Mayor Capra stated that there is an item on the City of Centerville Check Register for
Capra's Utilities Inc. She wanted to clarify that this is not her, nor is it a relative of hers.
Councilmember Broussard-Vickers pointed out that the Encroachment Agreement
referred to in Item 5 is between two individuals - not the City.
City Administrator Larson stated that there are utility easements around the property line
and there might be a large utility easement around the pond where the fence would
encroach.
Councilmember Broussard-Vickers inquired whether anyone had looked at this.
City Administrator Larson replied that Paul had looked at it.

VI. A W ARDSIPRESENT A TIONS/APPEARANCES
Mr. Paul Pierce, Anoka County Historical Society, thanked the Council and the City of
Centerville for their help and contributions. He presented Mayor Capra with a historical
picture and some elementary school level books that she could keep at City Hall or pass
on to elementary schools. Mr. Pierce stated that publishing the books required a lot of
research, working with District 11, and going before the State Board of Education. The
books have been approved for the elementary school level and are going out to schools in
Anoka County.
Mr. Pierce explained that 2007 was the Sesquicentennial Year (1857 - 2007) for Anoka
County. Mr. Pierce showed a film on numerous Sesquicentennial events that took place
over the last year and gave Sesquicentennial mugs to all the City Council Members.
Mayor Capra stated that during the Sesquicentennial, they had a very successful wagon
train that went through Anoka County. Mr. John Olson was the leader of the wagon
train, with his mules and his wagon from that era.
Mr. Pierce announced some upcoming events and once again thanked the Council for
their help and contributions.
VII. OLD BUSINESS
1. Proposed Ord. #21. Second Series - Senior Citizen! Active Dutv Deferment of
Special Assessment
City Administrator Larson stated that the State Legislature authorized a revision to
include service people (on active duty and 12 months after) in this Special Assessment
Deferment, and Governor Pawlenty signed it.

2. Parks & Recreation Committee Recommendation for Lake Shore Stabilization at
Hidden Spring Park
City Engineer Statz reported that he met with the Park Board to discuss the status of this
improvement, and that he forwarded an email to the Parks Committee. He stated that the
study showed the soil is not compacted, with the exception of 2 small areas. That part is
complete; however, they still want to do a test.
City Engineer Statz stated that they would like to use Mr. Greg Thompson's design, but
they are only 75% sure it will work. The City would like this solved once and for all.
Mayor Capra recommended doing more substantial plantings.

Conversation ensued regarding the first design's failure, Mr. Thompson's proposed
design, and the fact that there are three contractors who could bid on it. If Bonestroo
would redo it correctly, there would be no additional cost.
Motion by Council Member Lee. seconded by Council Member Lakso. to approve
Bonestroo to redo the Lake Shore Stabilization at Hidden Sprin2: Park at no
additional cost. Motion carried (4/1). Council Member Broussard-Vickers
opposed.
VIII. NEW BUSINESS
1. Consider Using Volunteers for Tree Trimming at Eagle Park vs. Public Works
Staff
Motion by Council Member Lee. seconded by Council Member Parr. to use
volunteers for Tree Trimmin2: at Ea2:le Park - provided they would be covered by
the City's insurance. All in favor. Motion carried unanimously.
2. Restoration of Boulevard on Heritage Street - Not to Exceed $3.400
Motion by Council Member Broussard-Vickers. seconded by Council Member Lee.
to approve the restoration of the Boulevard on Herita2:e Street - not to exceed
$3.400. All in favor. Motion carried unanimously.
3. Drainage System Implementation - Downtown
City Administrator Larson stated that they have money allocated from three grants for the
downtown drainage system.
Mayor Capra commented that the benefit to the ground water would be huge.
City Engineer Statz stated that it would have to be designed where it would not have a
big bounce, and there will be some trade offs. He questioned whether we should have a
backup, as this is the backbone of the system. He added that it would not disturb too
much of the street.
City Administrator Larson stated that they would need approval from Anoka County.
Discussion ensued.

4. 2008 SealcoatlCrack Seal Proiect - Approval to Produce Plans and Specs.
Discussion ensued regarding the proven effectiveness of sealing cracks every year.
Motion bv Council Member Broussard-Vickers. seconded bv Council Member
Lakso. to authorize em!ineer to produce plans and specs for the 2008 SealcoatlCrack
Seal Proiect. All in favor. Motion carried unanimouslv.
5. Res. #08-012 - Assigning Duties for Handling Banking Transactions
City Administrator Larson remarked that this is similar to the resolution in 2005. He
explained that the main change would be that moving money could be done by one
person. That person would not be authorized to take money out, only to move it to
another account within the City.
Motion bv Council Member Lakso. seconded by Council Member Parr. to assim the
handline: of bankine: transactions to one person - with some restrictions. All in
favor. Motion carried unanimously.
6. Res. #08-013 - Abatement of Special Assessment & Re-Assessing the
Appropriate Parcel
City Administrator Larson explained that this would be done to correct an error in the
parcel numbers.

1. City Administrator, Mr. Dallas Larson
City Administrator Larson reported that they are revising the job description for the City
Works staff, and requesting to refill the vacant position. If they could obtain someone
with building inspector experience, they would have the backup needed.
Motion bv Council Member Lee. seconded bv Council Member Lakso. to look for a
candidate with the needed experience for the City Works vacancy. All in favor.
Motion carried unanimously.
2. Revision to Chapter 154
It was noted that Planning would like to have Council's feedback by its next meeting.

3. Mayor Capra reported on the Minnesota Mayors' Conference.
Mayor Capra stated that the Minnesota Mayors' Conference was very informative, and it
encouraged high performance partnership. They discussed gearing up for the census and
assessment policies regarding roadwork. Mayor R.T. Rybak gave a speech about
preparedness.
4. Problem with speeding at 73rd & 20th
Mayor Capra reported that citizens are requesting that police sit and take note of the
speeding problem at 73rd and 20th. It was reported cars sometimes drive so fast they are
missing the comer.
Councilmember Broussard-Vickers suggested that they need to narrow down the
timeframe during which this is happening.
5. Congratulations to Council Member Lakso
Mayor Capra congratulated Councilmember Lakso on the excellent job she did. The
whole treatment area was moved when they smelled gas.
6. Parks & Recreation
Councilmember Lee stated that, in the next couple of weeks, residents would be able to
have picnics in the park. A battle of the bands is being planned for June 14. Music in the
Park was discussed at the last meeting.
Councilmember Lakso expressed her hope that they will see continued activities in the
parks.
Councilmember Parr stated that special thanks should go out to Parks & Recreation
Committee, as they put in a lot of extra hours.
7. Performance Review
Mayor Capra announced that following the City Council Meeting and a short break by
Council Members, the Council would reconvene for an Executive Session - Subject:
Performance Review - City Administrator, Mr. Dallas Larson.

The City Council of Centerville, Minnesota met in a closed session on Wednesday, May
14,2008, at 9:40 p.m. in City Hall. Present were Mayor Mary Capra, Council members
Linda Broussard-Vickers, Michelle Lakso, Tom Lee and JeffPaar. Also present was
Administrator Dallas Larson. The purpose of the closed meeting was to complete the
annual performance evaluation of City Administrator Dallas Larson.
The Council discussed their individual evaluations of Dallas Larson. Larson was excused
from the meeting briefly while the Council discussed the matter.
The Council decided to continue the evaluation at the next meeting.
The meeting was reopened to the public at 9:20 p.m.
The meeting was adjourned at 9:20 p.m.

