savela arriving later).
Motion by Wilharber, second by L'Allier to open hearing at
7:00 pm, motion carried. Clerk read public hearing notice,
copy of which is attached to and made a part of these minutes.
Audience participation was held on Ordinance for one hour.
Motion by Wilharber, second by Murray to close public hearing
motion carried. Hearing closed at 8:00 pm.
Acting Mayor called the regular meeting of the City Council
to order at 8:00 pm. Present were Wilharber, Murray; absent:
Laska and Savela. Motion by Murray, second by L'Allier to
approve minutes of July 14, meeting, motion carried.
PETITIONS AND COMPLAINTS: Complaints on speeding on Mill Road,
thistles on property across from LaValle Drive, drainage
problem with lot adjacent to 7232 Mill Road.
Motion by Murray, second by Wilharber to have Walter Prachar
cut the weeds in the city right-of-way at a fee of $15.00 an
hour not to exceed three hours, motion carried.
Motion by Wilharber, second by Murray to issue a 3.2 beer
permit to the Circle Pines Sno-Goers Snowmobile Club for their
softball tournament on August 7 and 8, 1982, motion carried.
Motion by Wilharber, second by Murray to pay the three bills
presented by clerk, motion carried.
Motion by Wilharber, second by Murray to adjourn meeting,
motion carried. Meeting adjourned at 9:00 pm.
Motion by Wilharber, second by Murray to reopen public hearing
on Ordinance #4, motion carried. Hearing reopened at 9:15 pm.
The following changes were made to the Ordinance #4 as it was
presented:
24. SCH~DULE OF REGULATIONS. (6) Any metal siding upon single
family residence structures shall have horizontal edges and
overlapping sections no wider than twelve (12) inches. Sheet
metal siding shall not be permitted in such districts not over
at least fifty (50) percent of entire structure.
33.02 STRUCTURES. Structures in the Commercial and Industrial
districts no building or other structure may be erected to a
height exceeding thirty-five (35) feet.
34.07 ADDITIONAL REGULATIONS. Omit 34.07-1; 34.07-2 and 34.07-3.

Motion by Laska, second by L'Allier to accept minutes of
June 23, 1982, motion carried.
PETITIONS' AND COMPLAINTS: Some damage to grounds at
Centerville Elementary School after Water Gremlin Softball
tournament on July 10 and 11. Mr. Jolly should be made
aware of situation if and when he comes in for another
permit.
Consensus of council not to place street light at Pavilion
entrance at this time unless the owner will take care of the
cost himself.
Update on park situation was given by Floyd Laska and
Ray Houle. Culverts in park area will be picked up by
Gary Barott.
Motion by L'Allier, second by Laska to grant permission
to Northwestern Bell Telephone Company to place, construct
and thereafter maintain buried telephone cable on County
Road #54 (20th Avenue) south approximately 1400 feet,
motion carried.
Motion by Laska, second by Murray to adopt Resolution
electing the City of Centerville to be governed by the
provisions of Chapter 564 of the Laws of 1982 relating
to the certification of transfers of certain unplatted
properties, motion carried. Copy of Resolution is
attached to and made a part of these minutes.
Motion by Laska, second by Murray to grant permission
to St. Genevieve's Church to sell 3.2 beer, hold bingo
games and rope off a block of Goiffon Street for their
annual pinnic on Sunday, August 15, 1982, motion carried.
Notice is hereby given that a public hearing will be held
on Wednesday, July 28, 1982 at 7:00 PM in City Hall to
hear the proposed ORDINANCE #4 which is the City's revised
zoning ordinance.
Motion by L'Allier, second by Laska to pay the current

