A W ARDSIPRESENTA nONS/APPEARANCES 1. Representative Robert Dettmer Representative Dettmer addressed the Council and the audience. He commented on his experience as a new state Representative, a former teacher and coach, and a current member of the Army Reserve. He discussed the current bonding bill, the $34 billion budget, and the need to prioritize where money is spent. Representative Dettmer discussed the transportation bill and the tax bill. He stated that he serves on four committees including Veteran's Affairs, K-12 Education Finance, Education Policy, and the Education Workforce Committees. He stressed the importance of getting involved. He listed five governing principles he lives by: Does it make common sense? Is it fiscally responsible and lower taxes? Does it increase our personal responsibility and promote individual freedom? Does it make our families become stronger? Will it provide safety and security for our citizens? 2. Mr. Greg Kieselhorst. Centerville Lion's a. 2008 Easter Egg HUfllZ - Snecial Event Permit (Previouslv Aooroved) Mr. Kieselhorst requested the use of Laurie LaMotte Memorial Park on March 22,2008 for the annual Easter Egg Hunt. b. 2008 Fete des Lacs - City Funding (Festiva1lFishimz Contest) Parade Mr. Kieselhorst distributed the information and schedule fur the 18th Annual Fete des Lacs Festival. He stated that the Roaring 20's is the theme for the festival. He requested Page 20f6 City ofCenlerville Council Meeting Minutes March \2, 2008 the City contribute $19,044.00 towards the festival. Mr. Kieselhorst discussed the schedule of events. Mayor Capra questioned City Administrator Larson about the money budgeted for the festival. City Administrator Larson replied about $20,000 was budgeted for the festival; however, this amount did not include the parade. Mayor Capra stated that she would like the City Attorney to research several items on the list presented by Mr. Kieselhorst prior to approving the request. c. TeJl!POrary Gambling Permit (Raflle - 05/19/08 to 08-03/08 and Bingo from 08/01/08 to 08/03/08 Mr. Kieselhorst stated that the Lions Club is not sure bingo would be part ofthe event. He stated a mud volleyball tournament might be considered. d. Fete des Lacs Parade Mr. Kieselhorst commented a parade might not occur this year. Discussion ensued. Consensus reached to ask City Administrator Larson to draft a letter from Council and discuss a parade route with Mr. Doug Fischer, Anoka County. vn. OLD BUSINESS 1. Consider Agreement for Local Assessor Services with Mr. Kenneth To1zrnann. SAMA (Tabled from Previously Meetings) City Attorney Glaser commented that he reviewed the insurance and contract and deemed it appropriate. He recommended approval of the agreement. Motion bv Council Member Lee. seconded bv Council Member Paar. to aDnrove the Ae:reement for Local Assessor Services with Mr. Kenneth Tolzmann. SAMA as presented and aDDroved bv the City Attornev. All in favor. Motion carried unanimouslv. 2. Engineer's Report on Hidden Soring Park City Engineer Statz presented information regarding exploring a more substantial shoreline restoration/stabilization technique than was originally proposed. He presented a sketch and cost estimate for the revised approach to restore the shoreline at Hidden Page 3 of6 City of Centerville Council Meeting Minutes March 12, 2008 Spring Park. He requested that cost participation be considered by the City for the materials, which are above and beyond the original design. City Engineer Statz stated that he wanted the Council to be comfortable with the design and plantings. He displayed photos ofthe before and after proposed look. Discussion ensued. Councilmember Lee recommended this proposal be presented to the Parks and Recreation Committee before it is approved. City Engineer Statz stated that the amount of$6,260 would be the total cost to the City. Consensus reached to add this to the all-committee joint meeting agenda of April 2, 2008. 3. !liddeR Svrml!: Park SiEnat.:e 3. Closinl!: on New Public Works Building City Administrator Larson reported the building is substantially complete. He requested that Council consider closing on the project prior to completing the work. He explained the proposal is to close and escrow approximately $75,000 (in addition to the warranty escrow of $1 00,000). Mayor Capra requested a walk-through of the building prior to closing. City Administrator Larson distributed a list of additional items for approval in the amount of$7,650. Mr. Paul Pa1zer, Public Works Director, requested an upgraded polyurethane coating be applied to the concrete floor for better protection. He reported that the cost is about $16,000; however, the lifespan is about 20 years. Motion bv Council Member Lee. seconded bv Council Member Lakso. to approve the uPl!l"llded coatin!! at a cost not to exceed $16.000. Councilmember Paar questioned which funds would pay for the additional costs. City Administrator Larson replied that it would probably come from the Utility Fund. City Administrator Larson stated that the current copier would be moved to Public Works. Mayor Capra questioned whether the old copier in Public Works could be donated. City Administrator Larson replied that it could if someone wanted it. City Administrator Larson City Administrator Larson reported that road restrictions go on March 14, 2008 City Administrator Larson reported that photos were taken of properties relative to the nuisance abatement on properties around the City. City Administrator Larson reported that the downtown sidewalk street work is scheduled for June/July 2008. A mock up is required to ensure the color combinations are correct. He suggested the concrete in front of City Hall be rebuilt as the mock up rather than destroy the mock up from the downtown. 