I. CALL TO ORDER
Mayor Capra called the May 21,2008, City Council Work Session to order at 6:30 p.m.
II. ITEMS FOR DISCUSSION
1. Proposed 2009 Street Proiect
a. Bonestroo' s Option 1 & 2
Mayor Capra inquired about how the assessments were calculated.
City Administrator Larson replied that he had City Clerk Bender go through the map and pick up
measurements for each lot to come up with their rate. When there was a comer lot, each side
was measured. If there were different kinds of improvements for each side, the different kinds of
improvements were each figured in. Also, 25% of the long side of the unit was figured in. For
the water main, the cost is $6,200 per unit. Some lots were large enough to be split into two
units. On the south side of the marsh area, they had to use 3-4 units for the parcel at that
location.
City Administrator Larson added that, for the water main they used one unit per lot, for the street
they used a rate per foot, and the sidewalks and trails were rolled in as an appurtenance to the
street project.
Mayor Capra inquired about what was in the Grant as opposed to what was in the Street Project
and whether we have the Grant here.
City Administrator Larson replied that he did not think the grant was considered when making
the project estimates. When City Engineer Statz did his estimate, he thought they would be able

to do all the trails in the Compo Plan and thus some costs could come out of the 2009 Street
Project and instead allocated to the grant. Finance Director Meyer felt they could do any trail in
town as part of the Grant. Most of the trails in the grant application were south of Main Street.
Mayor Capra inquired whether that is split out on these estimates.
Councilmember Broussard-Vickers stated that the number would be out of the Street Assessment
number; that is the number that would go down.
City Engineer Statz stated that the City fees would be reduced also.
City Administrator Larson stated that if you took out all sidewalks and trails, the street
assessment estimate would go down about 10%.
Mayor Capra stated that if we were to do trails with the Grant dollars, it would be beneficial to
do them with this project.
City Administrator Larson reported that Circle Pines recently bid a $3.5 million project. When
bids were received, it came in at $2.2 million. He stated that they had more underground work
and did more piping than is in the 2009 Street Project. They had 6,000 feet of sewer. The water
main cost was $12-14 per foot. He added that we have not seen those prices in 10-15 years and
probably would not see those prices again.
City Engineer Statz stated that he had a master spreadsheet that shows the sidewalks and trails
would be 6.4% of the total cost ofthe project.
Mayor Capra stated that she is concerned that the plan will cause water to run off the road onto
private property.
City Engineer Statz replied that there is a ditch on the east side and the houses are 5-10 feet
farther back there than on the West side. The ditch on the East side would narrow up and the
back side would be shallower. He stated that they would line the ditch with storm sewer and
would raise the ditch 1 to 1-1/2 feet. They would also put in drain tile. He added that right on
the right-of-way, they would put a storm sewer.
Mayor Capra inquired about how much right of way the city owns.
City Engineer Statz replied that we own the right-of-way and the easement is another 10 feet.
However, to people it would feel like they are in their front yard. He stated that he is
sympathetic to that, but the other side would be worse.
Mayor Capra requested seeing aerials of Mill Road. She inquired about drainage and whether it
would have to be treated.
City Engineer Statz replied that they can treat it, but it does not have to be treated where it is not
practical to do so. He stated that the slopes are too steep in this particular area.

Mayor Capra stated that they would have to discuss where the rain gardens will be located in
other parts of the project.
City Engineer Statz replied that there was one west of Centerville Road, and he pointed out other
locations on the map.
Mayor Capra stated that she has concerns about the houses being lower than the road and would
not want to see standing water there.
City Engineer Statz replied that they will be fully reconstructing that and will have the
opportunity to move the road up or down.
Councilmember Lee stated that he did not feel the project is far enough along to talk about the
details yet.
City Engineer Statz reassured them that if there were a problem, they would fix it. He stated that
he cannot tell them how all of the issues would be resolved until they have designed the project.
Councilmember Parr stated that Brian Drive, at the north section of 73rd, is not in Option 1. It is
in Option 2, as well as original 2009, for full bituminous with R&R and drain tile. He inquired
whether they are figuring that in just to carry it through to the newer houses on the end, because
that road changes.
City Engineer Statz replied yes, that the road changes pretty significantly at that break.
Councilmember Parr stated that will have water and sewer, etc. He added that, if we make
changes to the overall project and go from $7.8 million down to $4 million, some of those would
be pulled out. The fewer people participating, the more the cost will change.
City Engineer Statz replied that certain streets were more difficult than others. He stated that it is
a pretty homogenous project. It is a dollar-for-dollar trade-off - a foot-to-foot trade-off. The
rates probably would not change if we choose all the hardest streets to do. If we go to the $1.2
million option, that might happen, but it would not be more than a 5% change in the unit prices.
Councilmember Parr stated that there are some yellow areas on the map for water. He wanted to
clarify that, basically, those are areas that don't have water and eventually should have water.
Mayor Capra stated that the map is not correct. The east of Center Street does not have water
and the map shows that it does.
City Administrator Larson replied that the yellow areas mean they either have a water main but
no service line is hooked up, or there is no water main.
City Engineer Statz stated that, in general, those are not currently served with water.

Councilmember Broussard-Vickers requested a new vote on the 2012 Drop Dead (Mandatory
HookUp) Date. She stated that, if the Drop-Dead Date stays, she will not vote for the project.
Mayor Capra stated that they have no way to stop them from putting in a new well after the fact.
Councilmember Broussard-Vickers stated that they need to go back to 2004, when it was
adopted. The well diggers had 30 days to turn in a report.
Mayor Capra stated that people were mad about that. She added that it was done because they
had no way of governing it. She stated that she talked to a downtown citizen who had a water
line by her house. The citizen got a call from her son, who was at Menards, about getting
something to repair the well. Mayor Capra asked her why she would repair the well when she
has water right outside her house. The citizen did end up connecting to City water.
Mayor Capra stated that she is willing to shift the drop dead date for watermain connection.
Councilmember Broussard-Vickers stated that it would need to go away for her to support this.
Councilmember Lee stated that, at some point, the City would have to treat the water.
Mayor Capra stated that she is willing to make it 2020.
Councilmember Broussard-Vickers requested input from the rest of the Council Members.
Councilmember Parr stated that he would be willing to discuss it. He stated that they have
grown from a little City where everyone had little wells. Wells were great, but a well will
become contaminated - or something will happen. He stated that he is willing to discuss the
water hook-up being mandatory because the scope of the project is large. In another 5 years, it
will cost $10,000-12,000 more. It was difficult to get into homes to inspect sump pumps for
sewers; it will be more difficult getting into homes to enforce this one.
Mayor Capra stated that this came up in the middle of the 2004 Project.
City Administrator Larson replied that the ordinance was already here, but it was not known that
it was here.
Councilmember Lee stated that there was a consensus that it will be talked about. He added that
he is not sure about cost-sharing items.
Councilmember Broussard. Vickers stated that everyone pays for something they do not use or
need. For example, she pays taxes for the school system which she does not need. She added
that whether citizens agree or disagree, it is real and has a value.
Mayor Capra added that there is a storm sewer fee that everyone pays.
Councilmember Lee added that people with wells are paying for sewers.

City Engineer Statz reported that the City of Farmington charges a $12 per quarter fee for people
who have a water main that is not hooked up. There is also another city (he could not remember
the name) that does something similar.
Councilmember Lee stated that everyone would need new wells eventually.
Councilmember Broussard-Vickers stated that she does not support not having the Drop dead
date unless we have in place some sort of base rate cost. She stated that part of the Drop dead
date was to move everyone toward sharing the cost.
Councilmember Lee inquired whether they will be able to do all of this in time for the street
project.
Councilmember Broussard-Vickers replied that she did not see why not. She stated that once
they know where they are going, they would have enough meetings to dedicate to this project.
Councilmember Lee reinforced that they need to determine what the scope of this project might
be.
Mayor Capra inquired whether they could do alternates; i.e., alternates 1, 2, 3 - or maybe just
two alternates.
City Engineer Statz questioned whether she was talking about big sections of the street. He
stated that the engineering cost would go up.
Councilmember Broussard-Vickers inquired whether they could design the whole thing like it is
done, in an effort to avoid doing more than one engineering plan.
Councilmember Lee replied that if he were the contractor, he would then go higher on the price.
Councilmember Lee stated that the citizen's two biggest complaints are that they do not want
forced water and that it would look like it is part of their front yard.
Councilmember Broussard-Vickers replied it is not that the people are objecting to the water,
they just don't want to pay a high cost. She stated that after hearing about what happened in
Circle Pines, she believes that now would be the best time for the City to do that, in terms of
gross cost for every citizen. She added that when the economy is better and everyone's
pocketbook opens up, costs will quickly go higher.
Mayor Capra stated that Councilmember Broussard-Vickers had asked about mill and overlay.
Mayor Capra inquired about what the cost would be to keep repairing the streets every year.
Public Works Director Palzar replied that the cost for a I-inch overlay for 6 lots was $13,000 and
that it will only last about 6 years.