RESOLUTION
A RESOLUTION ELECTING TO BE GOVERNED BY THE PROVISIONS OF
CHAPTER 564 OF THE LAWS OF 1982 RELATING TO THE CERTIFI-
CATION OF TRANSFERS OF CERTAIN UNPLATTED PROPERTIES
WHEREAS, Chapter 564 of the Laws of 1982 adopted by the
Minnesota State Legislature provides for the certification
by a municipality prior to the transfer by the County
Auditor of certain unplatted properties within the
municipality; and,
WHEREAS, the Act provides a procedure by which the County
and participating municipalities can prohibit the filing
of illegal lot splits with the County; and,
WHEREAS, Subdivision 3 of said Chapter 564 provides that
a municipality may elect to be governed by said Chapter
564 by filing with the County Auditor a certified copy
of a resolution of the governing body evidencing such
decision; and,
WHEREAS, the City Council of the City of Centerville
deems it in the best interests of the City that the
City elect to be governed by said provisions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Centerville that it hereby elects to be
governed by the provisions of Chapter 564 of the Laws
of 1982.
BE IT FURTHER RESOLVED that a certified copy of this
resolution be filed with the County Auditor for Anoka
County.

from City Engineer on complaints voiced at June 9th meeting,

Clerk advised council on Wilharber request for explanation
on acquisition costs of New Brighton trunk sewer by MWCC.
Jim Hubinger of Beulke Agency appeared before council with
reference to insurance audit and other insurance matters.
Clerk was to check with Zerwas Roofing and Berwald Roofing
for quote on repair of city hall roof.
Motion by Laska, second by Wilharber to pass Resolution
adopting the City of Centerville Comprehensive Plan, motion
carried. Copy of Resolution is attached to and made a
part of these minutes.
Request of Council by Shietong Chu to apply for a wine
license for House of Chu. Motion by Wilharber, second by
L'Allier to issue a wine license to the House of Chu for
balance of calendar year 1982, motion carried.
Clerk advised council on status of speed limit study done
on Centerville Road.
Clerk read request from Twin Lakes Pavilion for a street
light to be installed on existing pole at 1281 Main Street.
Mayor to check on above and report a next meeting.
Council agreed to purchase 3M VQC III copier from Wager's
in amount of $695.00 to be paid in July, 1982.
Motion by Murray, second by Wilharber, to adjourn meeting,

RESOLUTION
WHEREAS, the City of Centerville has complied with the
Metropolitan Land Planning Act Statute 473.864, Subd. 1
which states that every local governmental unit shall
draft a comprehensive plan, and
WHERBAS, the City of Centerville has completed the
draft of the Comprehensive Plan and has been reviewed
and adopted by the Metropolitan Council on September
24, 1981.

Pursuant to due call and notice thereof, the City Council
of the City of Centerville held their regular meeting on
Wednesday, June 9, 1982 in City Hall. Mayor Savela
called the meeting to order at 8:00 PM. Present were
L'Allier, Laska, Murray and Wilharber. Motion by
Laska, second by Wilharber to accept minutes of May
26, 1982 meeting, motion carried.
PETITIONS AND COMPLAINTS: Ditch behind and two lots west
of 1760 Center Street needs cleaning up/out; the ditch
running along 1793 Center Street needs cleaning out,
water doesn't flow through; sod at corner of County #14
and 20th Avenue (7105 - 20th Avenue) needs looking at
because grass isn't growing in bottom of ditch. Mayor
checked with insurance agent on liability insurance to
be taken out by persons applying for 3.2 beer permits
in City. Under new legislation, in March of 1983,
civic groups such as Lions, VFW, Legion Clubs will be
required to have such insurance when applying for a
3.2 beer permit. Insurance agent quoted amount for an
eight-team, 2-day tournament running approximately $350.-
500.
Council reviewed request from Northwestern Bell Telephone
for buried cable placement on Progress Road. Motion by
Wilharber, second by Laska to give permission for North-
western Bell to place, construct and thereafter maintain
buried cable from a pole on City right-of-way (corner
of County Road #14 and Progress Road) 180 feet north
on Progress Road to property line of 7124 Progress Road,
motion carried.
Park & Recreation Chairman Kruger requested council give
permission to Fire Department to have a water ball facility
inside the skating rink. Council agreed to request if no
water problems develop for city or Dorscher property.
Discussion was held on development of city park property.
Fertilizer has been spread and Laska was instructed to
have black dirt delivered for filling up ruts and
spreading over area. Ray Houle advised that MetroFolitan