2. CERT Update - (Tabled until the next meetinl!.) CALL TO ORDER Mayor Capra called the March 12, 2008, City Council Work Session to order at 8:31 p.m. ll. ITEMS FOR DISCUSSION a. Downtown Redevelopment - Beard Group Update City Engineer presented options for the downtown redevelopment Discussion ensued. Mayor Capra requested the original Pavement Management Plan for review. She stated she would like to know which streets were pushed back and which were scheduled for 2009. b. 2009 Street Imorovement ProiectlPavement Management Plan City Engineer distributed a copy of the 2009 Street Improvement ProjectlPavement Management Plan and discussed Option 1. Discussion ensued. Council member Broussard-Vickers stated that she has an issue related to the requirement to hook up to City water. She stated that if what the City is really trying to do is support the City water system could be done a different way. She indicated that everyone benefits whether they hook up to City water system or not. She recommended that City of Centerville Council Work Sessioo Meeting Minutes March 12, 2008 everyone share the cost of supporting the City water system whether or not they are hooked up. She questioned whether the City could force residents to share in the cost without hooking up. She recommended that a fair share number be agreed to and then determine the legalities. She wants to support the program; however, she did not approve of forcing individuals. Councilmember Lee commented that the ordinance was not enforced in 2004. Discussion ensued. Mayor Capra stated that Council needs to know who has the authority to require individuals to cap wells. She requested that City Attorney Glaser research how this could be accomplished. She requested that a fee be calculated by Finance Director Meyer. City Engineer Statz recommended that Council call for a public hearing at the next Council meeting. c. Foreclosure Statistics City Administrator Larson distributed the foreclosure rates for Anoka County cities. He provided information that would be included in utilities bills concerning the Minnesota Home Ownership Center. d. Inspector/Proiect Coordinator Position This item was not discussed. e. Draft Ordinance for Deferment ofSoecial Assessments This item was not discussed. III. THE CITY OF CENTERVILLE ORDAINS: Section 1. The City Code is hereby amended by inserting Chapter 33 as follows: CHAPTER 33: SPECIAL ASSESSMENTS 33.01 Deferment of Special Assessments for Senior Citizens. A. The Council may defer the payment of any special assessment on homestead property owned by a person who is 65 years of age or older, or who is retired by virtue of permanent and total disability, and the Clerk is hereby authorized to record the deferment of special assessments where the following conditions are met: 1. The applicant must apply for the deferment within ninety days of when the assessment is adopted by the Council. 2. The applicant must be 65 years of age, or older, or retired by virtue of permanent and total disability. 3. The applicant must be the owner ofthe property. 4. The applicant must occupy the property as his/her principal place of residence. 5. The applicant's income from all sources shall not exceed the low income limit as established by the Department of Housing and Urban Development as used in determining the eligibility for Section VIII housing. B. The deferment shall be granted for as long a period of time as the hardship exists and the conditions as aforementioned have been met. However, it shall be the duty of the applicant to notilY the Clerk of any change in his/her status that would affect eligibility for deferment. Interest shall not accrue during the deferment period. [Alternative: "During the deferment period, interest shall accrue from the date of the adoption of the special assessment until paid, at the same interest rate as for those assessments adopted against other properties for the project that were not deferred."] C. The entire amount of deferred special assessments shall be due within sixty days after loss of eligibility by the applicant. If the special assessment is not paid within sixty days, the Clerk shall add thereto interest at 8% per annum from the due date through December 3 I of the following year and the total amount of principal and interest shall be certified to the County Auditor for collection with taxes the following year. Should the applicant plead and prove, to the satisfaction of the Council, that full repayment of the deferred special assessment would cause the applicant particular undue financial hardship, the Council may order that the applicant pay within sixty days a sum equal to the number of installments of deferred special assessments outstanding and unpaid to date (including principal and interest) with the balance thereafter paid according to the terms and conditions of the original special assessment. D. The option to defer the payment of special assessments shall terminate and all amounts accumulated plus applicable interest shall become due upon the occurrence of anyone of the following: l. The death of the owner when there is no spouse who is eligible for deferment. 2. The sale, transfer or subdivision of all or any part of the property. 3. Loss of homestead status on the property. 4. Determination by the Council for any reason that there would be no hardship to require immediate or partial payment. Section 2. Effective Date. This ordinance shall be effective immediately upon its passage and publication according to law.