Councilmember Broussard-Vickers inquired whether a Mill and Overlay would be done for
Center Street and whether it would last 10 years. She stated that they now have a chance to get
water in at 2004 prices. She added that if they do not take that chance, what will happen to those
people in 10 years.
Mayor Capra stated that she does not know if they will be able to get Federal assistance for some
areas.
City Engineer Statz suggested that he would not do the storm sewers, as that is just minor. He
stated that they will last 7-10 years with Mill and Overlay (Robin Lane and Center Street). He
suggested no road improvements to Robin Lane and Center Street at this time, as those streets
are still drivable.
Councilmember Broussard-Vickers stated that would become a yearly repair issue.
Councilmember Lakso inquired as to how they can get some Federal assistance.
Mayor Capra suggested sending letters to individuals that they are thinking about pulling their
part of the project.
Councilmember Broussard-Vickers stated that she has heard people say they were too afraid to
speak out. She stated that she believes there are people here who have a different opinion who
are not speaking up.
Councilmember Lee stated that some would not want to speak up, because they are afraid of
their neighbors.
Mayor Capra questioned whether Councilmember Broussard-Vickers would support the project
if they approved the extra fee.
Councilmember Broussard-Vickers replied that, as long as they get the extra fee, and favorable
bids like Circle Pines, she would support it.
Councilmember Lee stated again that they need to start to determine the scope of the project.
Councilmember Parr stated that the 2 cul-de-sacs off Center Street are in pretty good shape.
City Engineer Statz replied that they considered drilling both. He stated that one-third of the cul-
de-sacs will tom up so savings would not be significant.
Councilmember Parr inquired whether, if they did Center Street, they could stub the piping to
that location so water could be hooked up later.
City Engineer Statz replied that one of the complaints people have is construction crews going
over new roads. He stated that he hoped Center Street would last 10 years.

Councilmember Parr stated that, if it lasted over 16-17 years, we got our monies worth. He
added that they need to make sure citizens 65 or older, or returning Vets, who are affected by the
project and qualify, get the deferment.
Councilmember Parr stated that, if there were a full reconstruct, he would want to put in water.
If there were a way to figure it, he would like to see the 10% number for trails and sidewalks.
He questioned the difference if sidewalks and trails are removed, noting if it could possibly come
up to 25-30%, that would make a big difference.
City Engineer Statz suggested that the Council Members just look at the sheets they have in their
hands and not at the other maps. The plan was to take off Robin Lane. Center Street would be
taken off our list next.
Councilmember Lakso stated that she thought Center Street looked pretty bad.
City Engineer Statz replied that in some regard, Center Street and Robin Lane could wait a
while.
Public Works Director Palzar stated that one-half of the patching they have done has been on
Center Street.
Councilmember Broussard-Vickers stated that they are spending half of the City maintenance
budget on that one street, and everyone is paying for that.
Mayor Capra stated that they talked about adding a drain.
Councilmember Broussard-Vickers stated that City Engineer Statz had mentioned Center Street
was an option. She inquired about adding C 1 improvements.
Councilmember Lee stated that he would like to see accurate maps.
Councilmember Broussard-Vickers stated that they should start with the map they had at the
Public Hearing. She stated that she voted "no" on putting water in areas that were off to the side.
Mayor Capra stated that she would like more information on where they want trails and
sidewalks.
City Engineer Statz stated, if we get great numbers back on water, that would affect his
recommendation on what gets done on Center Street. If they have to, they could pull the "C's"
just like they pulled 73rd from the 2004 project.
Councilmember Lakso stated that she agrees with what was taken out and with pulling C2' s.
Councilmember Broussard-Vickers stated that Circle Pines' cost is lower than what we were are
estimating.

Councilmember Lakso stated that if we are looking at taking costs down, we should keep the
ones in that connect. She stated that the whole portion of Centerville Road does need to be done.
She added that she is fine with taking Mill Road out of the project.
Mayor Capra inquired as to what was the point of the full reconstruct on this portion.
City Engineer Statz replied that if you put curb on both sides of the road, you have to do a full
reconstruct. He confirmed that part of Mill Road is pulled out of both Option 1 and Option 2, as
people said they did not want it.
City Engineer Statz stated that the cost for the trail on Mill Road is $40,000.
Councilmember Parr suggested that, on one option, they figure no trails or sidewalks to see what
the costs are.
Councilmember Lee suggested leaving out Robin Lane and Center Street and doing the rest. He
stated that Center Street would be either Option 2 or delayed to 2014. Peltier should be done as
water is needed. He added that they might return to Mound, Lavelle and Center as an Option,
and that they should keep the C 1 ' s.
City Engineer Statz questioned whether the Council members would support the project if C1
were part of the alternative.
Councilmember Lee stated that he was just trying to keep it simple.
Councilmember Broussard-Vickers added that she would like to see different options.
City Engineer Statz replied that if you bid these and decide not to do them, you would risk
$50,000 in engineering fees. The rest of C1 improvements would lose $75,000 in engineering
fees.
Councilmember Broussard-Vickers stated that based on $125,000 in fees, we should either put it
all in or leave it all out.
Mayor Capra stated that they have done change orders before.
Councilmember Lee suggested that if doing Fox Run, why not do the surrounding roads.
Councilmember Parr requested Public Works Director Palzar's opinion regarding what he has
heard them describe.
Public Works Director Palzar replied that Peltier Drive could reduce the sand amount on the high
area. He stated that possibly to save money, the City Engineer could look at that. He stated that
Center Street was never properly graded, and that it definitely could use a full reconstruct. He
added that a full reconstruct would be extending the life of the roads around there. He suggested
that annual inspections could help the City Council make future decisions.

Councilmember Parr questioned if there was anything Public Works Director Palzar thought
should be added or removed.
Public Works Director Palzar replied that they all could use some attention. He added that if it is
not done this time, we would need to look at it next time.
Mayor Capra stated that they could put it in as an alternative. She stated that she had a question
on Mill Road. She would like to see a trail go to the end. She stated that with Grant dollars, they
are doing improved drainage to make the trails possible. They are only doing it because of the
trails. Managing the storm water is being done that way because of the trails. She inquired
whether they could use Grant dollars for that cost.
City Engineer Statz stated that contract changes could be made up to 25% of the price of the
contract. But, if it is more than 25%, they cannot change the contract.
Councilmember Broussard-Vickers suggested leaving out Peterson and Center and getting
started.
Councilmember Lee suggested that when they decide what they are going to order, they need to
keep their options open. He added that they will have to order it all, but bid on only part of it.
City Engineer Statz suggested that it can be split into 2 projects, and they can decide later
whether or not to do the second one.
Councilmember Broussard-Vickers inquired whether it would it be possible to have 2 projects in
the same bond.
City Attorney Glaser replied that bonding companies may be more flexible now because of the
economy.
Councilmember Parr stated that City Engineer Statz now knows what they are looking for.
Councilmember Broussard-Vickers inquired about what happens to Mill Road. If they do not
choose to put in a trail, would they want work done on Mill Road. She suggested starting on
things that can be done.
Mayor Capra stated that they should use grant dollars to improve drainage and do the trail.
City Engineer Statz stated that at the June 11 Meeting, he would provide a Letter of Proposal,
with his fees for the project as they have defined it.
Councilmember Broussard-Vickers stated that she does not want to lose the first map.
City Engineer Statz stated that between now and June 11, the City Council should add and
subtract. He stated that they would move forward from there.