Clerk read letter from G & S Development (Gerald Rehbein)
concerning the installation of light pole at the corner
of Main Street and Shad Avenue and the work to be done
on the ponding area in Rehbein Estates. The work should
be completed in thirty (30) days or June 26th. Council
agreed on time limit requested by Rehbein.
L'Allier wished to publicly thank George Haberman
and his 4-H members for the planting of seedlings in
the City park. Council instructed clerk to write letter
to Haberman thanking him and his crew for the good job
they had done.
Motion by L'Allier, second by Wilharber to approve
corrected 1982 assessment valuation for the City of
Centerville, motion carried. Corrections are noted
on the minutes of the Board of Review held on May 25, 1982.

1. Hours of 3.2 Beer Sale: Saturday - 8:00 AM
until 8:00 PM; Sunday - 12:00 Noon until
8:00 PM.
2. Premises must be vacated by 10:00 PM on day
of activity.
3. Sanitation facilities in form of portable
satellite are to be provided - two in number.
4. Damage deposit is required by City in amount
of $200.00 in form of money, certified or
cashier's check. No personal checks. Deposit
will be returned to applicant after ten day
holding period.
5. Applicant for permit will appear before City
Council at least ten days before event.
6. Applicant is responsible for keeping traffic
off of LaValle Drive during activity.
7. The area should be cleaned of debris, cans
and bottles when activity is finished. If the
City is required to clean up area after event,
the responsible party for the event will be
required to reimburse the City for their
services.
8. The fee for 3.2 Beer permit is set at $15.00.
9. Number of permits issued will be determined
by City Council.

AN ORDINANCE AUTHORIZING THE ISSUANCE OF TEMPORARY
NON-INTOXICATING MALT LIQUOR LICENSES.
The City Council of the City of Centerville does ordain:
Section 1. Definitions.
For purposes of this Ordinance, the following words
and phrases shall have the meanings ascribed to them in
this section:
"Non-intoxicating malt liquor" shall mean any liquid,
potable as a beverage, containing not less than one-half
of one per cent alcohol by volume, not more than J.2 per
cent alcohol by weight.
Section 2. Issuance of Temporary Non-Intoxicating Malt
Liquor License:
Temporary "on-sale" non-intoxicating malt liquor
licenses may be issued to sell non-intoxicating malt
liquor "on-sale" for a limited period of time, not to
exceed three (]) days.
Section]. Application for License:
Any individual, partnership or corporation desiring
a temporary "on-sale" non-intoxicating malt liquor license
shall file a vertified application therefor in writing,
with the City Clerk, at least ten (10) days before such
license is to take effect on forms to be prescribed by
the City Council and shall appear before the Council ten
(10) days before license issuance.
Such application shall specifically state the precise
premises where such non-intoxicating malt liquor is to be
sold, shall contain the names and local managing agents
of the club or organization making such application and
shall be accompanied by the following:
(a) A Two Hundred Dollar ($200.00) deposit by
cashier's check or money order.
(b) A license fee of Fifteen Dollars ($15.00) for
day or days the license is to be effective.
Section 4. Return of Deposit.
The deposit of Two Hundred Dollars ($200.00)
required to be submitted with an application for a
temporary "on-sale" non-intoxicating malt liquor
license, shall be returned to the licensee after the
license expires if, and only if, the licensed premises
is cleaned up to the satisfaction of the City Council
of the City of Centerville or its designated representative.
Section 5. Issuance of Licenses:
The City Clerk shall not issue any temporary
"on-sale" non-intoxicating malt liquor license unless
directed to do so by resolution duly adopted by the
City Council of the City of Centerville.
Any such license that shall be issued shall contain
the following provisions:
(a) The specific dates on which it is valid;
(b) The precise premises where the non-intoxicating
malt liquor is to be sold;
(c) That the license is not transferable;
(d) The specific time of the day for which the
license is valid;
(e) The time by which the licensed premises shall
be vacated;
(f) That the license may be suspended or revoked
at any time by the City Council for violation
of any Ordinance of the City of Centerville,
or any Statute of the State of Minnesota
without notice or hear~ng; and
(g) Such other conditions as may be imposed by
the City Council.
No license shall be issued under this Ordinance if
it appears that the issuance of such license will endanger
the health, safety or morals of the public.
Section 6. Licenses Prohibited to Certain Corporations
and Organiza"tions:
The corporation or organization shall not be
granted such a license if any of its officers, directors,
shareholders, local managers or local managing agents
have been convicted within five (5) years prior to the
application for such license of violation of any law
relating to the sale of non-intoxicating malt liquor or
of intoxicating liquor, and unless such officers,
directors, shareholders, local managers or local
managing agents are of good moral character and reputation.
Section 7. Sales, Closing Hours; Vacation of Premises:
No sales of non-intoxicating malt liquor shall be
made by the holder of a temporary "on-sale" non-
intoxicating malt liquor license during any time in
which such license is not valid. Provided, however,
that in no event shall any such sale be made between
the hours of one o'clock (1:00) a.m. and eight o'clock
(8:00) a.m.
All customers of the licensee shall vacate the
premises for which a temporary "on-sale" non-intoxicating
malt liquor license has been issued by the time specified
on such license, which shall not be later than ten o'clock
(10:00) pm. It shall be the responsibility of the
licensee to assure compliance with this requirement, and
non-compliance shall constitute grounds for revocation
of such license.
Section 8. Suspension and Revocation.
Any license issued under this Ordinance may be
suspended or revoked at any time by the City Council
for and violations of the provisions of this Ordinance,
any other Ordinance of the City of Centerville or any
Statute of the State of Minnesota. Such suspension or
revocation may be ordered by the City Council without
notice or hearing.
The Chief of Police shall nd~ify the licensee of
such revocation or suspension and shall forthWith cause
the licensed premises to be vacated by the licensee and
its customers.
Section 9. Marking of Licensed Premisesl
Licensed Premises, outside of buildings, shall be
clearly indicated and segregated by ropes and/or signs.
Section 10. License not Transferable:
No license issued under this Ordinance shall be
transferable.
Section 11. Violations, Penalties:
Any person, organization or corporation who shall
violate any of the provisions of this Ordinance shall
be guilty of a misdemeanor.
Section 12. Effective Date:
This Ordinance shall be effective immediately after
its passage and publication once in the local newspaper
of the City of Centerville.

