PLANNING AND ZONING COMMISSION
January 8, 2008
Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regularly
scheduled meeting on January 8, 2008, at 6:30 p.m.

Chair Hanson called the meeting to order at 6:30 p.m.

IV. OLD BUSINESS
Code Revisions. The Commission reviewed a memo dated January 4, 2008, from
Administrator Larson detailing a number of issues for consideration.
1) 154.023 The Commission agreed that submitting application materials five business
days in advance of a meeting should be satisfactory, as long as city staff determines
that the application is complete. The Commission determined that three copies of the
materials would be sufficient as long as an electronic copy is included in order that the
City can make additional copies as needed.
2) Fence setback from property line. There was considerable discussion on whether the
two foot setback from a property line was excessive. Commissioners Mosher and

Parucci requested that the setback be reduced or eliminated, but the majority agreed
that the setback was appropriate.
3) 154.110 The Commission determined that this section should be rewritten to not
permit privacy or security fences in front yards. Staff will submit proposed code
revisions.
4) 154.110 Considerable time was spent discussing the appropriate restrictions on fences
in residential districts particularly those in the street frontage of corner lots. The
consensus of the Commission was that staff should draft new language that provides:
a. Where a corner lot abuts an adjacent property's front yard, the fence should be
set back a minimum of 10 feet, unless the fence is a decorative fence.
b. A decorative fence should be defined as a fence not exceeding a height of 36
inches that is picket type fence, wrought iron, or split rail.
c. All fences shall be set back a minimum of two feet from any property line,
except adjoining lot lines where an agreement with a neighbor may permit
construction on a boundary line, but in no event shall any fence be closer than
fifteen feet to a curb or street pavement.
d. Corner lots shall only have one front yard for the purpose of fences and that
should be the side that has the front entrance to the home.
5) 154.110 (C) The Commission agreed to leave the regulations on barbed wire and
electric fencing as they are.
The balance of the discussion items were tabled.
V. NEW BUSINESS
Commissioner Love suggested that the City should try to get a guard rail installed along
Centerville (CSAH 21) immediately north and south of Center Street. The ditch is very deep. A
motion was made by Commissioner Love that the Planning & Zoning Commission recommend to
the City Council that a request be made by the City for a guard rail along the east side of
Centerville Road (CSAH 21) from Center Street south for a distance of approximately 400 feet.
The motion was seconded by Commissioner Fehrenbacher, all present voted in favor of the
motion. The motion carried unanimously.
VL DISCUSSION ITEMS
The next meeting will be a joint meeting with Council to discuss the draft of the 2008
Comprehensive Plan. The draft will be distributed about February 1, 2008, for the meeting
on February 12.

Motion by Commissioner Fehrenbacher, seconded by Commissioner Love, to
approve the Minutes of December 4, 2007 as presented. All in favor. Motion carried
unanimously.
VIII. PLANNING AND ZONING COMMISSION MEETING ADJOURNMENT
Motion by Commissioner Pangell, seconded by Commissioner Love, to adiourn the
Meeting at 9:00 p.m. All in favor. Motion carried unanimously.