Councilmember Broussard-Vickers inquired about what processes they would have to go
through to find out how they can use the Grant.
City Administrator Larson stated that they would check to see if the Grant money can be used for
other things.
Mayor Capra stated that they should use most of dollars to improve drainage and do everything
possible to offset the cost. She added that for the regional area, everyone should use it for the
betterment of the City as a whole.
Councilmember Broussard-Vickers inquired about how they can figure out the dollar number
that is useable.
Councilmember Lee suggested figuring the maintenance cost of the water system.
Mayor Capra stated that Finance Director Meyer needs to come back with a number in the next 2
meetings. She stated that they need to maintain the system and guard for the future. She added
that they have commercial property not hooked up to City water.
City Attorney Glaser stated that they could have one drop dead date for commercial properties,
then another for residential.
City Engineer Statz inquired if they are considering charging everybody if you put water in for
them or not.
Councilmember Parr suggested doing a fee system. He stated that everybody already on the
system is going to pay more than someone on a well that has a line stubbed to them. There
would be a different fee for people with no stub or service at all.
City Engineer Statz stated that those who wanted the project would be pretty upset if it did not
get done and they still had to pay the fee.
Councilmember Broussard-Vickers stated that everyone will have a benefit from it, so all of
them should pay something. She stated that they cannot say they do not benefit from water.
City Attorney Glaser stated that there is a difference between a fee and an assessment. A fee has
to be structured and done exactly right so we do not get sued.
Councilmember Parr stated that everyone on City water pays a monthly fee based on usage, and
they should leave that alone. People who have water available, but chose not to use it, would
pay a fee for having the water available there.
Councilmember Lee stated that everyone should pay for the benefit they are getting. He stated
that ifhe were on City water, he would pay "X" times what he is using.

City Administrator Larson stated that the person who does not have the option to connect does
not have the same benefit.
City Attorney Glaser inquired whether the residents' insurance is the same on the streets that
have no fire hydrants.
Council member Broussard Vickers replied that yes, it is the same.
Councilmember Parr added that the insurance company will ask if the structure is within 1,000
feet of a fire hydrant but the rates are actually the same as other homes in the protected area.
Mayor Capra inquired whether they want to send letters to residents involved that the City is
considering bumping it to 2014 (Robin Lane, Fox, Center Street, Sumac, Ivy, Lavelle and
Mound). She stated that they could emphasize that this is the time to be heard, and this would
give them a chance to come forward. The letter would state that unless the City Council gets
positive input, that portion would be held until 2014.
Public Works Director Palzar stated that they talked about redoing the entire campgrounds. He
inquired whether it would it make a difference if the County would pay some fees.
Councilmember Lee replied that it would figure into the equation.
City Administrator Larson inquired whether that is a public water supply.
Public Works Director Palzar replied that it is.
Mayor Capra stated that she is open to considering it. She stated that they need to know what the
C 1 improvements are.
City Engineer Statz replied Robin, Center Street, Mound Trail, La Valle Drive and Center Street
could be Project #2. Also Mill Road, if we can use Grant dollars to significantly offset the cost.
Councilmember Lee inquired whether the drop dead date could be put offto 2020.
Councilmember Broussard-Vickers replied that sounded good to her. She added that she needs
to know that is where we are going.
Mayor Capra stated that, at some point, they need to review their Assessment Policy. She stated
that they cannot go back and get credit for what they paid. She added that the collector streets
would build differently than a cul-de-sac.
City Engineer Statz stated that because of the drainage factor, they are building things more
substantially.
Public Works Director Palzar suggested monitoring it on an annual basis.

Mayor Capra stated that she would like to review more of an actual schedule. It should be more
aggressive on the roads that get used more often. She stated that she wants to explore the
possibility of getting someone to oversee these projects other than the engineer. She added that
she does not want to think they need a babysitter but, since they do need to take the lowest bid,
she wants these projects scrutinized.
City Engineer Statz replied that on a project this size, he would suggest having a full-time
inspector.
Councilmember Broussard-Vickers inquired whether they could insert a process that each level
gets done before going on to the next level.
City Administrator Larson stated that at times they could possibly use someone from the City
Engineer's office in addition to a city staff person.
Mayor Capra stated that they have to have that overseeing on the project to make sure it is done
properly.
Councilmember Broussard-Vickers stated that there seems to be the thought of maintaining what
was put in place a good number of years ago. She inquired whether they are then ignoring what
people are saying is their reasoning for not wanting this project. She stated that she understands
we generally get this kind of opposition. The City Council is representing everyone in the City
who has put in any money; they are affecting everybody.
Councilmember Parr stated that if they do it as needed, it is more expensive because we are just
doing one road at a time.
Councilmember Lee stated that the economy helps us as much as it hurts us. He stated that there
is no way it will be cheaper later.
Mayor Capra stated that the citizens do not think it will be cheaper - they were just talking about
the economy and how gas is going up, etc.
Councilmember Parr suggested that, mid-section, they could throw that in as an alternative. He
added that Option 2 does not have that in there.
Mayor Capra stated that people are saying not to do the streets unless they need to be done. She
inquired about what is total failure and what can be delayed.
Councilmember Broussard-Vickers stated that the assessment is $3,000 vs. $3,600 to a street.
She inquired about Peterson and Houle - if it is not done until 2014, what would those people
gain or lose.
Mayor Capra replied that they are losing.

Councilmember Broussard-Vickers stated that people would just say, "Not now."
Councilmember Lee inquired about the dollar difference if we do Peterson now or 5 years from
now. He stated that he would rather make a mistake by doing it now than make a mistake by not
doing it now.
Councilmember Parr inquired about what they are really going to save if they remove that
section.
Mayor Capra stated that she would like the Council to include some of the drainage areas in the
bid.
Councilmember Parr suggested that they discuss some of the comers and big lots at another
meeting.
City Engineer Statz stated that would be some time between now and the assessment hearing.
He added that they are looking at $4.5 million project, compared to the $6.3 million project.
City Administrator Larson stated that for $250,000, the total would be $140 per year.
Councilmember Lakso inquired whether the Governor's levy limit affects it.
City Administrator Larson replied that it does not affect a bond levy.
Mayor Capra requested that City Attorney Glaser explain the process for appeal.
City Attorney Glaser stated that would be for the Public Meeting. He stated that the City
Council is the first appeal. Each case is reviewed on a case-by-case basis. Then the property
owner can take it to the District Court. They would have to fill out a form. He stated that notice
timelines are really short. They would have to be on target within 30 days. He added that there
is a judge - not a jury.
City Engineer Statz stated that the assessments we have proposed are in line.
Councilmember Broussard-Vickers inquired when they figure numbers, if they figure shortage of
value.
City Engineer Statz replied that often it equates to the cost to put in new sewer, water, and
streets. He added that the cost for each lot in a new subdivision is $25,000 -$40,000.
City Administrator Larson requested that City Engineer Statz submit his letter, with the map, to
the Council by their next meeting.
Mayor Capra repeated that by June 11, City Engineer Statz would have the final proposal and
map.

City Engineer Statz stated that it would take a couple of months to put it out for bid.
Councilmember Broussard-Vickers inquired as to what happens if we have a bid, and they don't
perform.
City Attorney Glaser replied that they would have a contractor is required to have a bid bond to
guarantee that they honor their bid and a performance bond to guarantee they fuHfuH the
contract.
Mayor Capra stated that they would still look for grants such as Farmers Home Administration
for people in this whole area who may qualify for any assistance. She stated that they need to
define the criteria. It is not a loan - it is a grant. She inquired about how they would do that.
She added that she would like to have information on who did qualify.
City Administrator Larson replied that he would find the criteria.

Mayor Capra opened the public hearing at 6:35 p.m. and inquired whether anyone wanted

Administrator Larson reported that the City Council is required to do an Annual Public
Meeting. He stated that a notice was in the newspaper, there were brochures available,

and it has been on the web site and on the local access channel. There have been a
number of actions during the year. There were 33 outcalls (out of33) inspections and 25
ponds (out of 25) inspected. A new storm water permit will be issued, and they will

Councilmember Paar requested that this item be held for discussion. He requested more
information on Check #023366 for Anoka County Highway and Check #023373 for the
Met Council.
City Administrator Larson explained that the check for the Met Council was for quarterly
waste water treatment services and the check for Anoka County Highway was the third
payment that was due on the CSAH 14 project.
City Engineer Statz stated that Anoka County Highway usually requires full payment up
front, but the City negotiated for payments.