The Planning Commission of the City or the City
Council shall grant any preliminary or final approval
to a subdivision plat, site plan or other development
map or application, or unless such subdivision plat,
site plan has received preliminary approval of the
City Council prior to May 13, 1981."
Section 7. Effective Date.
This Ordinance shall take effect upon adoption
and publication as required by law.

Assessor was to check on three parcels for further

PARCEL 0125 - Valuation was reduced on this parcel by
$1,700.00. Everyone was in agreement.
PARCEL 9010 - Valuation was left at $45,300.
PARCEL 9020 - Valuation was raised to $77,000. due to
the fact that the home is considered complete as of
January 2, 1982. This is an increase of $42,200. over
valuation discussed at May 25th Board of Review.

1982 valuation assessment for the City of Centerville
with the corrections noted, motion carried.

ROBISCHON PROPERTY - 1832 Main Street
~82 valuation is now $56,800. - assessor reduced valuation on
this property from $58,500. to $56,800. The land valuation
was the same as stated last night, the home valuation was
reduced and Mrs. Robischon was in agreement this morning
when Mike talked to her about it.
CARPENT~R PROPERTY - 6985 - 20th Avenue North
PARC~L 9010 - Shop/living quarters - '82 valuation as
stated last night was $~5,300. Mike talked this over
with Ed Arneson of the Assessor's office who assesses
commercial property in Anoka County. Ed thought the
structure should be assessed at $41,500 which he considered
just the shop area and add valuation for living quarters -
after much discussion they decided to leave it at $45,)00 total
valuation.
PARCEL 9020 - HOUSE - This is a different story. Last
night as you remember, Mike thought it was 61% incomplete
or 39% done. He arrived this morning and found it to
be completed upstairs and down, which is the basement.
The valuation he stated last night was $34,800 based on
the 39% done. Now the valuation has been changed to
$66,000 for the ho~e, $11,000 for the land making a total
of $77,000. 1982 valuation. Mike also told me that he
asked Ken if the house was the same today as it was on
January 2, 1982. Ken said yes.
I'm writing this memo because Carpenter does not know

