PLANNING AND ZONING COMMISSION
February 12, 2008
Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regularly
scheduled meeting on February 12, 2008, at 6:30 p.m.

The meeting was called to order at 6:35 p.m.

The Planning and Zoning Commission decided to amend the agenda to consider New Business
before Old Business
V. NEW BUSINESS
L Correspondence from Mr. Bob Wright -Mailboxes.
Chair Hanson questioned why this matter is before the Planning and Zoning Commission since it
does not appear to be a planning and zoning issue.

City Administrator Larson replied the correspondence from Mr. Wright was addressed to the
Commission and added he felt there appears to be an issue in the Hanzal development.
Commissioner Fehrenbacher stated that he contacted the City and inquired about placement of
mailboxes and the staff in Public Works was not sure.
Commissioner Love stated that an ordinance is in place addressing mailbox placement and
installation and it needs to be enforced.
Commissioner Fehrenbacher concurred.
City Administrator Larson stated that the ordinance requires mailboxes be clustered in groups of
not less than four nor more than six. He added that enforcement should be part of the building
inspection process and agreed to check into the enforcement issue, particularly as it relates to
newer areas.
Commissioner Love questioned whether Mr. Wright is looking for a response to his letter.
City Administrator Larson agreed to write a letter to Mr. Wright.
Councilmember Broussard questioned whether there is a violation of the ordinance with respect
to Eagle Pass. She stated that the Post Office may have required large clusters rather than
individual mailboxes.
Commissioner Mosher stated the ordinance requires mailboxes be clustered in groups of not less
than four nor more than six, and added Eagle Pass appears to have clusters of twelve mailboxes.
Commissioner Parucci stated that the cluster mailboxes are more aesthetically pleasing and
provide security because they are locked.
Commissioner Fehrenbacher suggested revising the ordinance to state that mailboxes shall be
clustered with a minimum of four mailboxes.
City Administrator Larson stated that staff will review the current ordinance to determine if any
changes are required.
It was the consensus of the Planning and Zoning Commission that no action is required at this
time.
II. OLD BUSINESS
1. Code Revisions
City Administrator Larson presented proposed code revisions for discussion by the Planning and
Zoning Commission.

City Administrator Larson stated that the 30 day requirement in Section 154.023(A) has been
revised as agreed to by the Planning and Zoning Commission to state that application materials
must be submitted at least five business days before the Planning and Zoning Commission
meeting. In addition, Section 154.023(C) has been revised to reflect that three sets of site plans
will be required versus sixteen. He stated that the City may also require that plans be submitted
in an acceptable electronic format.
City Administrator Larson stated that Section 154. ll0(A)(1) has been revised as agreed to by the
Planning and Zoning Commission to state that all fences shall be located a minimum of two feet
from any property line. He stated that Section 154.ll0(A)(3) has been revised to state that all
decorative fences shall have at least 40% of the surface area of the fence open.
Commissioner Love questioned whether a definition of "street property line" should be included
in this section.
City Administrator Larson replied that this is the property line as it abuts the street as opposed to
the interior property line.
It was the consensus of the Planning and Zoning Commission to include a definition of "street
property line" in the code revision.
Councilmember Broussard questioned whether the word "wood" should be deleted in Section
154. ll0(A)(3) in describing vertical post, horizontal rail, and picket type fences. She stated that
there are new products on the market made of recycled vinyl that would be acceptable. She
requested that spiked metal tops not be allowed when referring to wrought iron fencing.
It was the consensus of the Planning and Zoning Commission to delete the word "wood" as it
relates to vertical post, horizontal rail, and picket type fences.
City Administrator Larson questioned whether the height requirement is accurately reflected in
the code.
It was the consensus of the Planning and Zoning Commission that the height requirement as
contained in the code is acceptable.
Councilmember Broussard questioned whether the snow-stop fencing should include the same
setback requirements as decorative fencing.
City Administrator Larson replied that the snow-stop fencing does not need a setback
requirement and is considered a temporary fence.
City Administrator Larson questioned whether the code should contain a provision that states
where snow-stop fencing is permitted and whether it should be restricted to the R-1 District or on
a lot with more than "x" number of acres. He stated that it may be appropriate to restrict the use
of a snow-stop fence by a showing of need as a special use.

It was the consensus of the Planning and Zoning Commission to revise Section 154.ll0(B) to
state that snow-stop fences are allowed by permit only and shall be allowed only in the R-1
District.
City Administrator Larson stated that Section 154.ll0(E) related to swimming pool fencing has
been revised to state that no permanent private swimming pool with a water depth exceeding 24
inches may be allowed unless enclosed by a permanent wall or fence not less than four feet in
height with self-closing door and self-closing latch. He stated that the term "permanent' has
been defined to mean if it has a water supply or drain connection or if it has a filter or
chlorination system attached; however, there are swimming pools on the market that are not
permanent but that have a filter system. He questioned whether the reference to filter or
chlorination system should be deleted.
Councilmember Broussard stated that the original reason behind this was safety.
City Administrator Larson questioned whether the City has the capacity to enforce this and
added that permanent swimming pools have a building permit associated with them.
Councilmember Broussard questioned whether decorative fencing is allowed in
commercial/industrial zoning districts as referenced in Section 154. ll0(F).
It was the consensus of the Planning and Zoning Commission to allow decorative fencing as
defined in Section 154.ll0(A)(3) in commercial/industrial zoning districts.
III. DISCUSSION ITEMS

IV. CONSIDERATION OF MINUTES
1. January 8, 2008 Planning and Zoning Meeting Minutes
Commissioner Love requested that the minutes be amended to state that the guard rail along
Centerville Road shall be placed both north and south of Center Street for a distance of
approximately 400 feet, and not just to the south of Center Street.
Chair Hanson stated that it was the intent of the Planning and Zoning Commission to request
installation of the guard rail along both the north and south side.
City Administrator Larson stated that he will verify the guard rail placement along both the north
and south side.
Motion by Commissioner Love, seconded by Commissioner Parucci, to approve the
Minutes of January 8, 2008, as amended. All in favor. Motion carried unanimously.