Item 1 of the Consent A1!enda as presented. All in favor. Motion carried
unanimously.
VI. A W ARDSIPRESENT ATIONS/APPEARANCES
1. Mr. Greg Kieselhorst. Centerville Lion's Club - Fete des Lacs Special Event
Permit. Temporary On-Sale Liquor License. Noise & Fireworks Permits
Mr. Kieselhorst stated that he would like to make a couple corrections to the Special
Event Permit Application. In the second to the last paragraph on Page 3, the last date for
the Hockey Rink should be August 3 instead of August 5. Also the Hockey Rink time on
August 2 should be 11 :30 p.m. instead of 11 :30 a.m.
Mr. Kieselhorst requested a Noise & Fireworks Permit for Saturday and Sunday. He also
requested Permits that would include the use of park and an on-sale liquor license. Mr.
Kieselhorst acknowledged that he would need to submit a copy of his updated insurance
before the festival.
Councilmember Lee announced that they need volunteers. They currently only have 25%
of those needed.
Mr. Kieselhorst clarified that the Festival Street Dance, the evening of Saturday, August
2, will be for ages 21 and older.
Mayor Capra requested that the reporters, who were present, obtain Mr. Kieselhorst's
contact information and put a notice regarding this in their paper.

2. Statements regarding city of Hugo

Mayor Capra stated that they had a storm event that could have been much worse. She
reported that fifty individuals from Centerville will go to help with cleanup. She stated
that our County has a Mutual Aid Agreement but, as of now, Hugo has not requested
mutual aid from the County. She added that we have ten spots left for people to go, and
there will be additional times they will need volunteers. She stated that Eagle Brook
church is working with us on this. The City Hall in Hugo said they have plenty of
volunteers.
Mayor Capra stated that we did what we had to do, which is register as a group. There is
a concern of having 1,000 people there to volunteer and no place to put them.
Councilmember Paar stated that if volunteers were not needed now, they would be
needed in the future.
Mayor Capra stated that there might be other clean up days. She said we would not know
until end of the day on Saturday.
Mayor Capra added that her thoughts and prayers go out to victims. She stated that their
City Council is doing a great job.
Centerville Police Sergeant Pat Aldridge stated that he was glad the tornado was one mile
north of us because, if not, it would have been devastating. He stated that Centerville did
have minor damage mainly due to hail. He didn't realize how bad Hugo was until the
next day, and he was surprised they didn't ask for Centerville's help.
Sergeant Aldridge reported that they made 35 squares to cover the map of Centerville,
and the Fire Department and Police Department went through every grid. He stated that
Centerville, Cottonwood and Brian Drive had the worst hail damage. Some areas had
loss of power, there was one house that lost a roof, there were two hail-damaged police
cars, and the hail was 1-1/2 feet deep in some areas.
Mayor Capra stated that she would like to commend Officer Jacobson and the other
police officers that drove around immediately to make sure no one needed help
Public Works Director Palzar reported that there was a meeting on May 27 at noon, and
thirteen people were in attendance. They were asked why there was only one Public
Works person there. He stated that the generator on Peltier Lake is still functioning. He
added that he wanted to commend everyone, and stated that we were all very lucky.
Sergeant Aldridge stated that this was his first command center encounter. He added that
it would help prepare him for future problems
Mayor Capra stated that she talked to the coordinators regarding Hugo's clean-up day.
She was told that Hugo would like to do their own patrolling.
Sergeant Aldridge reported that they have had reserves there today.

Mayor Capra stated that the Eagle Brook's church services will be ending at the same
time people will be leaving the Hugo site. Volunteers will be there to instruct people on
what would be the best route.
3. Police Department Reports
Sergeant Aldridge reported that there were a rash of car robberies (5 in 2 nights) mid-
May. He stated that officers are now patrolling the areas. There was one DWI, one
juvenile consumption, and a juvenile fight in McBride Park. In addition, there was
vandalism to the Skate Park. Sergeant Aldridge conveyed his frustration that happened,
and stated that they cannot place an officer at the Skate Park.
Councilmember Lee reported that there is a skate event coming up. He stated that, while
at the event, he would talk to some of the kids to see ifhe can obtain any information. He
will also let them know that the Skate Park doesn't have to be there and, if the vandalism
continues, it may no longer be there. He added that he believes it is just a couple kids
that are 90% of the problem.
Sergeant Aldridge reported that at the Department, they conducted several boy scout
tours, safety seminars, and ride-alongs. Sergeant Aldridge reported that the Centerville
police get more seat belts citations than the other 11 cities combined.
Mayor Capra stated that she heard a news story about a man who got a ticket for not
wearing his seat belt. He put the seat belt on. Later he got in an accident, and the seat
belt saved his life.
Sergeant Aldridge stated that the odds of surviving an accident are significantly higher if
the person is wearing a seat belt.
Sergeant Aldridge reported that the Department has hired internally for the vacant police
officer position. The background check has been completed and the officer's start date
will be June 9.
VII. OLD BUSINESS
1. McBride Park
Public Works Director Palzar stated they had a change order for the park and the work
would be completed by Friday. He stated that they left a portion of the trail to put in a
bench, and they will wrap trail around the East side of park.
Councilmember Lee inquired about whether there was suppose to be a trail.
Public Works Director Palzar stated that it was talked about but not done.

Councilmember Lee stated that he thought it would be done in the original bid, and that it
would wrap all the way around.
Public Works Director Palzar replied that because of the size of the play structure, it had
to be moved, so the plans were adjusted.
Mayor Capra asked whether the part of the trail shown on the screen would be fixed.
Public Works Director Palzar replied that in addition to the new section of trail, they can
put a %" overlay on that area, with the cost not exceeding $3,400.
Councilmember Lee stated that the Change Order needed to be approved to include
adding that overlay.
Councilmember Lee inquired whether there was storm damage to the newly constructed
structure or the pump house.

VIII. NEW BUSINESS
1. Res. #08-014 - Appointing a Fire Chief for Centennial Fire District
City Administrator Larson reported that the Fire Steering Committee's vote was
unanimous to approve Jerry Streich as the new Fire Chief. He stated that Mr. Streich
more than met the criteria of what they are looking for and recommended that it be
approved. He added that Mr. Streich has 20 years of experience, has a lot of credentials
and he is very eager to start. City Administrator Larson stated that they are looking
forward to Mr. Streich's start date of August 1. City Administrator Larson added that
there would be some overlap time for Chief Milo Bennett.
Councilmember Paar recommended that the City Council put their faith in Jerry Streich.
Motion bv Council Member Paar. seconded bv Council Member Lee. to aDDrove
Res. #08-014 authorizine: the hire of Jerry Streich as the new Fire Chief for the
Centennial Fire District. All in favor. Motion carried unanimously.
IX. ANNOUNCEMENTSIUPDATES
1. City Administrator. Mr. Dallas Larson
City Administrator Larson did a quick summary on the map showing what he understood
was the consensus of the City Council of what would be included in the road project. He
stated that this would be on the next City Council agenda. The total cost of the project is
would be $4.5 million, including $1.6 million of assessments.

Discussion ensued regarding whether favorable bids would lead to following up with
bidding of Option 2, which would include the Center Street area.
Mayor Capra stated that she asked City Administrator Larson for some information from
Finance Director Meyer. She inquired about what would be average house value with
these improvements, and what would be the impact of tax increase.
Councilmember Broussard-Vickers stated that she understood that the other red area on
the map would be part of second bid.
Mayor Capra stated that they should get back to basics and put that consensus out for bid.
She pointed out that they were missing the completion of the trails, which should be
included because the City has Grant dollars. She added that, if the City does not use
those Grant dollars by 2011, it would not get them again, and probably not do another
project for 5 years.
City Engineer Statz stated he would do calculations on the effect of using Grant dollars
for the trails. He stated that Mill Road and its associated costs are already figured in the
curb and storm sewer cost, as part of the trail project cost. He stated that people on Mill
Road would not be assessed for those. He stated that he took a few more liberties with
the cost including sod and top soil. He stated that if they eliminate the D2 sections of the
trail on Brian Lane and the far side of Mill Road, the cost would be $12/foot. If the entire
$ 12/foot is paid by the Grant, $1.65 per foot would be taken off the assessment
Councilmember Broussard-Vickers inquired whether that savings would come out of the
$4.5 million.
City Administrator Larson stated that it has not yet been taken out.
City Engineer Statz stated that this is an assumption at this point. He is not sure all of
these things can be covered under the Grant.
Councilmember Lee inquired as to what the overall effect would be if they pulled part of
the road (C1's ) out.
City Engineer Statz replied that it would be about a $1 million difference.
Mayor Capra inquired as to what the 2004 project added on the consumers.
City Administrator Larson replied that the levy was $100.00 per year.
Councilmember Broussard-Vickers stated that it is somewhat reduced because a portion
was going toward the trails.
Councilmember Lee stated that the backage road could pay for itself.