the street light and ponding area in Rehbein Estates. Copy

Clerk advised council of costs involved in moving telephone
booth on Main Street to different location.
Question of fences erected on city right-of-way will be taken
up when city ordinances are revised.
On information received from Harvey Cartier, maintenance man,
the snow plow truck is being housed at 6716 Centerville Road
for summer months at a fee of $20.00 monthly.
Mr. Dean Olson of 1688 Sorel Street appeared before council
with sketch plan showing placement of 27x27 garage to be moved
onto his property from the Twin Lakes Pavilion.. Building
Inspector has inspected structure and Planning and Zoning
have recommended approval of action. Council approval was
given Olson for moving garage onto his property.
Mr. Steve Hulback of 1739 Center Street appeared before council
requesting variance to build garage on his property. The
variance is requested because of garage not meeting side yard
requirements as stated in Ordinance #10, Section I, II Residential
(F) Side Yard Requirements. Motion by Laska to grant variance
to Ordinance 10, Section I-II Residential (F) Side Yard
Requirements, motion died for lack of second. Motion by Wilharber,
second by L'Allier to request Hulback submit proposal for
smaller sized garage and move it up half the distance (which
on present proposal is 5' back from house); said garage setting
at least 7' from the property line under side yard requirement,
motion carried.
Ordinance regulating installation and maintenance of individual
sewage treatment systems will be heard at May 26th meeting.
Steve Marcello of 1588 Peltier Lake Drive appeared before council
with plan to add attached garage to his present house on
property. His question was on whether he needed a variance to
Ordinance #10, Section I, II Residential (E) Front Yard require-
ments. Variance is requested because one corner of garage is
51' from edge of traveled roadway and other corner 41' from edge
of traveled roadway. Motion by L'Allier, second by Laska to
grant variance to Ordinance 10, Section I-II Residential (E)
Front Yard Requirements for Marcello property at 1588 Peltier
Lake Drive, motion carried.

Proposals for a Cable Communication System for the City of
Centerville, Minnes~a.
Discussion held on RFP by council, Ted Gonsinr, Centerville
Director of NCSCCC and Ralph Campbell of Anita Benda Associates.
Consensus of council was to request commission to extend
the initial service area to include the area between Shad
Avenue and 20th Avenue along Main Street. Director Gonsior
will check out the possibility of such action.

Pursuant to due call and notice thereof, the City Council
of the City of Centerville met on Wednesday, April 28,
1982 in the City Hall. Mayor Savela called the meeting to
order at 7:10 pm. Present were: L'Allier, Laska and
Wilharber. Absent: Murray.
Mr. and Mrs. Fitzgerald appeared before council with
reference to home they wish to erect on Lot 2, Block 1,
LeRoux Addition. They will be having a swale on each
side of lot draining toward lake. This is agreeable
with the parcel owners on either side of Lot 2 and also
with building official. Fitzgeralds also requesting
bringing in more than the 50 cubic yards of fill which
is the limit under Chapter 70 of the DBC. Motion by
Laska, second by L'Allier to issue building permit for
Lot 2, Block 1, LeRoux Addition to John Fitzgerald with
variance to Chapter 70, DBC on the 50 cubic yard fill
limit, motion carried.
Balance of meeting was spent on ordinance review.
Motion by L'Allier, second by Wilharber to adjourn meeting,
motion carried. Meeting adjourned at 9:10 PM.