Mayor Capra inquired what if they just did storm water improvements and less in depth.
City Engineer Statz replied that they need an adequate crown in the road. He stated that
with the three projects, the backage road is a liability and CSAH14 is something forced
on them.
Councilmember Paar stated that he keeps hearing, "Just not now." He stated that if we
don't tack it on now, in 3-4 years it will be double the price. No matter which way we
go, we can't make everyone happy. He acknowledged that he knows the economy is
having issues, and he sympathizes. He added that maybe they should just do the roads
that absolutely need it as full reconstruct - and it would have to include the water.
Maybe, with some roads that are borderline, the City could let them "limp along" for a
while and scale down as much as possible. He stated that this is because of CSAH 14
and the backage road. He believes to totally throw it away isn't logical.
Mayor Capra stated that, when you drive on these roads, some of them do not look like
they need that many improvements.
Councilmember Lee stated that what happened before was that they filled potholes until
the budget ran out, and they could not fill them all. Then, the following year, they did the
same, etc.
Councilmember Paar stated that they talked with City Engineer Statz about the areas
where water was driving (and pulling them out), amended mandatory hookup, looked for
grants, discussed seniors/military exemptions, etc. He added that, every time the City
does something to help, it is never enough. In 5 years, people will say our roads are
falling apart.
Discussion ensued regarding the various options previously discussed. No consensus was
reached at this point.
Councilmember Broussard-Vickers stated that they need to know before ordering if they
have a majority vote. She added that they are suppose to have that in 2 weeks, and they
are nowhere close.
Mayor Capra stated that they need to support what was delayed in 2004, Mill Road, 73rd,
Peltier - all the way across, and Centerville Road, and they need to know if they are going
to do the trails. She added that they also need to ask about storm water improvements

Councilmember Broussard-Vickers stated that the City Council needs another Work
Session for a decision-making meeting.
Councilmember Paar agreed that another Work Session is needed to make a decision.

Mayor Capra inquired whether they could schedule a Work Session on Tuesday, June 3.
Councilmember Broussard-Vickers stated that the June 3rd or the lOth would be good
dates.

City Administrator Larson placed a call to Councilmember Lakso, and Councilmember
Lakso stated that June 10 would work for her.
City Administrator Larson then clarified that the next Work Session would be on June 10
at 6:30 p.m.
Councilmember Broussard-Vickers suggested that by the June lOW ork Session, the City
Council Members should decide, and make a list of, exactly what they are willing to
support.
He stated that he would support this project. He noted that they had opposition in 2004
also. He stated that he is still willing to make changes.
Mayor Capra stated that she needs to be sure of what they would be adding on for the
levy.
2. Storm Damage Update
Mayor Capra stated that there was damage to some public buildings.
Public Works Director Palzar stated that 100% of the homes have some sort of hail
damage. He added that there are also some with tree debris. He stated that they will not
do tree removal as a City expense at this time.
Mayor Capra stated that the City Council would have to determine, with each separate
incident, whether or not tree removal should be included as a City expense.
3. Parks and Recreation
City Engineer Statz stated that the next Parks and Recreation meeting would be held on
June 4. He added that they have proposals to bring to the Parks Board on June 4.
X. ADJOURNMENT
Mayor Capra announced that the City Council Meeting would reconvene with the Work
Session Meeting after a short break.

I. CALL TO ORDER
Mayor Capra called the May 28, 2008, City Council Work Session to order at 8:25 p.m.
II. ITEMS FOR DISCUSSION
1. Nuisance Issues - Ordinance Enhancement
City Administrator Larson reported that they had a large list of nuisance complaints.
Public Works Director Palzar looked at the list and identified those that were dangerous.
Letters were sent to those homeowners, with instructions stating that their specific item(s)
needed to be moved out of the right of way.
Public Works Director Palzar showed a case where there were bricks in the right-of-way,
causing a tripping hazard
City Administrator Larson explained that the violations were broken down to the most
hazardous nine, using the opinions of Public Works Director Palzar, City Administrator
Larson and citizen complaints.
Mayor Capra inquired whether there is a term within the Ordinance to specify that the
final decisions be at the discretion of the City Council.
City Attorney Glaser confirmed that it is at the City Council's discretion whether or not
to enforce the violation.

Councilmember Broussard-Vickers stated that she believed they should send a letter to
everyone who is in violation, not only the most hazardous. She stated that the
homeowners also need to be aware that any costs the City incurs to fix the hazard would
be billed back to the homeowner. She added that the violations should be addressed
when they are brought up, so it is obvious that the City Council has looked at every case.
Councilmember Paar stated that the Council is only enforcing these nine cases, because
these have been deemed to be dangerous.
Mayor Capra stated that they should send the homeowners with hazardous violations a
letter, advising them that the Council has received a complaint. The letter should go on
to say that the Council is not taking action at this time, but wants to make them aware
that they are in violation and, if the City has to correct the situation, the cost will be billed
to the homeowner.
City Attorney Glaser stated that people would say that everyone else is doing it. He
believes the reality is that a lot of this list came out of spite. One homeowner was
notified of her violation, so she/he wants to accuse others.
Councilmember Paar stated that the Ordinance should specify that the decision about
each case be at the discretion of the City Council.
Councilmember Broussard-Vickers stated that some people have no clue what they are
doing wrong.
City Attorney Glaser suggested that a list be posted on the web site of the alleged
violations.
Mayor Capra stated that the Council is doing whatever they said they would do.
Public Works Director Palzar clarified that anything 6 feet from the curb line or within 1
foot of the sidewalk is definitely a hazard.
Mayor Capra inquired whether the City would respond to Mrs. Essex regarding her
concerns.
Councilmember Broussard-Vickers suggested that the letter say that the City Council has
addressed his (or her) concerns, and that is all.
City Attorney Glaser stated that he would send a letter to Mrs. Essex.
Councilmember Lee stated that there are other Ordinances that are being violated; i.e.,
homeowners impeding water.
Councilmember Broussard-Vickers questioned how they would decide which ones to
enforce.

Councilmember Lee stated that they have not been enforcing Ordinances; therefore, there
are more violations.
Public Works Director Palzar stated that they need to look at correcting some of these
Issues.
Councilmember Broussard-Vickers stated that it would cost the City taxes.
Councilmember Lee replied that, if you enforce the Ordinance, it is assessed to the
homeowner.
City Attorney Glaser suggested that if starting this type of enforcement, they should start
with education, warnings, etc. If that does not work, then they would start stricter
enforcement. He added that it gets very expensive.
Public Works Director Palzar suggested that they could put in drain tiles to address some
of the rear-yard drainage problems.
Councilmember Broussard-Vickers inquired whether they could force homeowners to
participate and charge them for 100% of it.
Councilmember Paar pointed out that some people have fences in drainage easements.
Councilmember Lee stated that these violations should be addressed when a new buyer
first buys the property.
Councilmember Paar stated that, if they start enforcing every house in violation of any
code, they will see 90% of the City's mature trees come down. He stated that he does not
believe enforcement should be all or nothing.
Councilmember Lee stated that enforcing the hazardous violations would have to be done
on a case-by-case basis.
Councilmember Paar pointed out that this could open a can of worms.
City Engineer Statz inquired whether the Ordinance states that you have to remove the
hazard, or the City may remove it at your cost. He stated that the City may do this, and
we are doing this to the nine people with hazardous violations. He added that if it stays
as it is, homeowners would know that the City could come in to fix it at their expense.
Councilmember Paar inquired about the sump pump issue.
City Administrator Larson replied that the City has taken care of the ones they received
complaints on.

Public Works Director Palzar stated that, regarding private water issues vs. city water
issues, previous Councils did not fix the private water issues. He added that early
development did not have proper drainage.
Councilmember Broussard-Vickers suggested that in those areas, rather than letting it
carry-on, they should get one at a time off the list as they prioritize them.
Mayor Capra stated that she could think of five locations that could benefit.
Public Works Director Palzar reported that $100 would buy 300 feet of drain tile.
Councilmember Broussard-Vickers stated that, if one out of six people brought forward a
complaint and it affects all six, all six should pay.
City Attorney Glaser stated that they could go into one house and say it is a problem, but
they have to leave neighbors alone if they do not have the problem.
Councilmember Lee inquired whether they could selectively enforce a certain number of
ordinances per year.
City Attorney Glaser replied that, since they have not been enforcing the ordinance,
enforcing it now should start with needs (i.e. complaint from a citizen).
Councilmember Paar questioned where they are with the sump pump ordinance.
Mayor Capra replied that a sump pump could not drain into someone else's yard.
Councilmember Paar stated that his neighbors' water comes into his yard, and his goes
down Centerville Road.
Mayor Capra stated that they could not solve all the issues. They could have Public
Works Director Palzar look at these specific issues. She inquired whether this could be
fixed out of storm water dollars.
City Engineer Statz replied that the City may not have the means to fix backyard drainage
problems. He stated that those people bought those lots. The problem should have been
addressed when they purchased the house.
City Attorney Glaser agreed that backyard drainage problems should be left to the private
landowners.
Public Works Director Palzar stated that it is private water until it gets to our storm water
system.
Councilmember Lee stated that the yards upstream are considerably wetter, and it is
closer to the end of their yards.

City Administrator Larson inquired whether they could pursue some cost estimates to fix
these.
Mayor Capra stated that she agreed.
Councilmember Broussard-Vickers suggested that they pick one or two areas and go
around and see if the homeowners want to pay the assessment to get it resolved. She
added that, if there is no success, she is not willing to go through all the trouble. She
would then only want to enforce it if it was a nuisance.
Councilmember Paar stated that he agreed that nuisance situations should be brought to
the Council, like Mrs. Essex's, should be addressed. He added that, as it was done in this
case, the Staff should look at it, invest some time, and give it their discretion.
Public Works Director Palzar stated that ifhe does not put drain tile in, he could not solve
their problems.
Mayor Capra inquired whether that one yard is higher than the others.
Councilmember Broussard-Vickers stated that if one particular object caused the
problem, a letter should be sent, stating that it should be taken out.
City Attorney Glaser stated that, if something is impeding the flow of water, it does not
have to be in the easement to be considered a violation.
Councilmember Broussard-Vickers stated that this should go back to Staff to be handled.
Councilmember Lee agreed that these situations should be handled by Staff.
2. Chapter 154 - Review & Provide Feedback to Planning: & Zoning Commission
City Attorney Glaser read the definition of Chapter 154.
Mayor Capra stated that, if property is destroyed, homeowners have one year to rebuild.
City Attorney Glaser stated that R4 has been removed from the code. Any new mobile
home park would have to be done as a Planned Unit Development. He added that it
could cause problems with existing units.
Councilmember Broussard-Vickers stated that she could not see redoing this without
referring to the Comp Plan. She added that there is no R1 in the Comp Plan.
City Attorney Glaser replied that R1 is being phased out.

Councilmember Broussard-Vickers stated that R1 would become medium-density
housing, and we do not have medium-density housing zoning. She suggested that they
rework it now, if it will soon be irrelevant.
City Attorney Glaser stated that they would have to hold a Public Hearing on anything
they do with the Planning & Zoning Commission.
Councilmember Broussard-Vickers stated that she believes they need to concentrate on
the road project at this time.
Councilmember Broussard-Vickers stated that Planning & Zoning is mostly concerned
with the fence and pool issues. She stated that what is in there is the majority vote. She
added that they have already spent four hours on the fencing issue. She suggested that
they need to look at some pictures at the same time, and everyone should either come to
the Planning & Zoning Meeting or support what is in there.
Mayor Capra stated that the Planning & Zoning Commission meets on June 3.
Mayor Capra stated that with the LGA cuts, Centerville lost $23,000.
3. Code Revision
Mayor Capra stated that because the time had run over on other issues, the Code Revision
would be discussed at their next City Council Meeting.
4. CSAH14 Update
City Administrator Larson stated that on the far west end, they continue to work on the
road constructed on the swamp. He stated that they are starting on some storm sewer
issues next week. He added that, eventually, our water main would would be constructed
on CSAH 14 in the downtown.
City Engineer Statz stated that there are some contamination problems. He stated that
they are working with the County to figure out how to avoid contaminating the future
downtown site. He added that they were right on schedule at this time.
Councilmember Paar stated that they would still be able to access everything in the
downtown area.
City Engineer Statz agreed. He stated that they talked about completely delaying
decorative concrete construction in the downtown area until next year.
Public Works Director Palzar stated that they want to corne up with a better process to
give notice before they close off streets.
City Attorney Glaser inquired whether they have a go-to number.

Mayor Capra replied that it is on the website, and that they have to give them the
CSAH14 number.
City Administrator Larson .~!l:tt~.d that the County is often not very responsive, but that if
you copy Commissioner ~af:lSivarajah on it, things get done.
5. Schedule Budget Work Session
Mayor Capra scheduled the Budget Work Session on July 9, at the end of the City
Council Meeting. The Session would be continued at the July 23 City Council Meeting.
The Budget has to be completed in August.

The City Council of Centerville, Minnesota met in a closed session on Wednesday, May
28, 2008, at 9:50 p.m. in City Hall. Present were Mayor Mary Capra, Council members
Linda Broussard-Vickers, Michelle Lakso, Tom Lee and JeffPaar. Also present were
City Attorney Kurt Glaser and Administrator Dallas Larson. The purpose of the closed
meeting was to complete the annual performance evaluation of City Administrator Dallas
Larson and to consider the annual evaluation of Public Works Director Paul Palzer.
Paul Palzer requested the opportunity to have his evaluation considered by the City
Council. Palzer provided information showing the amount of training and education
associated with the building official responsibility included with his job. He suggested
that the pay study done in 2006 did not adequately consider his building official
designation. It was noted that there are no more than a couple of public works directors in
the state that also have the responsibility of building official, so pay comparisons at the
time of the study would not have been meaningful. It was further noted that an additional
five points would have put his job in the next pay grade. After some discussion the
Council consensus was that the job should be moved from grade 11 to pay grade 12.
The Council discussed their individual evaluations of Dallas Larson. Council members
expressed their satisfaction with his work and performance.
The meeting was reopened to the public at 10:50 p.m.
A motion was made by Council member Broussard-Vickers that the council authorize the
public works director position to be placed in Pay Grade 12 and that Palzer be placed in
Step 8, retroactive to January 1,2008. Motion seconded by Council member Lee, all
present voted in favor. The motion passed.
Motion made by Council member Broussard-Vickers to approve the performance review
of Administrator Larson and that the Council grant 64 hours of additional PTO time for
2008, in recognition of outstanding performance and extra meetings required during the
past year. Motion seconded by Council member Paar, all present voted in favor. The
motion passed.
The meeting was adjourned at 10:55 p.m.

Mediation Services for Anoka County, a non profit organization utilizing trained and supervised
volunteer mediators, celebrates 21 years of providing free or low cost conflict resolution services
to the community. Some new developments occurred in 2008:
· MSAC's previous executive director retired after 20 years.
. To economize, no new staff was hired, but promoted within.
. To economize, we reduced our present leased space by 1/3.
. Our brochure is now available in Spanish.
. The court mandated Peaceful Alternatives Class we provide for 1st-time juvenile
offenders continues to track a non-recidivism rate of 86%.
Over the past 21 years the funding provided by our partnership with local government has served
as a foundation for support. In 1987, 73% of our funding came from local government. In 2009
it is projected to represent only 17%. Over the years we have been expanding and diversifying
other funding sources, but fundraising goals in light of the present economy has been less than
expected. We need your continued support.