Pursuant to due call and notice thereof, the City Council of
Centerville held their regular meeting on Wednesday, April 14
1982 in City Hall. Mayor Savela called the meeting to order at
7:00 PM. Present were: L'Allier, Laska, Murray and Wilharber.
Motion by Wilharber, second by L'Allier to approve minutes
of March 10, 1982 meeting, motion carried.
PETITIONS AND COMPLAINTS: Mayor Savela brought council up
to date on inspection made by George Johnson of PCA and
Walt Williams, City Engineer on the ground in which W & G
Rehbein Bros. had spread sludge; request to move the phone
booth on Main Street to an area adjacent to Trippel's Market;
clerk will check on this and Wilharber to check on truck
storage for summer.
Jim Hubinger of Beulke Agency appeared before council to answer
questions on city insurance package.
Joe LaCasse, Jr., appeared before council with questions on
procedure for rezoning of a parcel on 20th Avenue.
Ted Gonsior, director of NCSCCC for Centerville, appeared
and gave brief report on status of CABLE TV commission.
Fire Chief Bnglund requested council to okay 9 or 10 firemen
going to Fire School next month at cost of $45.00 per fireman;
requested City pay one-half total on tools fire department
had purchased for $79.59, council agreed.
Motion by Wilharber, second by Murray to pass Resolution
designating May 17-21, 1982 as Centennial Pride Week and
City Council are in full support of such action, motion carried.
April 28~h council meeting will be cancelled and council will
work on ordinance review.
Motion by Laska, second by Wilharber to pay current disburse-
ments, motion carried. Copy of Receipts and Disbursements
are attached to and made a part of these minutes.
Motion by L'Allier, second by Wilharber to adjourn meeting,

Pursuant to due call and notice thereof, the City Council of
Centerville held their regular meeting on Wednesday, March
10, 1982 in City Hall. Mayor Savela called the meeting to
order at 7:00 pm. Present were: L'Allier, Laska and Wilharber.
Absent: Murray. Motion by Wilharber, seconded by Laska to
accept minutes of February 17th meeting, motion carried.
PETITIONS AND COMLAINTS: Complaints voiced on the sewer
sludge spreading done by W & G Rehbein Bros. on property
in Centerville; the need for a stop sign on the three exits
from Tripple's Market parking lot onto Mill Road and Main
Street. Clerk will request placement of signs from Tripple's
and Anoka County. Harvey advised that snow plow truc~ will
have to be removed from Tourville property by April 1st.
Rich Granger appeared before council requesting transfer of
sewer rights from Tract "E", Registered Land Survey #65 to
Tract "D", Registered Land Survey #65; Tract "E" being 11
acres in area; Tract "D", 9.8 acres in area.
Motion by Laska, seconded by Wilharber to transfer 4.9 acres
of sewer service area from Tract "E" to Tract "D", leaving
.5 acre service area on Tract "E"; sufficient service for
one house on Tract "E" parcel; Mr. Granger to pay all
engineering fees, including redrawing of sewer service area
map and any legal fees incurred from such action, motion
carried.
Fire Chief Englund presented council with overall formula
for 1982 fire contract with Lino Lakes, or second year fee
of five-year contract, a~ount being $16,125.68 payable
quarterly in the amount of $4,031.42. Council consensus
to send information to Lino Lakes. Fire Department requested
purchase of helmets and coats; only six helmets should be
ordered at present time, amounting to approximately $360.
Balance of meeting was spent on discussion of procedures
involved in permitting the spread of sewer sludge on property
in Centerville. Messrs. George Johnson and Ken LeVoir from
Minnesota Pollution Control Agency ex~lained their responsi-
bilities with the process. Question/answer period was held
with considerable amount of displeasure on process voiced
from audience. Clerk will check on ordinance prohibiting
the spread of sewer sludge and report at next meeting.
Motion by Laska, second by Wilharber to pay current disburse-
ments, motion carried. Copy of Receipts and Disbursements
is attached to and made a part of these minutes.
Ordinance review will be held March 24th, 7:00 PM. Reg~lar'
meeting is cancelled.