I just met with a couple folks from ProSource Technologies (the consultant North Pine is using to investigate the
contaminated soils). I explained our situation and asked if they would give us a recommendation on what to do,
given our future development plans which include underground parking. Of course, the simple answer I was
seeking was a bit more complicated and would involve placing some vapor probes and analysis of the levels of
contamination. I asked them to give us a proposal to complete these tasks and give us a recommendation. I
hope to have that proposal in the next few days so that we can review it prior to the council meeting. It may be
a good idea to place an item on the agenda to discuss this in the event that we want to do something like this.
The contractor will likely be excavating this area in about 3 weeks, so it is important that we decide what, if
anything, to do by then.

Hope things are O.K. down there after the bad weather this weekend - thought about you and
the signs after seeing the news.

MONTHL Y ENGINEER'S REPORT
For June 11,2008 City Council Meeting

1. 21st AvenuelBackage Road (000616-05143-0). The Contractor has an agreement with the
City to have all the remaining stockpile material to be removed by the end of August.
Contractor has afew cleanup items that will be taken care of this month and the Record Plans
will be delivered to the City this month also. Once all work has been approved the project will
be recommendedfor Final Payment.
2. Old Mill Road Improvements (000616-06147-0). All remaining work for the project is
anticipated to be completed in June. The Contractor has some punch list work and to finish the
wear course. Record Plans will be delivered to the City this month. Once all work has been
approved the project will be recommendedfor Final Payment.
3. Centerville Townoffice Park 2nd Addition (000616-06152-0). Project punch list has been
forwarded to the Contractor. The Contractor plans on finishing all punch list items and wear
course paving this month. Once all work is completed and accepted by the City and Record
Plans are acquired we will recommend Project Closeout.
4. Clearwater Creek Estates (Hanzal Property) (000616-06154-0). All work is complete.
Seed germination will be evaluated in the spring prior to release of surety. The contractor will
be on site as soon as road restrictions are lifted to correct the wetland mitigation grading and
reseed the area.
5. Hidden Spring Park (000616-07155-0). Mark Statz attended the June Parks and Rec.
Committee meeting to discuss the contractor's proposal for completing the work designed by
Gregg Thompson. The contractor had proposed a much larger gabion than the one shown on
Gregg's drawings. The parks committee did not want something this large and asked that the
contractor resubmit a proposal which included a gab ion sized between their original proposal
and that of Mr. Thompson. The contractor had also suggested doing the work in late summer
when the water levels were down. The parks committee understood this concern, but for a
number of other reasons, will ask that the contractor begin as soon as possible.
6. Comprehensive Plan (000616-07157-0). The Comprehensive Plan was approved for
jurisdictional review on April 9th. The City is receiving comments and responding as
appropriate. The next step will be to submit the plan to the Metropolitan Council Review.
7. 2009 Street and Utility Improvements (000616-07158-0). A final work session to discuss the
scope of the project is set for June 1 dh. It is anticipated that a decision to move forward with
plans and specs (for the agreed-upon scope) would be made at the June 11th City Council
meeting.
8. CSAH 14 Construction Services (000616-07159-0). Weekly meetings are still ongoing and
the Contractor has started to do a significant amount of work. The Contractor is still getting all
the requested submittals for our review and ongoing preparation for the streetscape and city
utility relocations continues. Our inspector has been working closely with the Public Works
Department. The Contractor has been working on City water main installation, relocation, and
testing. The Contractor has also been doing a significant amount of storm sewer installation.
They are currently working in the Lakeland Circle & CSAH 14 area working towards
downtown Centerville.
9. New Public Works Facility (000616-07160-0). Our building services group assisted the
public works department in developing a comprehensive punch list for interior work on the
facility. Paul will be working with the owner to complete the items identified in our inspection.
An inspection of the exterior work will take place, once it is completed.
10. Downtown Redevelopment Comprehensive Infrastructure Plan (000616-07161-0). The
Beard Group will be giving regular updates on their land acquisition as they move forward. We
are formulating a project for 2008 to construct some of the main line storm sewer and pond
system with the grant funds we have received. John Meyer continues his work to find more
grant dollars with our technical assistance.
11. Creative Kids Day Care Site (000616-07164-0). An onsite preconstruction meeting was held
with Public Works, the Contractor, and Bonestroo on April 30, 2008. The Contractor started
work the week of May 5, 2008. The Contractor has completed all utility work. Water main
has passed all the required field tests and the Contractor is making progress on constructing
the building onsite.

The Department of Natural Resources (DNR) has completed its review of the draft City of Centerville Wellhead
Protection Plan, Part 2 that was received March 18,2008. The plan was well written. However DNR Waters
would like the following,comments concerning the City ofCenterville Wellhead Protection Plan to be offered to
the wellhead protection manager:
1. DNR Waters believes that collecting data is important and recommends that the levels of public water supply
, wells be measured at least once a: mOl1.th. This infotination should be submitted to the DNR with the annual
Water Use Report and with DNRAppropriation Permit and Water Supply Plan amendments. The water level
information should be stored ina spreadsheet for an indefmite amount of time for easy accessibility. '
2. The City of Centerville is required to update its Water Supply Plan (formerly called an Emergency and
Conservation Plan) and submit it to DNR Waters by October 15,2008. The new plan is changed substantially
from the old plan. Information on the plan may be found on the DNR Website at http://MNDNR.GOV/Waters.
3. Please note that besides Clearwater Creek, DNR Public Water 02~0252W is also located within the drinking
water supply management area (page 2). It appears that well #2 may be located within the floodplain of
Clearwater creek. Should the top of the casing be lower than the regulatory flood protection elevation, then well
#2 should be flood proofed to protect the aquifer from contamination by floodwaters.
4. The sealing of unused wells is important for protecting aquifers (page 6). Centerville should consider using
historic aerial photos to locate places where structures have been removed. Unsealed abandoned wells are often
located at sites where structures were removed decades ago.
5. Centerville mentioned the possibility of storm water polluting the aquifer (Page 7). Centerville should avoid
constructing sediment basins within the inner wellhead management zone. When possible, ditches should be
used to convey storm water instead of storm sewers, so that the water will continue to be cleansed by vegetation
and filtration. The use of low impact development principles as a means of reducing storm water impacts to the
aquifer is also a good idea. .

consider requiring rain sensors on new automatic sprinkling systems, and promoting the use of smart controllers
on those systems that irrigate large areas of lawns.

I have reviewed the remaining part of the wellhead protection plan (Part 2) for the city of Centerville,
received February 18,2008, according to the requirements of Minnesota Rules, part 4720.5555, subparts 1
and 2. The following principles were used as a basis for review:
· Compliance with the rule - the wellhead protection plan must be in compliance with parts 4720.5100
to 4720.5590.
· Sound management of water resources - includes evaluations concerning whether significant up-
or down-gradient effects on groundwater may result from management controls specified in the plan.
Source management options should be based on sound data and technical analysis, and the interactions
between surface water and groundwater are considered. Also, the effects of short- and long-term
variations in precipitation must be evaluated for their impacts on source management.
· Effective health and environmental protection - includes preventing potential water and related
land resource problems which may impact the public wells, identifying anticipated and appropriate
improvements in the quality ofthe environment within the drinking water supply management area,
and promoting public health and safety.
· Efficient management of potential contaminant sources - includes estimating the cost of imple-
menting the wellhead protection plan. Also, the management approach must identify 1) mechanisms
for funding plan implementation, 2) how coordination will be achieved with participating state and
local agencies, 3) approaches that were used to identify source management problems and oppor-
tunities to correct them, and 4) how water conserVation practices will be used to support wellhead
protection goals.
The plan provides an adequate assessment of the city's source waters and contains goals, objectives,
and action strategies for the potential sources covered by the plan. The city ofCenterville is commended
for their efforts in preparing a plan to protect their drinking water supply from contamination. For your
information, enclosed are written comments that were received from the Minnesota Department of Natural
Resources. No written comments were received from the other state agencies.