Pursuant to due call and notice thereof, the City Council of
the City of Centerville held their regular meeting on February
17, 1982 in City Hall. Mayor Savela called the meeting to
order at 7:00 pm.. Present were: L'Allier, Murray and Wilharber.
Absent: Laska - he arrived 20 minutes later. Motion by
L'Allier, second by Murray to approve minutes of January 27,
1982 meeting, motion carried.
PETITIONS AND COMPLAINTS: Complaint was voiced concerning
W & G Rehbein Bros. spreading sludge on their property at
20th and Main Street. Clerk is to request a representative
from PCA to attend the March 10th council meeting to discuss
the City's role in situations similar to the above; fire chief
advised council of department's loss of gloves during the period
February 3 - 11.
A new form of monthly report from Lino Lakes Police Department
was presented to council for review.
The 1982 Police Contract between Lino Lakes and Centerville
was presented for approval. Motion by Murray, second by
Wilharber to approve 1982 Police Contract as submitted at a
cost of $40,152.00 per year, motion carried. The following

The Planning Commission of the City or the City Council
shall grant any preliminary 9r final approval to a
subdivision plat, site plan, rezoning, or other develop-
ment map or application, or unless such subdivision
plat, site plan, or rezoning has received preliminary
approval of the City Council prior to May 13, 1981.
The aforementioned restriction shall not apply to any
property within the industrial zoning classification
within the City of Centerville."
SECTION 7. ~ffective Date
This ordinance shall take effect upon adoption and publication
as required by law.

ville City Engineer for 1982 providing they will not do any
private work for developers and/or developments within Center-
ville, motion carried. Professional services agreement
between Carley & Associates and the City of Centerville will
be signed by Mayor and Cle,rk.
Consensus of council to close skating rink on Sunday, February
28th for the season.
Discussion held on S.F. 1677 (H.F. 1738), A BILL FOR AN ACT
RELATING TO MUNICIPAL PLANNING AND ZONING, PROHIBITING
EXCLUSION OF MANUFACTURED HOMES AND OTHER TYPES OF SINGLE
FAMILY DWELLINGS; amending Minnesota Statutes 1980, Section
462.357, Subdivision 1. Motion by Wilharber, second by
L'Allier for council to go on record against the passage of
this bill and advise authors of same, motion carried.
Clerk advised council on meeting she had attended concerning
local government aid and homestead credit payments to city
and shade tree program being dissolved. After discussion of
financial problems facing city, motion was made by Wilharber

WHEREAS, a majority of the owners of property abutting on the
street and utility easements described below have requested
the City Council in a petition dated the 13th day of August,
1981, to vacate such street and utility easements according
to law; and
WHEREAS, a public hearing was held before the City Council
in the City Hall on January 13, 1982, continued January 27,
1982, continued February 17, 1982, on such petition after
due published and posted notice had been given by the Clerk
on December 3 and 10, 1981, and all persons interested were

on snow plowing but Mayor commended the public works employees
on their snow plowing over the weekend.
Discussion was held on the Resource Handbook for Southeastern
Anoka County which was put out by the Lutheran Social Service.
Consensus was not to contribute to the printing costs at this
time.
Mr. Granger appeared before council to inform them that the
Centennial School District board had turned down his request
for transfer of sewer rights. Matter is tabled until future
meeting~
Being two councilmembers are absent, motion by L'Allier,
second by Murray to continue the public hearing on the street
and utility easement within the plat of Peltier Lake Hills
Addition~ motion carried. The matter will be placed on the
next meeting agenda.
Approval was given the Fire Department to purchase up to
ten pair of boots at an approximate cost of $654.
Motion by L'Allier, second by Murray to change the February
meeting date to February 17th, cancelling the dates of February
10th and 24th, motion carried.
Balance of meeting was spent interviewing firms for the
position of City Engineer. They were as follows:

Final plat presentation of Wegleitner's Addition was presented.
Motion by Laska, second by L'Allier to approve final plat of
WEGLEITNER ADDITION, motion carried. Park fee of $500. was
received for Wegleitner Addition.
Messrs. Granger and Husnick appeared before council with
discussion on transfer of sewer rights from the school
to Peltier Lake Hills #2. Matter will be on the January
27th agenda.
Attorney Hawkins will register Affidavit of Purchaser deeding
Tract F of Registered Land Survey #65 to City.
Clerk is to check on items in Resource Handbook-Southeast
